UNDER MAIRS ANNOUNCEMENTS TONIGHT I DO HAVE A NUMBER OF THINGS. I WANT TO THANK AUBURN BEAUTIFICATION COUNCIL, THEIR ANNUAL WINE AND CHEESE GATHERING WAS LAST NIGHT AND IT WAS A GOOD TIME TO REMEMBER ALL OF THE GREAT THINGS THAT THAT ORGANIZATION DOES FOR OUR CITY.

THEY WORK HAND-IN-HAND WITH AN -- NUMBER OF OUR DEPARTMENTS IN THE CITY AND MEMBERS OF OUR DEPARTMENTS HAVE SERVED ON THEIR BOARD AND ACTUALLY SERVE AS LEADERSHIP WITHIN THE AUBURN BEAUTIFICATION COUNCIL. THIS IS THE ORGANIZATION THAT THEY WILL BE HAVING A FALL PLANT SALE SOON AND THEY TAKE CARE OF OUR BEAUTIFUL HANGING BASKETS DOWNTOWN FOR I WANT TO THANK ALL OF THE PEOPLE AT LEE SCOTT ACADEMY FOR FEEDING OUR FIRST RESPONDERS BREAKFAST TODAY AND CELEBRATING ALL OF THE GOOD WORK. THANK THEM FOR DOING THAT.

FELTON LITTLE SO THAT PIECE OF LAND TO THE CITY FOR A DOLLAR A LONG TIME AGO AND IT HAS SERVED MANY USES IN OUR COMMUNITY AND WE ARE GOING TO PUT SOME ATTENTION TO THAT AND TALK ABOUT ITS HISTORY HERE IN A COUPLE WEEKS. I WANT TO THANK OUR FOLKS AT THE SGA FOR VOTER DRIVE TODAY. IT GOT WET BUT THEY TRIED HARD AND I WITH THEM FOR ABOUT 30 UNITS BEFORE THE SURPRISING RAINS CAME IN BUT I YOUR CONTINUED ENTHUSIASM FOR ENCOURAGING OUR STUDENTS TO BE A PART OF THE POLITICAL PROCESS FROM A VOTING STANDPOINT. WE NAMED THEM THE RECOGNIZED THEM AS THE CHILDHOOD CANCER AMBASSADORS FOR 2022. CHILDHOOD CANCER IS A VERY TENDER SITUATION THAT AFFECTS TOO MANY OF OUR CHILDREN AND CERTAINLY OUR CHILDREN HERE LOCALLY AND THAT'S WHY WE ARE WEARING THESE GOLD BUTTONS TONIGHT STRICT LAST WEEK THE RAIN COMMUNITY ARTS CENTER HAD ITS GRAND OPENING AND A NUMBER OF US WERE AT THE CEREMONY. WHAT A FANTASTIC ASSET THAT IS GOING TO BE FOR OUR COMMUNITY PURKETT IS GOING TO GIVE PEOPLE ANOTHER REASON TO COME TO AUBURN AND SPEND A LONG WEEKEND OR SPEND TIME. WE CERTAINLY ARE EXCITED ABOUT ALL OF THE POTENTIALITIES THERE. I WANT TO REMIND EVERYBODY IN OUR COMMUNITY, YOU HAVE BEEN REMINDED THAT THIS IS A DOUBLE HOMECOMING WEEK AND WE USUALLY DO THOSE ONE WEEK AT A TIME BUT NOT THIS YEAR. WE WILL DO THE BACK TO BACK.

TO START US OFF AS THE MAYOR MENTIONED WE HAS OUR VOTER REGISTRATION DRIVE TODAY AND IT ENDED UP BEING A REALLY SUCCESSFUL EVENT DESPITE THE RAIN. WE MOVED INSIDE AND A LITTLE SLOW TO START BECAUSE OF THAT THE BY THE TIME I LEFT WE WERE HAVING PEOPLE COME UP AND SCAN OUR QR CODES EVERY 30 SECONDS BUT WE HAD SEVERAL OUT OF STATE STUDENTS.

THAT IS ALL FROM THE.

PLEASE COME TO THE HOMECOMING PARADE AND ENJOY IT.

[6. CITIZENS’ COMMUNICATIONS ON AGENDA ITEMS]

>> SPEAKER: THANK YOU. AT THIS TIME CITIZENS COMMUNICATIONS ON TONIGHT ON ITEMS ON TONIGHT'S AGENDA TRICK IF YOU WOULD LIKE TO ADDRESS CITY COUNCIL PLEASE COME FORWARD AND GIVE US HER NAME AND ADDRESS FOR THE RECORD.

YOU WILL HAVE FIVE MINUTES TRICK THERE ARE A NUMBER OF THINGS ON OUR AGENDA TONIGHT THAT DO HAVE PUBLIC HEARINGS.

IF THE ITEM YOU WOULD LIKE TO THINK TO DO WAS TO SPEAK TO WE ASK THAT YOU WAIT UNTIL THE END TO ADDRESS CITY COUNCIL.

ANYONE? MOVE FORWARD WITH.

>> SPEAKER: [INAUDIBLE] >> SPEAKER: OKAY.

>> SPEAKER: MY NAME IS DR. DEJA REDDICK.

MY ADDRESS I LIVE IN OPELIKA SO IT'S 4150 ACADEMY DRIVE NUMBER 236. TONIGHT'S AGENDA INCLUDES A REQUEST TO SIGN A NEW CONTRACT BETWEEN AUBURN PUBLIC LIBRARY AND HORSHOE BEND REGIONAL LIBRARY.

MY NAME IS DR. DACIA RUDDICK AND AS THE REGIONAL LIBRARY DIRECTOR I WISH TO GIVE SOME CONTEXT AND EXPLAIN WHY AUBURN'S CONTINUED EXCLUSION IS SO CRUCIAL TO OUR LIBRARY TRICK THAT WE HAVE GONE THROUGH NAME CHANGES, THE HORSHOE BEND REGIONAL LIBRARY HAS BEEN SERVED COUNTIES IN ALABAMA FOR 80 YEARS.

AUBURN PUBLIC LIBRARY HAS BEEN PART OF OUR SYSTEM SINCE THEY OPENED IN 1960. WHILE TRADITION DOES NOT EQUAL OBLIGATION, IT DOES MEAN THAT YOUR LIBRARY AND OUR REGIONAL SYSTEM HAVE MUTUALLY BENEFITED FROM OUR ASSOCIATION FOR 62 YEARS. THOUGH WE HAVE BOTH GROWN SIGNIFICANT DURING THAT TIME, I FEEL STRONGLY THAT THERE ARE STILL REASONS TO KEEP ON TOGETHER.

[00:10:02]

AS PART OF THEIR INCLUSION IN OUR SYSTEM, AUBURN PUBLIC LIBRARY AND SEVERAL OTHER LIBRARIES PROVIDE US WITH HALF OF THEIR YEARLY STATE AID. THIS YEAR THAT AMOUNTS TO $45,846 FROM AUBURN AND THIS IS A SIGNIFICANT AMOUNT OF MONEY AND A SIGNIFICANT AMOUNT OF MONEY FOR US.

IT IS ABOUT 10 PERCENT OF OUR TOTAL OPERATING BUDGET.

IN FACT BECAUSE STATE AID IS BASED ON POPULATION, AUBURN STATE AID IS ALMOST EQUAL TO THE STATE AID FROM ALL OTHER LIBRARIES IN OUR REGIONAL SYSTEM COMBINED.

THIS STATE FUNDING WHICH AUBURN HAS SO GENEROUSLY SHARED WITH US FOR MORE THAN HALF A CENTURY HAS DONE INCALCULABLE GOOD AS IT HAS BEEN ROUTED THROUGH OUR REGIONAL LIBRARY, REDISTRIBUTED IN PART TO SMALLER LIBRARIES IN OUR SYSTEM AND USED TO BENEFIT ALL OF OUR OUTREACH PATRONS IN FOUR COUNTIES.

AUBURN DOORS HORSHOE BEND REGIONAL LIBRARY DOES TWO THINGS OF SIGNIFICANCE. WE SUPPORT TEN LIBRARIES IN OUR REGIONAL SYSTEM. THIS INCLUDES AUBURN PUBLIC LIBRARY BUT IT ALSO INCLUDES ALL STATE AID IN PUBLIC LIBRARIES IN PLEA, TELL AND SHE WAS A COUNTY. THAT INCLUDES THE ANGELIA AND RUSSELL LIBRARY AND ALEXANDER CITY, DAVE NEAL PUBLIC LIBRARY, ECLECTIC PUBLIC LIBRARY, GOOD WATER PUBLIC LIBRARY, WILL TOBRUK PUBLIC LIBRARY, OPELIKA ROCKFORD, TALLASSEE COMMUNITY LIBRARY AND THE TELCO. IF YOU RECOGNIZE THE NAMES OF THOSE TOWNS YOU KNOW THAT MANY OF THESE LIBRARIES ARE IN EXTREME SMALL UNDERSERVED RURAL AREAS.

NOT ALL LIBRARIES ARE AS PASSIONATELY AND GENEROUSLY FUNDED IS AUBURN'S. TO BE PERFECTLY FRANK, THE ENTIRE YEARLY BUDGET OF SOME OF THESE LIBRARIES IS EQUAL TO OR SIGNIFICANTLY LESS THAN THE AMOUNT OF STATE AID AUBURN SHARES WITH US. I WON'T NAME NAMES BUT ONE OF THESE LIBRARIES HAS A TOTAL OPERATING BUDGET OF ABOUT $26,000 PER THAT INCLUDES SALARY, BUILDING EVERYTHING.

SO THESE ARE SMALL LIBRARIES BUT THEY ARE MIGHTY FORCES IN THEIR COMMUNITIES. TO PROVIDE BOOKS AND ELECTRONIC RESOURCES WITH A TOTAL COMBINED CIRCULATION OF ALMOST 350,000 ITEMS A YEAR. THAT WAS LAST YEAR PER THEY HAVE COMPUTER LABS FOR SOME OF THE INTERNET AND THE LIBRARY IS THE ONLY LIBRARY THAT THE PEOPLE IN THE TOWN CAN ACCESS.

THEY RUN A STORY TIMES, THEY HAVE UKULELE LESSONS, THEY DO BOOK CLUBS AND GAME CLUBS AND ALL KINDS OF THINGS IN THEIR COMMUNITIES. JUST LIKE AUBURN THEY ARE THE CENTER OF THEIR TOWNS. WHEN WE REDISTRIBUTE STATE AID WE GIVE THEM THOUSANDS OF DOLLARS MORE THAN THEY WOULD OTHERWISE HAVE AND WE ALSO SUPPORT THEM AS A REGIONAL LIBRARY. THEY ARE OFTEN RUN BY PASSIONATE LIBRARIANS WHO MAKE LITTLE MORE THAN MINIMUM WAGE AND THEY RELY ON HORSHOE BEND READ MEETINGS. MY PERSONAL GUIDANCE IS THE REGIONAL DIRECTOR AND CONNECTION WITH OTHER DIRECTORS LIKE TYLER TO GUIDE THEM IN BEST PRACTICES. THE OTHER PART OF WHAT WE DO IS OUTREACH SO WE ARE A BOOKMOBILE AND OUTREACH LIBRARY OF OURSELVES. WE RUN MOBILE AND OUTREACH AND WE NOW GO TO 82 STOCKS THROUGHOUT ALL FOUR COUNTIES AND WE HAVE A WONDERFUL BOOKMOBILE LIBRARIAN FOR SOME OF OUR PATRONS. PEGGY TALK IS THE ONLY PERSON THEY SEE ALL WEEK. WE SERVE HOMEBOUND INDIVIDUALS, PEOPLE IN NURSING HOMES, A BUNCH OF DAY CARES, HOME SCHOOL FAMILIES AND ANYBODY ELSE WHO NEEDS ITEMS DELIVERED DIRECTLY TO THEM. I HAVE SEEN AUBURN'S GENEROUS YEARLY BUDGET AND I UNDERSTAND THAT UPCOMING PLANS INCLUDE FUNDING FOR OUTREACH VEHICLES AND A NEW OUTREACH LIBRARY AND.

