ALLEGIANCE. >> I PLEDGE ALLEGIANCE TO THE FLAG OF THE UNITED STATES OF AMERICA INTO THE REPUBLIC FOR WHICH IT STANDS ONE NATION UNDER GOD INDIVISIBLE WITH LIBERTY AND

JUSTICE FOR ALL. >> AS FAR AS A MEETING TONIGHT TO THE COMMITTEE OF WHOLE WE DID

[4. MAYOR AND COUNCIL COMMUNICATIONS]

APPOINT SHARON TOBER TO THE COMMITTEE, WE ARE THANKFUL FOR EVERYBODY THAT PARTICIPATED IN THIS PROCESS, WE ARE GRATEFUL TO THE CITIZENS, WHO WANT TO SERVE FOR THAT OPPORTUNITY.

ANYWAY WE RECEIVE YOUR PROGRESS REPORT ON THE COMMUNITY ARTS STUDY GROUP AS I GO INTO OTHER ANNOUNCEMENTS TONIGHT, WE GOT A NUMBER OF THINGS THAT WE WOULD LIKE TO WALK THROUGH.

FIRST OF ALL AUBURN LOST A COUPLE OF PEOPLE MR. JAMES NICHOLS, HE WORKED AT TUMOR DRUGS, HE MAKES THOUSANDS OF LEMONADES AND WAS DELIVERING PRESCRIPTIONS LONG FOR PIZZA BUSINESS WE WERE DELIVERING PEACE OR HE WAS SUCH A FABRIC OF AUBURN HE PASSED AWAY AND THEN THERE MR. SISCO CAIN, WHO WOULD COME IN HERE, IN THE EARLY SUMMER, AND THEN PRESENT THE CISCO WITH A CHECK, TO PROVIDE FOR JULY 4 FIREWORKS ON BEHALF OF STAN STRATTON HE WAS THE HR DIRECTOR AT BRIGGS & STRATTON, AND HE LOST HIS LIFE LAST WEEK TO CANCER, HE WAS A PRINCE OF A FELLA AND HE LOVED HIS ADOPTIVE COMMUNITY, AND THERE WAS ARE TWO GOOD PEOPLE.

WHEN YOU THINK ABOUT AUBURN'S UNIQUE AND SPECIAL PLACE, BECAUSE SPECIAL PEOPLE THAT CHOSE TO LIVE YOUR. AND JAMES AND CISCO WERE TO THOSE PEOPLE.

YESTERDAY, WE HAD A GREAT ANNOUNCEMENT, AN EXCITING ANNOUNCEMENT, OUR CONGRESSMAN MIKE ROGERS WAS IN TOWN, AND WE WERE PROUD TO, I WAS UP TO VISIT WITH HIM FOR 30 MINUTES, AND THANK HIM FOR HIS SUPPORT, HE ASSISTED IN OBTAINING AN APPROPRIATION OF FEDERAL APPROPRIATION FOR $3 MILLION THAT IS HELPING US EXPAND AUBURN CENTER FOR DEVELOP INDUSTRIES.

I THINK HE HAS ALWAYS BEEN HELPFUL TO AUBURN. THIS WAS SOMETHING THAT THE INDUSTRIAL DEVELOPMENT TEAM HAS WANTED TO SEE FOR A WHILE. THERE WILL HAVE A NICE INTERESTING BEAUTIFUL NEW BUILDING THAT WILL ASSIST US IN MANY WAYS I DON'T KNOW IF WE CAN

GET UP BEFORE WHAT GOES ON OUT THERE IN A CDI. >> THIS IS A FANTASTIC PROJECT, AND INNOVATIVE THING, THE CITY'S ECONOMIC DEVELOPMENT STAFF CAME UP WITH, BUT IT IS A PARTNERSHIP, WITH MANY OTHER PEOPLE, WHICH IS ONE OF THE REASONS CONGRESSMAN ROGERS CAN'T SUPPORT IT. IT IS VERY REGIONAL IN NATURE AND WILL GO OVER THAT LITTLE

BIT. >> SURE, YES THANK YOU, THE OPERANT CENTER OF DEVELOPING INDUSTRIES SITS ON PUMPHREY AVENUE. WE HAVE USES FOR YEARS FOR START UPS AND INTERBORO AERIAL PROGRAMS. ABOUT FOUR YEARS AGO WE DEDICATED TO OF THE PLACE OF EACH 10,000 SQUARE-FOOT ADDED TO OUR TRAINING WORKFORCE PROGRAM.

WE CREATED THE ADVANCEMENT EFFECTIVE TRAINING CENTER. FOCUSING SPECIFICALLY ON TECHNOLOGY TRANSFER IN OUR INDUSTRIES AND UPSCALING WORKFORCE.

THIS IS AN PARTNERSHIP AS MEGAN SAID, WITH THE COMMUNITY COLLEGE UNIVERSITY ET CETERA.

AND ABOUT TWO AND A HALF YEARS AGO THE UNIVERSITY, HAD CREATED I CAMP.

AN INSTITUTE THROUGH ENGINEERING, AND IS COLOCATED WITH US IN THAT LOCATION.

THE APPROPRIATION THAT YOU ARE DESCRIBING, WITHIN HOURS THE PLACENTA BUILDING FOR TRAINING AND CONFERENCES TO BRING ACADEMIA AND INDUSTRY AND WORKFORCE TOGETHER.

>> THANK YOU WE APPRECIATE THAT AND THANK YOU FOR YOUR HARD WORK.

ONCE AGAIN THANKS CONGRESSMAN ROGERS FOR HIS SUPPORT. IN RELATED TOPICS, I AM PROUD AND FORTUNATE TO SERVE ON THE PORT OF THE OPERANT RESEARCH AND TECHNOLOGY FOUNDATION, WE MEET QUARTERLY AND IN OUR RECENT MEETING, WE WERE PROUD TO RECORD THAT AUBURN IS NOW ONE OF THE

[00:05:01]

TOP 100 RESEARCH UNIVERSITIES IN THE UNITED STATES. IT IS REALLY INTERESTING TO REALLY THINK ABOUT HOW THAT IMPACTS OUR COMMUNITY WITH JOBS, AND JUST TALENT.

THAT WILL COME TO OUR COMMUNITY. BUT IS ALSO AN OPPORTUNITY FOR OUR STUDENTS TO LEARN AND DO RESEARCH AND AREAS, ARE UNIQUE, AND THIS REALLY WORKS TO WHAT WE DO AT AC DI, COULD BECAUSE SOME OF THE THINGS THAT GO ON IN THE RESEARCH PARK END UP PARTNERS AND WE WORK TOGETHER, WITHIN THE CITY. SO WE ARE EXCITED AT THE WORK THAT IS GOING ON, AND WE ARE VERY THANKFUL FOR EVERYBODY'S SUPPORT WITH THIS ENDEAVOR OUT THERE.

I WANT TO THANK PARKS AND RECREATION WORKING WITH WEATHER THIS WEEKEND AND MAKE AN EASTER EGG HUNT HAPPEN. I'M GLAD WE USE PLASTIC EGGS IT COMES TO BENEFIT WHEN YOU HAVE A RAIN SHOWER. THANK YOU I KNOW THE CHILDREN HAD A GREAT TIME.

I KNOW IN OR IS IT WE HAD IT WONDERFUL TIGER TRAIL CEREMONY A COUPLE OF FRIDAYS AGO, SCOTT WAS MENTIONED A WHILE AGO IT IS A PEOPLE PUBLIC ART DOWNTOWN. WE CONDUCTED EIGHT NEW MEMBERS INTO THE TIGER TRAIL. A COUPLE OF THEM HAVE ARTICLES IN THE PAPER RECENTLY.

VERY PROUD NIGHT FOR THEM AND THE FAMILIES THEY WERE ALL VERY HUMBLED, TO BE CHOSEN TO BE PART OF THE TIGER TRAIL OF AUBURN, AND WE LOOK FORWARD TO LOOKING AND SEEING THEIR PLACE IN THE GROUND AND THE SIDEWALK SOON. I WAS TO BE OF PART OF ESPERANCE OPEN HOUSE RECENTLY.

WHAT A WONDERFUL MINISTRY THAT ESPERANZA HOUSE PROVIDES FOR HISPANIC CHILDREN IN THE COMMUNITY. THEY ARE DOING EVERYTHING FROM PROVIDING SHOES TO HELPING THEM WITH HOMEWORK, TO HELPING THEM PARTICIPATE IN SPORTS AND ANY OTHER YOUTH ACTIVITIES IN THE COMMUNITY. AND IT WAS A VERY SPECIAL NIGHT, TO LISTEN TO THEIR REPORT OF ALL THEIR GREAT WORK IN OUR COMMUNITY. ALSO, I WAS ABLE TO BE A PART OF THE OPERANT GLOBAL, OPEN HOUSE, THAT HAPPENED A COUPLE OF FRIDAYS AGO OVER THE JOE CULLEN SMITH. WE APPRECIATE THE VISION OF AUBURN GLOBAL TO BRING ALL OF THE PEOPLE FROM SO MANY DIFFERENT NATIONALITIES WE HAVE LIVING IN THE COMMUNITY PRIMARILY IN AND AROUND THE UNIVERSITY TOGETHER FOR A DAY OF FELLOWSHIP AND FOOD AND A TIME TO GET TO KNOW EACH OTHER. SO I THINK THOSE MEMBERS AND VP OF OUTREACH DEPARTMENT AND ALL THE PEOPLE THAT PUT TIME INTO THAT. MANY OF US HERE WITH THE TRUE DELIVERANCE RIBBON-CUTTING FOR BISHOP TOLBERT AND HIS CHURCH NEW FACILITY, WHAT A GREAT ASSET THAT WILL BE TWO NORTHWEST OPERANT AND TO ALL OF AUBURN AND GRATEFUL FOR THEIR INVESTMENT IN THE COMMUNITY THAT CHURCH HAS REALLY MADE AN INVESTMENT IN THE PEOPLE THAT THEY SERVE.

