[4. MAYOR AND COUNCIL COMMUNICATIONS.]

EARLIER IN THE COMMITTEE OF THE WHOLE WE COMPLETED A DISCUSSION ABOUT THE CHANGES IN THE ROUNDABOUT THAT WILL BE COMING UP POTENTIALLY ON OUR AGENDA TONIGHT.

THAT IS EIGHT MACKEITH FIVE AND WE WILL BE TALKING ABOUT THAT A LITTLE LATER. AND THEN ALSO MS. WITTEN HAS SOME QUESTIONS AND COMMENTS ON ITEM 9E.

AS FAR AS MAYOR'S COMMENTS THIS EVENING THERE ARE A NUMBER OF THINGS I WOULD LIKE TO MENTION. I WANT TO THANK ALL OF THE PEOPLE WHO WERE INVOLVED IN THE SUMMER NIGHTS PROJECT THIS PAST FRIDAY NIGHT. WHAT A BEAUTIFUL EVENING IN DOWNTOWN AUBURN. IF I DON'T GET ALL OF THESE RIGHT, SOMEBODY PLEASE HELP ME OUT.

AUBURN ARCH ASSOCIATION, JAN DEMPSEY ARTS CENTER WHICH SUPPORT, CAROLYN CENTER FOR ARTS AND HUMANITIES, DOWNTOWN MERCHANTS AND I THINK FROM THE CITY'S PERSPECTIVE OF OUR PARKS AND REX STAFF, PUBLIC SAFETY STAFF AND ENVIRONMENTAL SERVICES. IT WAS A WONDERFUL EVENING AND A LOT OF PEOPLE ARE HAVING A GREAT TIME DOWNTOWN.

I APPRECIATE EVERYBODY'S HARD WORK TO MAKE THAT HAPPEN.

THERE WAS A LOT OF SMILING FACES DOWNTOWN.

IT WAS EXCITING ON SATURDAY MORNING AS I WENT TO THE CITY MARKET WHICH WAS FANTASTIC AND I ENCOURAGE THOSE WHO HAVE NOT BEEN TO THE CITY MARKET TO TAKE A LITTLE TIME.

USUALLY MY WIFE GOES AND SHE HAD TO WORK AND SHE ASKED ME TO GO SO I WANDERED OUT THERE AS A NOVICE AT CITY MARKET HAD A GREAT TIME. WAS A GREAT ATMOSPHERE.

AS I DROVE THROUGH DOWNTOWN AUBURN, DOWNTOWN AUBURN WAS VERY CLEAN AND YOU WOULD HAVE NEVER KNOWN THAT THERE HAD BEEN THOUSANDS OF PEOPLE THERE THE NIGHT BEFORE.

KUDOS TO OUR ENVIRONMENT OF SERVICES STAFF.

THEY HAD THE PLACE LOOKING GREAT.

>> SPEAKER: THE PUBLIC WORKS STAFF.

>> SPEAKER: PUBLIC WORKS STAFF. THANK YOU.

I KNEW I WOULD NEEDED TO BE CORRECTED.

KUDOS TO THE PUBLIC WORKS STAFF. THANK YOU FOR YOUR HARD WORK.

RECENTLY YOU MIGHT HAVE SEEN A STORY ABOUT A FORMER POLICE OFFICER MIKE ROBERSON WHO HAS SUFFERED SOME HEALTH SETBACKS.

THERE WAS AN EVENT FOR HIM AT HIS HOME THIS PAST FRIDAY AND THE CHATTAHOOCHEE CHAPTER OF THE FULLER CENTER IS RAISING MONEY CURRENTLY FOR HIM RIGHT NOW. TO DO IN ADDITION TO HIS HOUSE WHICH WOULD PROVIDE A SHOWER THAT WOULD ALLOW HIM TO GET IN AND A HANDICAP AND WHEELCHAIR AND ANOTHER BEDROOM THAT'S DOWN STAIRS FOR HE AND HIS WIFE. I WOULD ENCOURAGE YOU IF YOU FEEL LED TO LOOK INTO THAT AND MAKE A CONTRIBUTION TO MIKE.

HE WAS A GREAT GUY, SERVED OUR CITY WELL.

AND SRO AT AUBURN JUNIOR HIGH SCHOOL FOR MANY YEARS AND THEIR FAMILY COULD USE SOME HELP. I WOULD ENCOURAGE YOU TO CONSIDER THAT. JUST LAST NIGHT A YOUNG MAN FROM AUBURN HIGH SCHOOL WAS A MEMBER OF THE MISSISSIPPI STATE BASEBALL TEAM RODNEY JORDAN AND HE WAS LEADOFF BATTER AND PLAYED CENTER FIELD FOR THE BULLDOGS AND LEAD THEM TO THE COLLEGE WORLD SERIES. CONGRATULATIONS TOO ROWDY AND WE LOOK FORWARD TO WATCHING HIM THIS WEEK IN OMAHA.

SINCE OUR LAST MEETING WE HAD THE RIBBON CUTTING FOR THE MEDICAL PAVILION WHICH IS THE NEW HOSPITAL AND THE RESEARCH PARK AND THERE WAS A VERY EXCITING DAY.

AS YOU SAW THE PARTNERSHIP WITH EA MC AND AUBURN UNIVERSITY IN THE RESEARCH PARK IN THE CITY AND A GROUP OF DOCTORS THAT ARE PUTTING A GREAT FACILITY HERE IN AUBURN THAT'S GOING TO BE SUCH A GREAT ASSET TO OUR COMMUNITY, OUR STUDENT BODY AND CAMPUS.

THAT WAS AN EXCITING DAY. I LOOK FORWARD TO WATCHING WITH THE AUBURN MEDICAL PAVILION IS FOR OUR COMMUNITY TODAY AND WHAT IT WILL BECOME IN THE FUTURE. REPRESENTATIVE MIKE ROGERS WAS HERE RECENTLY AND WE GOT TO SPEND A LOT OF TIME WITH HIM.

I HAD LUNCH WITH HIM AND THEN HE VISITED OUR INDUSTRIAL PARK AND I APPRECIATE REPRESENTATIVE ROGERS BEING WILLING TO ASSIST THE CITY OF AUBURN IN OUR PROJECT.

IS VERY INTERESTED IN WHAT WE ARE DOING HERE AND WANTS TO BE AS HELPFUL AS POSSIBLE AND WE WERE GLAD TO HAVE HIM.

THERE WAS A RECENT ANNOUNCEMENT ABOUT THE OPENING OF THE WIC AND FOOD PANTRY WHICH IS A PARTNERSHIP OF THE CITY OF AUBURN AND THE AUBURN CITY CORPORATION.

IT WILL BE OPEN AND A COUPLE OF DAYS A WEEK AT THE BOYKIN COMMUNITY CENTER AND WE LOOK FORWARD TO THAT NEW OPPORTUNITY FOR THE RESIDENTS OVER THERE TO BE ABLE TO UTILIZE THE GREAT RESOURCES FROM THE FOOD PANTRY. CONGRATULATIONS TO YOU AND YOUR STAFF FOR MAKING THAT HAPPEN. A COUPLE OF LADIES I GOT TO KNOW, ACTUALLY BROWN AND OLIVIA NICHOLS SAW THE COMPLETION OF THE PROJECT COME TO FRUITION THIS PAST WEEKEND WITH THE REMEMBRANCE PROJECT WITH A MEMORIAL THAT WAS DEDICATED ON

[00:05:02]

SATURDAY AFTERNOON IN FRONT OF THE COURTHOUSE IN OPELIKA.

THESE YOUNG LADIES HAVE BEEN WORKING ON THIS FOR MANY, MANY YEARS. THIS IS WHERE THEY HONOR THE MEMORIES OF PEOPLE THAT WORK IN LEE COUNTY WHO WERE LYNCHED IN OUR PAST. I APPRECIATE THEIR EFFORTS AND THEIR DESIRE TO BRING HONOR TO THESE PEOPLE'S LIVES.

I KNOW BOB YOU WENT OVER THERE THE OTHER DAY AND PARTICIPATED IN THAT. DID YOU WANT TO SAY SOMETHING ABOUT YOUR EXPERIENCE OVER THERE?

>> SPEAKER: YES, IT WAS DEEPLY MOVING CEREMONY.

THE WOMEN INVOLVED ACTUALLY -- ASHLEY BROWNE AND OLIVIA NICK NICHOLS LED AN ORGANIZATION CALLED THE LEE COUNTY FOR MEMBERS PROJECT. TOGETHER IN COOPERATION WITH THE EQUAL JUSTICE INITIATIVE OUT OF MONTGOMERY AND THE LOCAL NAACP CHAPTER THEY CONDUCTED A WONDERFUL SENSITIVE CEREMONY HONORING THE LIVES OF THESE FOR LOCAL LEE COUNTY MEN, GEORGE HART, JOHN MOSS, CHARLES HUMPHREYS, AND SAMUEL HARRIS, WHO PERISHED AS VICTIMS OF RACIAL LYNCHINGS IN THIS COUNTY.

THERE IS NOW A MARKER THAT YOU CAN VIEW AT THE COURTHOUSE SQUARE. THERE IS ALSO IF YOU GET THE OPPORTUNITY GO TO THE EAST ALABAMA MUSEUM, THE MUSEUM OF A STELLA -- THERE IS ALSO A NICE INFORMATIVE DISPLAY FURTHER EXPLAINING THE HISTORY OF THIS SAD MOMENT IN LEE COUNTY.

INCREDIBLY VERY HONORED TO BE A PART AND TO WITNESS THIS.

>> SPEAKER: THANK YOU, BOB. IN TWO WEEKS I WILL BE GOING TO MOBILE AND ADJOINING THE OTHER MAYORS FROM THE BIG TEN MAYORS.

THE FIRST TIME WE HAVE GOT GOTTEN TOGETHER SINCE COVID.

I LOOK FORWARD TO THAT MEETING AND ACTUALLY CITY MANAGER CROUCH WILL BE ATTENDING WITH ME. AS WELL AS SOME STAFF FROM OUR PUBLIC SAFETY. IT SHOULD BE A GREAT MEETING WITH THE TEN LARGEST CITIES IN THE STATE.

AND DON'T FORGET ON JULY 4 FIREWORKS WOULD BEGIN AT DOUG STANFORD STADIUM AND I APPRECIATE LAST YEAR THE CITY REALLY WORKING HARD TO PROVIDE THAT FOR US ASSISTANCE DURING A DIFFICULT TIME AND THIS YEAR WE LOOK FORWARD TO HAVING A NORMAL AND GREAT TIME. THIS SATURDAY WILL BE A FIRST TIME EVER EVENT IN AUBURN AND I'M GOING TO ASK MS. TAYLOR IF SHE WOULD LIKE TO SPEAK TO JUNETEENTH.

>> SPEAKER: THE COMMUNITY -- THE PUBLIC IS INVITED TO COME OUT TO JUNETEENTH ON SATURDAY JULY 19 AT SAM HARRIS PARK.

