WE ANNOUNCED, I ANNOUNCED THAT MR. PHILLIP CHANSLER WILL BE RETURNING TO THE PLANNING COMMISSION AS THE MAYOR'S APPOINTEE AND REPRESENTATIVE. UNDER ANNOUNCEMENTS TONIGHT I WANT TO REMIND EVERYONE THAT THE TOY DRIVE IS ONGOING AND IT ENDS , MR. REGISTER I BELIEVE AT THE END OF THIS WEEK, AND YOU CAN DROP YOUR TOYS OFF AT THIS BUILDING AND CERTAINLY ENCOURAGE EVERYBODY TO DO THAT PURPOSE HAS BEEN A GREAT TRADITION IN OUR COMMUNITY FOR A NUMBER OF YEARS TO COLLECT TOYS AND PROVIDE THOSE FOR CHILDREN WHO DO NOT HAVE THIS CHRISTMAS.
I ALSO WANT TO REMIND EVERYBODY THAT DAUGHTER THAT HE SIGN UPS ARE ONGOING RIGHT NOW AND EVEN THOUGH IT IS NOT CHRISTMAS YET OR THE NEW YEAR, THAT EVENT FILLS UP FAST AND I ENCOURAGE EVERYBODY NOT TO MISS. THIS PAST WEEK WE HAD THE SUPER SEVEN HERE IN AUBURN AND I HAVE BEEN INVOLVED IN THAT SINCE ITS INCEPTION AND I WANT TO SAY THANK YOU TO SO MANY PEOPLE THAT PARTICIPATED IN THAT SPIRIT OUR PUBLIC SAFETY MEN AND WOMEN WERE OUTSTANDING AND THEY MADE SURE THAT WE WERE TAKEN CARE OF AND THAT PEOPLE FELT SAFE AROUND THE BUILDING -- AROUND THE STADIUM, WHETHER IT WAS THE FANS OR THE FIREWORKS OF THE BUSES OR WHATEVER WAS GOING ON, OUR MEN AND WOMEN HAD TAKEN CARE OF AND I'M GRATEFUL FOR THAT. I WANT TO THANK JUDGE MCLAUGHLIN
[00:05:01]
WHO HELPED KEEP OUR FIELDS CLEAR OF ALL RIFFRAFF AND MAKE SURE ONLY THE RIGHT PEOPLE WERE ON THE FIELD AND WHERE THEY WERE SUPPOSED TO BE AND I APPRECIATE HIS EFFORTS.TOURISM, AUBURN ATHLETICS, AUBURN UNIVERSITY WERE GREAT PARTNERS AS WELL AS THE CITY OF OPELIKA WAS A PARTNER FINANCIALLY AND HUNDREDS AND HUNDREDS AND HUNDREDS OF VOLUNTEERS BUT SOME OF YOU ARE IN THIS ROOM.
ONE OF HE WAS SITTING NEXT TO ME AND I APPRECIATE EVERYBODY THAT GAVE OF THEIR TIME. IT WAS A GREAT WEEK.
WE HAD A GREAT EXPERIENCE OVER THERE, GREAT WEATHER AND I'M PROUD OF THE AUBURN HIGH WORLD CHAMPIONS AND WHEN THE GIRLS FLY CHAMPIONSHIP AND THEY WON THAT IN THEIR HOMETOWN AND CERTAINLY PROUD OF OUR BOYS FOOTBALL TEAM FOR PARTICIPATING.
SINCE OUR LAST MEETING I PARTICIPATED IN A COMMUNITY THANKSGIVING SERVICE WHICH WAS AWESOME AND I APPRECIATE THE INVITATION TO BE PART OF THAT AND THE HOLIDAY TREE LIGHTING ON CAMPUS, GREAT COMMUNITY EVENT THAT WAS ATTENDED BY A LOT OF PEOPLE THAT LIVE IN AUBURN, NOT JUST THAT WORK ON CAMPUS.
GREAT THINGS. ANYBODY ELSE HAVE AN
ANNOUNCEMENT TONIGHT? >> SPEAKER: I DO.
IT'S BEEN A WILD SINCE HE HAD A MEETING SO I WANT TO THANK FIRST OF ALL MY COMMUNITY WARD MEETING I WANT TO THANK DR. KAREN AND DR. YOUNG FOR CONDUCTING THAT MEETING ON MONDAY NIGHT, NOVEMBER 21, AND ALL OF THE STAFF THAT WAS ABLE TO COME OUT AND PARTICIPATE AND TALK TO THE COMMUNITY ABOUT THE NEW HEALTH CENTER THAT IS NOW HOUSED IN BOYKIN.
THERE WAS A VERY PRODUCTIVE MEETING AND A LOT OF PEOPLE GOT A CHANCE TO TOUR THE BUILDING AND THEY GOT INFORMATION ABOUT THE NEW HEALTH CENTER. IF THEY ARE LISTENING, I WANT TO SEND THEM A THANK YOU FOR SETTING THAT UP FOR THE COMMUNITY, WHICH BECAUSE IT WAS THE HOLIDAYS THERE WASN'T A LOT OF PEOPLE SO WE WILL DO IT AGAIN SO PEOPLE CAN ACTUALLY COME OUT AGAIN AND DO THE SAME THING. ALSO FOLLOWING THAT, EVENTS, TUESDAY NIGHTS, THE NORTHWEST AUBURN TASK FORCE AND OTHER MEMBERS OF THE COMMUNITY ALSO GAVE THE SENIOR CITIZEN DISABLED AND HOMELESS THANKSGIVING DINNER DR. HARRELL WAS ABLE TO COME BACK AND SHE HELPED SERVE. I INVITED HER BACK TO EAT BUT SHE SAID SHE DIDN'T WANT TO EAT SHE WANTED TO HELP SERVE.
SHE ENJOYED HERSELF AND I WANT TO ALSO THINK AL DAVIS AND HIS STAFF WERE SETTING UP EVERYTHING AND PUTTING OUT ALL OF THE CHAIRS AND TABLES SO THEY COULD AND WE STILL DIDN'T HAVE ENOUGH ROOM. THIS YEAR WAS A SUCCESS, A LOT OF PEOPLE THERE, AND I GUESS I WAS REALLY TOUCHED AND IMPRESSED BY SO MANY HOMELESS PEOPLE THAT ACTUALLY CAME OUT.
I DIDN'T REALIZE THERE WERE SO MANY HOMELESS PEOPLE HERE IN AUBURN BUT WE HAD A GOOD NUMBER OF HOMELESS PEOPLE THAT SHOWED THEIR FACES AND CAME OUT AND ENJOY ENJOYED THE FESTIVITIES.
WE PLAYED BINGO, WE HAD ACTUALLY I THINK WE HAD A BINGO WINNER IN THE ROOM TONIGHT. IT WAS REALLY TOUCHING TO SEE SO MANY PEOPLE, WERE HAPPY TO GET A MEAL AND IF I HAD TO DO ALL OVER AGAIN I THINK I PROBABLY WOULD TRY TO DO IT EVERY WEEK BUT I ALSO WANT TO THANK THOSE WHO PARTICIPATED AND THOSE WHO DONATED FOOD. WE HAD A LOT OF FOOD.
IT WAS ABLE TO ACCOMMODATE EVERYBODY THAT CAME OUT.
WE DIDN'T HAVE ENOUGH CHAIRS BUT WE DID OUR BEST TO MAKE SURE WE HAD CHAIRS. I ALSO WANT TO THANK OUR CHILDREN, OUR SCOUTS WHO SERVE THE SENIOR CITIZENS.
THEY COME OUT AND THEY HAD TO GIVE UP THEIR CHAIRS FOR SOME OF THE GUESTS. EVERYTHING WORKED OUT WELL.
I ALSO WANT TO SAY THAT MY MATCH WHICH IS A SCOUT TROOP AND THOSE KIDS ANYWHERE FROM THE AGES OF FIVE TO 15 YEARS OLD AND THEY WERE IN THE CHRISTMAS PARADE. IF ANYBODY WAS AT THE CHRISTMAS PARADE, WE WERE DIRECTLY BEHIND THE BAND.
WE HAD ALL OF THOSE BALLOONS, GREEN AND RED BALLOONS, AND THE KIDS HAD A GOOD TIME AND THEY REALLY ENJOYED THEIR SELVES AND IF I HAD TO DO THAT ALL OVER AGAIN I WOULD DO THE SAME THIS
SATURDAY. >> SPEAKER: THANK YOU, CONNIE.
ANYONE ELSE FROM COUNCIL HAVE AN ANNOUNCEMENT?