TO SOME EXTENT THIS WILL MAKE THE OUTREACH WE PROVIDE IN AUBURN CITY LIMITS OBSOLETES. BUT JUST BEYOND YOUR CITY LIMITS WE HAVE DONE AND WILL CONTINUE TO DO A WORLD OF GOOD.

WHEN IT COMES DOWN TO IT I REALIZE AUBURN PUBLIC LIBRARY DOES NOT NEED HORSHOE BEND REGIONAL LIBRARY BUT LET ME BE PERFECTLY CLEAR. REGIONAL -- OUR REGIONAL LIBRARY NEEDS AUBURN PUBLIC LIBRARY. IF THEY WORK WITHDRAW FROM OUR ARRANGEMENT DESPITE OUR BEST EFFORTS IT IS LIKELY THAT OUR 80 YEAR REGIONAL LIBRARY WILL CRUMBLE AND THE SNOWBALL EFFECT OF THAT CRUMBLY WOULD DEAL A TERRIBLE BLOW TO THE LIBRARIES IN OUR SYSTEM AND THE LITERACY OF OUR STATES.

THE STATES ADULT ILLITERACY RATE IS 15 PERCENT PICKED OUR SERVICE AREA INCLUDES 2500 SQUARE MILES OF ALABAMA TURKISH LIBRARY SERVICE IN THAT AREA DISSOLVES, THE IMPACT WOULD BE PROFOUND.

THE CITY OF AUBURN CAN HELP US KEEP THAT FROM HAPPENING AND I URGE YOU WITH THE WEIGHT OF 59,256 TOTAL REGIONAL LIBRARY PAGES BEHIND ME TO CARRY FORWARD THE 60 YEAR RELATIONSHIP BETWEEN OUR TWO LIBRARIES AND SIGN THE CONTRACT YOU WILL HAVE A FOR A SNIPER THANK YOU LET ME KNOW IF YOU HAVE ANY QUESTIONS.

>> SPEAKER: THANK YOU VERY MUCH.

ANYONE ELSE? THERE WILL BE AN OPPORTUNITY FOR THE COUNCIL TO REMOVE THIS ITEM FROM THE AGENDA IF WE WOULD LIKE TO ASK SOME FURTHER QUESTIONS. I KNOW MS. WITTEN IS EVENTUALLY

[7. CITY MANAGER’S COMMUNICATIONS]

ABLE TO ANSWER SOME OF THESE. ANYTHING ELSE? NOW WE WILL MOVE ON TO THE CITY MANAGER'S MEDICATIONS.

>> SPEAKER: MAYOR, CITY MANAGER'S COMMUNICATIONS I WOULD LIKE TO HAVE THE ANNOUNCEMENT OF TWO VACANCIES ON THE BUILDING BOARD OF ADJUSTMENTS FOR TERMS THAT BEGIN NOVEMBER 3, 2022, AND END NOVEMBER THE 2ND 2026. THERE WILL ALSO BE THREE VACANCIES ON THE TREE COMMISSION FOR TERMS THAT BEGIN NOVEMBER 8, 2022, AND NOVEMBER 7, 2025. OUR NEXT ITEM OF BUSINESS IS THE

[8. CONSIDERATION OF CONSENT AGENDA]

[00:15:01]

CONSENT AGENDA. DOES ANY COUNCIL WISH TO REMOVE AN ITEM FROM THE CONSENT AGENDA AND DEAL WITH THAT ITEM

INDIVIDUALLY? >> SPEAKER: DO.

8G. >> SPEAKER: WOULD LIKE TO

REMOVE 8D10 PLEASE. >> SPEAKER: EIGHT D9.

ANYONE ELSE? >> SPEAKER: MATT GAETZ DE NINE AUTHORIZES RENEWAL OF HORSHOE BEND REGIONAL LIBRARY MEMBERSHIP AGREEMENT AUTHORIZES HORSHOE BEND REGIONAL LIBRARY TO RETAIN 50 PERCENT OF THE CITY'S ANNUAL AID ALLOCATION FROM THE ALABAMA

PUBLIC LIBRARY SERVICE. >> SPEAKER: MOVE FOR APPROVAL.

>> SPEAKER: SECOND. >> SPEAKER: MOTION AND SECOND.

MS. KRAUT, I WOULD LIKE FOR YOU TO REITERATE SOME OF THE THINGS THAT OUR SPEAKER JUST COMMUNICATED TO US.

THIS IS A PASS-THROUGH PROGRAM. >> SPEAKER: CORRECT.

I WILL HAVE OUR LIBRARY DIRECTOR SPEAK TO THIS AS WE GET YOUR QUESTIONS OUT AND GO FROM THERE AND I THINK ONE OF THE IMPORTANT NOTIONS IS SHE TOUCHED ON, WE DID FUND AN OUTREACH VEHICLE OF OUR OWN COMING UP AND THAT IS A HUGE SERVICE THAT LIBRARY DIRECTOR WOULD SPEAK TO. THAT THEY ARE PROVIDING.

ONE OF THE KEY THINGS IS THIS IS ALSO STATE PASS-THROUGH DOLLARS.

I WOULD LIKE TO ITERATE AND TYLER WILL CORRECT ME IF I'M WRONG IT SAID IT CAME TO THE COUNCIL BEFORE BECAUSE I THINK WE HAVE SEVERAL COUNCILMEMBERS THAT HAVE SERVED MULTIPLE TERMS. I HAVEN'T SEEN THIS BEFORE. THAT IS CORRECT, UNDER TYLER'S LEADERSHIP WE HAVE CORRECTED A FEW THINGS THAT THE LIBRARY BOARD ANNOUNCED TO THEM SHOULD NOT OF BEEN THE APPROVING AUTHORITY ON AND THIS IS ONE OF THEM.

THIS IS YOU. THAT IS WHY IT IS BEFORE YOU FOR THE FIRST TIME YOU ARE SEEING IS.

BUT I THINK IT IS ABSOLUTELY APPROPRIATE AT THIS TIME TO DISCUSS EXACTLY WHERE THESE FUNDS COME FROM AND HOW ARE THEY UTILIZED. TYLER CAN SPEAK TO THE SERVICES THAT ARE PROVIDED TO US AND WHAT THAT LOOKS LIKE MOVING FORWARD.

I THINK IT IS A BIG DECISION FOR YOU MOVING FORWARD AS YOU HEARD A LOT OF THE SERVICES THEY PROVIDE.

WILL BE PROVIDING ON OUR OWN BUT ALSO THERE IS A BIG RELIANCE ON THIS FUNDING FOR OTHER AREAS IN OUR REGION.

TYLER CLARK? >> SPEAKER: FOR US AS MEGAN WAS SAYING, CURRENTLY WE ARE RELYING ON THE HORSHOE BEND REGIONAL LIBRARY TO PROVIDE MONTHLY BOOKMOBILE STOPS TO A VARIETY OF PLACES IN AUBURN, INCLUDING DAY CARES AND OTHER ABILITIES OF THAT NATURE. BUT AS THE COUNCIL HAS BEEN VERY GENEROUS WITH THE LIBRARY GOING INTO FISCAL YEAR 23, INCLUDING THE OUTREACH AND THE ADDITIONAL PROGRAMMING SPECIALIST, WE ARE INCREASING SERVICES IN THAT AREA.

AND WE HOPE TO BE IN VERY GOOD SHAPE WITH OUTREACH AS WE MOVE INTO THE SPRING AND SUMMER OF 23.

SO WE DO PLAN TO TAKE OVER THOSE STOPS IN TERMS OF SERVICES NEEDED IN AUBURN. BUT AGAIN, THERE IS THE ISSUE OF THE RELIANCE ON THE SURROUNDING AREA.

>> SPEAKER: TYLER, CAN YOU SPEAK TO THE FUNDING? IT IS PASSED THROUGH STATE FUNDING COMING TO US AND 50 PERCENT IS ALLOCATED BACK TO HORSHOE BEND.

IT IS NOT JUST COMING FROM THE TAXPAYERS OF AUBURN.

THIS FUNDING. >> SPEAKER: THAT IS CORRECT.

THIS IS FUNDING THAT IS APPROVED BY THE LEGISLATURE AT $1.19 PER CAPITA IN FISCAL YEAR 23. AND WAS A DOLLAR 13 AND IS GOING UP. IF WE ARE A MEMBER OF A COLLECTIVE, THEN OUR STATE AID GOES TO THE COLLECTIVE.

THEY RETAIN 50 PERCENT AND THEY PASSED THE REMAINDER TO US IN FOUR QUARTERLY PAYMENTS. IF WE ARE NOT A MEMBER OF A COLLECTIVE, THE STATE AID COMES DIRECTLY TO THE CITY OF AUBURN.

TO BE USED HERE. >> SPEAKER: TYLER, CAN YOU ALSO EXPLAIN IN THE AGENDA REFERS TO IF YOU ARE GOING TO WITHDRAW YOU HAVE TO DO SO BY JULY 1. IS THAT STILL APPLICABLE?

>> SPEAKER: THAT IS CORRECT. THAT IS A GUIDELINE SET DOWN BY THE ALABAMA PUBLIC LIBRARY SERVICE.

THEY ASK THAT IF WE ARE GOING TO CHANGE OUR MEMBERSHIP, WHETHER WE ARE IN OR OUT OF THE COLLECTIVE, THAT THEY WOULD LIKE TO KNOW THAT BEFORE OR ON JULY 1 SO THAT THEY CAN CORRECTLY ALLOCATE STATE AID FOR THE COMING FISCAL YEAR WHICH ALSO STARTS FOR THEM ONE OCTOBER. SO IF WE ANNOUNCE BY JULY 1 THAT WE WOULD LIKE TO WERE NOT -- WITHDRAW, THEN THEY WOULD PLAN TO SEND ALL OF THE FUNDS TO US DIRECTLY AS OPPOSED TO SENDING THEM TO THE REGIONAL LIBRARY WHICH WOULD DISTRIBUTE SPECIAL SEE IT THERE WAS THEORETICALLY IS TOO LATE FOR FISCAL YEAR 23?

>> SPEAKER: THAT'S RIGHT UNLESS WE RECEIVE SOME SORT OF SPECIAL DISPENSATION TO WITHDRAW THIS YEAR.

WE WOULD HAVE TO FACE THAT WITH THE PUBLIC LIBRARY SERVICE IN

MONTGOMERY. >> SPEAKER: ANY OTHER QUESTIONS FOR TYLER? I DO WANT TO BE THE ONLY ONE.

[00:20:02]

>> SPEAKER: IS THIS TYPE TO ITEM 8D2?

>> SPEAKER: THE GRANT FUNDING --

>> SPEAKER: NO, SIR, THAT IS LIBRARY SERVICES AND TECHNOLOGY GRANT THAT WE APPLY FOR TO ENHANCE OUR HOLDINGS AT THE BOYKIN COMMUNITY CENTER. IT IS A SEPARATE INITIATIVE.

>> SPEAKER: OKAY. EVEN THOUGH THIS DOESN'T DIRECTLY BENEFIT AUBURN, I BELIEVE OUR WORKFORCE WITHIN AUBURN IS DRAWN FROM THE SURROUNDING COUNTIES SO I SEE THIS AS BENEFICIAL TO NEAR-TERM AND FUTURE WORKFORCE IMPROVEMENT. I WILL BE SUPPORTING THIS.

>> SPEAKER: ANY OTHER COMMENTS? >> SPEAKER: WILL THE CITY COUNCIL BE SEEING THIS RENEWAL EVERY YEAR GOING FORWARD? OR IS IT A MULTIYEAR TYPE OF CONTRACT?

