WE APPOINTED LAUREN RAYBURN AND NICK HAYES TO FULL TERMS AND THEN WE DID HAVE A DISCUSSION ABOUT SUSPENDING THE RULES FOR OUR IMPENDING BOARD OF EDUCATION APPOINTMENT THAT WILL BE MADE ON APRIL THE 20TH. THANK YOU, THEY CAN.

I AM OUT OF MY ROUTINE HERE. ANYBODY ELSE ON THE COUNCIL HAVE AN ANNOUNCEMENT THEY WOULD LIKE TO MAKE? WE WILL MOVE FORWARD TO AUBURN UNIVERSITY COMMUNICATIONS.

[5. AUBURN UNIVERSITY COMMUNICATIONS.]

>> SPEAKER: I'M EXCITED TO BE HERE IN PERSON.

THANK YOU FOR HAVING ME. FIRST OF ALL AS YOU STATED WE DO HAVE A FULL CABINET NOW SO WE ARE SUPER THRILLED TO START THAT NEW PROCESS WITH REPS. YOU WILL BE AWESOME.

I AM EXTERNAL AFFAIRS SO I WILL BE WORKING WITH YOU ALL AGAIN FOR THE NEXT YEAR. THAT'S EXCITING.

SECONDLY WE HAVE OUR LIFE AND FINANCIAL LITERACY COACH ERIC SMITH COMING TO TALK TO GRADUATING SENIORS TO INCREASE PREPAREDNESS FOR REAL-WORLD SITUATIONS IN TERMS OF FINANCES.

WE ARE REALLY LOOKING FORWARD TO GETTING OUR GRADUATING SENIORS A LITTLE BIT OF FINANCIAL PREPAREDNESS.

NEXT, AUBURN HARBOR COLLEGE OF BUSINESS IS OFFERING A NEW GRADUATE MASTERS DEGREE IN SUPPLY CHAIN MANAGEMENT.

THEY WILL BE REALLY EXCITING AND HOPEFULLY INCREASING ENROLLMENT.

LASTLY -- NEXT ALBERT IS HOSTING THE STATE GLOBAL CLIMATE CHANGE SEMINAR. IT WILL BE A WEBINAR THIS YEAR AND THAT IS TOMORROW. AT 6 PM ONLINE.

WE ARE REALLY HONORED AS A UNIVERSITY TO HAVE THE OPPORTUNITY TO HOST THAT. AS YOU STATED, MAYOR ANDERS, WE HAVE CITY BREAKFAST ON FRIDAY AND BRIGHT AND EARLY AT 7:30 AM.

THRILLED TO INTRODUCE OUR NEW CITY REPRESENTATIVES AND STUFF LIKE THAT TO YOU ALL. THEY WILL BE AT COUNCIL IN TWO WEEKS. THAT'S ALL FOR ME.

>> SPEAKER: THANK YOU FOR YOUR SERVICE.

WE APPRECIATE IT. THIS IS AN OPPORTUNITY NOW FOR

[6. CITIZENS’ COMMUNICATIONS ON AGENDA ITEMS.]

CITIZENS COMMUNICATION ON ITEMS ON OUR AGENDA.

I WOULD ENCOURAGE EVERYBODY THAT WOULD LIKE TO SPEAK.

THESE ARE JUST ITEMS ON OUR AGENDA THAT SHE WOULD LIKE TO SPEAK TO TONIGHT. NONE OF TONIGHT'S AGENDA HAS A PUBLIC HEARING ATTACHED TO IT SO IF YOU WOULD LIKE TO SPEAK TO US NOW WOULD BE THE MOST APPROPRIATE TIME FOR YOU TO MAKE THOSE COMMENTS. MEGAN,.

>> SPEAKER: STAFF IN THE HALLWAY WE DON'T HAVE ANYBODY SIGNED UP? WE DO HAVE SOME PEOPLE IN HERE

[00:10:02]

THAT WOULD LIKE TO SPEAK. I THINK MR. LED NETTLES WOULD LIKE TO SPEAK. WHAT WE ARE TRYING TO DO HERE BECAUSE WE ARE RUNNING IN THE HALLWAY AND THE COURTROOM IS MAKE SURE THAT WE HAVE SOME SIGN-UP SHEETS TO LOCATE PEOPLE AND MAKE SURE THAT THEY HAVE AMPLE TIME TO MAKE THEIR WAY INTO THE COUNCIL CHAMBER. I APOLOGIZE AS WE ARE WORKING THROUGH THIS WORK HE CONTACTED ME TODAY AND SAID HE WOULD LIKE

TO SPEAK. >> SPEAKER: JUST BEFORE YOU COME UP HERE, ANYBODY WOULD LIKE TO SPEAK YOU HAVE FIVE MINUTES TO TALK TO THE COUNCIL. PLEASE GIVE US YOUR NAME AND

ADDRESS FOR THE RECORD. >> SPEAKER: FIRST OFF, IT'S GOOD TO SEE YOU ALL. I'M GLAD TO BE FINALLY HERE IN FRONT OF EVERYBODY. I LIKE THAT A LOT BETTER.

LET'S NETTLES 1899 WEST FARM ROAD.

SPEAKING ON THE MARTIN AVENUE TOWNHOMES.

I WILL BE BRIEF. I JUST WANT TO GET A POINT ACROSS AND LET YOU ALL HAVE IT. ON THAT SITE, WE ARE TRYING TO DO FOUR SIMPLE TOWNHOMES. TEN BEDROOMS. THERE ARE THREE ON THE END, TO IN THE MIDDLE.

THERE ARE TEN TOTAL. A COUPLE OF THE PERMITTED USES FOR THE AREA SOUNDS WEIRD NOW BUT IT IS A KENNEL, A LAUNDROMAT AND SO THOSE ARE SOME STRANGE THINGS THAT ARE PERMITTED.

WE COULD GO THROUGH WITH IT RIGHT NOW.

WE ARE ASKING FOR SINGLE-FAMILY FEE SIMPLE TOWNHOMES.

I KNOW IT WASN'T WELL RECEIVED, PLANNING COMMISSION BUT I WANT TO DO ONE MORE THING OUT THERE. ANOTHER THING ALLOWED IS ADD YOU UNITS WHICH YOU CAN HAVE THE FIVE BEDROOMS. WE COULD DO 25 BEDROOMS WITH THE FRONT IS WE HAVE.

THAT WOULD BE TEN BEDS. TWO, FIVE.

TO ME IT SEEMS BETTER TO PUT IT IN A TOWNHOME BECAUSE IT IS MORE OF A SINGLE-FAMILY THING, FEESIMPLE.

THAT IS PRETTY MUCH WHAT I WANT TO SAY.

PUT IT OUT THERE LIKE THAT. AND JUST SAY THAT ONE WAY OR THE OTHER WE CAN DO ONE THING, I WOULD RATHER DO THE OTHER.

I WOULD LIKE FOR Y'ALL TO TALK ABOUT IT AND SEE YOU THINK.

I THINK THE FEESIMPLE THING IS REALLY TO ME BETTER IN THE LONG RUN. THANK YOU AND GOOD TO SEE YOU

ALL. >> SPEAKER: WE WILL DISCUSS

THIS LATER ON IN THE AGENDA. >> SPEAKER: CAN I ASK A

QUESTION. >> SPEAKER: WE CAN WAIT UNTIL THE AGENDA ITEM. HE WILL REMAIN AVAILABLE.

WE ARE IN THE CITIZENS COMMUNICATION.

AT THE COUNCIL'S PLEASURE. I ALSO WANT TO REMIND YOU AND THANK YOU COUNCILPERSON GRISWOLD THAT YOU CLOSE THE PUBLIC HEARING DURING THE LAST MEETING BEFORE COUNCILMAN PARSONS MOVED TO POSTPONE. SO YOU HAVE THE ABSOLUTE RIGHT AS A COUNSEL, THE MAJORITY OF YOU WOULD LIKE TO REOPEN IT AT THAT TIME YOU CAN BUT WE DID NOT ADVERTISE A PUBLIC HEARING BECAUSE YOU HAVE ALREADY HAD IT. THAT'S AT THE PLEASURE OF THE

COUNCIL. >> SPEAKER: ANYONE ELSE LIKE TO

ADDRESS THE COUNCIL TONIGHT? >> SPEAKER: SCOTT? NO SPEC SEEING NO ONE WE WILL MOVE AHEAD TO CITY MANAGERS

[7. CITY MANAGER’S COMMUNICATIONS.]