>> SPEAKER: YES. EVERY ONCE IN A WHILE I GET A QUESTION ABOUT HOW THINGS WORK AND HOW WE OPERATE, PARTICULARLY ABOUT HOW SOMETIMES WE REACH THROUGH A LOT OF AGENDA ITEMS. I WANT TO REMIND THE PUBLIC THAT WE AS COUNCILMEMBERS GET A PACKET OF INFORMATION AHEAD OF TIME SO WE DON'T JUST QUICKLY DECIDE ON SOMETHING HERE AT A COUNCIL MEETING.
I WOULD LIKE TO ALSO POINT OUT THAT THE SAME EXACT PACKET IS AVAILABLE TO ALL OF THE PUBLIC AHEAD OF TIME SO THAT YOU HAVE THE SAME INFORMATION THAT WE HAVE HERE AT OUR PODIUM IT IS
[00:10:01]
AVAILABLE THE CITY WEBSITE OR YOU CAN REQUEST THAT IT BE E-MAILED, YOU GET A NOTIFICATION OF IT THROUGH THE E-MAIL NOTIFIER. I WANT TO MAKE SURE EVERYBODY IS AWARE OF THAT, THAT WE SERIOUSLY CONSIDER EACH AND EVERY ITEM EVEN IF IT IS ON A CONSENT AGENDA ALL OF THAT INFORMATION IS OUT THERE, AVAILABLE FOR ANY AND EVERYBODY TAKE A LOOK AT.>> SPEAKER: THAT IS A GREAT REMINDER.
A GOOD RULE OF THUMB IS THIS INFORMATION IS GENERALLY AVAILABLE TO THE PUBLIC ON FRIDAYS?
>> SPEAKER: FRIDAY AFTERNOON IT SHOULD BE POSTED BY 5 PM.
ONCE IN A WHILE IT COULD BE A BIT LATER IF WE HAVE A LARGE AGENDA BUT USUALLY AROUND 5 PM. AUBURNALABAMA.ORG/AGENDA.
>> SPEAKER: WE HAVE A WORK SESSION AT 4 O'CLOCK ON THURSDAYS WHERE WE GO THROUGH THE AGENDA AND GET OUR FIRST
LOOK AT THE AGENDA. >> SPEAKER: AND YOUR WORK SESSION IS A PUBLIC MEETING. WE DON'T RECORD THEM BECAUSE IT'S A WORK SESSION BUT THAT IS OPEN TO THE PUBLIC AND THAT IS A PREVIEW OF THE AGENDA WHICH IS SUBJECT TO CHANGE BETWEEN THURSDAY AND FRIDAY AND OFTEN DOES.
>> SPEAKER: AND I THINK IT IS WORTH MENTIONING NOW THAT MR. GRISWOLD BROUGHT THIS UP IS THAT CONSENT AGENDA WAS CREATED FOR YEARS AGO WHEN THE PREVIOUS COUNCIL WAS BROUGHT IN.
THE WHOLE HEART OF THE MATTER WAS TO GIVE THE PUBLIC MORE OPPORTUNITY TO SPEAK AND SO WE TRIED TO TAKE SOME OF OUR DECISIONS AND CONSOLIDATE THOSE SO WE PROVIDED MORE OPPORTUNITIES FOR THE PUBLIC TO SPEAK TO THE CITY COUNCIL.
THAT WAS THE PRIMARY REASON WE DID THAT.
ANYWAY, THANK YOU, KELLEY FOR BRINGING THAT UP.
EVERYTHING IS ALWAYS AVAILABLE TO YOU AND WE ENCOURAGE YOU TO GO FIND IT IF YOU HAVE QUESTIONS AND FOLLOW UP WITH YOUR COUNCILMEMBER OR ANYBODY ON THE STAFF.
ANYONE ELSE HAVE AN ANNOUNCEMENT?
[5. AUBURN UNIVERSITY COMMUNICATIONS.]
WE WILL MOVE AHEAD TO AUBURN UNIVERSITY COMMUNICATIONS.>> SPEAKER: HI EVERYONE. PRETTY SHORT REPORT FOR ME THIS WEEK BECAUSE THE BIGGEST THING THAT WE HAVE GOING ON THIS WEEK IS FINALS. IF YOU HAVE A COLLEGE STUDENT IN YOUR LIFE PLEASE WISH THEM GOOD LUCK TRICK I KNOW THEY WOULD APPRECIATE IT. THAT WILL LEAD US RIGHT INTO COMMENCEMENT CEREMONIES THIS WEEKEND AND THEN A FEW WEEKS OF WINTER BREAK. AS I ALWAYS SAY, DO ENJOY THE QUIET AROUND HERE WITHOUT US. AND THEN GOING OFF OF THAT, SINCE WE WILL BE GONE, PLEASE HELP MAKE UP FOR THE NOISE AT THE MEN'S AND WOMEN'S BASKETBALL GAMES.
YOU KNOW WE DEPEND ON OUR HOME-COURT ADVANTAGE IN THE ARENA LOTS OF HELP TO FILL IN FOR US.
CLASSES START BACK ON THE 11TH SO WE WILL START TRICKLING BACK AND ONCE THE NEW YEAR STARTS. THAT IS ALL ON THAT NOTES.
SECOND, OUR WOMEN'S VOLLEYBALL TEAM JUST FINISHED A HISTORIC SEASON THEY MADE IT TO THE NCAA TOURNAMENT FOR OVER THE SECOND TIME IN PROGRAM HISTORY. THEIR MOST RECENT APPEARANCE BEFORE THIS ONE WAS 12 YEARS AGO SO WE ARE VERY EXCITED ABOUT THE DIRECTION OF THE PROGRAM AND WHAT THIS MEANS FOR THOSE YOUNG WOMEN AS THEY CONTINUE TO SUCCEED BOTH WITHIN THE PROGRAM AND IN THEIR FUTURES BEYOND. AND LASTLY, THE JULE COLLINS SMITH MUSEUM OF FINE ARTS WAS ACCREDITED BY THE AMERICAN ALLIANCE OF MUSEUMS WHICH IS THE ORGANIZATION THAT ACKNOWLEDGES THE HIGHEST STANDARDS IN THE MUSEUM PROFESSION.
I THINK THE LAST TIME WE WERE ACCREDITED WAS 2003 SO THIS IS A BIG DEAL AND IT REALLY SPEAKS TO THE QUALITY OF OUR MUSEUM CREEK THAT IS ALL FOR ME THIS WEEK. WAR EAGLE.
>> SPEAKER: THANK YOU FOR GOOD LUCK ON FINALS.
CERTAINLY GRADUATION IS A GREAT TIME AT A CELEBRATION FOR THOSE STUDENTS AND THEIR FAMILIES BUT IT IS ALSO A GOOD TIME OF ECONOMICS FOR OUR COMMUNITY AS THOSE FAMILIES COME BACK AND SPEND A GREAT DEAL OF TIME WITH US AND BEING CLOSE TO CHRISTMAS IT IS A VERY FRUITFUL TIME FOR OUR BUSINESSES AND RESTAURANTS
[6. CITIZENS’ COMMUNICATIONS ON AGENDA ITEMS.]
SO WE ARE EXCITED ABOUT THIS WEEKEND.NOW IT'S TIME FOR CITIZENS COMMUNICATIONS ON ITEMS ON TONIGHT AGENDA. IF YOU WOULD LIKE TO SPEAK TO THE COUNCIL ABOUT ANYTHING THAT IS ON OUR AGENDA TONIGHT PLEASE COME FORWARD IF THAT ITEM HAS A PUBLIC HEARING, WE WOULD ASK THAT YOU WAIT AT THAT TIME TO SPEAK TO US ON THE ITEM THAT HAS
THE PUBLIC HEARING. >> SPEAKER: IT HAS BEEN A LONG TIME SINCE I GRADUATED FROM COLLEGE.
MY NAME IS ROBERT WILKINS, 261 DENSON DRIVE, AUBURN.
MAYOR, AND COUNCILMEMBER, GREAT TO SEE YOU AGAIN.
I HEARD THAT IT MAY BE POSTPONED BUT I THINK IS VERY IMPORTANT THAT I CONTINUE ON DEALING WITH THE VOTE ON THE BUSINESS LICENSE ORDINANCE I BELIEVE A NO VOTE ON THAT SHOULD BE DONE, NO EXTENSION SHOULD BE DONE. THE CITY MANAGER, CITY GOVERNMENT JOB IS TO DEVELOP LOTS OF RULES, LAWS AND RESOLUTIONS FOR THE COUNCIL. BUT THE MAYOR AND THE CITY EMPLOYEES ARE RESPONSIBLE TO PRESENT ALL OF THE DATA AND INFORMATION ABOUT THINGS BROUGHT BEFORE THE COUNCIL.
THE CITY PERCEPTION BY CITIZENS IS THAT THIS CITY IS NOT PROCEEDING THE COUNCIL NOT PRESENTING THE COUNCIL ALL OF THE INFORMATION NEEDED TO MAKE A PROPER DECISION.
I KNOW HE MENTIONED THE BIG PACKETS.
