THAT'S ALL. THANK YOU.

>> SPEAKER: ANY OTHER COUNCIL MEMBERS WITH AN ANNOUNCEMENT?

[5. AUBURN UNIVERSITY COMMUNICATIONS]

OKAY WE WILL MOVE AHEAD TO AUBURN UNIVERSITY

COMMUNICATIONS. >> SPEAKER: HI EVERYONE.

[00:05:04]

HOPE YOU ALL ARE WELL AND HAD A GOOD WE CAN.

DESPITE THE GAME. THING ABOUT AUBURN'S WE KEEP GOING NO MATTER WHAT. EXCITED FOR THE NEXT FEW GAMES TO FINISH OFF THE SEMESTER. THE BIGGEST THING HAPPENING SO FAR IN THE PAST FEW DAYS ON CAMPUS HIS FACE COVERS ARE NO LONGER REQUIRED IN MOST BUILDINGS.

ACCEPT THE PROFESSOR IF THEY WANT TO PUSH FOR MASKS IN CLASS AND STUDENTS COULD WEAR THEM IF THEY FEEL UNCOMFORTABLE.

FOR ME IS THE FIRST TIME I'VE SEEN WHAT MY PROFESSORS LOOK LIKE SATURDAY AND TODAY PERSON THAT HAS BEEN REALLY COOL.

MAKING GOOD PROGRESS. LAST FRIDAY AUBURN BROKE DOWN ITS NATIONAL LEGACY POLICY -- COMMEMORATE GREEK ORGANIZATIONS ON CAMPUS. THAT SHOULD BE COMPLETED NEXT SPRING 2022 BUT THAT WILL BE A REALLY, REALLY GREAT FACILITY FOR STUDENTS TO USE. THIS WEEK WE HAVE BETTER RELATIONS DAY, THURSDAY THE 18TH SO UGA AND ALL OF THEM ARE COMING. THEY DON'T TALK TO EACH OTHER THEY JUST TALK TO US. WE ARE EXCITED TO SEE THEM OFF THE FOOTBALL FIELD. MY BRANCH EXTERNAL AFFAIRS IS WORKING ON SPORTSMANSHIP CAMPAIGN BECAUSE WE HAVE DEFINITELY SEEN A DECLINE IN THAT ACROSS THE SEC SO WE WILL WEEP TALKING ABOUT WHAT WE CAN DO TO GET SPORTSMANSHIP UP ACROSS ALL OF SEC. AND EPC, A UNIVERSITY PROGRAM COUNCIL IS HOLIDAY TREE LIGHTING THAT WILL BE GREAT, LOTS OF SNACKS AND GAMES. AUBURN SINGERS ARE COMING OUT, ACQUIRES, THERE WILL BE A GREAT TIME AND.

AND THANKSGIVING BREAK IS NEXT WEEK BUT THE IRON BOWL NEXT WEEKEND AND FINAL EXAMS START DECEMBER 4.

THEY GO FOR ABOUT A WEEK. STUDENTS ARE REALLY EXCITED TO

FINISH UP THE SEMESTER AND. >> SPEAKER: I LOOK FORWARD TO BEING PART OF THE HOLIDAY TREE LIGHTING CEREMONY.

THIS TIME IS AN OPPORTUNITY FOR CITIZENS TO COMMUNICATE TO THE COUNCIL ONLY ON ITEMS AT TONIGHT'S AGENDA.

IF YOU WOULD LIKE TO SPEAK TO THE CITY COUNCIL PLEASE COME FORWARD AND GIVE YOUR NAME AND ADDRESS FOR THE RECORD.

YOU WILL HAVE FIVE MINUTES TO SPEAK TO THE COUNCIL COUNCIL.

THERE ARE A NUMBER OF ITEMS IT PARTICULARLY AT THE END OF THE AGENDA THAT HAVE PUBLIC HEARINGS I WOULD ENCOURAGE HER TO WAIT UNTIL THOSE ITEMS ARE INTRODUCED BEFORE YOU SPEAK TO THE COUNCIL.

[7. CITY MANAGER’S COMMUNICATIONS]

ANYONE? WE WILL MOVE AHEAD.

CITY MANAGER'S COMMUNICATIONS. >> SPEAKER: MAYOR, UNDER CITY MANAGER'S COMMUNICATION THIS EVENING WE HAVE THE ANNOUNCEMENT OF ONE VACANCY ON THE WATER WORKS BOARD, SIX-YEAR TERM BEGINS JANUARY 2, 2022. IT ENDS JANUARY 6, 2028.

YOUR ORIGINAL AGENDA SAID WE WOULD APPOINT AT THE DECEMBER 7 MEETING. THAT IS ACTUALLY DECEMBER 21.

WE HAVE MODIFIED THAT. JUST KNOW THAT THAT IS COMING DECEMBER 21. A FEW OTHER MINOR ITEMS. AS I MENTIONED IN COMMITTEE OF THE WHOLE ITEM A 8D4 YOU HAD A REDUCTION, FOR 13 CHEVROLET TAHOES AND A LOWER DOLLAR AMOUNT. AND WE WILL BE TAKING DUE TO A PRE-ZONING REQUEST BY THE APPLICANT, ITEM 9B1 THE KEEL REZONING WILL COME BEFORE ITEM 9A2 THE KEEL ANNEXATION.

I WILL WALK YOU THROUGH THAT WHEN WE GET THERE.

ANY QUESTIONS ABOUT THOSE THINGS?

[8. CONSIDERATION OF CONSENT AGENDA]

MOVING FORWARD, FIRST ITEM OF BUSINESS IS THE CONSENT AGENDA.

IS ANY COUNCIL MEMBER WAS TO REMOVE AN ITEM FROM THE CONSENT AGENDA AND DEAL WITH THAT ITEM INDIVIDUALLY?

>> SPEAKER: YES, I WOULD LIKE TO REMOVE ITEM 8B3 AND 8B4.

>> SPEAKER: ANYONE ELSE? ITEM 8B3 IS A REQUEST FROM SHINHWA AUTO FOR TAX ABATEMENT ASSOCIATED WITH BUILDING EXPANSION AND PURCHASE OF NEW CAPITAL EQUIVALENT WITH A TOTAL INVESTMENT OF $70 MILLION AND THE CREATION OF 48 JOBS.

>> SPEAKER: MOVE FOR APPROVAL. >> SPEAKER: MOTION AND SECOND.

I REALLY WANTED TO JUST REMOVE THESE FROM THE AGENDA TO HIGHLIGHT THESE. THESE ARE TWO EXCITING MOMENT THAT IT HAPPENED AN EVENT THAT HAPPENED FOR OUR COMMUNITY AND MS. CROUCH, I DIDN'T KNOW IF THE ECONOMIC DEVELOPMENT DIRECTOR COULD SHED A BIT OF LIGHT ON THESE.

YOU CAN TAKE THEM ONE OF THE TIME IF YOU WOULD LIKE TO.

>> SPEAKER: ABSOLUTELY. WE WILL GO WITH 8B3 NATIONWIDE ANNOUNCEMENT BECAUSE YOU WOULD HAVE SEEN AND NOTIFY HER ABOUT THAT I WOULD LIKE MR. DUNLAP TO SPEAK A LITTLE BIT MORE ABOUT THE NEW INVESTMENT AND IT'S IMPORTANT TO THE CITY.

>> SPEAKER: THANK YOU. >> SPEAKER: I APPRECIATE THE RECOGNITION FOR THE STAFF AND ECONOMIC DEVELOPMENT.

THOSE FOLKS, ALL OF THE TEAM HAS WORKED VERY HARD IN THE LAST FEW MONTHS PARTICULARLY WITH SHIN WHILE.

THIS IS A VERY EXCITING PROJECT AND IT HAS BEEN A LITTLE UNDER THE RADAR. IF YOU HAVEN'T HAD AN OPPORTUNITY TO SEE IT, OUR FRIENDS FROM KOREA HAVE WANTED TO DO AN OPEN HOUSE YET AND SO BEFORE WE COULD EVEN HAVE AN OPEN HOUSE, THEY HAVE ANNOUNCED ANOTHER BIG INVESTMENT AND THIS IS VERY EXCITED BECAUSE THEY ARE GOING TO BRING IN VERY LARGE HIGH-PRESSURE DIECAST MACHINES. THAT IS WHAT THIS IS.

IT IS CAPITOL EQUIPMENT EXPANSION WITHIN THE FACILITY.

THESE MACHINES GIVE THEM THE CAPABILITY TO DO VERY LARGE PARTS FOR HYUNDAI AND KIA. WHAT IS INTERESTING ABOUT SHINHWA IS THAT THERE ARE OTHER THINGS ON THE HORIZON AND WHILE WE EXPECT OTHER THINGS TO HAPPEN, WE EXPECT TO HAVE AN

[00:10:02]

ENTIRE COMPLEX WITH THIS COMPANY AND IT'S A VERY LARGE COMPANY.

WE ARE WORKING VERY HARD WITH THEM TO SUPPORT THEM AS THEY MOVE FORWARD. IT IS A $70 MILLION INVESTMENT, ABOUT 48 JOBS. HIGHLY AUTOMATED.

JOBS ARE GOING TO BE WELL PAID BECAUSE WE ARE WORKING WITH PIPE METAL OBVIOUSLY IT IS A KEY PIECE OF INDUSTRIAL INFRASTRUCTURE THAT IS NECESSARY AND THE -- IN THE AUTOMOTIVE INDUSTRY. PARTICULARLY WHEN YOU'RE TALKING ABOUT FRAMES AND ENGINE MOUNTS, OTHER THINGS.

KNUCKLES, DRIVESHAFTS OR THOSE KINDS OF THINGS.

SO IT IS ALL PART OF A NETWORK THAT WE HAVE BEEN ABLE TO BUILD OVER THE YEARS OF HIGH AND QUALITY SUPPLIERS FROM KOREA.

>> SPEAKER: THANK YOU, MR. DUNLOP.

ANY OTHER COMMENTS OR QUESTIONS FROM THE COUNCIL? ALL IN FAVOR? ANY POST?

THE MOTION CARRIES. >> SPEAKER: ITEM 8B4 IS A REQUEST FROM SIO2 FOR TAX ABATEMENT ASSOCIATED WITH THE BUILDING EXPANSION AND PURCHASE OF NEW CAPITAL EQUIPMENT WITH A TOTAL INVESTMENT OF $123,000,100 AND THE CREATION OF 40 NEW JOBS.

>> SPEAKER: MOVE FOR APPROVAL. >> SPEAKER: SECOND.

>> SPEAKER: MOTION AND SECOND. ONCE AGAIN I WOULD LIKE MS. CROUSE FOR THE ECONOMIC DEVELOPMENT DIRECTOR TO TALK MORE ABOUT THIS SIO2 HAS CERTAINLY BEEN A PRIMARY TOPIC OF THE CITY COUNCIL HERE FOR THE LAST COUPLE OF YEARS.

WE ARE CERTAIN EXCITED ABOUT THEIR FURTHER EXPANSION.

>> SPEAKER: MAYOR, I WANT TO AND WHY WE DID NOT MOVE IT FROM CONSENTS. THERE ARE SEVERAL MODIFICATIONS ON THE AGENDA THAT WILL FALL LATER FOR SIO2 AND ONE OF THE THINGS IS ONE OF THEIR INVESTMENT AMOUNTS WILL INCREASE FROM $63.3 MILLION -- THERE IS ANOTHER $137 MILLION IN THERE THAT IS IN A DIFFERENT AGENDA ITEMS I REALLY WANT TO ACKNOWLEDGE YOUR TALKING WELL OVER $250 MILLION OF ADDITIONAL INVESTMENT BY SIO2. MR. DUNLOP WILL TALK A LITTLE BIT MORE ABOUT IT. WE APPRECIATE BOBBY ABRAMS VERY MUCH AND HIS CONTINUED COMMITMENT TO THIS COMMUNITY FROM THE EARLY '90S FORWARD. THIS IS A MASSIVE INVESTMENT AND A VERY CRITICAL TO COVID AND MODERNA VIALS AND OTHER THINGS.