COMMUNICATIONS. >> SPEAKER: TO REMIND EVERYONE AS WE DISCUSSED DURING COMMITTEE OF THE WHOLE, ITEM 11 A UNDER OF THE BUSINESS WE ARE ADDING A REQUEST FOR AN ALCOHOLIC BEVERAGE LICENSE FOR RETAIL WINE AND BEER FOR DUMPS LIKE A TRUCK DOING BUSINESS AS THE IRRITABLE BOWEL.

WE WILL GET TO THAT AT THE END OF THE AGENDA.

THAT IS ALL I HAVE UNDER THAT. WHAT I WOULD LIKE TO MOVE

[8. CONSIDERATION OF CONSENT AGENDA.]

FORWARD WITH THE CONSENT AGENDA AS THE FIRST ITEM OF BUSINESS AND THERE IS ANY COUNCIL MEMBER IT WAS TO REMOVE AN ITEM FROM THE CONSENT AGENDA AND DEAL WITH THAT ITEM INDIVIDUALLY?

>> SPEAKER: YES MR. MATTER I WOULD LIKE TO REMOVE ITEM EIGHT C1, AND ALSO 8D. EIGHT DELTA.

>> SPEAKER: ANYONE ELSE? >> SPEAKER: WE WILL TAKE THOSE

IN ORDER. >> SPEAKER: ITEM EIGHT C1 IS A TRAFFIC SIGNAL OPERATION AND MAINTENANCE AGREEMENT WITH THE ALABAMA DEPARTMENT OF TRANSPORTATION FOR A TRAFFIC SIGNAL TO BE LOCATED AT THE INTERSECTION OF ALABAMA HIGHWAY 14 AND THE RICHLAND ROAD CONNECTOR.

THIS IS THE FIRST STEP IN THE PROCESS.

THE SIGNAL MAY ONLY BE INSTALLED IF APPROVED BY THE ALABAMA

DEPARTMENT OF TRANSPORTATION. >> SPEAKER: SECOND SPEC I HAVE A MOTION TO SECOND. ANY DISCUSSION?

MS. GRISWOLD. >> SPEAKER: THANK YOU, MS. RIMER. I HAVE -- I UNDERSTAND THE LIGHT DIDN'T WARREN SOLOMON AND HIGHWAY 14 THE STATE DID NOT

WANT THAT. >> SPEAKER: THAT'S CORRECT.

>> SPEAKER: IF WE PROCEED, THAT IS OVER WITH?

>> SPEAKER: IT IS OVER WITH UNTIL THE TRAFFIC COUNTS THAT EXIST AND WHAT WE CALL A CURRENT CONDITION.

SOLEMN AIR IN AND OF ITSELF IS NOT GENERATING ENOUGH TRAFFIC TO MEET THE WARRANTS WHICH IN ENGLISH FOR THE PUBLIC MEANS IT'S JUST A VOLUME OF TRAFFIC AT CERTAIN TIMES OF THE DAY AND CERTAIN TURN MOVEMENTS. IS NOT ENOUGH VOLUME FROM THAT SUBDIVISION BY ITSELF TO MEET A STATE OF ALABAMA WARRANT FOR A TRAFFIC SIGNAL ON HIGHWAY 14. THE TRAFFIC STUDY SUBMITTED FOR

[00:15:02]

THAT INDICATED FUTURE TRAFFIC FROM AN ADJACENT DEVELOPMENT THAT IS PROPOSED AND STILL DOES NOT HAVE A DEVELOPMENT AGREEMENT THAT HAS GONE BEFORE THE COUNCIL CALLED PLAINSMAN LAKE.

CITY STAFF IS IN THE PROCESS OF GETTING TOGETHER WITH THE PLAINSMAN BLAKE DEVELOPERS TO DISCUSS WHAT THIS MEANS IN TERMS OF HOW MUCH THEY COULD BUILD BY CONNECTING TO SOLEMN AIR VERSUS ANOTHER WAY OUT OF THE SUBDIVISION.

AS THIS INFORMATION JUST CAME DOWN EARLY THIS WEEK, THE CITY ENGINEER AT FRASER WE HAVE HAD THAT MEETING YET.

WE HAVE NOT BEEN ABLE TO HAVE THAT.

I NEED TO BE CLEAR THAT THIS SIGNAL IS NOT RELATED TO THE SOLEMN YOUR SIGNAL IN TERMS OF WHEN THE TRAFFIC DOES WARRANT, ALDOT HAS MADE IT VERY CLEAR THAT THEY ARE WILLING TO REVISIT A SIGNAL AT SOLEMN YOUR LANE BUT AT THIS TIME BECAUSE THE TRAFFIC IS IN THERE THEY WILL NOT APPROVE ONE PREEMPTIVELY FOR FUTURE TRAFFIC THAT IS NOT CURRENTLY DRIVING ON THE ROAD.

>> SPEAKER: TO WE HAVE TO GET THE WANTING PROCESS WHEN THERE

IS ON THE AGENDA FOR TONIGHT? >> SPEAKER: ABSOLUTELY WE DO.

THERE ARE CONCERNS AND THE CITY ENGENDER -- WE HAVE HAD A CONVERSATION ABOUT THIS WITHOUT THE TRAFFIC BEING THERE TODAY WE ARE GOING TO HAVE SIMILAR ISSUES.

SHE IS VEHEMENTLY HAVING VERY PROFESSIONAL AND STRONGLY WORDED DISCUSSIONS WITH OUR FRIENDS AT ALDOT.

WE WILL TALK ABOUT THE FACT THAT THERE ARE TWO ELEMENTARY SCHOOLS THAT WE WILL DO EVERYTHING WE CAN TO GET THIS WARRANTED AND THIS WILL BE SOMETHING THAT WILL LIKELY INVOLVE OUR STATE REP INCENTIVES IF ALDOT TURNED US DOWN.

THIS IS ONE THAT WE FEEL VERY STRONGLY WHEN WE ARE BUILDING THIS MAJOR CONNECTING ROAD. IT IS AN $8 MILLION PROJECT FOR THE CITY. WE ARE OUT TO BID IN THE LATE SUMMER, EARLY FALL AND WE NEED TO GET THAT ROAD BUILT AND CONNECTED. THIS IS ONE OF THE CITY IS GOING TO BE VERY RESPECTFUL ABOUT. THERE ARE A GREAT PARTNER OF OURS BUT WE ALSO GOING TO PUSH THE ENVELOPE IS TO GET TURNED

DOWN. >> SPEAKER: THANK YOU.

>> SPEAKER: CAN WE BE INTERESTED IF WE GET TURNED DOWN AS YOU PROGRESS WITH THE CONNECTOR?

>> SPEAKER: READDRESS THE CONNECTOR?

>> SPEAKER: IF IT'S TURNED DOWN BECAUSE YOU DON'T HAVE THE

CONNECTOR UP? >> SPEAKER: WE WILL PUSH THIS UNTIL WE CAN'T PUSH IT ANYMORE. CITY ENGINEER IS ALREADY WORKING ON THAT. ALDOT IS AWARE.

I THINK THE OTHER IMPORTANT THING TO BRING OUT BECAUSE SOME OF YOUR FAT QUESTIONS, WE HAVE ALREADY LOOKED AT THE SPACING BETWEEN THE PROPOSED SOLEMN AIR CONNECTOR, THE WEBSTER ROAD.

I WILL REMIND EVERYONE, RICHLAND CONNECTOR IS IN YOUR PACKET FOR THIS AGENDA ITEM WILL NOT ALIGN WITH WEBSTER ROAD.

THE REASON IT DOES NOT ALIGN IS THE RIGHT OF WAY THAT IS NEEDED IS IN THE COUNTY AND THE CITY HAS NO AUTHORITY TO REQUIRE RIGHT-OF-WAY ON PROPERTY IN THE COUNTY.

