[4. MAYOR AND COUNCIL COMMUNICATIONS]
THE MAYOR'S ANNOUNCEMENTS TONIGHT I WANT TO SAY THANK YOU TO THE STAFF AT THE AUBURN HOUSING AUTHORITY AND OUR PUBLIC SAFETY STAFF FOR CONDUCTING NIGHT OUT LAST NIGHT OVER AT THE RIDGECREST APARTMENTS. WHAT A BEAUTIFUL EVENING WITH BEAUTIFUL WEATHER. WE HAD A NUMBER OF VENDORS THERE IT WAS A VERY POSITIVE EVENT AND I'M GRATEFUL FOR EVERYBODY'S EFFORTS AND TIME TO MAKE THAT HAPPEN.THE CHILDREN WERE HAVING A GREAT TIME.
THERE WERE SOME BICYCLES THAT WERE GIVEN AWAY AND A LOT OF FUN HAD. THINK IT'S EVERYBODY THAT MADE THAT HAPPEN. REMINDING EVERYONE THAT TRICK-OR-TREAT IS ON SUNDAY THE 31ST THIS YEAR AND THAT IS CERTAINLY A BIT DIFFERENT SITUATION FOR US TO HAVE TRICK-OR-TREAT ON A SUNDAY NIGHT.
REMIND OUR COMMUNITY TO BE MINDFUL THAT CHILDREN AND FAMILIES WILL BE OUT WALKING AROUND AND PLEASE BE CAREFUL AS YOU GO ABOUT YOUR BUSINESS ON SUNDAY EVENING.
WE ALSO LOOK FORWARD TO HAVING THE DOWNTOWN TRICK-OR-TREAT EVENT AS WE ALWAYS DO. AUBURN HIGH SCHOOL HAS A BIG GAME THIS FRIDAY NIGHT WITH ENTERPRISE.
IT IS HOMECOMING AND IT IS A BIG GAME FOR THE REGION IN THE PLAY OF HOPE. I KNOW THERE IS A PARADE HERE THIS WEEK AS WELL AND JUST ENCOURAGE PEOPLE IF YOU DON'T HAVE ANYTHING TO DO THIS WEEKEND TO WATCH AUBURN HIGH TIGERS ON FRIDAY NIGHT PARTICIPATE AGAINST THE ENTERPRISE WILDCATS.
REMINDING OUR COMMUNITY THAT ONE WEEK FROM LAST NIGHT THIS COMING MONDAY NIGHT IS THE STATE OF THE CITY AT THE PERFORMING ARTS CENTER. IS A FREE EVENT OPEN TO ANYONE IN OUR COMMUNITY FOR YOU TO COME AND LEARN EVERYTHING THAT IS BEEN GOING ON IN YOUR CITY OVER THE PAST YEAR.
WE WILL ALSO RECOGNIZE WITH THE MAYOR'S LAMPLIGHT AWARD SIX INDIVIDUALS IN OUR COMMUNITY WHO ARE DOING OUTSTANDING THINGS TO SUPPORT AUBURN DURING THIS TIME. WE ANNOUNCED TODAY AND YOU MIGHT HAVE SEEN A PRESS RELEASE ABOUT OUR TOY DRIVE CONDUCTED THROUGH OUR PUBLIC SAFETY. I THINK -- I THANK THEM AGAIN FOR DOING THIS EACH AND EVERY YEAR.
YOU HAVE AN OPPORTUNITY IF YOU WOULD LIKE TO SIGN YOUR CHILDREN UP TO REGISTER YOUR CHILD TO RECEIVE A TOY.
I BELIEVE IT IS FOR AGES TWO THROUGH EIGHT AND IF YOU HAVE A TOY THAT SHE WOULD LIKE TO DROP OFF IN EITHER THE POLICE DEPARTMENT OR THE AUBURN FIRE STATION, PLEASE DO THAT SO WE CAN SUPPORT SOME GREAT KIDS IN OUR COMMUNITY HERE DURING THE HOLIDAYS. ALL OF THE INFORMATION ABOUT THIS IS ON THE CITY'S WEBSITE. TOMORROW I WILL BE PARTICIPATING IN AN EVENT AT THE EAST OF ALABAMA FOOD BANK AND I HAVE A PRESS RELEASE THAT WAS PUT OUT BY PUBLIC AFFAIRS STAFF TODAY.
I FEEL LIKE IT IS WORTH READING BECAUSE THE ACCOMPLISHMENTS AND WHAT HAS HAPPENED WITH THIS PROGRAM IS REALLY OUTSTANDING.
TOMORROW I WILL JOIN THE FOOD BANK OF EACH ALABAMA AT THE WALMART DISTRIBUTION CENTER IN OPELIKA TO CELEBRATE OVER 20 MILLION POUNDS OF FOOD THAT HAD BEEN DONATED BY THE WALMART DISTRIBUTION CENTER IN JUST OVER 20 YEARS.
THAT IS ENOUGH FOOD TO FILL 800 18 WHEELERS AND PROVIDE 15.4 MILLION MEALS TO HELP FIGHT FOOD INSECURITY IN EAST ALABAMA OVER THE LAST TWO DECADES. THIS EVENT WILL INCLUDE A JOINT PROCLAMATION BETWEEN MYSELF AND MAYOR GARY FULLER AS THE FOOD BANK OF EAST ALABAMA EXTENDS A SINCERE THANKS TO THE WALMART DISTRIBUTION CENTER FOR THEIR GENEROSITY.