AND I'M CERTAINLY THANKFUL FOR THAT. WE ARE VERY PROUD TO BE THE HOME OF THE ALABAMA BOYS AND GIRLS CLUB YOUTH OF THE YEAR. 190 WOODS, I HOPE I GOT THAT PRONOUNCE RIGHT AND IF NOT I APOLOGIZE. THIS PAST WEEKEND SHE WAS CHOSEN AS THE YOUTH OF THE YEAR IN THE STATE OF ALABAMA, AND WE APPRECIATE ALWAYS THE GREAT WORK OF THE GREAT BOYS AND GIRLS CLUB AND ONE OF OUR YOUTH WAS CHOSEN ONE OF THE BEST ONES IN STATE OF ALABAMA. WE HAD A SGA BREAKFAST RECENTLY, GREAT TO CONTINUE THE CONVERSATION WITH HGA I KNOW THEY WILL COME FORWARD AND TALK ABOUT AN ACTIVITY THAT WE ARE GOING TO HAVE LATER ON THIS WEEK. TODAY, I ALSO HAD AN OPPORTUNITY TO EAT LUNCH WITH LEE COUNTY HOMEBUILDERS. WHAT A GREAT GROUP OF PEOPLE WHO ARE WORKING HARD TO BUILD NEW HOMES IN THIS NEW COMMUNITY. I JUST APPRECIATE EVERYTHING THAT THEY DO, AND THE AMOUNT OF PEOPLE THAT THEY EMPLOY, ALL OF THEIR SELVES THAT WORK HARD, THESE ARE GREAT JOBS AND HAPPEN RIGHT HERE IN AUBURN AND I THINK THAT.

THEN MYSELF AND MS. WHITSON, AND THE CITY MANAGER ENTERTAINED THE OPERANT YOUNG LEADERS HERE.

IN OUR CHAMBERS RIGHT NOW, RIGHT WHERE WE ARE TONIGHT, AND TALK TO THEM ABOUT A FORM OF GOVERNMENT AND HOW WE DO PUT THIS IN AUBURN, AND HOW DOES THAT COMPARE TO THE SISTER CITIES HERE IN LEE COUNTY, AND I JUST APPRECIATE THOSE YOUNG PEOPLE.

THERE'S A LOT OF THINGS THAT CAN BE DISTRACTED BY THE SEASON THEIR LIFE, AND THEY CHOSE TO BE A PART OF THE PROGRAM WHICH MAKES THEM BE COMMITTED TO SOMETHING AND I THINK THEY MEET ONCE A MONTH FOR A SIGNIFICANT AMOUNT OF TIME. I LOOK FORWARD TO GOING TO THEIR GRADUATION NEXT TUESDAY NIGHT AND CELEBRATING ALL OF THE GREAT WORK.

TOMORROW NIGHT WE HAVE AN INDUSTRY APPRECIATION DINNER AND EVENT, THAT OUR CHAMBER OF COMMERCE IS HELPING THE CITY. AND MAYBE THEY WILL TAKE THE LEAD ON THAT, BUT WE ARE EXCITED ABOUT BEING A, AND WE THANK ALL OF THE INDUSTRIES AGAIN FOR WHAT THEY DO IN THE CITY OF AUBURN AND THE PEOPLE THAT THEY EMPLOY. WHAT THEY PROVIDE FOR US ECONOMICALLY AND ALLOW US TO DO HERE IN THIS COMMUNITY I AM VERY THANKFUL AND LOOK FORWARD CELEBRATE WITH HER.

ALSO LAST FRIDAY COPS ON TOP OCCURRED HERE AT KROGER'S HERE. IT IS A FUNDRAISER FOR SPECIAL OLYMPICS, AND ALL I APPRECIATE OUR POLICE DEPARTMENT BEING INVOLVED, AND THE END OF THE POLICE WERE INVOLVED IN LEE COUNTY SHERIFFS. WHAT A GREAT EVENT TO BRING ATTENTION TO A SPECIAL GROUP OF GROUP OF CITIZENS WE HAVE IN A COMMUNITY.

AND IT ALLOWS THEM TO GO DO SOME THINGS THAT ARE VERY EXCITING FOR THEM.

AND THEN FINALLY, THERE WAS A TRIAL THAT ENDED LAST WEEK, I JUST WANT TO SAY TO OUR POLICE OFFICES AND PUBLIC SAFETY LEADERSHIP, THANK YOU FOR BEING GREAT LEADERS, THANK YOU FOR NEVER GIVING UP, THANK YOU FOR PURSUING JUSTICE TO THE VERY END.

THAT WAS DIFFICULT FOR ALL OF US TO RECALL, AND GO BACK THROUGH. BUT I APPRECIATE THAT WE NEVER

[00:10:04]

GAVE UP, AND WE BOUGHT SOME CLOSURE TO THE FAMILY PRESENT THANK YOU BELT TO YOU AND YOUR OFFICERS. ALRIGHT ANYONE ELSE HAVE AN ANNOUNCEMENT TONIGHT?

>> MAY OR IF I MAY ADD SOME NEWS THAT I WANT TO SAY HOW MUCH I APPRECIATE DIRECTOR REGISTER.

GOING TO MAKE IT HAPPEN. >> YES THANK YOU MR. MAYOR, A ONE ANNOUNCEMENT, THE ALABAMA LEAGUE OF MUNICIPALITIES PUTS OUT A MONTHLY MAGAZINE, AND I HIGHLY ENCOURAGE YOU TO READ IT.

TO TAKE A LOOK AT IT HAS AN EXTENSIVE PRESENTATION AND THERE, ABOUT MIRRORS ACROSS THE STATE OF ALABAMA. VARIOUS COMMUNITIES AND HAD A LOT OF EXAMPLES OF THINGS.

I'M SURE IT IS AVAILABLE ONLINE, SEE ALABAMA LEGAL MISSPELLINGS. ALSO TO THE PUBLIC LIBRARY, BUT IF YOU ARE INTERESTED IN THAT I HIGHLY COMMEND YOU TO TAKE A LOOK AT THAT.

AND THE OTHER ONE IS NOT AN ANNOUNCEMENT AS IT IS AN ACKNOWLEDGMENT, AND I LIKE TO THANK THE CITY COUNCIL AND STAFF, THE PROCESS FOR SELECTION OF PLANNING COMMISSION MEMBERS, AND BOARD OF EDUCATION BOARD MEMBERS. HAS BEEN PUT TO THE TEST OVER THE LAST MONTH. WHERE WE ADD SIGNIFICANT NUMBER OF FANTASTIC CANDIDATES WITH THE INTERVIEW PROCESS. AND ALLOWED US TO MAKE BETTER JUDGMENTS ON JUST WHAT IT IS WE NEED TO DO, AND I THINK THAT IS A PROCESS THAT THE COUNCIL HAS PUT IN PLACE OVER THE LAST SEVERAL YEARS, THAT IS REALLY COME TO FRUITION. SO I JUST LIKE TO ACKNOWLEDGE

THAT. THANK YOU ALL. >> THANK YOU.

ANYONE ELSE? OKAY, REAL QUICK. >> I JUST WANT TO ECHO WHAT YOU SAID ABOUT THE EASTER EGG. SPEAKING OF A FATHER OF THREE WE HAD A FANTASTIC TIME, THE OLDEST DAUGHTER DID WANT TO SAY THANK YOU AND SHE THOUGHT IT WAS THE NEATEST THING THAT THE CITY HAS THE PEOPLE TO BRING THE EASTER BUNNY. IT WAS A REALLY GREAT EVENT, AND WE ARE CONCERNED ABOUT THE WEATHER. AND WE HAD AN OPPORTUNITY AND

THEY MEET EASTER BETTER FOR SO THANK YOU VERY MUCH. >> OKAY, AUBURN UNIVERSITY

[5. AUBURN UNIVERSITY COMMUNICATIONS]

COMMUNICATIONS. >> HELLO, HELLO, FOR THOSE WHO DON'T REMEMBER ME MY NAME IS OLIVIA SUTHERLAND I WAS SERVE AS THIS YEAR'S DIRECTOR OF CITY RELATIONS FOR EDGE GA, SO I LOOK FORWARD TO A GREAT YEAR I REPLACED ANNA SHE DID A GREAT JOB.

BUT I AM SORRY IN ADVANCE FOR ANY BAD JOBS MHL OVER THE COURSE OF THE YEAR.

BUT YOU WILL GET USED TO IT I PROMISE. SO TO START US OFF, I WANT TO THANK YOU SO MUCH AGAIN FOR ANOTHER FANTASTIC CITY PREFACED WITH THE BEAR IN THE CITY MANAGER AND OF THE CITY STAFF. IT WAS VERY SUCCESSFUL AS ALWAYS AND WE ARE REALLY LOOKING FORWARD TO CONTINUING THAT OVER THE SUMMER. ALSO, AS HE KIND OF MENTION, OUT ON THE LAWN IS THIS THURSDAY FROM 11-1 ON THE HALEY CONGRESS. IT IS REALLY WRONG ON THE CON.