IS A LOT OF CASELAW ABOUT IT AND WE HAVE NO EMINENT DOMAIN POWERS IN THE COUNTY FOR THE LAWS OF THE STATE OF ALABAMA.

THEREFORE, WE CANNOT BUILD A ROAD THROUGH PROPERTY THAT IS NOT IN THE CITY LIMITS, NOR DOES IT WANT TO COME IN THE CITY LIMITS. THE PROPERTY OWNER HAS BEEN MORE THAN WILLING TO MEET WITH US BUT HAS INDICATED THEY HAVE NO INTEREST IN THAT. THAT IS WHY WE HAVE HAD TO PURSUE THIS CONNECTOR OFFSET WHICH WAS NOT OUR PREFERENCE BUT WE MUST -- AND YOU HAVE BEEN CLEAR IN YOUR BUDGETING PROCESS, DELIVER THIS ROAD SOONER RATHER THAN LATER SO THAT IS THE CHOICE

WE HAD TO MAKE. >> SPEAKER: HOW WOULD THIS TRAFFIC SIGNAL AFFECT THE OTHER ROADS COMING OFF OF HIGHWAY 14?

THERE ARE OTHER ROADS. >> SPEAKER: THIS PARTICULAR TRAFFIC SIGNAL DOESN'T ALIGN WITH ANY OTHER INTERSECTION.

IT WILL MAKE A T INTO HIGHWAY 14 SO IT WILL -- IT HAS NO DIRECT IMPACT ON ANY OTHER ROADS OTHER THAN PEOPLE COMING AND GOING FROM WEBSTER AND OTHER THINGS WILL BE HELD UP BY THE SIGNAL AS IT GOES. OUR ORIGINAL PLAN WAS TO FIX THE WEBSTER CROSSING IS NOT AN IDEAL SITUATION IN TERMS OF THE WE DON'T HAVE A STACKING OR WE CAN'T STACK A NUMBER OF VEHICLES. THERE HAVE BEEN SOME ISSUES THERE. WE USED TO HAVE IT ALSO A BAD GRADE. WE GOT IT SHAVED DOWN.

SEMI TRUCKS YOU TO GET STUCK ON THAT RAILROAD CROSSING.

CHIEF DAWSON HAS WORKED A LOT OF THOSE.

WE HAVE TRIED EVERYTHING. WE DON'T CONTROL THE RAILROAD CROSSING DIRECTLY FOR THE CITY IS NO AUTHORITY OVER THAT NOR THE INTERSECTION AT HIGHWAY 14. WE ARE DOING EVERYTHING WE CAN

TO MAKE IT SAFER. >> SPEAKER: SO FOR ALL PRACTICAL PURPOSES WHAT ACTION ARE WE TAKING TONIGHT?

>> SPEAKER: THIS IS SHOULD ALDOT APPROVE A TRAFFIC SIGNAL THEY ARE? WE ARE AGREEING TO ASSAULT -- INSTALL AND MAINTAIN IT. THAT'S BASICALLY WHAT YOU ARE AGREEING TO. AS ALDOT SEES THINGS, THEY NEED ALL OF THIS DOCUMENTATION TO BE SURE THE GOVERNING BODY AGREES WITH THE STAFF BEFORE THEY WILL MOVE FORWARD AND REVIEW THE

DOCUMENTS. >> SPEAKER: ANY OTHER QUESTIONS OR COMMENTS FROM THE COUNCIL? WE HAVE A MOTION.

ALL IN FAVOR SAY AYE. >> SPEAKER: AYE.

>> SPEAKER: ANY OPPOSED? >> SPEAKER: THAT MOTION

CARRIES. >> SPEAKER: ITEM EIGHT DR BOARD APPOINTMENT FOR THE HISTORIC PRESERVATION COMMITTEE FOR TWO POSITIONS, TERMS BEGIN APRIL 21, 2021, AND APRIL 20, 2024.

THE NOMINEES ARE NICK HAYES AND LAURA RAYBURN.

>> SPEAKER: MOVE FOR APPROVAL. >> SPEAKER: SECOND.

>> SPEAKER: A MOTION AT A SECOND.

COMMENTS OR QUESTIONS? ME TO GRISWOLD.

>> SPEAKER: THANK YOU. I WOULD LIKE TO VOTE FOR THE

[00:20:01]

REST OF THE CONSENT AGENDA BUT I CAN'T VOTE FOR THIS PARTICULAR ITEM BECAUSE I DON'T CONSIDER THE APPLICANT AS BEING QUALIFIED AS THE PREREQUISITES FOR THE HISTORIC PRESERVATION COMMISSION

>> SPEAKER: ANY OTHER COMMENTS OR QUESTIONS?

>> SPEAKER: WOULD YOU LIKE TO CLARIFY WHICH APPLICANT YOU ARE DISCUSSING? THERE ARE TWO.

>> SPEAKER: MR. HAYES. >> SPEAKER: THANK YOU.

>> SPEAKER: ANY OTHER COMMENTS OR QUESTIONS? SEEING AND HEARING NONE, ALL IN FAVOR PLEASE THAT SAY I.

>> SPEAKER: AYE. >> SPEAKER: ANY OPPOSED?

>> SPEAKER: NE. >> SPEAKER: TWO OPPOSITIONS.

MOTION CARRIES. >> SPEAKER: MAYOR AS WE GO INTO

ORDINANCES -- >> SPEAKER: WE NEED TO APPROVE.

>> SPEAKER: SORRY. I'M AHEAD OF YOU.

>> SPEAKER: TO HAVE A MOVE TO APPROVE THE BALANCE OF THE

CONSENT AGENDA? >> SPEAKER: SO MOVED.

>> SPEAKER: ALL IN FAVOR SAY AYE.

>> SPEAKER: AYE. >> SPEAKER: ANY OPPOSED.

THE CONSENT AGENDA IS APPROVED. LET'S MOVE HAD TO ORDINANCES.

[9. ORDINANCES.]

>> SPEAKER: AS WE MOVE INTO ORDINANCES I WILL REMIND THE COUNCIL WE ARE BACK TO THE PROCEDURE THAT YOU WERE ON AT YOUR LAST MEETING WHERE YOU INTRODUCE AND AS FOR UNANIMOUS CONSENT. THERE WILL BE A SECOND BUT WE ARE NOT DOING ROLL CALL VOTE TWICE AND WE WILL JUST FOLLOW THE MERIT. UNDER ORDINANCES THIS EVENING ITEM NINE A1 AUTHORIZES THE INSTALLATION OF FIVE STOP SIGNS AND 125-MILE PER HOUR SIGN IN BRIDGEWATER SUBDIVISION PHASE ONE. UNANIMOUS CONSENT IS NECESSARY.

>> SPEAKER: I WILL INTRODUCE THE ORDINANCE AND ASKED FOR

UNANIMOUS CONSENT. >> SPEAKER: SECOND.

>> SPEAKER: ANYONE ON THE COUNT HAVE A PROBLEM MOVING FORWARD WITH THE VOTE ON THIS THIS EVENING? SEEING OR HEARING NONE ANY DISCUSSION?

LINDSAY, ROLL CALL. >> SPEAKER: DIXON.

>> SPEAKER: HOVEY. >> SPEAKER: SMITH.

>> SPEAKER: TAYLOR. >> SPEAKER: WITTEN.

>> SPEAKER: ANDERS. >> SPEAKER: AUTUMN -- ITEM NINE A TO PICK ONE STOP SIGN A LONGLEAF CROSSING PHASE BE.

UNANIMOUS CONSENT IS NECESSARY. >> SPEAKER: I WILL INTRODUCE THE ORDINANCE AND ASKED FOR UNANIMOUS CONSENT.

>> SPEAKER: SECONDS THAT I HAVE A MOTION TO SECOND.

ANYONE ON THE COUNCIL HAVING A PROBLEM MOVING FORWARD WITH THIS THIS EVENING? SEEING AND HEARING NONE ANY DISCUSSION? LINDSAY ROLL CALL.

>> SPEAKER: DIXON? >> SPEAKER: AYE.

>> SPEAKER: GRISWOLD? >> SPEAKER: AYE.

>> SPEAKER: PARSONS? >> SPEAKER: AYE.