MARTHA HANKS SENT OF THE VERY FIRST TRUCK FROM THE WALMART DISSOLUTION CENTER TO PICK UP THEIR FIRST DONATION IN JUNE OF 20 OUGHT TO. I DON'T THINK SHE EVER DREAMED THAT WE WOULD BE CELEBRATING 20 MILLION POUNDS OF FOOD DONATION 21 YEARS LATER. THE CITY OF AUBURN HAS A LONG PARTNERSHIP WITH THE FOOD BANK OF EAST ALABAMA GOING ALL THE WAY BACK TO MAYOR JAN DEMPSEY WHO STILL SITS ON THE FOOD BANK BOARD. IN THE '90S THE FOOD BANK WAS ACTUALLY HOUSED IN AUBURN'S OLD POST OFFICE WHICH TODAY IS CITY HALL. THANK YOU TO THE FOOD BANK FOR ALL THEY DO TO FIGHT HUNGER HERE IN AUBURN AND EAST ALABAMA.
THANK YOU TO THE WALMART DISTRIBUTION CENTER AND OPELIKA FOR GIVING SO MUCH TO OUR GREAT COMMUNITY.
I ALSO WANT TO NOTICE THAT OVER THE WEEKEND WE OPENED A NEW PARK HERE IN AUBURN, THE DINIUS PARK. I ENCOURAGE EVERYONE TO VISIT THIS VERY UNIQUE LITTLE JUUL RIGHT HERE IN THE MIDDLE OF OUR TOWN AND WE THINK -- THINK THE DINIUS FAMILY FOR THE GIFT TO OUR CITY AND BECKY, THANK YOUR STAFF ARE GETTING IT READY AND WE LOOK FORWARD TO HAVING MANY WONDERFUL OPPORTUNITIES AND EXPERIENCE IS OUT THERE. I WANT TO SAY A SPECIAL BIRTHDAY TO COUNCILMAN TOMMY DAWSON. I WON'T TELL ANYBODY HOW OLD YOU
ARE, BUT HAPPY BIRTHDAY TO YOU. >> SPEAKER: THANK YOU, SIR.
>> SPEAKER: ANY OTHER COUNCIL MEMBERS HAVE AN ANNOUNCEMENT THEY WOULD LIKE TO MAKE? TOMMY DAWSON, I WILL TURN IT
[00:05:01]
OVER TO YOU. >> SPEAKER: WE HAD A WARD EIGHT MEETING LAST NIGHT AT KEISEL PARK.
WE HAD A GOOD TURNOUT AND GREAT MEETING IN A COUPLE OF DEVELOPERS OUT TO LOOK AT SOME PROJECTS IN AUBURN.
ONE OF THEM BEING AN ASSISTED LIVING FACILITY WITH A SENIOR CITIZEN NEIGHBORHOOD BEHIND IT. IT WOULD BE AT THE CORNER OF WIRE AND COX ROAD. EXCITED ABOUT THAT.
IT SEEMS TO BE A PRETTY GOOD PROJECT SO LOOKING FORWARD TO SEEING WHAT COMES OF THAT. JUST ENCOURAGE IF YOU HAVE ANY QUESTIONS LET ME KNOW. I WOULD BE GLAD TO ANSWER THEM FOR YOU AS BEST I CAN. IT WAS A GREAT TIME.
>> SPEAKER: THANK YOU. ANYONE ELSE?
>> SPEAKER: IT WAS REPORTED TO ME THAT A YOUNG CHILD FELL INTO A POOL AT THE NORTH TOWN SUITES -- THE INTOWN SUITES ON COMMERCE DRIVE. THERE WAS AN 11-YEAR-OLD YOUNG MAN, ZACHARY BRYANT I RECOGNIZE THAT THE CHILD WAS IN SOME KIND OF DISTRESS AND HE JUMPED IN TO RESCUE THAT CHILD.
I JUST WANT TO COMMEND PUBLICLY ZACHARY BRYANT FOR HIS SWIFT ACTIONS AND HIS COMPASSION AND HIS KNOWLEDGE IN WHAT IT TOOK TO HELP THAT YOUNG MAN. THE SECOND ONE IS THAT I HAVE BEEN ADVISED THAT COUNCILMAN DIXON'S LAWSUIT AGAINST THE CITY REGARDING SHORT-TERM RENTALS HAS NOW COST THE CITY $32,109.16.
THAT IS AS OF THE 30TH OF SEPTEMBER.
>> SPEAKER: ANYONE ELSE ON THE COUNCIL OF AN ANNOUNCEMENT THEY
WOULD LIKE TO MAKE? >> SPEAKER: I WILL BE HOLDING A WARD SIX MEETING ON NOVEMBER THN MEETING ROOM HERE ON CROSS STREET. CITY MANAGER A GALLON CROUCH WILL BE -- MCALLEN CROUCH WILL BE A GUEST OF HONOR THAT NIGHT AND I APPRECIATE YOU SPENDING SOME TIME WITH US AND ANSWERING ANY QUESTIONS THAT THE CONSTITUENTS MAY HAVE.
THANKS A LOT. >> SPEAKER: IF I MAY, THE COUNCIL AND UPON THE RETIREMENT OF THE PREVIOUS CITY MANAGER NAMED WHAT USED TO BE THE LIBRARY, A MEETING ROOM WHERE THE COUNCIL YOU TO HOLD COMMITTEE OF THE WHOLE AND PUBLIC SAFETY USED FOR MANY TRAINING THINGS IN THAT BUILDING. WE HAVE REVAMPED THAT SPACE AND IT IS A VERY NICE SPACE TO REUSE OF EDUCATION FOR EMPLOYEES BUT WAS ALSO ATTENDED FOR THINGS LIKE BOARD MEETINGS.
WE NOW HAVE AMPLE PARKING HERE AND OTHER WHEN WE ARE DOING STUDY SESSIONS AND OTHER THINGS IT IS A BIGGER SPACE WITH A LOT OF WINDOWS AND LIGHTS. WE ARE HAPPY TO HOST OTHER WARD MEETINGS THERE IF THAT'S WHERE YOU CHOOSE TO HOST THEM.