I GET THOSE PACKETS NOW PERCEPTION CAN BE A REALITY.
THE SECOND GROUP IS AUBURN DECIDUOUS AND AUBURN BUSINESSES.
THEY WANT LIMITED LAW AND REGULATIONS FOR STABLE BUSINESSES AND FAMILIES. THE THIRD GROUP IS YOU, THE
[00:15:03]
COUNCIL. THERE ARE NINE OF YOU.YOU HAVE A LOT OF RESPONSIBILITIES BECAUSE YOU GO BETWEEN WE THE CITIZENS AND THE CITY TO MAKE THINGS HAPPEN.
I HOPE YOU DON'T FORGET THAT RESPONSIBILITY.
THIS COUNCIL HAS GIVEN THE PROPER DATA TO DECIDE THE FATE OF THIS ORDINANCE. A LOT OF CONSTITUENTS I HAVE TALKED TO SAY YOU ARE NOT GETTING THE PROPER INFORMATION.
I GOT SOME DIFFERENT QUESTIONS. I WAS GOING TO LABEL EACH PERSON BUT I'M NOT GOING TO DO THAT AT THIS TIME JUST TO SAY PLEASE FIND THE ANSWER TO THIS. THE FIRST ONE IS A SHOULD THE CITY BE ALLOWED TO BIRD AND ITS BUSINESS OWNERS BECAUSE AUBURN IS THE ONLY TOP TEN CITY IN ALABAMA NOT TO HAVE A SINGLE ORDINANCE WHILE SHIFTING THE BURDEN OF PROOF FROM CITY OF AUBURN TO THE AUBURN BUSINESSES. WHEN DID AUBURN BECOME A FOLLOWER INSTEAD OF A LEADER? HOW HAS EACH COUNCILMAN GIVEN NINE COPIES -- GIVEN COPIES OF ALL OF THE NINE ORDINANCES AND A SUMMARY OF THAT. HAVE YOU GOTTEN THOSE? YOU SHOULD HAVE. HOW MANY BUSINESSES HAVE YOU AND OTHER COUNSELORS CONTACTED IN THE WARDS TO ASK THEIR OPINION AND THEIR FEEDBACK? THAT'S VERY IMPORTANT.
AUBURN CITY MANAGER BACK ON OCTOBER 18 THIS YEAR AT AUBURN CITY COUNCIL MEETING SAID OPELIKA HAS HAD THIS IN EFFECT SINCE 2007. THE LOCAL AREA I DO NOT KNOW HOW OFTEN OPELIKA HAS INVOKED TO THIS BUT I DO NOT RECALL A TIME I READ AN ARTICLE IN THE NEWSPAPER ABOUT ITS.
I THINK IT IS AN EXTREME RARE CIRCUMSTANCE THAT ANY CITY IN VOGUE'S THIS BUT IT IS NOT -- IT IS JUST A TOOL IN THE TOOLBOX AND WHEN AND IF NECESSARY. THEN WHY DO WE HAVE IT'S? I DON'T UNDERSTAND IT. HOW MANY BUSINESSES HAVE NOT PAID THEIR TAXES IN AUBURN THE LAST TEN MONTHS? TWO YEARS, FIVE YEARS? IS THAT ONE, THREE, 50, A HUNDRED? I DON'T KNOW.
HOW MUCH MONEY HAS BEEN LOST BY THE CITY? 1000, HUNDRED THOUSAND, A MILLION? HOW MUCH IS IT? WE NEED SOME DATA.
HOW MANY BUSINESSES LICENSES HAVE NOT -- WOULD HAVE BEEN REVOKED IN THE LAST TEN MONTHS IF THIS ORDINANCE HAD BEEN ENACTED? MAYOR, YOU HAD MENTIONED SOMETHING I DON'T UNDERSTAND, YOU SAID PHILOSOPHICAL POSITIONS DEALING WITH THIS ORDINANCE BACK ON OCTOBER 18.
I KNOW WITH THE WORD MEANS BUT I DON'T UNDERSTAND IT PERTAINING TO THIS ORDINANCE. MAYBE AFTERWARDS YOU COULD TELL ME A LITTLE BIT AND ALSO SHOULDN'T THERE BE A TASK FORCE TO MAKE UP BUSINESSES TO GET PROPER INPUT FOR THOSE THAT ARE AFFECTED? WHY DO YOU NEED ANOTHER ORDINANCE? , NOT JUST DEMAND CHAPTER 12 -- AMEND CHAPTER 12 OF THE CITY CODE EVEN THOUGH IT MAY NOT BE POSSIBLE. I DON'T KNOW.
WHAT IN CHAPTER 12 IS NOT WORKING? SECTION 1219 DEALS WITH DISCONTINUING BUSINESSES THAT DON'T PAY THEIR TAXES. WHY IS THIS NOT CURRENTLY WORKING? IS THIS ABOUT TAXATION? WHY HAS THE CITY BROADENED THE SCOPE WITHIN THE BUSINESS LICENSE ORDINANCE TO BE SO ENCOMPASSING? THE PHRASE PUBLIC HEALTH SAFETY AND WELFARE OF THE CITIZEN IS THAT ORDINANCE. I THOUGHT THIS WAS ABOUT TAXATION. I'M NOT SURE WHAT WE HAVE ADDED THAT. WE HAVE THAT IN OTHER PARTS OF THE CITY CODE. THIS ORDINANCE IS WAY TOO BROAD.
IS LIKE A COUPLE THAT HAS THREE BUSINESSES IN AUBURN AND THEY HAVE THREE EMPLOYEES AT EACH LOCATION AND ONE OF THOSE EMPLOYEES GOES BEHIND THEIR BUILDING AND A POLICE COMES UP AND HE'S DOING DRUGS AND THAT PERSON IS ARRESTED AND THAT BUSINESS CAN BE SHUT DOWN BY THIS ORDINANCE.
NOW I KNOW THE CITY IS GOING TO SAY, WELL, WE DON'T HAVE ANY
INTENTION OF DOING THAT. >> SPEAKER: YOUR TIME IS UP.
WHO WILL BE NEXT? >> SPEAKER: GOOD EVENING.
MY NAME IS REYNOLDS AND RECORDS. I HAVE MY BUSINESS CALLED DOGGY DAWG BAY I'M ON THE AGENDA. LOGAN GAVE ME A BRIEF -- THIS IS MY FIRST TIME SO. HE ASKED ME IF I HAD TO ASK CITY COUNCIL IF THEY HAD ANY QUESTIONS ABOUT MY APPLICATION OR ANY OF THAT NATURE. I JUST WOULD LIKE TO SAY THANKS FOR THE OPPORTUNITY TO BE DOWNTOWN TO SELL HOT DOGS AND SAUSAGES AND ANY -- ANYTHING LIKE COLD DRINKS AND STUFF FOR THE CITIZENS AND COLLEGE STUDENTS DOWNTOWN.
AS FAR AS THE ADDRESS ON GAY STREET, 125 GAY STREET.
[00:20:04]
MR. SAINI, HE WENT TO MY CARTS ONE TIME, OVER ON ACE HARDWARE ON UNIVERSITY DURING THE WEEK. I JUST WANTED TO COME UP AND SEEIF YOU HAD ANY QUESTIONS. >> SPEAKER: TO AS ANYBODY HAVE
ANY COMMENTS OR QUESTIONS? >> SPEAKER: WE DID INQUIRE ABOUT YOUR BUSINESS AT OUR PACKET MEETING LAST WEEK AND IT SOUNDS GREAT AND I CAN'T SPEAK FOR EVERYBODY BUT I'M EXCITED
ABOUT THIS OBJECT. >> SPEAKER: YES, SIR.
>> SPEAKER: IT WAS MIGHTY GOOD. >> SPEAKER: THANK YOU.
I WAS LIKE, I HOPE I GET TO SEE THEM AND ASK THEM HOW THE HOTDOG WAS AND WE TALKED FOR A FEW MINUTES AND IT WAS LOVELY.
I LOVE SERVING THE PEOPLE OF AUBURN.
I REALLY WANT TO GET DOWNTOWN, I WANT TO HAVE MY CAR TO BE A SAFE PLACE COLLEGE STUDENTS TO COME AT NIGHT WHERE THEY CAN BE LOONY A LITTLE BIT AND I WANT TO HAVE A SPACE.
>> SPEAKER: LOONY IS A GREAT WORD.
>> SPEAKER: >> SPEAKER: LIKE SAFE AND IF IT OVERCOMES, SOMETIMES THEY GET IN THE UBER IN THE WRONG UBER AND THEY DON'T KNOW WHERE THAT NUMBER IS.
I JUST WANT TO BE DOWN THERE AND BE A SAFE PLACE FOR EVERYBODY.
>> SPEAKER: ANY OTHER QUESTIONS?
