WE HAVE HAD ANOTHER SGA BREAKFAST SINCE LAST TIME WE MET AND ENJOYED SOME TIME WITH SOME OF THEIR NEW OFFICERS AND LOOK FORWARD TO SOME TIME HERE IN THE FUTURE AND I KNOW THEY ARE HERE TONIGHT. A COUPLE OF SATURDAYS AGO I WAS ON CAMPUS FOR THE BIG EVENT. VERY EXCITED TO SEE ALMOST 800 STUDENTS AND ADMINISTRATORS AND FACULTY AND THEY WERE SIGNED UP TO PARTICIPATE IN ALMOST 150 PROJECTS AROUND OUR CITY, AROUND THE AREA, ON THAT SATURDAY MORNING.

I'M VERY THANKFUL AND ENCOURAGED THAT OUR YOUNG PEOPLE THAT ARE HERE WITH US THINK ENOUGH OF US THAT THEY GAVE UP THEIR SATURDAY MORNING TO GO AND MAKE OUR TOWN AND MAKE OUR COMMUNITY AND MAKE SOMEBODY'S LIFE A LITTLE EASIER. SO THANK ALL OF THEM FOR DOING THAT. A COUPLE OF WEEKS AGO A COUPLE OF MEMBERS OF OUR COMMUNITY WERE INDUCTED INTO THE ALABAMA HIGH ATHLETIC HALL OF FAME. HAVE AN ANNOUNCEMENT? >> SPEAKER: I JUST SPOKE ON THE CAR SHOW AND I GOT TO ATTEND THAT.

IT WAS A GREAT EVENT. IT WAS DOWNTOWN CRUISING CAR SHOW. THERE WERE ABOUT 50 CARS THAT WERE ALLOWED TO BE PART OF THE SHOW.

MY CAR ACTUALLY MADE IT IN AS WELL.

GOT TO SEE LOTS OF UNIQUE VEHICLES THAT YOU NORMALLY WOULDN'T GET TO SEE. I THINK EVERYONE THAT WAS INVOLVED DID A WONDERFUL JOB GETTING THAT TOGETHER AND I LOOK FORWARD TO A LOT MORE IN THE FUTURE.

>> SPEAKER: THANK YOU, MR. DIXON.

ANYONE ELSE HAVE AN ANNOUNCEMENT?

MS. TAYLOR? >> SPEAKER: SINCE WE LAST MET, I WANTED TO THANK AL AND HIS STAFF AGAIN FOR ALLOWING ME TO HOST AT THE BOYKIN COMMUNITY CENTER THE MOTHER SON COMBINED

[00:15:02]

MOTHER SON DAUGHTER DADDY DANCE. IT WAS A SUCCESS AND I JUST WANT TO THANK YOU FOR OPENING YOUR DOORS AND ALLOWING OUR COMMUNITY TO BE ABLE TO HAVE DIFFERENT EVENTS AT THE BOYKIN CENTER.

I THINK EVERYBODY AND APPRECIATES THAT.

MR. DAVIS, YOU AND YOUR STAFF Y'ALL ARE ALWAYS THERE AND OPEN THE DOORS FOR US. AND ALSO I WANT TO SAY THAT YESTERDAY I WAS ABLE TO ATTEND A SEMINAR AT THE JULE COLLINS SMITH SMITH MUSEUM SPONSORED BY DR. JOANNE -- JOAN HAROLD.

IT WAS CALLED THE BECOMING BELOVED COMMUNITY.

IT WAS AN AWESOME SEMINAR, DIFFERENT PEOPLE, DIFFERENT SPEAKERS, PANELISTS. THEY HAVE A LOT OF DIFFERENT ISSUES -- THINGS THAT THEY TALKED ABOUT TO MAKE THIS A MORE BELOVED COMMUNITY BETWEEN AUBURN UNIVERSITY AND AUBURN.

THEY HAD A GREAT PANEL OF MINORITIES, DIFFERENT MINORITY GROUPS TALKING AND STUDENTS AND PROFESSORS FROM DIFFERENT PLACES IN THIS WORLD. I GOT A CHANCE TO ACTUALLY TALK TO THE STUDENTS AND PROFESSORS ON THE BREAK ABOUT MY EXPERIENCE AS BEING THE ONLY MINORITY ON THE COUNCIL.

SO THAT WAS AN EXPERIENCE AND THEY WERE EXCITED ABOUT IT AND ALSO ENCOURAGED A LOT OF THEM TO WANT TO RUN FOR A POLITICAL POSITION. I REALLY ENJOYED IT AND IT WAS A

GREAT EVENT. >> SPEAKER: THANK YOU, MS. TAYLOR. ANYONE ELSE HAVE AN

ANNOUNCEMENT? >> SPEAKER: YES, MISTER MARE.