THE LIBRARY IS BEEN WONDERFUL AND TYLER DOES A GREAT JOB AT THAT SPACE. JUST LET US KNOW AND WE WILL BE
HAPPY TO SCHEDULE IT. >> SPEAKER: THANK YOU.
>> SPEAKER: ANYONE ELSE? >> SPEAKER: I HAVE A COUPLE.
ONE, THE ROUNDABOUT AT 147 IS OPERATING SMOOTHLY.
I BELIEVE WE HAVE HAD LIMITED INCIDENTS.
>> SPEAKER: I THINK WE HAD ONE MINOR FENDER BENDER, WHICH IS A LOT BETTER THAN WHAT WE TYPICALLY SEE AT THAT INTERSECTION WITH HIS OTHER ACCIDENTS.
>> SPEAKER: HOPEFULLY EVERYBODY IS USING THAT AND ABLE TO TRAVERSE THAT AREA. SADLY, OUR COMMUNITY LOST A GIANT PRESENCE WITH THE PASSING OF GREG BRADSHAW THE OWNER OF MELLON MUSHROOM AND TAQUERIA THIS PAST WEEKEND.
I BELIEVE YESTERDAY. I KNOW HE WILL BE GREATLY MISSED IN MANY OF THE DOWNTOWN MERCHANTS IN THE DOWNTOWN AREA WILL MISS HIM GREATLY. I BELIEVE HIS SERVICE IS
THURSDAY AT 1 O'CLOCK. >> SPEAKER: YES, MISTER MR. BETTER WAS BIGGER THAN LIFE PERSON.
DOWNTOWN AUBURN. COUPLE OF GREAT BUSINESSES.
[5. AUBURN UNIVERSITY COMMUNICATIONS]
ANYONE ELSE ON THE COUNCIL? OKAY AUBURN UNIVERSITYCOMMUNICATIONS. >> SPEAKER: HELLO HOPE YOU'RE ALL DOING WELL AND ENJOYING THIS SLOWLY EMERGING FALL WEATHER.
ALABAMA FOR YOU. OUT OF STATE PEOPLE ARE GETTING A TASTE OF AUBURN IN THE FALL. LAST WEEK WE HAD 11,075 NAMETAGS GIVEN OUT FOR HEYDAY. THIS IS A GREAT NUMBER FOR US AND WE ARE SO EXCITED TO SEE THE SMILING FACES ON CAMPUS.
IT WAS GREAT. THE FOOTBALL PLAYERS, BEST ABOUT PLAYERS WAS A GREAT DAY FOR EVERYONE.
AND ALSO EXTRA IS WORKING ON INCREASING AWARENESS OF OUR LIFT PROGRAM. STUDENTS CAN GET FREE LIFT RIDE THURSDAY TO SATURDAY NIGHT WITHIN A 10-DOLLAR RIDE.
WE ARE TRYING IS ANOTHER WAY AUBURN CAN PROMOTE SAFETY FOR STUDENTS AND MAKING SURE THEY GET HOME SAFE.
TOMORROW AUBURN IS HOSTING A LET'S TALK MONEY SEMINAR WITH ERIC SMITH A FINANCIAL LITERACY COACH.
BELIEVE IT OR NOT A LOT OF AUBURN STUDENTS AND COLLEGE STUDENTS DON'T KNOW HOW TO USE THEIR MONEY WISELY SO I MIGHT BE TUNING INTO THAT EVENT. MY PARENTS MIGHT BE A LITTLE PROUD OF ME FOR DOING THAT. WE WILL SEE.
AND LASTLY WITH THE MAYOR IS 830 TO 1030.
[00:10:06]
WE ARE SUPER EXCITED ABOUT THAT. I SAW ALL THE BUTTONS IN AND THE POEM WAS YESTERDAY. AND THEN RON ON THE LAWN.WE WILL DEFINITELY MAKE THAT HAPPEN.
THANK YOU SO MUCH. >> SPEAKER: I APOLOGIZE TO YOU, WE HAD THE PODIUM ACCESSIBLE AND IT WAS OBVIOUSLY LOWERED FOR THE CITIZEN FOR ACCESSIBILITY PURPOSES AND WE ARE ABOUT TO CORRECT THAT. I APOLOGIZE.
>> SPEAKER: NOW IS THE TIME FOR CITIZENS COMMUNICATIONS ON ITEMS ON TONIGHT'S AGENDA. REMEMBER THIS IS JUST ITEMS ON OUR AGENDA TONIGHT. IF YOU WOULD LIKE TO ADDRESS THE COUNCIL PLEASE COME FORWARD AND GIVE YOUR NAME AND ADDRESS FOR THE RECORD. YOU WILL HAVE FIVE MINUTES TO ADDRESS THE COUNCIL. SEEING NO ONE WE WILL MOVE AHEAD. CITY MANAGER'S COMMUNICATIONS.
>> SPEAKER: GOOD EVENING PICKED OUR FIRST ITEM OF BUSINESS IS THE CONSENT AGENDA BECAUSE ANY COUNCIL MEMBER WISH TO REMOVE AN ITEM FROM THE CONSENT AGENDA AND DEAL WITH THAT ITEM
INDIVIDUALLY? >> SPEAKER: MS. CROUCH THERE
WERE SOME BOARD ANNOUNCEMENTS. >> SPEAKER: I POPPED ON THE
[7. CITY MANAGER’S COMMUNICATIONS]
BOARD ANNOUNCEMENTS ANNOUNCEMENT AND I'M SORRY WE HAVEN'T HAD ANY. THE FIRST THING ITEM 7A WHICH IS THE ANNOUNCEMENT OF TWO VACANCIES ON THE PARKS AND RECREATION ADVISORY BOARD. THOSE APPOINTMENTS WILL BE NOVEMBER 16, 2021, AND THOSE APPLICATIONS WILL BE LIVE THIS[8. CONSIDERATION OF CONSENT AGENDA]
WEEK. THANK YOU, MAYOR MAYOR BERKE IT IS BEEN A WHILE. NOW WE ARE TO THE CONSENT AGREEMENT -- AGENDA. ANY COUNCILMEMBER WISH TO REMOVE AN ITEM FROM THE CONSENT AGREEMENT AND DEAL WITH THATITEM INDIVIDUALLY? >> SPEAKER: 891 -- 891.