MR. DUNLAP? >> SPEAKER: YES, MA'AM.

ONCE AGAIN, THIS IS A VERY, VERY EXCITING PROJECT.

WE HAVE WORKED ON THIS PROBABLY FOR NINE MONTHS WORKING VERY CLOSELY WITH BOBBY. WE WERE ABLE TO CONTINUE TO SUPPORT HIM. WE HAVE IN A POSITION NOW WHERE WE CAN MOVE FORWARD. THEY ARE GOING TO BUILD AND 87,000 SQUARE-FOOT EXPANSION ON THE REAR OF THE 2425 OF THE BUILDING I'M TALKING ABOUT IS THE ONE WHERE YOU SEE GE AVIATION OFF TO THE LEFT WHEN YOU ARE ATTENDED THAT GROUNDBREAKING -- GROUNDBREAKING.

THIS BUILDING IS GOING TO BE MORE THAN DOUBLED IN SIZE WITH THE LOT TO THE REAR. WHAT WILL BE IN THE BUILDING IS ALMOST OVER $90 MILLION OF CODING LINES.

TO UNDERSTAND WHAT IS HAPPENING HERE, THIS TECHNOLOGY -- I DON'T LIKE USING SUPERLATIVES GENERALLY, AND I CAUTION MY STAFF AGAINST USING SUPERLATIVES, BUT IT IS TRULY A WORLD-CLASS FACILITY IN THAT THESE VIALS ARE PLASTIC AND THEY ARE COATED WITH A THIN STRIP OF METAL AS WELL AS GLASS.

THAT IS WHY IT IS SIO2. THAT IS THE CHEMICAL NAME FOR GLASS. WHAT IS HAPPENING HERE IS THERE EXCLUSIVE PROVIDER TO MODERNA AND SO THIS FACILITY WILL GIVE THEM THE ADDITIONAL ABILITY TO DO A NEW PRODUCT THAT WILL GO ALL OVER THE WORLD, INJECTORS. THE PREPACKAGED INJECTORS.

SO RECENTLY TAKEN OUT OF THE KIDS AND GIVE THE SHOT TO AN INDIVIDUAL. SO THIS IS REALLY TARGETED TO THIRD WORLD COUNTRIES, AFRICA, OTHER PLACES.

IS TARGETED TO SOUTHEAST ASIA, INDIA.

BOBBY IS DOING A LOT OF EXCITING THINGS WHERE I AM HAVING LUNCH TOMORROW WITH A GROUP OF SWISS ARE HERE.

THEY ARE LOOKING AT OTHER OPPORTUNITIES.

WHEN YOU ARE LOOKING AT $123 MILLION INVESTMENT, MACON IS EXACTLY CORRECT. THE TRUE INVESTMENT OF SIO2 IS PROBABLY CLOSER TO $700 MILLION. IT IS A HUGE WIN FOR US AND IT IS CONSISTENTLY ADDING JOBS. THE ENDGAME IS NOT IN SIGHT.

IT IS AN OPPORTUNITY. RESPOND AN ENTIRE BIOTECH INDUSTRY HERE WITH THAT, THERMO FISHER, AND BOBBY'S HAD A HAND IN EACH OF THOSE. YOU MAY NOT REALIZE THAT BUT HE WAS INVOLVED IN EACH OF THOSE COMING TO AUBURN.

I AM EXCITED BECAUSE THE BIG WINNER HERE -- IS VERY IMPORTANT FOR US TO UNDERSTAND, WHEN WE DO THESE KINDS OF PROJECTS WITH THESE HUGE CAPITOL INVESTMENTS, THE BIG WINNER IS OUR PUBLIC SCHOOL SYSTEM ALL TAXES. THERE WILL BE BETTER THAN

[00:15:01]

1.3 MILLION IN TAXES, EDUCATIONAL ADD VALOREM TAXES GENERATED JUST OFF OF THESE TWO INVESTMENTS.

AND THAT IS HUGE. THAT IS JUST ANNUAL.

MULTIPLY THAT BY TEN, THAT IS A HUGE NUMBER.

TYPICALLY THIS VERY SOPHISTICATED IS EIGHT TO TEN YEARS. IT IS GOING TO BE A SOLID INCOME STREAM FOR OUR PUBLIC SCHOOLS AND WE ARE VERY FORTUNATE TO HAVE THIS INVESTMENT. TYPICALLY THIS KIND OF INVESTMENT WOULD BE ON THE PRINCETON CORRIDOR IN THE NORTHEAST. THAT'S WHERE MOST OF THE PHARMA INDUSTRY IS LOCATED IN THE U.S. THIS IS A GREAT WIN FOR AUBURN AND THE UNIVERSITY HAS PLAYED A ROLE.

ALL OF US HAVE WORKED VERY HARD -- MACON PLAYED A MAJOR ROLE. SO WE ARE VERY PROUD TO HAVE

THIS INVESTMENT IN AUBURN. >> SPEAKER: ANY QUESTIONS OR COMMENTS FROM THE COUNCIL? CONGRATULATIONS TO YOU AND YOUR STAFF. THANK YOUS EVERYBODY THAT IS MADE THIS HAPPEN. THIS IS AWESOME.

ALL IN FAVOR PLEASE SAY? THAT MOTION CARRIES.

MOTION TO APPROVE THE BALANCE OF THE CONSENT AGENDA?

>> SPEAKER: SO MOVED. >> SPEAKER: SECOND.

>> SPEAKER: MOTION AND SECOND. ALL IN FAVOR PLEASE SAY I ANY

[9. ORDINANCES]

POST? >> SPEAKER: AND ORDINANCES, ITEM NINE A MAC ONE IS A REQUEST FROM THE AUBURN CITY OF EDUCATION APPROXIMATELY 128.68 ACRES OF PROPERTY LOCATED ON THE EAST SIDE OF NORTH DONOHUE DR. AT THE TERMINUS OF YARBROUGH FARMS BLVD. THE PLANNING COMMISSION UNANIMOUSLY RECOMMENDED APPROVAL AT ITS NOVEMBER 9, 2021, MEETING. UNANIMOUS CONSENT IS NECESSARY.

>> SPEAKER: I INTRODUCED THE ORDINANCE AND ASK UNANIMOUS

CONSENT. >> SPEAKER: SECOND.

>> SPEAKER: MOTION AND SECOND. ANYONE DOES ANYONE ON THE COUNCIL HAVE A PROBLEM MOVING FORWARD WITH A VOTE ON THIS THIS EVENING? HEARING NONE, ANY DISCUSSION?

>> SPEAKER: COULD YOU WALK US THROUGH A LITTLE BIT OF THEIR INTENTIONS? IS THAT PUBLIC KNOWLEDGE?

>> SPEAKER: AT THE MOMENT THEIR INTENTIONS ARE THEY ARE ACQUIRING SCHOOL PROPERTY. FOR SOME FUTURE USE.

THEY HAVE NOT INDICATED FULLY WHAT THEY ARE GOING TO DO WITH

THE PROPERTY THIS TIME. >> SPEAKER: THANK YOU.

>> SPEAKER: AND THEY WOULD SAY, THEY HAVE ANOTHER LARGE SITE OFF OF RICHLAND WROTE AS WELL THAT HAS BEEN THE POINT OF DISCUSSION. THEY HAVE NOT MADE A FINAL DECISION AND TO THE NATURE OF WHAT THEY ULTIMATELY PLAN TO DO

WITH THIS PROPERTY OR WHEN. >> SPEAKER: THANK YOU.

>> SPEAKER: ANY OF THE QUESTIONS? LINDSAY, ROLL CALL? (ROLL CALL VOTE)

>> SPEAKER: AS PREVIOUSLY MENTIONED, SECTION 115285 OF THE CODE OF ALABAMA ALLOWS MUNICIPALITIES TO PREZONE PROPERTIES THAT ARE ACTIVELY SEEKING ANNEXATION PRIOR TO CONSIDERATION OF ANNEXATION ITSELF.

THEREFORE ITEM NINE MAYBE 1 NEED TO BE CONSIDERED BEFORE ITEM 9A2 REQUEST FROM LEDGE NETTLES ON BEHALF OF RAYFORD KEEL TO PREZONE APPROXIMATELY 41 POINTS 66 ACRES OF PROPERTY LOCATED ON THE EAST SIDE OF HEATH ROAD AND NORTH OF U.S. HIGHWAY 280 IN THE WATER OAK RIDGE SUBDIVISION. THE REZONING REQUEST IS FROM RURAL TO LARGE LOT RESIDENTIAL DISTRICT WHICH EQUALS 1 ACRE LOTS. 1 ACRE LOT MINIMUMS. THE PLANNING COMMISSION RECOMMENDED APPROVAL BY A VOTE OF 81 AT ITS OCTOBER 14, 2021, MEETING.

UNANIMOUS CONSENT IS NECESSARY AND A PUBLIC HEARING IS REQUIRED SPECTRAL INTEREST ORDINANCE AND ASK UNANIMOUS CONSENT.

>> SPEAKER: SECOND. >> SPEAKER: MOTION AND SECOND.

DOES ANYONE ON THE COUNCIL HAVE A PROBLEM MOVING FORWARD WITH A VOTE ON THIS THIS EVENING? HEARING NONE AT THIS TIME WE WILL OPEN THE PUBLIC HEARING. IF YOU WOULD LIKE TO ADDRESS THE CITY COUNCIL ON THIS, PLEASE COME FORWARD AND GIVE US YOUR

NAME AND ADDRESS FOR THE RECORD. >> SPEAKER: GOOD EVENING EVERYBODY. LEDGE NETTLES BASELINE SURVEYING 20 DOORS 2004 YARBOROUGH DRIVE. OPELIKA.

THE PREVIOUS TIME YOU MENTIONED THIS AND YOU VOTED ON THE LL RD, WE MISSED IT. WE GOT OUR WIRES CROSSED UP.

MISCOMMUNICATION, WE DIDN'T SHOW UP TO TALK.

WE WISH WE COULD HAVE BECAUSE I THINK WE COULD'VE HAD SOME GOOD POINTS. I DO WANT TO ADDRESS YOU ABOUT THAT NOW. AND LET YOU SEE WHAT YOU THINK ABOUT WHAT WE HAVE -- WHERE WE ARE COMING FROM HERE.

KEITH RHODES AND ARTERIAL ROAD AND I THINK ONE OF THE MAIN VOTE AGAINST IT FROM WHAT I'VE READ AND HEARD IT WAS THAT THERE WERE TOO MANY MAILBOXES. THIS WAS GOING TO ADD TO HEATH ROAD IN THAT SECTION. 40 ACRES, SO WHEN YOU DO THE ROAD AND ANYTHING ELSE, YOU ARE PROBABLY TALKING ABOUT MAYBE 34 LOTS. THIS IS THE END OF HIS AREA.

HE HAS NO MORE RIGHT THERE. THAT IS IT.

[00:20:03]

OVER TIME, WE HAD -- HE HAD DEVELOPED THIS LAND I HELPED HIM SINCE 2000 AND BREAKING UP THE LOTS.

WE SAVED PURPOSELY ONE SPOT FOR ROAD ONE DAY.

THE SITE DISTANCE THERE, IF THERE IS A PROBLEM, I WANT TO GET IT OUT THERE. SITE DISTANCE SHOULD BE A PROBLEM BECAUSE WE LEFT 700 FEET TO THE NORTH.