THE ONGOING CONVERSATION WITH THE MURAL COMMITTEE, WE MET AGAIN LAST MONDAY. STAFF HAD PREPARED FOR US A DOCUMENT THAT SHOWED OTHER COMMUNITIES APPROACHES TO MURAL POLICY. WE ARE CONTINUING OUR CONVERSATION AND WE EXPECT TO BRING THAT CONVERSATION TO THE COMMITTEE OF THE WHOLE, MAYBE THIS NEXT FOLLOWING COUNCIL

MEETING. >> SPEAKER: APRIL 19?

>> SPEAKER: YES. ALSO, I WANTED TO SHARE AND PUBLICLY THANK THE DIRECTOR OF PUBLIC SAFETY, PAUL REGISTER.

TODAY I WAS WITH A GROUP OF REGISTERS -- HERE AT THE MUNICIPAL BUILDING AT THE TIME OF THE TORNADO WARNINGS AND WE GOT A SPECIAL TOUR OF THE COMMUNICATIONS CENTER OF THIS BUILDING. (LAUGHTER) VERY IMPROMPTU, PAUL, YOU HANDLED YOURSELF SO PROFESSIONALLY GIVEN THE AMOUNT OF RADIO TRAFFIC AND PHONE CALLS AND SO ON IN FRONT OF YOU IN THE MOMENTS.

WHAT I THINK THE GROUP THAT I WAS WITH WILL GO HOME WITH A NUMBER OF GOOD STORIES TO SHARE AND SINCE WE ARE IN THE COMMUNICATIONS CENTER, NEXT WEEK IS THE TELECOMMUNICATIONS WEEK WHERE WE HAVE PUBLIC DISPATCHERS ARE ROCK -- RECOGNIZED FOR THE WORK THAT THEY DO. WE MIGHT BE MEETING NEXT WEEK SO I WILL TAKE THIS OPPORTUNITY TO THANK THE DISPATCHING COMMUNITY HERE IN OPELIKA AND THE COUNTY. IT IS A TOUGH JOB.

I SPENT EIGHT YEARS DOING IT MYSELF AND IT IS A JOB THAT IS NOT FOR THE FAINT OF HEART. WE REALLY DO APPRECIATE THAT LEVEL OF PROFESSIONALISM THAT THEY PERFORM EVERY SINGLE DAY.

SHOUT-OUT TO THOSE GUYS. THANKS.

>> SPEAKER: THANK YOU, MR. PARSONS.

VERY GOOD. >> SPEAKER: I HAVE ONE OTHER ANNOUNCEMENT THAT I WANTED TO MAKE.

ACTUALLY, LAST YEAR AUBURN WAS DECLARED A PROCLAMATION FROM JUNETEENTH. THIS YEAR WE WILL BE CELEBRATING JUNETEENTH ON JUNE 18 AT THE MARTIN LUTHER KING PARK.

IT IS GOING TO BE AN ALL DAY EVENT.

THAT EVENT WILL ALSO BE COMBINED WITH THE UNSUNG HERO, THE LEGACY CONTINUES. EVERYONE, THE PUBLIC AND EVERYONE IS INVITED TO COME OUT AND ENJOY JUNETEENTH ON JUNE 18.

JUST IN CASE IT RAINS, WE DO HAVE A RAIN VENUE.

WE WILL ANNOUNCE THAT LATER BECAUSE WE WILL DO A RAIN DANCE AND HOPE IT -- DURING A RAIN DANCE FOR THERE NOT TO BE ANY RAIN. WE EXPECT TO HAVE A NICE EVENT THIS YEAR. IT WAS NICE LAST YEAR AND I AM INVITING THE COUNCIL AND ANYONE ELSE THAT WOULD LIKE TO COME OUT AND ENJOY JUNETEENTH AT MARTIN LUTHER KING PARK.

>> SPEAKER: THANK YOU. ANYONE ELSE?

[5. AUBURN UNIVERSITY COMMUNICATIONS]

[00:20:04]

WE WILL MOVE AHEAD WITH AUBURN UNIVERSITY COMMUNICATIONS.

>> SPEAKER: HI EVERYONE. HOPE YOU'RE STAYING OUT OF THE WEATHER TODAY. WE JUST FINISHED UP A LONG WEEK OF INTERVIEWING STUDENTS FOR DIRECTOR POSITIONS.

WE ARE EXCITED TO HAVE A FULL CABINET NOW.

WE HAVE OUR NEW DIRECTOR OLIVIA SUTHERLAND AT ASSISTANT DIRECTOR BUT THEY ARE BACK THERE. THEY ARE EXCITED TO REPORT TO YOU ALL THE NEXT YEAR. MAYBE THEY WILL LET ME FILL IN.

I WILL MISS THIS PODIUM. THEY ARE EXCITED FOR THAT.

SJ IS ALSO PARTNERING WITH THE PROVOST OFFICE AND REGIONS BANK TO START THIS NEW THING CALLED I GRABBED.