I AM LOOKING FOR A PATCH OF GRASS TO PUT YOU ON FOR THE SAKE OF ACCURACY BUT WE WILL SEE HOW WILL BE WITH THAT. WE ARE EXCITED AND WE ARE EXPECTING A BIG JOURNAL FOR THAT EVENT. ALSO, MEMBERS OF SGA THIS MORNING, AND HELP TO DISTRIBUTE MARKETING MATERIALS FOR AU TEN TODAY. THAT IS OUR INITIATIVE TO GIVE STUDENTS A 10% DISCOUNT AT PARTICIPATING THIS IS FOR SHOWING THAT TIRE CARS.

SO THAT WE GOT SOME POSTERS AND OTHER MARKETING MATERIAL OUT THERE TODAY AND WE ARE EXCITED PROMOTING THAT. ALSO GYMNASTICS MADE IT TO THE FINAL FOUR AND THE NCAA CHAMPION SHIP THIS WEEKEND AND THAT WAS THE HIGHEST PLACEMENT IN PROGRAM HISTORY.

SOME WERE VERY EXCITED ABOUT THE CEILING FOR THAT. ALSO, AUBURN HAS IS FIRST TRUMAN'S CALL THAT THE TRUMAN SCHOLARSHIP IS VERY PRESTIGIOUS IT IS FEDERALLY FUNDED.

AND IT IS FOR STUDENTS WHO ARE DEDICATED TO PURSUING CAREERS IN PUBLIC SERVICE LEADERSHIP.

FIFTY-EIGHT STUDENTS WERE SELECTED NATIONALLY, AND WE HAVE ONE OF THEM, HIS NAME IS ALAN LEE WE ARE PART OF HIM, AND HE HAPPENS TO BE ONE OF MY CLOSEST FRIENDS SO I HOPE HE RUBS OFF ON ME WHEN HE GETS FROM ALL HIS EVENTS. ALSO, JUST FINALLY WE HAVE THE OFFICE OF INCLUSION AND DIVERSITY OF HOSTING A INAUGURAL STATE OF INCLUSION AND DIVERSITY EVENT ON THURSDAY. IT WAS FOCUSED ON HIGHLIGHTING THE STEPS THAT AUBURN HAS TAKEN TO MAKE AUBURN'S CAMPUS MORE DIVERSE AND EQUITABLE AND INCLUSIVE'S OVER THE PAST COUPLE OF YEARS. AND ON THE GOALS THAT THEY ARE TAKING TO CONTINUE THE PROGRESS WITH THAT. WE ARE EXCITED ABOUT WHERE THAT GOES AS WELL AND THANK YOU.

>> THANK YOU OLIVIA, WE TALKED ABOUT THIS, THIS IS GOING BE SO ONLY PEOPLE THAT THERE'S NO REAL

REASON FOR THE COUNSELOR COME THURSDAY RIGHT? >> I THINK THEY COULD.

>> WILL THEY NEED TEACHERS. >> I DON'T KNOW ABOUT THAT MA MAYBE?

>> ANYONE ELSE? >> ITEM EIGHT, D. >> A.D.?

[8.c.1 Alabama Power Company. Relocation and installation of street lighting along Wire Road at the Soccer Complex roundabout. $64,592.07. ]

>> YES. >> ALL RIGHT ITEM 8C1 IS A CONTRACT FOR THE ALABAMA POWER CAN BE FOR THE RELOCATION INSTALLATION OF STREET LIGHTING ALONG WIRE ROAD AT THE SOCCER

COMPLEX ROUND ABOUT. AT THE AMOUNT OF $64,592.77. >> A MOTION IN A SECOND I WILL

TURN IT OVER TO. >> I JUST WANT TO SAY I THINK THIS IS A GOOD THING FOR WIRE ROAD, AND THAT AREA THERE. IT SHOULD HAVE FOLKS COMING OUT ITS LOWER TRAFFIC, THE ONLY THING THAT I WOULD ASK IS THAT YOU NOT TAKE AS LONG AS THE UNWANTED.

>> THE LIGHTING ON THE ROUNDABOUT, IS UNDER A DIFFERENT CONTRACT, THE LIGHTING I THINK WILL BE RELATIVELY FAST. IN TERMS OF THE ROUNDABOUT IS THAT IS ACTUALLY WROTE INTO THE CONTRACT OF THE CUT SOCCER COMPLEX. SO IT WOULD BE HARD TO ADD

ADDITIONAL CAPACITY TO THE COMPLEX AND NOT HAVE THAT READY. >> I'LL PROBABLY GET STRUNG UP

IF IT TAKES LONGER THAN THAT. >> I HEAR YOU LOUD AND CLEAR, AND CITY ENGINEER FRASER KNOWS THAT THAT PROJECTS FROM YOU, TO ME, TO HER. [LAUGHTER]

HAVING BEEN HIT WITH A TASER BEFORE THEY DO THE JOB. I ASSURE YOU OF THAT.

I JUST APPRECIATE THE LEADERSHIP, AND I'M HAPPY THE CITY COUNCIL WILL PASS THIS WITH NO PROBLEM. AND IT SHOWS WE SUPPORT OUR SUBLEASED ENEMIES OFF OF THE.

>> ANY OTHER COMMENTS FROM COUNSEL? I CERTAINLY AGREE WITH YOU TOMMY. SUPPORT OUR MEN AND WOMEN PROTECT US IS VITAL AND

[8.c.7 Stone Building, LLC. New Environmental Services & Public Works Facility. $27,294,225.00. ]

IMPORTANT. ALL RIGHT ALL IN FAVORS PLEASE SAY I.

>> CALLED FOR ENVIRONMENT TO SERVICE BY THE WORDS COMPLEX TO BE LOCATED IN WIRE ROAD IN THE INTERSECTION A BEEHIVE ROW. IT AWARDED TWO STONE BUILDING LLC AND THE AMOUNT OF

$27,294,225. >> MOVE FOR APPROVAL. >> SECOND PERIOD.

[00:20:01]

>> MOTION AND SECOND 2,000? >> I WANT TO SAY HOW MUCH IS NEEDED COST A LOT OF MONEY AND BROUGHT A FORWARD AND CITIZENS KNOW WHAT WE SPENT IT ON. BUT I SEE SOME OF THOSE FOLKS IN THE BACKPACK THAT I'VE KNOWN FOR A LONG TIME. AND THIS IS A LONG TIME COMING, I AM JUST PROUD I CAN BE A PART OF IT. AND GET YOU BUILDING I KNOW THE CITY IS SHOT FOR ONE, IT'S ALWAYS BEEN FOR LESS 35 YEARS. A MAN NAME MR. BILL PLUMMER RUN THAT SHOP. AND I INTERESTED IN THE YOUNG ROOKIE POLICE OFFICER RUN OVER A DEAD ANIMAL. HE PULLED INTO THE PAY. I ALMOST GOT RUN OUT BEFORE I GOT STARTED. I'M VERY HAPPY TO SEE THIS GOING FORWARD, AND I KNOW YOU ALL

ENJOY THE BENEFIT AND GET A BEAT UP. >> THANK YOU.

>> THANKS CHIEF GREAT STORY. ANYBODY ELSE IN THE COUNCIL? >> SO IS THIS FOR THE WHOLE

PROJECT? IS THIS THE RELOCATE. >> IT RELOCATES SO BOTH ENVIRONMENTAL SERVICES DEPARTMENT WHICH INCLUDES FLEET SERVICES WHICH IS ACROSS FROM WHERE THEY SIT NOW AND THE ENTIRE PUBLIC WORKS DEPARTMENT, WE WERE ABLE TO TAKE A NUMBER OF ALTERNATE SO WE CAN PROTECT OUR EQUIPMENT WITH POLE BARNS, WE ARE CONCRETING ON THE MAIN DRIVEWAY AREAS BECAUSE OF ALL OUR TRUCKS AND HEAVY DUMP TRUCKS AND ALL KINDS OF THINGS TRAVERSE THE AREA. AND THIS IS ADEQUATE SPACE WE ARE ALSO ADDITIONAL BAYS TO FLEET SERVICES. OVER AND ABOVE WHERE WE ARE TO ALLOW THE MECHANIC WHO IS WAITING ON A PART WHICH IS PRETTY COMMON THESE DAYS. TO GO TO ANOTHER BAY WITH ANOTHER VEHICLE, AND HOPEFULLY GET THAT VEHICLE BACK IN SERVICE EVEN SOONER.

SO IT IS DOING WHAT WE NEEDED TO CHIEF DAWSON COMMENT I HAVE A LOT OF STAFF MEMBERS THAT HAVE BEEN WORKING ON THE UNDERSIDE FACILITIES FOR A LONG TIME AND IF WE SERVICES HAS BEEN SINCE WE BUILT THIS BUILDING, AS BEEN POLICE'S WAY OF DESERVE. SAID THEY HAVE BEEN IN THE TOUGHEST CONDITIONS AND I HAVE LOOK FORWARD TO THE DAY THAT WE CAN'T MOVE THEM INTO MUCH BETTER CONDITIONS AND MAINTAIN A MASSIVE FLEET AND DO IT WITH A SMILE ON THEIR FACE IN SERVICE THE ENTIRE CITY STAFF. WITH ALL OF THAT THEY DO AND ALL THAT WE NEED TO KEEP THINGS MOVING IN SERVICE AND CITIZENS. THIS IS AN EXCITING DAY FOR US WILL I LOOK FORWARD TO INVITING BOTH DEPARTMENTS OUT AND THEN ALL OF THE MEMBER THOSE DEPARTMENTS BEFORE WE GET MOVING SO CAN GET THEIR OWN BIT OF DIRT IT'S A LONG TIME COMING AND I AM PROUD THAT WE ARE HERE RIGHT

NOW. >> IS EXCITING FOR THOSE DEPARTMENTS AND UPDATES ARE NEEDED, IS ALSO REPRESENTATIVE OF THE FIRST DOMINO IN A CITY OF UPGRADES AND ADDITIONS AND CHANGES TO THE CITY THAT WE HAVE BEEN TALKING ABOUT, AND ANTICIPATING FOR A FEW YEARS, SO I CERTAINLY WANT TO CELEBRATE FLEET SERVICES AND'S AND ALL OF THEIR UPGRADES.