WE LEFT 1400 FEET TO THE SOUTH. THAT SHOULD BE WELL WITHIN THE GUIDELINES. I DON'T THINK THAT 34 LOTS WILL ADD A LOT OF TRAFFIC. THE DEFINITION OF AN ARTERIAL IS 13,000 -- 13,300 VEHICLES A DAY. WE ARE ADDING 34 LOTS TIMES TO A OR SO. I DON'T THINK WE ARE OVERLOADING IT. WE ARE TRYING TO DO HERE IS TRY TO GET YOU TO CONSIDER -- RECONSIDER THIS PIECE OF LAND AS PART OF WHERE IT WAS ORIGINALLY. IT WAS ORIGINALLY INCLUDED IN THE MAP. THE MASTER PLAN FOR THE SITE.

IT WAS TAKEN OUT -- I DON'T KNOW WHY.

MAYBE IT WAS A CONCERN FOR THE TRAFFIC.

THAT'S WHAT I AM TRYING TO DISPEL THAT NOW.

A LOT OF STUDIES WERE DONE SINCE JANUARY OF 2020 ON THIS AREA.

STAFF, I BELIEVE YOU GUYS WERE INVOLVED IN SOME OF THAT TOO.

A LOT OF THE STUDIES OF COVID STOPPED IT.

I KNOW EVERYONE HAD A LITTLE INPUT ON IT AND STAFF HAD RECOMMENDED IT. WE ACTUALLY MET WITH STAFF THINKING THAT IT WAS GOING TO GO THROUGH.

WE HAD A LAYOUT AND TALKED WITH THEM AND THEY WERE GOOD.

EVERYTHING SEEMS PRETTY GOOD. SO WE WERE A LITTLE BIT BLINDSIDED BY THE REMOVING IT FROM THE AGENDA, FROM THE LL RD.

REALLY WHERE WE ARE GOING WITHOUT IS WE WANT YOU TO THINK -- FOR ALL OF THIS WORK THAT STAFF PUT IN, THAT YOU GUYS PUT IN, ALL OF THAT, FOR SOMEBODY TO COME IN AND SAY SOMETHING ABOUT IT, IT'S GOING TO ADD TOO MANY MAILBOXES AND SAY, WELL, GOOD POINT AND VOTED DOWN, JUST TO RECONSIDER THAT A LOT OF WORK WAS PUT INTO THAT THOUGHT AND YOU GUYS PUT A LOT OF WORK INTO IT. I JUST WANT YOU TO THINK ABOUT IT AND RECONSIDER, OPEN YOUR MIND FOR A MINUTE AND THINK ABOUT MAYBE IT IS. IT IS NOT GOING TO BE THE GATEWAY THAT OPENS UP EVERYTHING.

I JUST -- IF YOU HAVE ANY QUESTIONS, I WOULD BE GLAD TO COME BACK AND ANSWER. IF YOU THINK OF SOMETHING, I WILL COME BACK. IF YOU WANT ME TO.

I WOULD BE GLAD TO TRY TO ANSWER.

>> SPEAKER: DOES THE COUNCIL HAVE ANY QUESTIONS FOR MR. NETTLES NOW? THANK YOU.

>> SPEAKER: I'M DONE. THANK YOU.

>> SPEAKER: WHO WILL BE NEXT? >> SPEAKER: THE TIMER WASN'T

WORKING. >> SPEAKER: THERE IS NO TIMER

ON PUBLIC HEARING. >> SPEAKER: CITY COUNCIL MY NAME IS BRAD TAPLEY A LIVE ON 4943 HEATH ROAD.

PLEASURE TO BE HERE THIS EVENING.

I HAVE BEEN FOLLOWING THIS ALL ALONG BECAUSE I WAS WONDERING HOW IT AFFECTS OUR PROPERTY OUT THERE.

I LIVE WEST SIDE, PROBABLY A HUNDRED YARDS FROM WHERE THIS NEIGHBORHOOD WOULD BE DEVELOPED. LOOKING AT THE 280 FOCUS STUDY AND ALL, A LOT OF COMMERCIALS BEING BROUGHT TO THAT AREA.

WITH OUR LOT BEING 1.8 ACRES, IT WAS BUILT DON'T OUR HOUSE WAS BUILT IN '96. IT IS BEEN OUT THERE WHILE.

I THINK WE LOVE THE COMMUNITY OUT THERE, THE FELLOWSHIP WITH OUR NEIGHBORS OUT THERE AS WELL. I THINK THE LARGE LOT RESIDENTIAL DISTRICT WOULD BE GOOD FOR THE COMMUNITY OUT THERE. I LISTEN TO THE PREVIOUS CITY COUNCIL MEETINGS AND THERE WAS THINGS BROUGHT UP ABOUT TRAFFIC AND MAILBOXES AND WE HAVE RESIDED OUT THERE FOR THREE YEARS NOW AND WE HAVE NEVER HAD AN ISSUE TURNING INTO OUR DRIVEWAY. WE HAVE NEVER HAD AN ISSUE WITH BACKLOGS GETTING ONTO TO 80. MY WIFE GOES AND CHECKS THE MAILBOX FOR THE KIDS EVERY EVENING AND WALKS ACROSS HIGHWAY 147 AND WE NEVER EVEN HAD ANY ISSUES WITH THAT.

AS FAR AS I KNOW AS LONG AS I LIVED OUT THAT THEY HAVE A BIT ANY ACCIDENTS NEAR OUR DRIVEWAY. I AM IN SUPPORT OF IT GOING TO THE LARGE LOT RESIDENTIAL DISTRICT.

I'M JUST COMING HERE TO VOICE MY SUPPORT TONIGHT.

>> SPEAKER: THANK YOU. WHO WILL BE NEXT?

ANYONE? >> SPEAKER: SHANE DAVIS, I LIVE AT 4020 ALABAMA HIGH 147. I SPOKE AT THE PLANNING MEETING LAST MONTH. MY WIFE AND I, MY FAMILY HAVE BEEN ON 47 FOR 15 YEARS NOW. WE TRAVEL.

[00:25:02]

I HAVE A 17-YEAR-OLD SON THAT TRAVELS TO AND FROM SCHOOL WITH MY TWO DAUGHTERS EVERY DAY AND THE TRAFFICRN OF MINE. I NEVER AM AFRAID OF MY KID TAKING MY DAUGHTER TO SCHOOL OR COMING HOME.

WE ARE NEVER BACKED UP ON 280, LIKE YOU SAID.

WE VERY SELDOM MIGHT SEE AN ACCIDENT AT THE INTERSECTION OF 147 AND 280. THERE HAS BEEN A LOT AT THE OTHER INTERSECTION OF 147 OR NORTH COLLEGE AND 280 BUT THEY PUT A TRAFFIC LIGHT AND I BELIEVE THAT THE STATE MAYBE CONSIDERING A TRAFFIC LIGHT AT THE NORTH SIDE OF 147 AND 280.

Y'ALL MIGHT KNOW MORE ABOUT THAT THAN I DO.

THAT'S RUMORS THAT I'VE HEARD. I SAY, I SUPPORT THE LARGE ACRE LOTS, THE LL RD OR WHATEVER IT'S CALLED ALSO.

I THINK IT WOULD BE A GREAT SPOT TO DO THE 1 ACRE LOTS AND GET AWAY FROM THE REAL TIGHT SUBDIVISIONS.

>> SPEAKER: THANK YOU, SIR. WHO WILL BE NEXT?

>> SPEAKER: MY NAME IS GEORGIA JONES AND I LIVE AT 50/50 HEATH ROAD. I ACTUALLY LIVE AT THE HOUSE THAT WOULD BE THE ENTRANCE TO THE NEIGHBORHOOD.

I HAVE NEVER HAD AN ISSUE WITH TRAFFIC.

I DON'T HAVE AN ISSUE WITH THE SITE DISTANCE.

I WOULD LIKE TO SAY THAT I'M 26 AND SO I AM CURRENTLY TRYING TO FIND A HOUSE AND SO I HAVE HAD A REALLY HARD TIME TRYING TO FIND SOMETHING BETWEEN THE QUARTER OF AN ACRE LOT OR 3-ACRE LOT THAT I CAN'T AFFORD 3 ACRES. I JUST CAN'T AFFORD THAT AT MY AGE. AND THERE IS A LOT OF PEOPLE THAT ARE LIKE GRAD STUDENTS, YOUNG COUPLES, JUST MARRIED COUPLES, LITTLE CHILDREN THAT CAN'T AFFORD 3-ACRE LOT EITHER.

SO I THINK IT WOULD BE GREAT DEVELOPMENT FOR THE NORTH AUBURN AREA AS IT IS GROWING SUBSTANTIALLY.

I HAVE A LOT OF FRIENDS AND FAMILY THAT LIVE ON DONAHUE AND THEY HAVE MORE TRAFFIC THAN WE DO OUT THERE.

AND LIKE I ORDER ORDERED THE PIZZA THE OTHER NIGHT DELIVERED AND I DON'T REALLY HAVE AN ISSUE TRAFFIC, DELIVERY OF FOOD, MAILBOXES, TRASH. I THINK IT WOULD BE A GREAT ADDITION TO THE AUBURN AREA. THANK YOU.

>> SPEAKER: THANK YOU. NEXT?

YES, MA'AM? >> SPEAKER: MY NAME IS ASHLEY MAJERUS. I LIVE AT 997 BERNIE LN.

I LIVE OFF DONAHUE AND I WANTED TO JUMP UP AND SUPPORT THE KEEL'S REQUEST FOR THE 1 ACRE LOTS.

I GREW UP ON THE NORTH SIDE OF AUBURN LIVED HERE PRETTY MUCH MY WHOLE LIFE. NOW MY HUSBAND AND I WITH OUR LITTLE BOY LIVE OFF DONAHUE, LIKE I SAID.

WE ARE ON .3 ACRES AND QUICKLY FOUND THAT THAT IS NOT WHAT WE DESIRE LONG TERM. WE HAVE BEEN EXCITED ABOUT THE IDEA OF 1 ACRE LOTS NEARBY. WE COULD STAY IN OUR AREA AND WHERE WE WANT TO BE CLOSE TO TOWN, BUT STILL TAKE ADVANTAGE OF THOSE 1 ACRE LOTS. THAT WAS ALL.

THANK YOU FOR YOUR TIME THAT WAS MY TWO CENTS.

>> SPEAKER: THANK YOU. >> SPEAKER: GOOD EVENING.

HOLLY GILL, MIKE GIL'S WIFE. OUR ADDRESS IS 50/50 HEATH ROAD.

I WILL COME IT AT A COUPLE OF DIFFERENT SENSES.

A TRAFFIC IS NEVER BEEN AN ISSUE ON HEATH ROAD.

IT IS A VERY ADEQUATE HIGHWAY. I HAVE BEEN TRAVELING THAT ROAD SINCE 2012. NOT ONLY IS THE TRAFFIC NOT AN ISSUE, BUT OUR NEED -- I'M AN AGENT, A REAL ESTATE AGENT -- OUR NEED IN THE CITY OF AUBURN, THERE IS SO MUCH DENSE DEVELOPMENT. WE DON'T KNOW IF WE HAVE KIND OF LOST THAT PERSONAL TOUCH OF A BUILDER THAT WILL ACTUALLY LISTEN TO A CLIENT. AND WILL BUILD A HOME THAT IS SPECIFICALLY WHAT THEY WOULD LIKE.

THAT IS MIKE DILTS' PRODUCT. HE IS BEEN BUILDING OVER 30 YEARS AND HAS A REPUTATION ON HIS OWN.

I WOULD ASK YOU TO TO CONSIDER THIS BECAUSE NOT ONLY WILL IT BE AN ASSET TO OUR RESIDENTS HERE IN THE TOWN, BUT IT WILL BE A

[00:30:01]

QUALITY BUILD AND SOMETHING THAT WILL LAST FOR AN ETERNITY.

