(ROLL CALL) >> SPEAKER: WOULD YOU PLEASE RISE FOR THE PLEDGE OF ALLEGIANCE AND THEN REMAIN STANDING FOR A MOMENT OF SILENCE (RECITAL OF PLEDGE OF ALLEGIANCE). >> SPEAKER: I PLEDGE ALLEGIANCE TO THE FLAG OF THE UNITED STATES OF AMERICA AND TO THE REPUBLIC FOR WHICH IT STANDS, ONE NATION UNDER GOD, INDIVISIBLE, WITH LIBERTY AND JUSTICE FOR ALL. (SILENCE) >> SPEAKER: THANK YOU. EARLIER DURING THE COMMITTEE OF [4. MAYOR AND COUNCIL COMMUNICATIONS.] THE WHOLE WE DID NOT HAVE ANY ITEMS FOR BUSINESS BUT WE WERE INTRODUCED TO OUR NEW EMPLOYEE WITH THE CITY, MR. KEITH WILLIAMS. KEITH, WE ONCE AGAIN ARE EXCITED ABOUT HAVING YOU HERE AND LOOK FORWARD TO WORKING WITH YOU IN THE VERY NEAR FUTURE. A COUPLE OF ANNOUNCEMENTS. I HAVE TONIGHT. NOT NEAR AS LONG AS TWO WEEKS AGO. I WANT TO THANK THE AUBURN BEAUTIFICATION COUNCIL ON WORKING ON THE BASKETS IN DOWNTOWN AUBURN. THERE WERE ABOUT 20, 25 VOLUNTEERS WE COULD GO OUT THERE ONE MORNING WORKING VERY HARD AND THOSE BASKETS ARE ONE OF THE SPECIAL AND UNI GREAT PLACE. I APPRECIATE THEIR EFFORTS. DR. CHRIS ROBERTS, FIRST DAY AS AUBURN UNIVERSITY PRESIDENT WAS YESTERDAY AND I'M VERY THANKFUL TO DR. ROBERTS AT LUNCH YESTERDAY HE BROUGHT IN ALL OF THE PUBLIC SAFETY LEADERSHIP FROM OUR CITY AND I APPRECIATE THE MESSAGE AND THIS HIM AND HE MADE THAT HE THOUGHT HAVING THOSE PEOPLE THAT PROTECT US IN TO HAVE LUNCH WITH HIM ON HIS FIRST DAY AT WORK WAS VERY IMPORTANT. WE ARE EXCITED ABOUT DR. ROBERTS AND LOOK FORWARD TO WORKING WITH HIM. HE HAS BEEN A PART OF OUR INDUSTRIAL DEVELOPMENT BOARD FOR AWHILE AND BEEN A PART OF THE CITY FOR ALMOST 30 YEARS AND WE LOOK FORWARD TO HIS GREAT WORK. SPEAKING OF PUBLIC SAFETY, LAST WEEK WAS THE BATTLE OF THE BADGES SOFTBALL GAME. COUNCILMAN GRISWOLD AND COUNCILMAN COLBY JOINED ME AT LEE SCOTT AND WON AN EXCITING GAME THAT WAS. THE POLICE DEPARTMENT CAME BACK FROM LAST YEAR'S DEFEAT TO WIN A CLOSE GAME 22-21. YOU HAD SOME EXCELLENT ATHLETES WORKING FOR YOU OVER THERE. WAS A LOT OF FUN AND I JUST APPRECIATE EVERYBODY'S GOOD-NATURED SPORTSMANSHIP ABOUT THEM. THERE WAS SOME MONEY RAISES FOR SOME GOOD CAUSES AND IT WAS A GREAT TIME TO BE OUT THERE. SO THANK YOU TO ALL OF YOUR MEN AND WOMEN WHO PARTICIPATED. IT WAS A LOT OF FUN. SPEAKING OF PUBLIC SAFETY, THIS IS THE THIRD YEAR ANNIVERSARY OF THE CITY OF AUBURN LOSING OUR FIRST EVER POLICE OFFICER WILL PUKE THERE. THAT THIRD YEAR ANNIVERSARY IS THIS THURSDAY ON THE 19TH. WE CERTAINLY WANT TO CONTINUE TO REMEMBER THE BUECHNER FAMILY AND OUR FAMILY -- THOUGHTS AND PRAYERS AS THEY GO THROUGH THIS WEEK AND THOSE REMEMBRANCES AND WE CONTINUE THINK WILL FORGIVING HIS LIFE TO PROTECT US ALL HERE IN THIS COMMUNITY. THIS OCTOBER THE BIG TEN MAYORS WILL BE COMING TO AUBURN FOR THEIR QUARTERLY MEETING AND WE LOOK FORWARD TO HOSTING THEM HERE IN OUR COMMUNITY AND SHOWING THEM WHAT AUBURN IS ALL ABOUT. THAT DATE IS OCTOBER 23 AND 24TH. ONE OF THE REASONS THEY ARE COMING TO AUBURN, THAT IS ABOUT TWO WEEKS BEFORE THE GENERAL ELECTION IN NOVEMBER. ON THE BALLOT WILL BE A CONSTITUTIONAL AMENDMENT CALLED ANAÏS LAW IS WHAT IT'S CALLED. IT IS NAMED FOR A NICE PLANTER WHO LOST HER LIFE THROUGH BEING KIDNAPPED AND MURDERED HERE IN AUBURN. SHE WAS A STUDENT HERE, LOOKING TO START HER LIFE HERE AND GET AUBURN UNIVERSITY. THAT WAS TAKEN FROM HER BY SOMEBODY WHO SHOULD NOT HAVE BEEN OUT OF JAIL AND ANAÏS LAW IS PASSED WILL GIVE JUDGES THE RIGHT TO HOLD VIOLENT CRIMINALS IN JAIL AND NOT ALLOW THEM TO BAIL OUT. AND SO THE BIG TEN MAYORS ARE IN UNISON IN SUPPORTING ANAÏS LAW AND WILL BE HERE IN AUBURN WHERE A NICE PLANTER LIVED IN TALKING ABOUT THAT IN OCTOBER. I WANT TO CONGRATULATE AND THANK OUR INDUSTRIAL DEVELOPMENT TEAM AND ECONOMIC DEVELOPMENT TEAM FOR THE AGREEMENT -- WE TALKED ABOUT THIS EARLIER WITH