I DO WANT TO POINT OUT AND CELEBRATE THE REPRESENTATION OF YOU KNOW THE NEXT STEP IN

SEVERAL FACILITY UPGRADES AND CHANGES. >> ABSOLUTELY WE HAVE A LOT OF EXCITING PROJECTS SLATED FOR WHAT WE CALL THE BOYKIN DONAHUE CAMPUS MOVING UP.

AND WITH THE RELOCATION OF PUBLIC WORKS AND ENVIRONMENTAL SERVICE WE ALSO HAVE A FEELING PEOPLE THERE. DON'T WORRY WE ARE NOT GOING TAKE RECYCLING AWAY WE JUST CAN MOVE ACROSS THE STREET. THIS WILL ENABLE US TO BEGIN A MASSIVE PROJECT AT THE COMMUNITY SCENTED THAT WE WILL TALK ABOUT IN THE MONTH OF JUNE. DURING THE BUDGET PROCESS.

YOU APPROVED A NUMBER OF DESIGN CONTRACTS AND WOULD GETTING TO POINT WITH BE ABLE TO MAKE BETTER RECOMMENDATIONS. ABOUT WHICH PART OF THAT PROJECT IF NOT ALL OF IT MOVE FORWARD, AND REMIND EVERYONE I WILL CLUED INDONESIAN WITH TWO BASKETBALL COURTS, FULL FITNESS FACILITY, MEETING EXERCISE ROOMS, POTENTIALLY A SPLASH PAD, BRANCH LIBRARY, AND ONE OF THE MOST IMPORTANT THINGS THAT WE EMBARKED ON IN THIS JOURNEY IS THE AUBURN CULTURAL CENTER.

AND IT WILL BE A CULTURAL CENTER TO CELEBRATE OUR BLACK AND AFRICAN-AMERICAN HERITAGE WITHIN OUR BEEN. AND THAT IS THE MAIN FOCUS OF THAT.

AND IN SPECIFICALLY THAT NEIGHBORHOOD. SO IF THAT IS A PIECE THAT IS NOT LIVABLE IN THE FIRST PHASE, BUT WE WERE GOING TO SEE WHERE NUMBERS COME DOWN, AND WE WILL

TALK ABOUT THAT IN THE BUDGET PROCESS. >> SO THE EXCITING THINGS WE GET GREAT EMPLOYEES WHO HAVE ENDURED A DIFFICULT FACILITY TO WORKING FOR MANY YEARS, AND WE ARE PROUD TO GIVE THEM A BETTER PLACE TO WORK. THE PRACTICAL SIDE AS WE GROW SO MUCH AS A CITY WE MEET MORE SPACE TO WORK IN SO THIS WILL SOLVE THAT AS WELL.

BUT WHAT IS ALSO AWESOME, WE WILL REPLACE IT AND WILL BE ABLE TO ROOM IMAGINE WITH THE BOYKIN CAMPUS WILL LOOK LIKE AND THAT WILL BE GREAT FOR ALL OF US. THERE IS A LOT OF WAYS TO LOOK AT THIS PROJECT AND THE WHOLE COMMUNITY WILL BENEFIT GREATLY FROM IT.

>> THIS CONTRACT, IT SAYS TO COMPLETE IT, TO COMPLETE THE NEW ENVIRONMENTAL SERVICES AND PUBLIC WORKS FACILITY. SO WE HAVE ALWAYS DONE ALL OF DESIGN CONTRACTS, SO THIS IS

[00:25:01]

GREAT. IT IS REALLY GOOD. WHAT SHOULD WE ANTICIPATE IN THE FUTURE IN TERMS OF OTHER CONTRACTS, TO SUPPORT THE NEW FACILITY.

WE'RE TALKING ABOUT LIGHTING? >> THE MAIN THING THAT YOU WILL TALK ABOUT AND YOU WILL SEE IN THE BUDGETING PROCESS, WE HAVE EQUIPMENT AND FURNISHINGS TO GO. IT REALLY IS, SO YOU WILL SEE MAINLY IN THE ENVIRONMENTAL SERVICE AROUND FOR FLEET, WE HAVE A NUMBER OF THINGS THAT HAVE TO GO INTO THE BUILDING THAT ARE NOT ON THE BASE CONSTRUCTION CONTRACT.

AND THAT IS ALONG THE LINES OF ROUGHLY $1 MILLION. AND MY STAFF IS LOOKING AT ME TOO MAKE SURE OF THAT. AND THAT WILL COME IN AND THE BUDGETING PROCESS, AND THAT HAS NEVER BEEN PART OF BUILDING THIS INTO THE BASE PRICING, THIS IS THE CONSTRUCTION ONLY OF THE FACILITY, THE ONLY OF THE EQUIPMENT AND PREFERREDS THAT WE DON'T MOVE, WHICH I'LL BE HAPPY TO CHILL YOU THROUGH THE FANTASTIC FURNITURE THAT WE HAVE.

I ANTICIPATE SOME ADDITIONAL FURNISHINGS BUT WE WILL CAPTURE THAT INCOME TALK ABOUT THAT IN

JUNE AND YOU WILL SEE THAT CAPITAL OUTLAY. >> COMPACTORS AND SPECIALIZED

EQUIPMENT? >> LIKE A TRASH COMPACTOR? >> THAT'S WHAT I'M ASKING.

>> I DON'T ANTICIPATE THAT OUT THERE AT ALL. WE WILL DEFINITELY HAVE SOME THINGS THAT WE SERVICE AND TAKE TO THE LANDFILL. WE WILL HAVE TRASH AND GARBAGE.

NO WE ARE NOT ANTICIPATED THAT UNLESS I AM MISSING SOMETHING KATRINA, ALLISON, OR DAN? YES, THAT IS IT. YOU WILL SEE THAT IN CAPITAL OUTLAY IN THE BUDGET WHEN WE

WILL TALK TO YOU ABOUT THAT JUNE. >> OKAY SO WE WILL KNOW INJURED

WITH THE SEXUAL MILLION DOLLARS. >> YES THE EXTRA MILLION DOLLARS IS A LOT OF EQUIPMENT THAT KATRINA CAN GIVE YOU A QUICK PREVIEW IF YOU ARE INTERESTED OTHERWISE WE CAN TALK ABOUT IN

JUNE. >> WE COULD TALK ABOUT LATER THAT'S FINE I JUST WANT TO WILL CAPTURES THAT. JUST ANTICIPATE ADDITIONAL REQUESTS.

>> YES, IT SHOULD NOT BE FOR ANYTHING CONSTRUCTION RELATED OTHER THAN THAT AND SO, AND THE OTHER THING IS THAT A BUILDING CONTRACTOR IS THE SAME CONTRACTOR.

THIS IS A BIG PROJECT WE HAD A PARKING DECK WHERE WE DID NOT HAVE CHANGE ORDERS AND ISSUED

THE CONTRACTOR. >> THANK YOU. >> OKAY ANY OTHER COMMENTS?

>> DO WE HAVE A MOTION SECOND ALL IN FAVOR PLEASE SAY AYE. >>

>> MOTION CARRIES. >> WE WILL CALL IT HENRY FARMS LANE, THAT WAS IN THE ARBOR AND

I APOLOGIZE IF I PUT YOUR NAME I ITEM 1086 ON BEHALF OF ROBERT PATTON ROAD SERVICE USE FAST FOOD RESTAURANT WOULD DRIVE THROUGH FOR CHIPOLTE. CURRENTLY LOCATED AT 346 WEST MAGNOLIA AVENUE IN THE URBAN NEIGHBORHOOD WEST ZONING DISTRICT. PLANNING COMMISSION RECOMMENDS APPROVAL BY A VOTE OF 7-2, AND IS APRIL 14 MEETING.

PUBLIC HEARING IS REQUIRED. >> GO FOR APPROVAL.

>> SECOND PERIOD. >> I HAVE A MOTION IN THE SECOND IS OPEN TO PUBLIC HEARING IF YOU LIKE TO ADDRESS THE COUNCIL THE MESSAGE COME FORWARD AND GIVES YOU NAME AND ADDRESS FOR THE

RECORD. >> MAYOR I WOULD LIKE TO ADD CITY COUNCIL OPERATES DIFFERENT THE PLANNING COMMISSION IF THE APPLICANT IS GOING TO SPEAK UNLESS YOU HAVE QUESTIONS FOR THEM THIS IS THE ONLY TIME TO DO IT.

>> ALL RIGHT SO IF THE APPLICANT WOULD LIKE TO SPEAK, TO THE COUNCIL THIS BE THE TIME TO DO THAT.

OKAY ANYBODY ELSE? WILL CLOSE PUBLIC HEARING.