>> SPEAKER: THE CONTRACT THAT IS IN THE AGENDA TONIGHT IS A FIVE YEAR CONTRACT WHICH IS WHAT HORSHOE BEND TYPICALLY REQUESTS.

I IMAGINE THAT WOULD BE UP TO THIS BODY HOW YOU HANDLE THAT

GOING FORWARD. >> SPEAKER: WE WOULD HAVE TO LOOK AT THE SPECIFICS OF THE CONTRACT AND WE WOULD HAVE TO DOUBLE CHECK. THERE IS LIKELY A WITHDRAWAL CLAUSE THAT WOULD ALLOW IT. WHAT IS IMPORTANT TO ME IS EVEN UNTIL MR. WOULDN'T AND I HAVE HAD A LOT OF DISCUSSIONS ABOUT THIS AND HE STEPPED INTO THE DIRECTOR WILL WE HAVE BEEN -- DOING A LOT OF WORK TO GET SOME THINGS TO THE COUNCIL.

THIS COUNCIL UNLIKE A LOT OF CITIES IN ALABAMA, THE LIBRARY IS DIRECTLY FUNDED BY THE CITY. A LOT OF LIBRARIES ARE INDEPENDENT FROM THE CITY. ONE OF THE THINGS IS THERE IS ALMOST UNUSUAL TO HAVE A GENERAL FUND FUND IS MUCH AS WE DO.

WE HAVE FRIENDS OF THE LIBRARY, WE HAVE OTHER FUNDING SOURCES, BUT THIS COMMUNITY HAS LONG BEEN COMMITTED TO EDUCATION IN THE LIBRARY IS PART OF THAT AND THE COUNCIL HAS BEEN STAUNCH ABOUT THAT FOR MANY YEARS. AND SO ONE OF THE YEARS THAT WAS THINGS WE HAVE BEEN LOOKING AT TO MAKE SURE THINGS ARE GOING BEFORE THE COUNCIL SINCE YOU VOTE TO FUND OR THE LIBRARY EVERY TIME WE DO THE BIENNIAL BUDGET, ALSO THAT YOU ARE MAKING SOME HIGH-LEVEL DECISIONS ABOUT THIS.

SO WE WOULD HAVE TO LOOK IF THERE IS A WITHDRAWAL CLAUSE OR

LOT. >> SPEAKER: THAT WITHDRAWAL CLAUSE IS IN THE ALABAMA PUBLIC LIBRARY SERVICE.

RULES. AND POLICIES.

SO EVEN THOUGH THIS IS A FIVE-YEAR AGREEMENT, THE LIBRARY IS RECEIVING STATE AID DO HAVE A YEARLY OPPORTUNITY TO CHANGE WHETHER THEY ARE IN A COLLECTIVE OR NOT.

>> SPEAKER: I HAVE ONE OTHER QUESTION.

IN TERMS OF YOUR OPERATING BUDGET, DOES THIS MONEY FACTOR

INTO IT AT ALL? >> SPEAKER: WE USE A STATE AID FUNDS, THE 50 PERCENT WE RECEIVE TO EXPAND THE E-BOOK COLLECTION TYPICALLY. IF WE WERE TO RECEIVE MORE, WE COULD RETHINK THAT. BUT IT WORKS WELL TO USE THAT FOR E-BOOKS BECAUSE THEY ARE EXPENSIVE RELATIVE TO PHYSICAL

MATERIALS. >> SPEAKER: TYLER, THIS MAY NOT BE A QUESTION FOR YOU AND I MIGHT BE A QUESTION FOR PREVIOUS SPEAKER, BUT HOW WOULD THESE REGIONAL SMALLER RULE LIBRARIES REPLACE THIS MONEY IF WE WERE NOT BE A PART OF THIS AGREEMENT?

>> SPEAKER: I COULD DEFINITELY SAY THEY WOULD HAVE A DIFFICULT TIME DOING THAT. THEY RELY ON THE FUNDS AS

DR. REDDICK SAID. >> SPEAKER: ANYONE ELSE HAVE A QUESTION? COMMENT? WE DO HAVE A MOTION AND SECOND. ALL IN FAVOR, PLEASE SAY AYE.

ANY OPPOSED? MOTION CARRIES.

>> SPEAKER: ITEM EIGHT DETENT TENURE CONTRACT WITH ANIMAL SHELTERING SERVICES PER THE CONTRACT AMOUNT OF $201,331 HAS BEEN ESTABLISHED FOR FISCAL YEAR 2023 ADDED AMOUNT TO BE NEGOTIATED FOR FISCAL YEAR 2024 WHICH WILL BE BASED ON THE CITY'S PRO RATA SHARE OF SOCIETY.

>> SPEAKER: MOVE FOR APPROVAL. >> SPEAKER: MOTION AND SECOND.

MR. GRISWOLD I THINK YOU HAD THIS REMOVED.

>> SPEAKER: >> SPEAKER: DURING OUR BUDGET DISCUSSIONS WE HAD SOME DISCUSSION ABOUT THE POSSIBILITY OF INCREASING OUR CONTRIBUTION TO THE HUMANE SOCIETY.

HOW DOES THIS COMPARE WITH WHAT WE HAVE DONE IN THE PAST?

>> SPEAKER: I WILL HAVE BETWEEN A COOK SPEAK TO THIS TRICK IF I WERE A MEMBER THE, WE CLARIFIED THAT THE ANIMAL SHELTERING SERVICES FEES THAT WE ARE PAYING IS PRO RATA BASED ON WHAT SERVICES WERE PROVIDED IN THE LAST YEAR SO THERE IS -- ISN'T A FORMULA FOR AN EXTRA ASK OF FUNDS.

>> SPEAKER: THAT'S CORRECT. WE PAY OUR SEVEN DAY HOLD FEE PER ANIMAL TAKEN IN. WHETHER IT'S AN ANIMAL CONTROL SERVICE OR ANY MEMBER OF THE PUBLIC, WE PAY THAT PORTION.

>> SPEAKER: OUT IS THAT AMOUNT DETERMINED, THAT $1.70.

>> SPEAKER: THAT IS DETERMINED AT THE SHELTER ITSELF.

THEY ASSESS EACH ANIMAL AND THEY DETERMINE WHAT EACH ANIMAL NEED FOR THERE ARE SHOTS, THERE ARE PEELS AND ANOTHER ENDORSED A

[00:25:02]

NUMBER OF PHARMACY AND THAT CARE FOR EACH ANIMAL THAT IS THERE TO MAKE SURE THAT THEY ARE NOT SICK OR INJURED AND THEY ARE PROCESSED WHILE THEY ARE TAKING CARE OF.

AT SEVEN DAY HOLD IS A BASIC A $20 NIGHT AND THOSE OTHER FUNDS COME FROM THE PRESCRIPTION GIVEN TO EACH ANIMAL.

>> SPEAKER: I'M ASSUMING SINCE THE HUMANE SOCIETY'S PARTY TO THIS CONTRACT THAT THEY ARE COMFORTABLE WITH THAT AMOUNT?

>> SPEAKER: THIS IS THE AMOUNT THAT THEY SUBMITTED TO US.

>> SPEAKER: OKAY. >> SPEAKER: KATRINA, WE HAVE NOT HAD OTHER REQUESTS FOR FUNDING FROM THEM?

>> SPEAKER: WE HAVE NOT HAD ANY OTHER REQUESTS FOR FUNDING.

>> SPEAKER: THANK YOU. ANY OTHER COMMENTS OR QUESTIONS FOR EITHER OF MS. COOK OR THE CITY MANAGER? CERTAINLY KATRINA, I REALLY APPRECIATE ALL OF THE GREAT WORK THAT LEE COUNTY HUMANE SOCIETY DOES ON BEHALF OF THE CITY.

WE CREATE A LOT OF WORK FOR THEM IN OUR COMMUNITY AND THEY DO IT WITH A SMILE AND THEY ARE ACTIVE AND ALWAYS POSITIVE ON SOCIAL MEDIA. ALWAYS RAISING MONEY AND AWARENESS TO OUR COMMUNITY AND I KNOW YOUR DEPARTMENT, YOU ARE THE PRIMARY CONTACT WITH THEM SO PLEASE TELL THEM FOR ALL OF

THEIR HARD WORK. >> SPEAKER: I SURE WILL.

WE WOULD NOT BE ABLE TO DO OUR JOBS WITHOUT THEM.

THANK YOU FOR SAYING THAT. >> SPEAKER: AND THEY ARE ALWAYS

LOOKING FOR VOLUNTEERS. >> SPEAKER: ALWAYS.

>> SPEAKER: ANY THING ELSE? ALL IN FOR? ANY OPPOSED? MOTION CARRIES.

>> SPEAKER: ITEM AUTHORIZES EXECUTION OF SETTLEMENT AGREEMENTS AGREEMENT IN THE OPIOID LAWSUIT IN THIS PARTICULAR SETTLEMENT INVOLVES MCKESSON AND JANSSEN ALSO KNOWN

AS JOHNSON & JOHNSON. >> SPEAKER: MOVE FOR APPROVAL.

>> SPEAKER: SECOND. >> SPEAKER: MOTION AND SECOND.

I ASKED FOR THIS TO BE REMOVED. MIST CROUCHED, I WOULD LIKE TO GET A GENERAL EXPLANATION FOR OUR AUDIENCE AND COMMUNITY

WHAT'S GOING ON ON WITH THIS. >> SPEAKER: I WILL GIVE IN NONATTORNEY SPEAK MY LENS AND THEN I WILL ASK BOTH THE CITY ATTORNEY RICK DAVIDSON AND OUR OUTSIDE COUNCIL CHRISTINE CRUZ WHO HAS BEEN HANDLING THIS TO BRING THAT UP FROM A LEGAL PERSPECTIVE. OVERALL SEVERAL YEARS AGO THERE WAS A MEMO IN YOUR PACKET THAT CITY COUNCIL, THIS CITY AND MANY CITIES IN ALABAMA WERE ASKED TO JOIN IN AND OPIOID LAWSUIT.

THE STATE HAS BEEN PURSUING PHARMACEUTICAL COMPANIES AS MANY STATES AND NATIONAL SUITS HAVE BEEN FILED.

THIS IS THE FIRST SETTLEMENT AGREEMENT I AM BRINGING FORWARD TO YOU. I WOULDN'T BRING IT FORWARD OR SUGGEST THAT EVEN THOUGH WE JOINED IN THIS AND I THINK IT IS ALL BUT FOUR JURISDICTIONS. FIVE.

IN ALABAMA THERE ARE OVER 10,000 THAT ARE PART OF THIS SUIT.

I THINK THE KEY THING WITH THESE FUNDS IS IF WE WERE GOING TO RECEIVE FUNDS FROM AND OPIOID SUITS COULD BE USE THE FUNDS PRETTY THERE ARE A COUPLE OF PUBLIC SAFETY THINK THAT WE ARE ALREADY DOING THAT ARE ELIGIBLE FOR THE FULL SETTLEMENT AGREEMENTS ARE IN YOUR PACKET AND ON THE WEBSITE FOR THE PUBLIC TO VIEW. THAT IS 100 PERCENT OF THEM.

THERE ISN'T ANY OTHER DOCUMENTS. I THINK IT'S IMPORTANT TO UNDERSTAND THAT WE ARE JOINING IN BUT WE'RE WE ARE ALSO JOINING IN IN A MANNER THAT WILL ALLOW SOME FUNDING TO GO FOR SOME PREVENTION AND/OR RESPONSE WHEN PEOPLE DO OVERDOSE OR HAVE ISSUES. I WILL HAVE ANY FURTHER QUESTIONS OR INFORMATION OUR LEGAL COUNCIL WOULD LIKE TO PROVIDE. AND AGAIN, THIS IS CHRISTINA

CROW. >> SPEAKER: THANKS FOR BEING

HERE. >> SPEAKER: THANK YOU ALL FOR PARTICIPATING IN THE LITIGATION. IS IMPORTANT FOR THE PEOPLE OF THE STATE OF ALABAMA TO ADDRESS THE OPIOID EPIDEMIC AND TO TRY TO COME UP WITH EFFECTIVE WAYS TO REDUCE THE EFFECT IT IS

HAVING ON OUR COMMUNITIES. >> SPEAKER: ANY QUESTIONS? OKAY. THANK YOU SO MUCH.