IT WILL BE A FINANCIAL EDUCATION PROGRAM FOR STUDENTS SO THEY CAN LEARN HOW TO DO IMPORTANT THINGS LIKE LOANS, MANAGED DEBT, CREDIT, THINGS REALLY NEED TO KNOW.

MY PARENTS WILL BE GLAD ABOUT THAT I WILL BE ATTENDING.

THIS MONTH AUBURN IS RECOGNIZING SEXUAL ASSAULT AWARENESS MONTH BY EDUCATING STUDENTS THROUGH SOCIAL MEETING AND DOING LOTS OF PUSHES TO PROVIDE EDUCATIONAL RESOURCES AND ALSO HONOR THE SURVIVORS OF SEXUAL ASSAULT. AS FOR STUDENT LIFE, STUDENTS ARE GETTING THROUGH THE LAST FEW MONTHS -- LAST MONTH OF SCHOOL AND INTERIOR DESIGN STUDENTS WERE ABLE TO GO TO HAWAII RECENTLY TO WORK ON THEIR STUDENT CAPSTONE PROJECT.

THIS WAS A FIRST FOR THE PROGRAM AND SOMETHING THAT THEY WANT TO CONTINUE TO DO. UPCOMING MEMBERS OF THE AUBURN ROCKETRY ASSOCIATION IS THE AEROSPACE ENGINEERING STUDENT COUNCIL THEY ARE GOING TO KANSAS SOON TO WORK ON SOME PROCEDURES LAUNCH AND FLIGHT EVENT, SOMETHING I WOULD NEVER UNDERSTAND THAT PART OF THEM FOR DOING THAT.

THAT'S ABOUT IT BUT THAT WE ARE EXCITED TO CONTINUE SJ.

I'M STAYING EXTERNAL AFFAIRS. I WILL STILL BE AT CITY BREAKFAST. I'M EXCITED.

>> SPEAKER: THANK YOU FOR ALL OF YOUR GOOD WORK.

AT THIS TIME CITIZENS COMMUNICATIONS ON ITEMS ON THE AGENDA. THIS IS ONLY ON TONIGHT'S AGENDA. WE DO HAVE ONE ITEM AT THE END, A RESOLUTION THAT HAS A PUBLIC HEARING ATTACHED.

IF YOU WOULD LIKE TO SPEAK TO THE COUNCIL ABOUT THIS ITEM PLEASE WAIT UNTIL THE PUBLIC HEARING IS OVER.

ANYONE LIKE TO COME FORWARD AND SPEAK TO THE COUNCIL ON TONIGHT'S AGENDA? SCENE NO ONE WILL MOVE AHEAD

[7. CITY MANAGER’S COMMUNICATIONS]

WITH CITY MANAGER MANAGERS COMMUNICATIONS.

>> SPEAKER: UNDER CITY MANAGERS COMMUNICATIONS THIS EVENING I HAVE THE ANNOUNCEMENT OF THE FOLLOWING VACANCY, ONE VACANCY ON THE GREENSPACE ADVISORY BOARD.

THE UNEXPIRED TERM BEGINS IMMEDIATELY AND ENDS AUGUST 7, 2023. THE APPOINTMENT WILL BE MADE AT THE MAY 3 MEETING. ALSO IN TERMS OF THE MAY 3 MEETING I WOULD ALSO LIKE TO REMIND EVERYONE THAT WILL BE THE FIRST CITY COUNCIL MEETING THAT OFFICIALLY STARTS AT 6 PM.

WILL BE PUSHING THAT OUT ON SOCIAL MEDIA BUT I WANTED TO MAKE SURE I START REMINDING EVERYONE THAT WE ARE ALIGNING FOR THE RESOLUTION THAT YOU PASS RECENTLY CHANGING THE MEETING START TIME FROM SEVEN TO 6 PM WHICH MEANS COMMITTEE OF THE WHOLE WILL BE SOMEWHERE BETWEEN 5:30 AND SIX ON AVERAGE.

SHE JUST ALWAYS REMIND YOU OF THAT EARLY AND OFTEN TO MAKE SURE THAT WE GET THAT OUT AND TO OUR EARLIER POINT WE WILL TALK

ABOUT THAT IF NEEDED. >> SPEAKER: IF YOU ARE READY TO ROLL INTO THE CONSENT AGENDA. ANY COUNCIL MEMBER WISHED TO REMOVE AN ITEM FROM THE CONSENT AGENDA AND DEAL WITH THAT ITEM

INDIVIDUALLY? >> SPEAKER: YES, I WOULD LIKE

TO REMOVE ITEM 8E. >> SPEAKER: I WOULD LIKE TO

REMOVE ITEM 8F5. >> SPEAKER: I WOULD LIKE TO REMOVE ITEM 8F -- FOXTROT. (LAUGHTER)

[8.e. Community Development Block Grant (CDBG) 2022 Annual Action Plan.]