WE HAVE A GREAT COMMUNITY OUT AT HEATH ROAD.

EVERYONE KNOWS EVERYONE AND WE WOULD JUST LIKE TO ASK FOR THE

SUPPORT. >> SPEAKER: THANK YOU.

ANYONE ELSE? >> SPEAKER: I'M JOSH GAUNTT AWAY, I LIVE ON 140 GRID ELLIS LN.

I WANT TO REITERATE SOME THINGS THAT THEY SAID.

WE DON'T HAVE A PROBLEM WITH TRAFFIC UP AND DOWN THERE.

WOULD TURN IN AND OUT OF OUR DRIVEWAYS AND EVERYTHING JUST FINE. BRINGING THIS TO THE CITY, IT WOULD BE 1 ACRE LOTS ARE HUGE IN AUBURN.

THE BUILDING PROCESS, EVERYTHING LIKE THAT IS A PLUS.

3-ACRE LOTS WOULD BE OUTRAGEOUS FOR PEOPLE TO AFFORD.

THEY WILL BE $200,000 PLUS. IF YOU GET DOWN TO 1 ACRE LOT YOU CAN AFFORD MORE, THEY HAVE MORE LUXURY STUFF THEY CAN BUILD WITH THAT AND NOT BE SO CONFINED TO HAPPEN ACRE OR QUARTER OF AN ACRE. AND ALSO IT WOULD GIVE MY KIDS AWAY TO GO INTO THE NEIGHBORHOOD AND PLAY AND HAVE MORE PEOPLE TO PLAY WITH AND STUFF LIKE THAT, OTHER THAN BEING DEFINED TO PLAINSMAN HILLS SUBDIVISION, ONE ROAD.

LIKE I SAID, GO OFF TO 80 ALL THE TIME, NOT A PROBLEM.

I DON'T THINK IT'S GOING TO BE A PROBLEM AT ALL.

I BELIEVE THAT'S IT. THANK YOU.

>> SPEAKER: THANK YOU. APPRECIATE IT.

ANYONE ELSE? WE WILL CLOSE THE PUBLIC HEARING. ANY QUESTIONS OR DISCUSSION FROM

THE COUNCIL? >> SPEAKER: YES, MS. TURMERIC.

I APPRECIATE THE OPPORTUNITY TO COME UP.

FOR PEOPLE TO LIVE OUT ON THE HEATH ROAD AREA UNABLE TO BE HERE TONIGHT BUT ASKED THAT I PASS ALONG THEIR OBJECTIONS TO THIS REQUEST. THE RATIONALE AGAIN WAS TRAFFIC.

YOU YOU HAVE MENTIONED HAPPY TO HEAR THAT Y'ALL DON'T HAVE PROBLEMS WITH TRAFFIC. BUT THE FOUR OTHER PEOPLE THAT LIVE OUT ON HEATH ROAD THAT CONTACTED ME CITED TRAFFIC ISSUES. THE OTHER THING THAT WAS VERY CONSISTENT WAS THE LACK OF A SEWER SYSTEM, SEWER SUPPORTABILITY IN THE AREA. WE ARE TALKING ABOUT 38 OR 40 -- YOU SAID 34 LOSS TO WHATEVER IT IS, UP TO 40 THAT WOULD ALL BE ON SEPTIC SYSTEMS. I HAVE A NEIGHBORHOOD THAT WAS ANNEXED LONG BEFORE I WAS ON THE CITY COUNCIL.

THERE IS 100 PERCENT ON SEPTIC SYSTEMS. AND NOW THEY ARE COMING BACK ASKING FOR CITY SUPPORT AND ALL OF THESE KINDS OF THINGS BECAUSE THE PROPERTY HAS TURNED OVER OVER TIME AND THEY DIDN'T KNOW WHAT THEY WERE GETTING INTO.

I DON'T THINK IT IS A GOOD IDEA FOR US TO BE ANNEXING AND ESTABLISHING ENTIRE SUBDIVISIONS WITHIN THE CITY LIMITS THAT ARE

SOLELY ON SEPTIC SYSTEMS. >> SPEAKER: OKAY.

THANK YOU, KELLEY. ANYBODY ELSE ON THE COUNCIL HAVE

A COMMENT OR QUESTION? >> SPEAKER: I HAVE A COMMENT AND MAYBE A QUESTION. I GUESS THE BIG ISSUE HERE IS THAT FROM A PLANNING PERSPECTIVE, THIS BODY IT AS RECENT AS SEPTEMBER OF THIS YEAR , VISITED AND DELVES INTO THE 280 FOCUS AREA STUDY WHICH WE ADOPTED AS PART OF THE MASTER PLAN. WE CHOSE TO KEEP THAT AREA AS CLASSIFIED AS RURAL. THIS WOULD GO INDIRECT CONFLICT WITH WHAT WE JUST AS A BODY AGREED TO DO.

I DO AGREE THAT 1 ACRE LOTS ARE A CATEGORY THAT THIS COMMUNITY NEEDS MORE OF. HOWEVER, I DON'T KNOW THAT THIS IS THE BEST PLACE FOR THAT TO HAPPEN.

AT THIS POINT IN TIME. BECAUSE OF THE LACK OF INFRASTRUCTURE THAT DOES EXIST OFF OF HIGHWAY 147.

I TRAVEL THAT ROAD TOO, ON A WEEKLY AND DAILY BASIS.

I HAVE A DIFFERENCE OF OPINION ON TRAFFIC.

THERE IS SPEED ISSUES, THERE IS COMING UP TO 147, THE STACKING.

BUT MAINLY, IF I LIVED IN ONE OF THE HOUSES THAT BACKED UP TO A DEVELOPMENT OF ALMOST 34 LOTS OF SEPTIC'S AND THEY START FAILING, I WOULD BE MOST UPSET. THAT IS JUST ONE ASPECT OF IT.

I JUST DON'T THINK THAT THE AREA IS SET UP FROM AN INFRASTRUCTURE PERSPECTIVE. WE'VE ALREADY HAD ENOUGH TROUBLES WITH TRYING TO GET THAT PORTION OF 147 ALIGNED SAFELY

[00:35:02]

DEVELOPED. THAT HAS TAKEN A VERY LONG TIME TO HAPPEN. I THINK THIS WOULD COMPOUND THOSE ISSUES. I RECOGNIZE THAT THE APPLICANTS SPOKEN STATED THAT IT IS A -- AND ARTERIAL ROAD THAT CAN HANDLE 13,300 TRIPS. BUT I THINK IT IS GREATLY UNDERESTIMATED HOW MANY TRIPS 34 LOTS WOULD ACTUALLY HAVE.

NOT TO MENTION RIGHT NOW OUR SCHOOL SYSTEMS, THAT'S 34 ADDITIONAL FAMILIES COMING IN OR NOT THAT'S A BAD THING, IT'S JUST THAT I THINK FOR THAT AREA, WE ALSO JUST RECENTLY, THIS BODY CHOSE TO DECLINE AND ANNEXATION THAT WOULD HAVE BUILT HOMES MUCH FURTHER UP NORTH 147 FOR SOME OF THE SAME EXACT REASONS.

FOR THAT PERSPECTIVE, I AM NOT IN FAVOR AT THIS TIME GOING TO LARGE LOT RESIDENTIAL DISTRICT. I THINK IT SHOULD STAY RURAL IN NATURE BECAUSE OF LACK OF INFRASTRUCTURE AT THIS POINT IN

TIME. >> SPEAKER: THANK YOU, BETH ANYONE ELSE ON THE COUNCIL? MS. CROUCH, CAN YOU TALK TO THE ASPECT OF A NEIGHBORHOOD BEING BUILT ON SEPTIC AND WHAT KIND OF RESPONSIBILITY DOES THAT PUT ON THE CITY FOR ITS FUTURE?

>> SPEAKER: I WILL GIVE YOU AN INTRODUCTION AND I WILL HAVE OUR WATER RESOURCE MANAGEMENT DIRECTOR SPEAK MORE TO IT.

AT THE END OF THE DAY, TYPICALLY WE SEE LOTS IN AUBURN THAT ARE C TANKS. BUT NOT ALL THE TIME.

THE HEALTH DEPARTMENT WHICH ACTUALLY REGULATES SEPTIC TAKES, WE SAY MINOR THINGS ABOUT THEM, DOES ALLOW THEM FOR 1 ACRE LOTS.

THERE IS NO QUESTION ABOUT THAT. IN THIS CASE, THEY DON'T HAVE PUBLICLY AVAILABLE -- IT'S NOT LIKE THEY ARE REFUSING TO TIED TO PUBLIC SEWERS. IT'S NOT AVAILABLE ON THAT SIDE OF 280. I WILL HAVE MR. CARSON COME UP AND SPEAK A LITTLE BIT TO IT FROM HIS PERSPECTIVE AND HOW WE LOOK AT THAT FROM A REGULATORY STANDPOINT.

>> SPEAKER: THANK YOU, COUNCIL. FROM A REGULAR TOUR STANDPOINT, REALLY NOT A WHOLE LOT OF AUTHORITY THAT THE WATER RESOURCE MANAGEMENT DIVISION HAS OVER IT.

OBVIOUSLY A 1 ACRE LOT MEETS THE STATE REGULATIONS.

OUR BIGGEST CONCERN IS IF A SEPTIC TANK FAILS, IS THERE ENOUGH ROOM TO BUILD ANOTHER LINE.

A 1 ACRE LOT COULD PRESENT SOME CHALLENGES.

WE HAVEN'T SEEN ANY ISSUES WITH THE LARGER LOTS, BUT AGAIN, WE REALLY DON'T HAVE ANY AUTHORITY TO PREVENT THEM FROM THE CITY

PERSPECTIVE. >> SPEAKER: WHAT HE IS REFERRING TO IS IN OUR WATER RESOURCE MANAGEMENT DESIGN AND CONSTRUCTION MANUAL IT IS NOT PROHIBITED, BUT IT IS ALSO BECAUSE THE STATE LAW ALLOWS IT. HE IS OUT MONEY FOR YOU THEIR CHALLENGES THERE CHALLENGES ASSOCIATED SOMETIMES UPON FAILURE AND COUNCILPERSON GRISWOLD IS ALSO REFERRING TO SUBDIVISION WHERE THE SAME CONSTITUENTS THAT COUNTS IT HIM DO CONTACT MY OFFICE AND MR. CARSON'S OFFICE A GOOD BIT WANTING TO TIED TO SEWER AND WE DON'T HAVE THAT ABILITY WITHOUT THE SUBDIVISION COMING TOGETHER. THEY WOULD HAVE TO SPEND A GOOD BIT OF MONEY TOGETHER TO TIE IN. ONE OF OUR CHALLENGES WITH THINGS LIKE THIS HAPPEN IS THE EXPECTATION OF FUTURE HOMEOWNERS AFTER YOU TURN OVER THE HOUSE ONE TIME WILL EVENTUALLY EXPECT THE CITY TO DO SOMETHING. MR. CARSON, WE DON'T HAVE CURRENT PLANS FOR PUBLIC SEWER TO BE IN THE VICINITY.

>> SPEAKER: NO. DUE TO THE TOPOGRAPHY OF THE REGION AND THE DISTANCE OUT THERE, THE ONLY WAY TO GET SEWER TO THAT AREA WOULD BE A MAJOR PUMP STATION ACROSS 280.

THERE ARE NO PLANS RIGHT NOW TO PUT FUTURE SEWER OUT IN THAT

AREA. >> SPEAKER: A MAJOR PUMP STATION WOULD BE AN ALLOCATION FROM THE CITY OR DEVELOPERS DO PARTICIPATE IN THOSE KINDS OF EXPENSES?

>> SPEAKER: TYPICALLY DEVELOPERS PARTICIPATE IN THEM.