>> SPEAKER: THANK YOU. >> SPEAKER: ANY OTHER COMMENTS

OR QUESTIONS FOR CITY MANAGER? >> SPEAKER: THIS WAS THE TOPIC

OF THE SPECIAL SESSION. >> SPEAKER: WE CANNOT DISCUSS OUR TOPICS OF EXECUTIVE SESSION. IT WAS JUST FOR PENDING

LITIGATION. >> SPEAKER: I CAN'T CONFIRM OR DENY THAT, MR. GRISWOLD. (LAUGHTER) ANYBODY ELSE? WE HAVE A MOTION AND SECOND ALL IN FAVOR, PLEASE SAY AYE. ANY OPPOSED? THE MOTION CARRIES DO I HAVE A MOTION TO APPROVE THE BALANCE OF

THE CONSENT AGENDA? >> SPEAKER: SO MOVED.

>> SPEAKER: SECOND. >> SPEAKER: ALL IN FAVOR, PLEASE SAY AYE. ANY OPPOSED?

[9. ORDINANCES]

CONSENT AGENDA IS APPROVED. >> SPEAKER: UNDER ORDINANCES THIS EVENING ITEM 9A WANT REQUEST FROM MATT COBB ON BEHALF OF AU ALLIANCE TO NX APPROXIMATELY 7.90 ACRES LOCATED ON THE NORTH SIDE OF BEEHIVE ROAD AND WEST OF AUBURN TECHNOLOGY PARK WEST FOR A PROJECT KNOWN AS SONIC TOOLS PER THE PLANNING COMMISSION UNANIMOUSLY RECOMMENDED ITS APPROVAL ON ITS AUGUST 11 MEETING.

UNANIMOUS CONSENT IS REQUIRED. >> SPEAKER: I WOULD INTRODUCE

[00:30:02]

THE ORDINANCE AND ASKED FOR UNANIMOUS CONSENT.

>> SPEAKER: SECOND. >> SPEAKER: MOTION AND SECOND.

DOES ANYONE ON THE COUNCIL HAVE A PROBLEM MOVING FORWARD WITH A VOTE ON THIS THIS EVENING? ANY COMMENTS OR QUESTIONS? LINDSAY? (ROLL CALL VOTE)

>> SPEAKER: ITEMS NINE TO MATT COBB ON BEHALF OF AU ALLIANCE LOC LLC TO REZONE OR POSSIBLY NINE ACREAGE FROM RURAL TO INDUSTRIAL FOR PROPERTY LOCATED ON THE NORTH SIDE OF BEEHIVE ROAD SONIC TOOLS. PLANNING COMMISSION RECOMMENDED APPROVAL OF THIS REQUEST BY A VOTE OF SIX TO THREE AT ITS AUGUST 11TH MEETING. UNANIMOUS CONSENT IS NECESSARY AT AND A PUBLIC HEARING IS REQUIRED.

>> SPEAKER: I WILL INTRODUCE THE ORDINANCE AND ASKED FOR

UNANIMOUS CONSENT. >> SPEAKER: SECOND.

>> SPEAKER: MOTION AND SECOND. DOES ANYONE ON THE COUNCIL HAVE A PROBLEM MOVING FORWARD WITH A VOTE ON THIS THIS EVENING? SEEING AND HEARING THEN WE WILL OPEN THE PUBLIC HEARING.

IF YOU WOULD LIKE TO ADDRESS THE CITY COUNCIL WE ASK THAT YOU PLEASE COME FORWARD AND GIVE US YOUR NAME AND ADDRESS FOR THE RECORD. SEEING NO ONE WILL CLOSE THE PUBLIC HEARING. ANY COMMENTS OR QUESTIONS FROM THE COUNCIL? LINDSAY, ROLL CALL.

(ROLL CALL VOTE) >> SPEAKER: ITEM 9A3 REQUEST FROM TJ JOHNSON OF HOLLAND HOMES ON BEHALF OF SCOTT HANSEN SARAH HENDRICKS AND HANSON GRIMES LAND LLC TO APPEASE OWN APPROXIMATELY 156.27 ACRES FROM RURAL TO LIMITED DEVELOP A DISTRICT FOR PROPERTY LOCATED AT 943 LEE ROAD 57 ALSO KNOWN AS WILLIS TURK ROAD IN THIS PROPERTY IS ALSO ALONG WIMBERLY ROAD FOR A PROJECT KNOWN AS THE STABLES. THE PLANNING COMMISSION RECOMMENDED DENIAL OF THIS REQUEST BY A VOTE OF EIGHT TO ONE AT ITS AUGUST 11 MEETING. THE APPLICANT HAS REQUESTED THAT THIS ITEM BE POSTPONED TO DECEMBER 6, 2022.

UNANIMOUS CONSENT IS NECESSARY AND A PUBLIC HEARING IS REQUIRED

>> SPEAKER: I WILL INTRODUCE THE ORDINANCE AND ASKED FOR

UNANIMOUS CONSENT. >> SPEAKER: SECOND.

>> SPEAKER: MOTION AND SECOND TRICK ANYONE ON THE COUNCIL DOES ANYONE ON THE COUNCIL HAVE A PROBLEM MOVING FORWARD WITH A VOTE ON THIS THIS EVENING? GO AHEAD AND OPEN THE PUBLIC

HEARING. >> SPEAKER: VOTING ON A

POSTPONEMENT. >> SPEAKER: NO, YOU ARE NOT VOTING ON A POSTPONEMENT TRICK TO CLARIFY, THE APPLICANT IS REQUESTING THIS. IT WOULD BE HIGHLY UNUSUAL IN TERMS OF POSTPONEMENT TYPICALLY, WHEN THE COUNCIL NEEDS INFORMATION. OR IS REQUESTED INFORMATION THEY CANNOT RECEIVE TO MAKE A DECISION.

THAT FLOWS A LITTLE DIFFERENTLY THAN PLANNING COMMISSION WHEN REQUESTS ARE MADE THEY ARE TRICK THE REASON OF FLOW DIFFERENTLY IS THE ZONING ORDINANCE AS YOU HAVE 60 DAYS BETWEEN PLANNING COMMISSION AND CITY COUNCIL TO ACT.

ON ZONING REQUESTS UNLESS YOU HAVE A REASON TO POSTPONE THEM.

AND SO IT IS AN UNUSUAL REQUEST TO POSTPONE SOMETHING THIS FAR ALONG. THE APPLICANT ALSO HAS THE OPPORTUNITY TO WITHDRAW TO THE PLANNING COMMISSION IF THEY WOULD LIKE TO APPLY -- HAVE DIFFERENT ANIMATION -- INFORMATION. WAY OUTSIDE OF THE 60 DAYS UNLESS THE CITY COUNCIL MEMBERS THEMSELVES HAVE A REASON THEY NEED TO DO SO SPECIAL THE CITY COUNCIL DOES NOT HAVE A REASON TO DO THIS, THEN WE CANNOT CONSIDER THE POSTPONEMENT.

>> SPEAKER: THAT IS UP TO YOU. IN TALKING WITH OUR LEGAL COUNCIL, THERE WAS A PREVIOUS CASE THAT WANTED TO KIND OF POSTPONED INDEFINITELY DUE TO THE 60 DAY RULE AND I WAS ADVISED BY THE CITY ATTORNEY THAT BECAUSE OF THE CITY -- 60 DAY RULE IN THEIR THERE ARE PREFERENCES UNLESS YOU HAVE SOMETHING THAT A MEMBER OF THIS BODY NEEDS A PIECE OF INFORMATION WHERE YOU ARE NOT PREPARED TO MAKE A DECISION OR WE CANNOT PROVIDE YOU WITH THIS TIME, THEN YOU POSTPONE.

IT IS UNUSUAL TO POSTPONE SOMETHING SEVERAL MONTHS MORE THAN 24 MONTHS AWAY. THEIR STATED REASON IS THEY WANT TIME TO ACQUIRE SANITARY SEWERS WITH A GRAVITY -- GRAVITY SEWER TRICK THERE ARE A LOT MORE THINGS GOING ON WITH THIS AND

GRAVITY SEWER. >> SPEAKER: IF I MAY.

MISS CROUCH, YOU AND I HAVE HAD BEEN NUMEROUS DISCUSSIONS ABOUT THIS. IT IS APPARENT THAT THE CITY IS NOT PREPARED TO MOVE FORWARD IN THIS AREA DUE TO INFRASTRUCTURE AND THINGS OF THAT NATURE. ANY TIME IN THE NEAR FUTURE.

>> SPEAKER: THAT'S CORRECT. THIS IS IN THE LAND USE PLAN DESIGNATED AS RULE AND WE HAVE MADE ZERO PLANS FOR

INFRASTRUCTURE IN THIS AREA. >> SPEAKER: IF WE WERE TO PUT IT OFF THROUGH -- UNTIL DECEMBER YOU STILL WON'T BE READY TO MOVE

FORWARD. >> SPEAKER: THAT'S CORRECT.

>> SPEAKER: HOWEVER I DO THINK THIS WOULD HAVE BEEN A GREAT PROJECT AND I THINK IT IS COMING EVENTUALLY.

I WOULD ENCOURAGE -- I DON'T KNOW IF IT'S TOO LATE FOR THIS TO HAPPEN OR NOT -- I WOULD ENCOURAGE THE APPLICANT TO

[00:35:01]

REMOVE THEMSELVES FROM THE AGENDA TONIGHT IF THAT'S POSSIBLE AND WORK WITH THE CITY TO MAKE THIS HAPPEN IN THE FUTURE WHEN THE CITY IS PREPARED TO MOVE THAT FAR.

THIS IS A PROBLEM THAT ANY CITY WOULD BE GLAD TO HAVE TO DEVELOP AND I THINK IN THE FUTURE IT WILL BE GOOD.

I HATE TO BE WHERE I CAN'T SUPPORT MOVING FORWARD TONIGHT BECAUSE I AM BIG ABOUT PROPERTY RIGHTS AND THINGS OF THAT NATURE BUT UNFORTUNATE THE CITY JUST NOT READY FOR THAT TYPE OF DEVELOPMENT. THAT FAR OUT TO.

I DO THINK IF IT WERE TAKEN OFF THE AGENDA TONIGHT BY THE APPLICANT AND WORK ON IT FOR THE NEXT SIX MONTHS TO A YEAR OR WHATEVER I THINK IT WOULD HAVE A GOOD CHANCE OF GETTING SOMETHING DONE IN THE FUTURE. BECAUSE THE CITY COULD WORK WITH THE APPLICANT AND MAYBE MAKE SOMETHING HAPPEN.

LIKE I SAID IT IS A GREAT PROBLEM FOR A CITY TO HAVE BUT THE CITY IS JUST -- EVERYONE KNOWS I AM PRODEVELOPMENT AND GIVING PEOPLE -- BUT THE CITY IS NOT THERE YET.

YOU AND I HAVE TALKED ABOUT IT AND TALKED ABOUT IT TO NO END AND I JUST RATHER THAN PULL IT TONIGHT IF THAT IS STILL POSSIBLE. AND IF THEY WANT TO DO THAT.

>> SPEAKER: THAT IS CERTAINLY UP TO THE APPLICANT.

>> SPEAKER: SURE, IF THAT WERE TO HAPPEN, IF THE APPLICANT MADE THAT DETERMINATION, COULD THEY MAKE THAT REQUEST DURING THE

PUBLIC HEARING? >> SPEAKER: THEY COULD MAKE THE REQUEST WHATEVER THEY WISH. THERE IS ALSO AN IMPORTANT NOTION IN THE ZONING ORDINANCE THAT SAYS THERE IS PLANNED DEVELOP A DISTRICT ACTION THAT FOLLOWS ON THIS.