>> SPEAKER: SMITH? >> SPEAKER: AYE.

>> SPEAKER: TAYLOR? >> SPEAKER: AYE.

>> SPEAKER: WITTEN? >> SPEAKER: AYE.

>> SPEAKER: DAWSON? >> SPEAKER: AYE.

>> SPEAKER: ANDERS? >> SPEAKER: AYE.

>> SPEAKER: >> SPEAKER: ITEM 90 IS A CONSENT TO LEASE AGREEMENT BETWEEN THE WATER WORKS BOARD OF THE CITY OF AUBURN AND BRASFIELD & GORRIE LLC FOR COULD GRANT A TEMPORARY CONSTRUCTION LAY DOWN AND TRAILER LOT NEXT TO THE BAILEY-ALEXANDER COMPLEX. THIS IS NECESSARY FOR CONSTRUCTION ON AN ADJACENT BUILDING THAT IS AN ECONOMIC DEVELOPMENT RELATED PROJECT. UNANIMOUS CONSENT IS NECESSARY.

>> SPEAKER: I WILL INTRODUCE THE ORDINANCE AND ASK FOR

UNANIMOUS CONSENT. >> SPEAKER: SECOND.

>> SPEAKER: MOTION SECOND ANYONE ON THE COUNCIL HAVE A PROBLEM MOVING FORWARD THE VOTE ON THIS? SEEING ANY DISCUSSION OR QUESTIONS?

SEEING AND HEARING NONE LINDSAY? >> SPEAKER: GRISWOLD?

>> SPEAKER: AYE. >> SPEAKER: MOVIE?

>> SPEAKER: AYE. >> SPEAKER: PARSONS?

>> SPEAKER: AYE. >> SPEAKER: SMITH?

>> SPEAKER: AYE. >> SPEAKER: TAYLOR?

>> SPEAKER: AYE. >> SPEAKER: WITTEN?

>> SPEAKER: AYE. >> SPEAKER: DAWSON?

>> SPEAKER: AYE. >> SPEAKER: DIXON?

>> SPEAKER: AYE. >> SPEAKER: ANDERS?

>> SPEAKER: AYE. >> SPEAKER: UNDER RESOLUTIONS

[10. RESOLUTIONS.]

THIS EVENING I APOLOGIZE FOR THE AGENDA ITEM SAYS TEN A 100 AGENDA SAYS TEN WON. THAT EQUALS THE SAME THING FOR THE RECORD. IT IS A REQUEST FROM ANDREW PARMER ON BEHALF OF MIKE AND FRANCES THROWER FOR A CONDITIONAL USE APPROVAL FOR A PERFORMANCE RESIDENTIAL SUBDIVISION THAT INCLUDES FOR TOWNHOME LOSS TO BE LOCATED AT 456 MARTIN HAVE A IN THE REDEVELOPMENT DISTRICT ZONING DISTRICT. THE PLANNING COMMISSION RECOMMENDED DENIAL OF THIS REQUEST BY A VOTE OF FIVE TO THREE AT ITS MARCH 11, 2020, WHEN MEETING.

THE CITY COUNCIL HELD A PUBLIC HEARING AND POSTPONE THIS ITEM AT THE MARCH 16, 2021, MEETING. IT REALLY HELPS YOU UNDERSTAND THAT THIS ITEM THAT WAS ALREADY MOVED AND SECONDED SO THE BUSINESS IS ON THE TABLE. WHEN YOU POSTPONE PER ROBERT'S RULES OF ORDER IF YOU POSTPONE AFTER A MOTION HAS BEEN MADE YOU ARE READY TO TAKE UP THE BUSINESS AS IS.

AGAIN IT IS YOUR DISCRETION IF YOU CHOOSE TO OPEN A PUBLIC

HEARING. >> SPEAKER: NO MOTION IS

NEEDED. >> SPEAKER: NO MOTION IS NEEDED. ALREADY MOVED AN SECONDS OF THE BUSINESSES ON THE TABLE FOR DISCUSSION AND THE VOTE.

>> SPEAKER: THANK YOU, MEGAN. WE WILL OPEN IS FOR DISCUSSION.

ANYONE ON THE COUNCIL HAVE ANY COMMENTS OR QUESTIONS?

>> SPEAKER: I DO. I FORGOT THE GENTLEMAN'S NAME.

>> SPEAKER: WOULD YOU LIKE TO ASK HIM A QUESTION.

MR. NETTLES. >> SPEAKER: I DON'T KNOW WHAT THE QUESTION -- IF THE QUESTION IS FOR HIM OR NOT.

IT MAY BE FOR THE COUNCIL. IF THIS IS DENIED, AND THE

[00:25:01]

TOWNHOMES IS WHAT I'M SAYING. AND Y'ALL HAVE TO DO THE ADD YOU. WHAT IT HAVE TO GO BACK THROUGH

THE PLANNING? >> SPEAKER: NO, MA'AM, IT IN THE REDEVELOPMENT DISTRICT, ACADEMIC DETACHED DWELLING ARE CONDITIONAL OF CRUISE. THEY WOULD NEED TO SUBDIVIDE BUT UNLESS THEY HAVE ANY EASEMENTS OR OTHER THINGS YOU WOULD NOT SEE THIS AGAIN AND NEITHER WOULD PLANNING COMMISSION.

THOSE ARE ADMINISTRATIVE FUNCTIONS AND PERMITTED BY SUBDIVISION REGULATIONS AND SORTING ORDINANCES AS IS.

IT IS THE SAME NUMBER OF BEDROOMS. IT IS FIVE BEDROOMS PER ADD YOU AND THERE IS A TOTAL.

THAT WOULD BE TEN TOTAL BEDROOMS ON THE PROPERTY, .46 ACRES.

WHAT'S BEEN PROPOSED TO ME TOWNHOMES ARE THREE BEDROOMS ON THE END UNITS EACH, SO THAT'S SIX BEDROOMS, AND TWO BEDROOMS EACH FOR THE MIDDLE UNITS, FOUR BEDROOM SO A TOTAL OF TEN

BEDROOMS ON THE SAME PARCEL. >> SPEAKER: THAT WAS MY

QUESTION. >> SPEAKER: ARE YOU GOOD,

CONNIE? >> SPEAKER: MR. MAYOR, IF I MAY. THE REASON THAT I ASKED FOR POSTPONEMENT AT THE TIME THAT WE FIRST CAME BEFORE US, WAS THE FACT THAT THE AGENDA OF COUNCIL COUNSEL RAN US VERY LATE AND I WAS CONCERNED THAT THE PUBLIC HEARING, THE PUBLIC WHO SPOKE AT THE PLANNING COMMISSION'S DELIBERATION ON THIS MATTER, THERE WERE A COUPLE OF PEOPLE WHO SPOKE AND THEY WANTED TO MAKE SURE THAT THEY HAD THE OPPORTUNITY TO SHARE THEIR OPINIONS WITH US AND IF YOU ARE AMENABLE TO IT THAT WE COULD POSSIBLY SEE IF THERE IS SOMEBODY IN THE PUBLIC HERE TONIGHT WHO MAY LIKE TO VOICE THEIR OPINIONS ON THIS.

>> SPEAKER: I'M NOT SURE IF THERE IS ANYBODY HERE TONIGHT THAT WAS MAYBE PART OF THE NEIGHBORHOOD OR MARTIN NEVER THAT WANTED TO SPEAK. WANTED TO COMMUNICATE CLEARLY EARLIER THAT THE TIME FOR THOSE KINDS OF COMMENTS WAS EARLIER IN THE AGENDA. IF I WASN'T CLEAR AND YOU WOULD LIKE TO SPEAK, I ASK THE COUNCIL WOULD THEY CONSIDER REOPENING

THE PUBLIC HEARING. >> SPEAKER: MAYOR, GIVE US A MINUTE AND WE WILL MAKE SURE DOWN IN THE COURTROOM SCOTT SAYING WE DON'T HAVE ANYBODY. WE ARE OKAY.

EVERYBODY'S IN THIS ROOM THAT COULD BE SPEAKING.

>> SPEAKER: THANK YOU, MISTER MAYOR.