ANY COMMENTS OR QUESTIONS I WILL LET YOU GO FIRST MR. GRISWOLD.

>> THANK YOU, LET ME REITERATE WHAT I SAID EARLIER, INADVERTENTLY. I AM CONCERNED ABOUT THE ADDITIONAL TRAFFIC IN THE ROAD SERVICE USE AND THE DRIVE TO TYPE ACTIVITY. THAT WOULD GENERATE A LONG MAGNOLIA. SO THAT IS CERTAINLY CONCERT I'M NOT SURE WITH A 7-TO VOTE WAS, PREDICATED ON, CAN YOU COMMENT ON WHAT THE TWO VOTES WERE? THAT GENERATED SOON A VOTES?

>> I BELIEVE THAT WAS SOME OF THE SHARE CONCERNS THAT YOU MENTIONED THERE WERE CONCERNED ABOUT THE DRIVE-THROUGH SO WE HAD SOME DISCUSSION AROUND FULL-FLEDGED MENU BOARD, VERSUS

A PICKUP WINDOW WE ORDER ONLINE. >> OKAY I VOICE MY CONCERNS.

>> YOU DID IT TWICE TOO. >> THAT'S RIGHT.

>> SO MAKING THE CLARIFICATION THIS IS A PICKUP WINDOW THERE BE NO BOX THERE WE GO UP IN ORDER THANK YOU UP.

>> THIS CANNOT BE FOUNDED OR TEXTED AND WERE PINCHED.

>> THROUGH THE APP IT WOULD HAVE IT IS THE FORM ARBY'S BEFORE CHIPOLTE CONVERTED AND THEY REMOVE THE DRIVE-THROUGH WINDOW THAT IS ACTUALLY A WINDOW WITH A SET TO A T'S AND OTHER THINGS RIGHT NOW AND THEY ARE ASKING TO REINSTALL IT.

ONE THING THAT HAS HAPPENED IN THE NUMBER OF BUSINESSES, IS MOBILE ORDERING IS THE SAYING, ESPECIALLY WERE COVID-19, AND SO WE SEE THIS AND WE SEE AT MOBILE GROCERIES AND OTHER THING IS NOT CHRIST TO GET GROCERIES BUT YES, THIS IS DOING THAT.

ONE OF THE CHALLENGES THAT WE HAVE AT THIS SITE ANYWAYS IS TRAFFIC INCOMING ON THE SITE AND PARKING AND PICKING UP THINGS AND LEAVING. SAME IDEA.

SO IT IS UNIQUE. >> SO THIS IS HAPPENING ALREADY

WITH MOBILE ORDERS. >> THEY HAVE A ROBUST MOBILE ORDERING BUT THERE ARE SO A LOT OF PEDESTRIANS THAT COME IN AND WALK THROUGHOUT THE NEIGHBORHOOD.

>> ALL RIGHT ANY OTHER COMMENTS OR QUESTIONS FROM COUNSEL.

>> DOES A CITY HAVE ANY CONCERNS ABOUT THE TRAFFIC IN THE AREA?

HAVE YOU LOOKED AT IT? >> I HAVE NOT WITNESSED ALL OF

[00:45:02]

THE CITY ENGINEER FRASER TO REFER TO IT.

WE HAVE NOT WITNESSED IT, AND I'D FREQUENTLY TRAVERSE THE AREA, AND THE AREA SINCE A NEW CHICK-FIL-A DRIVE-THROUGH HAS OPEN. WE HAVE TRAFFIC ON MAGNOLIA THAT CANNOT SAY IT IS CAUSED BY THE TRAFFIC BACKED UP ON MAGNOLIA IT TENDS TO BE CAUSED BY CLASS CHANGE TIME AS OPPOSED TO ANYTHING ELSE. BUT CITY FRAZIER HAD COMPLAINTS ABOUT TRAFFIC FROM CHIPOLTE OR THE VICINITY.

>> NO WE HAVE NOT. >> I WAS GOING TO ASK A SIMILAR QUESTION ABOUT THE IDEA OF PLANNING THE INCREASED DENSITY AND THE ENCOURAGEMENT OF WALK ABILITY IN OUR DOWNTOWN, IS IT, DO YOU COME ACROSS THIS WHAT APPEARS TO BE SOME KIND OF CONFLICT IN THE WAY PEOPLE MOVE WITHIN THE DENSE AREA THE DENSELY POPULATED AREA. COULD YOU SPEAK TO THE IDEA THAT THE DRIVE THROUGH, I KNOW I HAVE BEEN THROUGH THE DRIVE-THROUGH AT THE CHICK-FIL-A. IT IS A LITTLE INTERESTING NEGOTIATING THE SIDEWALK AS YOU COME UP TO MAGNOLIA.

BECAUSE THERE ARE SO MANY FOOT TRAFFIC THERE NOW.

I WONDER IF YOU CAN SPEAK TO THAT PERCEIVED CONFLICT THEY ARE, OF THE VEHICULAR TRAFFIC THAT IN CURRENT MINGLING WITH

THE PEDESTRIAN. >> WE LOOKED AT THE FACT THAT THIS IS, AT WAS RV BEFORE IT HAD A FULL-FLEDGED DRIVE-THROUGH IN THE PAST, COURSE WAS A DIFFERENT DAY AND TIME.

BUT WE ALSO, A LOT OF THINGS TRY TO DISCOURAGE DRIVE-THROUGH IN DOWNTOWN, A FACT OF THE MATTER IS WE ARE ALL IN CARS ALL DAY.

AND SO, IF THIS HAD BEEN A MENU BOARD OPERATED PROPOSAL, I THINK WE MIGHT LOOK AT THAT A LITTLE DIFFERENTLY, BECAUSE I THINK CARSTEN TO BACK UP A LITTLE BIT MORE WHEN YOU HAVE TO PULL UP AND THINK ABOUT WHAT YOU WANT AND AS THE KIDS WHAT THEY WANT AND LSI. IT CAN EXPECT THIS TO BE A LITTLE QUICKER, WE EXPECTED NOT TO PRESENT A PROBLEM COMES BECAUSE OF THE TYPE OF RESTAURANT THAT IT IS OPPOSED TO A CHICK-FIL-A OR SOMETHING OF THAT NATURE.

AND, I DO NOT KNOW IT WOULD INCREASE THE NUMBER OF CARS COMING OUT ALREADY THE EXISTING DRIVEWAYS ARE NOT CHANGING.

SO AT THE SITE IS REMAINING SUBSTANTIALLY THE SAME WITH THE EXCEPTION OF 252 SQUARE FOOT ADDITION FOR THE ACTUAL WINDOW WHERE YOU RECEIVE ORDER. I WOULD SAY ONE OTHER THING CONDITIONS RECOMMENDED BY STAFF AND THE COMMISSION, ONE OF THOSE WAS SURE THE RESTAURANT EVER WANT TO GO TO A FULL-FLEDGED ORDERING BOARD THIS PREVENTS THAT FROM HOPSCOTCH INTO

SOMETHING DIFFERENT. >> ONE OTHER QUESTION, IS THERE ANY MARKED INCREASE IN VEHICULAR ACCIDENTS VEHICLES VERSUS PEDESTRIANS AND SO ON IN THIS AREA SINCE THE ADVENT OF

CHICK-FIL-A? >> WE ARE BOTH SHAKING OUR HEADS WE DON'T THINK SO. WE DON'T KNOW.

>> I WOULD SAY WHILE WE HAVE NOT SEEN THAT, WE CAN ATTEST TO THAT WE SPEND A LOT OF MEETINGS AT THE SGA TALKING ABOUT ROBUST PEDESTRIAN ACTIVITY RIGHT AT CROSSWALK 320 MAGNOLIA.

WE HAVE RECEIVED COMPLAINTS AND I HAVE FROM SOME OF YOU THAT YOU HAVE HEARD FROM CONSTITUENTS WITH FRUSTRATIONS OF CONVERSING THE AREA AGAIN A CLASS CHANGE TIME, I THINK IT IS SEVEN OR SO CROSSWALKS IN A STRETCH. SO MY RECOMMENDATION IS DON'T DRIVE THAT WAY. WE ARE LOOKING AND CONSTANTLY WORKING WITH THE SGA AND BOUNCING IDEAS AROUND BETTER WAYS TO MANAGE THE 320 MAGNOLIA CROSSWALK BECAUSE WHILE WE LOVE PEDESTRIANS THAT IS A FREE-FOR-ALL WALKING ACROSS THE STREET WHENEVER YOU FEEL LIKE IT AND YIELD TO NO ONE, SO WE ARE WORKING ON THAT WE WOULD TALK WITH PUBLIC SAFETY WE DON'T WANT IS PEOPLE HIT, WE ARE NOT SEEING THAT WE ARE MAKING IMPROVEMENTS ON THAT AND THE NICE THING ABOUT 320 MAGNOLIA IS, THERE IS LIGHT AND VISIBILITY IN THAT AREA IN THE EVENING AND NIGHT HOURS,.

>> WHICH IS A SIGNIFICANT IMPROVEMENT.

>> WE'VE ALSO WORKED TANGIBLY AND AT A PEDESTRIAN LIGHTS IN THE VICINITY TO MAKE IT EASIER ON PEDESTRIANS TO BE SEEN.

>> ANY OF THE COMMONS? >> I WAS JUST GOING TO SAY I FREQUENT THIS RESTAURANT. QUITE REGULARLY, AND I THINK THAT IT WILL BE A GREAT IMPROVEMENT TO THE AREA.

