HAVE FIVE VOTING MEMBERS YOU NEED FOR AFFIRMATIVE VOTES OR A MOTION TO PASS. NEW BUSINESS. BZ-2022-005.

>> GOOD AFTERNOON EVERYONE. THIS REQUEST IS FOR A VARIANCE TO TABLE 5 ? 2 LOT AREA SETBACK AND PARKING REQUIREMENTS FOR THE IN SEAT ZONING DISTRICT AND THE SPECIFIC REQUEST IS FOR THE APPLICANT TO RECEIVE A VARIANCE OF 228 FEET FOR THE REQUIRED 42 FOOT REAR SETBACK. THEY WISH TO CONSTRUCT AN ADDITION WHERE THERE IS AN EXISTING PATIO. HERE IS THE PROX MAP SHOWING AN OUTLINE OF THE PROPERTY AND IT IS LOCATED ON THE CORNER AND IT IS A LARGE LOT JUST UNDER 3500 SQUARE FEET. IT CURRENTLY DOES NOT COMPLY WITH THE REAR SETBACK REQUIREMENT. IT'S ABOUT 26 FEET FROM THE REAR PROPERTY LINE. THE NEXT EXHIBIT IS GOING TO SHOW THE OUTLINE IN YELLOW IS THE MAXIMUM POSSIBLE BUILDING AREA IF THE SETBACKS WERE APPLIED.

THE OUTLINE THERE IN BLUE IS WELL, THE BLUE IN THE ORANGE IS THE EXISTING PATIO STRUCTURE. THE ORANGE WILL BE REMOVED AND IN THE BLUE WILL BE USED AS THE AREA FOR THE ADDITION. THEN, HERE ON THE NEXT EXHIBIT WE ARE GOING TO SEE THE THREE AREAS WHERE THE ADDITION WILL ENCROACH ONTO THE SETBACK. IT WILL ENCROACH AT THREE PLACES. THE ANGLE OF THE PROPERTY LESSENS THE VARIANCE NEEDED AS YOU GO FURTHER WEST. SO, IT IS GOING TO BE 16 FEET UP AT THE EAST, 14 AND A HALF FEET IN THE MIDDLE AND IN JUST OVER 14 FEET ON THE WEST. THE AERIAL HERE WILL SHOW YOU THAT THE HOME MOST AFFECTED BY THE VARIANCE IS GOING TO BE TO THE NORTH AT 225 TERRACE ACRES SCIRCLE. ON THAT PROPERTY, THE HOME ON THE SOUTHERN SIDE IS THAT HOMES GARAGE. THE OWNER FOR THAT RESIDENCE HAS PROVIDED AN EMAIL IN SUPPORT OF THE REQUEST. THE HOME IS LOCATED ON IN UNCONVENTIONAL SHAPED CORNER LOT. IF THE SETBACKS WERE APPLIED DIFFERENTLY IF THE HOME WAS FACING TOWARDS THE EAST A VARIANCE WOULD NOT BE NEEDED FOR THE PROPERTY FOR THE ADDITION. WHICH CREATES A UNIQUE CIRCUMSTANCE AND THEY HAVE ALSO DETERMINED THAT THERE ARE UNNECESSARY HARDSHIPS BASED ON THE SIZE OF THE PROPERTY AND THE PLACEMENT OF THE IN C-15 REQUIREMENTS AFTER THE CONSTRUCTION OF THE HOME.

BASED ON THESE FACTORS WE RECOMMEND APPROVAL OF THE VARIANCE REQUEST UP TO 28 THE TO ALLOW A REAR SETBACK EXCUSE ME, I AM SORRY. A VARIANCE OF UP TO 28 FEET TO THE 42 FOOT REQUIREMENT TO ALLOW AN ADDITION UP TO 14 FEET FROM THE SETBACK BASED ON THE CONDITION THAT THE PLAN FOLLOWS WHAT WAS SUBMITTED TO THE BOARD.