IT'S GOING TO START AT TEN. WILL HAVE A SPEAKER AND HE WILL SPEAK AROUND 2 O'CLOCK. THERE WILL BE DIFFERENT ACTIVITIES GOING ON, GAMES, AND SINGING, MUSIC.

IT IS A DAY OF FUN. WE ASK THAT EVERYONE COME OUT AND ENJOY ALL OF THE FESTIVITIES FOR THAT EVENT.

IT WILL END AROUND 6 PM. I WAS LOOKING AT THE WEATHER THIS MORNING AND I HEARD IT WAS 50 PERCENT CHANCE OF RAIN.

LET'S PRAY AND HOPE THE RAIN DON'T COME IN.

>> SPEAKER: THANK YOU FOR YOUR HARD WORK.

AND BETH I APPRECIATE YOUR ASSISTING ON THAT AS WELL.

I KNOW CONNIE YOU HAVE A COMMITTEE PUT TOGETHER SO THANK

YOU FOR DOING THAT. >> SPEAKER: I ALSO WANT TO THANK BETH AND MEMBERS OF THE CHAMBER OF COMMERCE FOR STEPPING UP TO THE PLATE AND HELPING OUT. WE REALLY, REALLY APPRECIATE.

TODAY SEE SOMEONE SMILING IN THE BACK.

WE REALLY, REALLY APPRECIATE ALL OF THE HELP AND EFFORT THAT EVERYBODY HAS PUT INTO THIS CELEBRATION.

>> SPEAKER: ANYONE ELSE ON THE COUNCIL HAVE AN ANNOUNCEMENT OR

ANYTHING THEY WOULD LIKE TO SAY? >> SPEAKER: I WOULD LIKE TO SAY I THANK GOD TONIGHT THAT I GO BACK AND SEE SERGEANT WEBB SISTRUNK FOR HE WAS WOUNDED WHEN WE LOST OFFICER BUCKNER AND PROBABLY WITH THE HAND OF GOD BE UPON HIM.

IT'S GOOD TO SEE YOU AND THANK YOU FOR THE JOB YOU DO.

I DON'T WANT TO LEAVE OUT BRENT HOWELL.

OFFICER OFFICER HOWELL IS ONE OF THOSE GUYS WHO'S BEEN WITH US A LONG TIME. HE IS ONE OF THE GUYS, IF YOU CAN'T GET ALONG WITH HIM YOU CAN'T GET ALONG WITH ANYBODY.

HE KEEPS THINGS ROLLING AND I APPRECIATE THE WAY YOU TREAT OUR CITIZENS AND WHAT YOU DO FOR US. THANK YOU.

>> SPEAKER: THANK YOU, TOMMY. FINISHING TOUCHES ON THE NEW

[5. AUBURN UNIVERSITY COMMUNICATIONS.]

[00:10:17]

I GOT A TOUR THAT THE OTHER DAY AND IT'S BEAUTIFUL.

IT'S ON A BIG APARTMENT THANKS TO THE AGRICULTURE DEPARTMENT AT AUBURN. THANKS TO HIGH-TECH SHIPPING CONTAINERS THEY HAVE ALL OF THESE VIRTUAL GARDENS AND IS REALLY PUSHING AUBURN TO THAT NEW SUSTAINABILITY THAT WE ARE PUSHING FOR. WE ARE EXCITED ABOUT THAT.

I KNOW ALL INCOMING FRESHMEN ARE EXCITED FOR THAT.

SPEAKING OF FRESHMEN, CAMP IS APPROACHING ITS END.

THE BIGGEST FRESHMAN CLASS WE HAVE HAD.

IT'S BOUGHT A LOT OF PEOPLE INTO AUBURN, PEASANT -- PARENTS, A LOT OF REVENUE DOWNTOWN. SAD THAT IT'S OVER BUT EXCITED FOR THE CLASS OF 2025. THEY ALSO WANT TO MENTIONED THIS SATURDAY IN COMMEMORATION JUNETEENTH AUBURN ATHLETICS IS GOING TO BE HOSTING A UNITY WALK.

THEY ARE STARTING AT THE AUBURN ATHLETIC COMPLEX PARKING LOT AND FINISHING ON THE STUDENT CENTER IN THE GREEN SPACE.

THAT WILL BE FROM ONE TO THREE. THAT WILL BE A GREAT EVENT.

THIS TIME WE WILL HAVE CITIZENS TO MEDICATIONS FOR ITEMS ON THE AGENDA. THIS IS ONLY ITEMS ON THE AGENDA. IF YOU WOULD LIKE TO TALK TO US ABOUT SOMETHING NOT ON THE AGENDA YOU WOULD NEED TO WAIT UNTIL LATER ON IN OUR MEETING. IF YOU HAVE ANYTHING YOU WOULD LIKE TO SAY ABOUT ITEMS ON OUR AGENDA THERE ARE A NUMBER THINGS ON OUR AGENDA THAT HAVE PUBLIC HEARINGS ATTACHED AND THAT WOULD BE THE MORE APPROPRIATE TIME FOR YOU TO SPEAK.

[7. CITY MANAGER’S COMMUNICATIONS.]

ANYONE? WE WILL MOVE AHEAD.

CITY MANAGER'S COMMUNICATIONS. >> SPEAKER: UNDER CITY MANAGER'S COMMUNICATIONS THIS EVENING WE HAVE THE ANNOUNCEMENT OF TWO VACANCIES ON THE GREEN SPACE ADVISORY BOARD AND ONE VACANCY ON THE WATER WORKS BOARD.

APPOINTMENTS WILL BE MADE AT THE JULY 20, 2021, MEETING.

[8. CONSIDERATION OF CONSENT AGENDA.]

OUR NEXT ITEM OF BUSINESS IS THE CONSENT AGENDA.

IS ANY COUNCIL MEMBER WAS TO REMOVE AN ITEM FROM THE CONSENT AGENDA AND DEAL WITH THAT ITEM INDIVIDUALLY?

>> SPEAKER: 8E5. >> SPEAKER: ANY OTHER ITEM?

>> SPEAKER: 8E1, PLEASE. >> SPEAKER: ANY THING ELSE?

WE WILL TAKE. >> SPEAKER: ITEM EIGHT ELEPHANS FOR THE WIRE ROAD SOCCER COMPLEX ROUNDABOUT IN THE AMOUNT OF

$179,700. >> SPEAKER: MOVE FOR APPROVAL.

>> SPEAKER: WE HAVE A MOTION AND THE SECOND.

DISCUSSION. I WILL TURN IT OVER TO YOU.

>> SPEAKER: THIS IS THE FIRST I HAVE BEEN MADE AWARE OF THIS AND I THINK IT IS AN INTERESTING PROJECT AND I WOULD LIKE SOME MORE DETAILS IF WE GET A BRIEF DESCRIPTION OF WHAT IT'S GOING TO ENTAIL AND POSSIBLY A TIMELINE.

>> SPEAKER: I WILL GIVE YOU ONE BRIEF OVERVIEW AND THAT I WILL HAVE CITY ENGINEER FRAZIER BUILT IN MORE DETAILS.

THIS IS A VERY NEW PROJECT TO ME AS WELL.

WHAT I MEAN IS WE HAVE TALKED FOR A WHILE ABOUT WE HAVE IN OUR CAPITAL IMPROVEMENT PLAN WE ARE GOING TO BE DOING MAJOR EXPANSION AT THE SOCCER COMPLEX ADDING THREE ADDITIONAL OUTDOOR FIELDS AND INDOOR LARGE FACILITY AND A LOT OF PARKING.

WE ALSO HAVE A LOT OF CONCERNS FROM OUR CITIZENS THAT USE THE COMPLEX AND VISITORS ABOUT THEIR ABILITY OF INGRESS AND EGRESS.

THROUGH THAT AREA AND A LOT OF CONCERNS.

WE DID LOOK AT I ASKED CITY ENGINEER FRAZIER TO EVALUATE A TRAFFIC SIGNAL THAT WOULD OPERATE ONLY WHEN THE COMPLEX WAS IN FULL OPERATION. SHE EVALUATED THAT AND VERY KINDLY TOLD ME IT'S A REALLY GREAT IDEA, MAKE AND, EXCEPT IT DOESN'T WARRANT A TRAFFIC SIGNAL AND THEREFORE WE CANNOT MAKE ONE EVEN IF IT GOES INTO FLASH MODE. SO SHE AND HER TEAM LOOK AT OTHER OPTIONS AND ALLISON, TAKE IT FROM HERE AS TO WHERE THE

ROUNDABOUT CAME FROM. >> SPEAKER: AFTER THE SIGNAL DIDN'T WARRANT, ONE OF THE THINGS WE LOOKED AT TO IMPROVE THE EFFICIENCY OF THE INTERSECTION WAS A ROUNDABOUT.

SO WE REACHED OUT TO DESIGN SOLUTIONS AND THEY ALSO DID THE DESIGN FOR THE ROUNDABOUT AT COX AND WIRE.

THIS SHOULD ALLOW THE EXITING TRAFFIC FROM THE SOCCER COMPLEX TO DO SO FAIRLY EFFICIENTLY WITHOUT HAVING TO STOP AND CAUSE THE BACKUP THAT WE HAVE BEEN EXPERIENCING.

THIS WAS JUST AN ALTERNATE SOLUTION TO A TRAFFIC SIGNAL

THAT DOES NOT WARRANT. >> SPEAKER: ALLISON, ONE ADDITIONAL THING I HAD THIS FOR TRAVEL IT ON WIRE ROAD BECAUSE THE SOCCER COMPLEX IS NOT IN OPERATION WEEKDAYS EXCEPT FOR IN

[00:15:03]

THE SUMMER, WEEKNIGHTS AND WEEKENDS, WHAT DOES THAT MEAN

FOR TRAVELERS ON WIRE ROAD? >> SPEAKER: THE WAY WE LAID IT OUT WITH THE CONSULTANT TRAFFIC ALONG WIRE WILL PRETTY MUCH MIMIC WHAT IT'S DOING NOW, ALMOST BE STRAIGHT WITH THE EXCEPTION OF A SLIGHT CURVATURE. BUT WIRE ROAD SHOULD NOT EXPERIENCE ANY ISSUES BECAUSE OF THIS.

I THINK MEGAN YOU MENTIONED TO THE TIMELINE WE ARE TRYING TO GET THIS DESIGN SO WE CAN INCLUDE IT IN THE PROJECT FOR THE SOCCER COMPLEX AND MAKE IT ONE PROJECT.

>> SPEAKER: I ALSO THINK THERE HAD BEEN A QUESTION ABOUT I HAD RECEIVED ONE FROM COUNCILMEMBER GRISWOLD THAT YOU HAVE A DRAWING IN YOUR PACKETS THAT SHOWS THAT IT MAY EXTEND ONTO AN ADJOINING PROPERTY. WE HAVE NOT APPROACHED ANY ADJOINING PROPERTY OWNERSHIP BECAUSE UNTIL THE DESIGN IS COMPLETE WE DON'T KNOW HOW MUCH RIGHT-OF-WAY.