SABRE FINANCE. THIS WILL BE A GREAT TOOL FOR OUR COMMUNITY, TO HELP START UPS, MINORITY OWNED, WOMEN-OWNED, UNDERSERVED AND OTHER LOCAL BUSINESSES THAT NEED THAT EXTRA BOOST TO GET STARTED AND I JUST THANK ALL OF OUR STAFF AND THEIR PARTNERSHIP WITH SABOR MAKING THIS AVAILABLE TO PROSPECTIVE ENTREPRENEURS IN OUR COMMUNITY. I WANT TO SAY CONGRATULATIONS TO ASHLEY CARTER, THE YOUNG LADY WHO GREW UP IN AUSTIN AND GRADUATE FROM AUSTIN IVORY. SHE WON THE JAVELIN CHECK AND CHECK LAST WEEK AND CERTAINLY PROUD OF ASHLEY. AND CONGRATULATIONS FOR AUBURN HIGH SCHOOL AND LEE SCOTT IS COMING UP AND WE WANT TO SAY CONGRATULATIONS TO ALL OF OUR YOUNG PEOPLE WHO WILL BE GRADUATING FROM HIGH SCHOOL AND WE WISH THEM ALL THE BEST IN THEIR FUTURE ENDEAVORS. ANYONE ELSE ON THE COUNCIL HAS AN ANNOUNCEMENT TONIGHT? >> SPEAKER: I DO. >> SPEAKER: YES, MA'AM. >> SPEAKER: I WANT TO START OFF THIS MEETING HERE BY ANNOUNCING THE JUNETEENTH EVENT FOR THIS YEAR IS GOING TO BE JUNE 18 AT THE MARTIN LUTHER KING PARK STARTING AT 10 O'CLOCK. ALONG WITH THAT JUNETEENTH WE [00:05:01] WILL BE DOING UNSUNG HEROES. UNSUNG HEROES CEREMONY. THE CEREMONY IS GOING TO START AT 11 AND THE PUBLIC IS INVITED TO THIS FREE EVENT. >> SPEAKER: OKAY. ANYONE ELSE ON THE COUNCIL HAVE AN ANNOUNCEMENT? >> SPEAKER: YES, THE LIGHTS ARE BACK ON ITSELF COLLEGE ON COX ROAD AND I-85. WORKING ON THEM A LONG TIME AND MEGAN, I APPRECIATE YOUR HARD WORK ALONG WITH THE ALABAMA THE IT OF TRANSPORTATION. IT LOOKS VERY, VERY NICE. PEOPLE CAN RIDE AFTER DARK AT NIGHT AND CONDUCT BUSINESS IN COX ROAD LOOK AT THOSE LIGHTS. WE HAVEN'T HAD THEM ON COX ROAD BEFORE. WE'RE PRETTY HAPPY ABOUT THAT. >> SPEAKER: WHAT ABOUT THE LANDSCAPING? >> SPEAKER: THAT'S NICE. >> SPEAKER: IT'S NOT FINISHED BUT IT IS LOOKING A LOT BETTER. >> SPEAKER: WE HAVEN'T FINISHED WITH THE LIGHTS YET. >> SPEAKER: THEY ILLUMINATE THE PRETTY LANDSCAPING. WE ARE VERY PROUD, CHIEF, THIS IS A GATEWAY TO AUBURN AND IT HAS BEEN A LONG TIME COMING. OUR ENTIRE STAFF IS BEEN WORKING SINCE THE INTERCHANGE WAS BUILT TO GET IT BOTH LIT AND LANDSCAPED AND IT DOES TAKE A LONG TIME. WE NEED THE WILL OF ALDOT TO WORK WITH US AND WE WERE ABLE TO FACILITATE THAT AFTER A LOT OF WORK, PARTICULARLY BY ENGINEERING SERVICES. WE ARE APPRECIATIVE AND THAT NOW HAS COX ROAD ELIMINATED A LONG DISTANCE FROM SOUTH COLLEGE ST. ALL THE WAY UP. WE ARE PROUD TO HAVE A LOT MORE ILLUMINATION IN THAT AREA. >> SPEAKER: OUR CITIZENS ARE VERY HAPPY ABOUT THAT. WE HAVE BEEN WAITING FOR THAT FOR A LONG TIME. >> SPEAKER: ANYONE ELSE? >> SPEAKER: I WAS ABLE TO ATTEND TO THE PEACE OFFICERS MEMORIAL IN OPELIKA THE OTHER DAY AND OBVIOUSLY AUBURN HAS HAD A TREMENDOUS LOSS, BUT IN ALL THERE WERE SIX OFFICERS REPRESENTED ACROSS LEE COUNTY, OPELIKA AND IN AUBURN. THE ATTORNEY GENERAL SPOKE AND I THOUGHT IT WAS REALLY INTERESTING AND IT HAD DAWNED ON ME THE IMPACT THAT COVID HAD ON OUR POLICE OFFICERS OVER THE LAST COUPLE OF YEARS. AND ACTUALLY ALABAMA LOST MORE OFFICERS TO COVID THAN IT DID TO POLICING ACTIVITIES. SO WE OFTEN RECOGNIZE OUR HEALTHCARE WORKERS AS BEING IN HAZARDOUS ENVIRONMENTS, ARE PEACE OFFICERS AND FIRST RESPONDERS ARE SIMILARLY IN THOSE ENVIRONMENTS AND I JUST WANT TO THANK ALL OF YOUR FOLKS FOR OUR FORCE. THANK YOU. >> SPEAKER: THANKS, KELLEY. I WANT TO REMIND EVERYBODY AGAIN ABOUT THE MAYOR'S MEMORIAL DAY BREAKFAST ON MEMORIAL DAY. WE STILL HAVE TICKETS LEFT. PLEASE CALL CITY HALL IT WILL BE A GREAT PROGRAM AND WILL END UP WITH A BRIEF PRESENTATION AND A RIEF LAYER ON THE VETERANS MEMORIAL. WE WILL MOVE FORWARD WITH AUBURN [5. AUBURN UNIVERSITY COMMUNICATIONS.] UNIVERSITY COMMUNICATIONS. >> SPEAKER: NOT A LOT FOR ME THIS WEEK. AS THE MAYOR MENTIONED, OUR BIG NEWS THIS WEEK IS THAT PRESIDENT ROBERTS HAD HIS FIRST DAY. HE