>> SPEAKER: LET'S TAKE THOSE IN ORDER.

>> SPEAKER: ITEM 8E BLOCK GRANT 2022 ANNUAL ACTION PLAN PICK THE CDBG 2022 FISCAL YEAR BEGINS JUNE 1, 2022, AND ANTICIPATED

FEDERAL FUNDING IS 686,000 $92. >> SPEAKER: TO HAVE A MOTION? MOTION AND THE SECOND. I WILL TURN THIS OVER TO YOU.

>> SPEAKER: THANK YOU, MISTER MARE.

I WAS ASKED TODAY BY A CITIZEN IF THE CDBG PROGRAM BASICALLY ONLY BENEFITED ADMINISTRATION AND WARD ONE RESIDENCE.

MY ANSWER TO THAT WAS NO, ABSOLUTELY NOT.

IT IS A CITYWIDE PROGRAM AND SO WHEN THIS IS DISCUSSED IN DETAIL I WOULD APPRECIATE IT IF YOU EMPHASIZE THAT POINT SO THAT FOLKS KNOW THIS PROGRAM TO WHICH THESE PROGRAMS ARE AVAILABLE TO ALL OF OUR CITIZENS ACROSS THE WHOLE CITY.

>> SPEAKER: I WILL LET MISTER DAVID SPEAKE TO THAT BECAUSE I THINK IT'S IMPORTANT TO COUNCIL UNDERSTAND.

GENERALLY SPEAKING THIS IS FEDERAL DOLLARS THAT COME TO THE CITY TO BENEFIT LOW AND MODERATE INCOME PEOPLE IN OUR COMMUNITY.

PERIOD. NO PREFERENCE IS GIVEN TO NEIGHBORHOOD IN TERMS OF BENEFICIARIES.

IT HAS TO DO WITH INCOME LEVELS SET BY THE FEDERAL GOVERNMENT.

[00:25:04]

I WILL HAVE MISTER DAVIS EXPLAINED FURTHER.

>> SPEAKER: THAT IS ABSOLUTELY CORRECT.

OUR PROGRAMS BENEFITS AUBURN CITIZENS ALL OVER AUBURN.

WE HAVE INDIVIDUALS THAT BENEFIT FROM EVERYTHING FROM OUR SPORTS VOUCHERS TO UTILITY RENTAL ASSISTANCE, EVEN THE FUNDS THAT WE HELP SUPPORT OUR DAY CARE CENTERS WE HAVE INDIVIDUALS THAT COME FROM ALL OVER THE CITY. SO ALL OF THE PROJECTS, WHETHER IT IS FUNDING FOR THE FOOD BANK, JUST AN ARRAY OF THINGS THAT WE FUN WITH OUR CBG PROGRAM. THEY BENEFIT THE ENTIRE CITY.

>> SPEAKER: THANK YOU. ANY OTHER COMMENTS OR QUESTIONS

FROM THE COUNCIL? >> SPEAKER: I ALSO HAD A QUESTION. IT SAYS COMMUNITY BLOCK GRANT ANNUAL ACTION PLAN. 2022 ACTION PLAN.

IS THAT NEW MONEY GETTING THAT IS COMING IN ON THIS CDBG?

>> SPEAKER: YES, MA'AM. THIS IS FOR THIS COMING YEAR, IT STARTS JUNE 1. IT RUNS FROM JUNE 1 TO MAY 3 OF EVERY YEAR. THAT IS HOW THE CYCLE RUNS.

>> SPEAKER: OKAY. THAT IS WHEN THE COMMUNITY COMES IN AND YOU TALK TO THEM ABOUT HOW THE MONEY IS GOING TO BE

SPENT. >> SPEAKER: WE HAVE GONE THROUGH THAT PROCESS AND WE WERE ABLE TO IN FEBRUARY ALLOW ORGANIZATIONS THAT WERE INTERESTED IN BEING FUNDED THIS CYCLE TO COME IN AND BE BRIEFED ON THE PROCESS, WHICH WE DID.

ONCE WE GOT THOSE APPLICATIONS BACK, WE REVIEWED THE APPLICATIONS, RANKED THEM AND THOSE APPLICATIONS AND THEN OUR PROPOSAL TONIGHT IS RECOMMENDING HOW THOSE DOLLARS SHOULD BE

ALLOCATED. >> SPEAKER: IT'S IMPORTANT TO NOTE THAT WE DO A MULTIYEAR WHAT WE CALL CITIZEN PARTICIPATION PLAN THAT TURNED INTO A MULTIYEAR CONSOLIDATED PLAN.

WE HAVE TO DO ALL OF THESE PLANS , DIFFERENT PUBLIC MEETINGS IN DIFFERENT PUBLIC MEETINGS AND THEN THE ACTION PLAN IS A ONE YEAR PLAN INSIDE OF THE CONSOLIDATED PLAN.