THE RIGHT-OF-WAY IS ACTUALLY KIND OF STRANGE RIGHT THERE.

IT IS ODDLY WIDE AND THE ROAD IS BUILT ITSELF CLOSER TO THE SOCCER COMPLEX SIDE SO THERE IS A BIGGER GAP.

WE DON'T KNOW IF IT'S TEMPORARY CONSTRUCTION EASEMENTS, RIGHT-OF-WAY OR WHAT. WE WILL APPROACH THAT PROPERTY OWNER ONCE WE HAVE ENOUGH INFORMATION TO DO SO.

IT IS NOT OUR INTENT TO SPRING DESIGN ON PEOPLE BUT THIS IS A RELATIVELY NEW THING THAT WE ARE TRYING TO ACCOMPLISH IN TIME FOR THE BID AND THAT'S WHY THE HURRY UP.

>> SPEAKER: I HAVE A QUESTION. IT WOULD BE THE SAME QUESTION FOR E5. TWO WE HAVE CONTROL OF WIRE ROAD

FROM A MAINTENANCE -- >> SPEAKER: WE CONTROLLED WIRE ROAD FROM WEBSTER ROAD OUT OF THE CITY LIMITS.

CHADWICK LANE ACTUALLY. >> SPEAKER: OKAY.

>> SPEAKER: AS IN WE DO NOT NEED ANOTHER AGENCY'S PERMISSION TO ACCOMPLISH. WE HAVE NOT APPLIED FOR A GRANT FOR THIS AND PROBABLY WILL NOT BE.

>> SPEAKER: HOW CLOSE IS THIS ONE, THIS SOCCER ONE TO NUMBER

FIVE? >> SPEAKER: MAYBE A MILE.

>> SPEAKER: IT'S A REASONABLE DIFFERENCE.

YOU WILL NOT HIT -- YOU WILL SEE THEM BACK TO BACK BUT IT'S NOT ON TOP OF EACH OTHER. THIS WILL ACTUALLY HELP TREMENDOUSLY IF PEOPLE WHO USE THE COMPLEX WILL TALK ABOUT COX AND WHY ARE GETTING WAY BACKED UP AS WELL AS WELL AS INGRESS AND EGRESS TO THE SOCCER COMPLEX AND TO NOTE WE ARE ALSO PUTTING OUR ENVIRONMENTAL SERVICES AND PUBLIC WORKS FURTHER DOWN WIRE ROAD AND SO ON AND SO WE WILL HAVE MORE TRAFFIC WE ARE GENERATING OURSELVES WITH OUR OWN VEHICLES.

NOT ALL OF THEM WILL USE WIRE ROAD.

THERE WILL ALSO USE BEEHIVE AND CUT OVER TO HIGHWAY 14 END AND OTHER THINGS BUT THERE WILL BE A LOT MORE GOING ON ON WIRE ROAD.

WE EXPECT PEOPLE TO STILL USE THAT AS A THIRD WAY TO GET TO THE INTERSTATE FROM THAT AREA AND THERE IS A GOOD BIT OF TRAFFIC INTO MAKING COUNTY FROM THERE.

>> SPEAKER: ANY OF THE QUESTIONS? WE HAVE A MOTION AND SECOND. ALL IN FAVOR PLEASE SAY AYE.

MOTION CARRIES. >> SPEAKER: EXECUTION OF A CONTRACT WITH JL THE ENTERPRISES FOR THE INSTALLATION OF A ROUNDABOUT AT THE INTERSECTION OF WIRE ROAD AND COX ROAD IN THE

AMOUNT OF $1,874,570.25. >> SPEAKER: MOVE FOR APPROVAL.

>> SPEAKER: MOTION A SECOND. WE WILL START A DISCUSSION.

YOU ASKED FOR THIS TO BE PULLED I WILL GIVE YOU THE FLOOR IF YOU

WOULD LIKE IT. >> SPEAKER: SAME THING I EXPRESSED EARLIER. I THINK THIS IS REALLY NEEDED AND I KNOW IT IS A LOT OF MONEY FOR US TO SPEND BUT WE HAVE BEEN WORKING ON IT FOR A LONG TIME. IT'S SOMETHING NEEDS DOING AND I THINK IT WILL SAVE LIVES IN THE LONG RUN.

I WOULD JUST PLEAD WITH THE COUNCIL TO SUPPORT IT AND LET'S

GET IT WORKING OUT THERE. >> SPEAKER: ANY OTHER COMMENTS

OR QUESTIONS? >> SPEAKER: SAME QUESTION.

AT THIS STAGE OF OUR -- WIRE ROAD, DO WE HAVE COMPLETE CONTROL OF WIRE ROAD AND COX ROAD? HOW IS ALDOT INVOLVED IF THEY DON'T CONTROL THAT?

>> SPEAKER: THE GRANT THAT WE WERE RECEIVING FROM ALDOT WAS A SAFETY GRANT UNDER THE HIGHWAY SAFETY IMPROVEMENT PROGRAM AND THIS PARTICULAR PROJECT THE ROUNDABOUT WAS ACTUALLY A SAFETY IMPROVEMENT PROJECT TO IT WAS ELIGIBLE TO RECEIVE THOSE FUNDS.

>> SPEAKER: IS THERE AN OPPORTUNITY EVEN IF WE PASS THIS THAT THEY COULD COME BACK AND HAD A CHANGE OF HEART AND AGREE

TO THE $450,000 GRANT? >> SPEAKER: NOT BASED ON MY

CONVERSATIONS THIS AFTERNOON. >> SPEAKER: I DO WANT TO ASSURE THE COUNCIL THAT BEING I FOUND ABOUT THIS AT 4 O'CLOCK TODAY WE ARE STILL PLANNING TO PURSUE THAT.

THE CHALLENGE IS, THE CITY INFORMATION IF WE ARE A REWARD THIS IT'S GONE. WE WILL SEE IF THAT HOLDS.

I WILL HAVE A TALK WITH THE MAYOR ABOUT THAT AND MAKE SOME PHONE CALLS. I'M NOT WILLING TO WALK AWAY FROM HALF A MILLION DOLLARS THAT EASILY.

WE HAVE A TIMING ISSUE HERE AND THEY WANT TO GIVE YOU THE ABSOLUTE DECISION POINT ON THIS. STAFF IS RECOMMENDED WE PROCEED BASED ON YOUR SENTIMENTS PRIOR THAT YOU WANT THIS PROJECT DELIVERED. BUT WE WILL ALSO ABSOLUTELY WAIT IF YOU WOULD PREFER THAT WE PURSUE THIS A BIT FURTHER.

THE CONCERN THAT WE HAVE IS THAT WHAT WE WERE TOLD TODAY, AS I

[00:20:03]

SAID DURING COMMITTEE OF THE WHOLE IS IF YOU AWARD THIS THE MONEY IS GONE. OTHERWISE YOU NEED TO WAIT UNTIL WE AWARDED TO YOU, PROVE IT, THEN YOU CAN GO OUT TO BID AND THEN YOU CAN AWARD IT. WHAT WE ARE CONCERNED ABOUT IS HOW MANY DAYS LIKE IS THAT? IS THAT 90 DAYS, 120 DAYS, 150 DAYS. WE DON'T KNOW.

WE CAN'T GIVE YOU A GOOD GAUGE ON THAT.

THAT'S WHAT I WANT TO PUT THIS IN YOUR HANDS.

WE ARE HAPPY TO GO EITHER WAY BUT OUR RECOMMENDATION IS YOU WANT THIS DELIVERED THEN WE SHOULD PROCEED THIS EVENING.

>> SPEAKER: I AGREE WITH COUNCILPERSON DAWSON THAT WE HAVE ALREADY SIGNALED TO THE COMMUNITY THAT WE ARE WILLING TO MOVE FORWARD AND WE WANT TO EXPEDITE THIS BECAUSE OF THE DELAYS THAT WE WERE EXPERIENCING WITH THE OUTSIDE AGENCY.

I WOULD BE IN AGREEMENT TO MOVE FORWARD.

>> SPEAKER: I WILL ALSO NOTE THAT THERE ARE OTHER FUNDING THINGS THAT WOULD BE COMING DOWN TO THE CITY AND THIS MAYBE AN ELIGIBLE EXPENSE TO REIMBURSE OURSELVES FROM THIS AND WE MIGHT TAKE A HARD LOOK AT THAT. AS LONG AS IT IS THAT WE HAVE ALREADY ISSUED AND WE ARE NOT ISSUING DEBT THIS IS A CASH PROJECT. WE THINK THERE ARE OTHER WAYS TO REPAY OURSELVES FOR THIS AND IT'S A CONVERSATION THAT BEGAN AT FOUR TODAY BUT WE ARE PRETTY COMFORTABLE AND ALLISON IS NODDING AT ME. THERE YOU GO.

>> SPEAKER: ANY OF THE QUESTIONS FROM THE COUNCIL?

COMMENTS? >> SPEAKER: I LIKE THE NOTION OF NOT BEING HELD HOSTAGE BY ANYONE LIKE PERHAPS ANOTHER ROUNDABOUT ON THE NORTH SIDE OF TOWN.

I SAY LET'S MOVE FORWARD. >> SPEAKER: I DROVE THROUGH SUNDAY EVENING AND IT'S LATE JUNE IN MY MIND AND IT HAS A

WAYS TO GO. >> SPEAKER: AND 280 AND 147 WAS A DEADLINE OF APRIL AND IT IS JUNE.

>> SPEAKER: ONE SIDE OF 280 HAS BEEN PAVED BUT NO TRAFFIC SIGNAL YET. UNDERSTOOD.

>> SPEAKER: ANYBODY ELSE? WE HAVE A MOTION AND SECOND.

ALL IN FAVOR PLEASE SAY AYE. >> SPEAKER: AYE.

>> SPEAKER: MOTION CARRIES TO HAVE A MOVE TO APPROVE THE BALANCE OF THE CONSENT ACHIEVEMENT?

[10. RESOLUTIONS.]

UNDER RESOLUTIONS THIS EVENING. ITEM 10A WON ONE IS REQUESTING DAVID SLOCUM ON BEHALF -- SWANN INVESTMENTS FOR CONDITIONAL USE FOR PERFORMANCE. MULTIUNIT DEVELOPMENT FOR PROPERTY LOCATED AT 687 NORTH DEAN ROAD IN COMPREHENSIVE DEVELOPMENT DISTRICT ZONING DISTRICT.

AT THE MAY 13, 2021, MEETING, PLANNING COMMISSION MADE A MOTION TO RECOMMEND APPROVAL OF THIS CONDITIONAL USE REQUEST BUT THAT MOTION FAILED BY A VOTE OF 0-7.