IF YOU HAVE MADE A DECISION ON THAT, IF YOU HAVE DECIDED VOTED ONE WAY OR THE OTHER ON IT, ONCE YOU HAVE MADE A DECISION ON IT YOU HAVE TO WAIT 12 MONTHS TO COME BACK.

IF IT IS WITHDRAWN, THE APPLICANT HAS A RIGHT TO CONTINUE OR NOT CONTINUE, THAT IS UP TO THEM BUT THERE IS NO SUCH TICKING CLOCK. THEY COULD COME BACK AT ANY TIME BY GOING TO THE PLANNING COMMISSION.

>> SPEAKER: HELP ME TO GET THIS RIGHT TRICKS PARTS OF THE CITY MANAGER AND THE STAFF HAVE ADVISED US THAT POSTPONEMENT IS NOT A TOOL THAT COULD BE UTILIZED.

>> SPEAKER: ULTIMATELY IF YOU WANT TO UTILIZE I AM TELLING YOU YOU HAVE BEEN CAUTIONED, BUT THAT IS UP TO YOU.

YOU ARE THE GOVERNING BODY, YOU CAN ABSOLUTELY MAKE A DECISION.

IT IS HIGHLY UNUSUAL FOR A LENGTHY POSTPONEMENT WHEN THE APPLICANT IS ASKING FOR MORE TIME, NOT THE GOVERNING BODY.

THAT IS MY RESPONSE TO THAT. BUT IF THIS IS WHAT YOU WANT TO

DO, THAT IS CERTAINLY YOUR CALL. >> SPEAKER: FOR EXTRA CLARIFICATION, THE APPLICANT HAS A CHOICE, HAS MADE A CHOICE TO POSTPONE, A REQUESTED POSTPONEMENTS, OR THE OTHER

CHOICE WOULD BE TO WITHDRAW. >> SPEAKER: OR WITHDRAW OR YOU CAN MOVE FORWARD AND ACT ON THESE AGENDA ITEMS. THE 60 DAY RULE WAS PUT INTO PLACE WHERE IT HAD TO GO TRICK FOR YOU TO HAVE APPLICANTS THAT WOULD SIT THINGS SIX, NINE, 12 MONTHS BETWEEN PLANNING COMMISSION AND CITY COUNCIL WAITING ON THINGS TO HAPPEN AND FOR US, WE NEED THINGS TO MOVE FORWARD. WE HAVE PROCESSES WE FOLLOW, WE HAVE FILED TO MAINTAIN. IF YOU ARE NOT READY -- AND I'M NOT SAYING THAT IS THE CASE WITH THIS APPLICANT, GENERALLY SPEAKING WHY THE RULE WAS MADE IS IF YOU ARE NOT READY TO MOVE FORWARD TO THE CITY COUNCIL WITH SOMETHING WHO WAS A FINAL ARGUMENT -- ARBITER, THEN YOU SHOULD WAIT TO SUBMIT UNTIL YOU ARE. IN THIS CASE THE APPLICANT HAS PROVIDED INFORMATION AND THEY HAVE MET WITH STAFF AND PROVIDED INFORMATION, BUT WHERE WE ARE CHALLENGED IS THIS AREA IS SLATED TO BE RULE IN THE LAND PLAN ALL THE WAY TO 2030.

WE ARE NOT IN 2030. WE HAVE MADE NO PLANS, WATER IS LOACHAPOKA WATERPARK IF THEY SAID THEY CAN SERVE THAT'S FINE FOR THAT THERE IS A HOLD AREA OUT THIS OUT HERE AND IF THIS WHOLE AREA WERE TO CHANGE TO THE STYLE OF ZONING, MR. CUMMINGS, HOW MANY LOCKS COULD SOMEBODY THEORETICALLY GENERATE OUT

THERE? >> SPEAKER: IF YOU CONTINUE THIS TYPE OF ZONING IT COULD GO ANYWHERE FROM 1200 TO 4000 LOTS.

>> SPEAKER: IN THIS WHOLE AREA SLATED RULE AND THAT IS WHERE OUR CONCERN IS. WE HAVE NOT STUDIED THIS FOR DENSER DEVELOPMENT AT THIS TIME AND OUR LAND USE PLAN AND ALL IN FOR STRUCTURE PLANS HAVE ALL SUGGESTED THIS THE RULE FOR THE TIME BEING. AND SO WE ALSO HAVE ANOTHER 2300 OR SO VACANT LIGHTED LOTS THAT ARE EITHER VACANT OR UNDER CONSTRUCTION SO WE HAVE A LOT OF INVENTORY GOING AND HOW MANY ACRES DO WE HAVE, SCOTT'S NECK IS TO BE DEVELOPED?

>> SPEAKER: I THINK ROUGHLY ABOUT 10,000 ACRES.

>> SPEAKER: ALREADY ENTITLED TO BE DEVELOPED IN SOME WAY OR ANOTHER. FROM A ZONING PERSPECTIVE TRICK THAT IS WHY YOU A LAND USE PLAN TRICK AND INFRASTRUCTURE PLAN.

THAT IS WHERE STEPH IS COMING FROM ON THIS BUT YOU ARE THE GOVERNING BODY AND THIS IS SURELY YOUR DECISION.

[00:40:03]

>> SPEAKER: IF WE PUT IT OFF TO DECEMBER, THEN THEIR OPTION THEY HAVE TO START ALL OVER AGAIN, WAIT A YEAR.

>> SPEAKER: A YEAR IS FROM THE LANING COMMISSION APPLICATION PROCESS. IT WOULD NOT BE AS LONG OF A YEAR BUT AGAIN, WAITING UNTIL DECEMBER I CAN TELL YOU STAFF IS NOT GOING TO HAVE VERY FEW ANSWERS FOR YOU MORE THAN WE HAVE TODAY ABOUT A PROJECT. THE OTHER THING WE WILL SEE IN FURTHER ACTIONS WHICH AREN'T THIS AGENDA ITEM WE HAVE PREPARED NOTE LAND DEVELOPMENT DISTRICT OF WHY HAVE WE NOT PREPARED ONE CARD BECAUSE THIS IS SO FAR OUT OF OUR PLANNING RANGE IN TERMS OF WHAT WE WERE EXPECTING THAT WE HAVE MADE NO PLANS FOR A DEVELOPMENT AGREEMENT.

WE ARE NOT READY WITH ANY INFORMATION BECAUSE WE WERE NOT EXPECTING THIS AREA TO DEVELOP TO THIS LETTER -- LEVEL OF DENSITY. WE WERE EXPECTING TO BE 3-ACRE

LOTS. >> SPEAKER: I DON'T KNOW IF ADVANTAGE IS THE RIGHT WORD, BUT I WANT TO MAKE IT CLEAR THAT THEY CAN UNDERSTAND AND I UNDERSTAND AS WELL.

IF WE DON'T PULL IT OFF, AND IT IS DENIED UNTIL DECEMBER AND NOT PASSED, WE HAVE TO WAIT UNTIL THE PLANNING COMMISSION TO COME BACK IN. IF THEY DO PULL IT OFF, THEY

COULD BRING IT UP ANYTIME. >> SPEAKER: THAT'S CORRECT.

>> SPEAKER: I BELIEVE FOR CLARIFICATION IS 12 MONTHS FROM

THE DATE OF DENIAL. >> SPEAKER: MR. FOOT, I THINK IS THE DATE OF APPLICATION BASED ON THE HAMILTON PLACE SITUATION.

>> SPEAKER: OKAY. >> SPEAKER: WILL HAVE TO LOOK.

I DON'T HAVE THE ZONING ORDINANCE IN FRONT OF ME.

WE COULD LOOK THAT UP IN THE PLANT DEVELOPMENT.

I THINK IT IS FROM WHEN THEY PLANNING COMMISSION FIRST

CONSIDERED IT. >> SPEAKER: THE 12 MONTHS COULD BE WAIVED IF THEY HAVE A SIGNIFICANT CHANGE, IS THAT CORRECT? WE HAVE RECENTLY DONE THAT WITH THE PROPERTY BEHIND PUBLIC SUSPECT THAT AS OF THE SOLE DISCRETION OF THE PLANNING COMMISSION.

>> SPEAKER: BUT THAT IS NOT A HARD AND FAST 12 MONTHS?

>> SPEAKER: IT IS A HARD AND FAST 12 MONTHS UNLESS THE PLANNING COMMISSION DEEMS A CHANGE AND MR. FOOT IS PULLING

THE ZONING RIGHT NOW. >> SPEAKER: SIGNIFICANT CHANGE THEY COULD COME BACK SOONER THAN THAT OR THE OPTION IS PULL IT ALL TOGETHER AND COME BACK NEVER THEY CHOOSE AND WHEN THEY'RE READY. AND THEN THEY WOULD HAVE TO

START OVER. >> SPEAKER: THAT'S CORRECT.

WHAT THAT ULTIMATELY MEANS NOT JUST PLANNING COMMISSION IT HAS TO BE READVERTISED NOT ONLY IN THE NEWSPAPER BY THE ADJOINING PROPERTY OWNERS HAVE TO BE NOTICED AGAIN.

>> SPEAKER: SO WE HAVE BEEN ASKED TO POSTPONE UNTIL DECEMBEN ADVISED THAT WE NEED TO DO THAT CAREFULLY AND CONSIDER THAT CAREFULLY. OR WE CAN OPEN THE PUBLIC HEARING AND BEGIN HERE WITH THE APPLICANT MIGHT HAVE TO SAY.

WITHDRAWAL IS CERTAINLY AN OPTION TO THEM AS COUNCILMAN DAWSON HAS SPOKEN TO. OR WE COULD JUST HANDLE THIS AS BUSINESS TONIGHT AND VOTED UP OR DOWN.

TRYING TO SIMPLIFY EVERYTHING SO WE CAN MOVE FORWARD.

>> SPEAKER: MR. FOOT, DID YOU LOCATE THAT?

>> SPEAKER: I BELIEVE WHAT WE ARE TALKING ABOUT IT HAVE TO DO WITH THE PDD AND IT HAS TO DO WITH -- SECTION FIVE A 504 IS DENIED THE REQUEST FOR MASTER DEVELOPMENT IS DENIED THE MATTER CANNOT BE REOPENED OR THE SUBJECT OF A NEW APPLICATION FOR AT LEAST A YEAR. PLANNING COMMISSION JUST MAKES

RECOMMENDATION. >> SPEAKER: IF ONE OF US WERE TO DENY UNANIMOUS CONSENT WITH THAT GIVE THEM TIME TO DO SOMETHING WITHIN THE NEXT TWO WEEKS?

>> SPEAKER: KNOW THEY STILL HAVE THE RIGHT BY THE 60 DAY RULE UNTIL OCTOBER 4 MAYBE OUR FIRST MEETING.

SOMEBODY TO CHECK. OCTOBER 4.

IT IS ONE OF THE SAME. NOTHING WOULD CHANGE FROM A STAFF PERSPECTIVE IN THE NEXT COUPLE OF WEEKS.

BUT THAT IS UP TO YOU AND THEM. >> SPEAKER: BELIEVE YOU ME, I HAVE READ AND RESEARCHED ALL OF THE STUFF AND I WOULD LOVE FOR IT TO HAPPEN BUT TALKING WITH THE CITY MANAGER AND THE CITY IS NOT READY FOR TOO MANY POINTS THAT THE CITY HAS GOT TO LOOK AT AND I AM ALL FOR DEVELOPMENT OUT THERE BUT THE CITY IS NOT READY FOR THIS TO HAPPEN, NOT LIKE THIS PART -- THE CITY JUST NOT

READY. >> SPEAKER: I'M LOOKING FOR SOME GUIDANCE HERE AS TO WHAT JOEL'S DETERMINATION IS AND HOW YOU WOULD LIKE TO MOVE FORWARD. I SEE THREE OPTIONS.