STARTED THAT OFF BY HAVING BREAKFAST WITH STUDENT LEADERS FROM VARIOUS ORGANIZATIONS ACROSS CAMPUS, AND HE WILL BE POSTING MEETING AND GREETS WITH OTHER GROUPS AS WELL AND WE ARE THANKFUL TO SEE THEM ALREADY PRIORITIZING THE STUDENT VOICE THIS WAY AND LOOKING FORWARD TO WHAT ELSE HE WOULD DO IN THAT ROLE. ALSO THIS WEEK OUR CAMP REGAL COUNCIL STARTED THEIR TRAINING. WE ARE EXCITED TO FINALLY HAVE A NORMAL SUMMER OF CAMP REGAL SESSIONS AHEAD OF US. I WILL SURELY HAVE MORE UPDATES ON THAT TO COME. ALSO CLASSES BACK IN SESSION STARTING TOMORROW SO WISH A COLLEGE STUDENT GOOD LUCK IN THEIR SUMMER CLASSES BUT WE ARE ALSO VERY PROUD TO HAVE HAD EIGHT STUDENTS SELECTED FOR NATIONAL SCIENCE FOUNDATION GRADUATE RESEARCH FELLOWSHIPS. EACH ONE OF THOSE FELLOWSHIPS INCLUDES A $34,000 STIPEND AND A COST OF EDUCATION ALLOWANCE OF $12,000. AND REALLY THIS INVESTMENT IS JUST A TESTAMENT TO THE IMPACT OF THE RESEARCH THAT OUR STUDENTS ARE DOING AND WE ARE VERY GRATEFUL TO SEE THEM RECOGNIZED FOR THAT. AND THE LAST THING FOR ME, BJ AND SUSAN GOOSE PERFORMING ARTS CENTER HAS ANNOUNCED IS 2022-2023 PERFORMANCE SCHEDULE AND IT INCLUDES MUSICAL ACTS, BROADWAY SHOWS AND LOTS MORE STUFF. SO DO CHECK THAT OUT AND SEE WHAT YOU COME -- WANT TO COME SUPPORT. THAT'S ALL FOR ME. WAR EAGLE. >> SPEAKER: THANKS. AT THIS TIME A CITIZENS COMMUNICATIONS ON ITEMS ON TONIGHT'S AGENDA. IF YOU WOULD LIKE TO TALK TO THE COUNCIL ABOUT ANYTHING ON TONIGHT'S AGENDA, PLEASE COME FORWARD AND GIVE US YOUR NAME AND ADDRESS FOR THE RECORD. I BELIEVE THERE IS ONE ITEM ON OUR AGENDA THAT DOES HAVE A PUBLIC HEARING. [7. CITY MANAGER’S COMMUNICATIONS.] WE WILL MOVE AHEAD WITH CITY MANAGER CAN MEDICATIONS. >> SPEAKER: MAYOR, CITY MANAGERS CAN MEDICATION THIS EVENING WE HAVE THE ANNOUNCEMENT OF THE FOLLOWING VACANCIES, TWO VACANCIES ON THE PLANNING COMMISSION, SIX YEAR TERMS BEGIN AUGUST 1, 2022, AND JULY 31, 2028. THE APPOINTMENTS WILL BE MADE AT THE JULY 19 MEETING. >> SPEAKER: MEGAN, WHEN WILL THE APPLICATION TURN ON ON THE SYSTEM, WHEN WILL PEOPLE APPLY FOR THAT? [00:10:01] >> SPEAKER: YOU WILL BE TOMORROW. >> SPEAKER: TOMORROW -- TONIGHT IF YOU WANT TO. >> SPEAKER: GOOD. WE WILL ANNOUNCE SOON THE SCHEDULE FOR THE APPLICATION DEADLINE AND THEN OBVIOUSLY WITH THE INTERVIEWS. >> SPEAKER: WHAT WE NEED TO DO IN THE POSTING OF APPLICATIONS WE DO PUT A CLOSING DATE AND MSA CLOSING DATE ON THERE? >> SPEAKER: IT IS LISTED BY DORMER THE DATE. >> SPEAKER: WE WILL DOUBLE CHECK THAT. IF YOU GUYS -- BACKING UP IF YOU NEED TIME TO DO INTERVIEWS BEFORE THE JULY 19 MEETING AND GET THAT SCHEDULED, I WAS LOOKING EARLIER TODAY, IF YOU WAIT TO LATE JUNE TO CLOSE APPLICATIONS THAT IS SIX WEEKS OF THE EVOCATIONS BEING OPEN AND IT GIVES YOU THREE WEEKS. THAT MAYBE TOO LONG TO HAVE APPLICATIONS OPEN AND WE MAY WANT TO ROLL THAT BACK TO FIVE. IF YOU HAVE ANY DIRECTION TONIGHT WE CAN DOUBLE CHECK DAYS BEFORE THIS GOES LIVE. >> SPEAKER: WE NORMALLY HAVE LEFT APPLICATIONS OPEN FOR ABOUT A MONTH, IS THAT IN THE RULE OF THUMB? >> SPEAKER: FOR WEEKS IS YOUR BOARD POLICY OF ANNOUNCEMENT, WHICH USUALLY MEANS THREE OR SO WEEKS, LINDSAY IT'S OPEN? AND THEN IT IS EIGHT WEEKS ON PLANNING COMMISSION AND BOARD OF EDUCATION FOR YOUR POLICY. THAT WE BACKED THAT UP BECAUSE OF INTERVIEW TO GIVE YOU TIME TO REVIEW APPLICATIONS AND TO DETERMINE WHO YOU ARE GOING TO INTERVIEW HER SO THERE IS NO RULE ABOUT EXACTLY WHEN WE CLOSE APPLICATIONS. >> SPEAKER: ANYONE ON THE COUNCIL HAVE A THOUGHT? FOR WEEKS IS PLENTY OF TIME IN MY OPINION. >> SPEAKER: FOR WE WI-FI WILL MAKE SURE IT IS FOR WEEKS AND THAT WILL BE THAT AND THEN I WILL SEND IT TO YOU. >> SPEAKER: THANK YOU, MEGAN. MOVING ON WITH THE CONSENT AGENDA. >> SPEAKER: FIRST ITEM OF BUSINESS' CONSENT AGENDA. IS ANY COUNCIL MEMBER WISH TO