ALSO MAYOR FULLER AND I WERE AT THE WALMART EDUCATION CENTER RECENTLY AS WE CELEBRATED 20 MILLION POUNDS OF FOOD THAT WERE GIVEN OVER THE LAST 20 YEARS TO THE FOOD BANK OF EAST ALABAMA. WHAT GREAT LEADERSHIP THE FOOD BANK OF EAST ALABAMA HAS HAD OVER THE LAST DURING THEIR TIME HERE. THE FOOD BANK OF EAST ALABAMA ORIGINALLY STARTED IN THE SAME BUILDING THAT TODAY HOUSES CITY HALL IN DOWNTOWN AUBURN. IT NOW HAS A BEAUTIFUL FACILITY IN OUR INDUSTRIAL PART OF OUR CITY HAD A LOT TO DO WITH MAKING HAPPEN. THEY HAVE A GREAT BOARD OF DIRECTORS AND WE ARE VERY THANKFUL TO WALMART AND THEIR WILLINGNESS TO GIVE THAT FOOD TO THE FOOD BANK OVER THE YEARS.
AND PROVIDE THAT FOR ALL OF THE FAMILIES IN NEED IN OUR COMMUNITY. THOSE ARE MY MAYOR'S ANNOUNCEMENT. ANYTHING FROM ANYONE ELSE AT THE

THAT WILL START AT 6:30 ON NOVEMBER 8, MONDAY. THE MAIN TOPIC WILL BE A PRESENTATION BY SOME DEVELOPERS ABOUT A POTENTIAL DEVELOPMENT IN THE MRS. JAMES ROAD FACILITY KNOWN AS OLD SAMFORD.
IT WOULD BE QUITE A PROJECT AND I WANT TO GET PUBLIC INPUT AS TO JUST FILL EVERYBODY IN ON THAT. NOTHING HAS BEEN APPROVED YET, BUT I WOULD LIKE TO GO AHEAD AND GET INPUT FROM THE PUBLIC'S BACK THE OTHER ONE IS THAT THE CUMULATIVE LEGAL EXPENSES FOR THE COUNCILMAN DIXON VERSUS CITY OF AUBURN CASE AS OF 30 SEPTEMBER, 21, IS $32,109.16. WE HAD A GREAT TURNOUT. IT WAS IN TWO SEPARATE THE THING FROM AUBURN AND THE COMMUNITY, IT WAS JUST THAT I KNOW THAT A LOT OF THE PARENTS DON'T TAKE THEIR CHILDREN OUT FOR TRICK-OR-TREATING AND STUFF SO I MADE IT ACCESSIBLE FOR KIDS WHO WAS IN WALKING DISTANCE TO BE ABLE TO COME AND ENJOY A NICE FESTIVAL. I FEEL LIKE WE ALL JUST GOT HERE.
WE HAVE A LOT OF STUFF COMING UP.
FIRST OFF THE BEAT BAMA FOOD DRIVE WILL BE GOING TO NOVEMBER 14. I SAW IT AT KROGER LAST NIGHT.
YOU CAN PUT FOOD IN THEM AND THERE'S A LOT OF STUDENTS WORKING HARD ON THIS. WE ARE COMPETING AGAINST UNIVERSITY OF ALABAMA TO HELP FIGHT FOOD INSECURITY IN EACH ALABAMA. ANYTHING WE CAN DO TO BEAT BAMA WE REALLY WANT TO DO. WE ARE WORKING HARD ON THAT.
[00:10:04]
WE HAVE ALSO ORDERED A LOT OF PROMOTIONAL MATERIALS TO ENCOURAGE STUDENTS TO USE THAT LIFT PROGRAM THAT I WAS TALKING ABOUT LAST TIME. AGAIN, SAFETY IS A HUGE PRIORITY AT AUBURN AND WE REALLY WANT TO MAKE SURE THEY ARE TAKING ADVANTAGE OF THIS OPPORTUNITY BECAUSE IT'S A GREAT DEAL.WHO DOESN'T WANT TO SAVE MONEY, ESPECIALLY IN COLLEGE? AND MY BRANCH EXTERNAL AFFAIRS ARE CIVIC ENGAGEMENT TEAM IS WORKING ON GETTING A POLLING LOCATION HERE IN AUBURN.