>> SPEAKER: I PULLED THIS FROM THE CONSENT AGENDA BECAUSE I
WILL BE ABSTAINING FROM THE VOTE >> SPEAKER: ITEM EIGHT 91 IS A PURCHASE OF AN F1 502 WHEEL DRIVE REGULAR CAB TRUCK FOR THE INSPECTION SERVICES DEPARTMENT AND THE AMOUNT OF $30,992.70.
>> SPEAKER: MOVE FOR APPROVAL. >> SPEAKER: SECOND.
>> SPEAKER: MOTION AND SECOND. ANY COMMENTS OR QUESTIONS? ALL IN FAVOR PLEASE SAY AYE. MOTION CARRIES MOTION TO APPROVE THE BALANCE OF THE CONSENT AGENDA?
>> SPEAKER: SO MOVE. >> SPEAKER: MOTION AND SECOND.
ALL IN FAVOR PLEASE SAY AYE. ANY POST?
[9. ORDINANCES]
THE CONSENT AGENDA IS APPROVED. >> SPEAKER: ORDINANCES THIS EVENING WE HAVE THE SECOND REUNION OF ITEM 9A WHICH AMENDED CHAPTER 12 TOWING FEES OF THE CITY CODE.
THE PROPOSED CHANGES WILL AUTHORIZE A MAXIMUM FEE OF $150 FOR NONCONSENSUAL TOWING FROM FIVE -- PRIVATE PROPERTY AND A MAXIMUM FEE OF $75 FOR WHEEL LOCKING.
>> SPEAKER: MOVER APPROVAL. >> SPEAKER: SECOND.
>> SPEAKER: MOTION AND SECOND. AT THIS TIME THIS IS THE SECOND READING OF AN ORDINANCE. IS THERE ANY DISCUSSION?
>> SPEAKER: I MOVED TO AMEND THE ORDINANCE AS READ TO CHANGE THE MAXIMUM FEE FROM 150 TO 125 AND SET THE STORAGE FEE AFTER
$25 -- 24 HOURS TO 25. >> SPEAKER: SECOND.
>> SPEAKER: WE DO HAVE COUNCILMAN DAWSON HAS OFFERED AN AMENDMENT. IT HAS BEEN SECONDED.
BY MAYOR PRO TEM WITTEN. ANY DISCUSSION ON THIS?
>> SPEAKER: I HAVE A QUESTION FOR CITY MANAGER.
I RECALL SOMEWHERE YOU SPOKE ABOUT THE SPECIFICS OF THIS ORDINANCE COVERING ONLY CITY RELATED ISSUES, CORRECT?
>> SPEAKER: NO, IT'S THE OPPOSITE.
THIS IS A NONCONSENSUAL TOWING FROM PRIVATE PROPERTY.
THERE IS ANOTHER PROVISION IN OUR TOWING ORDINANCE THAT DEALS WITH IF YOU ARE PART OF THE SIDEWALK ILLEGALLY OR WE DIDN'T TOE YOU OUT OF A CITY PARKING SPACE FOR SOME REASON.
AT THOSE RATES NOT PROPOSED TO CHANGE AND I BELIEVE AND DAVID GORDON WILL CORRECT ME IF I'M WRONG, THEY ARE $100 AND $10.
THEY ARE NOT PROPOSED TO CHANGE. >> SPEAKER: THANK YOU.
>> SPEAKER: ANY OTHER QUESTIONS OR DISCUSSION?
>> SPEAKER: HOW DID WE COME TO THE ORIGINAL AMOUNT OF 150?
>> SPEAKER: THE ORIGINAL AMOUNT WAS A FUNCTION OF WE HAD A REQUEST FROM ONE OF THE LOCAL TOWING COMPANIES VIA THEIR ATTORNEY AND WE HAD LOOKED AT THOSE NUMBERS BENCHMARKED IN YOUR PACKETS AGAINST SOME OTHER COMMUNITIES.
WE ACTUALLY LOOKED AT AN INFLATIONARY IT INFLATIONARY FACTOR. THEY HAD NOT BEEN RAISED SINCE 2008 AND THAT IS PART OF THE REASON FOR THE REQUEST.
THAT IS WHERE THE 150 CAME UP WITH.
THAT IS NOT ACTUALLY THEIR REQUEST IT WAS CLOSER TO 125, 130 RANGE. THAT IS WHERE WE GOT THAT NUMBER, THE BENCHMARKING PLUS INFLATION AT 3 PERCENT A YEAR IS
HOW WE LANDED THERE. >> SPEAKER: ANY OTHER COMMENTS
OR QUESTIONS? >> SPEAKER: JUST FOR CLARIFICATION, THAT WAS NOT THE PRICE THAT WE HAD BEFORE PRIOR TO THE AMENDMENT WAS NOT THEIR REQUEST?
[00:15:01]
IS THAT CORRECT OR EXPECT PRIOR TO THE AMENDMENT IT IS BEEN THAT WAY SINCE 2008. DOES THAT ANSWER YOUR QUESTION?>> SPEAKER: THE 150 WITH THAT SOMETHING THE CITY CAME UP WITH?
>> SPEAKER: IT WAS AT 125 OR 130.
I WOULD HAVE TO PULL THE ORIGINAL.
THEY DID NOT REQUEST 150. I CAN TELL YOU THAT.