THE PUBLIC HEARING IS NOT OPEN. >> SPEAKER: YOU ARE WELCOME TO HAVE QUESTIONS OF STAFF BY YOUR OWN PROCEDURES PRIOR TO OPENING THE PUBLIC HEARING. YOU DON'T USUALLY DO THAT BUT THIS IS QUITE INVOLVED SO DON'T FORGET THE PUBLIC HEARING.

>> SPEAKER: ANY THOUGHTS WHICH DIRECTION WE SHOULD GO?

LOOKING -- >> SPEAKER: WE DO HAVE THE

[00:45:03]

OPPORTUNITY AFTER THE PUBLIC HEARING.

>> SPEAKER: ABSOLUTELY. WE COULD JUST STOP OUR DISCUSSION AND GO TO THE PUBLIC HEARING WE WILL DO THAT PART WE OPEN THE PUBLIC HEARING IF YOU WOULD LIKE TO ADDRESS THE COUNCIL PLEASE COME FORWARD AND GIVE US YOUR NAME AND ADDRESS

FOR THE RECORD. >> SPEAKER: GOOD EVENING MISTER MR. MAYOR, CITY COUNCIL AND STAFF.

I'M TJ JOHNSON THE APPLICANT WITH HOLLAND HOMES MY ADDRESS IS FOUR TO WHAT OPELIKA RD. AND AUBURN.

I REPRESENT HANSON GRIMES LAND HERE AS WELL TONIGHT.

WE CERTAINLY APPRECIATE YOUR CONSIDERATION.

UNDERSTAND THIS IS A COMPLICATED MATTER THAT REQUIRES A LOT OF STUDY SO I WANT TO ADDRESS THE REASON WE WERE ASKING FOR A DELAY WAS TO ACQUIRE SANITARY SEWER EASEMENTS.

IF WE DON'T BELIEVE THAT WAS CHANGE ANYTHING FROM A STAFF PERSPECTIVE I THINK WHAT MAKES THE MOST SENSE IS A VOTE TONIGHT IF WE UNDERSTAND THIS IS A BIG PROJECT THAT OPENS UP A WHOLE SECTION OF AUBURN AS MR. CUMMINGS MENTIONED.

SO SOME OF THOSE THINGS ARE OUTSIDE OF OUR CONTROL.

I DON'T KNOW THAT THREE MONTHS OR 12 WOULD CHANGE THAT SO EVEN IF IT WERE TO BE DENIED HERE TONIGHT WE ARE STILL COMMITTED TO THIS PROJECT. I KNOW THAT HANSON GRIMES LAND THE IS AS WELL AND WE UNDERSTANT AUBURN.

AS MS. KRAUT SAID, MUCH OF THE FOCUS IS ON WATERPROOF WE FOUND A SANITARY SEWER THAT WE THINK IS VIABLE BUT THE CAPACITY IS NOT JUST ON OUR LOSS BUT ALL OF THAT IN THE OPPORTUNITY THAT MR. CUMMINGS MENTIONED. WE BELIEVE THIS PROJECT WOULD BE AWESOME FOR THE CITY, RIGHT ON THE OUTER LOOP SO THERE WOULD BE GREAT CONDUCTIVITY, WATER SERVICE WE COULD GET TO SEWER BUT AGAIN WE UNDERSTAND THE EXCELLENT STAFF AND PLANNING COMMISSION IT IS OUTSIDE OF THE CURRENT SCOPE SO WE WANTED TO BRING INTO THIS BODY AND SEE WHAT THE PLAN IS.

FOR WEST AUBURN. SOMETHING WE BELIEVE IN AND WE THINK IT WOULD BE ON AWESOME ASSET PER WOULD YOU BELIEVE IT WAS APPRECIATE YOUR CONSIDERATION.

OBVIOUSLY OPEN FOR ANY QUESTIONS.

THE DENSITY AND BUILT ZONING WE ARE ASKING FOR IS IN LINE WITH WHAT WAS APPROVED WITH THE WIMBERLEY STATION PREVIOUSLY.

I KNOW SOME TIME HAS PASSED. ALSO WOODLAND PARK IS ADJACENT AS WELL IS THE ORCHARD WAIVED MOBILE HOME PARK.

WE DIDN'T JUST PULL THAT DENSITY OUT OF THIN AIR.

WE DO UNDERSTAND IT IS NOT IN LINE WITH THE CURRENT PLAN WE DO ASK THIS BODY TO CONSIDER WHAT IS BEST FOR WEST AUBURN MOVING FORWARD. I APPRECIATE YOUR TIME AND I'M

OPEN FOR ANY QUESTIONS. >> SPEAKER: THANKS TRICK BEFORE YOU LEAVE DOES ANYBODY HAVE ANY QUESTIONS?

>> SPEAKER: YOU HEARD WHAT THE MAIRS MAYORS OUTLINED IS ARE THREE OPTIONS. WHAT IS THE APPLICANT'S

PREFERENCE FOR HOW WE PROCEED? >> SPEAKER: WE BELIEVE THAT GOING TO GET THE SEWER EASEMENTS MAY COULD CHANGE THINGS MATERIALLY IF WE HAD AN ABSOLUTE ROUTE FOR GRAVITY SEWER TO AUBURN INFRASTRUCTURE IF WE HAD A COMMITMENT TO SERVE IT WITH WATER TRICK TRAFFIC IS ALWAYS A CONCERN BUT TYPICALLY WE DO A TRAFFIC STUDY AFTER AN EVENT LIKE THIS.

IF WE DON'T BELIEVE THAT MATERIALLY CHANGES ANYTHING I DON'T SEE ANY REASON TO WAIT 90 DAYS TO BE QUITE HONEST.

WE THOUGHT MAYBE GETTING THOSE COULD CHANGE THINGS.

THAT IS UP TO YOU GUYS AND STAFF AND WE APPRECIATE ALL OF YOUR

WORK ON THIS SO FAR. >> SPEAKER: SO WITHDRAWING DON'T THINK IS AN OPTION FOR YOU RIGHT NOW?

>> SPEAKER: UP TO YOU GUYS BUT MS. CROUCHED MAYBE CAN SPEAK TO THAT AS WELL. WITHDRAWAL IF YOU WERE TO DENY TONIGHT'S I THINK 12 MONTHS IS PROBABLY A NORMAL LIFE CYCLE TO STUDY SOMETHING THIS BIG. I DON'T KNOW THAT WITHDRAWING AND BRING IT BACK REALLY CHANGES MUCH.

I WOULD LOVE TO HEAR YOUR CONCERNS IN ADDITION TO WHAT THEY MENTIONED AND WE ARE NOT OPPOSED TO BRINGING THAT BACK IF IT DOES COME TO A POINT WHERE THE PLANS CHANGE.

I DON'T KNOW IF 12 MONTH CHANGES THAT.

THE SCALE OF THE ASKED I GUESS. >> SPEAKER: I DO THINK ONE OTHER THING THAT COUNCIL WE WILL HAVE TO CHECK WITH OUR LEGAL COUNCIL ON THIS, IF YOU ASK TONIGHT THE FACT -- IF THIS WERE TO BE DENIED, A PLAN DEVELOPMENT JUST IT WILL NEVER COME BEFORE YOU AND THAT TRIGGERS THE 12 MONTH RULE, NOT THE REST OF IT.

SO THERE MAYBE NO 12 MONTH RULE AND WE WILL CHECK WITH LEGAL COUNCIL BUT IF YOU ARE NOT -- IF THAT APPLICATION IS NEVER CONSIDERED IT MAY TRIGGER NOTHING.

I CAN TELL YOU THAT I DON'T KNOW EVEN IN 12 MONTHS WE HAVE OTHER THINGS ON THE WORK PROGRAM AND OTHER PRIORITIES AND THIS WAS -- MR. FOOT, WAS THIS AREA ON ANY WORK PROGRAM AND THE NEXT TWO YEARS EVEN BE STUDIED FROM A PLANNING PERSPECTIVE?

>> SPEAKER: NO, IT WAS NOT. >> SPEAKER: SO OUR PRIORITIES ARE ON MANY OTHER THINGS RIGHT NOW AND THAT IS SOMETHING WE WOULD HAVE TO TALK TO THE GOVERNING BODY ABOUT WHETHER OR NOT YOU ARE WANTING TO SEE INSTRUCT ME TO MAKE A MATERIAL SHIFT IN THE PLAN UNIT DEVELOP A CHANGES -- THAT IS A WHOLE NEW THING THAT WE WERE WANTING TO BRING TO THE ZONING ORDINANCE.

WE ALSO HAVE A LOT OF ZONING ORDINANCE SIMPLIFICATION WOULD BE WELCOME BY A LOT OF PEOPLE. IT IS VERY CHALLENGING AND THICK. WE HAVE FUNDED AS PART OF THE BUDGET ALSO WE HAVE OTHER PLANNING PRIORITIES AND THIS WAS NOT ONE OF THEM. THOSE THINGS WOULD HAVE TO BE

[00:50:03]

DISCUSSED AND I WOULD HAVE TO GET BACK TO YOU AS TO WHERE WE

STAND. >> SPEAKER: THIS -- I HAVE ONE QUESTION TO ASK. WHAT IS THE DIFFERENCE BETWEEN

FREE ZONING AND REZONING? >> SPEAKER: ON THE FREE ZONING, WHAT THIS MEANS IS BY STATE LAW THE REASON I CITE THAT IS BECAUSE SOME PEOPLE AND THOSE AT HOME IF YOU LIKE TO LOOK THINGS UP AND UNDERSTAND WHAT OUR STATE LAW SAYS.

WHAT IT BASICALLY SAYS IS THE APPLICANT HAS A RIGHT TO ASK FOR ZONING BEFORE THEY AN EXPERT NORMALLY YOU SAW IN A PREVIOUS ACTION WITH SONIC TOOLS THAT YOU AND NEXT AND THEN ZONED.

THIS ALLOWS THEM TO KNOW IF THEY ARE GOING TO HAVE THE ZONING THAT THEY WOULD PREFER PRIOR TO COMING INTO THE CITY LIMITS.

AND ALSO THE CITY HAS THE SAME RIGHTS IRONICALLY THAT THEY DO.

WE COULD ACTUALLY CHANGE THE LAND USE PLAN TO THE FUTURE ZONING PLAN IF IT WANTED TO WITHIN REASON PER STATE LAW AND SAY WHEN THIS COMES AND IT IS GOING TO COME IN AS X BUT WE HAVE TO SAY ALL LAND COMES IN AS A RULE.

THAT IS OUR CHOICE AS WELL. THAT IS SOMETHING THAT APPLICANTS AVAIL THEMSELVES OF AND IT -- PLANNING COMMISSION DOES DECIDE THAT AND SO IT ONLY HAPPENS AT THE CITY COUNCIL LEVEL. IT IS NOT UNUSUAL FOR DEVELOPMENTS SUCH AS THIS. IT IS PRETTY NORMAL.

>> SPEAKER: ANY OTHER COMMENTS OR QUESTIONS FOR THE REPRESENTATIVE WHILE HE IS STANDING WITH US?

>> SPEAKER: I WOULD LIKE TO SAY, VICTOR HANSEN DID A LOT OF GREAT FORWARD LEG WORK ON THIS PROJECT.

I GOT THE OPPORTUNITY TO LOOK AT THE PROPERTY AND IT IS BEAUTIFUL AND I THINK IT IS A WONDERFUL IDEA AND A WONDERFUL AREA.

I'M JUST FEELING LIKE COUNCILWOMAN DAWSON AS WELL THAT WE ARE NOT UP TO SPEED WITH YOUR SPEED.

REALLY DO APPRECIATE THE OUTREACH AND THE REAL PROACTIVE THIS OF MAKING THOSE CONNECTIONS WITH US AND I CERTAINLY

APPRECIATE IT. >> SPEAKER: THANK YOU.