IF YOU OTHER'S SCHOOLS HAVE THEM, GEORGIA TECH, ALABAMA, AND THEN. NOT A LOT SO AUBURN WOULD BE ON THE FOREFRONT OF THAT WHICH IS GREAT TO GET FACULTY AND STAFF AND STUDENTS A PLACE TO VOTE ON CAMPUS.
WE ARE LOOKING INTO THAT'S. WE ARE JUST THE BEGINNING STAGES OF THAT BUT THAT IS A HUGE THING THEY'RE WORKING ON.
LASTLY WITH THE MAYOR WAS SO MUCH FUN.

PLEASE REMEMBER THIS IS ONLY ITEMS ON TONIGHT'S AGENDA.
IF YOU WOULD LIKE TO SPEAK TO THE COUNCIL PLEASE COME FORWARD AND GIVE US YOUR NAME AND ADDRESS FOR THE RECORD.
THANK YOU MR. GRISWOLD. CERTAINLY DURING THE COMMITTEE OF THE WHOLE HAD AN UPDATE FROM THE AUBURN MUNICIPAL COURT JUDGE MCLAUGHLIN. IT WAS AN OUTSTANDING UPDATE BUT WE WERE THANK YOU FOR THAT. THANKS FOR THE GREAT WORK THAT THEY DO. ANYONE LIKE TO SPEAK TO THE
[7. CITY MANAGER’S COMMUNICATIONS]
COUNCIL ON ITEMS ON TONIGHT'S AGENDA? SEEING NO ONE WILL MOVE AHEAD. CITY MANAGER?>> SPEAKER: GOOD EVENING. UNDER CITY MANAGER'S COMMUNICATIONS, WE HAVE THE ANNOUNCEMENT OF TWO VACANCIES ON THE CEMETARY ADVISORY BOARD, THREE YEAR TERMS BEGIN JANUARY 1, 2022. IN DECEMBER 31, 2035.
THE APPOINTMENT WILL BE MADE AT THE DECEMBER 7, 2021, MEETING.
[8. CONSIDERATION OF CONSENT AGENDA]
OUR FIRST ITEM OF BUSINESS IS THE CONSENT AGENDA.IS ANY COUNCIL MEMBER WISH TO REMOVE AN ITEM FROM THE AGENDA AND DEAL WITH THAT ITEM INDIVIDUALLY?
>> SPEAKER: YES, MITTERMAYR I WOULD LIKE TO REMOVE 8D1.
>> SPEAKER: ANYONE ELSE LIKE TO REMOVE AN ITEM FROM TONIGHT'S CONSENT AGENDA? MS. KRAUT, 8D1.
>> SPEAKER: IT AUTHORIZES THE EXECUTION OF A DEVELOPMENT AGREEMENT WITH EDGAR HUGHSTON BUILDER INC. FOR THE LANDINGS AT ACADEMY DRIVE. THIS PART OF THE DEVELOPMENT AGREEMENT THE CITY WOULD COMMIT UP TO $192,631 FOR THE INSTALLATION OF BIKE LANES AND A MULTIUSE PATH EXCESSIVE FEATURE
GREENWAY. >> SPEAKER: MOVE FOR APPROVAL.
>> SPEAKER: SECOND. >> SPEAKER: MOTION AND SECOND.
MR. GRISWOLD? >> SPEAKER: I WOULD LIKE TO THANK DEVELOPMENT SERVICES FOR CONSIDERATION OF THIS AND FOR ADDING A BIKEWAY GREENWAY INFRA STRUCTURE TO THIS PROJECT.
BUT I WOULD ALSO LIKE TO HAVE AN EXPLANATION ABOUT WHAT IT IS WE ARE SPENDING $52,000. ANY TIME THE CITY IS PROVIDING FUNDING TO A DEVELOPER, WE OUGHT TO PROBABLY BRING IT UP IN PUBLIC AND GET A GOOD EXPLANATION OF IT.