THAT WAS BASED ON AN INFLATIONARY THING AND BACK TO THE BENCHMARKING. LOWERING IT TO 125 I WOULD STILL SAY IS BETTER THAN LEAVING IT AT 100 IN TERMS OF HOW THEY FEEL
ABOUT IT. >> SPEAKER: ANYONE ELSE? MEGAN, WOULD THIS STILL BE A ROLL CALL VOTE?
>> SPEAKER: WITH ORDINANCES WE DO ROLL CALL.
FOR THE AMENDMENT FIRST AND THEN ONTO THE AMENDED MOTION.
>> SPEAKER: THIS VOTE WILL BE ON THE AMENDMENT.
LINDSAY, ROLL CALL. (ROLL CALL VOTE)
>> SPEAKER: WE WILL MOVE AHEAD TO THE ENTIRE ORDINANCE AT THIS
TIME? >> SPEAKER: ORDINANCE AS AMENDED. WE HAVE OUR HE HAD A MOTION AND SECONDS OF THE VOTE ON THE ORDINANCE UNLESS THIS FURTHER
DISCUSSION. >> SPEAKER: ANY FURTHER DISCUSSION? SO WE WILL DO A ROLL CALL VOTE AND THEN ORDINANCE AS AMENDED. LINDSAY?
(ROLL CALL VOTE) >> SPEAKER: ITEM NINE MAYBE AUTHORIZE A SEVERE WEATHER PREPARED TO SALES TAX HOLIDAY WAS EXEMPT SPECIFIED ITEMS FROM THE CITY SALES TAX ON FRIDAY FEBRUARY 25 THROUGH SUNDAY FEBRUARY 27.
THERE IS A PIECE THAT YOU ARE NOT VOTING ON WHERE THE STATE HAS ALREADY WAVING SOMETHING. YOUR CONSIDERATION JUST HAS TO DO WITH THE WAIVER OF THE CITY TAX SIDE OF THIS AND UNANIMOUS
CONSENT IS NECESSARY. >> SPEAKER: I WHICH IS THE ORDINANCE AND ASK FOR UNANIMOUS CONSENT.
>> SPEAKER: SECOND. >> SPEAKER: MOTION AND SECOND.
ANYONE ON THE COUNCIL HAVE A PROBLEM WITH MOVING FORWARD WITH THE VOTE OF THIS THIS EVENING? HEARING ON ANY DISCUSSION OR QUESTIONS? LINDSAY, ROLL CALL.
(ROLL CALL VOTE) >> SPEAKER: ITEM 9C AUTHORIZES THE INSTALLATION OF ONE STOP SIGN AT BRIDGEWATER SUBDIVISION PHASE TWO, UNANIMOUS CONSENT IS NECESSARY.
>> SPEAKER: ISLANDERS THE ORDINANCE AND ASK UNANIMOUS
>> SPEAKER: MOTION AND SECOND. ANYONE ON THE COUNCIL OF A PROBLEM MOVING FORWARD WITH THE VOTE ON THIS THIS EVENING? HEARING THEN THE ROLL CALL, LINDSAY?
(ROLL CALL VOTE) >> SPEAKER: ITEM 9D1 IS A REQUEST FROM JOSEPH AND JERRY ALLEN TO ANNEX APPROXIMATELY 64.20 ACRES OF PROPERTY LOCATED AT THE SOUTHWEST CORNER OF U.S.
HIGHWAY 280 AND NORTH COLLEGE STREET/ALABAMA 147.
PLANNING COMMISSION RECOMMENDED APPROVAL OF THIS REQUEST BY A VOTE OF 6-2. SEPTEMBER 9, 2020, WHEN MEETING.
UNANIMOUS CONSENT IS NECESSARY. >> SPEAKER: ISLANDERS THE ORDINANCE AND ASK UNANIMOUS CONSENT.
>> SPEAKER: SECOND. >> SPEAKER: MOTION AND SECOND.
ANYONE ON THE COUNCIL HAVE A PROBLEM MOVING FORWARD THE VOTE ON THIS THIS EVENING? HEARING ON ANY DISCUSSION OR QUESTIONS? MR. MAYOR.
>> SPEAKER: HAVE A QUESTION FOR CITY MANAGER.
THERE WERE TWO FOLKS ON THE PLANNING COMMISSION THAT VOTED NAY. CAN YOU ELABORATE ON THEIR
RATIONALE PLEASE? >> SPEAKER: I WOULD LIKE THE PLANNING DIRECTOR MR. STEVE FOOTE TO RESPOND TO THAT,
PLEASE. >> SPEAKER: AT THE TIME THEY TOOK THE VOTE, I DON'T BELIEVE EITHER OF THE MEMBERS PROVIDED A REASON OR RATIONALE BEHIND THE REP POSITION.
I THINK AT SOME POINT THERE WAS CONCERN ABOUT WHICH ITEMS WERE GOING FORWARD AND WHICH WERE NOT MOVING FORWARD.
I DON'T THINK THEY WERE DON'T I DON'T RECALL THEM NECESSARILY SAYING IT WAS PARTICULAR PART OF THE PLAN.
>> SPEAKER: THANK YOU. ANY OTHER QUESTIONS OR COMMENTS?
>> SPEAKER: WHEN WE ANNEX, TO CLARIFY, IT COMES IN AT THE BASE
ZONE OVERALL, CORRECT? >> SPEAKER: THAT IS CORRECT.
>> SPEAKER: HAVE A QUESTION. FOR THE CITY PLANNER.
THIS IS THE COUNCIL THAT LIBERATED ON A SMALL SECTION THAT WAS OMITTED FROM IT CORRECT?
>> SPEAKER: THERE IS. WE ACTUALLY TALKED TO THE APPLICANT ABOUT THAT BECAUSE WE FELT LIKE IT WOULD BE BETTER TO BRING THE ENTIRE AREA OF LAND IN AT THE SAME TIME, ESPECIALLY WITH IN THE DD. THE PROPERTY OWNER WAS NOT WILLING TO SELL THAT PIECE OF THIS POINT IN TIME.