REMOVE AN ITEM FROM THE CONSENT AGENDA AND DEAL WITH THAT ITEM INDIVIDUALLY? >> SPEAKER: ITEM 8E1. >> SPEAKER: 8D AS IN DAVID. >> SPEAKER: 8D, ONE OR TWO? >> SPEAKER: ONE AND TWO. >> SPEAKER: OKAY. 8E2. >> SPEAKER: 8E2. [8.d.1. Rexnord Industries, LLC. 1600 Pumphrey Avenue. Auburn Industrial Park.] ANY OTHERS? ALL RIGHT. ITEM 8 DE ONE IS A REQUEST FROM REX LORD LOCATED 1600 PUMPHREY AVENUE FOR TAX ABATEMENT ASSOCIATED WITH THE PURCHASE OF NEW CAPITAL EQUIPMENT WITH A TOTAL INVESTMENT OF TWO-POINT A $5 MILLION AND THE CREATION OF 60 NEW JOBS. >> SPEAKER: MOVE TO APPROVE. >> SPEAKER: SECOND. >> SPEAKER: MOTION AND SECOND. I JUST WANTED TO HAVE THIS REMOVED JUST TO SAY THANK YOU TO OUR INDUSTRIAL DEVELOPMENT TEAM. THESE ARE TWO GREAT ANNOUNCEMENT TONIGHT WITH THESE EXPANSIONS WITH REXNORD AND CHIN WAUGH AND I JUST APPRECIATE Y'ALL'S HARD WORK. THIS IS OVER HUNDRED JOBS, OVER $80 MILLION IN CAPITAL INVESTMENT IN OUR COMMUNITY AND I'M JUST THANKFUL THAT Y'ALL ARE DOING THE KIND OF JOB THAT HELPS THESE COMPANIES MAKE THESE GREAT DECISIONS TO INVEST IN IN LARGER COMPANIES IN AUBURN. WE ARE VERY GRATEFUL FOR THAT SO THANK Y'ALL. ANY OTHER QUESTIONS OR COMMENTS FROM COUNCIL? MOTION AND SECOND, ALL IN FAVOR SAY AYE. ANY OPPOSED POST? [8.d.2. Shinhwa Auto USA Corp. 2530 West Tech Lane. Auburn Technology Park West Annex.] MOTION CARRIES. >> SPEAKER: REQUEST OF SHINHWA AUTO USA COURT LOCATED AT 2530 -- 2530 WEST TECH LANE FOR TAX ABATEMENT ASSOCIATED WITH CONSTRUCTION OF A SECOND PLANT. I WANT TO REMIND YOU YOU HAVE APPROVED ABATEMENT NOT ALL THAT LONG AGO, $70 MILLION JUST IN ADDITION THEY WERE INVESTING 70 MILLION IN ADDITION TO THEIR CURRENT PLANT. THIS IS A NEW PLANT INVESTING OVER $78 MILLION IN NEW CAPITAL EQUIPMENT AND A NEW BUILDING AND THE CREATION OF 42 NEW JOBS. >> SPEAKER: MOVE FOR APPROVAL. >> SPEAKER: MOVE -- MOTION AND SECOND. ANY OF THE, THE QUESTIONS? ALL IN FAVOR SAY AYE. ANY OPPOSE? [8.e.1. Alabama Department of Transportation. Cost overrun funding Agreement. Project No. ATRP2‐41‐2022‐092 Center Turn Lane Addition on Shug Jordan Parkway at Ware Drive and Shepherd's Cove Apartments. ] MOTION CARRIES. >> SPEAKER: ITEM 8E1 AUTHORIZES A COST OVERRUN FUNDING AGREEMENT WITH THE ALABAMA DEPARTMENT OF TRANSPORTATION FOR A LONG AWAITED CENTER TURN LANE ADDITION ON SHUG JORDAN PKWY. AT WARE DRIVE AND SHEPHERD'S COVE APARTMENTS THAT MOVE FOR APPROVAL. >> SPEAKER: SECOND. >> SPEAKER: MOTION AND SECOND. MS. TAYLOR? >> SPEAKER: YES, YOU SAY LONG TERM WEIGHT. AND SEVERAL PEOPLE HAVE CALLED ME ABOUT THIS. I JUST WANTED TO SAY I APPRECIATE THIS COMING ON THE AGENDA AND ALSO DO WE HAVE ANY IDEA WHEN THIS PROJECT IS GOING TO GET STARTED? >> SPEAKER: TO THE CITY ENGINEER, MS. FRASER, HAD CHECKED WITH THE ALABAMA DEPARTED OF TRANSPORTATION AND I BELIEVE SHE TOLD ME THEY WOULD BE LETTING THIS PROJECT, WHICH I ALSO SAY IN ENGLISH IS BIDDING OR AWARDING A BID IN JANUARY 2023. SO THAT MEANS THAT THE START DATE OF APPROXIMATELY 90 DAYS AFTER THAT POINT. JUST FOR GENERAL INFORMATION, ALDOT IS INVESTING OVER $1.5 MILLION IN THIS PROJECT AND IT IS MONEY WITH NO MATCH FOR THE CITY OF AUBURN. SO THIS IS A GRANT AND THIS IS RARE TO GET AN ALL OUT BRANCH WITH NO MATCH FOR THE CITY. THIS HAS BEEN A LONG AWAITED PROJECT. WE ARE HAVING COLLISIONS IN BOTH LOCATIONS AND A LOT OF RESIDENTS [00:15:01] IN THE AREA FOR THOSE WHO DON'T KNOW WARE DRIVE IS WHERE THE HUMANE SOCIETY IS. AND SO THERE IS A LOT OF ACTIVITY THERE. THIS IS LONG AWAITED BY THE PEOPLE WHO LIVE AND TRAVERSE THE AREA. THIS IS A LEFT TURN. >> SPEAKER: WE MIGHT GET IT TURNED LANE THE ENTIRE LENGTH? >> SPEAKER: WE ARE WORKING ON SOMETHING THE CITY ENGINEER HAS LONG BEEN WORKING ON. OUR GOAL IS THE TURN LANE IS TO GET TURN LANES EVERYWHERE THERE ARE DRIVEWAYS OR STREETS. >> SPEAKER: THANK YOU. THAT WOULD BE NICE. >> SPEAKER: WE HAVE MADE SIGNIFICANT PROGRESS ALONG THE WAY, AND THINGS ARE IMPROVING THERE. THESE ARE TWO OF THE LAST MAJOR ONES THAT NEEDED TO GET DONE. THERE ARE OTHER SMALLER ONES BUT THESE ARE HIGH ACTIVITY DRIVEWAYS. >> SPEAKER: ANY OTHER COMMENTS OR QUESTIONS? MOTION AND SECOND. ALL IN FAVOR PLEASE SAY I. [8.e.2. Batson‐Cook Company. Tower crane use agreement. 