>> SPEAKER: ANY OTHER QUESTIONS? THANKS. PUBLIC HEARING IS OPEN IF ANYONE WOULD LIKE TO ADDRESS THE COUNCIL PLEASE COME FORWARD.

ANYONE ELSE? WE WILL CLOSE THE PUBLIC HEARING. ANY COMMENTS OR QUESTIONS FROM

THE COUNCIL? >> SPEAKER: AGAIN, MAYER MAYOR, I APPRECIATE MR. HANSEN AND A GREAT AUBURN FAMILY AND I KNOW THEY HAVE A RIGHT TO BUILD LIKE THEY WANT TO.

BUT AFTER READING EXTENSIVELY MEETING EXTENSIVELY AND TALKING EXTENSIVELY WITH THE CITY MANAGER AND SEEING THE CITY'S VIEWPOINT JUST -- ONE THING THAT BOTHERS ME MORE THAN ANYTHING IS THE AMOUNT OF TRAFFIC THAT THIS WOULD CREATE CREEK -- ONE INTERSECTION THE RAILROAD TRACKS AND THE STATE 14, AND STATE ROAD SO IT WOULD BE THERE, THE STATES PRIORITY TO PUT A LIFE THERE.

THERE IS A BIT OF A DIP COMING INTO AUBURN RIGHT THERE AND YOUR LINE OF SIGHT. AND THEN I TALKED TO SOME OTHER PEOPLE IN THE COMMUNITY ABOUT A TRICK ON THE OTHER END YOU HAVE WIRE ROAD AND IT IS HORRIBLE. I DO THINK IF WE WE WORK TOGETHER WITH HIS FAMILY AND GET SOME OF THESE AREAS, PROBLEMS TAKING CARE OF, I WOULD WELCOME THEM BACK AGAIN.

AND COULD SUPPORT IT 100 PERCENT.

BUT I JUST -- I HAVE AGONIZED OVER AND THOUGHT ABOUT IT BUT IN ALL GOOD CONSCIOUS I DON'T THINK WE ARE READY TO DO IT.

SORRY TO THE HANSEN FAMILY, BUT I'M -- I CAN'T SUPPORT IT RIGHT NOW. IN THE FUTURE MAYBE WE CAN WORK TOGETHER AND MAKE SOMETHING LIKE THAT HAPPENED OUT THERE.

I THINK IS A GREAT OPPORTUNITY FOR THAT AREA.

I JUST IN ALL GOOD CONSCIENCE CAN'T GIVE MY OKAY TO IT TONIGHT

>> SPEAKER: THANK YOU, CHIEF. ANYONE ELSE?

>> SPEAKER: REGARDLESS OF HOW THIS GOES TONIGHT, I THINK IT IS APPARENT THAT THE WEST SIDE OF AUBURN IS GOING TO DEVELOP SOONER THAN WE ANTICIPATED. I THINK THE COUNCIL AS A WHOLE SHOULD PROVIDE SOME DIRECTION TO THE STAFF ON HOW WE WANT TO PROCEED IN TERMS OF STUDYING THIS AREA.

I ALSO HAVE MET WITH THE CITY MANAGER AND THERE ARE A LOT OF QUESTIONS TO BE ANSWERED ON THE TOPOGRAPHY AND HYDROLOGY AND THE FLOW AND EVERYTHING, TRAFFIC AND SEWER SYSTEMS AND THE WHOLE INFRASTRUCTURE PICTURE TRICK SO I DON'T KNOW IF WE NEED TO REQUEST OF OUR CITY MANAGER THAT THE PRIORITIES BE ADJUSTED TO START WORKING AND FOCUSING ON THIS AREA OR WHAT THE RIGHT

[00:55:02]

PROCEDURE IS TO DO THAT. I WOULD THINK SOONER VERSUS LATER IS SOMETHING WE NEED TO CONSIDER.

>> SPEAKER: MISSING CROUCH, WHEN THE LAND USE PLAN WAS PUT TOGETHER THIS AREA WAS CONTEMPLATED AS BEING RULE.

I AM GUESSING THOSE DETERMINATIONS WERE MADE BASED ON AVAILABLE INFRASTRUCTURE AND ROAD NETWORKS AND THOSE KINDS OF

THINGS IN THE AREA. >> SPEAKER: THEY WERE AND AS A MATTER OF FACT THE COX AND WIRE ROAD AREA WAS STUDIED NOT ALL THAT LONG AGO AND THAT THE STUDY AREA DID NOT INCLUDE THIS AREA GETTING SOME PUSH THEY ARE BASED ON CHANGES IN THAT AREA.

THAT IS WHERE ULTIMATELY IF I MADE I WOULD RATHER COME TO YOU AS A COMMITTEE OF THE WHOLE TO GIVE YOU GUYS SOME INFORMATION ABOUT WHAT IS ON OUR PLATE AND A FEW CURRENTLY WHAT THE CURRENT SITUATION IS OUT HERE FROM A RULE PERSPECTIVE.

THINGS LIKE THE OUTER LOOP YOU HEARD MENTIONED AND OTHER THINGS AND GIVE YOU MORE INFORMATION AND GET YOUR FEEDBACK IF YOU WOULD BE AMENABLE TO DOING A COMMITTEE OF THE WHOLE OR A BIT MORE ABOUT IT BEFORE YOU MAKE A DECISION.

I ALSO WANT TO PROVIDE TO YOU SOME OTHER DATA WE TALKED ABOUT.

WE ARE DOING SOME UPDATES TO THE COMP PLAN BUT I WANT TO MAKE SURE YOU KNOW WHAT IS GOING ON IN THE REST OF THE CITY FROM A DENSITY STANDPOINT AND YOU WILL HAVE DECISIONS TO MAKE IF YOU WANT TO STUDY THIS AND ONCE WE DO WE WILL BE THE FINDINGS BACK TO YOU AND THE PLANNING COMMISSION ASIDE FROM THERE.

WE COULD DO A COMMITTEE OF THE WHOLE AND I KNOW SOME PEOPLE MAYBE OUT OF TOWN SO I WILL CHECK WITH YOU INDIVIDUALLY COMING UP TO SEE WHAT A GOOD TIME TO DO THAT.

I WOULD LIKE TO GIVE US MORE INFORMATION IF YOU MAY WANT TO RESET OUR PRIORITIES WHICH IS ABSOLUTELY YOUR CALL.

I WANT TO TELL YOU WHAT ALL IS ON OUR PLATES YOU CAN MAKE A SWORD -- INFORMED DECISION. TO HELP GUIDE THE STAFF.

>> SPEAKER: I THINK INFRASTRUCTURE WAS THE NUMBER ONE PROBLEM IN OUR CITIZEN SURVEY AND I THINK MAYBE I DIDN'T REALIZE IT WAS SUCH A PROBLEM ITSELF I DEALT WITH MR. HANSEN ON THIS PIECE OF PROPERTY.

REALLY NEED TO GET TOGETHER WITH THE COUNCIL AND LOOK AT INFRASTRUCTURE AND SEE WHAT WE CAN DO TO IMPROVE IT.

AND WORK HARD FOR GETTING FEDERAL MONEY TO PUT THAT OUTER LOOP IN. WE ARE GROWING UNBELIEVABLE.

THE WAY AUBURN IS GROWING IS UNBELIEVABLE.

WE HAVE TO KEEP THE INFRASTRUCTURE AND IF NOT WE ARE NEGLECTING OUR CITIZENS. 'S FACT BASED THE LATEST CENSUS WE ARE GROWING AT 6.6 PEOPLE PER DAY.

>> SPEAKER: IF WE DON'T COME TOGETHER AND SOLVE THIS

INFRASTRUCTURE. >> SPEAKER: MOTION AND SECOND.

>> SPEAKER: WHAT WE ARE CONSIDERING HERE IS A FREE ZONE.

SO IF THIS PASSES WE WILL MOVE ONTO THE OTHER ITEMS ON THE AGENDA. OF THE SALES THEN THAT WE WON'T CONSIDER THE OTHER ITEMS. I'LL FINISH UP BY SAYING WE JUST GOT THROUGH -- FINISHED MUNICIPAL ELECTION.

LIKE MOST OF OUR RECENT MUNICIPAL ELECTIONS, THE TOPIC OF GROWTH WAS THE PRIMARY TOPIC THAT WAS DISCUSSED.

THE WORD MANAGED GROWTH WAS UTILIZED IN MANY OF OUR MEETINGS AND VOTER FORMS. WE ARE HEARING OUR STAFF TONIGHT AND MANY OF US HAVE HEARD THIS IN PRIVATE CONVERSATION SAYING THAT THEY ARE NOT READY FOR THIS DEVELOP OUT THERE BECAUSE THE INFRASTRUCTURE IS RIGHT THERE. WE -- IF THIS WERE TO BE IN PLAY IT WOULD BE VERY PROBLEMATIC FOR OUR COMMUNITY AND MAYBE THAT WOULDN'T BE CONSIDERED MANAGED GROWTH.

I DON'T KNOW. I DO KNOW THAT EVENTUALLY THIS IS GOING -- WE WILL HAVE TO CONSIDER WHAT IS GOING ON IN WEST AUBURN. THERE IS NO QUESTION ABOUT THAT.

GETTING WITH THE STAFF AND EVALUATING WHERE WE ARE AND WHAT WE ARE DOING HOLISTICALLY AS A CITY IS NO QUESTION AN EXERCISE TO DO IN THE NEAR FUTURE. ANY OTHER COMMENTS FROM THE COUNCIL? AT THIS TIME LINDSAY, ROLL CALL.

(ROLL CALL VOTE) >> SPEAKER: MAYOR, THAT ITEM FAILED AND SO FOR THE RECORD ITEM 9A4 AND -- 9 A4 WAS REQUEST TO PRES OWN PLAN DEVELOP A DISTRICT SO YOU DO NOT APPROVE A RULE TO LTD ZONE AND ITEM 9A3 SO THERE IS NO REASON TO TAKE ON 9A4. 9A5 WAS REQUEST TO ANNEX ASSUMING YOU HAD ZONED UNDER 9A3.

SO THEIR FATE -- SO 9 A4 AND FIVE WILL NOT BE CONSIDERED.

[10. RESOLUTIONS]

ARE YOU READY FOR RESOLUTIONS? >> SPEAKER: ITEM 10A1 IS A REQUEST FROM AUBURN SELF POUR LLC ON BEHALF OF COX PROPERTIES

A PUBLIC HEARING IS REQUIRED.

>> SPEAKER: MOVE APPROVAL. >> SPEAKER: SECOND.

>> SPEAKER: MOTION AND SECOND WILL OPEN A PUBLIC HEARING.

IF YOU WOULD LIKE TO ADDRESS THE COUNCIL PLEASE COME FORWARD TO GIVE US YOUR NAME FOR THE RECORD CLOSE TO PUBLIC HEARING TRICK ANY QUESTIONS OR DISCUSSION FROM THE COUNCIL?

>> SPEAKER: IF I MAY, MS. CROUCH, HAVE WE GOT ANYTHING

TO SHOW THIS IS A FAMILY PLACE? >> SPEAKER: I THINK IS A SOMETHING THAT WAS IN THE NEWSPAPER ARTICLE.

TO MY KNOWLEDGE, THE APPLICANT MAY BE HERE -- IS THE APPLICANT PRESENT? AND MIGHT BE WISE, CHIEF DAWSON, IF THEY SPEAK TO THAT AT YOUR DISCUSSION.

>> SPEAKER: I WOULD LIKE TO MAKE SURE WE ARE NOT PROMOTING -- THIS IS DRINKING ESTABLISHMENT.

>> SPEAKER: WE WILL HAVE THE APPLICANT TO SPEAK TO THAT.

I DO BELIEVE THAT THAT CAME IN PART FROM A NEWSPAPER ARTICLE.