BECAUSE WHEN YOU GO THAT AND DURING THE ASSIGNMENT IN TIME THERE IS A LOT OF PARKING, AND CARS ARE WRAPPED AROUND THE PLACE I THINK THIS WILL HELP WITH THE FLOW, BECAUSE A LOT OF PEOPLE, IT IS A ONE LINE THING AND WILL OPEN UP TWO LANES OR TWO WAYS TO PICK UP FOOD, AND I THINK THINGS WILL BE A LOT CLEANER AND BE A LOT EASIER FOR PEOPLE TO GET THEIR FOOD.

>> ANY OTHER COMMENTS? OKAY, WE HAVE A MOTION IN A

[00:50:01]

SECOND ALL IN FAVOR PLEASE SAY AYE.

>> I THINK THERE ARE TWO KELLY BOB IS THAT CORRECT?

>> ALL RIGHT ITEM 1087 HAS BEEN WITHDRAWN OUT OF 1088 IS AGGRESSIVELY STOP ON BEHALF OF PHYLLIS AND THE PARTNERSHIP LIMITED INCREASE GLP FOR CONDITIONAL USE OF SUPPORT USED DISTRIBUTION FACILITY FOR PROPERTY LOCATED AT 511 WEST VETERANS BOULEVARD AND COPPERHEADS OF DEVELOPMENT DISTRICT. THE PLANNING COMMISSION RECOMMENDS APPROVAL AT THE 14TH MEETING A PUBLIC HEARING

IS REQUIRED. >> MOVE FOR APPROVAL.

>> SECOND. >> I HAVE A MOTION IN THE SECOND IF YOU WOULD LIKE TO ADDRESS THE COUNCIL COME FORWARD AND GIVE

NAME AND ADDRESS FOR THE RECORD. >> WILL CLOSE THE PUBLIC HEARING ANY COMMENTS OR QUESTIONS FROM COUNSEL?

>> OKAY ALL IN FAVOR PLEASE SAY AYE.

>> AYE. >> ANY OPPOSED?

MOTION CARRIES. >> ITEM 10B1 LOCATED AT 1407 REYNOLDS DRIVE. THE PUBLIC HEARING IS REQUIRED.

>> MOVE FOR APPROVAL. >> SECOND PERIOD.

>> MOTION IN SECOND, WILL MOVE TO PUBLIC HEARING IF YOU LIKE TO ADDRESS THE COUNCIL COME FORWARD THE IN ADDRESS FOR THE COUNCIL.

>> CITY COUNCIL RATHER THE CITY HAS A PROBLEM WITH AND HAS TO AND ACT THE PROPERTY OWNER ABOUT SO I AM TRYING TO UNDERSTAND, THE POTENTIAL IMPACT OF RELINQUISHING THAT EASEMENT TO SOMEONE, WHAT ARE THE PLANS FOR THAT AND HOW MIGHT THAT AFFECT DRAINAGE FOR THE FIRST PROPERTY THAT IS ABUTTING AGAINST IT.

>> DO YOU WANT TO ALL THE QUESTIONS AND THEN WILL ANSWER?

>> WAS A PRIMARY QUESTION YOU HAD WHAT WAS THE FIRST QUESTION

YOU READ? >> JUST TO CLARIFY WHETHER IT IS

THE ENTIRE CROSSHATCH? >> YES CITY ENGINEER FRAZIER COULD YOU PLEASE RESPOND TO WHY THEY'RE REQUESTING A VACATION OF

THE EASEMENT? >> AS SO AS PART OF THE PROCESS WHEN WE RECEIVE A REQUEST WE ROUTED TO CITY DEPARTMENTS TO MAKE SURE THERE ARE NO ISSUES FROM THAT CITY PERSPECTIVE IF EASEMENTS WERE TO BE VACATED. TO MY KNOWLEDGE THERE IS NO THAT WOULD REQUIRE US TO MAINTAIN IT. BUT THE DEVELOPER IS PRESENT IF WE NEED TO ASK THEM SPECIFIC QUESTIONS.

>> DOES THAT GIVE YOU THE ANSWER YOU LOOKING FOR?

>> ARE THEY PRESENT? >> I BELIEVE SO YES.

>> WANTED TO ASK THAT THE ANSWER.

>> THAT IS WITH THE RELINQUISHMENT OF THE EASEMENT, BLOCK FUTURE INSTALLATIONS OF BURIED FIBER UTILITIES? ALONG THE SAME PATH AS THE CURRENT PERRY UTILITIES?

>> THERE ARE NOT UTILITIES IN THIS EASEMENT CURRENTLY.

NOT CITY NO PRIVATE IS THAT CORRECT?

>> NOT CITY. THERE ARE PRIVATE EASEMENTS THAT RUN. EVEN ALABAMA POWER THAT RUN BETWEEN THE PROPERTY OWNER AND THE POWER.

WE CANNOT SPEAK TO BUT THEY ARE IN THE CITY EASEMENT.

WILL BE UP TO THE LANDOWNER AS WELL IS DIFFERENT UTILITY COMPANIES HAVE DIFFERENT RIGHTS OF CONDEMNATION.

IF THEY CANNOT ACHIEVE THE EASEMENTS THAT THEY WISH.

SO IT IS NOT A QUESTION WE CAN DIRECTLY ANSWER ABOUT THE

PRIVATE SIDE. >> SO WE KNOW WE HAVE NO CITY

UTILITIES THERE. >> WE DON'T KNOW.

[00:55:09]

THAT WHOLE NEIGHBORHOOD IS SERVED BY UNDERGROUND POWER UNDERGROUND COPPER, UNDERGROUND CO- X, AND I THINK THAT IS IT.

FOR PRIVATE UTILITIES. SO, I DON'T KNOW WHETHER THAT FITS IN THE 50-FOOT ROADWAY EASEMENT OR WHETHER THAT IS

OUTSIDE THE ROADWAY EASEMENT. >> IT GETS CONFUSING AGAIN THOSE ARE PRIVATE EVEN IN THE RIGHT OF WAY IN THE STREET WHICH IS BEHIND THE CURVE THERE IS A LOT OF EASEMENT, NOTHING CHANGES ABOUT THAT AREA WE HAVE FRANCHISE AGREEMENTS AND OTHER THINGS WERE UTILITIES CAN SHARE THAT WITH US.

IN TERMS OF ANYTHING THAT WE ARE BANDING ON THIS PARTICULAR EASEMENT WE HAVE NO AWARENESS BEING SOMEBODY IN THERE IS THAT CORRECT CITY ENGINEER FRAZIER? SO PRIVATE THINGS WILL REMAIN UNCHANGED IF THERE ARE PRIVATE EASEMENTS GRANTED THIS IS UNAFFECTED BY THIS BUT ANYTHING ELSE IN THE PILOT OF BOOK RIGHT

AWAY REMAINS. >> WHO WOULD BE THIS THE OWNER WOULD HAVE THE RIGHT TO NEGOTIATE WITH ANY FEATURE?

>> RIGHT AND THEY MAY ALREADY HAVE PRIVATE EASEMENTS.

THAT ALREADY TRAVERSE IN THE PROPERTY THAT DOESN'T CHANGE

ANYTHING ABOUT THAT EITHER. >> OKAY ALL RIGHT.

MR. SELBY WAS THERE ANYTHING THAT YOU LIKE TO ADD TO THE

CONVERSATION? >> NO.

>> DOES THE COUNCIL HAVE ANY QUESTIONS FOR MR. SELBY? IS THERE ANY QUESTION THAT YOU WOULD LIKE TO HAVE MR. SELBY

ANSWER POTENTIALLY? >> I'M JUST TRYING TO UNDERSTAND

THE PLANS FOR THAT 1.12 ACRES. >> HOLD ON JUST ONE SECOND

PERIOD. >> IF YOU WOULD SIR, IF YOU CAN RETURN TO YOUR SEAT WILL HAVE MR. SALE COME FORWARD AND ANSWER THE QUESTION. MR. SELBY.

>> I HAVE NOT DEVELOPED ANY PLANS AS OF YET.

THIS WAS THE FIRST PART TO SEE IF I COULD GET IT ABANDONED AND THEN IT WILL BE SOMETHING RESIDENTIAL, BUT IT IS A SMALLER PARCEL WITH ALL OF THE SETBACKS, IT WILL BE SOME KIND OF LIKE

DENSITY. >> MR. SILVA DO YOU KNOW IF ANY PRIVATE UTILITIES ARE RUN THROUGH THEIR.

>> NOT THAT I AM AWARE OF. >> THANK YOU.

>> OKAY ANY OTHER QUESTIONS OR COMMENTS FROM THE COUNCIL?

>> DID YOU CLOSE A PUBLIC HEARING?

>> I DID THANK YOU. >> YES, SIR?

>> WE NEED A NAME AND ADDRESS FOR RECORD.

>> TO BE A FACT ON THAT MAYOR, I GAVE YOU A DOCUMENTATION, FROM WASHINGTON D.C. A BOOK THAT I DONATED.

>> OKAY ONE SECOND IS THIS ABOUT THIS RIGHT HERE THE ITEM THIS IS ABOUT TEN B1 ABOUT ABANDONING UTILITIES.