>> SPEAKER: WHY ARE YOU LIMITING IT TO THAT ONE
LOCATION? >> SPEAKER: WELL, WITH THE RULES, ALL OF THE SIDEWALKS HAVE TO BE 10 FEET AND 200 FEET AWAY FROM THE RESTAURANT AND SO THERE ARE NOT A LOT OF PLACES I CAN BE DOWNTOWN SO UNFORTUNATELY THE PLACE ON GAY STREET I CAN ONLY BE THERE AFTER SIX BECAUSE THERE IS A RESTAURANT ACROSS THE STREET. I WANTED TO BE OVER THERE ON SOUTH COLLEGE NEAR THE BOOKSTORE , JAY AND AM, THE LITTLE PIECE OF SIDEWALK IS LIKE 10 FEET, BUT LOGAN WAS LIKE, THE NEIGHBORS MIGHT BE A LITTLE UPSET BECAUSE IT'S A HIGH-RISE WHERE PEOPLE LIVE AT SORT OF NEAR THERE.
THAT WAS THE ONLY OTHER PLACE. AND IT IS NOT REALLY TOO MANY PLACES DOWNTOWN TO HAVE 10 FEET WALKWAYS SO IT'S HARD TO BE DOWNTOWN WITHOUT IT BEING INTERFERING WITH OTHER RULES AND
STUFF. >> SPEAKER: AND CUBES FACT BUT IF I COULD BE SOMEWHERE ELSE I WOULD GLADLY BE THERE.
>> SPEAKER: I LOOK FORWARD TO A BREAK THANK YOU.
>> SPEAKER: YOUR PROPOSED HOURS ARE MONDAY THROUGH FRIDAY 6 PM TO 10 PM. ARE THOSE YOU WILL TEST THE
WATERS? >> SPEAKER: YET, JUST TO TEST THE WATERS. JUST TO SEE HOW IT IS.
PROBABLY I WILL TEST IT OUT TO SEE HOW IT GOES.
>> SPEAKER: ISELLE ESSAYS -- I SELL AT A LIKE 11 TO FOUR SPECIAL YOU WILL CHANGE YOUR LOCATION DEPENDING ON YOUR
WORKDAY? >> SPEAKER: YES, SIR.
I USUALLY POSTED ON SOCIAL MEDIA I HOPE YOU GUYS CAN COME BY AND GET A HOT DOG OR A SAUSAGE OR I CAN MAKE A SAUSAGE.
>> SPEAKER: I ADMIRE YOUR WILLINGNESS TO BE IN BUSINESS.
THANK YOU FOR MAKING AN INVESTMENT IN AUBURN AND WE LOOK FORWARD TO SHARING HOTDOG WITH YOU SOON.
>> SPEAKER: THANK YOU. >> SPEAKER: A FEW QUICK THINGS, HER ABILITY TO BE AT ACE'S REGULAR DID BY DIFFERENT SECTION OF THE ZONING ORDINANCE BUT MUCH EASIER THERE IS A LOT OF HOOPS TO JUMP THROUGH DOWNTOWN WITH REGARD TO FOOD TRUCKS ARE NOT ALLOWED BUT PUSHCARTS ARE. SHE HAS WORKED DILIGENTLY WITH STAFF FOR SEVERAL MONTHS TRYING TO FIND A SPOT.
THE GAY STREET PARKING LOT LOCATION MEETS ALL OF THE CRITERIA. THERE IS ELBOWROOM THERE, IT IS NOT NEAR RESTAURANTS, IT IS NOT CALLING OUT ACROSS THE BANK BUILDING THERE IS A COFFEE SHOP THAT CLOSES AT SIX AND THAT IS WHY THE HOURS CAN'T BEGIN UNTIL THEN BASED ON HOW THE ORDINANCE WAS ORIGINALLY WRITTEN. THERE IS WAIVER PROVISION SSO SHE HAS WORKED DILIGENT WITH US AND IT WAS IMPORTANT FOR STAFF TO FIND A LOCATION THAT HAD PEDESTRIAN ACTIVITY.
BUT YET MET ALL OF THE CRITERIA AND MEASURING DISTANCES FOR THE
ORDINANCE. >> SPEAKER: WE ARE STILL IN CITIZENS COMMUNICATIONS ON ITEMS ON TONIGHT'S AGENDA.
ANYONE ELSE LIKE TO SPEAK TO THE COUNCIL REGARDING THAT?
[7. CITY MANAGER’S COMMUNICATIONS.]
OKAY. WILL MOVE AHEAD.CITY MANAGERS COMMUNICATIONS. >> SPEAKER: I WOULD LIKE TO ANNOUNCE THREE VACANCIES ON THE BOARD OF ZONING ADJUSTMENT.
THERE ARE TWO REGULAR POSITIONS AND ONE SUPERNUMERARY POSITION PREP FOR THREE YEAR TERMS BEGIN JANUARY FIRST 2023 AND END JANUARY 20, 2026. IF YOU ARE READY FOR THE CONSENT AGENDA DOES ANY COUNCIL MEMBER WISH TO REMOVE AN ITEM FROM THE CONSENT AGENDA AND DEAL WITH THAT ITEM INDIVIDUALLY?
>> SPEAKER: I WOULD LIKE TO REMOVE 8E1.
[00:25:04]
>> SPEAKER: ANYONE ELSE? >> SPEAKER: I WOULD LIKE TO
ANYONE ELSE? MS. CITY MANAGER MARK 8E1.
[8.e.1 Barge Design Solutions. Authorize Amendment 1 to Task Order 31: Auburn University Sub‐Basin FY22 SSES Project. $21,000. ]
>> SPEAKER: AUTHORIZES AMENDMENT ONE TASK ORDER 31 AUBURN UNIVERSITY SUBBASIN FY SANITARY SEWER SYSTEM ADVENTIST -- DESIGN SOLUTIONS IN THE AMOUNT OF $21,000.
>> SPEAKER: MOVE FOR APPROVAL. >> SPEAKER: MOTION AND SECOND.
MITCHELL GRISWOLD? >> SPEAKER: DURING OUR PACKET MEETING, WE MENTIONED THAT THE ORIGINAL AGREEMENT INCLUDED SOME FUNDING FROM AUBURN UNIVERSITY. I'VE SINCE LEARNED THAT THAT IS NOT THE CASE BUT I WAS CURIOUS AS TO THE UNIVERSITY'S CONTRIBUTION TO THIS AMENDMENT AND TO ANY FOLLOW ON ACTIVITY
THAT IS GENERATED BY THIS STUDY. >> SPEAKER: ABSOLUTELY.
I HAD TOLD YOU THROUGH PACKET MEETING ATTRIBUTE IN AND THAT IS A FOLLOW ON TO WHAT WILL EVENTUALLY BE AN OPERATION AND MAINTENANCE AGREEMENT. I'M GOING TO EXPLAIN AND LET THE CITY MANAGER SPEAK BEFORE OUR WATER RESOURCE MANAGEMENT DIRECTOR EXPLAINS A LITTLE BIT DEEPER.
AT THE END OF THE DAY A NUMBER OF MAJOR CITY SEWER LINES RUN RIGHT TO THE MIDDLE OF AUBURN UNIVERSITY'S CAMPUS AND AT THIS TIME YOU DON'T -- WE HAVE A RESPONSIBILITY THROUGH THE ALABAMA DEPARTMENT OF ENVIRONMENTAL MANAGEMENT TO MAINTAIN THEM BUT AUBURN UNIVERSITY HAS BEEN ALSO MAINTAINING THEM OVER THE YEARS AND WE ARE WORKING TOGETHER JOINTLY TO EVALUATE ALL OF THE LINES AND SEE WHAT CONDITION THEY ARE IN, ANY MAINTENANCE THAT NEEDS TO BE PERFORMED, AND ULTIMATELY WE ACTUALLY DON'T HAVE EASEMENTS FROM AUBURN UNIVERSITY AND WE ARE STRIVING TO GET THOSE SO WE HAVE THE RIGHT THINGS FOR OUR CITIZENS THEY DON'T UNDERSTAND AUBURN UNIVERSITY IS ITS OWN STATE ENTITY IN OUR CITY LIMITS AND WE DON'T NECESSARILY UNLESS WE DO BY CONTRACT HAVE RIGHTS TO ENTER AUBURN UNIVERSITY'S PROPERTY TO PERFORM CERTAIN SERVICES.
EVERYBODY IS COLLABORATING AND WORKING TOGETHER BUT FINANCIAL CONTRIBUTIONS WILL COME AT THE TIME OF OPERATION AND MAINTENANCE AGREEMENT AND I WILL HAVE ERIC ADD ONTO THAT.
>> SPEAKER: YOU DID A GREAT JOB EXPLAINING THAT.