IN FACT, I THINK MOST DEVELOPED AGREEMENTS IN GENERAL SHOULD NOT BE ON THE CONSENT AGENDA. BUT IF YOU WOULD PLEASE GO THROUGH THIS DEVELOPMENT AGREEMENT AND EXPLAIN IT TO THE
PUBLIC PLEASE. >> SPEAKER: I WILL.
I WILL HAVE SCOTT CUMMINGS OUR EXECUTIVE DEVELOPMENT SERVICES COORDINATOR HE NEGOTIATES THE DEVELOPMENT AGREEMENT FOR THE CITY WALK YOU THROUGH THE CITY COMMITMENT PEACE.
I DO WANT TO SAY, AS IS SHOWN ON YOUR AGENDA, THAT THE CONTRIBUTIONS TOWARD THIS, WHICH TOTAL ABOUT $192,000, WERE NOT ORIGINALLY BUDGETED. WE CANNOT FORESEE SOMETIMES WHAT IS COMING WITH DEVELOPMENT AGREEMENTS.
WHAT WE PLAN TO DO IN THE NEXT BIENNIAL BUDGET IS GET A LUMP SUM LINE ITEM IN THERE THAT HELPS US WHEN WE CONTRIBUTE TO THINGS. IT DOESN'T MEAN THAT YOU WON'T APPROVE THE DEVELOPMENT AGREEMENTS.
COUNCIL ALWAYS WOULD AND YOU WOULD APPROVE THE BUDGET, BUT WE ALSO ARE SEEING MORE AND MORE OF THIS WILL BE GET A CHANCE TO PARTICIPATE. WE WILL TALK ABOUT THAT IN THE LATE SPRING EARLY SUMMER. MR. CUMMINGS, PLEASE GO AHEAD.
>> SPEAKER: THANK YOU. IN GENERAL, AS WE WERE LOOKING AT THIS DEVELOPMENT, WE SAW AN OPPORTUNITY TO EXTEND SOME INFRASTRUCTURE THAT WAS ALREADY IN PLACE SUCH AS THE BIKEWAY IN ORDER TO KEEP THAT MOVING. I APPLAUD THE EFFORTS OF ENGINEERING SERVICES AND RECOGNIZING THAT CONNECTIVITY IN
[00:15:03]
ORDER TO EXTEND THE BIKEWAY'S, AS WELL AS CONNECTIVITY FOR FUTURE GREENWAYS, AS WE SOUGHT TO THIS DEVELOPMENT.THE DEVELOPMENT DID NOT REQUIRE THAT THESE BE BUILT, SO ENGINEERING, CITY ENGINEERS RECOMMENDATION THAT WE CONTRIBUTE TO THE COST OF THAT IN ORDER TO CAPTURE THAT NOW.
IT IS MUCH LESS EXPENSIVE TO BUILD THINGS THE FIRST TIME AS OPPOSED TO GOING BACK AND RENOVATING SOMETHING IN THE FUTURE. SO WE FEEL LIKE WE HAVE NEGOTIATED A GOOD PRICE. THE CITY ENGINEER LABORED OVER THE ESTIMATES AND QUANTITIES FOR THIS AND UTILIZING OUR DATABASE FOR UNIT COSTS THAT WE HAVE FOR BIDS AND OTHER EFFORTS THAT WE DO WITHIN THE CITY IN ORDER TO DEVELOP THESE COST ESTIMATES.
THESE ARE ACTUALLY AS YOU CAN READ IN DEVELOPMENT, UP TO.
SO THE DEVELOPMENT DOES THE DEVELOPER WILL HAVE TO PROVIDE A DETAILED COST ESTIMATE BEFORE WE PROCEED WITH IT AND FINALIZE THE PAYMENT FOR THAT. I WOULD ASK IF ALISON FRAZIER
HAS ANYTHING TO ADD TO THAT. >> SPEAKER: AGAIN, I COMMEND YOU FOR THE OUTREACH AND FOR THE INSIGHT TO GO AHEAD AND ADD THIS PROJECT IN AS PART OF THIS DEVELOPMENT WORK.
THANK YOU FOR THAT SPECK THANKS TO OUR ENGINEERING TEAM BECAUSE
THEY RECOGNIZED. >> SPEAKER: I ALSO WANT TO SAY THAT THE DEVELOPER HAS ALSO BEEN VERY OPEN.