YEARS AGO THERE WAS A LARGE ELEMENT PROPOSED UP THERE THAT WAS GOING TO REQUIRE A BIG PUMP STATION AND EVENTUALLY THE DEVELOPER DECIDED IT WASN'T COST-EFFECTIVE AND THEY BUILT ELSEWHERE. THERE IS A HISTORY OF SOME AREAS, SOME SUBDIVISIONS LIKE WILLOW CREEK AND DOWN BY THE WATER PLANT THEY WERE PUT ON SEPTIC TANK YEARS AGO AND HAVE PROBLEMS FOR SOME OF THOSE HOMEOWNERS REALLY LEFT WITH NO OPTIONS AND REALLY STRUGGLED WITH REPAIRING THOSE LINES.

>> SPEAKER: WATER AUTHORITY SERVICES.

>> SPEAKER: THE WATER DEWICH AUBURN WATER BOARD DOES.

>> SPEAKER: ANY CONCERNS ABOUT THE SEPTIC TANK SEEPING INTO THE WATER? ARTHUR SOME OUT THERE?

>> SPEAKER: INTO THE WATER TABLE? NOT THAT I'M AWARE OF. IT HAS BEEN AN ISSUE.

IF IT WAS THE STATE WOULD HAVE TO STEP IT.

THE STATE DOES HAVE A VERY MINIMAL REQUIREMENT FOR LOT SIZES, WHICH IS A CONCERN TO ME PERSONALLY, BUT I HAVE NO DATA

OR AUTHORITY. >> SPEAKER: THIS ONE ISSUE, A

[00:40:01]

PERSON CONTACTED ME TODAY WORRIED ABOUT SEEPING INTO SOME

WELLS. >> SPEAKER: THAT IS ALWAYS A CONCERN WHEN YOU GET HIGH DENSITY ON SEPTIC TANKS -- SEPTIC TANKS. I HAVE NO KNOWLEDGE OF ANY

INSTANCES IN THE CITY. >> SPEAKER: THANK YOU.

>> SPEAKER: WAS -- I KNOW IN THE PAST WE HAD SOME ISSUES WITH WATER PRESSURE UP IN THAT AREA. HOW ARE WE ON THAT ISSUE? RIGHT NOW FOR PLAINSMAN HILL'S WAS HAVING SOME DISRUPTION IN FLOW AT CERTAIN TIMES OF THE DAY WITH THE WATER.

>> SPEAKER: I THINK THAT WAS INTERMITTENT DUE TO PROBLEMS WITH OUR BOOSTER STATION UP THERE.

I THINK FOR THE MOST PART THAT HAS BEEN RUNNING PRETTY SMOOTH LATELY. AS MORE HOMES DEVELOP OUT THERE, WE COULD LOOK AT THE POSSIBILITY OF BUILDING A WATER TOWER IN THAT AREA TO PROVIDE MORE CONSISTENT PRESSURE.

BUT THERE IS JUST NOT ENOUGH DEMAND RIGHT NOW BECAUSE IF YOU BUILD A WATER TOWER YOU HAVE A LARGE VOLUME OF WATER STORED AND THAT CREATE WATER QUALITY ISSUES.

THERE IS JUST NOT ENOUGH HOMES UP THERE RIGHT NOW TO TURN OVER A WATER TOWER SO THE BOOSTER STATION IS ALL WE CAN REALLY RELY ON RIGHT NOW FOR WATER QUALITY PURPOSES.

>> SPEAKER: ANY OTHER QUESTIONS FOR MR. CARSON?

>> SPEAKER: IT SOUNDS LIKE A CHICKEN AND EGG SITUATION.

IF THERE IS A CONCERN WITH THE WATER TOWER, OR NEED TO ADD WHEN WE CAN'T DO UNTIL THERE ARE HOUSES TO SERVICE.

BUT WE ARE NOT TALKING ABOUT ADDING HOUSES TO NECESSITATE A WATER TOWER. AT THE PERIPHERY WE ARE ALWAYS GOING TO HAVE AN ISSUE WITH SERVICE, WHETHER IT'S WATER OR SEWER. I THINK OUR CONCERN -- AND LEGITIMATE CONCERN ON SEWER ISSUES, BUT A LOT OF SPECULATION HERE ON WHETHER OR NOT 1 ACRE LOT CAN HANDLE A SEPTIC TANK.

I'M NOT GOING TO TRY TO HANG MY HAT ON WHETHER OR NOT MY OPINION APPEAR -- UP HERE CAN DICTATE THE SERVICE OF A SEPTIC TANK ON A 1 ACRE LOT VERSUS A 3-ACRE LOT.

I JUST THINK WHAT I WANT TO POINT OUT THERE IS A LOT OF IN THESE FINGERS THE PERIPHERY OF OUR ANNEXATION OVER STATIONS WE ARE NOT GOING TO HAVE ANSWERS AND WE CAN'T SERVICE THESE PEOPLE UNTIL TELL WE GET HOUSES TO NECESSITATE IT.

AS FAR AS A SEPTIC TANK SYSTEM GOES A SMALLER LOT VERSUS A LARGER LOT WE ARE TO THE EXPERTS.

WE DO HAVE THE HEALTH DEPARTMENT TO HAVE SOME SORT OF REGULATORY STIPULATIONS WE HAVEN'T HAD THE OPTION UNTIL A MONTH AGO.

WE HAVEN'T HAD TO WORRY ABOUT THAT.

>> SPEAKER: WE HAVE HAD THE OPTION, JUST PEOPLE HAVEN'T BUILT THEM. YOU CAN BUILD A 1 ACRE LOT.

>> SPEAKER: GOOD POINT. >> SPEAKER: IT JUST HASN'T BEEN

ZONED AS AN OPTION. >> SPEAKER: A 1 ACRE NEIGHBORHOOD. WE ARE TALKING ABOUT THEN TO THE. ACRE NEIGHBORHOODS BECAUSE THEY HAVE BEEN REQUIRED TO BE 3 ACRES.

>> SPEAKER: I THINK IT'S ALSO IMPORTANT TO KNOW WITH WATER PRESSURE, MR. CARSON HERE'S MUCH ABOUT IT CITYWIDE AND WHEN WE ARE LOOKING AT SUBDIVISIONS THEY HAVE TO MEET A MINIMUM PRESSURE REQUIREMENTS PER LAWS AND REGULATIONS BUT IT DOESN'T MEAN IT IS A PRESSURE THAT THEY LOVE TO HAVE IN THEIR SHOWER OR OUT OF THE GARDEN HOSE. THAT IS SOMETHING WHEN PEOPLE BUY INTO A SUBDIVISION, THEY NEED TO KNOW.

WE HAVE DIFFERENT PRESSURES THROUGHOUT THE CITY AND I CAN TELL YOU RIGHT NOW ONE OF THE BEST PLACES TO BE IS NEAR INTERSTATE 85. EVERYBODY HAS PRESSURE PRODUCERS IN THAT AREA. IT IS PURELY AN ELEVATION ISSUE AND GRAVITY AND THAT CAUSES THAT.

I THINK YOU GET MUCH FROM YOUR CONSTITUENTS ABOUT PRESSURE AND WE DO MAKE SHOW TO US MAKE SURE THERE IS FIRE TO MAKE SURE SUBDIVISIONS MEET MINIMUM FLOWS FOR DOMESTIC WATER FOR HOUSES AND THOSE ARE MET WHEN THEY ARE IN CITY DISTRICTS.

>> SPEAKER: AS PART OF THE PROBLEM WITH WATER TOWERS IS YOU HAVE TO HAVE 1000 GALLONS AT MINIMUM RESIDUAL PROTECTION FOR FIRE PRESSURE. YOU HAVE TO HAVE THAT FOR TWO HOURS AND THAT IS WHAT CAUSES THE WATER TOWERS TO HAVE TO BE SO BIG. THAT IS THE REASON WE CAN'T TURN THAT WATER OVER ENOUGH WITH THAT FEW HOMES IN THAT AREA.

THAT BEING SAID, OUR BOOSTER STATION, IT DOES PROVIDE 40, 50, 60 POUNDS OF PRESSURE IN THAT AREA, WHICH IS GOOD PRESSURE.

IT'S NOT GREAT PRESSURE BUT IT IS GOOD PRESSURE.

AT TIMES WE HAVE HAD ELECTRICAL PROBLEMS THERE.

MISCELLANEOUS THINGS BREAKING WHICH CAUSE THE BOOSTER STATION TO GO DOWN AND PRESSURE TO DROP TO 20 POUNDS OR 30 POUNDS.

BUT FOR THE MOST PART, IT IS PRETTY RELIABLE.

I CAN UNDERSTAND IT BEING A NUISANCE WHEN IT DOES GO DOWN LIVING OUT THERE IT COULD GET OLD ONES IN A WHILE.

BUT I THINK WE HAVE OUR HANDLE ON IT PRETTY GOOD NOW.

>> SPEAKER: ANY OTHER QUESTIONS? ANY OTHER COMMENTS OR QUESTIONS FROM COUNCIL?

[00:45:03]

MS. CROUCH, WOULD YOU REMIND THE COUNCIL WHAT WE ARE VOTING ON

THIS POINT IN TIME? >> SPEAKER: VOTING ON PREZONING REQUEST PRIOR TO ANNEXATION. THIS WOULD TELL THE PROPERTY OWNER WHETHER OR NOT THEY ARE ABLE TO ACHIEVE THE ZONING THEY REQUESTED PRIOR TO CONSIDERATION OF ANNEXATION AND THAT WOULD BE TO REZONE 41.66 ACRES FROM WHAT WOULD BE RURAL UPON AN ANNEXATION TO LARGE LOT RESIDENTIAL WHICH IS 1 ACRE MINIMUM LOT. IT IS NOT A MAXIMUM, IT'S A

MINIMUM. >> SPEAKER: OKAY.

ANY OTHER QUESTIONS FOR COUNCIL? EVERYBODY READY?

>> SPEAKER: BEFORE WE -- TO 80 QUARTERS STUDY, WE KIND OF SPECIFIED THIS PARTICULAR SPOT TO BE PULLED OFF OF THAT

ORIGINAL. >> SPEAKER: THE FUTURE LAND USE

PLAN. >> SPEAKER: THE PROPOSED.

WHAT WAS IT. WHAT WAS BEFORE HE PULLED OFF AND --'S BACK IN THE RECOMMENDATION OF THE 28 A QUARTER STUDY WAS LIMITED RESIDENTIAL WHICH WAS THE SAME.

PRIOR TO THAT AND THE PLANNING STAFF IS GOING TO SPEAK TO THIS, IT WAS RULE, I BELIEVE. BECAUSE EVERYTHING IS RULE UNTIL HE MOVED TO SOMETHING ELSE. ESPECIALLY ON THE FRINGES OF THE CITY. IT WAS RULE, INITIALLY PROPOSED AND WHAT YOU REVIEWED BASED ON THE STUDY TO GO TO LIMITED RESIDENTIAL. FUTURE LAND USE PLAN WHICH IS AKIN TO LARGE LOT RESIDENTIAL WHICH THE DEVELOPERS ASKING.

THAT IS WHAT I BELIEVE MR. NETTLES WAS REFERRING TO IS THE CHANGE WAS IN THE PROPOSED FUTURE LAND USE PLAN AND WHERE THE COUNCIL MADE THAT MODIFICATION UPON ADOPTION.

I DO NEED TO BE CLEAR, YOU ARE THE CITY'S POLICYMAKERS SO STAFF MAKES EMENDATIONS BUT ULTIMATELY THIS NINE-MEMBER BODY MAKES THE FINAL DECISION ABOUT OUR FUTURE LAND USE PLAN.

YOU MADE A DECISION THAT NIGHT AT THAT TIME.