WHAT WE DID IN RESPONSE TO THAT WAS WE WERE CONCERNED ABOUT THE NUMBER OF ACCESS POINTS TO NORTH COLLEGE STREET, VEHICULAR ACCESS POINTS. SO WE HAVE IN THE PDD COMMENTS AND I THINK THEY ARE NOW SHOWING NOTES ON THE PLAN THAT WILL PROVIDE CROSS ACCESS EASEMENTS FROM THE PDD PORTION THAT ABUTS THAT SITE SO THAT WE WON'T HAVE TO HAVE NECESSARILY ANOTHER
ACCESS DRIVEWAY. >> SPEAKER: ANYBODY ELSE?
[00:20:05]
LINDSAY, ROLL CALL. (ROLL CALL VOTE)>> SPEAKER: ITEM 9D2 IS A REQUEST FROM THE ANB PEARSON PERSON TO ANSWER PROXIMALLY 44.37 ACRES OF PROPERTY LOCATED IN THE EAST SIDE OF SHELTON WILL ROAD NORTH OF COBBLESTONE SUBDIVISION. THE PLANNING COMMISSION RECOMMENDED APPROVAL OF THIS REQUEST BY VOTE OF 8-1 OF HIS OCTOBER 14, 2020, WHEN MEETING. UNANIMOUS CONSENT IS NECESSARY.
>> SPEAKER: ISLANDERS THE ORDINANCE AND ASKED FOR
UNANIMOUS CONSENT. >> SPEAKER: SECOND.
>> SPEAKER: MOTION AND SECOND. ANYONE ON THE COUNCIL OF A PROBLEM MOVING FORWARD WITH THE VOTE ON THIS THIS EVENING? HEARING NONE, ANY DISCUSSION OR QUESTIONS?
>> SPEAKER: I JUST WANT TO CLARIFY THAT THIS EVENING ALL WE ARE BEING ASKED TO DO FOR THIS PARCEL OF LAND IS TO ANNEX.
HAS THE PLANNING DEPARTMENT RECEIVED ANY ADDITIONAL ACTION
ITEMS ON THIS PROPERTY? >> SPEAKER: THEY HAVE NOT.
THERE WAS ORIGINALLY AN APPLICATION TO ANNEX AND TO ZONE TO DDH. THAT REQUEST WAS WITHDRAWN AND NOT CONSIDERED BY THE PLANNING COMMISSION.
IT WAS WITHDRAWN PRIOR TO THE AGENDA BEING PUBLISHED.
SO IT IS JUST ANNEXATION TO THE RULES OWN.
>> SPEAKER: THANK YOU. >> SPEAKER: ANY OF THE
QUESTIONS OR COMMENTS? >> SPEAKER: SAME QUESTION.
THERE WAS ONE NEGATIVE VOTE BY THE PLANNING COMMISSION.
I WONDER IF ANY SPECIFIC RATIONALE WAS PROVIDED FOR THE
NEGATIVE VOTE. >> SPEAKER: MR. FOOT, IT WAS
8-1. >> SPEAKER: IT WAS UNANIMOUS?
>> SPEAKER: IT WAS 8-1 BY THE PLANNING COMMISSION.
>> SPEAKER: I WAS LOOKING AT THE SUMMARY.
MY APOLOGIES. >> SPEAKER: I DON'T REMEMBER.
IT WAS THE VOTE CAME AND IN THERE WAS ONE NAY VOTE.
I DON'T REMEMBER ANYBODY GIVING ANY REASONS.
WE CAN TRY TO COLLECT REASONS WHEN THAT HAPPENS IF YOU WOULD LIKE AND CERTAINLY FOR THE NAMES OF THE INDIVIDUALS WHO MAYBE
VOTED. >> SPEAKER: THAT MIGHT BE BENEFICIAL. THANK YOU.
ANY OTHER COMMENTS OR QUESTIONS? LINDSAY, ROLL CALL.
(ROLL CALL VOTE) >> SPEAKER: ITEM JAMES LANE SEGREST TO ANNEX APPROXIMATELY .94 ACRES OF PROPERTY LOCATED AT 2424 LEE ROAD 56 ALSO KNOWN AS WIMBERLY ROAD.
PLANNING COMMISSION UNANIMOUSLY RECOMMENDED APPROVAL OF THIS REQUEST IN ITS OCTOBER 14, 2020, WHEN MEETING.
UNANIMOUS CONSENT IS NECESSARY. >> SPEAKER: ISLANDERS THE ORDINANCE AND ASK UNANIMOUS CONSENT.
>> SPEAKER: SECOND. >> SPEAKER: MOTION AND SECOND.
ANYONE ON THE COUNCIL HAVE A PROBLEM MOVING FORWARD WITH THE VOTE OF THIS THIS EVENING? HEARING NONE, ANY DISCUSSION?
>> SPEAKER: I HAVE A QUESTION FOR THE CITY MANAGER.
WE TALKED ABOUT WHAT THIS MIGHT COME INTO.
IS IT LIKELY TO COME INTO TO? >> SPEAKER: WELL, THE CITY ATTORNEY IS DOUBLE CHECKING STATE STATUTE.
CURRENTLY WORK TWO YOU WOULD HAVE POINTED OUT IS ON THE WEST SIDE OF WIMBERLEY OR LEE ROAD 56 AND LOGIC SAYS THAT IT WOULD COME INTO THAT WARD. BUT I AM DOUBLE CHECKING TO MAKE SURE THERE IS NOT SOME STATUTE. WARD EIGHT IS ON THE OTHER SIDE OF WIMBERLEY AND FURTHER SOUTH, BUT AT THE END OF THE DAY, THERE HAS BEEN AN EAST-WEST THING. IF HE WERE FURTHER SOUTH MAYBE WARD EIGHT AND THAT'S ONE OF THE THINGS WE'RE LOOKING AT.