THE PUBLIC HEARING IS REQUIRED. >> SPEAKER: MOVE FOR APPROVAL.

>> SPEAKER: SECOND. >> SPEAKER: MOTION AND SECOND.

AT THIS TIME WE WILL OPEN THE PUBLIC HEARING.

IF YOU WOULD LIKE TO ADDRESS THE CITY COUNCIL PLEASE COME FORWARD AND GIVE YOUR NAME AND ADDRESS FOR THE RECORD.

>> SPEAKER: GOOD EVENING I'M DAVID SLOCUM.

I'M THE CIVIL ENGINEER FOR THE DEVELOPMENT ALSO THE APPLICANT REPRESENTING THE DEVELOPER. ALSO HERE TONIGHT.

I JUST WANT TO BE VERY BRIEF AND WANTED TO CLARIFY SOME CONFUSION THAT OCCURRED DURING THE LAST HEARING THAT THE PLANNING COMMISSION MEETING. WE ARE NOT REQUESTING ANY REZONING. THIS PROPERTY IS -- THE TOWN OWNS ARE ALLOWED BY RIGHT AND CDD ZONING.

WHAT WE ARE ESSENTIALLY TRYING TO DECIDE HERE TONIGHT IS THE

[00:30:08]

METHOD, HOW THE END RESULT WILL BE OBTAINED.

APPROVAL OF THE CONDITIONAL USE REQUEST WILL ALLOW THE TOWNHOMES TO BE PLATTED WITH A CONDOMINIUM STYLE PLOT.

THAT MEANS WE CAN UTILIZE EXISTING INFRASTRUCTURE THAT IS ALREADY IN PLACE. THERE IS ALREADY A PRIVATE DRIVE FROM DEAN ROAD BACK TO THE SITE WHERE THE TOWNHOMES WOULD BE BUILT. THAT DRIVEWAY IS OF COURSE IN PLACE, IT IS FUNDED AND MAINTAINED WITH PRIVATE MONEY.

AND WOULD CONTINUE TO BE SO. ON THE OTHER END, DENIAL OF THE CONDITIONAL USE REQUEST MEANS THE DEVELOPER WOULD HAVE TO INSTALL A CITY STREET ON A CITY RIGHT-OF-WAY FROM DEAN ROAD BACK TO THE SITE SO THAT THOSE TOWNHOMES COULD BE SOLD AS FEE SIMPLE LOTS. WHICH MEANS THE CITY WOULD BE TAKING ON THE RESPONSIBILITY OF MAINTAINING ROUGHLY 1000 FEET OF KNEW CITY STREET AND ALL OF THE INFRASTRUCTURE THAT GOES ALONG WITH IT. SO I JUST WANTED TO MAKE SURE THAT EVERYONE IS CLEAR ON EXACTLY WHAT THE REQUEST IS AND THE RESULT OF THAT REQUEST. THE END RESULT, THE TOWNHOMES WILL LOOK THE SAME REGARDLESS. SOMEONE DRIVING DOWN THE ROAD LOOKING AT IT WOULD NOT KNOW THE DIFFERENCE OF HOW, IF IT'S A CONDOMINIUM OR A TOWNHOME. THE BUILDINGS WILL BE EXACTLY THE SAME. IT'S JUST A MATTER OF WHETHER OR NOT THE CITY WANTS THAT MAINTENANCE OF A CITY STREET ON CITY RIGHT-OF-WAY VERSES UTILIZING WHAT IS ALREADY IN PLACE. I WOULD BE GLAD TO ANSWER ANY QUESTIONS OR MAYBE COME BACK AFTER THE PUBLIC HEARING.

>> SPEAKER: THAT'S ANYBODY HAVE A QUESTION OF MR. SLOCUM AT THIS TIME? WE WILL LET YOU KNOW.

>> SPEAKER: I HAVE A QUESTION. WHAT'S THE ALTERNATIVE RUN? YOU WERE TALKING ABOUT ALTERNATIVE ACCESS.

>> SPEAKER: THERE IS A NUMBER OF SOLUTIONS.

IT IS FORTUNATELY A VERY LARGE LOT WITH A LOT OF ROAD FRONTAGE SO WE HAVE ALREADY LOOKED AT LOOKED AT SEVERAL DIFFERENT SCENARIOS. IT COULD BE RIGHT IN THE CENTER OF THE PROPERTY AND REARRANGE SOME OF THE EXISTING PARKING LOTS. THERE ARE SEVERAL OPTIONS FOR IT

>> SPEAKER: SO YOU WILL BUILD A RESIDENTIAL FACILITY ONE WAY OR ANOTHER, IS THAT WHAT YOU'RE SAYING?

>> SPEAKER: YES, THE DEVELOPER REALLY BELIEVES IN THE SITE.

HE REALLY HAS A VISION FOR IT AND BELIEVES IT'S A GOOD LOCATION FOR WHAT HE IS WANTING TO DO.

SINCE IT IS ALLOWED BY RIGHT, IT'S JUST A MATTER OF HOW WE

WILL GET TO THAT POINT. >> SPEAKER: THANK YOU.

>> SPEAKER: ANYONE ELSE? >> SPEAKER: I HAVE A QUESTION ABOUT THE INDOOR POOL. WHEN THEY CLOSED.

>> SPEAKER: THIS IS NOT THE SIGN.

THIS IS PUBLIC HEARING FOR THIS ITEM WE HAVE ON THE AGENDA TONIGHT. WHO WILL BE NEXT?

>> SPEAKER: I AM JIM PHILLIPS, MY OFFICE IS AT 761 NORTH DEAN ROAD. I HAVE, I WAS THE FIRST DENTIST TO BUILD ALONG THAT STRETCH OF ROAD IN CENTRAL PARK.

I HAVE BEEN PLEASANTLY PLEASED WITH THE DEVELOPMENT OF THE CENTRAL PARK NEIGHBORHOOD AS A PROFESSIONAL OFFICE PARK, FOR THE MOST PART. FOR THE MOST PART THE MEDICAL DENTAL IN NATURE, A FEW OTHERS, VETERINARY CLINIC, SOME OTHER THINGS -- BUT THE DEVELOPMENT HAS BEEN VERY CONSISTENT WITH THE NEIGHBORHOOD WORK. ADDING 25 CONDOMINIUMS DIRECTLY BEHIND MY OFFICE ACROSS FROM THE POOL WOULD BE SIGNIFICANTLY OUT OF CHARACTER WITH THE NEIGHBORHOOD.

IT IS A BUSINESS PARK. IT IS A MEDICAL DENTAL PROFESSIONAL BUSINESS PARK. THERE IS A LAWYER, SOME OTHER PROFESSIONALS IN THE PARK, A SLEEP CLINIC.

[00:35:03]

IT IS A PROFESSIONAL MEDICAL DENTAL PARK.

THE CHARACTER HAS BEEN MAINTAINED -- I HAVE BEEN THERE 20 YEARS. THE CHARACTER OF THE CENTRAL PARK NEIGHBORHOOD HAS BEEN MAINTAINED AND THIS DEVELOPMENT IS VERY MUCH OUT OF CHARACTER. I THINK AS A CITY, WE NEED TO LOOK AT THE CHARACTER OF A NEIGHBORHOOD WHEN WE MAKE DECISIONS LIKE THIS. THANK YOU VERY MUCH.

>> SPEAKER: THANK YOU. >> SPEAKER:

>> SPEAKER: I HAVE A QUESTION FOR DR. PHILLIPS.

IT'S MY UNDERSTANDING THAT THE CENTRAL PART OF ELEMENT IS UNDER

A PROPERTY OWNERS ASSOCIATION. >> SPEAKER: YES.

>> SPEAKER: DO JO EACH HAVE A VOTE IN HOW THE ASSOCIATION OR THE PROPERTY OR THE DEVELOPMENT OF IT?

>> SPEAKER: THAT'S A GOOD QUESTION.

WE HAVE NEVER VOTED ON ANYTHING. I HAVE SENT E-MAILS TO THE FOLKS THAT RUN THE PROPERTY OWNERS ASSOCIATION AND I HAVE NOT BEEN ABLE TO GET A RESPONSE. I HAD THAT QUESTION AS TO WHY THEY WORKED UP HERE FIGHTING THIS BECAUSE THE VAST MAJORITY, IF YOU TOOK A VOTE IN THE NEIGHBORHOOD, I DON'T KNOW A SINGLE PERSON THAT WOULD VOTE FOR THIS.

>> SPEAKER: YOU HAVE ONE DEVELOPER WHO HAS CONTROLLING INTEREST OVER THE PROPERTY OWNERS ASSOCIATION?

>> SPEAKER: THAT QUESTION I DON'T KNOW BUT THE CONNOR BROTHERS AND FRED BENNETT WERE INVOLVED AT THE ONSET OF IT.

I DON'T KNOW RIGHT NOW WHAT THE STATUS OF THAT IS.

I KNOW WE PAY $333 A YEAR FOR THE DUES TO THE OWNERS ASSOCIATION AND I DON'T KNOW THE ANSWER TO THAT QUESTION.

>> SPEAKER: I THINK WHAT WE ARE FACED WITH IS THIS IS PERMITTED BY RIGHT EXCEPT FOR THEY ARE ASKING FOR A PRIVATE ACCESS VERSUS A PUBLIC ACCESS. I WOULD SUGGEST THAT IF THERE IS ENOUGH OF THE PROPERTY OWNERS THAT HAVE AN ISSUE WITH THIS THAT YOU FIND THE PERSON WHO GAVE THEIR BLESSING OF THIS HAPPENING WITHIN THE PROPERTY OWNERS ASSOCIATION.

>> SPEAKER: YES, MA'AM,. THANK YOU.

>> SPEAKER: ANYONE ELSE? >> SPEAKER: I AM SCOTT PRAISED VERY I'M ON 773 NORTH DEAN ROAD, I'M AN ORTHODONTIST.

I HAVE BEEN HERE SINCE 1999. BETH, THANKS FOR THAT BIT OF INFORMATION. I AM GOING TO HAVE TO CHANGE WHAT I'M SAYING BECAUSE EVERYTHING I HAVE HEARD LEADING UP TO THIS MEETING WAS I WAS GOING TO HAVE AN OPPORTUNITY TO TRY TO PERSUADE YOU TO NOT APPROVE THIS.

IT WAS MY UNDERSTANDING THAT THE CITY COULD, DID HAVE RIGHTS WITHIN ZONING OF WHAT GOES IN DIFFERENT LOCATIONS.

I DO WANT TO POINT OUT TO THE CITY COUNCIL AND MAYOR THAT I CAN REMEMBER MOVING HERE AND IT WAS RARE THAT PEOPLE IN AUBURN WERE ABLE TO GO TO THE DOCTOR OR SPECIALIST, AND CERTAINLY DENTAL SPECIALISTS, WITHOUT LEAVING TOWN.