YEAH, THIS PROJECT IS NO DIFFERENT THAN ANY OTHER SSC PROJECT. IT IS BEEN A LONG TIME SINCE THE SEWER -- THESE SEWER MAINS HAVE BEEN EVALUATED WITH THE GROWTH IN AUBURN I THOUGHT IT WAS AN APPROPRIATE TIME TO GO AHEAD AND PUSH THIS AND MAKE SURE THERE ARE NO PROBLEMS. WE HAVE SEWER MAINS THAT RUN UNDER BUILDINGS, UNDER SHOWED SHOULD STADIUM, WE NEED TO MAKE SURE -- CHECKED THE AND HAVE CONTINGENCY PLANS IF SOMETHING WERE TO HAPPEN.
ANYTHING WE SEE IN THE SURVEY WE WILL ADDRESS WITH AUBURN AS PART OF THE MAINTENANCE AGREEMENTS AND THEY WILL HAVE SKIN IN THE GAME AND TRYING TO REPAIR THESE LINES.
I DO KNOW THEY ALREADY HAVE SOME PROJECTS LINED UP WHERE THEY ARE PLANNING ON LINING SOME OF THE EXISTING SEWER MAINS ARE READY.
THEY HAVE COMMITTED FUNDS TO THAT.
THE ONLY REASON WE ARE BACK TO YOU TONIGHT IS THAT DURING THE FIRST PHASE OF THIS SURVEY WE HAVE ENCOUNTERED SOME AREAS THAT NEEDED SOME HEAVY PLEADING AND WE WERE NOT ABLE TO GET OUR CAMPERS THROUGH THEIR SO WE HAD TO DO SOME HEAVY CLEANING TO GET THE DEBRIS OUT OF THE LINES AND THEN GO BACK.
AND ALSO A COUPLE OF THE MANHOLES THAT WE HAD TO INSPECT AND SO WE ARE UNDER SOME OF THE FOOTBALL PRACTICE FIELDS AND THEY DIDN'T WANT US DIGGING THAT UP DURING FOOTBALL SEASON.
SO I APPRECIATE YOU ASKING THESE QUESTIONS BUT IF YOU HAVE ANY MORE I WOULD BE GLAD TO ANSWER THEM BACK THANK YOU FOR THAT EXPLANATION. THAT SATISFIES ME.
>> SPEAKER: ANY OTHER COMMENTS OR QUESTIONS? MOTION AND SECOND. ALL IN FAVOR, PLEASE SAY AYE.
[8.e.4 McMillan, Pazdan, Smith, LLC. Design services for Auburn Public Library Public Restroom ADA Improvements Project. $15,750. ]
ANY OPPOSED? MOTION CARRIES.>> SPEAKER: AUTHORIZES DESIGN CONTRACT WITH MCMILLAN, PAZDAN, SMITH LLC FOR THE AUBURN PUBLIC LIBRARY PUBLIC RESTROOM ADA IMPROVEMENTS PROJECT IN THE AMOUNT OF $15,750.
>> SPEAKER: MOVE FOR APPROVAL. >> SPEAKER: SECOND.
MOTION AND SECOND. >> SPEAKER: THIS IS FOR DESIGN SERVICES ONLY BUT I UNDERSTAND THE CONSTRUCTION ON THIS PROJECT IS EXPECTED TO BEGIN SOMETIME THIS SUMMER AND WILL BE EXTENSIVE AND EXPENSIVE. I BELIEVE IT WILL ENCOMPASS FOUR RESTAURANTS, TWO FOR THE BOYS AND TWO FOR THE GIRLS.
AND SINCE WE ARE IN THE DESIGN PHASE OF THIS PROJECT, I WANTED TO ASK IF THE LIBRARY EXPECT TO CONTINUE IN OPERATION DURING THIS CONSTRUCTION IN LIGHT OF THE POSSIBLE CONCRETE REMOVAL
AND OTHER DEMOLITION. >> SPEAKER: ABSOLUTELY.
I WILL HAVE TYLER WITTEN, OUR LIBRARY DIRECTOR INTERRUPTS ME IF I MISSED STEP, BUT THAT IS PART OF THE DESIGN IS WE WILL MAKE A PLAN FOR WHAT WE HAVE TO TAKE OUT OF SERVICE.
WE ARE ALSO LOOKING AT TOTALLY REVAMPING THESE RESTROOMS. WE MAY COME BACK TO YOU WITH SLIGHTLY DIFFERENT PLAN AND A LOT OF OUR BUILDINGS TO MAKE ALL INDIVIDUAL -- IS A ROOM FOR EVERY TOILET WILL HAVE ITS OWN ROOM AND THERE WILL BE A COMMON SINK AREA AND THERE MAYBE NOTE GENDER PREFERENCE SO THAT IT IS
[00:30:03]
JUST INDIVIDUAL UNISEX BATHROOMS. WE MAY MAKE A TOTAL SHIFT WITH THESE AND COMPLETELY GUTTED ANDREPLACED THE BATHROOMS ENTIRELY. >> SPEAKER: I WONDER IF THE CONSTRUCTION COULD BE DONE IN A STAGGERED FASHION SO THAT RESTROOMS WOULD BE AVAILABLE FOR MALES AND FEMALES INDEPENDENTLY.
WITHOUT BOTH SEXES HAVING TO SHARE A SINGLE RESTROOM.
>> SPEAKER: WHAT I'M SAYING IS IT IS PART OF THE DESIGN PROCESS AND WE WILL BE WORKING THROUGH ALL OF THOSE THINGS.
WE DON'T HAVE THE ABILITY TO SHUT THIS MAIN BRANCH DOWN BECAUSE IT COULD BE MONTHS SO WE WILL HAVE TO SHIFT.
WE MAY BRING RESTROOM TRAILERS ENTER THERE WILL BE MALE AND FEMALE BATHROOMS BUT WE ARE ALSO LOOKING AT OTHER DESIGNS TO ACCOMMODATE FAMILIES, PARENTS WITH SMALL CHILDREN, DIFFERENT DESIGNS THAT REALLY HELP FACILITATE FOR WHAT WE ARE ENCOUNTERING TODAY VERSUS WHEN THE LIBRARY WAS BUILT.
PARTICULARLY FOR ADA ACCESS. REGARDLESS WE HAVE TO GET INTO THE SLAB TO RIP OUT PLUMBING AND REBUILD IT AND SO WE WILL AND HAVE TO BUY CODE IF WE ARE GOING TO REMAIN OPEN WE HAVE TO HAVE ENOUGH RESTROOMS AND ACCOMMODATE ADA REQUIREMENTS THROUGHOUT THE ENTIRETY OF CONSTRUCTION AND THAT IS PART OF WHAT WE ARE
DEALING WITH. >> SPEAKER: ANY OTHER COMMENTS OR QUESTIONS? ALL IN FAVOR, PLEASE SAY AYE.
[8. CONSIDERATION OF CONSENT AGENDA.]
MOTION TO APPROVE THE BALANCE OF THE CONSENT AGENDA?>> SPEAKER: SO MOVED. >> SPEAKER: SECOND.
>> SPEAKER: MOTION AND SECOND. ANY OTHER FURTHER COMMENTS OR QUESTIONS? ALL IN FAVORED THE CONSENT AGENDA? ANY OPPOSED?
[9. ORDINANCES.]
CONSENT AGENDA HAS PASSED. >> SPEAKER: AND ORDINANCES, ITEM NINE CAPITOL 80 PROVISION THAT ESTABLISHES A PROCESS FOR REVOCATION OF A BUSINESS LICENSE AND SETS FORTH THE CIRCUMSTANCES UNDER WHICH A BUSINESS LICENSE MAYBE REVOKED.
THIS ITEM WAS POSTPONED FROM NOVEMBER 1 PRINT THE PUBLIC
HEARING IS RECOMMENDED. >> SPEAKER: MOVE TO POSTPONE
THIS UNTIL JANUARY THE 17TH. >> SPEAKER: SECOND.
>> SPEAKER: MOTION AND SECOND TO POSTPONE THE TO JANUARY 17.
I WAS GOING TO EXPLAIN. CITY MANAGER IS PUT A MEMO IN OUR BOOK. I WOULD ENCOURAGE THE COUNCIL TO MOVE FORWARD TONIGHT WITH A PLAN OF HAVING SOME INFORMATION GATHERING SESSION AT OUR NEXT COMMITTEE OF THE WHOLE WHERE THE STAFF CAN PRESENT THEIR REASONING BEHIND THIS POTENTIAL ORDINANCE AND FOR THE COUNCIL TO BE ABLE TO ASK THE QUESTIONS THAT THEY NEED TO ASK AND THEN THIS WOULD PUT THE DECISION ULTIMATELY ONE MONTH PAST THAT. I DO KNOW THERE HAS BEEN A NUMBER OF MEETINGS WITH BUSINESSES THAT HAVE OCCURRED RECENTLY IN THE LAST FEW WEEKS. AS WELL AS CONVERSATIONS WITH CITIZENS. I DO BELIEVE THE COUNCIL IS IN A POSITION WHERE THEY NEED SOME MORE INFORMATION AND NEED TO HAVE AN OPPORTUNITY TO ASK SOME MORE QUESTIONS AND HEAR FROM SOME MORE CITIZENS. THIS WOULD GIVE US I BELIEVE THAT YOU HAVE TIME TO DO ALL OF THAT.