I APPRECIATE IT. >> SPEAKER: ANY OTHER COMMENTS

OR QUESTIONS FROM THE COUNCIL,. >> SPEAKER: I HAVE A QUESTION.

IS THIS BASICALLY THE SAME THING THAT YOU ALREADY BUILT ON

SANDERS? >> SPEAKER: SIMILAR TO THAT.

>> SPEAKER: SIMILAR FOOTPRINT. JUST REACH WEEK.

>> SPEAKER: THAT HAS BEEN ALMOST EXCLUSIVELY STUDENT HOUSING. THIS IS BEING DESIGNED FOR

MARKET RATE HOUSING. >> SPEAKER: HE SAID HE WANTS TO SELL SOME, MAYBE KEEP SOME IS WHAT HE SAID.

HE SAID HE'S GOT A MARKET OF KEEPING AND SELLING SOME.

HE IS TRYING KEEP A MIX OF THINGS IN THE REPERTOIRE.

>> SPEAKER: THANK YOU. >> SPEAKER: I DO WANT TO NOTE, I THINK THIS IS HELPFUL THAT OUR NEIGHBORHOOD SPECIALISTS HAVE REACHED OUT TO THE TWO PEOPLE THAT SPOKE AT PLANNING COMMISSION AND THEN E-MAIL THEM INFORMATION ABOUT THE ITEM AND ABOUT THE MEETING TONIGHT TO BE SURE THAT THEY WERE CONTACTED.

>> SPEAKER: WAS THERE ANY RESPONSE FROM THEM?

>> SPEAKER: I DON'T BELIEVE SO. >> SPEAKER: THANK YOU, MAKE MEGAN. THAT'S GOOD TO HEAR.

ANY OTHER QUESTIONS OR COMMENTS. ANYTHING?

>> SPEAKER: I HAVE A QUESTION. JUST THE LAYOUT, THE DESIGN.

I MENTIONED THIS IN THE LAST MEETING.

THE PARKING IS SHOWING IN THE FRONT.

WAS THERE ANY CONSIDERATION OF PUTTING THE ABILITY TO PARK IN THE REAR? THAT NEIGHBORHOOD, IT'S WEIRD BECAUSE IT SHIFTS FROM A LOT OF MULTIUNIT DEVELOPMENT, ADD YOU TYPE, ON MARTIN BUT CLOSER TO ROSS.

AND THEN WHEN YOU CROSS OVER SPRING, THAT ONE LITTLE SECTION BETWEEN SPRING AND PIT IS ALL SINGLE-FAMILY HOMES.

THIS IS REALLY, EVEN THOUGH IT IS ZONED FOR ADD YOU AND ZONED, THIS IS CONDITIONAL USE AND THE OTHER ITEMS YOU MENTIONED, IT'S STILL KIND OF SLIGHTLY OUT OF CHARACTER JUST FOR THAT ONE.

WE ARE TALKING ABOUT MAYBE NOT EVEN A DOZEN LOTS.

IT JUST SEEMS THAT THERE'S A WAY TO KEEP IT IN KEEPING WITH THE REST OF THE NEIGHBORHOOD AS OPPOSED TO MAKING IT A PARKING LOT IN THE FRONT. WAS THERE ANY CONSIDERATION ON

THAT? >> SPEAKER: TO ANSWER THAT, BASICALLY THE WIDTH OF THE LOT THAT I HAD TO WORK WITH, I WENT WITH THE TWO MINIMUM LOTS TO GET THAT DOWN AS MUCH AS WE COULD.

WE DIDN'T HAVE A GRACIOUS PLENTY OF WITH TO WORK WITH TO WORK OUT ON THAT. WE COULD PUT IT DOWN THE LOT LINE. I'M TRYING TO REMEMBER HOW MUCH

[00:30:02]

ROOM I HAD DOWN THAT SIDE LOT LINE.

IT WOULD BE PRETTY TIGHT. YOU WOULD HAVE TO PUSH THEM UP TO THE FRONT. PROBABLY WHAT I WAS GOING TO DO WAS TO SOME KIND OF DETENTION OR SOMETHING.

IT SLOPES TO THE BACK. I WAS GOING TO TRY TO MAKE THAT A GRASSY OR AREA. HIS PERSONAL PLAN, HE LIKES TO HAVE THE GRASSY AREAS IN THE BLACK -- IN THE BACK FOR THEM TO ENJOY THE BACKYARD MORE. THAT'S HIS PERSONAL PREFERENCE.

WITH THOSE THINGS IN MIND, THAT'S KIND OF THE ROUTE WE WENT WITH IT AND LESS, IT SLOPES TO THE BACK.

OF A SLOPE TO THE BACK YOU HAVE A LOT OF PAYMENT BACK THERE IN THAT PAVEMENT IS GOING TO WASH OFF PRETTY QUICK FOR THE PROPERTY LINE WORK THAT'S JUST THE WAY WE WENT WITH IT.

>> SPEAKER: WOULD THAT BE ALL ASPHALT IN THE FRONT OR A

DIFFERENT MATERIAL? >> SPEAKER: IT DEPENDS ON WHAT KIND OF ISR NUMBERS YOU HAVE ON THAT.

IT COULD BE VIEWED PROBABLY A CONCRETE OR SOMETHING.

OR IF THE ISR NUMBERS ARE TOO HIGH HE WILL HAVE TO DO A PREVIOUS PAPER OR SOMETHING. SOMETHING LIKE THAT.

IT WILL BE BASED ON THE ISR NUMBERS.

>> SPEAKER: OKAY. JUST FOR YOUR INFORMATION, I DON'T LOVE THIS. IT IS IN MY WARD.

I DON'T LIKE THE OTHER OPTIONS EITHER.

THE LESSER OF ALL OF THE OPTIONS.

I WON'T SAY EVIL BECAUSE HOUSING IS NOT EVIL.

IT'S JUST THAT LITTLE SECTION. AS A DEVELOPER I WISH Y'ALL WOULD RECONSIDER KIND OF THE INTENSITY OF THAT LOT.

AGAIN, IT'S THE LESSER OF THE OPTIONS THAT I THINK ARE PERMITTED AND AVAILABLE AND I WOULD RATHER SEE FEESIMPLE LOTS THAN WHAT THE OPTIONS ARE. THANK YOU.

>> SPEAKER: ANY QUESTIONS OR COMMENTS? ANYTHING FOR THE APPLICANT OR ANYTHING AT ALL FOR THE COUNSEL? THANK YOU, MR. NETTLES. SO WE HAVE A MOTION AT THE SECOND. ALL IN FAVORABLY SAY I.

>> SPEAKER: AYE. >> SPEAKER: ANY OPPOSED?

MOTION CARRIES. >> SPEAKER: MAYOR, IT IS

[11. OTHER BUSINESS.]

RESOLUTION SO UNDER OTHER ITEMS OF BUSINESS WE HAVE ITEM 11 A IS A REQUEST FROM DUMP LIKE A TRUCK LLC DOING BUSINESS AS THE IRRITABLE BOWEL FOR A RETAIL BEER AND RETAIL TABLE WIDE ALCOHOLIC BEVERAGE LICENSE. ON PROPERTY LOCATED AT 127 EAST

MAGNOLIA AVENUE. >> SPEAKER: MOVE FOR APPROVAL.

>> SPEAKER: SECOND. >> SPEAKER: WE HAVE A MOTION AND SECOND. ANY QUESTIONS OR COMMENTS?

ALL IN FAVORABLY SAY I. >> SPEAKER: AYE.

>> SPEAKER: ANY OPPOSED? THE MOTION CARRIES.

>> SPEAKER: MAYOR, THOSE ARE ALL THE ITEMS WE HAVE ON THE

AGENDA THIS EVENING. >> SPEAKER: AT THIS TIME WE

[12. CITIZENS’ OPEN FORUM.]

WILL OPEN THE OPPORTUNITY UP FOR CITIZENS OPEN FORM.

IF YOU WOULD LIKE TO SPEAK TO THE CITY COUNCIL PLEASE COME FORWARD AND GIVE YOUR NAME AND ADDRESS FOR THE RECORD AND REMEMBER THAT YOU HAVE THREE MINUTES.