I WILL REMIND YOU THAT THAT MAYBE SHORT-LIVED AS WE WILL BE REDISTRICTING IN THE COMING MONTHS.
>> SPEAKER: THANK YOU ANY OTHER COMMENTS OR QUESTIONS?
>> SPEAKER: A COMMENT. THERE IS ALREADY A SINGLE-FAMILY RESIDENCE ON THIS PROPERTY BUT THE BASE ZONE IS RULE.
IT WOULD BE NONCONFORMING BUT IT APPEARS THAT THERE IS NO OTHER ACTION THAT WILL BE TAKING PLACE ON THIS PARCEL OF LAND.
>> SPEAKER: MR. FOOT? >> SPEAKER: THE BUILDINGS THAT ARE OUT THERE TODAY, IT IS NOT A RESIDENCE BUT MORE OF A BARN AND OTHER STRUCTURES. THE INTENT IS THE APPLICANT WOULD LIKE TO CONSTRUCT A RESIDENCE ON THE PROPERTY.
>> SPEAKER: THANK YOU. >> SPEAKER: ANYONE ELSE? LINDSAY, ROLL CALL. (ROLL CALL VOTE)

>> SPEAKER: WE HAVE A MOTION AND A SECOND.
TO POSTPONE UNTIL NOVEMBER 16. MS. CROUSE, DO WE TAKE THAT -- IS THAT A VOICE VOTE OR ROLL CALL?
>> SPEAKER: YOU ARE FINALLY VOICE FOR THAT.
>> SPEAKER: ANY DISCUSSION ON THE MOVE TO POSTPONE
NOVEMBER 16? >> SPEAKER: I WILL GIVE YOU REASONING AS TO MY REQUEST. RIGHT NOW THERE IS NOT A PDD ASSOCIATED WITH THIS AND THE NEXT AGENDA ITEM AND IT IS MY UNDERSTANDING THAT PLANNING HAS YET TO MOVE OR MAKE A RECOMMENDATION ON THAT PDD. THIS IS A LOT OF PROPERTY TO PUT A ZONE TO WITHOUT KNOWING EXACTLY WHAT THE PLANS ARE FOR
THANK YOU, MS. WITTEN. ANY COMMENTS OR QUESTIONS?
>> SPEAKER: WILL HAVE ENOUGH TIME TO HAVE THAT A PLAN
TOGETHER? >> SPEAKER: THE PLANNING DID AT THEIR THURSDAY NIGHT MEETING ON THE 14TH OF OCTOBER THEY DID ACT ON THIS BUT YOU WON'T SEE IT UNTIL THE SECOND MEETING IN NOVEMBER. THEY RECOMMENDED APPROVAL THE PLANNING APPROVAL DISTRICT OF THESE TWO GOT SEPARATED OF THE PLANNING COMMISSION LEVEL BASED ON SOME DISCUSSION ABOUT THE PLANNED DEVELOPMENT DISTRICT. THAT IS WHY YOU ARE SEEING THEM.

SOMETIMES THEY ARE HELD TO GO ALTOGETHER AND SOMETIMES THEY
MOVE FORWARD. >> SPEAKER: ANY OTHER FURTHER QUESTIONS OR COMMENTS? WE HAVE A MOTION AND SECOND TO POSTPONE TO NOVEMBER 16. ALL IN FAVOR PLEASE SAY AYE ANY POST? WE WILL TAKE US UP AT OUR SECOND

UNDER RESOLUTIONS ITEM 10A1 IS A REQUEST ON BRETT BASQUIN THE CITY OF AUBURN. CONDITIONAL USE APPROVAL FOR THE EXPANSION OF AN INDUSTRIAL USE MANUFACTURING FOR SI ZERO TWO.

THE COUNCIL? >> SPEAKER: JUST EXCITED THAT WE HAVE A POTENTIAL BUSINESS IN THE STANDARD.
SPUR SOME OTHER ACTIVITY IN THAT AREA.
>> SPEAKER: EXACTLY. I DO HAVE A QUESTION.
IT SAYS THAT NO PARKING IS REQUIRED.
HOWEVER I'M CURIOUS ARE THEY GOING TO BE USING THE PARKING THAT THE STANDARD HAS CONSTRUCTED?
WILL THEY BE USING THAT PARKING? >> SPEAKER: MR. FOOT, IS THAT DISCUSS WITH THE PLANNING COMMISSION?
>> SPEAKER: I DON'T THINK IT WAS.
MY UNDERSTANDING IS WITHIN THAT AREA OF THE CITY, PARKING IS NOT REQUIRED FOR THESE TYPES OF USES.
PARKING FOR THE FACILITY WAS BASED I BELIEVE ON THE TOTAL NUMBER -- ARE THEY OPENING THE DECK UP?
>> SPEAKER: AT THE TIME IT WAS CONSTRUCTED, WHILE WE WERE GOING THROUGH A LOT OF DEVELOPMENT CHANGES AT THE TIME, THE COUNCIL HAD QUITE A PRESENTATION FROM THE DEVELOPER ABOUT THESE DOES THE USE OF PARKING IN THE INTENTION OF THE TIME.
I CAN SEND AN E-MAIL AND WE WILL CHECK.
THEY HAD THE ABILITY TO MOVE SOME THINGS ON THE GROUND FLOOR TO ALLOW SOME FLUCTUATION FOR RETAIL PARKING.
I DON'T KNOW IF THEY HAVE ACCOMMODATED THAT DUE TO THE LACK OF CITY REQUIREMENTS FOR COMMERCIAL PARKING IN THE URBAN CORE. WE CAN CERTAINLY CHECK.
THAT WAS THE NOTION AT THE TIME. IT IS A LOT DIFFERENT THAN THE 20 MAGNOLIA. 320 MAGNOLIA WAS BUILT INTENTIONALLY TO HAVE AN EASY WAY FOR GROUND-FLOOR CUSTOMERS WHERE IT WAS SEPARATE FROM RESIDENTIAL.