SO WE WOULD HAVE A COMMITTEE OF THE WHOLE DEDICATED TIME TO GO THROUGH A PRESENTATION FROM THE STAFF AND THEN THIS WOULD BE A DECISION WE WOULD MAKE A PROXIMALLY ONE MONTH LATER.
CORRECT? >> SPEAKER: ABSOLUTELY.
>> SPEAKER: SORRY TO INTERRUPT, MS. WITTEN.
>> SPEAKER: YOU COVERED MY QUESTION ABOUT A WORK SESSION OR A PRESENTATION TO BE ABLE TO ANSWER IN-DEPTH QUESTIONS.
WE DID RECEIVE QUITE A FEW DETAILS OF FREAK REALLY ASKED QUESTIONS THAT ARE IN THIS PACKET THAT IS AVAILABLE TO THE PUBLIC. I BELIEVE BUSINESS STAKEHOLDERS DIVE INTO THIS AND BE AVAILABLE TO SEND US QUESTIONS IF THEY HAVE ADDITIONAL ONES THAT WE CAN ANSWER DURING A PRESENTATION.
>> SPEAKER: I THINK, IF I MAY, ONE IMPORTANT THING TO NOTE IS CITY COUNCIL MEMBERS HAVE NO IDEA WHO HAS PAID TAXES AND WHO IS NOT BECAUSE THAT IS CONFIDENTIAL.
WE ARE NOT ALLOWED BY STATE LAW TO DIVULGE THAT SO YOU ARE PUT IN A UNIQUE POSITION THAT YOU WOULD NOT HAVE DAILY AWARENESS, THAT IS AN OPERATIONAL ITEM THAT ONLY IS HANDLED AND DIRECTED BY THE STAFF AND IT WOULD BE A VIOLATION OF STATE LAW AS TO OTHERWISE. IF WE WERE TO GO DATAPATH EITHER WAY, WHAT IS BEEN PROPOSED HERE IN A DIFFERENT PATH WE WOULD HAVE TO TAKE PEOPLE TO COURT TO GET MONEY, THIS IS ABOUT COLLECTION OF TAXES, BUT I WANT EVERYBODY TO UNDERSTAND THAT YOU CAN'T CALL ME AND SAY, IS XYZ BUSINESS HAVE A PAY THEIR TAXES? I CAN'T PROVIDE THAT INFORMATION , IT IS CONFIDENTIAL.
THAT IS WHY ALSO THE COUNCILMEMBERS MAY NOT HAVE DAILY INFORMATION ABOUT WHAT IS GOING ON WITH PAID TAXES.
I COULD TELL YOU CUMULATIVELY ARE I CAN TELL YOU THREE BUSINESSES OWE SEVERAL HUNDRED THOUSAND DOLLARS COMBINED OR I CAN TELL YOU THOSE THINGS BUT I CAN'T TELL YOU NAMES OR TYPES OF BUSINESSES OR ANYTHING ELSE. THAT IS PART OF THE PUZZLE THAT THE COUNCIL ENCOUNTERS WHEN WE WORK THROUGH THESE THINGS.
BUT WE WILL BE READY IN THE WORK SESSION I FEEL THESE MEETINGS HAVE BEEN PRODUCTION, THE FREQUENTLY ASKED QUESTIONS
[00:35:02]
PROVIDED TO YOU IS 100 PERCENT BASED ON QUESTIONS WE HAVE RECEIVED TO DATE. IN THOSE MEETINGS.THEY HAVE BEEN VERY HELPFUL AND PRODUCTIVE WITH THE BUSINESSES AND CHAMBER OF COMMERCE MEETING WITH TO BETTER UNDERSTAND WHAT QUESTIONS ARE OUT THERE. WE ARE HERE TO ANSWER QUESTIONS AND WE ARE DEFINITELY HERE TO BE SUPPORTIVE OF BUSINESS, BUT WE ARE ALSO HERE TO LEVEL THE PLAYING FIELD.
BUSINESSES ARE PAYING THEIR TAXES AND IN OPERATION, I'M TALKING ABOUT AT A 7100 RIGHT NOW WE ARE TALKING ABOUT THREE BUSINESSES OUT OF 7100 THAT WERE HAVING A CONSISTENT CHALLENGE WITH. THOSE ARE SOME OF THE THINGS WE WILL GO OVER AT THE COMMITTEE OF THE WHOLE TO GIVE YOU MORE INFORMATION. I WANT TO BRING YOUR QUESTIONS WITH YOU WE WOULD LOVE NOTHING MORE TO THEN TO ANSWER THEM.
>> SPEAKER: DO YOU ANTICIPATE BETWEEN NOW AND JANUARY 17 SINCE BUSINESS LICENSE RENEWALS ARE KIND OF IN THAT TIME FRAME THAT WE WOULD SEE A REQUEST TO TAKE ACTION AGAINST ANY INDIVIDUAL
BUSINESS? >> SPEAKER: NO, WE ARE READY RIGHT NOW BUT WE ACTUALLY HAD THREE WHEN WE STARTED THIS PROCESS IN OCTOBER, BUT NOW THERE ARE TWO.
DEPENDING ON WHAT YOU CHOOSE ABOUT THIS ORDINANCE, IF YOU DON'T PURSUE WITH THIS ORDINANCE, WE WILL COME TO YOU AND ASK TO BUSINESSES THE COURT IMMEDIATELY.
WE NEED TO PICK THEY ARE NOT PAYING US AND THEY ARE ALLOWED TO CONTINUE TO DO BUSINESS ALONG WITH EVERYBODY ELSE WHO IS PAYING YOUR TAXES. THEY ARE COLLECTING TAXES BUT NOT REMITTING THEM TO THE CITY'S BACK OF THE QUESTIONS FOR THE CITY MANAGER? I JUMPED OUT THERE AND ASKED TO POSTPONE THE TO JANUARY 17. I'M NOT SURE MS. CROUCH CROUSE
WAS I OUT OF ORDER? >> SPEAKER: YOU ARE FINE AND YOU GOTTA CHECK IN FROM COUNCILMAN PARSONS.
IS THAT CORRECT? SO YOU ARE HAVING DISCUSSION AND
THAT'S UP TO YOU GUYS. >> SPEAKER: THIS TO BE A VOICE
>> SPEAKER: ALL IN FAVOR OF POSTPONING THIS TO JANUARY 17?
>> SPEAKER: OKAY, ONE DAY. >> SPEAKER: CITY SALES TAX EXEMPTION FOR SPECIFIED ITEMS AS PART OF THE SEVERE WEATHER PREPAREDNESS SALES TAX HOLIDAY THAT RUNS FROM FRIDAY FEBRUARY 24 THROUGH SUNDAY FEBRUARY 26.
UNANIMOUS CONSENT IS NECESSARY. >> SPEAKER: I WILL INTRODUCE THE ORDINANCE AND ASK FOR UNANIMOUS CONSENT.
>> SPEAKER: SECOND. >> SPEAKER: MOTION AND SECOND.
DOES ANYONE ON THE COUNCIL HAVE A PROBLEM MOVING FORWARD WITH A VOTE ON THIS THIS EVENING? ANY COMMENTS OR QUESTIONS? THIS IS BEEN GOING ON FOR A NUMBER OF YEARS.
I BELIEVE ULTIMATELY THERE WILL BE A LIST OF INFORMATION OUT THERE THAT NORMAL TO THE SAY PUTS OUT THE TYPES OF PERSONAGES YOU CAN MAKE. AND SAVE ON THE SALES TAX.
LINDSAY, ROLL CALL? (ROLL CALL VOTE)
>> SPEAKER: MAYOR, WHILE I WAS OUT OF ORDER I WOULD LIKE TO REMIND OUR MOBILE PUSHCART DOGGY DAWG? THAT THAT WAS APPROVED AS PART OF THE CONSENT AGENDA BECAUSE IT WASN'T CALLED OUT INDIVIDUALLY SO I WANT TO MAKE SURE YOU WERE
APPROVED. >> SPEAKER: CONGRATULATIONS.
>> SPEAKER: MOVING FORWARD AND ORDINANCES, ITEM 9C AMEND ELECTRICAL CODE AND RESIDENTIAL CODES REMOVE THE NEWLY CREATED STANDARDS OF THE CITY OF AUBURN HAD PLANNED TO IMPLEMENT IN JANUARY OF 2023 BREAK THOSE STANDARDS REQUIRED OUTDOOR HEATING, VENTILATION AND AIR CONDITIONING ALSO KNOWN AS HVAC EQUIPMENT. TO HAVE A GROUND FAULT INTERRUPTER DISCONNECTED. GFCI THE LITTLE TRIP PLUG.