129 North College Street.] ANY OPPOSE? MOTION CARRIES. >> SPEAKER: ITEM TOWER CRANE USE AGREEMENT WITH BASS AND COOK COMPANY FOR THE 129 NORTH COLLEGE STREET PROJECT. >> SPEAKER: MOVE FOR APPROVAL. >> SPEAKER: SECOND. >> SPEAKER: MOTION AND SECOND. MR. CHRIS WALL? >> SPEAKER: THIS AGREEMENT IS BETWEEN THE CITY AND THE BATSON-COOK COMPANY. I WAS CURIOUS, ARE THE BUSINESS THIS THAT FALL UNDERNEATH THE AERIAL CIRCLE, ARE THEY ALSO REQUIRED TO AGREE WITH THIS? >> SPEAKER: WHEN WE STARTED TOWER CRANE AGREEMENTS WITH THE CONSTRUCTION HUB OF 191 -- WE CALLED IT WESTON RIGHT NOW WE CALLED IT I THINK 250 WEST TO GLENN OR IT WAS. THIS IS WHEN THIS STARTED. THE GOAL WAS ANY TIME THE TOWER CRANE IS GOING TO SWING OVER THE PUBLIC RIGHT-OF-WAY THAT IS THE CITY. IN THIS CASE IT IS SWINGING OVER THE PARKING DECK PROPERTY ALSO. WE WOULD DO TOWER CRANE AGREEMENTS NOT JUST WE REQUIRE THEM AND SCOTT CUMMINGS WILL CORRECT ME, WE REQUIRE THEM FOR ALL PRIVATE PROPERTY AS WELL. THIS IS JUST THE CITY'S PIECE OF THIS. THIS IS THE LIABILITY IS ON THE CONSTRUCTION COMPANY AND IT IS PROTECTING EVERYONE PUBLIC SAFETY WISE. WE WANT TO MAKE SURE ALL WERE PROTECTED SO NOT JUST US BUT ANYBODY THAT THIS IMPACTS. THE TOWER AGREEMENT IS EXECUTED WITH. >> SPEAKER: THERE IS A DEAF -- SEPARATE TOWER CRANE AGREEMENT WITH DIFFERENT BUSINESSES? >> SPEAKER: IT WOULD BE THE BUSINESS OWNERS, THE PROPERTY OWNERS. THE SAME, THEY GAVE US A TOWER CRANE AGREEMENTS BECAUSE WE SWUNG OVER THEIR PROPERTY IN REGIONS BANK WILL BE BUILT THE PARKING DECK AND WE HAVE THE SAME AGREEMENTS WITH THEM NOT BECAUSE WE ARE THE GOVERNMENT BUT BECAUSE WE WERE BUILDING A PROJECT. >> SPEAKER: ONE OF THE QUESTION. THE TERM TALKS ABOUT COMMENCES UPON THE FIRST OF JUNE. SO THAT IS WHEN WE THINK WE ARE GOING TO HAVE SOME CONSTRUCTION ACTIVITIES GOING ON THEN? >> SPEAKER: WE HAVE ACTUALLY HAD PART OF THE TOWER CRANES CONSTRUCTED. >> SPEAKER: MARKING THE FOUNDATION SO THEY HAVE STARTED BUT THEY WON'T BE ERECTING THE TOWER CRANE UNTIL JUNE. >> SPEAKER: WHEN I SAY PART OF A BASE THAT HAS IS GONE IN A MONTH SOME OTHER THINGS. >> SPEAKER: CORRECT. >> SPEAKER: IT LOOKED LIKE A TARGET DATE IS NOVEMBER 30. THERE IS EVERYTHING ELSE IN PLACE FOR THEM TO REACH THOSE DATES AS FAR AS WE KNOW? >> SPEAKER: THIS IS BASED ON INFORMATION THAT THEY PROVIDED TO SCOTT. >> SPEAKER: THIS IS A SCHEDULE THAT THEY PROVIDED TO US AND WE ACCEPTED. >> SPEAKER: WE ARE IN THE MIDDLE OF FOOTBALL SEASON. >> SPEAKER: IF YOU ARE TAKING A CRANE DOWN, WE DON'T ALLOW -- YOU WILL SEE STREET CLOSURES AT TIMES WHEN THE FULL CRANES COME DOWN AND SO ON. THERE IS MUCH COORDINATION THAT GOES ON THAT WE DO NOT ALLOW FROM 10 AM OR SO ON FRIDAY MORNINGS THROUGH SUNDAYS FOR FOOTBALL WEEKENDS ANYTHING TO COME AND GO FROM SITES. WE ARE VERY SENSITIVE ABOUT THAT. >> SPEAKER: THINK YOU VERY MUCH PAR. ANY OTHER, TO QUESTIONS? WITH EMOTION AND SECOND. ALL IN FAVOR PLEASE SAY I. [8. CONSIDERATION OF CONSENT AGENDA.] ANY OPPOSE? MOTION CARRIES. I HAVE A MOTION TO APPROVE THE BALANCE OF THE CONSENT AGENDA. >> SPEAKER: SO MOVED. >> SPEAKER: SECOND. >> SPEAKER: MOTION AND SECOND. ALL IN FAVOR PLEASE SAY I. [9. ORDINANCES. ] ANY OPPOSE? CONSENT AGENDA IS APPROVED. ORDINANCES. >> SPEAKER: ITEM NINE A AUTHORIZES THE BAPTIST SCHOOL SALES PSYCHOLOGY TO EXEMPT CERTAIN ITEMS FROM CITY SALES TAX ON FRIDAY JULY 