THEY FEDERAL GOVERNMENT CAN, KATE THINGS EVERY NOW AND THEN, BUT I THINK WHAT IS REALLY IMPORTANT IS THERE IS A CITIZEN PARTICIPATION PLAN THAT IS INVOLVED IN THIS.

THERE IS PUBLIC HEARINGS ALONG THE WAY, PEOPLE CAN WRITE, CALL, E-MAIL. WE USE THAT DATA GATHERED INFORMATION TO FORMULATE OUR OVERALL PLAN.

THIS IS THE ONE YEAR IMPLEMENTATION AS TO GET FUNDING. MR. DAVIS GUESSTIMATED AS WE SAY BASED ON THE FUNDING WE RECEIVED LAST YEAR AND IT OFTEN DEPENDS ON WHAT CONGRESS DECIDES THEY ARE OR AREN'T GOING TO DO.

IT COULD BE ADJUSTED UP OR DOWN DEPENDING ON THE FUNDS WE

ULTIMATELY RECEIVE. >> SPEAKER: THANK YOU.

>> SPEAKER: ANYTHING ELSE FROM THE COUNCIL? WE HAVE A MOTION AND ALL IN FAVOR.

[8.f.(4) HHB Engineers, P.C. Mechanical engineering services for the installation of air conditioning in the gymnasiums located at the Frank Brown Recreation Center and the Boykin Community Center. $55,345.]

(VOICE VOTE) MOTION CARRIES.

>> SPEAKER: ITEM 8F FOR AUTHORIZED PROFESSIONAL SERVICES AGREEMENT WITH HHB ENGINEERS FROM A KIND OF ENGINEER DESIGN SERVICES FOR THE BIDDING AND INSTALLATION OF AIR CONDITIONING SYSTEMS FOR THE BOYKIN COMMUNITY CENTER AND FRANK BROWN RECREATION CENTER GYMNASIUMS IN THE AMOUNT OF $55,345.

>> SPEAKER: MOVE FOR APPROVAL. >> SPEAKER: SECOND.

>> SPEAKER: MOTION AND SECOND. MS. TAYLOR, I WILL TURN IT OVER

TO YOU. >> SPEAKER: I JUST WANTED THE PUBLIC TO HEAR THAT FRANK BROWN AND BOYKIN COMMUNITY CENTER JIM IS ABOUT TO GET SOME AIR CONDITIONING.

(LAUGHTER) ESPECIALLY THE PEOPLE WHO WORK OUT OVER THERE. IT IS JUST SOMETHING THAT I NEED

EVERYBODY TO HEAR. >> SPEAKER: I WOULD LIKE TO SPEAK TO THAT JUST TO GIVE YOU A LITTLE FURTHER IDEA.

WE ESTIMATE IT WOULD BE ABOUT $250,000 TO AIR CONDITION BOYKIN AND ABOUT $350,000 TO AIR CONDITION FRANK BROWN.

WHILE EVERYONE IS EXCITED ABOUT THIS, LONG LEAD TIMES AND PRODUCTION -- PRODUCTION DELAYS COULD CAUSE THIS TO GET INTO THE FALL BEFORE WE SEE ROBUST ACTIVITY.

WE WOULD LOVE NOTHING MORE THAN TO GET THESE INSTALLED SOONER RATHER THAN LATER. WE DO HAVE TO DESIGN THEM AND THEN GO OUT TO BID WITH THEM. BUT THE LEAD TIME WAS 18 WEEKS I THINK THE LAST TIME WE TALKED ABOUT IT.

SO WE WILL KEEP YOU APPRISED, BUT FOR ELECTION SEASON WHERE WE USE THESE AS POLLING LOCATIONS, WE DO RENT AIR CONDITIONING.

WE ARE NOT TRYING TO COOK EVERYONE IN THERE.

BUT THIS IS A MUCH NEEDED SO THE STAFF IS HAPPY TO BRING THIS

FORWARD MUCH NEEDED PROJECT. >> SPEAKER: I AGREE WITH MS. TAYLOR. VERY EXCITED.

IT IS BEEN A LOT OF HOURS OF THOSE VERY HOT GYMNASIUMS IN THE SUMMER. ANY OTHER COMMONS OR QUESTIONS FROM THE COUNCIL? WE HAVE A SECOND.

ALL IN FAVOR? (VOICE VOTE)

[8.f (5) Hydro‐Engineering Solutions. Professional services agreement. Gay Street and Marion Circle Drainage Study. $30,000.]

AT MOTION CARRIES ITEM EIGHT MAC F5 AUTHORIZED PROFESSIONAL SERVICE AGREEMENT FOR THE GAY STREET AND MARION CIRCLE DRAINAGE STUDY IN THE AMOUNT OF $2000.

[00:30:03]

>> SPEAKER: MOVE FOR APPROVAL. >> SPEAKER: SECOND.