THIS REQUIREMENT HAS BEEN REPORTED NATIONWIDE TO CAUSE MANY ISSUES THEREFORE WE ARE RECOMMENDING THAT THE REQUIREMENTS BE REMOVED. YOUR ACTION TONIGHT DEPENDING ON WHAT YOU DO WOULD REMOVE THE REQUIREMENTS.
UNANIMOUS REQUEST IS NECESSARY AND A PUBLIC HEARING IS REQUIRED
>> SPEAKER: I WILL INTRODUCE THE ORDINANCE AND ASK FOR
UNANIMOUS CONSENT. >> SPEAKER: SECOND.

SEEING OR HEARING NONE I WILL OPEN THE PUBLIC HEARING PICK IF YOU WOULD LIKE TO ADDRESS THE CITY COUNCIL PLEASE COME FORWARD AND GIVES GIVE US YOUR NAME AND ADDRESS FOR THE RECORD.

ANY COMMENTS OR QUESTIONS FROM THE COUNCIL?
>> SPEAKER: I WOULD LIKE TO CLARIFY.
IF WE VOTE YES THAT MEANS TO REMOVE?
>> SPEAKER: ABSOLUTELY. YOU IMPLEMENT TO THIS CODE WE ACTUALLY ASKED FOR A DELAY OF IMPLEMENTATION THE JANUARY OF 2023 TO LEARN MORE ABOUT IMPLEMENTATION.
I THINK SOMETIMES PEOPLE THINK THE COUNCIL ADOPTS OR STAFF RECOMMENDS CARTE BLANCHE AND WE DON'T PICK WE HAD CONCERNS ABOUT THIS OUT OF THE GATE AND NOW OUR CHIEF BUILDING OFFICIAL HAS LEARNED THERE IS A LOT OF ISSUES WITH THIS SO WE DON'T WANT TO PROCEED WITH A LIMITATION IN JANUARY 2023.
YOU WANT TO WALK AWAY FROM THIS AND THEY ARE REWRITING THE CODE AS A MATTER FACT SO IT IS OUR STRONG RECOMMENDATION THAT YOU
APPROVE THIS. >> SPEAKER: ANY OTHER COMMENTS OR QUESTIONS? LINDSAY?
(ROLL CALL VOTE) >> SPEAKER: UNDER RESOLUTIONS

>> SPEAKER: YES, MISTER MAYOR. THE STAFF PREVIOUSLY RECOMMENDED THIS ADDITIONAL CONDITION. CAN SOMEBODY EXPLAIN WHAT HAS CHANGED AND THE RATIONALE BEHIND AGREEING TO WITHDRAW THIS
CONDITION? >> SPEAKER: WELL, WHEN IT IS A CONDITION IT IS A MUST AND WHEN I GO TO A STAFF RECOMMENDATION AND SOMETHING TO BE LOOKED AT THE DEVELOPMENT REVIEW PROCESS
[00:45:03]
IT IS A REQUEST. WHAT HAPPENED IS IF YOU LOOK IN YOUR PACKET YOU HAVE A DRAWING AND I HAVE BRIAN WOULD OUR CITY ENGINEER IS OUT THIS EVENING BUT BRIAN WOULD IS OUR ENGINEERING DIVISION MANAGER AND CAN EXPLAIN FURTHER IF I GET OFF COURSE HERE. ULTIMATELY, WHEN YOU ENTER A DRIVEWAY OFF OF GLENN AVENUE RIGHT NOW IT IS A SHOPPING CENTER THERE IS A CAR WASH TO YOUR RIGHTS AS A CROSS ACCESS DRIVEWAY THAT GOES TO THE BANK. AT THE HARD CORNER.THIS REQUIREMENT REQUIRED A CERTAIN DISTANCE FROM GLENN AVENUE BEFORE YOU COULD ENTER THE TACO BELL PROPERTY.
IF YOU INVOKE THAT AND MAKE IT A MUST, THEN SOMEBODY WANTED TO GO TO THE BANK WILL HAVE TO GO UP THE MAIN DRIVEWAY, TURN AND GO AROUND THE TACO BELL BUILDING TOWARD THE BANK AND SO THIS IS SOMETHING WHERE STAFF IS TO WASH WANTS TO CHANGE A MORE OF A COMMENTS THAT A CONDITION. THE APPLICANT IS REQUESTED IT BE BE REMOVED AND SOMETHING THAT WILL BE CONTINUED TO BE REVIEWED AS PART OF THE DEVELOPMENT TEAM PROCESS.
>> SPEAKER: THANK YOU. >> SPEAKER: ANY OTHER COMMENTS OR QUESTIONS? ALL IN FAVOR SAY AYE? ANY OPPOSED? THE MOTION CARRIES.
[12. CITIZENS’ OPEN FORUM.]
>> SPEAKER: MAYOR, THOSE ARE ALL OF THE ITEMS OF BUSINESS WE HAVE FEW THIS EVENING'S BACK AT THIS TIME WE WILL OPEN CITIZENS OPEN FOR HIM. THIS IS YOUR OPPORTUNITY TO SPEAK TO THE COUNCIL ABOUT ANYTHING THAT MIGHT BE ON YOUR MIND. I REMIND YOU YOU HAVE THREE MINUTES TO DO THAT AND PLEASE GIVE US HER YOUR NAME AND
ADDRESS FOR THE RECORD. >> SPEAKER: IT'S COOL TO BE UP HERE AGAIN TWICE IN ONE DAY. I LOVE ALL OF YOU ALL SO IT'S COOL. I WANTED TO MENTION A COUPLE OF THINGS. I REALIZE THERE IS SOME LEGAL ISSUES DEALING WITH GETTING THE INFORMATION BUT ONCE YOU DO A LAWSUIT CAN YOU NOT GET THE INFORMATION AVAILABLE FOR
EVERYBODY IS THAT CORRECT? >> SPEAKER: WE CAN TAKE THAT UP LATER. WOULD LIKE US TO ANSWER?
>> SPEAKER: YES. I'M TRYING TO READ MY WRITING.
I DON'T UNDERSTAND IF IT IS DEALING WITH TAXES THEN WHY IS THE ORDINANCE SO BROAD? CAN THEY NOT JUST SPECIFY THE TAXES? IF THAT IS YOUR CONCERN LET'S DO THAT. IF YOU HAVE THREE SMALL BUSINESS, THREE LARGE, I DON'T KNOW WHAT THEY ARE, BUT I LIKE EVERYBODY PAYING THEIR TAXES. I THINK EVERYBODY WANTS THEM TO DO THAT SO I DON'T HAVE ANY PROBLEM WITH THAT.
SOMETHING I WANT TO TALK ABOUT TOO IS THE TV SCREENS.
I MENTIONED BEFORE, YOU NEVER PUT ANYTHING UP THERE ANYMORE.
YOU STILL HAVE IT. PLEASE USE THESE SCREENS FOR THE BETTERMENT. YOU HAVE SOME THINGS IN THE PACKETS, PUT THEM UP THERE. IS A LOT PRETTIER THEN THE AUBURN LOGO ALL THE TIME. I FEEL LIKE I AM IN A DAZE.
ALSO I WANTED TO TALK TO SOMETHING I HAVEN'T TALKED ABOUT A FEW TIMES. THE COUNCIL HAS LOST TWO MEMBERS THAT VOTED FOR THIS ORDINANCE 3288 AND ONE OF COURSE HAD TO ABSTAIN AND THAT PERSON IS NO LONGER WITH US.
SIX FAMILIES NOW NO LONGER ARE IN OUR COMMUNITY.
THEY HAD TO SELL THEIR HOMES TO SATISFY THIS COUNCIL BY FOLLOWING THE LAW THAT YOU APPROVED WHILE STRIPPING THEIR PROPERTY RIGHTS, THE CONSTITUTIONAL RIGHTS AND THEIR CIVIL LIBERTIES. THE SHORT TERM RENTAL 3288 IS THE MOST ILL-CONCEIVED LAW IN ALABAMA.
AND AUBURN TRICK IT ALLOWS SOME AREAS TO HAVE SHORT-TERM RENTALS WHILE OTHERS CANNOT. WHILE MISSING -- MISUSING THE ZONING LAWS. AND THE LAST 21 MONTHS, NOTHING HAS CHANGED IN THOSE COMMUNITIES THERE WAS NO PROBLEM BEFORE, THERE'S NO PROBLEM NOW. IN THE SENSE OF NOISE.
THERE IS NO TRAFFIC PROBLEMS THEN, NO TRAFFIC PROBLEMS NOW.