MAKE SURE THAT YOUR COMMENTS ARE DIRECTED TOWARDS THE CITY COUNCIL AND NOT TOWARDS ANY OF THE STAFF MEMBERS AND IF THERE IS ANYTHING WE NEED TO DO AS FAR AS FOLLOWING UP OR FOLLOWING UP WITH QUESTIONS, WE WILL DIRECT THAT FROM HERE.

>> SPEAKER: MAYOR, IF I MAY, YOU HAD TALKED ABOUT CITIZENS COMMUNICATIONS AND KIND OF EXPLAINING ATTACHED ON EVERY AGENDA IN THE LOBBY IS THE CITIZENS COMMUNICATIONS PROCEDURE. IF EVERYBODY PICKS ONE UP THEY

HAVE THAT INFORMATION. >> SPEAKER: ANY OF OUR VISITORS HERE TONIGHT THAT SHE BEEN ATTACHED OUT THERE.

WOULD ANYBODY LIKE TO ADDRESS THE COUNSEL?

THERE IS NO SIGN-UP SHEET. >> SPEAKER: WE DO HAVE A

SIGN-UP SHEET. >> SPEAKER: NOBODY.

>> SPEAKER: MR. COSGROVE? >> SPEAKER: AT YOUR PLEASURE.

>> SPEAKER: I WILL LOOSEN UP. NUMBER ONE, I THINK IT'S REALLY NEAT TO BE ABLE TO BE IN THIS NEW ENVIRONMENT HERE.

IT'S REALLY SPECIAL. THIS IS A REFLECTION OF YOUR HARD AND COLLECTIVE WORK AND A LOT OF FRIENDS.

I REALLY AM IMPRESSED. I KEEP PESTERING WHATEVER I SEE ONE OF THE POLICEMAN I PESTERED THEM ABOUT WHEN I COME AND SEE THE FIRE ENGINES. TO SEE HOW THE DOORS OPEN UP AND ALL THAT. I JUST WANTED TO TELL EACH OF THE NINE OF YOU THANK YOU FOR YOUR LEADERSHIP TO THE CITY OF AUBURN. I KNOW SOME OF YOU BETTER THAN OTHERS, TOMMY, ALWAYS GOING TO BE CHIEF TOMMY TO ME.

I HOPE YOUR SWEET MOTHER PATSY IS DOING WELL.

>> SPEAKER: SHE IS. THANK YOU.

>> SPEAKER: AND RON, I HOPE YOUR MOTHER-IN-LAW'S DOING WELL.

AND BETH, YOU DO A GREAT JOB OF BEING OUR COMMISSIONER.

>> SPEAKER: THANK YOU. >> SPEAKER: OUT THERE IN OUR ASHTON CONCLAVE. I REALLY APPRECIATE THAT YOU MAKE YOURSELF VERY ACCESSIBLE AND VERY RESPONSIVE AND I REALLY, REALLY APPRECIATE THAT. EACH OF YOU, THE WAY I SEE IT, EACH OF YOU IS ATTACHED TO A PARTICULAR WORD AND SO FORTH AND

[00:35:06]

YOU ARE SPEAKING TO AND COGNIZANT OF WHAT'S GOING ON IN THAT WARD. BUT COLLECTIVELY IT TO THE BENEFIT OF THE CITY OF AUBURN. IT'S REALLY GREAT.

I FIRST CAME HERE IN FEBRUARY 1975, SO I HAVE SEEN -- COLLEGE ST. WAS TWO LANES. EXCEPT FOR AN EIGHT YEAR HIATUS IN ALASKA AND WE CAME BACK IN 88, I HAVE BEEN REALLY IN TOUCH WITH WHAT'S GOING ON HERE WITH THE CITY OF AUBURN AND THIS AREA. IT'S ALWAYS A REFLECTION OF THE COMMITMENT AND TIME THAT OUR COMMUNITY LEADERS DEDICATE I REALLY APPRECIATE THAT. I DO HAVE -- I MENTIONED.

>> SPEAKER: YOU HAVE A MINUTE. >> SPEAKER: I BROUGHT THIS UP BEFORE AND I HAVE A REAL PASSION FOR THE PART.

I HAVE COACHED KIDS. I'M KNOWN AS COACH STEVE.

I'VE COACHED KIDS SINCE I WAS 1. I'VE SPENT THOUSANDS OF HOURS.

I WOULD LIKE TO OFFER TO GENERATE A DRAFT OF A PLAQUE THAT COULD GO TO COMMEMORATE THE HALLOWED GROUNDS OF FELTON LITTLE PART. I WOULD BE GLAD TO TAKE THE LEAD ON THAT. I'M NOT ASKING FOR ANYTHING BUT I WOULD PROMISE THAT I WOULD TOUCH BASE WITH EVERY CORNER OF THE COMMUNITY AND HISTORICALLY AND WHAT ALL WENT ON AND WHAT ALL HAS GONE ON. I WOULD LIKE TO THROW THAT OUT THERE TO EACH OF YOU. I THINK THAT WOULD BE REALLY NEED TO HAVE ONE OF THOSE BIG STONES WITH A NICE PLAQUE THAT CREATES A PERMANENT REFLECTION, POSITIVE REFLECTION OF THE IMPORTANCE OF THAT PARTICULAR GROUNDS IN THIS COMMUNITY.

>> SPEAKER: MR. COSGROVE, THANK YOU.

I DON'T THINK YOU TOLD US YOUR FULL NAME AND ADDRESS.

JUST FOR THE RECORD. >> SPEAKER: STEVE COSGROVE, 1927 WATERCRESS DRIVE, ASHTON PARK AT NORTHLAKE'S.

>> SPEAKER: I WILL FOLLOW UP WITH YOU ON YOUR SIGN IDEA.

>> SPEAKER: THANK YOU. >> SPEAKER: WHO WILL BE NEXT?

>> SPEAKER: MAYOR ANDERS, LADIES AND GENTLEMEN OF THE COUNSEL, FOR 12 OPELIKA RD. ROAD, APARTMENT 111.

SINCE I CAN'T LAST CAME BEFORE YOU AT THE OTHER BUILDING, I TURNED 60 YEARS OLD AND I HAVE GOTTEN COVID-19 VACCINE.

JUST FOR THE RECORD. I ALSO HAVE BEEN MORE ACTIVELY INVOLVED IN LEE COUNTY NAACP BRANCH NUMBER 5038.

YOU MAY HAVE READ ABOUT IT. ONE OF THE MAIN CONCERNS IS CONCERNING THE APPOINTMENT OR REAPPOINTMENT OF ACTOR JENKINS TO THE SCHOOL BOARD. THERE HAS BEEN SOME CONCERNS RAISED BY THE EDUCATION COMMISSION, WHICH I AM A MEMBER OF CONCERNING THE WHOLE PROCESS PARTICULARLY INVOLVING THE INTERVIEWING OF HIM AND THE OTHER CANDIDATES.

I AS A CITIZEN AND AS A MEMBER OF THAT COMMITTEE WOULD SUGGEST THAT YOU WOULD MAKE SURE YOU INTERVIEW ALL THE CANDIDATES.

I WOULD REINTERVIEW DR. JENKINS ANYWAY BECAUSE IN THE LAST MONTH, THE NEW ELEMENTARY SCHOOL HAS BEEN APPROVED, THERE ARE CONCERNS ABOUT DRAKE MIDDLE SCHOOL.

WE HAVE RECEIVED INFORMATION JUST AT THE LAST EDUCATION COMMITTEE MEETING CONCERNING THE TEST SCORES AND CONCERNING HOW SOME OF THE STUDENTS ARE PERFORMING AT SOME OF THE SCHOOLS. PARTICULARLY IN THE MINORITY STUDENTS AND STUDENTS OF COLOR. WE ARE VERY CONCERNED ABOUT THAT. AND THE ISSUE WAS RAISED EVEN CONCERNING THE END SUSPENSION PROGRAM.