>> SPEAKER: MOTION AND SECOND. MR. PARSONS?

>> SPEAKER: THINGS. I JUST WANTED TO PULL IT OFF THE AGENDA SO THAT THIS PROJECT IS HAPPENING IN WARD SIX.

THERE IS A NUMBER OF CONCERNED RESIDENTS WHOSE YARDS OCCASIONALLY OVERFLOW WITH SOME OF THIS RUNOFF WATER AND IF IT IS POSSIBLE COULD THEY GET A BEAT -- BRIEF DESCRIPTION OF WHAT THIS PROJECT IS IN ENTAILING.

>> SPEAKER: CITY ENGINEER FRAZIER?

>> SPEAKER: YES, THE CONTRACT WILL BE WITH HYDRO ENGINEERING SOLUTIONS, MR. JOHN CURRY IS ONE OF THE TOP HYDROLOGISTS IN THE COUNTRY. BUT IT IS GOING TO BE AN ANALYSIS OF THE DRAINAGE BASIN THAT EXTENDS UP TO AUBURN -- OLD

JUNIOR HIGH. >> SPEAKER: EAST SAMFORD

SCHOOL. >> SPEAKER: EAST SAMFORD SCHOOL AND DOWN TO MARION CIRCLE AND TO GAY STREET.

HE IS GOING TO ANALYZE EXISTING DRAINAGE STRUCTURES, EXISTING DITCH, TO DETERMINE IF WE HAVE AN ISSUE OR IF THERE IS MITIGATION THAT IS NEEDED IN THAT BASIN.

>> SPEAKER: THANKS. I JUST ON BEHALF OF THE RESIDENTS LIKE TO THANK YOU FOR BEING RESPONSIVE TO THE WAY THAT THEY HAVE REACHED OUT TO US AND THANKS AND I APPRECIATE THAT.

>> SPEAKER: ANYBODY ELSE ON THE COUNCIL? HAVE A QUESTION OR COMMENT? OKAY.

[8. CONSIDERATION OF CONSENT AGENDA]

MOTION AND SECOND. ALL IN FAVOR.

(VOICE VOTE) AND HE OPPOSED? THE MOTION CARRIES. DO I HAVE A MOTION TO APPROVE THE BALANCE OF THE CONSENT AGENDA?

>> SPEAKER: SO MOVED. >> SPEAKER: MOTION AND SECOND.

ALL IN FAVOR. (VOICE VOTE)

[10. RESOLUTIONS]

THE CONSENT AGENDA CARRIES FORTH.

>> SPEAKER: WE DON'T HAVE ANY ORDINANCES THIS EVENING SO WE WILL ROLL INTO RESOLUTIONS. ITEM 10A IS A REQUEST FROM BRETT BASQUIN ON BEHALF OF A PT ARCHCO LLC FOR CONDITIONAL CONDITIONAL USE APPROVAL OF PREVIOUSLY APPROVED CONDITIONAL USE FOR A PERFORMANCE RESIDENTIAL USE MULTIPLE UNIT DEVELOPMENT LOCATED AT 1397 NORTH DEAN ROAD IN THE COMPREHENSIVE DEVELOPMENT DISTRICT WITH A PLAN DEVELOP A DISTRICT OVERLAY.

THE PLANNING COMMISSION UNANIMOUSLY RECOMMENDED APPROVAL IS MARCH 17, 2022, MEETING. A PUBLIC HEARING IS REQUIRED.

>> SPEAKER: MOVE TO APPROVE. >> SPEAKER: SECOND.

>> SPEAKER: MOTION AND SECOND PICK AT THIS TIME I WILL OPEN THE PUBLIC HEARING. IF YOU WOULD LIKE TO ADDRESS THE COUNCIL PLEASE COME FORWARD AND GIVE US YOUR NAME AND ADDRESS FOR THE RECORD. WE WILL CLOSE THE PUBLIC HEARING. ANY COMMENTS OR QUESTIONS FROM THE COUNCIL? YES OR?

>> SPEAKER: THIS HAS BEEN DELAYED ONCE BEFORE.

THIS IS THE SECOND REQUEST FOR EXTENSION.

THE RATIONALE PROVIDED IS THAT THEY CAN'T GET BUILDING PERMITS IN ENOUGH TIME TO FINISH. WHAT IS GOING ON THERE? WHY ARE WE DELAYED AFTER TWO EXTENSIONS ON GETTING THE

BUILDING PERMITS? >> SPEAKER: I WILL HAVE MR. FOOTS ARE PLANNING DIRECTOR EXPLAINED WHAT HE KNOWS AND IF WE HAVE FURTHER QUESTIONS WE CAN ASK THE APPLICANT'S BACK AS I UNDERSTAND IT THIS PROJECT WAS APPROVED IN 2020, CONDITIONAL USE IS GOOD FOR 18 MONTHS. THEY ALSO GOT A ONE-TIME SIX-MONTH EXTENSION WHICH IS THE ONLY NUMBER OF EXTENSIONS YOU CAN GET. THE PROJECT WILL EXPIRE I BELIEVE IN JUNE OF 2022. AND SO THEY ARE BUTTING UP AGAINST A DEADLINE APPROACHING AND THEY WILL ARE NOT SURE THEY WILL BE ABLE TO GET THE BUILDING PERMITS PULLED BY THAT TIME PERIOD WHICH WOULD MEAN THE CONDITIONAL USE EXPIRES.