>> I WENT THROUGH A BANKRUPTCY IN 2017, IT HAS MULTI FAMILY UNDER MY CREDIT REPORT I TRIED TO GET IN THE DENMAN AM LIVING IN AN RV NOW. FROM EVERYTHING THAT WAS SAID SINCE I'VE BEEN BACK I WAS TOLD BY LEE COUNTY, THAT I WAS IN

JAIL IN 1999. >> DOES THIS RELATE TO THIS

TOPIC TO VACATION IN TRAINING. >> CITIZENS COMMUNICATIONS COME

AT THE END OF THE SENSOR. >> WE ARE SPECIFICALLY TALKING

ABOUT THIS IF SHE RIGHT NOW. >> I WAS FIXING TO GO BACK TO

THE OTHER SIDE. >> YOU'RE WELCOME TO GO BACK AND TALK TO US AT THE END OF THE MEANING.

>> ONCE YOU COME BACK WE CAN TALK ABOUT THAT.

>> SINCE THE PUBLIC HEARING IS STILL OPEN ANYWAY LIKE TO ADDRESS THE SITUATION? OKAY WILL CLOSE A PUBLIC HEARING. ANY COMMENTS OR QUESTIONS FROM THE COUNCIL? REGARDING THIS VACATION.

>> DID YOU SAY THE CITY STILL MAINTAINS THE RIGHT OF WAY ALONG

REYNOLDS DRIVE? >> THAT'S DEDICATED

RIGHT-OF-WAY. >> THE ACTUAL CROSSHATCHING DOESN'T COME ALL THE WAY TO THE STREET.

[01:00:09]

>> ANY TIME SHOW YOU RIGHT AWAY ACROSS THE STREET THAT'S NOT THE CURB LINE THE CURVE IS OFTEN INSIDE OF THAT.

SO, IT WILL LOOK LIKE GRASS TO SOMEBODY AND THEN SOME CURB.

>> ARE THERE ANY CONSEQUENCES OF DENYING THIS WHAT WOULD HAPPEN

IF WE GOT A MOTION. >> THE CITY WILL HAVE TO CONTINUE TO MAINTAIN THE EASEMENT.

SO THE THINGS THAT YOU HEARD ABOUT IF IT IS GOT TO BE MOWED IN ANY WAY SHAPE OR FORM THAT IS ON US.

>> IF THE DEVELOPER OF THE PROPERTY DOES NOT MAINTAIN IN A SATISFACTORY WAY, THEN THE PROPERTY OWNER TO SIGN IT CAN

MAKE YOUR COMPLAINT? >> A LEAD ABATEMENT.

WE CAN ADDRESS IT THROUGH THAT. >> SO WE HAVE THE PROPERTY OWNER AND DEVELOPER DOESN'T HAVE TO HAVE ONE OF THOSE TYPES OF

COMMUNICATIONS? >> ANYTHING ELSE FOR THE COUNCIL? AND HE COMES A QUESTIONS? ALL RIGHT WE MOTION A SECOND ALL IN FAVOR PLEASE SAY AYE.

>> AYE. >> MOTION CARRIES.

>> EASEMENT LOCATED AT 1410 REYNOLDS DRIVE, A PUBLIC HEARING

IS REQUIRED. >> MOVE FOR APPROVAL.

>> SECOND PERIOD. >> MOTION AND SECOND ROW OF A PUBLIC HEARING IF YOU LIKE TO ADDRESS THE COUNCIL PLEASE CAN FORGIVE YOUR NAME AND ADDRESS FOR THE RECORD.

>> YES, SIR,. >> MY NAME IS KEN STONE I LIKE AT 1529 REYNOLDS DRIVE I AM ALSO ON THE BOARD OF STONE CREEK SUBDIVISION HOA. WE DID NOT RECEIVE ADVANCE NOTICE OF THIS HEARING. FOR THE EASEMENT AT 1410 REYNOLDS DRIVE. SO I DON'T KNOW WHAT THE RULES ARE, WHETHER THERE ARE OTHER NOTIFICATIONS ARE MERELY CURRENCY. ALL WHETHER THERE IS A REQUIREMENT JOINING LANDOWNERS OR REPRESENTING THE ADJOINING LANDOWNERS THAT RESOURCES RECEIVE NOTICE BUT WE DID NOT RECEIVE THE LETTER THAT WE CAN FIND ABOUT THIS EASEMENT

VACATION. >> MISS CROUCH, IS THAT.

>> I'M SENDING YOU TO ENGINEER FRAZIER I THINK SHE IS LOOKING THROUGH DOCUMENTS. THERE ARE SPECIFIC STATE REQUIREMENTS INCLUDING THAT WE HAVE A PUBLIC HEARING THAT IS PUBLISHED IN THE NEWSPAPERS IN THE COURTHOUSE.

IT IS POSSIBLE HOA'S ARE NOT REQUIRED TO BE NOTICED IS PROBABLY DEPENDENT ON THE ADJOINING PROPERTY OWNERS AND THAT IS CITY ENGINEER FRAZIER IS THAT CORRECT?

>> YES, I THINK FOR EASEMENTS THEY DON'T HAVE TO NOTIFY JOINT PROPERTY OWNERS BECAUSE THE PROPERTY IS NOT BEING SPLIT, BECAUSE OF RIGHT AWAY. THE PROPERTY WOULD BE SPLIT BETWEEN BOTH PROPERTY OWNERS, IN THE CASE OF AN EASEMENT IT JUST FOLLOWS THE STATE LAW AT THE COURTHOUSE.

>> DID YOU RECEIVE NOTICE OF THE OTHER?

>> YES, IN FACT IN ADVANCE FEBRUARY FEBRUARY 7.

THAT IS THE DAY. >> THERE IS A LETTER FROM THE

CITY. >> I CAN DOUBLE CHECK THAT.

>> SO COUNCIL IF YOU WANT TO CONTINUE WITH THIS OR IF YOU WANT TO POSTPONE AND POSTPONE THE PUBLIC HEARING TO THE NEXT

MEETING. >> I THINK THAT IS THE RIGHT THING TO DO, TO LET YOU GET YOUR SORRY MR. SELBY, I KNOW YOU LIKE TO MOVE FORWARD TONIGHT, BUT I THINK THE RIGHT THING TO DO FOR OUR CITIZENS IS TO NOTIFY YOU AND CAN WE PUT THIS ON THE NEXT

AGENDA FIRST MEETING IN MAY? >> YOU WOULD NEED TO POSTPONE.

>> SO WE NEED A MOTION TO POSTPONE?

>> YES YOU NEED A MOTION POSTPONE AND A SECOND AND DO

THAT TO THEM A THIRD MEETING. >> I MOVED TO MOST POSTPONE TO

THE MAY 3 MEETING. >> SECOND PERIOD.

>> I HAVE A MOTION A SECOND ALL IN FAVOR PLEASE SAY AYE.

>> AYE. >> ANY OPPOSED, ALL RIGHT.

>> THIS IS INFORMATIONAL THAT YOU DO NOT CAUSE A PUBLIC HEARING AND REMAIN OPEN UNTIL MAY 3.

>> OKAY THANK YOU. THE MEETING STARTS AT 6:00 P.M.

ALL RIGHT, WE WILL MOVE ON. >> ALL RIGHT, ITEM TEN C1 AUTHORIZE A DEMOLITION OF A DEVIL APP A AT 556 FOSTER STREET PER SECTION 1545 OF THE CODE OF THE CITY OF AUBURN PUBLIC

HEARING IS REQUIRED. >> MOTION TO APPROVE.

>> SECOND PERIOD. >> WE HAVE A MOTION TO APPROVE AND A SECOND IF YOU LIKE TO ADDRESS THE COUNCIL PLEASE CAN FORGIVE THE NAME AND ADDRESS FOR THE RECORD.

>> WILL CLOSE A PUBLIC HEARING ANY COMMENTS OR QUESTIONS FROM

THE COUNCIL? >> I DO HAVE A QUESTION ABOUT 556 FOSTER STREET. WHEN I WAS LOOKING THROUGH THE

[01:05:01]

PACKET, I NOTICE THERE WAS NO NAME ASSOCIATED WITH THE PROPERTY. SO, WHEN YOU DO THESE DEMOLITIONS, HOW DO YOU ACTUALLY CONTACT THE OWNER TO LET THEM KNOW I GUESS YOU'RE IN A CHAIR THIS DOWN?

>> SO IF YOU APPROVE THIS TONIGHT THERE IS AN ADDITIONAL TEN DAYS. A WAITING PERIOD, AND THEN AFTER THE ADDITIONAL TEN DAYS, I AM AUTHORIZED TO ORDER IT TO BE TORN DOWN, AND KIND OF WHAT YOU DO IS, WE ASSESS THE COST AND THERE IF THERE IS A LIEN ON THE PROPERTY FOR DEMOLITION COST.

BUT I WILL HAVE THE CHIEF BUILDING OFFICIAL INSPECTION SERVICE DIRECTOR EXPLAIN IT A LITTLE BIT MORE.

>> WHEN WE IDENTIFY ONE OF THESE PROPERTIES WE DO A TITLE SEARCH FROM THE CITY ATTORNEY'S TO GET THE NAMES OF ANYBODY THAT IS ASSOCIATED WITH THE PROPERTY. WE ACTUALLY STARTED THIS UNDER PROPERTY OWNER. AND SO THE PROPERTY.

TO A MORTGAGE COMPANY, AND THEY BECAME OWNERS OF IT, SO WE HAD TO GO THROUGH THE PROCESS AGAIN THROUGH HER NETTLE TITLE SEARCH TO MAKE SURE WE CONTACTED THE RIGHT PEOPLE.