15 THROUGH SUNDAY JULY 17. UNANIMOUS CONSENT IS NECESSARY. >> SPEAKER: I'LL INTRODUCE THE INTRODUCE THE ORDINANCE AND ASK UNANIMOUS CONSENT. >> SPEAKER: SECOND. >> SPEAKER: MOTION AND SECOND FOR ANYONE ON THE COUNCIL HAVE A MOVING FORWARD WITH THE VOTE OF THIS THIS EVENING? UNANIMOUS CONSENT IS NECESSARY. >> SPEAKER: I WOULD CHOOSE THE ORDINANCE AND ASK UNANIMOUS CONSENT. >> SPEAKER: SECOND. >> SPEAKER: MOTION AND SECOND. DOES ANYONE ON THE COUNCIL HAVE A PROBLEM MOVING FORWARD WITH A VOTE ON THIS THIS EVENING? ANY, TO QUESTIONS FROM THE COUNCIL? OKAY ROLL CALL, LINDSAY? (ROLL CALL VOTE) >> SPEAKER: UNDER RESOLUTIONS [10. ANY COMMENTS OR QUESTIONS FROM THE COUNCIL? >> SPEAKER: THE ENGINEERING CONDITIONS OF APPROVAL SAID THAT THE BRYANT AVENUE HAS TO BE WIDENED. 'S THAT WIDENING AT THE EXPENSE OF THE CONTRACTOR OR THE CITY? >> SPEAKER: THAT WOULD BE AT THE EXPENSE OF THE DEVELOPER. >> SPEAKER: OKAY. THANK YOU. >> SPEAKER: ANY OTHER QUESTIONS? MOTION AND SECOND. ALL IN FAVOR PLEASE SAY I. ANY OPPOSE? MOTION CARRIES. [12. CITIZENS’ OPEN FORUM.] >> SPEAKER: MAYOR, THOSE ARE ALL OF THE ITEMS OF BUSINESS WE HAVE ON THE AGENDA. >> SPEAKER: THANK YOU. AT THIS TIME WE WILL OPEN THE FLOOR UP FOR CITIZENS OPEN FORM. THIS IS YOUR OPPORTUNITY TO SPEAK TO THE COUNCIL ABOUT ANYTHING THAT MIGHT BE ON YOUR MIND. WE ASK THAT YOU ADDRESS YOUR COMMENTS TO THE COUNCIL AND GIVE US YOUR NAME AND ADDRESS FOR THE RECORD AND YOU DO HAVE THREE MINUTES. TO SPEAK. >> SPEAKER: HEY, COUNCILMAN, MAYOR. MY NAME IS ROBERT WILKINS TO 61 BENSON DRIVE ALBERT ALABAMA. I WANT TO TALK ABOUT WHAT IS TRUTH. I REALLY APPRECIATE HAVING SOME FEEDBACK FROM ONE OF THE COUNCILMEMBERS AFTER THE COUNCIL MEETING THE OTHER DAY. THE COUNCIL MEMBER WAS FULL OF PASSION AND SAID I WAS NOT TELLING THE TRUTH AND THAT THE ORDINANCE 3288 SHORT-TERM RENTAL WAS FOR THE BETTER OF THE WHOLE. FIRST I WAS RAISED IN A FARM IN WEST ALABAMA. MY MOTHER WAS A HOME ECONOMICS TEACHER AND MY DAD WORKED FOR SOUTHERN NATURAL GAS. BETWEEN MY PARENTS, KINFOLK, MEMBERS OF THE COMMUNITY AND MY CHURCH, TRUTH WAS THE BEDROCK FOUNDATION OF MY UPBRINGING. DR. ALFRED JESSEN SAID TRUTH IS THAT WHICH IS CONSTANT AND UNCHANGEABLE. SOMETHING ON WHICH SOMEONE CAN RELY WHICH WILL PROVE TO BE TRUE IN THE FUTURE. JUST LIKE THE ENTRAPMENT THAT I BROUGHT UP LAST WEEK IS STILL TRUE TODAY. LAST MEETING. IF YOU TELL THE TRUTH, YOU DON'T HAVE TO REMEMBER ANYTHING BY MARK TWAIN. HENRY DAVID THOREAU, RATHER THAN LOVE, THAN MONEY, THAN FAME, GIVE ME TRUTH. I ONLY BELIEVE -- I BELIEVE IN TRUTH, I BELIEVE EACH ONE OF YOU BELIEVE IN TRUTH. SECOND, BETTER OF THE WHOLE, HOW IS THAT POSSIBLE WHEN HALF THE CITY CAN HAVE AIRBNB WHAT IS COMMITTING THE OTHER HALF? NO ONE CAN EXPLAIN THE BETTER OF WHAT IS THE HOLE AND WHAT IS THE BETTER. EXPLAINED TO ME HOW A CITY REVENUE DEPARTMENT EMPLOYEE TRIES TO MAKE FAKE RESERVATIONS WITH AN ALIAS NAME SUCH AS BROOKE AND JOHNNY, AIRBNB REQUIRES AN ID WITHIN 24 HOURS AND PROVIDING THAT THE PERSONS MAKING THE RESERVATIONS IS REAL. OF COURSE THE CITY EMPLOYEE HAD NO IDENTIFICATION WITH ALL OF HER ALIAS NAMES SO THE RESERVATION WOULD NEVER HAVE BEEN MADE. EXCEPT THE CITY OF AUBURN USED THE TACTICS BY ENTRAPPING HARD-WORKING ARMORED CITIZENS, EVIDENCE IN MANY ADMISSIBLE COURT HEARINGS ON ORDINANCE 3288. IF YOU WANT TO FIND SOME PROOF, GO TO THE AUBURN OPELIKA NEWS ON FRIDAY, THURSDAY THE AUBURN VILLAGER, GO TO THE MENISCAL COURT RECORDS OR ASK THE CITY MANAGER. I KNOW SHE HAS SOME FILES ON THIS, PROBABLY IT SAYS CRIMINAL PEOPLE. I DON'T KNOW. HOW DO YOU DECIDE ON ORDINANCE 3288? THERE IS NO DATA, NO RECOMMENDATION BY THE USELESS TASK FORCE. WASN'T BY THE CITIZENS OF YOUR WARD? [00:25:02] WAS ANOTHER COUNCILMEMBER? OR WAS IT BY MAYOR ANDERS? THIS ISSUE HAS BEEN