THEY ARE ASKING FOR A BRAND-NEW EXTENSION A BRAND-NEW CONDITIONAL EXTENSION. IT HAS THE SAME NUMBER OF UNITS EVERYTHING IS PRACTICALLY THE SAME, THE DESIGNS A LITTLE BIT DIFFERENT, BUT BETTER. SO THE PLANNING COMMISSION DID TAKE A LOOK AT IT AND THEY RECOMMEND APPROVAL.

>> SPEAKER: SO WHY CAN'T GET THEY GET THE PERMIT?

>> SPEAKER: I DON'T KNOW THE ISSUES THAT THEY ARE HAVING WITH TIMING AS FAR AS THAT'S CONCERNED.

I JUST KNOW THAT THEY SUBMITTED A BRAND-NEW APPLICATION ASKING

TO GO AHEAD AND. >> SPEAKER: SO IT IS NOT A CITY

ISSUE? >> SPEAKER: NOT THAT I'M AWARE OF. ON THERE AND THEY ARE HAVING AN ISSUE WITH GETTING EVERYTHING LINED UP.

>> SPEAKER: THAT IS THE THING TO BE VESTED.

WE TALKED ABOUT THAT IN OTHER CIRCUMSTANCES.

YOU HAVE ZONING CERTIFICATES AND BUILDING PERMITS.

AND TO GET ALL THE WAY THROUGH THEY HAVE NOT SIGNALED AT THIS STAGE THEY ABSOLUTELY CAN'T DO IT THEY ARE NOT POSITIVE THAT THEY CAN. SO WE HAVE A LOT OF DEVELOPING GROUPS AND ENGINEERS THAT ARE IN THE PRACTICE OF ASKING WELL BEFORE THEY BUMP UP AGAINST A DEADLINE.

JUST IN CASE INSTEAD OF COMING TO YOU IN JUNE.

THAT IS PRETTY COMMONPLACE LATELY.

I WOULD SAY ACROSS THE BOARD WE HAVE SEEN A LOT OF PEOPLE WITH CHALLENGES AS USUAL IN COVID GETTING SOME STUFF DONE AS WE

ARE COMING OUT OF IT. >> SPEAKER: ONE ADDITIONAL QUESTION. THIS PLANNING AND STAFF NORMALLY IS REALLY EMPHASIZING CONDUCTIVITY AND THIS IS BASICALLY A DEAD END ROAD HERE WITH 250 UNITS BEING BUILT ON TOP OF IT. IS THERE ANY PLANS FOR IT DEEMED TO CONTINUE ELSEWHERE OR CONDUCTIVITY OVER TO SHELTON

MILK MILL ROAD? >> SPEAKER: FOR NORTH DEAN ROAD , ABSOLUTELY IT IS ON THE CITY'S MAJOR STREET PLAN TO CONNECT IT ALL THE WAY THROUGH. THERE IS NOTHING THE DEVELOPER DOES NOT CONTROL PROPERTY WHERE WE CAN DO THAT.

[00:35:02]

AND THEN IT JUST ABOVE THIS AREA ALSO WAS SHOWN IN EAST WEST CONNECTION TO THAT KIND OF COMES FROM BEHIND LEE SCOTT ACADEMY.

IS THAT CORRECT, CITY ENGINEER FRAZIER? UP OFF OF DEAN ROAD. SO WE DO HAVE CITY HAS PLANS FOR IT BUT IT WOULD BE WITHIN THIS DEVELOPMENT TO DO THAT.

>> SPEAKER: I UNDERSTAND THAT. I JUST DIDN'T WANT A REPEAT OF WHAT WAS ON RICHLAND DROVE OVER THE YEARS WITH ONE WAY IN ONE

WAY OUT DEVELOPMENT. >> SPEAKER: THERE IS ONE YOU WILL SEE TO THE RIGHT OF NORTH DEAN ROAD'S IS OUTSIDE CITY LIMITS. THAT IS A SMALL PIECE BUT THE REST OF IT GOING NORTH WAS RECENTLY MAY HAVE CHANGED BUT UNDER MAJOR SINGLE OWNERSHIP. THERE IS HOPE FOR THIS.

[12. CITIZENS’ OPEN FORUM.]