THE MORTGAGE COMPANY WAS ORIGINALLY TALKING ABOUT FIXING THE HOUSE. WE WORK WITH THEM ON AND THEY STOPPED COMMUNICATIONS WITH US. SO WE HAD TO PICK UP THE PROCESS AGAIN. IN ORDER TO HAVE IT DEMOLISHED.

>> I GUESS OKAY I'M OKAY WITH THIS, TO TELL YOU THE TRUTH BECAUSE IT'S AN EYESORE. MY QUESTION ON THAT IS.

>> GUARDIAN TAX A LLC ARE THE CURRENT OWNER.

>> AND THERE IS NOT AN INDIVIDUAL WAS A PROPERTY?

>> NO MAN, THE LAW REQUIRES US TO SEND CERTIFIED RECENT CERTIFIED AND REGULAR MAIL BECAUSE PEOPLE DON'T LIKE TO SIGN FOR CERTIFIED. AND IF WE CAN FIND A PHONE ABOUT WILL TRY TO CALL THEM, GUARDIAN TAX TO STOP ALL COMMUNICATION

WITH US. >> YOU HAVE PREVIOUS

COMMUNICATION THAT QUIT? >> YES.

>> AND IN THE NOTE IT SAYS THIS IS THE LAST THING THAT WE LIKE TO DO WE TRY EVERY EFFORT WE HAVE PROGRAMS, IF WE HAVE FOLKS HAVE INCOME ISSUES WE HAVE EVERYTHING WE CAN DO NOT DO THIS UNLESS IT IS NECESSARY. ALSO AS YOU SEE IN THE PACKET, A NUMBER OF HOMES, WE DO NEIGHBORHOOD ASSESSMENT IN 2018, AND THESE ARE BOTH M WE HAVE ANOTHER ONE FOLLOWING IDENTIFIED AS ISSUES IN A 20 TONY WE STARTED FOLLOWING UP AND IMAGINE WE DID THAT IN 2020, NOT BECAUSE OF COVERT, WE ARE HERE NOW WE ARE HERE IN 2022 ASKING YOU, WE SPENT A LOT OF TIME TRYING TO DO ANYTHING BUT TEAR IT DOWN, UNTIL WE GET TO A POINT THAT WE ARE

HERE. >> I THINK WHAT I WAS GOING TO ASK IS ONCE YOU TEAR THAT HOUSE DOWN, THE PROPERTY, ITSELF, THE

LIEN GOES AGAINST THE PROPERTY? >> IT WILL GO AGAINST THE PROPERTY TAX, SO WHEN THEY GO TO PAY THEIR PROPERTY TAXES BEFORE DECEMBER 31 THEY WILL HAVE TO PAY IT OFF AND THAT TIME.

>> IF THEY DON'T IT'S LIKE EVERYTHING WILL EVENTUALLY GET MONEY WHOEVER DOES BY IT WHETHER IT SOLD ON THE COURTHOUSE STEPS OR WHAT HAVE YOU WE WILL GET OUR MONEY BACK.

FOR THE DEMOLITION. >> ANY OTHER QUESTIONS?

ALL IN FAVOR PLEASE SAY AYE. >> AYE.

>> ANY OPPOSED THE MOTION CARRIES.

ITEM 10C TO DEMOLITION OF DILAPIDATED STRUCTURE AT 637 WESTWOOD DRIVE PER SECTION FIT 1645 CITY OF AUBURN.

PUBLIC HEARING IS REQUIRED. >> WE HAVE A MOTION AND A SECOND PUBLIC HEARING IF YOU LIKE TO ADDRESS THE COUNCIL PLEASE COME FORWARD AND NAME AND ADDRESS FOR THE RECORD.

>> SEEING NORMAL CLOSE A PUBLIC HEARING ANY QUESTIONS OR

COMMENTS FOR COUNSEL? >> WELL BASICALLY I GUESS I HAVE THE SAME QUESTION OF MS. BROWN WHO OWNS A PROPERTY HERE.

SO WHAT WAS A CONVERSATION THAT SHE CONTACT HER?

>> WE HAVE BEEN IN CONSTANT CONTACT WITH HER AND SHE IS NOT ABLE TO DEMOLISH IT HERSELF WE WORKED WITH HER FOR NUMBER OF YEARS. OUR COMMUNITY SERVICE DEPARTMENT IS WORKING TO TRYING TO GET SOME TITLES CLEANED UP.

AND SHE WAS NOT ABLE TO DO THAT. SO WE GOT TO THE POINT OF TWO YEARS OF TRYING TO GET RESOLVED ANY OTHER WAY WE CAN.

>> ANY OTHER COMMENTS OR QUESTIONS.

>> I DIDN'T MEAN TO CUT YOU OFF. OKAY.

>> ALL IN FAVOR PLEASE SAY AYE. >> AYE.

>> ANY OPPOSED? MOTION CARRIES.

[12. CITIZENS’ OPEN FORUM]

>> MAY ARE THOSE OF THE ITEMS OF BUSINESS THAT YOU HAVE AN AGENDA

FOR THE SEASON. >> THIS TIME WE OPEN THIS IS THE FORM OPPORTUNITY TO SPEAK TO COUNSEL WITH ANYTHING THAT'S ON YOUR MIND WILL ASK YOU TO COME FORWARD TO GIVE US YOUR NAME AND ADDRESS YOU HAVE 3 MINUTES, AND REMEMBER YOUR COMMENTS ARE FOR

[01:10:03]

THE COUNCIL. NOW FOR THE STAFF.

ANYONE? >> ROB WILKINS TO 61 HICKS DRIVE HERE TO TALK ABOUT THE ORDINANCE SHORT-TERM RENTALS 3288.

I WANTED TO COVER A COUPLE OF THINGS, ONE IS I GOT A A NOTICE NOT A NOTICE BUT A THING ON FACEBOOK WERE A GENTLEMAN WHO SAID I APOLOGIZE FOR BUGGING YOU HERE.

BUT JUST READ ABOUT THE PLACEMENT ARTICLE THAT CITY OF AUBURN'S A CEASE-AND-DESIST ORDER FOR SHORT-TERM RENTALS OF YOUR HOME IS PROBABLY EXPLAINS WHY CAN'T REACH YOU ON AIRBNB.

IF IT IS AVAILABLE WE WOULD LOVE TO RENT YOUR HOME.A.COME AND WE WOULD LOVE NOTHING MORE THAN TO SUPPORT CAPITALISM AND FREEDOM AND TO PROVIDE RENTAL TRANSACTIONS WITH YOU FOR THE WEEKEND. I THINK IT IS VERY IMPORTANT, SECOND IS, I TOOK A DRIVE TODAY ON BENT CREEK ROAD, I THOUGHT I WOULD LOOK AT SOME OTHER PLACES THAT HAVE NOT AIRBNB AND NOT SHOW ANY OF THESE HOUSES HAVE AND I ASSUME NOT, BUT ANYWAY, I WENT ON NOTTINGHAM DRIVE DOWN TO DANBURY DRIVE AND BENTLEY COURT, I FELT LIKE I WAS IN ENGLAND SOMEWHERE.

IT WAS SOME BEAUTIFUL HOMES. I WANTED TO SAY, THE HOMES THAT I WENT TO ONE HERE, THESE ARE ALL ON VAILLANCOURT.

THIS IS NOT KELLY GRISWOLD IS NOT A HOTEL.

IT IS JUST A RESIDENTIAL HOME. BUT IT'S A NICE HOME.

AND SO FORTH. SECOND IS, THIS HOUSE, COULD HAVE AIRBNB IF THEY WOULD LIKE. OKAY, ACROSS THE STREET, IS ANOTHER HOME. THIS ONE IS HARDER TO SEE, IT IS A RESIDENTIAL HOME, YOU CANNOT HAVE AIRBNB, THIS HOME CANNOT HAVE AIRBNB BUT IS ACROSS THE STREET.

OKAY NOW WHAT HAPPENED IS, I'VE COME UP WITH A NEW NAME CALL, THIS HOUSE HERE, IS DOWN ON THE CORNER, AND I CALL IT A HYBRID.

SHORT-TERM RENTAL. THE REASON I CALL IT HYBRID IS HALF OF THE HOUSE YOU CAN HAVE AIRBNB THE BACK OUT.

THE FRONT HALF OF THE HOUSE, YOU CANNOT HAVE AIRBNB.

WHAT KIND OF COORDINATES HAVE YOU ALL DEVELOPED? WHAT KIND OF RESEARCH DID YOU DO TO COME UP WITH SILLY STUFF, I DO NOT UNDERSTAND? YOU PUT A HUNDRED AND 51 PEOPLE OUT, SEVERAL HAVE IT TO SELL THEIR HOMES, SOMEONE ELSE TO OCCUPY THE HOME BECAUSE PEOPLE DO LOVE AUBURN I LOVE AUBURN.

ANYWAY, I DON'T UNDERSTAND WHY I WOULD LIKE FOR YOU ALL TO GET RID OF THE ORDINANCE. AND DON'T WAIT TO THE NEW PEOPLE ARE ON BOARD THE MAYOR IN THE COUNCIL.

DO IT NOW. MAKE A DECISION.

AND DO SOMETHING ABOUT IT OKAY THANK YOU.

>> YES OR THANK YOU. >> WILL BE NEXT? OKAY ANYONE ELSE? SO MOVED TO ADJOURN?

>> SO MOVED. TEN SHE LEFT THE BUILDING.

>> THANK YOU KELLY. >> ANYONE ELSE? OKAY SO MOVED