>> SPEAKER: LEAVING EVERYBODY. DION PEEPLES, 2321 HANSARD COURT, AUBURN. WE ARE SAYING IT IS A FAMILY ESTABLISHMENT. THE PLACE YOU CAN RING YOUR KIDS AND BE COMFORTABLE ENOUGH THAT THERE IS UNDERAGE DRINKING.

IT IS MORE OF AN ALL IS WELCOME, YOU DON'T HAVE TO FEEL LIKE YOU'RE AT DARE I SAY SKY BAR OR SOME KIND OF LOWER SLUMP TYPE OF BAR. IT WILL BE HIGH-END, HIGH-TECH.

THERE WILL BE NONE ALCOHOLIC BEVERAGES AVAILABLE, TEMPERATURE, SPARKLING WATER, CRAFT SODAS.

IT IS NOT A DAYCARE WITH ALCOHOL BY ANY STRETCH.

IT IS MORE A PLACE THAT PEOPLE WITH YOUNG CHILDREN CAN FEEL COMFORTABLE BRINGING THEIR FAMILY, HAVING A COUPLE OF DRINKS, EATING SOME FOOD AND NOT FEEL ANY OUTSIDE PRESSURES.

>> SPEAKER: SAME WAY TO GO TO A RESTAURANT.

>> SPEAKER: CORRECT. >> SPEAKER: YOU ARE NOT

PROMOTING IT FOR KIDS TO COME IN >> SPEAKER: ABSOLUTELY NOT PRINT THE TECHNOLOGY PLACED ON IT WITH LICENSE SCAN, RFID CARDS ARE REQUIRED FOR ANY INDIVIDUAL TO GO TO A TAP AND POUR THE BEVERAGE IT IS SAFER THAN A TRADITIONAL BAR.

>> SPEAKER: PROBABLY BETTER THAN THE AVERAGE SECURITY.

>> SPEAKER: CORRECT. >> SPEAKER: ANY OF THE

QUESTIONS? >> SPEAKER: CAN YOU WALK US THROUGH IF THERE WILL BE AN ATTENDANT PRESENT.

>> SPEAKER: STAFF INSTEAD OF BEING BEHIND THE BAR POURING THE DRINKS. NOW IS THE CONSUMER WILL BE ABLE TO POUR THE DRINKS AND STAFF WILL BE MONITORING, ANSWERING QUESTIONS. BUT EYES ON CONSUMERS SEEING IF THERE ARE ANY OVERCONSUMPTION'S. THE SYSTEM LOCKS OUT AFTER TWO DRUGS ARE CONSUMED AND THEY HAVE TO COME BACK TO THE STAFF TO BE REEVALUATED ACTIVATE THE RFID CARD AGAIN FOR THAT IS PRIMARILY THE STAFF WILL BE FOR MONITORING AND ASSISTING CUSTOMERS VERSUS BEHIND THE BAR POURING DRINKS OR BEING PREOCCUPIED WITH MAKING

BEVERAGES. >> SPEAKER: NOT SELF CHECKOUT

TYPE? >> SPEAKER: NO.

>> SPEAKER: ANY OTHER QUESTIONS? I APPRECIATED. ANY OTHER COMMENTS TO COUNCIL? MOTION AND SECOND. I WANT TO MAKE SURE I WAS IN THE RIGHT PLACE. MOTION AND SECOND.

ALL IN FAVOR, PLEASE SAY AYE. ANY OPPOSED?

CLOSE THE PUBLIC HEARING. ANY COMMENTS OR QUESTIONS FOR

THE COUNCIL? >> SPEAKER: BEFORE MR. FOOT GOT HERE, BEFORE SCOTT HAD THE UNIQUE TASK I SUPPOSE IT WOULD BE CALLED TO DETERMINE IF A FLOOR PLAN WAS A PRIVATE DORMITORY OR SOMETHING OTHER THAN A PRIVATE DORMITORY, SINCE THE CHANGE IN DIRECTORS OF OUR PLANNING DEPARTMENTS, IS THAT THE SAME ROLE THAT MR. FOOT IS TAKING ON NOW THAT YOU WILL BE THE DETERMINING BODY TO DETERMINE IF A FLOOR PLAN IS OR

IS NOT PRIVATE DORMITORY? >> SPEAKER: QUICKLY, WHAT I

[01:05:04]

BELIEVE MR. GRISWOLD IS REFERRING TO IS THAT THE PLANNING DIRECTOR HAS THE SOLE DETERMINING AUTHORITY, THE ZONING ORDINANCE TO DETERMINE WHETHER SOMETHING IS AN ACADEMIC DWELLING UNITS OR OTHER TYPE OF HOUSING UNIT.

THERE WAS A SUCCINCT PROCESS. ARE FORMER PLANNING DIRECTOR FOLLOWED TO ENSURE THAT AND I WOULD LIKE MR. FOOT TO EXPLAIN AS HE IS THE PERSON THAT INTERPRETS THE ZONING ORDINANCE BY LAW WHERE HE STANDS ON THIS SO YOU HAVE INFORMATION ON HOW THE STAFF FUNCTIONS IN THIS REGARD.

>> SPEAKER: THERE ARE DEFINITIONS FOR GEMMA TORI, FOR ADU. THERE IS A PROCESS WHERE STAFF LOOKS AT THOSE BEFORE THEY GET TO THE PERMITTING STANDPOINT.

DORMITORY MY STAFF WOULD BE LOOKING AND WORKING WITH APPLICANT DURING THE PROCESS AND THEY WOULD LOOK TO SEE THAT EVERYTHING MEETS THOSE DEFINITIONS.

ANYTHING QUESTIONS THAT COMES UP I WOULD BE THE FINAL DETERMINATE DETERMINING ORDINANCE AND MAKING SURE WE HAD HERE TO WHAT HAS BEEN APPROVED IN THE PAST AND WHAT THE CODE SAYS.

>> SPEAKER: THE REASON I ASK THAT IS THE STAFF GOING COMMENTS UNDER PLANNING FLOORPLANS WE NEED TO BE REVIEWED.

I JUST WANTED TO UNDERSTAND THE PROCESS FOR THAT.

>> SPEAKER: THEY ARE REVIEWED FREQUENTLY BECAUSE I HEARD FROM A FEW CITIZENS THAT DON'T AGREE WITH OUR INTERPRETATION THAT THEIR PROPOSED DEVELOPMENT INCLUDES ACADEMIC DWELLING UNITS PER WE DEFINITELY KNOW THAT THAT IS ALIVE AND WELL IN THE

PLANNING STAFF. >> SPEAKER: I WAS ABOUT TO ASK THAT QUESTION. DURING THE PLANNING OF IT IS IN ANY CITIZENS RESPOND BUT YOU ANSWERED.

>> SPEAKER: >> SPEAKER: ON THIS ONE IN GENERAL? MR. FOOT, DID ANY OF THE PLANNING OWNERS -- OWNERS COME TO THE MEETINGS.

BUSINESS WE HAVE YOU THIS EVENING.

>> SPEAKER: THANK YOU VERY MUCH.

WE WILL OPEN THE CITIZENS OPEN FORUM IF YOU WOULD LIKE TO ADDRESS THE COUNCIL PLEASE COME FORWARD AND GIVE YOUR NAME AND ADDRESS FOR THE RECORD. YOU HAVE THREE MINUTES AND PLEASE ADDRESS YOUR COMMENTS TO THE COUNCIL.

>> SPEAKER: GOOD EVENING, COUNCIL, MAYOR BERKE MY NAME IS ROBERT WILKINS, 261 DENSON DRIVE AUBURN ALABAMA.

ORDINANCE 3288 SHORT-TERM RENTAL , THIS AND COUNCIL RIPPED AWAY OUR CONSTITUTIONAL RIGHTS, RIPPED AWAY OUR PROPERTY RIGHTS AND AS YOU MENTIONED PROPERTY RIGHTS, I'M NOT SURE WHY YOU AGREE WITH THAT. AND ALSO OUR CIVIL LIBERTIES.

USING A NEIGHBORHOOD CONSERVATION ZONING IS THE GOSPEL. BUT I'M NOT HERE REALLY TALK ABOUT THE TRAVESTY BY THE COUNCIL, BUT I AM CONCERNED ABOUT THE DECLINE OF THE AUBURN COUNCIL AND IS MAYOR.

THERE IS ONLY ONE REASON FOR THE TURNOUT OF 3517 VOTERS IN THE CITY ELECTION. OVER 78,000 RESIDENTS AND I BELIEVE IT IS BECAUSE THEY HAD LITTLE HOPE AS U.S.

REPRESENTATIVES. WE HAD 816 PETITIONS YOU ALL IGNORED THEM. WANTING TO AMEND 3288.

YOU ALSO HAD SOME OF THOSE A LOT OF THOSE PEOPLE WE TALK TO INDIVIDUALLY HAD NO CONFIDENCE IN THE COUNCIL.

I AM CONCERNED. I BELIEVE THAT THERE WERE THOUSANDS MORE PEOPLE THAT WOULD HAVE SIGNED THE PETITIONS BUT YOU DIDN'T CARE ABOUT THE 816. I HAVE A FEW IDEAS.

I TRIED TO TALK TO THE MAYOR BUT HE WOULDN'T TALK TO ME AT ALL CONSIDERING THAT I WAS GOING TO DO SHORT-TERM RENTAL WHICH I WAS NOT. I INFORMED HIM I WAS NOT.

IT IS THAT I HAVE A FEW IDEAS OF THINGS LIKE THE COMMUNITY.

WHEN WE HAVE THESE MEETINGS AND STUFF, WE DO NOT INVOLVE THE COMMUNITY. WE DO NOT BRING THEM IN, WE DO NOT HAVE -- IT WAS GREAT TO HAVE A FEW OF THE PEOPLE FROM THE UNIVERSITY, BUT THERE ARE -- IS A LOFT OF ACTIVITY IN THE CITY AND YOU TALK ABOUT IT BUT YOU DON'T BRING THEM HERE.

MAYBE THE FIRST SESSION YOU HAVE GIVEN ALL OF THE WORDS AND STUFF, A BE THE SECOND COUNCIL MEETING EACH MONTH YOU WILL HAVE MAYBE 15 MINUTES AND YOU CAN HAVE SOME PEOPLE INVOLVED IN TALKING ABOUT THINGS. YOU COULD HAVE SOMETHING IN EACH ONE OF YOUR WORDS WERE EACH YOUT ONE ACTIVITY THAT IS REALLY UNIQUE ABOUT THAT PARTICULAR WARD.

I REALLY THINK THAT THERE SHOULD BE MORE INVOLVEMENT.

NOW WE ARE DOWN TO THREE MINUTES INSTEAD OF FIVE MINUTES.

IT IS LIKE THE COMMUNITY DOESN'T MATTER BUT ALL OF THIS ACTIVITY THAT YOU JUST MENTIONED ABOUT ALL OF THESE PLACES, ALL OF THESE SCREENS, YOU DIDN'T PUT ANYTHING.

DEVELOPMENT WAS SUPPOSED TO BE REALLY PRETTY THAT SHE TALKED ABOUT, PUT IT UP ON THE SCREEN AND LET'S SEE WHAT IS GOING ON IN THE COMMUNITY. INVOLVE US MORE.

QUIT MAKING SOME STRUCTURE SO BAD THAT THE BUREAUCRATS HAVE TO CONTROL IT ALL. WE ARE PEOPLE WHO WOULD LIKE TO BE INVOLVED. THANK YOU.

THE TOWN CREEK PARK -- I WENT BY IT WAS BEAUTIFUL.

IT SHOULD HAVE BEEN UP ON THE SCREEN.

I WENT BY AND THERE WERE LOTS OF PEOPLE, THEY WERE OLD, MIDDLE-AGED, COLORS AND EVERYTHING FOR BEAUTIFUL.

>> SPEAKER: WE ARE VERY PROUD OF IT.

WHO WILL BE NEXT? OKAY.