>> SPEAKER: MAYOR, THOSE ARE ALL THE ITEMS OF BUSINESS WE

HAVE YOU THIS EVENING. >> SPEAKER: THIS TIME IS YOUR OPPORTUNITY FOR CITIZEN'S OPEN FORM.

SPEAK TO THE COUNCIL ABOUT ANYTHING ON YOUR MIND.

WE ASK THAT YOU PLEASE COME FORWARD AND GIVE US YOUR NAME AND ADDRESS FOR THE RECORD. REMEMBER THAT YOU HAVE THREE MINUTES. REMEMBER YOUR COMMENTS SHOULD BE DIRECTED TOWARDS THE COUNCIL. YES, SIR?

>> SPEAKER: MAYOR AND COUNCIL. MY NAME IS ROBERT WILKINS TO 61 BENSON DRIVE AUBURN, ALABAMA. I WANTED TO TALK ABOUT THE CITY LACK OF FISCAL RESPONSIBILITY. TALKED ABOUT ORDINANCE 3288 SHORT-TERM RENTAL. FIRST OVER $100,000 IS SPENT FOR TRUCK AND EXPENSE CITY EMPLOYEES THAT BENEFITS SOFTWARE.

FOR MONITORING 151 FAMILIES. ORDINANCE 3288.

I FEEL LIKE A CRIMINAL BECAUSE I HAVE YOU SPENT THIS MUCH MONEY TO MAKE SURE THAT WE ABIDE BY THE RULES THAT HAVE BEEN SET THAT WE FEEL IS NOT CORRECT. I TENDED -- I ATTENDED A COURT HEARING ON MARCH 17 AND I NOTICE WE SPENT PROBABLY $100,000, THE CITY HAS, ON LEGAL EXPENSES FROM A LAW FIRM IN BIRMINGHAM.

THERE ARE PLENTY OF LAW FIRMS HERE IN THE AUBURN AREA.

IT WAS THE CASE STEVEN DIXON VERSUS THE CITY OF AUBURN.

IT WAS KIND OF A TOTAL EMBARRASSMENT BECAUSE THE LAW FIRM ALL THEY TALKED ABOUT WERE CASES.

FOR CASES IN ALABAMA AND ONE WAS BUDGET VERSUS THE CITY OF DAPHNE , A CASE IN BOAZ AND BIRMINGHAM AND GIRLY.

ALL OF THEM ARE BASED ON COMMERCIAL THINGS, THEY WERE NOT ANYTHING RESIDENTIAL AT ALL. THEY ALSO TALKED ABOUT A HOUSTON CASE IN TEXAS. THIRD THE CITY OF AUBURN HAS MADE AGREEMENT, MADE AN AGREEMENT WITH AIRBNB IN 2017 OVER 165,000 IN REVENUE WAS COLLECTED.

IF YOU CONVERT THAT TO TEN YEARS THAT IS AT LEAST 1.6 MILLION, MAYBE 2 MILLION MORE. THAT THE CITY WOULD GETS.

BUT YOU HAVE THROWN THAT OUT. ALSO THE CITY ACCEPTED LODGING TAX FROM US, EVEN THE MAYOR TOOK OUR COUNCILMAN DIXON WENT TO HIS HOUSE AND LOOKED AT THE AIRBNB TO SEE THAT IT IS JUST A REGULAR HOME. SOMETHING ALSO THE MAYOR AND COUNCIL ALLOWED US TO OPERATE WITH THEIR APPROVAL BUT THEN THEY THREW AWAY OUR LIVELIHOOD WITH NO CORRESPONDENCE.

THIS MAYOR AND COUNCIL HAD RESPONSIBILITY TO KEEP US INFORMED BEFORE THE CEASE AND DESIST ORDER.

THAT IS THE ONLY THING I EVER GOT FROM YOU, COUNCIL.

I'M AFRAID NEXT CORRESPONDENCE WILL BE CEASE MAYBE TAKING MY HOME. I DON'T KNOW WHAT YOU'RE GOING TO DO NEXT. THERE IS A HOTEL GOING UP AND YOU ARE VERY FAMILIAR IN YOUR STOMPING GROUND, MAYOR, WHERE THE ANDERS BOOKSTORE IS. I WISH AT THE GRAND OPENING THAT

[00:40:01]

Y'ALL WOULD HAVE A TOUR ALSO THE AIRBNB SO YOU CAN TELL THE DIFFERENCE BETWEEN A REAL HOTEL AND OUR HOMES.

I HAVE A FOUR BEDROOM HOME, MISTER DIXON HAS A ONE BEDROOM SUITE UNDER HIS HOUSE. AUBURN'S GROWTH IS 4.2 PERCENT SINCE THE GROUT GREP -- LEFT CENSUS.

IT IS MUCH SIMPLER TO MANAGE A GROWING CITY.

IT IS EASIER TO WASTE CITY FUNDS.

>> SPEAKER: WHO WILL BE NEXT?