>> SPEAKER: IF THERE HADN'T BEEN ANY RUMBLINGS OF A DEVELOPMENT OUT THERE ON THESE 41 ACRES, IF YOU LIKE I'M ON TRIAL HERE. WHAT DO WE THINK WOULD THERE HAVE BEEN A CONVERSATION TO PULL IT OFF AND REZONE IT IF THERE HADN'T BEEN A PROPOSED DEVELOPING ON THESE 41 ACRES? TO GO FROM LARGE LOT BACK TO RULE? I FEEL LIKE THERE WAS -- I WONDER IF IT WAS POINTED OUT.

>> SPEAKER: IT WAS AN EXTENSION PAST THAT PROPER -- PROPERTY IT ALL REMAINS RULE IN THE PROPOSED PLAN PICK WAS ALMOST LIKE THAT GOT IDENTIFIED TO BECOME LRT OR LL RD SPECIFICALLY TO SUPPORT A DEVELOPMENT VERSUS EVERYTHING OUTSIDE OF THAT WAS RULE.

ROLE. >> SPEAKER: AND LL RD WAS INTENDED AS A TRANSITION BETWEEN RURAL AND OTHER DEVELOPMENTS.

ALREADY A WHOLE ROW OF HOMES AND PROPERTIES ON HEATH ROAD THAT CAN SERVE AS THAT TRANSITION ALREADY.

IT IS ALREADY THERE ALREADY A TRANSITION.

>> SPEAKER: SO THERE IS A PRECEDENT FOR THAT SO A TRANSITION ON HEATH ROAD RIGHT NOW SO IT'S NOT A STRETCH TO CONTINUE 1 ACRE LOTS INTO THE FURTHER RULE OUTSIDE THIS 41 ACRES NOR IS IT A STRETCH TO CONTINUE RULE IN THE OTHER

DIRECTION. >> SPEAKER: SO THE ONLY QUESTION I HAVE, JUST TO UNDERSTAND WHAT WE ACTUALLY ARE VOTING, I DON'T KNOW WHAT THE COUNCIL IS GOING TO VOTE ON THIS. IF IT IS VOTED DOWN, THEN DOES

THAT KILL THE ANNEXATION? >> SPEAKER: THE APPLICANT HAS INDICATED THAT THEY WOULD LIKE TO WITHDRAW THAT BUT WE WOULD CONFIRM THAT IF THAT IS THE ACTION THAT COUNCIL TAKES.

JUST TO BE SURE. >> SPEAKER: OKAY.

>> SPEAKER: AN E-MAIL TODAY THEY SAID THAT WOULD BE THE REQUEST BUT WILL CONFIRM -- CONFIRM IF THAT WERE TO HAPPEN.

>> SPEAKER: THAT IS NOT IN OUR PURVIEW.

WHAT WOULD THEY BE ALLOWED TO DO IF THEY WEREN'T ANNEXED IN?

>> SPEAKER: THEY ARE IN THE COUNTY AND THEY CAN'T SUBDIVIDE SMALLER THAN 3-ACRE LOTS, BUT THEY CAN LAND HE WAS WISE TO DO WHATEVER THEY CHOOSE TO DO. IT IS IN THE COUNTY.

THE CITY HAS SUBDIVISION AUTHORITY IN THIS VICINITY BUT NOT ZONING AUTHORITY IF IT IS NOT IN THE CITY LIMITS.

>> SPEAKER: COULD THEY DO ANYTHING BESIDES RESIDENTIAL?

>> SPEAKER: YES, THEY CAN DO ANY LAND USE UNLESS THIS FALLS IN THE COUNTIES NEWS ZONING AREA, WHICH I BELIEVE THAT IS MORE IN THE BUEHLER BEULAH AREA AND NOT ANYWHERE NEAR HERE.

THEN THEY COULD CHOOSE WHATEVER LAND USE THEY WISH.

THE ONLY AUTHORITY WE HAVE IS SUBDIVISION AUTHORITY.

>> SPEAKER: IF IT IS DENIED, THEY CAN DO ANYTHING ON THAT

41 ACRES. >> SPEAKER: THAT'S CORRECT.

AS THEY HAVE HAD THE ABILITY TO DO TO DATE.

[00:50:01]

>> SPEAKER: ANY OTHER QUESTIONS? EVERYBODY READY? ANY OTHER QUESTIONS? LINDSAY, ROLL CALL. (ROLL CALL VOTE)

>> SPEAKER: A TIME SO IT FAILS -- A HIGH.

REZONING WAS NOT APPROVED. IT WAS A TIE.

THEREFORE DID NOT GAIN A MAJORITY IN EITHER DIRECTION SO IT FAILS. MR. NETTLES, DO YOU WANT TO PROCEED WITH THE ANNEXATION? OKAY JUST WANTED TO CONFIRM BEFORE WE HE MOVED ON IN THE AGENDA.

SO JUST IF YOU ARE TRACKING, ITEM 9A2 WHICH YOU PREVIOUSLY SKIPPED OVER HAS BEEN WITHDRAWN BY THE APPLICANT AND THAT IS THE HEEL ANNEXATION. MAYOR, I WILL PROCEED IN A MINUTE. WE HAVE SOME FOLKS GETTING UP.

ITEM NINE MAYBE 2 IS A REQUEST FROM T.J. JOHNSON ON BEHALF OF ERNEST TO REZONE OR POSSIBLY 1944 ACRES OF PROPERTY KNOWN AS THE BOTTLE TO DEVELOPMENT LOCATED SOUTHWEST CORNER INTERSECTION HEIGHT EIGHT TO 80 IN NORTH COLLEGE STREET.

FROM RURAL TO DEVELOPMENT OF HOUSING.

THIS ITEM WAS POSTPONED BY THE CITY COUNCIL AT ITS OCTOBER 19, 2021, MEETING AND THEREFORE THIS IS THE SECOND READING OF THIS ITEM. THE PUBLIC HEARING IS REQUIRED.

>> SPEAKER: I'LL INTEREST THE ORDINANCE AND ASKED FOR

UNANIMOUS CONSENT. >> SPEAKER: SECOND.

>> SPEAKER: MOTION AND SECOND. DOES ANYONE ON THE COUNCIL HAVE A PROBLEM MOVING FORWARD WITH A VOTE ON THIS THIS EVENING? HEARING NONE WILL OPEN THE PUBLIC HEARING.

IF YOU WOULD LIKE TO ADDRESS CITY COUNCIL PLEASE COME FORWARD AND GIVE YOUR NAME AND ADDRESS FOR THE RECORD.

SEEING NO ONE WILL CLOSE THE PUBLIC HEARING.

ANY DISCUSSION OF QUESTIONS FROM THE COUNCIL? OKAY, LINDSAY ROLL CALL. (ROLL CALL VOTE)

>> SPEAKER: ITEM 9B3 IS REQUEST FROM T.J. JOHNSON ON BEHALF OF JOSEPH EARNEST TO REZONE A PROXIMALLY 4818 ACRES LOCATED KNOWN AS THE BOTTLE DEVELOPMENT LOCATED AT THE SOUTHWEST CORNER OF THE INTERSECTION OF U.S. HIGHWAY 280 AND NORTH COLLEGE STREET FROM RURAL TO COGNITIVE DEVELOPMENT DISTRICT.

THE PLANNING COMMISSION UNANIMOUSLY RECOMMENDED APPROVAL AT SEPTEMBER 9, 2021, MEETING. THIS ITEM WAS POSTPONED BY THE COUNCIL AT ITS OCTOBER 19 MEETING AND THEREFORE THIS IS THE SECOND READING OF THIS ITEM. PUBLIC HEARING IS REQUIRED.

>> SPEAKER: I WILL INTRODUCE THE ORDINANCE AND ASK FOR

UNANIMOUS CONSENT. >> SPEAKER: SECOND.

>> SPEAKER: MOTION AND SECOND. DOES ANYONE ON THE COUNCIL HAVE A PROBLEM MOVING FORWARD WITH A VOTE ON THIS THIS EVENING? HEARING NONE WE WILL OPEN THE PUBLIC HEARING.

IF YOU WOULD LIKE TO ADDRESS THE CITY COUNCIL PLEASE COME FORWARD AND GIVE YOUR NAME AND ADDRESS FOR THE COUNCIL -- RECORD.

SEEING NO ONE WE WILL CLOSE THE PUBLIC HEARING.

ANY QUESTIONS FROM THE COUNCIL? COMMENT?

>> SPEAKER: I HAVE A QUESTION. IT SAYS RECOMMENDATION IS RECOMMENDED APPROVAL WITH STAFF CONDITIONS.

IF WE WERE TO PASS THIS THIS EVENING, WITHOUT AUTOMATICALLY

INCLUDE THE STAFF CONDITIONS. >> SPEAKER: THAT INCLUDES EVERYTHING THAT THE PLANNING COMMISSION HAD ADDED AND A LOT OF THAT CAME. THE DEVELOPMENT WORK HANDILY WITH THE STAFF ABOUT SOME THINGS THAT THEY AGREED TO AS PART OF THE PLAN DEVELOP A DISTRICT. OVERLAY.

STEVE, IS THERE. >> SPEAKER: THE CONDITIONAL USE HAS SEVERAL CONDITIONS THAT WERE RECOMMENDED BY THE PLANNING COMMISSION. MY RECOLLECTION WAS THAT THIS IS JUST THE STRAIGHT REZONING ON THE 45 ACRES, 44 ACRES.

ISN'T THAT RIGHT? I DON'T BELIEVE THERE ANY

CONDITIONS ON THIS ONE. >> SPEAKER: I AM LOOKING AT THE RECOMMENDATIONS. IT SAYS WITH STAFF CONDITIONS.

>> SPEAKER: I WAS LOOKING FOR THE RESOLUTION.

THAT MIGHT. >> SPEAKER: THE ITEM SUMMARY.

>> SPEAKER: OR 9B3. >> SPEAKER: IT PROBABLY CARRIED OVER FROM THE PDD PORTION. MAYBE I AM AHEAD A BIT.

I'M JUST GOING OFF WHAT'S IN FRONT OF ME.

>> SPEAKER: WE ARE ON 9B2. >> SPEAKER: 9B3.

>> SPEAKER: FORWARD TO THE CITY COUNCIL RECOMMENDATION WITH

APPROVAL WITH STAFF CONDITIONS. >> SPEAKER: I DON'T THINK THERE

WERE CONDITIONS. >> SPEAKER: THE CONDITIONS ARE

WITH THE PDD. >> SPEAKER: THAT ARE CONDITIONS AND THAT IS JUST A NORMAL THING THAT IS SAID WITH PLANNING COMMISSION ITEMS. IF YOU LOOK AT THE RESOLUTION THAT IS IN YOUR PACKET THAT COMES FROM THE PLANNING

[00:55:01]

COMMISSION, THERE IS AN ORDINANCE AND ACTUALLY, THE RESOLUTION DOESN'T SAY THAT THERE WERE ANY CONDITIONS PER MR. FOOT SO THAT WAS JUST PICKED UP IN THE AGENDA ITEM SUMMARY.

THERE ARE SOME THINGS AS I HAD PREVIOUSLY INDICATED THAT THE DEVELOPMENT -- DEVELOPER WAS VERY AMENABLE TO WORKING WITH THE CITY ON. THEY VOLUNTEER -- VOLUNTARILY DID SOME THINGS THAT STAFF'S REQUEST TO MAKE WHAT WE FELT WAS A BETTER PROJECT. I AM DEEPLY APPRECIATIVE OF THEIR WILLINGNESS TO DO THAT. THERE WERE A FEW THINGS THAT WERE NOT GOING TO BE EASY FOR THEM TO DO AND THEY WERE NOT ABLE TO PROCEED WITH THAT. BUT THEY VERY MUCH INDULGED NOT ONLY OUR REQUEST FOR PDD OVERLAY, BUT SOME ADDITIONAL THINGS SUCH AS SOME SIDEWALKS ON BOTH SIDES OF THE ROADS AND THINGS LIKE THAT. I SINCERELY APPRECIATE THEIR PARTNERSHIP WITH THE CITY AND WILLINGNESS TO DO THAT.