THAT IS THE ONLY ONE THAT IS QUITE LIKE THAT RIGHT NOW BUT WE WILL CHECK AND I WILL SEND YOU AN E-MAIL.
>> SPEAKER: I FULLY REALIZE THAT THERE IS NO REQUIREMENT FOR
COMMERCIAL PARKING. >> SPEAKER: THERE IS A FANCY DECK AT URBAN STREET THAT IS AVAILABLE.
AMPLE PARKING IN DOWNTOWN ALREADY.
PLEASE, PART. >> SPEAKER: WE ARE HAPPY TO HAVE SOMETHING GOING INTO THE GROUND FLOOR SOME OF THESE BUILDINGS THAT HAVE BEEN LANGUISHING A WHILE.
THAT WOULD BE NICE FOR FUTURE TENANTS OR PROSPECTIVE TENANTS TO KNOW THAT THEY HAVE PARKING AVAILABLE IN THE PARKING GARAGE
THAT IS ALREADY ON PROPERTY. >> SPEAKER: ABSOLUTELY.
I HAVE ALSO -- THEY HAVE SEVERAL OTHER TENANTS IN THE WORKS.
I THINK THINGS ARE PICKING UP. NO PUN INTENDED WITH HOT WORKS
IN THE WORKS. >> SPEAKER: ANY OF THE QUESTIONS? COMMENTS? ALL IN FAVOR PLEASE SAY AYE ANY POST?
SHE CARRIES. >> SPEAKER: THOSE ARE ALL OF
[12. CITIZENS’ OPEN FORUM]

IF YOU WOULD LIKE TO ADDRESS THE CITY COUNCIL THAT ANYTHING ON YOUR MIND PLEASE COME FORWARD AND GIVE US YOUR NAME AND ADDRESS FOR THE RECORD AND MAKE SURE YOUR COMMENTS ARE ADDRESSED
TO THE CITY COUNCIL. >> SPEAKER: MY NAME IS GREG LN.
AND I'M THE OWNER OF HOT WORKS. I CAN ANSWER YOUR QUESTION THERE IS 84 PARKING SPOTS IN THE STANDARD SPOT.
FOR COMMERCIAL USE. HOPEFULLY WE WILL HAVE A COUPLE OF RESTAURANTS COMING IN AND SOME OF THE THINGS.
PLENTY OF PARKING IN THERE THEY JUST HAVE TO WALK AROUND TO GET
INTO THE BUILDING. >> SPEAKER: THANK YOU FOR INVESTMENT IN OUR COMMUNITY. ANYONE ELSE?
>> SPEAKER: MAYOR ANDERS, LADIES AND GENTLEMEN, HERBERT WILL FOR OPELIKA RD. I WOULD LIKE TO AS A CITIZEN OF THE COMMUNITY THINK MAYOR ANDERS AND COUNCILMAN GRISWOLD FOR HAVING A CHANCE TO GO TO THE NATIONAL NIGHT OUT YESTERDAY.
IT WAS ACTUALLY A DAY OUT BUT IT COUNTS AS NIGHT OUT.
AND ALSO TO THE REST OF THE COUNCIL, INCLUDING MS. TAYLOR IN HER ABSENCE AND MR. HOLE BE. FOR SUPPORTING THIS EFFORT.
THE COMMUNITY IS VERY CONCERNED ABOUT THE RELATIONS BETWEEN LAW ENFORCEMENT AND THE BLACK COMMUNITY.
ALL OF THE COMMUNITY. IT WAS NICE TO SEE THE POLICE BEING THERE AND I SAW ABOUT FIVE POLICE CARS THERE YESTERDAY.
I HOPE THAT IS A GOOD SIGN AND I AM SURE IT BRINGS UP A LOT OF ISSUES, A LOT OF CONCERNS LIKE THE POLICE BRUTALITY ALLEGATIONS AND WHETHER THE POLICE PROVIDE ENOUGH SAFETY IN POOR NEIGHBORHOODS. WE HOPE THAT YESTERDAY WILL HELP RAISE THE ISSUES WE NEED TO ADDRESS.
I DON'T SPEAK AS A PERSON WHO IS ANTIPOLICE.
EVEN THOUGH I HAVE HAD MY RUN-INS WITH POLICE HERE IN AUBURN. I DO SUPPORT THE POLICE OFFICERS AND THEY ARE NOT PERFECT. THEY ARE NOT ROBOTS, THEY ARE HUMAN BEINGS LIKE EVERYONE ELSE. I AM JUST HOPING AS A CITIZEN
[00:35:03]
AND AS AN AFRICAN-AMERICAN WE CAN BETTER IMPROVE RELATIONS.I KNOW THERE IS SOME LEGISLATION IN WASHINGTON ADDRESSING THIS.
WE MAY HAVE SOME CONCERNS ABOUT THAT, BOTH AS COUNCILMEMBERS AND AS PRIVATE CITIZENS. BUT AT LEAST LET'S HOPE THAT THIS WILL BRING US CLOSER TO A RESOLUTION IN REGARDS TO THAT.
I WAS THERE YESTERDAY AS PART OF BE SMART, MOMS DEMAND ACTION FROM GUNSENSE IN AMERICA. EVERY TIME FOR GUN SAFETY AND WE WOULD LIKE TO THANK YOU ALL FOR THE LEADERSHIP AND ALLOWING THE HOUSING AUTHORITY AND THE AUBURN POLICE FOR LETTING US HAVE SPACE THERE. ALONG WITH ALL OF THE OTHER ORGANIZATIONS. AND I HOPE THE CITIZENS WOULD USE THOSE. THANK YOU.
>> SPEAKER: YES, SIR. ANYONE ELSE?