ONE OF THESE TEACHERS IN THE IN SUSPENSION PROGRAM SPOKE BEFORE THE EDUCATION COMMITTEE VIRTUALLY AT OUR LAST MEETING LAST WEEK. I WOULD HOPE THAT YOU WOULD INTERVIEW ALL THE CANDIDATES, ALL OF THE APPLICANTS, AND DR. JENKINS ON THESE ISSUES. BECAUSE I THINK EVERYONE OF YOU AND EVERY ONE OF US NEED TO KNOW HOW THEY ARE PLANNING TO ADDRESS IT. FOR EXAMPLE, IS THE ELEMENTARY SCHOOL GOING TO GET THE PRIORITY AND WHAT ABOUT DRAKE MIDDLE SCHOOL? IS A GOING TO BE PUT TO THE SIDE IS THERE GOING TO BE THE WHO WHAT WHEN WHERE AND HOW.

I'M SURE THERE ARE OTHER ISSUES THAT YOU MAY BE CONCERNED ABOUT AND THE CITIZENS MAY BE CONCERNED ABOUT.

SO JUST IN THE MATTER OF FAIRNESS, I WOULD INTERVIEW DR. JENKINS AGAIN AND ALL OF THE CANDIDATES.

I KNOW SOME OF YOU ARE READY TO MAKE A DECISION.

[00:40:04]

HE MAY BE WELL-QUALIFIED, BUT THERE ARE I'M SURE A COUPLE OF THE OTHER CANDIDATES MAY BE WELL-QUALIFIED TOO.

THANK YOU VERY MUCH. >> SPEAKER: WHO WILL BE NEXT?

>> SPEAKER: SORRY, I'M A SLOW WALKER.

I DON'T HAVE AN ADDRESS DO I JUST SAY ARBOR RESIDENT HALL?

>> SPEAKER: THAT'S FINE. >> SPEAKER: I AM A SOPHOMORE.

TOMORROW I WILL APPLY FOR MY JUNIOR CLASSES SO I WILL BE A JUNIOR NEXT YEAR. I DON'T KNOW IF YOU GET MANY COLLEGE STUDENTS RIGHT HERE. I AM MIKAL FLOYD-PRUITT IF YOU WATCH AUBURN MEN'S BEST BALL GAME I AM WEARING THE STRAW HAT WITH THE ORANGE BANNER AROUND IT ASKING -- ACTING CRAZY.

I JUST WANT TO APPLY EACH AND EVERY ONE OF YOU FOR YOUR GREAT WORK. I LOVE AUBURN EVEN THOUGH I'M NOT A CITIZEN. I WASN'T BORN HERE.

AUBURN HAS BECOME MY HOME AND I WANT TO APPLAUD EACH AND EVERY ONE OF YOU. I KNOW YOU DON'T GET ROWDY YOUNG PEOPLE APPEAR EVERY DAY. I'M GOING TO TAKE THIS OFF BECAUSE I LOVE TO TALK. ONCE AGAIN, THANK YOU.

I HAVE MET WITH MAYOR ANDERS BEFORE AND HIS COMMITMENT TO THIS CITY IS AMAZING. I'M FROM A SMALL LITTLE CITY CALLED PRUDE IN ALABAMA NEAR MOBILE.

JUST IN CASE, FOR REFERENCE. YES, THANK YOU EACH AND EVERY ONE OF YOU. I'VE WATCHED MANY CITY COUNCIL MEETINGS ON FACEBOOK AND I'M IN AWE IN EACH AND EVERY ONE OF YOU. ONE DAY MAYBE I CAN SIT IN ONE OF THE SEATS YOU HOLD TODAY. THANK YOU FOR ALL YOUR WORK.

MAYOR ANDERS, THANK YOU FOR YOUR ADVANCEMENT OF THIS CITY.

THANK YOU, THANK YOU, THANK YOU. IF I HAD 10,000.

EVERY MORNING I GET UP I SAY A PRAYER FOR EACH AND EVERY ONE OF YOU BECAUSE I THINK BEING IN A CITY POSITION IS PROBABLY ONE OF THE TOUGHEST JOBS THERE IS, BESIDES BEING THE PRESIDENT OF THIS GREAT COUNTRY. THANK YOU ALL, OR EGO AND I HOPE

YOU WILL HAVE A BLESSED EVENING. >> SPEAKER: THANK YOU, MICHAEL.

>> SPEAKER: NEW MAY WE INVITE THIS INDIVIDUAL TO COME BACK EVERY MEETING. (LAUGHTER)

>> SPEAKER: WRAP UP THE MEETINGS WITH THAT POSITIVITY.

THANK YOU. >> SPEAKER: I CAN SAY THAT HE

IS JUST LIKE THIS ALL THE TIME. >> SPEAKER: ANYONE ELSE? WE WILL CLOSE THIS PART OF OUR AGENDA.

DO WE HAVE A MOVE TO ADJOURN? >> SPEAKER: I HAVE A QUESTION

[Additional Item]

FOR THE CITY MANAGER. WHAT'S OUR PROCESS FOR FORMALIZING THE PREREQUISITES FOR THE HBC? IF WE ARE GOING TO ADD MAKE THEM UP AS WE GO ALONG?

>> SPEAKER: WE WOULD NEED TO BRING THAT UP IN A COMMITTEE OF

THE WHOLE. >> SPEAKER: WE WOULD NEED TO CHECK. THE PREREQUISITES THAT ARE ADOPTED NEAR THAT A STATE LAW WHICH SETS THAT THAT WASN'T A DICTATION SO I BELIEVE AND I WILL DOUBLE CHECK AND GET BACK WITH THE COUNSEL THAT WE WOULD ACTUALLY HAVE TO AMEND STATE LAW. I DON'T KNOW THAT WE CAN CHANGE

THE QUALIFICATIONS OF THAT BOARD >> SPEAKER: BUT WE JUST DID.

>> SPEAKER: KNOW, THE INTERPRETATION IN TERMS OF THE CITY ATTORNEY WAS, DOES THE MAYOR HAVE SOME FORM OF AUTHORITY TO INTERPRET WHETHER SOMEBODY HAS EXPERIENCE THAT MEETS THOSE PARTICULAR CRITERIA, AND ANSWER WAS YES.

THE OPINION OF THE CITY ATTORNEY THAT CAN HAPPEN.

THERE HAVE BEEN MANY MAYORS ACROSS THE STATE THAT HAVE MADE SIMILAR INTERPRETATIONS. IF IT NEEDS TO BE CHANGE, I DO BELIEVE WE HAD TO CHANGE STATE LAW.

THE ONLY PIECE OF STATE LAW YOU DID NOT -- NOT YOU BUT A PREVIOUS BODY DID NOT ADOPT WAS THE CREATION OF AN ARCHITECTURAL REVIEW COMMITTEE THAT WAS INDEPENDENT FOR HISTORIC DISTRICT, INDEPENDENT OF THE HISTORIC PRESERVATION COMMISSION. THEY SERVE IN THAT CAPACITY AS WELL AS THE HISTORIC PRESERVATION COMMISSION.

I WILL BE HAPPY TO CHECK IF YOU CAN FURTHER MODIFY OR RESTRICT CRITERIA TO SEE IF THAT IS POSSIBLE AT THE COUNSEL LEVEL.

>> SPEAKER: IF THE COUNSEL IS OKAY WITH THAT, WE CAN ASK THE

CITY MANAGER TO LOOK AT THAT. >> SPEAKER: I DON'T THINK YOU CAN EXPANDED BUT YOU MIGHT BE ABLE TO CONTRACT IT.

WE WILL GET AN ANSWER ON THAT SPOT THE QUESTION I HAD.

>> SPEAKER: THE QUESTION I HAD WAS A WEE DOING ZOOM? I THINK WE HAD TALKED ABOUT POTENTIALLY DOING A HYBRID TYPE

MEETING FOR THE NEXT LITTLE BIT. >> SPEAKER: NO CARBON MEETINGS.

ACROSS OUR BOARDS AND COMMISSIONS THAT IS A FIRM.

WE ATTEMPTED THAT ONCE WITH THE PLANNING COMMISSION AND OUR STAFF CAN TELL YOU THAT -- THIS WAS A WORK SESSION, IT WAS CHALLENGING. IT IS IN PERSON.

WE ARE TRANSITIONING THROUGH THE MONTH.