WE DON'T ALWAYS SEE THAT AND THEY WERE WILLING TO WORK WITH US. DID CREATE SOME DELAYS ALSO IN TIMING COMING TO YOU BECAUSE OF THAT PICTURE WE ARE APPRECIATIVE

>> SPEAKER: ANY OF THE QUESTIONS? LINDSAY? (ROLL CALL VOTE)

>> SPEAKER: ITEM THAT T.J. JOHNSON ON BEHALF OF JONAS ARE FIST TO PLACE A PLANNED DEVELOP A DISTRICT ON APPROXIMATELY 64.04 ACRES OF PROPERTY KNOWN AS THE BOTTLE DEVELOPMENT LOCATED AT THE INTERSECTION OF 280 IT NORTH COLLEGE STREET WITH CURRENT BASED ZONES COPPERHEADS OF DEVELOPMENT DISTRICT.

THE PLANNING COMMISSION UNANIMOUSLY RECOMMENDED APPROVAL AT ITS OCTOBER 14, 2021, MEETING UNANIMOUS CONSENT IS NECESSARY.

>> SPEAKER: ISLANDERS THE ORDINANCE AND ASK FOR UNANIMOUS

CONSENT. >> SPEAKER: SECOND.

>> SPEAKER: MOTION AND SECOND. DOES ANYONE ON THE COUNCIL HAVE A PROBLEM MOVING FORWARD WITH A VOTE ON THIS THIS EVENING? AT THIS TIME WILL OPEN THE PUBLIC HEARING.

IF YOU WOULD LIKE TO ADDRESS THE COUNCIL PLEASE COME FORWARD AND GIVE YOUR NAME AND ADDRESS FOR THE RECORD.

SEEING NO ONE WE WILL CLOSE THE PUBLIC HEARING.

ANY QUESTIONS OR COMMENTS FROM THE COUNCIL?

>> SPEAKER: DO WANT TO ACKNOWLEDGE THIS LOOKS LIKE A NICE CLEAN DEVELOPMENT AS FAR AS THE WAY IT IS LAID OUT.

AND HOW THE COMMERCIAL NOTES ARE TO THE STREETSIDE.

I DID ACKNOWLEDGE AND DID NOTICE THAT THERE IS ADDITIONAL BUFFERS THAT WERE ADDED ON CERTAIN PIECES AS ONE OF THE CONDITIONS.

MY QUESTION IS, IF WE APPROVE THIS IT IS WITH THE STAFF

COMMENTS. >> SPEAKER: THAT'S CORRECT.

YOU WILL SEE IN THE PLANNING COMMISSION RESOLUTION THOSE

ITEMS. >> SPEAKER: THANK YOU.

>> SPEAKER: WAS PART OF THE REASON THERE WAS A SLIGHT DELAY AND WHY THIS DIDN'T TRACK WITH THE TWO REZONINGS AS PLANNING COMMISSION DELAYED DUE TO A FEW OF THESE THINGS.

AND AGAIN THE DEVELOPER WORKED WITH STAFF ON THAT AND THOSE THINGS HAVE BEEN RESOLVED. WHAT IS IN THIS MEMO AND ATTACHED IN THE PLANNING COMMISSION RESOLUTION IS

ACCURATE. >> SPEAKER: TO ANTICIPATE THE PROPOSED REALIGNMENT OFF OF 2802 HAPPEN AT ANY POINT IN TIME?

>> SPEAKER: THE PROPOSED REALIGNMENT THROUGH AUBURN UNIVERSITY, YOU ARE REFERRING TO ALABAMA 147 SOMEHOW REALIGNING TO MAKE A FULL INTERSECTION ON THE NORTH AND SOUTH SIDES OF THE ROAD. CITY ENGINEER FRAZIER, I DON'T BELIEVE THAT WE HAVE ANY UPDATE ON THAT THAT THAT IS HAPPENING ANYTIME SOON. I WOULD SAY THAT ONE OF THE CHALLENGES WHY AUBURN UNIVERSITY IS A GREAT PARTNER, THAT IS RESEARCH PROPERTY FOR THEM AND THEY TEND TO NOT USUALLY PARKED WITH IT. BUT NEVER SAY NEVER.

IT IS SHOWN ON HERE BECAUSE IT IS PART OF A MASTER STREET PLAN AND THE DEVELOPER SHOWED IT AT OUR REQUEST.

THAT IS JUST LETTING YOU KNOW THAT SOMEDAY HOPEFULLY WE CAN

MAKE THAT CONNECTION. >> SPEAKER: THANK YOU.

>> SPEAKER: ANY OTHER COMMENTS OR QUESTIONS FROM COUNCIL? LINDSAY? (ROLL CALL VOTE)

>> SPEAKER: WE HAVE ONE MORE ITEM FOR THE BOTTLE BUT THAT IS UNDER RESOLUTIONS. MOVING FORWARD, ITEM 9C'S REQUEST FOR THE CITY OF AUBURN PLANNING DEPARTMENT TO MAKE VARIOUS ZONING ORDINANCE TEXT AMEND THIS TO CORRECT REFERENCES TO ZONING ORDINANCE SECTION DENSITY DEPARTMENT AS WELL TO RELOCATE CERTAIN REGULATIONS TO MORE LOGICAL SECTIONS.

IN OTHER WORDS, THIS ISN'T ANY MAJOR REVELATORY CHANGE BUT IT IS A CLEANUP OF THE ZONING ORDINANCE.

UNANIMOUS CONSENT IS NECESSARY IN A PUBLIC HEARING IS REQUIRED.

>> SPEAKER: WILL INTRODUCE THE ORDINANCE AND ASKED FOR

UNANIMOUS CONSENT. >> SPEAKER: SECOND.

>> SPEAKER: MOTION AND SECOND. DOES ANYONE ON THE COUNCIL HAVE A PROBLEM MOVING FORWARD WITH A VOTE ON THIS THIS EVENING?

>> SPEAKER: DO NE UNANIMOUS CONSENT -- DENY UNANIMOUS

CONSENT. >> SPEAKER: ALL RIGHT.

WE HAVE ONE MORE ORDINANCE TO CONSIDER AND IT IS ITEM 9D.

AUTHORIZES COMMERCIAL DEVELOPMENT AGREEMENT BETWEEN CITY OF AUBURN AND CLEVELAND NORTHSIDE LLC.

TO REBATE CERTAIN SALES OF CERTAIN $25,000 PER YEAR FOR

[01:00:01]

SEVEN YEARS NOT TO EXCEED 175,0004 NEW SHOP SPACE LOCATED AT 1850 SHUG JORDAN PKWY. UNANIMOUS CONSENT IS NECESSARY

AT A PUBLIC HEARING IS REQUIRED. >> SPEAKER: WILL INTRODUCE THE ORDINANCE AND ASK UNANIMOUS CONSENT.

>> SPEAKER: SECOND. >> SPEAKER: MOTION AND SECOND.

DOES ANYONE ON THE COUNCIL HAVE A PROBLEM MOVING FORWARD WITH A VOTE ON THIS THIS EVENING? SEEING OR HEARING NONE, WE WILL OPEN PUBLIC HEARING. IF YOU WOULD LIKE TO ADDRESS THE COUNCIL, PLEASE COME FORWARD AND GIVE YOUR NAME AND ADDRESS FOR THE RECORD. SEEING NO ONE WE WILL CLOSE THE PUBLIC HEARING. ANY COMMENTS OR QUESTIONS FROM

THE COUNCIL? >> SPEAKER: FOR A LOT OF EXCITEMENT ABOUT SOMETHING NEW COMING IN ON THAT SIDE OF TOWN AS FAR AS SOME OPTIONS TO EAT AND DINING OPTIONS ON THE NORTH SIDE. I'M GLAD TO SEE SOMETHING GOING

ON UP THERE. >> SPEAKER: IS THIS GOING TO BE AN ADDITIONAL AMSTERDAM'S LOCATION?

>> SPEAKER: INTO THIS. THEY WANT TO CLARIFY AND I APPRECIATE YOU ASKING. THIS WILL BE THEIR SECOND LOCATION. THE LOCATION OF THE RESEARCH PARK IS NO LONGER A LOCATION. SO YOU HAVE -- I THINK IT IS INTERESTING, IT'S THE NORTH SIDE CROSSING VERSUS SOUTH SIDE WHERE THE CURRENT DEVELOP IT IS. WE SINCERELY APPRECIATE THE CLEVELAND'S INVESTMENT IN THIS AREA, THE SHOP SPACE WILL BE BRICKED. THEY HAVE A VERY STRONG REPUTATION FOR THE RETAIL SPACE AND RESIDENTIAL HOMES THAT THEY HAVE DONE IN TERMS OF THE QUALITY OF DESIGN AND ARCHITECTURE. THE COMMERCIAL DEVELOPMENT AUTHORITY WAS DEEPLY APPRECIATIVE OF THE DESIGN AND KEVIN HOWARD, OUR COMMERCIAL DRUG DEVELOPMENT DIRECTOR WORKED WITH THEM BUT WE ARE ALSO VERY EXCITED TO OFFER TO OFFER MORE SIT DOWN DINING OFFERS. THIS IS OUR HIGHEST GROWTH AREA AND THEY ARE VERY LIMITED SIT-DOWN OPTIONS FOR PEOPLE THERE. THE AU CLUB DOES OFFER SOME OF THAT BUT NOT EVERYBODY HAS ACCESS.

THIS WILL BE A VERY GOOD LOCATION FOR THIS AND AGAIN, WALLACE ADJACENT TO THE WALMART MARKET ON A WHOLLY OWNED BY NORTHSIDE CROSSING LLC AND NOT RELATED TO THAT DEVELOPMENT.

OTHER THAN IT IS LOCATED HERE. >> SPEAKER: AND THIS ABATEMENT, THIS AGREEMENT FOR THE TAX PORTION, THAT STAYS WITH THE PROPERTY OWNER AND NOT WITH THE INDIVIDUAL BUSINESSES?

>> SPEAKER: THAT'S CORRECT. IF TENANTS CHANGE, STAYS WITH THEM. WE DO HAVE A CAN OF ELATION BECAUSE IN SOME OF THE THINGS AND I'M GLAD MR. CROSSFIELD BROUGHT THAT UP. YOU HAVE TO RETAIN -- IF BY GRANTING AN INCENTIVE WE HAVE SOME PROVISIONS THAT KEEP YOU FROM APPROACHING TENANTS FROM OTHER PEOPLE'S SHOPPING CENTERS AND US PROVIDING AN INCENTIVE. THEY ARE INVESTING MUCH MONEY HERE AND OUR REBATE IS SMALL, BUT WHAT OUR GOAL WAS WHAT TO REBATE THEM FOR THEIR ENHANCED ARCHITECTURE WHICH THEY DID VERY WELL PREPARED TYPICALLY SEEING EVIS OR STUCCO LOOKING SHOP SPACE AND TO GET SOME BRICK AND NICE ARCHITECTURE ON IT YOU WILL HAVE A RESTAURANT TO BOTH ENDS, OUTDOOR DINING.

I KNOW IT IS HARD TO HAVE ATMOSPHERE IN THE VICINITY OF SHUG JORDAN PKWY., BUT THE CLEVELAND ARE MASTERS AT CREATING THAT AND I KNOW THAT THEY WILL DO A GREAT JOB WITH IT. I AM EXCITED TO HAVE SOMETHING WHERE PEOPLE DON'T HAVE TO GET TOO FAR FROM THE NEIGHBORHOODS ANYMORE TO HAVE SOME SIT-DOWN DINING.