YOU THINK, THAT'S IMPOSSIBLE. BUT I'M PRETTY SURE THE ENDODONTIST IS ON NORTH DEAN ROAD IS THE FIRST ENDODONTIST.

THE PERIODONTIST NEXT DOOR TO ME I'M PRETTY SURE WAS THE FIRST PERIODONTIST IN AUBURN. THE TWO ORAL SURGEONS THAT ARE TWO BUILDINGS DOWN, THEY ARE THE FIRST ORAL SURGEONS TO HAVE A FULL-TIME PRACTICE IN AUBURN. THE AREA THROUGH ZONING WHEN I BOUGHT THE PRACTICE CERTAINLY ONE OF THE REASONS I BOUGHT THE LAND IS BECAUSE I FELT LIKE IF I DID THIS I WAS SECURING BUILDING A NICE SPECIALTY BUILDING. WHEN YOU BUILD A SPECIALTY DENTAL PRACTICE, YOU BUILD A VERY SPECIFIC BUILDING.

MY PRACTICE, MY BUILDING IS AN ORTHODONTIC OFFICE.

I CAN'T REALLY CONVERT IT TO ANYTHING.

JUST TWO YEARS AGO INVESTED TO REDO THAT AND FOR THE EXTERIOR AND INTERIOR. I WANT TO GIVE MY PATIENTS A GREAT EXPERIENCE AND SO I THINK EVERYBODY AROUND THIS POND THAT WOULD BE LOOKING INTO THOSE TOWNHOUSES WOULD AGREE THAT WE DID THIS WITH THE UNDERSTANDING THAT WE ARE INVESTING THIS TIME AND MONEY SO THAT WE HAVE A PROPERTY WE DON'T HAVE TO WORRY ABOUT SOMETHING LIKE THIS GOING IN.

IF YOU NEED -- I DON'T KNOW IF YOU HAVE DIAGRAMS, BUT THE POND

[00:40:02]

THAT SEPARATES THE BACK OF OUR BUILDINGS FROM THIS PROPOSED DEVELOPMENT IS NOT A LAKE. IT'S NOT A BIG POND.

IT'S JUST A BODY OF WATER THAT I COULD ASK SOMEBODY ON THE OTHER SIDE IF THEY EVER CATCH ANY FISH AND THEY COULD HEAR ME.

THIS THING GETS BUILT, AM I GOING TO HAVE THE RESIDENTS COMING OUT THE POND FISHING? I HAVE SIX PATIENT SHARES OVERLOOKING THE BACK OF THE POND AND TO HAVE A RESIDENTIAL AREA PUT IN THEIR DOES NOT FIT THE CHARACTER OF THE AREA AT ALL.

A FRIEND OF MINE, DR. TJ FUQUAY, HE'S COACHING HIS SON OUT OF TOWN AT BASEBALL TONIGHT, I WANTED TO USE HIM IN CLOSING AS AN EXAMPLE. DR. FUQUAY WENT AND BECAME AN ORAL SURGEON THROUGH HIS TRAINING AND EDUCATION AT AUBURN AT UAB. HE YOU SPENT TEN YEARS AT UAB AFTER GRADUATING FROM AUBURN. HE HAS A MEDICAL DEGREE, HE HAS A DENTAL DEGREE AND SO DOES HIS PARTNER, DR. KINSEY HEARTS.

I JUST WANT TO STRESS TO THE COUNCIL AND MAYOR WHAT A BENEFIT IT IS TO THE COMMUNITY FOR THE WELFARE OF THE COMMUNITY TO HAVE PEOPLE LIKE THAT. WE JUST CAME OUT OF COVID.

IF WE HAD HAD OUR OLD SYSTEM, WHERE WE HAD A GROUP OF ORAL SURGEONS COMING THROUGH FROM MONTGOMERY, I WOULDN'T HAVE ACCESS LIKE I DO CALLING DR. FUQUAY ARE DR. HEARTS.

DURING COVID WE WERE TRYING TO FIGURE OUT HOW TO VOTE -- HOW TO PRACTICE. THEY ARE TWO DOORS DOWN AND THEY ARE MY FRIENDS AND NEIGHBORS. IT SEEMS LIKE YOU WOULD BE CHARGED FOR PROTECTING THE WELFARE OF THE COMMUNITY TO INVEST FOR SITUATIONS LIKE THIS FOR THE LONG TERM.

IT CERTAINLY WE WOULD WANT TO ENCOURAGE SPECIALISTS, DENTISTS, DOCTORS, TO KEEP COMING TO AUBURN.

IF THIS SOMEHOW OR OTHER IS BUILT, IT WILL BE OF COURSE DISAPPOINTING. THANK YOU.

>> SPEAKER: THANK YOU. WHO WILL BE NEXT?

>> SPEAKER: MY NAME IS ALAN TAMES AN ORTHODONTIST RIGHT ADJACENT TO THE PROPERTY AT 719 NORTH DEAN ROAD.

I'VE BEEN IT FOR FIVE YEARS AND I WANT TO ECHO WHAT MY COLLEAGUES HAVE EXPRESSED AS WELL.

WHEN I BOUGHT THAT PROPERTY SEVEN YEARS AGO A LOT OF IT, YOU LOOK AT THE ZONING IN THE AREA AND WHAT CAN BE BUILT AND WHAT CAN'T BE BUILT AND WHEN YOU ARE MAKING THAT INVESTMENT IN YOUR PRACTICE AND WHAT WILL BE YOU YOU WANT TO BE A IN A BUSINESS PARK. YOU WOULD LIKE TO HAVE OTHER BUSINESSES -- IT DOESN'T HAVE TO BE ALL MEDICAL OR DENTAL BUT HAS TO BE BUSINESSES THAT ARE APPROPRIATE FOR WHERE YOU WOULD LIKE TO PRACTICE, WHERE YOU WOULD LIKE YOUR PATIENT COMING.

YOU NEVER WOULD IMAGINE HAVING APARTMENTS BUILT ALONGSIDE OF YOU. THAT WAS UNDERSTANDING.

I THOUGHT, WE HAVE ZONING AND THERE NEVER WILL BE APARTMENTS NEXT TO ME BECAUSE WE ARE IN THIS BUSINESS AREA.

INITIALLY I WAS GOING TO ASK Y'ALL AND APPEAL TO YOU TO UPHOLD THE PLANNING COMMISSION'S DECISION.

BUT A FEW WEEKS AGO AND I DON'T KNOW IT SEEMS LIKE THERE WAS A TECHNICALITY AT THE TIME, LAST TIME THE PLANNING COMMISSION VOTED UNANIMOUSLY 7-02 AT THE TIME WAS TO DENY THESE APARTMENTS TO GO IN. I DON'T KNOW IF THERE IS SOME TYPE OF DOCIA SEEMS LIKE COMMON SENSE TO ME WHERE NOBODY REALLY WANTS THESE APARTMENTS GOING IN. WE DON'T FEEL LIKE IT'S IN THE BEST -- IT'S NOT BEST FOR OUR CITY.

I HATE FOR SOME TYPE OF TECHNICALITY TO SAY OUR HANDS ARE TIED AND HE CAN'T DO ANYTHING AND WE HAVE TO LET THIS GO THROUGH. IT SEEMS LIKE THERE WOULD BE ANOTHER SOLUTION IF WE ALL PUT OUR HEADS TOGETHER TO FIGURE OUT WHAT THE BEST WAY TO MOVE FORWARD RATHER THAN JUST SAYING, WELL, THIS IS, I DON'T HAVE TO MAKE A DECISION HERE.

ANOTHER THING I WANT TO POINT OUT IS RIGHT NOW THAT PROPERTY AT KRAFT MASTERS IS 8.67 ACRES LARGE.

RIGHT NOW THEY ARE ASKING 25 UNITS TO PUT IN THE BACK OF THAT. MY CONCERN IS THAT IF THAT GETS PUT THROUGH THEY WILL PUT THAT IN AND THEN WHAT'S TO KEEP THEM A FEW YEARS FROM NOW SAYING KRAFT MASTERS, LET'S TAKE THAT DOWN AND WE WILL MAKE THAT WHOLE 8.67 ACRES ALL TOWN HOMES AND APARTMENTS AND MAKE THAT WHOLE AREA A HUGE COMMUNITY OF TOWNHOMES. THEY WOULD USE THE JUSTIFICATION FOR THAT AS WE ALREADY HAVE THESE 25 TOWNHOMES HERE, WE ALREADY HAVE THIS CITY STREET OR WHATEVER THE ACCESS IS THIS, LET'S TAKE ALL OF KRAFT MASTERS DOWN AND CONVERT THAT ALL TOWNHOMES. THAT'S MY CONCERN IS THAT TEN YEARS FROM NOW WE LOOK UP AND THERE IS AN APARTMENT COMPLEX RIGHT THERE WHERE WE USED TO HAVE A NICE MEDICAL DENTAL FACILITY BUSINESS COMMUNITY THERE.

[00:45:01]

I JUST WANTED TO APPEAL TO EVERYBODY TO FIGURE OUT WHAT THE BEST WAY TO MOVE FORWARD, WHAT'S BEST FOR THE CITY, BEST INTEREST FOR ALL OF US. THANK YOU.

>> SPEAKER: THANK YOU. >> SPEAKER: I'M KEN TAHARI AT 747 NORTH DEAN ROAD. RIGHT BETWEEN DR. TAMES AND DR. PHILLIPS WHO SPOKE ALREADY AND TWO DOORS DOWN FROM DR. SPRAYBERRY. MR. MAYOR, CITY COUNCILMEMBERS, I'M HERE TODAY ON BEHALF OF MY PARTNER DR. FUQUAY, MY ASSOCIATES AND MY PATIENTS. AND FOR MYSELF I WOULD LIKE TO EXPRESS OUR OPPOSITION TO THIS PROPOSAL.

WE HAVE BEEN THERE FOR TEN YEARS NOW, AT 747.

WHEN WE BUILT THAT OFFICE WE LOOKED AT MULTIPLE SITES UP AND DOWN NORTH DE. WE KNEW THAT WAS WHERE HE WANTED TO BE BECAUSE WHEN YOU LOOK AT THAT ROAD, IT IS MEDICAL OFFICE, DENTAL OFFICE, PHARMACY, DENTAL OFFICE, DENTAL SPECIALIST, MEDICAL OFFICE, DENTAL OFFICE. DENTAL SPECIALIST, DENTAL SPECIALIST, DENTAL OFFICE, DENTAL OFFICE.

AND WHEN YOU CROSS THE ROAD, IT'S A MIRROR IMAGE.

WE LOOKED AT MULTIPLE SITES AND WE LOOKED AT THE SURROUNDING AREAS OF THOSE SITES AND WHAT WE WERE LOOKING FOR IS PRIVACY FOR OUR PATIENTS. THIS SITE WAS UNIQUE FOR US BECAUSE IT WAS RIGHT ON THE POND THAT HAD A RIGHT ACROSS AND IT HAD OTHER MEDICAL AND DENTAL OFFICES AROUND THE POND.