THE BOARD OF ZONING ADJUSTMENT WILL BE TOMORROW AND PLANNING COMMISSION THURSDAY. THEY ARE NOT IN PERSON BECAUSE WE HAD ADVERTISED PUBLIC HEARINGS VIA ZOOM FOR THOSE SPECIFIC MEETINGS AND WE COULD NOT GIVE IT QUICK ENOUGH.

COUNCILPERSON GRISWOLD HAD ASKED ME ABOUT ANOTHER ITEM THAT GOT ADVERTISED IN THE VILLAGE OR AN APPLICANT WAS WILLING TO MOVE CONSIDERATION TO MAY BECAUSE WE HAD ADVERTISED SOMETHING ALREADY FOR CITY COUNCIL MEETING THAT WAS GOING TO BE IN PERSON INSTEAD OF ZOOM IN. WE WORKED VERY DILIGENTLY TO BE CLEAR WITH THE PUBLIC WHEN AND WHERE WE ARE MEETING.

[00:45:02]

BUT WE ARE NOT DOING HYBRID MEETINGS.

IT IS VERY DIFFICULT TO MANAGE. YOU CAN'T HEAR PEOPLE.

WE DON'T HAVE GOOD CAPABILITIES IN THIS ROOM TO MANAGE BOTH ZOOM AND THAT. I CAN TELL YOU WE ARE LEGAL TO MEET IN ZOOM OR IN PERSON UNTIL THE GOVERNOR UNDOES HER EMERGENCY ORDER THAT ALLOWS US TO MEET ELECTRONICALLY AT ALL.

SEVERAL OF YOU HAVE HAD QUESTIONS ABOUT MEETINGS.

LIKE YOUR PACKING MEETING AND SO ON.

CAN YOU CONTINUE TO MEET THAT WAY? WE ARE WORKING AS HARD AS WE CAN TO FIGURE THAT OUT.

IT HINGES ON DELIBERATION, WHICH YOU TYPICALLY DON'T DO IN THAT MEETING AND YOU HAVE BEEN VERY DILIGENT ABOUT THAT.

WE MAY HAVE TO BE EVEN MORE FIRM ABOUT THAT IF YOU WANT TO CONSIDER THAT PACKING MEETING ONLY ON ZOOM.

THE PUBLIC HAS ACCESS. THAT'S NOT THE ISSUE.

BUT IF WE DON'T HAVE BY STATE LAW THE MEANS TO MEET ELECTRONICALLY, THEN WE HAVE TO BE VERY CAREFUL ABOUT DELIBERATION. AND SO WE WILL COACH YOU GUYS IF YOU MAKE THAT DECISION IF WE DON'T SEE ANOTHER WAY AROUND IT.

>> SPEAKER: I THINK WE HAVE ALREADY DONE THAT BUT HAVE WE SENT OUT A NOTIFIER OR THROUGH OPEN LINE ABOUT A REFRESHER? IT'S BEEN ALMOST A YEAR WE HAVE BEEN OUT FROM MEETING IN PERSON.

HAVE WE SEND SOMETHING TO THE GENERAL PUBLIC TO GET THEM READY

FOR WHAT MEETINGS WILL BE? >> SPEAKER: WOULD PUSH THAT WILL BE CAN AND WE WILL CONTINUE TO PUSH OUT THAT THESE MEETINGS WHERE THEY ARE AND WHEN THEY ARE.

WE GET OUTSIDE OF APRIL UNLESS SOMETHING CHANGES THE GOVERNOR IS SPEAKING TOMORROW AT 11 SO WE ARE GOING TO GET BETTER DIRECTION. I THINK I WOULD LIKE TO SIGNAL TO YOU ALSO THAT WE ARE STILL ASKING THAT THE PUBLIC WEAR MASKS AND CITY FACILITIES AT THIS JUNCTURE EVEN THOUGH THE STATE HAS NOT MANDATED MASKS WE ARE STILL ASKING THAT THE PUBLIC WEAR MASKS. OUR STAFF WHEN THEY MEET THE PUBLIC WILL BE UNLESS THEY ARE BEHIND A PUT THE GLASS WILL BE WEARING A MASK. UNTIL PEOPLE CAN SAFELY DISTANCE OR WHAT HAVE YOU, OUR STAFF WILL BE DOING THAT'S.

WE ARE ALSO WILLING TO MEET WITH SOME PEOPLE IN PERSON AT A DISTANCE AT THE COMFORT LEVEL OF THE FOLKS.

AS WE DON'T KNOW SAY IT FOR PARKS AND RECORD WE ARE WAITING FOR A BIT MORE DIRECTION FROM THE GOVERNOR TO SEE WHAT SHE SAYS TOMORROW. TO MAKE A BETTER DETERMINATION ABOUT THE OPERATIONAL CAPACITIES OF THOSE FACILITIES AND OUR PROGRAMS AND WE NEED A BIT MORE INFORMATION BEFORE WE DO THAT.

AS WE TRANSITION THROUGH APRIL, OUR STAFF KNOWS OUR EXPECTATION IS THE COUNSEL MEETING IN PERSON THE REST OF THE BOARDS AND COMMISSIONS WILL BE TRANSITIONING TO MEETING BACK IN PERSON SAFELY AS WE CAN WITH THE GUIDANCE THAT WE ARE GETTING.

>> SPEAKER: THANK YOU FOR SETTING US UP TONIGHT.

THANK YOU EVERYBODY THAT THE STAFF THAT WAS HER TO DO THAT.

THANK YOU FOR COUNSEL. THANK YOU FOR EVERYTHING THE LAST YEAR OF ALL OF US HAVING -- IT'S BEEN -- I'M NOT PATTING MYSELF ON THE BACK BUT I WILL PAT THE BACK OF ALL OF THE COUNCIL MEMBERS AND STAFF THAT PUT IN A LOT OF WORK TO MAKE SURE THAT THE ENGINE OF GOVERNMENT STILL RAN THROUGH THIS PANDEMIC. I'M VERY THANKFUL FOR THAT AND THANKFUL FOR EVERYBODY. EVERYBODY'S EFFORTS MIGHT HAVE

US BACK IN PERSON. >> SPEAKER: I APPRECIATE YOU DECIDING TO MEET IN PERSON BECAUSE WE HAVE A PARKING LOT AND WE HAVE BEEN WORKING HARD TO HAVE A PARKING LOT FOR A VERY LONG TIME. I WANT TO THINK A NUMBER OF FOLKS STEPPED UP. WE HAD CONTRACTED TO PULL OFF OF OTHER JOBS. OUR STAFF HAD PEOPLE WORKING NIGHTS AND WEEKENDS. THE CONTRACTORS DID AND THEY STEPPED UP TO THE PLATE TO BE SURE THE PUBLIC HAD MUCH IMPROVED ACCESS TO THIS FACILITY TONIGHT.

I REALLY APPRECIATE THEM DOING THAT TO.

THEY DID NOT WORK EASTER SUNDAY BUT THEY SURE WORKED SATURDAY AND LONG HOURS AND I APPRECIATE THAT.

WE ARE GETTING CLOSER TO COMPLETION.

YOU WILL GO OUTSIDE AND SEE THE PARKING LOT IS VERY WELL LIT.

I ASK EVERYBODY TO WALK WITH CAUTION AND STAY ON THE PAVEMENT. DON'T GET IN OUR LANDSCAPED AREAS THAT DON'T HAVE DIRT IN THERE RIGHT NOW.

LITERALLY AT 5 O'CLOCK TODAY WE PULLED EQUIPMENT OFF THE SITE THAT IS HOW TO THE WIRE WE WERE PICKED UP MY TEAM TOLD ME THEY WOULD MAKE IT HAPPEN AND THEY MADE IT HAPPEN.

I'M DEEPLY APPRECIATIVE OF THAT. WE WOULD LIKE TO HAVE FINISHED SOONER BUT YOU DECIDING TO MEET TONIGHT IN PERSON IS WHY THE PARKING LOT IS FINISHED. THANK YOU.

>> SPEAKER: ANYONE ELSE? >> SPEAKER: CONGRATULATIONS, MACON, TO YOU AND YOUR STAFF. MOVED TO ADJOURN?

>> SPEAKER: SO MO