ONE OF THE IMPORTANT THINGS IS A LOT OF DEVELOPERS ARE WILLING TO WORK WITH US. THEY DON'T HAVE TO DO THIS.
THIS DOES SAVE US A GOOD BIT OF MONEY ADDING THESE IMPROVEMENTS NOW. IT IS A GOOD PARTNERSHIP AND A LOT OF TIMES A DEVELOPED AGREEMENT ISN'T NECESSITATED OTHER THAN PARTNERSHIPS LIKE THIS.
SO WE APPRECIATE YOUR INDULGENCE.
WHEN IT COMES TO BIKEWAYS AND GREENWAYS AND WE HAVE THIS OPPORTUNITY, YOU WILL SEE THEM AS OFTEN AS POSSIBLE WHERE IT
MAKES SENSE. >> SPEAKER: WHAT IS THE ANTICIPATED CONCLUSION OF THIS PROJECT?
>> SPEAKER: ALLISON, YOU HAVE MORE INFORMATION ON THAT SINCE YOU BEEN WORKING WITH THE DEVELOPER.
>> SPEAKER: WHERE ARE THE GREENWAY AND I WAS LOOKING AT THE MAP TO DETERMINE WHERE THOSE APPROVALS ARE GOING TO BE.
>> SPEAKER: ALLISON, DO YOU WANT TO --
>> SPEAKER: >> SPEAKER: YOU HAVE SOME UNNAMED STREETS STILL EXPECT IT WILL BE OFF OF ACADEMY DRIVE, IS
THAT? >> SPEAKER: THE BIKE LANE WILL
EXTEND OFF ACADEMY. >> SPEAKER: TO THE CUL-DE-SAC?
>> SPEAKER: YES, SIR. >> SPEAKER: SPECS IT WILL PICK UP THE BIKE LANES COMING EAST WEST ON ACADEMY, THE GREENWAY WILL GO ON THE NORTH-SOUTH CUL-DE-SAC THAT YOU SEE.
THESE WILL EVENTUALLY TIE HOPEFULLY OVER TO SHELTON WITH
FUTURE DEVELOPMENTS. >> SPEAKER: WITH ACADEMY
EVENTUALLY CONNECTED TO SHELTON? >> SPEAKER: YES.
>> SPEAKER: THANK YOU. >> SPEAKER: ANY OF THE QUESTIONS? WITH EMOTION AND SECOND.
ALL IN FAVOR SAY AYE. >> SPEAKER: THE MOTION CARRIES.
THE NEXT ONE, MS. CROUCH? >> SPEAKER: ITEM 8D TO OUR AV CONSTRUCTION FOR THE HIGHWAY 14 FORCE MAIN REPLACEMENT PROJECT IN THE AMOUNT OF $912,033 AND $0.10.
>> SPEAKER: MOVE FOR APPROVAL. >> SPEAKER: SECOND.
>> SPEAKER: MOTION AND SECOND. MR. GRISWOLD?
>> SPEAKER: THANK YOU. MY ONLY QUESTION IS WHAT LEVEL OF DISRUPTION OF SERVICES WILL BE TO RESIDENTS ALONG HIGHWAY
14? >> SPEAKER: I HAVE MET DONE HERE. HE IS OUR ASSISTANT WATER RESOURCE MANAGEMENT DIRECTOR AND I WILL HAVE HIM EXPLAIN A LITTLE
BIT MORE. >> SPEAKER: IT IS A FORCE MAIN, NOT A GRAVITY LINE SO THERE ARE NO SERVICES CONNECTED INTO THAT MAIN. IT WILL BE STRICT WE JUST REPLACEMENT OF A FORCE MAIN. WE WILL BE ON THE SOUTH SIDE OF THE RAILROAD ALONG HIGHWAY 14. WE WILL NOT BE IN THE ROAD OR IN
ANY AREAS DISRUPTING TRAFFIC. >> SPEAKER: THANK YOU.
>> SPEAKER: ANY OF THE QUESTIONS? ARE RIGHT MOTION AND SECOND ALL IN FAVOR.