HANDLED SO POORLY BY THE CITY ITS COUNCIL AND MAYOR WITH MANY UNANSWERED QUESTIONS LIKE WHY IS THE ORDINANCE MORE IMPORTANT THAN OTHER CITY ORDINANCES? MANY ARE BROKEN EVERY DAY. WHY WAS THE ZONING MAP USED TO DISCRIMINATE AGAINST CERTAIN AREAS, MANY CLOSE TO THE AUBURN UNIVERSITY? WHY DID THE MAYOR INTEND THE ORDINANCE -- AMEND THE ORDINANCE IN MARCH BACK TO ITS ORIGINAL LANGUAGE AFTER COUNCIL WITTEN HAD ALREADY AMENDED IT IN FEBRUARY? >> SPEAKER: THAT IS ENOUGH. THANK YOU. >> SPEAKER: WHO WILL BE NEXT? >> SPEAKER: GOOD EVENING. MY NAME IS LEAH BILLIE WILBURN I MET 112 NORTH PARLIAMENT STREET APARTMENT FIVE. I'M COMING UP TODAY TO ANNOUNCE MY RUN FOR CITY COUNCIL WARD FIVE. I SPOKE EARLIER WITH REPETITIVE DIXON WHO HAS TOLD ME HE WILL NOT BE SEEKING THE COLLECTION. RE-ELECTION. I WOULD LIKE TO SERVE THE CITY BOTH IN MY CAMPAIGN AND HOPEFULLY AS A REPRESENTATIVE IF ELECTED. SO I INVITE ANYONE WHO IS IN WARD 52 PLEASE REACH OUT TO ME. I WOULD LIKE TO PUT TOGETHER A CAMPAIGN THAT MAKES A DIFFERENCE WHETHER WE WIN OR LOSE. I'M NOT PARTICULARLY ATTACHED TO WINNING THE SEAT IF SOMEBODY ELSE COMES ALONG THAT WOULD LIKE MY SUPPORT BUT TIME WAS BEHIND THEM TO GET THAT SEAT FOR SERVICE, THAT WOULD BE JUST GREAT TOO. SO THANK YOU VERY MUCH, COUNCIL, AND I LOOK FORWARD TO WORKING WITH YOU GOING FORWARD. >> SPEAKER: THANK YOU. WHO WILL BE NEXT? WE WILL CLOSE THE CITIZENS OPEN FORM. >> SPEAKER: MAYOR, HAVE AN ANNOUNCEMENT. I BELIEVE SOME OF YOU, SOME COUNCIL KNOW BUT NOT ALL, FOR THOSE THAT DON'T KNOW, I HAVE RECENTLY WAS OFFERED A VERY LUCRATIVE JOB IN CENTRAL FLORIDA AND AS A RESULT, WILL BE MOVING AT THE END OF THIS MONTH AND RESIGNING FROM MY SEAT. THIS WILL BE MY LAST MEETING ON COUNCIL. IT HAS BEEN AN HONOR IS NOT THE RIGHT WORD TO SAY -- IT HAS BEEN , BUT IT HAS BEEN AN HONOR TO SERVE IN EACH ONE OF YOU AND COUNCIL. EACH OF YOU INSPIRE ME BY YOUR UNIQUENESS IN WHAT YOU BRING TO THE COUNCIL. HAS BEEN AN HONOR TO SERVE THE CITY AND IT HAS BEEN AN EVEN BIGGER HONOR TO ANSWER TO THE PEOPLE OF WARD FOUR. IT IS SOMETHING THAT I WILL ALWAYS HAVE FOND MEMORIES OF THIS WONDERFUL CITY. THE CITY IS A BEACON, SHINING BEACON ON A HILL THAT MANY OTHER CITIES COULD LOOK TO BE LIKE. THAT IS BECAUSE OF THE LEADERSHIP AND THAT LEADERSHIP IS NOT JUST SITTING UP HERE, IT IS CITY MANAGER, IT'S THE HEADS OF DEPARTMENTS, AND THAT EVERY EMPLOYEE THAT SPENDS THE DAY TO MAKE THIS PLACE BETTER. IT SHOWS AND I FULLY ANTICIPATE I WILL HAVE THREE DAUGHTERS WHO WILL BE RESIDENTS HERE PRETTY SOON, ATTENDING THE FINE UNIVERSITY HERE. WE WILL BE WITH FAMILY HERE AS WELL. I'M VERY THANKFUL OF THE PEOPLE THAT PUT THEIR FAITH IN ME. I HAVE MY FAITH IN EACH OF YOU TO SELECT MY REPLACEMENT AND I CERTAINLY HAVE THE FAITH AND THE PEOPLE TO VOTE FOR THE BEST ELECTION COME THIS NOVEMBER. I'M VERY THANKFUL FOR THIS OPPORTUNITY TO HAVE BEEN ABLE TO SERVE THE CITY. >> SPEAKER: THANK YOU. WE WERE HONORED -- I SPEAK FOR MYSELF, I WAS HONORED TO HAVE SERVED WITH YOU AND WISH YOU AND YOUR FAMILY THE BEST. I LOOK FORWARD TO OUR VISITS IN THE FUTURE. THANK YOU FOR YOUR HARD WORK REPRESENTING WARD 4 AND WE LOOK FORWARD TO CONTINUED SUCCESS IN CENTRAL FLORIDA AND I KNOW MY DAUGHTER WILL MISS HER STAR STUDENT IN THE DANCE. AT VARIATIONS. FROM A PRACTICAL MATTER, MEGAN, WHAT IS THE PROCESS THAT THE CITY COUNCIL WILL TAKE NOW TO MAKE AN APPOINTMENT TO FILL HIS TERM? >> SPEAKER: WE HAVE ENCOUNTERED THIS PERIODICALLY THROUGH THE YEARS. STATE CODE DICTATES HOW WE PROCEED. IN OUR FORM OF GOVERNMENT, WITH THE EXCEPTION OF THE MAYOR'S SEAT, WHEN A COUNCIL MEMBER VACATES AND COUNCILMAN SMITH HAS SAID IT GENERALLY WHEN HE IS MOVING, SO ONCE THE SEAT IS TECHNICALLY VACATED, WHICH IS THE VERY END OF THE MONTH OR SO, YOU ARE TO A POINT AT VERY NEXT REGULAR MEETING