THE EXCEPTION FOR THAT WAS KRAFT MASTERS WHICH WAS SITTING ON A BALLPARK EIGHT AND A HALF ACRES. WE ARE CONCERNED ABOUT THE HEALTH, SAFETY, PRIVACY AND WELFARE OF THE CENTRAL PARK BUSINESS COMMUNITY. WE ARE CONCERNED ABOUT OUR PATIENTS, WE ARE CONCERNED ABOUT OUR CUSTOMERS.

MAINTAINING THE WELFARE OF OUR OFFICE PARK INCLUDES PRESERVING THE BEAUTY AND THE NATURAL AESTHETIC OF THE AREA, WHICH IS UNIQUE TO THE CITY OF AUBURN TO HAVE A POND WITH BUSINESS OFFICES AROUND IT. THIS POND IS BEAUTIFUL, IT IS UNIQUE, AND WE WANT TO TRY TO MAINTAIN A CENTRAL PARK AS A THRIVING PROFESSIONAL DEVELOPMENT AREA.

THE POTENTIAL NEGATIVE IMPACT OF AN EXISTING AND ADJACENT PROPERTIES ARE MANY AND INCLUDE BUT ARE NOT LIMITED TO THE PRIVACY AS WELL AS EASE OF ACCESS FOR OUR PATIENTS.

IT IS A VERY BUSY ROAD ON WORKING.

ADDING 25 AND POTENTIALLY UP TO BY MY CALCULATION ON A PIECE OF CONSTRUCTION PAPER AND CRAYONS UP TO 100 TOWNHOMES ON THAT PIECE OF PROPERTY, WILL NEGATIVELY IMPACT THE ALREADY CONGESTED TRAFFIC ON NORTH DE. NOT TO MENTION THE LOGISTICAL CHALLENGES OF HAVING A RESIDENTIAL INTEREST SHARED WITH A BUSINESS DRIVEWAY AND A LOADING DOCK.

I DON'T KNOW ABOUT THE RULES OF PLANNING AND ZONING, BUT IF I GO AND BUY A PIECE OF PROPERTY, SUBDIVIDE IT AND COMPEL THE CITY TO BUILD A ROAD FOR ME TO DO WITH WHATEVER I WANT TO WITH THAT PROPERTY, I MAY BE IN THE WRONG BUSINESS.

THERE MAYBE SOME OPPORTUNITIES OUT THERE FOR ME TO DO SOME OTHER THINGS IN DEVELOPMENT. THANK YOU FOR YOUR TIME AND THE OPPORTUNITY TO REPRESENT OUR OPPOSITION TO THIS PROPOSAL.

>> SPEAKER: THANK YOU. WHO WILL BE NEXT?

>> SPEAKER: GOOD EVENING MY NAME IS TONY HIATT AND THE DEVELOPER FOR THIS APPLICATION AND PROPOSED USE FOR CONDITIONAL USE WORK I'M HERE TO TRY AND REINFORCE A FEW THINGS AND CLEAR UP SOME OF THE THINGS WE JUST HEARD.

LIKE THEY'VE ALL SAID, THIS HAS BEEN A NICE DEVELOPMENT.

IT ONLY HAS A FEW PARCELS LEFT AND IT WOULD BE CONSIDERED A GOOD QUALITY DEVELOPMENT THROUGHOUT WITH MIXED USE.

WHAT I MEAN BY THAT IS THERE IS OVER 65 BUSINESSES IN CENTRAL PARK WITH MEDICAL BEING THE MINORITY -- NOT THE MINORITY BUT LESS THEN 50 PERCENT. THERE IS A LOT OF OTHER BUSINESSES, RETAIL, DAYCARE CENTERS AND WHEN THEY PICKED THIS SITE OUT, I DON'T KNOW HOW THEY MISSED THE HUGEST BUILDING IN THE FACILITY IN THE DEVELOPMENT IS KRAFT MASTERS.

CRAFT MASTER WAS THE PIONEER. THEY WERE THE FIRST PURCHASER.

THEY PURCHASED THE PROPERTY FIRST, THE BIGGEST BUILDING, THEY HAVE THE LARGEST ACREAGE AND THEY HAVE BEEN 25 YEARS.

SOME HAVE BEEN THERE SEVEN, SOME IS 20 KRAFT MASTERS BEEN THERE OVER 25 YEARS AND WE ARE NOT ASKING TO DO ANYTHING THAT IS NOT ALLOWED WITHIN THE ZONING. WE JUST NEED A CONDITIONAL USE

[00:50:03]

TO NOT GO IN THERE AND DISTURB ANY OF THE INFRASTRUCTURE THAT IS ALREADY THERE AND REDEVELOPMENT AND MAY HAVE MORE IMPACT ON SURROUNDING PROPERTY OWNERS THEN LEAVING IT ALONE AS IT IS, WITH THE SAME RESULT IN MIND.

THE CITY WOULD NOT WANT TO MAINTAIN THIS ROAD FOR ETERNITY WHEN THEY ARE NOT GOING TO BENEFIT NO MORE THAN ALLOWING US TO UTILIZE WHAT'S THERE. WE WILL KEEP THE MAINTENANCE UP AS A PRIVATE OWNER AND YOU WILL RECEIVE THE TAX REVENUE FOREVER.

YOU WON'T HAVE THE EXPOSED TO LIABILITY.

THERE IS MORE BENEFITS THAN MAKING US RECONSTRUCT THE WHOLE DEAN ROAD. THEY MAY BE BACKUP YOUR COMPLAINING ABOUT MORE PROBLEMS AFTER THAT ABOUT NOT KNOWING WHAT WE MAY HAVE TO DO. THERE ARE SIX PAGES OF APPROVED USES FOR THIS PARTICULAR ZONING ON THE PROPERTY.

MOST ALL OF THEM ARE NOT BUSINESS, PROFESSIONAL OR DENTAL. THERE ARE MANY, MANY USES.

THIS JUST HAPPENS TO BE ONE THAT REQUIRES YOUR SUPPORT TO ALLOW US TO USE THAT ACCESS, THAT SIX PAGES OF PERMITTED USES WOULD NOT LEAVE -- NEED YOUR APPROVAL. WE ARE NOT LOOKING TO DO ANYTHING BUT CONTINUE TO TRY TO MAKE AUBURN OF THE BEST PLACES TO LIVE IN AMERICA. WE ARE NOT TRYING TO DO NOTHING EXCEPT IMPROVE EVERYONE'S PROPERTY.

THIS WILL BE A QUALITY DEVELOPMENT AND WE ARE GOING TO MOVE FORWARD WITH IT REGARDLESS, IT'S JUST A MATTER OF HOW WE GET TO THE END POINT AND THE END RESULT.

AGAIN, WE ARE NOT ASKING FOR REZONING OR VARIANCES, WE ARE JUST ASKING FOR YOUR APPROVAL TO ALLOW US TO DO WHAT IS ALLOWED.

I'M HERE TO ANSWER ANY QUESTIONS YOU MAY HAVE.

>> SPEAKER: ANY QUESTIONS FOR THE DEVELOPER? ANYONE ELSE? WE WILL CLOSE THE PUBLIC HEARING. COMMENTS OR QUESTIONS FROM THE COUNSEL? SPECTRAL QUICK, I AM A TENANT IN

THE KRAFT MASTERS BUILDING. >> SPEAKER: I'M GOING TO IMAGINE ETHICS FOR THIS WOULD REQUIRE ME TO ABSTAIN FROM ANY VOTING IN THIS WOULD AFFECT MY TENANCY AND COULD AFFECT -- POTENTIALLY AFFECTS. I WILL ABSTAIN FROM ANY

DELIBERATION OR VOTING. >> SPEAKER: I DO HAVE A FEW QUESTIONS. IS THIS LOT, WE TREAT -- WE KEEP TALKING ABOUT EIGHT-POINT HOWEVER MANY ACRES.

IS THIS LOT SUBDIVIDED? >> SPEAKER: NO, IT IS NOT.

>> SPEAKER: IT'S ONE LOT. >> SPEAKER: OKAY.

IF WE WERE. (LOSS OF AUDIO) DENY THIS CONDITIONAL USE APPROVAL, IN ORDER TO BUILD TOWNHOMES THAT ARE PERMITTED BY RIGHT, WHAT WOULD BE THE STEPS THAT WILL BE REQUIRED OF THE APPLICANT?

>> SPEAKER: THEY WOULD NEED TO DO A PRELIMINARY PLAT AND ADD A PUBLIC STREET. THE TOWNHOMES WOULD NEED TO HAVE

ROAD FRONTAGE. >> SPEAKER: LET ME CLARIFY WITH THAT. I NEED THE COUNSEL TO BE CLEAR BECAUSE YOU DON'T PUT THIS ON ANOTHER PROJECT.

THE CITY DOES NOT HAVE AN INTEREST IN MAINTAINING AND OWNING A ROAD THAT GOES TO NOWHERE FOR A SMALL DEVELOPMENT THROUGH ANOTHER PROJECT. AND SO IT IS NOT NECESSARILY -- WE ARE NOT NECESSARILY COMPELLED TO ACCEPT A RIGHT-OF-WAY.

THIS IS NOT ONE OF THE STAFF IS HAD AN OPPORTUNITY TO EVALUATE.

WE HAVE NO PLANS FOR THE PUBLIC RIGHT-OF-WAY ON IT.

NONE. THERE WAS A CASE ON TWIN FORKS WHERE WHAT YOU DEALT WITH THIS PREVIOUSLY.

THAT DEVELOPMENT ABUTTED TWIN FORKS AND COULD HAVE BRANCHED OFF OF THAT AND SUBDIVIDED DIFFERENTLY.

BUT I WANT TO BE CLEAR, WE HAVE NOT EVALUATED THIS.

THEY USE BEFORE YOU HAS NOTHING TO DO WITH DEDICATING A PUBLIC RIGHT-OF-WAY AT THIS TIME. WE HAVE NOT EVALUATED SETBACKS.

CAN KRAFT MASTERS TO BE CONFORMING? CAN WE MEET IMPERVIOUS SURFACE RATIO? I BELIEVE THAT ABSOLUTELY THE APPLICANT IS LOOKING AT THAT BUT STAFF IS HAVE NOT ANY OPPORTUNITY TO EVALUATE IT AND I CANNOT TELL YOU AT THIS STAGE THAT STAFF WOULD RECOMMEND THAT COUNSEL ACCEPT ANY PUBLIC RIGHT-OF-WAY FOR PROJECT LIKE THIS. THIS IS NOT SOMETHING WE LIKE TO GET INTO THE MAINTENANCE OF IF WE DON'T NEED TO.

THIS IS DEEP INTO THE BACK OF THE LOT.