I EXPECT THAT THE OTHER PARCEL MAY BE MORE OF A FAST CASUAL OR FAST FOOD STYLE SITUATION OR IT COULD HAVE A DRIVE-THRU.

ONE HAS BEEN APPROVED IN THAT LOCATION.

BUT AGAIN IT WILL OFFER OPTIONS FOR EVERYBODY IN THE VICINITY.

>> SPEAKER: MEGAN, THANK YOU FOR YOU AND YOUR STAFF FOR THE HARD WORK ON THIS AND CERTAINLY GRATEFUL FOR THE CLEVELAND FOR INVESTING THIS PART OF AUBURN. THANK YOU.

>> SPEAKER: LET ME ASK A QUESTION.

SO THIS IS GOING TO BE ON THE OTHER SIDE OF THE NEIGHBORHOOD

WALMART? >> SPEAKER: IT IS IN THE SAME PIECE OF PROPERTY. THERE IS A MAP IN YOUR POCKET -- IN YOUR PACKET THAT HAS AN AERIAL PHOTO THAT SHOWS.

IT IS ADJACENT TO THE GAS STATION.

IT WILL HAVE NO ADDITIONAL CURB CUTS ON A SHUG JORDAN PKWY. BUT IT IS ADJACENT TO THE CARROT CUT THE IS ALREADY THERE ON SHUG JORDAN PKWY. IT IS CURRENTLY UNDEVELOPED AREA AND IT SITS BETWEEN THERE AND OWENS ROAD, BASICALLY.

>> SPEAKER: SO WOULD THERE BE LIKE A CUT THROUGH FROM WALMART?

>> SPEAKER: YEAH, THAT'S CONNECTED AND WE REQUIRE CROSS ACCESS THROUGH OUR DEVELOPMENTS. AND THAT IS WHAT IS MEANT BY THAT REQUIREMENT. YOU CAN ACTUALLY TURN OFF OF DONAHUE IF HE DIDN'T WANT TO GET OUT ON SHUG JORDAN PKWY. AND GO AROUND WALMART AND GET THROUGH THIS.

THE SAME WE HAVE A NICE SIDEWALK ON DONAHUE THAT CONNECTS PEOPLE SO PEOPLE LIVE IN THAT PORTION OF AUBURN ARE ABLE TO WALK-THROUGH NEIGHBORHOODS AND UP DONAHUE AND GET THERE SURE

THEY WANT TO WALK THERE. >> SPEAKER: THIS MENTIONS THAT IF AMSTERDAM HAPPENS TO FAIL, THEY HAVE TO REPLACE IT WITH

SOMETHING WITH A RESTAURANT. >> SPEAKER: YES.

>> SPEAKER: NOT A FAST FOOD PLACE.

>> SPEAKER: THAT'S CORRECT. THAT IS WHERE THE MEAT OF THE AGREEMENT USUALLY IS. THOSE GET MODIFIED PROJECT BY PROJECT DEPENDING ON THE PARAMETERS.

THAT IS SOMETHING KEVIN HOWARD HAD RECOMMENDED THAT WE DO.

WE HAD A TALK WITH BILLIE CLEVELAND AND THEY WERE VERY AMENABLE TO IT. IT IS JUST SAYING WE WANT

[01:05:03]

ANOTHER RESTAURANT TO COME BACK THERE IF YOU WANT TO REBATE TO CONTINUE. INSTEAD OF A NAIL SALON, WHICH I APPRECIATE ALL INVESTMENT IN AUBURN, BUT WE ARE LOOKING FOR SOMETHING THAT TURNS OVER SALES TAX DOLLARS.

THOSE ARE JOBS AND OTHER TAXES BUT WE WOULD LIKE TO SEE ANOTHER

RESTAURANT GO BACK THERE. >> SPEAKER: ANY OTHER QUESTIONS? LINDSAY?

(ROLL CALL VOTE) >> SPEAKER: MOVING TO

[10. RESOLUTIONS]

RESOLUTIONS. UNDER RESOLUTIONS THIS EVENING WE HAVE A REQUEST ITEM 10A FROM T.J. JOHNSON ON BEHALF OF JOSEPH EARNEST FOR CONDITIONAL USE APPROVAL OF OUTDOOR RECREATIONAL USES, INSTITUTIONAL USES, SPECIAL RESIDENTIAL USES, OFFICE USE, AND ROAD SERVICE USES FOR PROPERTY KNOWN AS THE BOTTLE LOCATED AT SOUTHWEST CORNER OF HIGHWAY 280 AND NORTH COLLEGE STREET. THE PROPERTY IS CURRENTLY ZONED COMPREHENSIVE DEVELOPMENT DISTRICT AND DEVELOP A DISTRICT WITH OVERLAY. THE PLANNING COMMISSION UNANIMOUSLY RECOMMENDED APPROVAL AT ITS OCTOBER 14, 2021, MEETING. A PUBLIC HEARING IS REQUIRED.

>> SPEAKER: MOVE FOR APPROVAL. >> SPEAKER: SECOND.

>> SPEAKER: MOTION AND SECOND. AT THIS TIME WE WILL OPEN THE PUBLIC HEARING. IF YOU WOULD LIKE TO ADDRESS THE COUNCIL PLEASE COME FORWARD AND GIVE YOUR NAME AND ADDRESS FOR THE RECORD. SEEING NO ONE WE WILL CLOSE THE PUBLIC HEARING. ANY COMMENTS OR QUESTIONS FROM THE COUNCIL? ALL IN FAVOR? ANY OF POSTS? MOTION CARRIES.

>> SPEAKER: ITEM 10A2 REQUEST FROM DAVIS LOCAL ON BEHALF OF EMBRACE UNITED METHODIST CHURCH INC. FOR CONDITIONAL USE APPROVAL OF AN INSTITUTIONAL USE CHURCH FOR PROPERTY LOCATED AT 2142 NORTH COLLEGE STREET IN A DEVELOPMENT DISTRICT HOUSING ZONE WITH A PLANNED DEVELOPMENT DISTRICT OVERLAY.

THE PLANNING COMMISSION UNANIMOUSLY RECOMMENDED APPROVAL AT ITS NOVEMBER 9, 2021, MEETING.

A PUBLIC HEARING IS REQUIRED. >> SPEAKER: MOVE FOR APPROVAL.

>> SPEAKER: SECOND. >> SPEAKER: MOTION AND SECOND.

AT THIS TIME WE WILL OPEN THE PUBLIC HEARING.

IF YOU WOULD LIKE TO ADDRESS THE COUNCIL PLEASE COME FORWARD AND GIVE US YOUR NAME AND ADDRESS FOR THE RECORD.

I HAVE CLOSE TO PUBLIC HEARING. ANY COMMENTS OR QUESTIONS FROM

THE COUNCIL? >> SPEAKER: THIS IS JUST AN EXTENSION IS ALREADY BEEN APPROVED FOR THIS USE?

>> SPEAKER: IT HAS. IT ALSO CONSIDERED SOMETHING SIMILAR FOR THE AUBURN COMMUNITY CHURCH, COVID DELAYED A LOT OF PEOPLE'S PROJECTS AND YES, THEY HAD PREVIOUSLY RECEIVED

APPROVAL. >> SPEAKER: TO HAVE A TIMELINE? IS THIS EXTENDED ANOTHER 18 MONTHS?

>> SPEAKER: THIS IS A FRESH APPROVAL SO THEREFORE THEY HAVE

A FULL 18 MONTHS. >> SPEAKER: DID THEY INDICATE WHEN THEY MIGHT START MOVING DIRT?

>> SPEAKER: I DON'T KNOW ANYTHING ABOUT START DATE.

>> SPEAKER: I JUST KNOW THEY HAVE EVENTS ON A REGULAR BASIS ON THE PROPERTY? AND WAS CURIOUS AS TO WHAT THEIR

PLANS MAYBE. >> SPEAKER: I WILL DOUBLE CHECK. YOU DON'T HAVE DEVELOPMENT REVIEW TEAM PLANTS A MINUTE OR DO YOU? SO USUALLY WANT CIVIL PLANS GET COMMITTED AND ARE BUILDING PLAN HAS BEEN SUBMITTED? THEY ARE MOVING THROUGH THE PROCESS. USUALLY CIVIL PLANS OF THE FIRST THING WE SEE IN BEEN BUILDING PLANS FOLLOW.

THEY WILL HAVE ANOTHER 18 MONTHS TO START MOVING DIRT ON THE PROPERTY OR MOVE MORE DIRT THAN THEY PREVIOUSLY MAY HAVE DONE.

>> SPEAKER: I WILL JUST ACKNOWLEDGE THE FIRST TIME THIS CAME UP I VOTED NO BECAUSE I STILL DON'T THINK IT IS THE BEST PLACE FOR THIS USE ON THAT ROAD. BUT SINCE THEY HAVE ALREADY BEEN APPROVED, I WILL BE VOTING IN FAVOR AT THIS TIME FOR THE

EXTENSION. >> SPEAKER: ANY OTHER COMMENTS OR QUESTIONS? ALL IN FAVOR PLEASE SAY? ANY OPPOSE? MOTION CARRIES.

>> SPEAKER: ITEM 10A3 REQUEST FROM BRETT BASCOM ON BEHALF OF NP ALABAMA INVESTMENT LLC FOR CONDITIONAL USE APPROVAL FOR ROAD SERVICE USE PARKING LOT FOR SONS FOR LOCATING AT 114 EACH VETERANS BOULEVARD. THE PLANNING COMMISSION UNANIMOUSLY RECOMMENDED APPROVAL AT HIS NOVEMBER 9, 2021, MEETING. THE PUBLIC HEARING IS REQUIRED.

>> SPEAKER: MOVE FOR APPROVAL WITH REMOVAL OF CONDITION NUMBER

THREE.

SEEING NO ONE WE WILL CLOSE THE PUBLIC HEARING. ANY COMMENTS OR QUESTIONS?

>> SPEAKER: CAN WE -- NUMBER THREE.

>> SPEAKER: ON NUMBER THREE IN YOUR AGENDA ITEM SUMMARY THE PLANNING DIRECTOR INDICATED THAT STAFF WAS RECOMMENDING REMOVAL OF THAT ADDITIONAL INFORMATION CAME AVAILABLE BETWEEN PLANNING COMMISSION AND CITY COUNCIL. THAT IS NO LONGER A NEEDED COMMENT PER STAFF RECOMMENDATION.

MR. BASQUIN HAD RESOLVED ANY CONCERNS WITH THAT ITEM.

>> SPEAKER: COULD YOU CLARIFY WHICH ONE YOU'RE TALKING ABOUT?

>> SPEAKER: ITEM NUMBER THREE. I BELIEVE IT IS THE ISLAND.

>> SPEAKER: YES. >> SPEAKER: THEY'VE DONE SOME

[01:10:03]

WORK. IT'S VERY NICE.

>> SPEAKER: AND ALSO THE SAME WITH THIS ONE.

THIS HAD ALSO BEEN PREVIOUSLY APPROVED AND SAME, IT EXPIRED.

AGAIN, COVID DELAYED MUCH. >> SPEAKER: ANY OF THE QUESTIONS? ALL IN FAVOR? ANY POST? MOTION CARRIES.

>> SPEAKER: ITEM 10A4 REQUEST FROM LEDGE NETTLES FOR THE THIRD GENERATION AUBURN LLC FOR CONDITIONAL USE APPROVAL OF EXPANSION OF INDUSTRIAL USE FOR NATIONAL WIRELESS LOCATED AT 1955 MCMILLAN STREET IN THE INDUSTRIAL ZONING DISTRICT.

THE PLANNING COMMISSION UNANIMOUSLY RECOMMENDED APPROVAL AT HIS NOVEMBER 9, 2021, MEETING AND A PUBLIC HEARING IS REQUIRED