A REPLACEMENT, WHICH WOULD BE THE JUNE 7 MEETING. THAT PERSON APPOINTED AT THAT MEETING WILL SIT IN THAT SEAT FROM JUNE 8. IT WAS WHERE THIS PERSON IN ON [00:30:03] JUNE 8. THROUGH NOVEMBER 6, WHICH IS A SUNDAY IN NOVEMBER. AS I MENTIONED TO YOU BEFORE, A NEW COUNCIL DOESN'T SIT UNTIL THE FIRST MONDAY IN NOVEMBER. SO THE FIRST MONDAY IN NOVEMBER IS GOING TO BE ONE EXTRA COUNCIL MEETING THAT THIS COUNCIL SERVES COMPARED TO JUST HOW DAYS FALL. THIS PERSON WOULD SIT IN THAT SEAT FOR THAT PERIOD OF TIME. THE BOARDS AND COMMISSIONS POLICY DOESN'T COVER ANYTHING SPECIFIC TO THIS, IT IS COVERING BOARDS AND COMMISSIONS. IN MY EXPERIENCE, WE HAD RESEARCHED IN THE MINUTES AND THINGS JUST HOW THIS HAS BEEN DONE, IT WOULD BE NORMAL TO DISCUSS ANYBODY THAT THE COUNCIL IS POTENTIALLY INTERESTED IN AT THE COMMITTEE OF THE WHOLE MEETING. AND HAVE YOUR DISCUSSION THEY'RE LIKE TO DO WITH THE BOARD OF COMMISSION AND GENERALLY MAKE THE COMMISSION -- APPOINTMENT THERE. YOU WOULD RATIFY THAT DURING THE REGULAR MEETING. IN A RESOLUTION. IN TERMS OF THE PROCESS, IF YOU WANT FOLKS, IT HAS BEEN NORMAL IN THE RESEARCH THAT I'VE DONE AT THE PLEASURE OF THE COUNCIL THAT INTERESTED PARTIES WOULD CONTACT THE MAYOR AND PROVIDE SOME SORT OF LETTER OF INTEREST AND POSSIBLY A RESUME AND THEN THE MAYOR WOULD DESK -- DISSEMINATE THOSE AMONG THE COUNCIL. IT IS NOT SOMETHING USUALLY THE STAFF GETS INVOLVED IN, BUT WE ARE HAPPY TO POST ON THE WEBSITE WHATEVER YOU WISH TO ENCOURAGE PEOPLE TO APPLY FOR IT. I DON'T -- ON THE BOARDS AND COMMISSION PORTAL I DON'T INTEND ON OPENING IT FOR THAT. WE DON'T HAVE A PRESET UP THING. WE WOULD PUT SOMETHING OUT THERE ON OUR WEBSITE THAT WON'T BE UP LATER THAN THURSDAY MORNING. I ANTICIPATE IT WILL BE UP SOMETIME TOMORROW. ABOUT THIS ANNOUNCING IT AND TELLING PEOPLE HOW THEY CAN APPLY AND HOW TO GET IN TOUCH IF YOU GUYS CHOOSE TO BE IN TOUCH WITH THE MAYOR DIRECTLY. >> SPEAKER: ALL RIGHT. SO PEOPLE HAVE TO LIVE IN WARD FOUR AND WE ENCOURAGE OUR CITIZENS THAT IT IS TODAY'S VERSION OF WARD FOUR NOT THE FORMER VERSION OF WARD 4. IF YOU ARE A CITIZEN OF WARD 4 AND ARE INTERESTED IN SERVING IN THE SPOT, VERIFY YOU LIVE IN WARD 4'S BACK IN 90 IN WARD 4. >> SPEAKER: THAT YOU FOR CLARIFYING THAT. >> SPEAKER: WOULD BE FOLLOWING THE SAME IN TERMS OF IF YOU ARE QUALIFYING SOME OTHER THINGS WE HAVE TO CATCH UP ON SOME ETHICS COMMISSION FORMS AND SOME OTHER THINGS AND SOME APPOINTED ONES. >> SPEAKER: IF YOU ARE INTERESTED, PLEASE SEND ME A LETTER OF INTEREST. YOU ARE WELCOME TO CALL ME IF YOU WOULD LIKE TO DISCUSS THAT AND YOU WOULD SERVE UNTIL EARLY NOVEMBER. IT IS MY CONVICTION, MY BELIEF, AND I WOULD LIKE TO RECOMMEND TO THE COUNCIL, THAT THE PERSON THAT THE COUNCIL ULTIMATELY APPOINTS IS NOT A PERSON WHO WILL BE SEEKING THE SEAT THROUGH THE ELECTION IN AUGUST. IT IS MY BELIEF THAT IF WE WERE TO APPOINT SOMEBODY WHO WILL BE RUNNING FOR THIS SEAT, GIVES THEM A TWO MONTH HEAD START AND COULD BE VIEWED AS BEING UNFAIR. TO THE OTHER CANDIDATES WHO MIGHT BE INTERESTED IN RUNNING FOR WARD 4. I WOULD ENCOURAGE THE COUNCIL TO CONSIDER SOMEONE WHO IS NOT GOING TO BE RUNNING, THAT WANTS TO JUST SERVE FOR THE NEXT FEW MONTHS AND FINISH THIS TERM OUT. THAT WOULD BE MY REQUEST OF THE COUNCIL TO MAKE THAT CONSIDERATION. >> SPEAKER: SO IF A PERSON SAYS THAT THEY ARE INTERESTED IN THE POSITION AND NOT INTERESTED IN RUNNING BUT THEN THEY GET UP HERE DECIDE THEY WANT TO RUN, DO THEY HAVE AN OPPORTUNITY TO RUN AGAIN? >> SPEAKER: WE DON'T HAVE A MECHANISM TO PREVENT THEM FROM DOING THAT BECAUSE WE WILL APPOINT THEM ON JUNE THE 7TH AND THEY WILL BE SWORN IN ON JUNE 8. THE TIME. >> SPEAKER: JUNE 14 MOLLIFYING. >> SPEAKER: JUNE 28 IS A QUALIFYING DEADLINE. THEY COULD CERTAINLY CHANGE THEIR MIND IF THEY WANT TO, CONNIE.