UNTIL WE HAVE HAD A CHANCE TO EVALUATE THAT, WE ALSO TRY VERY HARD FOR YOU TO DEAL WITH THE PROJECT THAT IS BEFORE YOU NOT WHAT MIGHT COME BEFORE YOU ARE MIGHT BE SUBMITTED TO STAFF AT A LATER DATE THAT COULD BE PERMITTED BY RIGHT IF IT MEETS ALL OF OUR CRITERIA. THAT IS A WAYS OFF.

>> SPEAKER: IS THERE DENSITY BASED OFF OF THE 8. X ACRES?

>> SPEAKER: IT WOULD BE. BEFORE IT WAS SUBDIVIDED, SURE.

THE MAXIMUM DENSITY FOR THAT WHOLE 8 ACRES IS 82 UNITS.

[00:55:07]

BUT THAT IS UTILIZING THE ENTIRE 8 ACRES.

>> SPEAKER: IF IT WERE TO BE SUBDIVIDED, ARE THEY WITHIN THE DENSITY REQUIREMENTS OF WHAT THAT ACTUAL --

>> SPEAKER: THEY WOULD BE WITHIN THAT DENSITY BUT AS THE CITY MANAGER STATED, WE HAVE NO IDEA HOW BIG THE LOT WOULD BE NOW THAT THEY ARE CONTEMPLATING PUTTING IN A NEW RIGHT-OF-WAY.

>> SPEAKER: I AM NOT SAYING THEY CANNOT MAKE IT WORK, BUT WITHOUT THAT EVALUATION LENS, WE DO NOT HAVE THAT INFORMATION TO PROVIDE YOU AS YOU CONTEMPLATE THIS THIS EVENING.

A PUBLIC RIGHT-OF-WAY THAT GOES RIGHT THROUGH SOMEONE'S PARKING LOT BEGS A LOT OF QUESTIONS THAT HAVE TO BE ANSWERED AND YES THERE MAYBE TIMING WHERE THAT CAN BE SOLVED FOR BUT WE DON'T HAVE THAT INFORMATION THIS EVENING FOR YOU.

>> SPEAKER: MACON, CAN YOU CLARIFY FOR THE COUNCIL EXACTLY WHAT DECISION WE ARE BEING ASKED TO MAKE TONIGHT.

>> SPEAKER: YOU ARE BEING ASKED TO MAKE A CONDITIONAL USE APPROVAL FOR WHAT WE CALL A MULTIUNIT DEVELOPMENT WHICH IS A PERFORMANCE RESIDENTIAL DEVELOPMENT AND A COMPREHENSIVE DEVELOPMENT DISTRICT AND THAT MULTIUNIT DEVELOPMENT WE REFER TO AS CONDOMINIUMS. MULTIUNIT DEVELOPMENT CAN BE APARTMENTS, TOWNHOUSES, WHAT HAVE YOU.

THE ARCHITECTURAL STYLE OF THIS IS VERY MUCH A TOWNHOUSE BUT A TOWNHOUSE DEFINED IN THE CITY OF AUBURN ZONING ORDINANCES WON ON A FEE SIMPLE LOT WHICH MEANS IT'S ON A PUBLIC STREET AND HAS BEEN SUBDIVIDED AND YOU OWN THE LAND UNDER YOUR UNIT, FEE SIMPLE AS OPPOSED TO A CONDOMINIUM STYLE.

I KNOW THAT'S MORE OF A REAL ESTATE LANGUAGE THAT YOU WANT TO KNOW BUT IT IS A STATE EXTINGUISHING ACTOR IN OUR ORDINANCE AND THERE ARE TIMES THAT STAFF HAS NOT RECOMMENDED APPROVAL OR ACCEPTANCE OF A PUBLIC RIGHT-OF-WAY.

AGAIN, NOT SAYING WE WOULD OR HE WOULDN'T, BUT WITHOUT AN EVALUATION WE DO NOT KNOW. THIS ALLOWS ACCESS TO THIS PROPERTY DIRECTLY THROUGH THE CRAFT MASTER PROPERTY.

YOU WOULD CALL IT A CROSS ACCESS EASEMENT.

THOSE AREN'T ABNORMAL AND COMMERCIAL DEVELOPMENTS AT ALL.

THE OTHER THING IS THE LAND USE PLAN CALLS THIS OFFICE PARK AND SO THE REASON THAT RESIDENTIAL USES ARE ALLOWED IN THAT ZONE PER THE TABLE OF PERMITTED USES HAS EVERYTHING TO DO WITH THE FACT THAT THE COMPREHENSIVE DEVELOPMENT DISTRICT IS THE BROADEST ZONING DISTRICT IN THE CITY.

THAT'S WHY CRAFT MASTER IS ALLOWED THERE BECAUSE IT IS LIGHT MANUFACTURING AS WE WOULD CONSIDER IT IN THE ZONING ORDINANCE AT THE TIME. THAT PROJECT IS ALSO THERE BECAUSE THAT IS THE REASON THAT CENTRAL PARK GOT BUILT.

WE GOT AN INDUSTRIAL ACCESS GRANTS FROM THE STATE OF ALABAMA BECAUSE CRAFT MASTER QUALIFIED AS AN INDUSTRY AND THAT HELPED THE FIRST SECTION OF THE ROAD. DEVELOPMENT GROUP THEN, THE CITY ACTUALLY BUILT THE WHOLE ROAD AND THE DEVELOPMENT GROUP PAID THE CITY BACK FOR WHAT WAS NOT GRANT FUNDED MINUS THE CENTER TURN LANE TO PREPAY FOR THE THIRD LANE ALL THE WAY DOWN THAT ROAD. THE CITY BORROW THE MONEY, PAID FOR THE ROAD TO BE EXTENDED BECAUSE WE NEEDED OPELIKA RD.

AND EACH UNIVERSITY DRIVE TO CONNECT.

WE PAY FOR THAT AND THEN THEY PAID US BACK MINUS THE INDUSTRIAL ACCESS GRANTS. THAT'S HOW THAT GOT BUILT.

IT DOES ALLOW A VARIETY OF USES. THERE IS NO QUESTION.

BUT I TELL YOU AS A PERCENTAGE OF OUR LAND USE, OFFICE PARKS ARE VERY LOW BUT WE DON'T HAVE A LARGE -- WE DON'T HAVE A LOT OF LAND USE IN AUBURN SLATED FOR OFFICE PARK BECAUSE YOU LIKE TO GROUP THEM TOGETHER. BUT CERTAINLY AND ACKNOWLEDGE THERE IS RESIDENTIAL ABUTTING THIS AREA.

THERE IS RESIDENTIAL ON EDGES OF THIS.

THERE IS AN ASSISTED LIVING FACILITY.

THERE IS OTHER PARTS OF CENTRAL PART OF ELEMENT THAT INCLUDE HOUSING. THERE IS NO QUESTION THAT HOUSING EXISTS THERE AND A MIX OF USES AS YOU HEARD EXIST.

BUT THE LAND USE PLAN DEEMED -- DEEMED THIS BECAUSE OF THE

LIMITED USE NATURE. >> SPEAKER: A COUPLE MORE COMMENTS. AN ADDITIONAL CONCERN I HAVE, AND I DID SPEAK WITH AN APPLICANT, IS THE DENSITY OF THIS PROPOSAL. I WOULD BE MORE INCLINED TO BE CONCERNED FOR THE RESIDENTS THAT WOULD DESIRE TO LIVE THERE WITH THE LIGHT INDUSTRIAL USE OF A PRINTING COMPANY RIGHT IN LITERALLY IN THEIR BACKYARD. ADDITIONALLY, I WOULD ALSO -- THIS IS THE SECOND TIME IN MY TENURE THAT WE HAVE SEEN THE PROPERTY OWNERS NOT IN FAVOR OF RESIDENTIAL IN CENTRAL PARK.

I ASKED QUESTIONS BEFORE WITH TWIN FORKS IF THE PROPERTY OWNERS HAD A VOTE. THE QUESTION WAS -- THE ANSWER THEN WAS THE SAME AS TODAY. WE DON'T REALLY KNOW.

SO I THINK THIS COULD HAVE BEEN HEADED OFF AT THE PASS IF THERE WAS A MORE COLLECTIVE VOICE OF THE PROPERTY OWNERS OF CENTRAL PARK. I WOULD ENCOURAGE THOSE PROPERTY OWNERS TO MAYBE ORGANIZE BETTER WITHIN YOUR PROPERTY OWNERS ASSOCIATION SO THAT IN THE FUTURE IF THINGS COME BEFORE US

[01:00:01]

YOU WILL HAVE A BETTER UNDERSTANDING OF WHAT CAN AND CAN'T BE BUILT WITHIN YOUR OWN COVENANTS.

I AM CONCERNED ABOUT THE RESIDENTS THAT COULD POTENTIALLY LIVE THERE. I'M CONCERNED ABOUT THE FACT THAT THIS IS A USE THAT IS NOT PART OF THE LAND USE FOR THAT ACTUAL SECTION OF THIS SECTION OF DEAN ROAD.

AND FOR THOSE REASONS I WON'T BE SUPPORTING THIS CONDITIONAL USE

APPROVAL. >> SPEAKER: MEGAN, CAN WE GET A FLAVOR OF WHAT THE PLANNING COMMISSION THOUGHTS WERE.

MAYBE SOME OF THE COMMENTS OR THOUGHTS.

>> SPEAKER: ABSOLUTELY. I WILL HAVE ACTING PLANNING DIRECTOR EXPLAINED THAT. I ALSO THINK IN YOUR PACKET YOU TALKED ABOUT STAFF RECOMMENDED DENIAL BASED ON THE LAND USE BUT ALSO TO WHAT COUNCILPERSON WITTEN SAID, THE RECOMMENDATION OF THE DENIAL ALSO HAD TO DO WITH INCOMPATIBILITY WITH THE ADJACENT USE SPECIFICALLY THAT CURRENTLY AS IT SITS TODAY CRAFT

MASTER'S POLISHING PLANT. >> SPEAKER: I CANNOT RECALL COMPLETELY WHAT THE PLANNING COMMISSION INDIVIDUAL COMMENTS WERE. AS A WHOLE EVERYONE AGREED THAT THIS PROPOSED USE WAS NOT IN KEEPING WITH THE SURROUNDING NEIGHBORHOOD AND BEING SO CLOSE TO CRAFT MASTER'S, THERE WAS A POTENTIAL FOR NUISANCES SUCH AS LIGHT AND TRAFFIC FROM THE SEMI

TRUCKS THAT FREQUENT THERE. >> SPEAKER: THANK YOU, KATIE.

ANYBODY ELSE LIKE TO ASK ANY QUESTIONS?

>> SPEAKER: JUST TO BE CLEAR, WE ARE BEING ASKED TO DO IS THE DIFFERENCE BETWEEN CONDOMINIUMS AND TOWNHOMES.

IS THAT -- >> SPEAKER: THE END PRODUCT MAY LOOK THE SAME OUTSIDE TO THE AVERAGE PERSON.

THE DIFFERENCE IS THE NOTION OF A PUBLIC STREET IS NOT SOLVED.

IF IT'S A TOWNHOME IT HAS TO BE A PUBLIC RIGHT-OF-WAY OR CANNOT BE A TOWNHOME AT THIS NIGHT -- DEFINED BY OUR ORDINANCE.

WE CAN'T TELL YOU IS WHETHER OR NOT STAFF WOULD EVEN RECOMMEND APPROVAL OF THE RIGHT-OF-WAY IN THIS LOCATION.

THERE IS A LOT OF ANALYSIS THAT HAS TO BE DONE.

THAT IS THE MAIN DIFFERENCE. HE WOULDN'T SEE ANYTHING ABOUT A TOWNHOME UNTIL RIGHT-OF-WAY DEDICATION CAME BEFORE YOU.

CONDOMINIUMS ARE CONDITIONAL. >> SPEAKER: SO THE DEVELOPER IS STATED THEY ARE GOING TO BUILD SOMETHING THAT LOOKS LIKE ONE IN THE SAME NO MATTER WHAT WE VOTE TONIGHT.

>> SPEAKER: I DON'T KNOW THAT THEY ARE GOING TO BUILD TO BECAUSE I DON'T KNOW -- WHAT I MEAN FROM A REGULATORY STANDPOINT WITHOUT ANOTHER PLAN SUBMITTED IN THESE ALL OF OUR CRITERIA, I CAN'T TELL YOU THAT THEY CAN'T TELL YOU -- BUILD TOWNHOMES. WE CAN'T -- WE DON'T HAVE THAT

INFORMATION. >> SPEAKER: BUT IT IS PERMITTED

BY RIGHT? >> SPEAKER: ABSOLUTELY THIS.

>> SPEAKER: ANY OTHER COMMENTS OR QUESTIONS?

>> SPEAKER: EVEN THOUGH IT IS PERMITTED BY RIGHT THE TOWNHOMES, THEY HAVE TO A FRONT A PUBLIC RIGHT-OF-WAY.

>> SPEAKER: THERE'S GOING TO HAVE TO BE A PUBLIC RIGHT-OF-WAY

>> SPEAKER: CERTAIN REQUIREMENTS.

>> SPEAKER: CORRECT. >> SPEAKER: TO GET THEIR PUBLIC RIGHT-OF-WAY. SO EVEN THOUGH IT'S PERMITTED BY RIGHT, THEY STILL HAVE THE HURDLE OF THE PUBLIC

RIGHT-OF-WAY. >> SPEAKER: THIS IS NOT BEING PROPOSED ON THE DEAN ROAD SIDE OF THE CRAFT MASTER PLAN THAT ABUTS THE RIGHT-OF-WAY. THE NEW PLAN WOULD HAVE TO BE COMPLETELY DESIGNED, BUILT AND WHAT HAVE YOU AND THE CITY ENGINEER WOULD HAVE TO RECOMMEND THAT IT BE A PUBLIC RIGHT-OF-WAY AND WE ARE NOT THERE. THAT'S NOT THE PROPOSAL THAT STAFF HAS AT THIS TIME. ABSOLUTELY THE APPLICANT HAS INDICATED THAT THEY ARE WORKING ON BUT WE ARE NOT THERE.

>> SPEAKER: TOMMY? >> SPEAKER: JAY AND I ARE THINKING ALIKE TONIGHT. I DO THINK THAT CENTRAL PARK MEDICAL AREA IS A GYM. I GREW UP HERE AND WE HAD A HANDFUL OF DOCTORS AND DENTISTS AROUND.

I HAD THE DISTINCT PLEASURE OF BEING IN DR. FUQUAY'S CHAIR LOOKING OUT AT THE POND. I'M GOING TO DEFAULT TO LAND USE AND GENERAL CONTINUITY OF THE NEIGHBORHOOD TO NOT VOTE IN FAVOR. DO THINK THAT THERE ARE HURDLES TO BE HAD AND I THINK BETH HAS MADE IT VERY CLEAR AND RIGHTFULLY SO THAT THE NEIGHBORHOOD REALLY SHOULD BE PROTECTING YOU IN THIS USE AND FOR CONTINUITY ISSUE.

IT'S KIND OF WHERE WE ARE. THAT'S MY TWO CENTS.

>> SPEAKER: ANYONE ELSE? >> SPEAKER: I WOULD SAY THAT I HAVE A DIFFERENT OPINION ON THIS.

I AM SUPPORTIVE OF IT. I MAY BE THE ONLY ONE THAT IS SUPPORTIVE OF THIS TONIGHT. BUT IF YOU THINK OVER THE PAST YEAR OR SO, BUSINESSES ARE NOT GOING TO BE THE WAY THEY USED TO

[01:05:06]

BE. I THINK THAT WE HAVE ALSO SEEN A SHORTAGE OF HOMES IN THIS AREA IN AUBURN AND THAT IS WHY I AM SUPPORTIVE OF THIS. I THINK THAT AS WE MOVE FORWARD IN THE YEARS, YOU WILL SEE MORE PEOPLE WORKING FROM HOME AND THAT KIND OF THING. THAT'S JUST KIND OF WHAT I SEE.

THERE IS THE DENTIST AND MEDICAL OFFICES ARE ALWAYS GOING TO BE HERE. I DO THINK THAT THIS IS A GOOD FIT. IT ABUTS NEXT TO OTHER EXISTING HOMES AND PROPERTIES IN THE AREA I AM SUPPORTIVE OF THIS.

>> SPEAKER: ANYONE ELSE? THIS IS A RESOLUTION.

WE HAVE A MOTION AND SECOND. WE HAVE THE PUBLIC HEARING AND DISCUSSION. THIS WILL BE A VOICE VOTE.

ALL IN FAVOR OF THIS PLEASE SAY AYE.

>> SPEAKER: AYE. >> SPEAKER: ALL OPPOSED, PLEASE

SAY NAY. >> SPEAKER: NE.

>> SPEAKER: THERE WERE SIX. >> SPEAKER: MAYOR THOSE ARE ALL OF THE ITEMS OF BUSINESS WE HAVE FOR YOU THIS EVENING.

[12. CITIZENS’ OPEN FORUM.]

>> SPEAKER: AT THIS TIME WILL OPEN UP THE CITIZENS OPEN FORM.

THIS IS YOUR OPPORTUNITY TO SPEAK TO THE CITY COUNCIL BUT ANYTHING THAT MIGHT BE ON YOUR MIND.

PLEASE GIVE US YOUR NAME AND ADDRESS FOR THE RECORD AND WE WILL GIVE YOU THREE MINUTES TO SPEAK TO US.

>> SPEAKER: MY NAME IS NOTA AND >> SPEAKER: CAN YOU GIVE US AN

ADDRESS. >> SPEAKER: (INDISCERNIBLE) YOUR GRANDPARENTS NEIGHBORS. I WONDER WHAT IS HAPPENING WITH THE INDOOR POOL. I AM MISSING.

>> SPEAKER: YOU HEARD US SPEAK. WE ALLUDED EARLIER ON THE PUBLIC HEALTH -- PUBLIC WORKS AND BUY MODEL SERVICES AND AREA WE WERE HOPING TO GROW SOME OF OUR PARKS & RECREATION IS IS THAT AREA THAT YOU WOULD ACCESS ALSO -- OFF OF DONAHUE DRIVE NEAR BOYKIN COMMUNITY CENTER. WE ARE IN THE PROCESS OF WORKING THROUGH THAT. I WILL LET THE CITY MANAGER CLEAN THIS UP. WE ARE WORKING TOWARD THAT RIGHT NOW. MEGAN, CAN YOU TELL US WHERE WE ARE WITH THE PUBLIC WORKS ENVIRONMENT OF SERVICES?

>> SPEAKER: AS SIGNALED WITH THE INDOOR POOLS AND BASICALLY AROUND DECEMBER 2019 WHEN THE DISCUSSION BEGAN.

WE WENT INTO COVID BUT WE STILL DID A BIENNIAL BUDGET LAST SUMMER AND IN THE BIENNIAL BUDGET LAST SUMMER THE BOYKIN COMMUNITY CENTER PROJECT, WE CALLED IT THE BOYKIN CAMPUS, WAS MOVED UP. IN ORDER TO FACILITATE THAT PROCESS WE FIRST HAD TO SUSPEND THIS FISCAL YEAR, FISCAL 2021 DESIGNING ENVIRONMENTAL SERVICES AND PUBLIC WORKS AND IT INCLUDES OUR FLEET SERVICES WHICH IS ACROSS DONAHUE.

A LARGE AND MASSIVE RELOCATION PROCESS FOR THOSE TWO DEPARTMENTS AND DIFFERENT DIVISIONS TO RELOCATE OUT TO WIRE ROAD. THAT DESIGN IS NEAR COMPLETION IN THAT PROJECT IS NEARING TO GO OUT TO BID.

ONCE THAT IS OUT TO BID, AND UNDER CONSTRUCTION WE WILL BEGIN A DESIGN OF THE BOYKIN CAMPUS PROJECT WHICH INCLUDES MULTIPLE POOLS, A LIBRARY, A MUSEUM, GYMNASIUM SPACE, WORKOUT SPACE, ALL KINDS OF THINGS. WE WILL BEGIN THAT DESIGN BASICALLY IN THE FALL OF WE CALL IT FISCAL YEAR 2022 BUT IT'S THE FALL OF CALENDAR YEAR 21. IT WILL TAKE A PROXIMALLY ONE YEAR TO DESIGN AND THEN WE WILL GO OUT TO BID.

WE WOULDN'T BE UNDER CONSTRUCTION AND WE HAVE TO MOVE ENVIRONMENTAL SERVICES AND PUBLIC WORKS.

WE WOULD BE UNDER CONSTRUCTION SOMETIME IN 2023 AT THE EARLIEST WITH SUCH A COMPLEX, DELIVERING SOMETIME IN 2024 OR SOMETIME IN FISCAL 2024, CALENDAR YEAR 2024. WE ARE THREE TO FOUR YEARS OUT AT THE FASTEST THAT WE CAN DO WITH THIS COMPLEX DELIVERY.

WE DO HAVE FISCAL CHALLENGES THAT COME WITH THIS.

THIS IS SOMETHING WE WILL BE DEALING WITH THIS SUMMER WITH THE COUNCIL AND ARE MID BIENNIUM BUDGET ADJUSTMENTS.

THERE IS NOT A TIME FRAME IN WHICH YOU CAN DELIVER A INDOOR POOL FACILITY BECAUSE WE HAVE TO MOVE OTHER CITY FACILITIES THAT ARE IN THE WAY OF THIS PROCESS -- PROJECT.

>> SPEAKER: THANK YOU. >> SPEAKER: IF YOU HAVE ANY OF THE FIRST QUESTIONS -- FOR THE QUESTIONS WE WOULD BE HAPPY TO ANSWER THEM. ANYONE ELSE? TO A HAVE TO MOVE TO ADJOURN?