THERE IS NO TRASH PROBLEMS NOW AND THERE WAS NO TRASH PROBLEMS THEN. SO I DON'T QUITE UNDERSTAND WHAT THIS ORDINANCE WAS FOR. OVER THE NEXT FEW MONTHS I WILL COVER MORE OF SOME MISUNDERSTANDINGS.
LET ME EXPLAIN ONE OF THEM. SOME OF THE CITIZENS I REMEMBER SAID THAT FOR THE ORDINANCE TO STAY THAT THEY OR THEIR PROPERTY WOULD BE DEVALUED BUT THEY ARE 100 PERCENT WRONG.
ALL OF THE MATERIAL I HAVE READ AND PROBABLY 100 DIFFERENT ARTICLES ABOUT SHORT-TERM RENTALS, ALL OF THEM INCREASED PER THE BIGGEST CONCERN IS PROPERTY INCREASES TOO FAST.
THEY DON'T LIKE THAT. BUT IN THIS TOWN THEY SAID IT WOULD DECREASE -- IT WOULD NOT BECAUSE IT DOESN'T HAVE ANY OF THOSE STIPULATIONS OF TRASH AND LOOKING DIFFERENT WAYS.
THIRTY-ONE DAYS FROM SHORT-TERM RENTALS, THAT IS 11 PEOPLE THAT
YOU HAVE. >> SPEAKER: THANK YOU SIR.
WHO WILL BE NEXT? >> SPEAKER: I'M STEVE COSGROVE 1927 WATERCRESS DRIVE. ASHTON PARK NORTH LAKES I BELIEVE IS OFFICIALLY CALLED. I AM THE WORST IT'S AMAZING HOW
[00:50:01]
YOU ALL GET ALL OF THIS DONE. AND YOU DO IT TWICE A MONTH.I THINK IT'S AMAZING. I REALLY DO.
I DON'T KNOW -- THE DILIGENCE AND THE THOROUGHNESS AND THE TIME AND EFFORT AND THE CONSCIENTIOUSNESS OF DOING THIS IS AMAZING I REALLY APPRECIATE IT.
I REALLY, REALLY DO. HONORABLE MAYOR, COUNCIL MEMBERS, CITY MANAGER, DIGNITARIES AND ALL.
SEVERAL THINGS SINCE THE LAST MEETING, THE STATE OF THE CITY ADDRESS. I REALLY ENJOYED THAT.
IT IS THE SECOND ONE I'VE BEEN TO.
I HAVE NO IDEA, RON. I'VE BEEN DELIVERING QUITE A FEW PRESENTATIONS BUT I HAVE NO IDEA THE CONTENT AND THE PRECISION AND THE COMPREHENSIVE NESTS OF THAT PRESENTATION.
IT WAS JUST AMAZING. YOU SPENT A LOT OF TIME ON THAT AND THERE WAS A LOT OF INPUT FROM A LOT OF PEOPLE ON THAT'S.
I KNOW THAT. BUT I REALLY ENJOYED THAT.
THE LAMPLIGHTER RECOGNITION, I DON'T CALL IT AN AWARD I CALL IT A RECOGNITION. IT WAS A SPECTACULAR.
THE FAMILY MEMBERS OF THOSE RECOGNIZED, IT IS INDESCRIBABLE.
HOW PROUD THEY WERE. AND HOW PROUD THEY ARE.
SOME OF THEM ARE GETTING UP THERE IN AGE AND I USED EXPRESSION BEFORE, NO ONE IS PROMISED TOMORROW AND IT REALLY REALLY, REALLY DOES APPLY TO I THINK TO THE CITIZENS THAT HAVE CONTRIBUTED SO MUCH TO THIS FINE VILLAGE THAT WE CALL AUBURN.
THAT IS JUST A BRILLIANT, BRILLIANT THING TO DO, TO TIE THAT IN AND MOST OF THEM HAVE NO IDEA THAT THAT IS COMING AND SO FORTH AND YOU GET A LOT OF INPUT FROM A LOT OF PEOPLE AND ONE AWARDEE IN PARTICULAR THAT I TAKE A LOT OF PRIDE IN, SOMEBODY WHO HAS WORKED CLOSELY WITH CHIEF PAUL REGISTER, WORKED CLOSELY WITH CHIEF TOMMY DAWSON, AND CHIEF FRANK DEGRAFF AND READ , AND CHIEF CENTRIC HENDERSON, AND THAT WAS JOHN LOCKHART. I GOT TO KNOW JOHN AND I GOT THE COACHES SON WAY BACK IN 1994 OR SOMEWHERE IN THERE AND HE HAD NEVER PLAYED BASEBALL BEFORE. THAT WAS A REALLY, REALLY NEAT THING. IT WAS A GREAT FRIENDSHIP AND SO FORTH AND REALLY PROUD OF THAT AND PROUD OF THAT INITIATIVE.
THE SUPER SEVEN, OUTSTANDING JOB AGAIN.
I KNOW YOU WORKED YOUR TAIL OFF, YOU WERE EXHAUSTED THE NEXT DAY, I SAW THAT. THE CHRISTMAS PARADE ON SUNDAY, IT WAS REALLY, REALLY NEAT. AND LASTLY, FELTON LITTLE PARK
INITIATIVE IS COMING TOGETHER. >> SPEAKER: THANK YOU I REALLY
APPRECIATE WHAT YOU'RE DOING. >> SPEAKER: WHO WILL BE NEXT?
>> SPEAKER: MAYOR ANDERS, 412 OPELIKA RD., WHEN MRS. TAYLOR REFERRED TO HER COMMENTS THIS EVENING ON THE THANKSGIVING DINNER AND BINGO, SHE REFERRED TO ME.
I WAS ONE OF THE BINGO PLAYERS. BUT I CAME UP HERE THIS EVENING TO THANK YOU ALL FOR PROVING FROM YOUR CONSENT AGENDA THE ITEM IN REFERENCE TO AUBURN PUBLIC LIBRARY'S PUBLIC RESTROOMS. I GO TO THE LIBRARY A LOT AND I DO USE THE RESTROOMS AND I'M THANKFUL THAT YOU ALL ARE THINKING OF MEETING YOUR REQUIREMENTS OF ADA SO THAT OUR SENIOR CITIZENS CAN BE HELPED. I THINK IT WOULD BE TREMENDOUS HELP LATER ON AND I AM SURE THAT THE LIBRARY PEOPLE WILL LET US KNOW AT THE PROPER TIME SO THAT EVERYTHING WILL BE RIGHT.
I JUST WANTED TO EXPRESS THOSE CONCERNS THAT IT WILL GO ALONG SMOOTHLY. I HEARD RECENTLY ABOUT AN INCIDENT WHERE A POLICE OFFICER USED A TASER TO KILL SOMEONE RECENTLY. THIS CAME TO MY ATTENTION RECENTLY. IF YOU ALL COULD LOOK FURTHER INTO THAT, I WOULD APPRECIATE IT VERY MUCH.
I DON'T KNOW ALL OF THE INFORMATION, BUT AS A PERSON WHO IS CONCERNED ABOUT THE RELATIONSHIP BETWEEN LAW ENFORCEMENT AND CITIZENS, I AM VERY CONCERNED ABOUT THAT.
SO I DIDN'T WANT TO MAKE A COMMENT ON THAT NEGATIVE OR POSITIVE BECAUSE I DON'T HAVE ALL OF THE INFORMATION TO BE HONEST WITH YOU. BUT I JUST WANTED TO LET YOU
[00:55:01]
KNOW THAT I AM CONCERNED ABOUT THAT AS A CITIZEN.THANK YOU. >> SPEAKER: THAT WAS A PRETTY COMMON THERE WAS STRONG, THAT YOU MAY.
I KNOW THIS INVESTIGATION IS GOING ON AND WE ARE NOT AT LIBERTY TO SAY ANYTHING AS A COUNCIL COUNCIL.
IS THERE ANYTHING THAT CAN BE CLARIFIED AND WHAT THIS
GENTLEMAN JUST SAID? >> SPEAKER: I WILL HAVE OUR PUBLIC SAFETY PAUL REGISTER ANSWER.
>> SPEAKER: YES, MAYOR, COUNCIL MEMBERS, AS ANY SITUATION WHERE LAW ENFORCEMENT IS INVOLVED IN AN INCIDENT SUCH AS THIS, WE CALL IN THE STATE OF ALABAMA LAW ENFORCEMENT AGENCY TO INVESTIGATE, THAT WAY IT IS AN UNBIASED INVESTIGATION DONE BY SEPARATE AGENCY. THEY ARE IN THE PROCESS OF DOING THAT INVESTIGATION NOW AND AFTER THAT THIS INFORMATION WILL BE PRESENTED PROBABLY TO THE GRAND JURY IN LEE COUNTY SO THAT WE WILL WAIT FOR THAT INFORMATION BEFORE WE KNOW ANYTHING FURTHER.
>> SPEAKER: WHO WILL BE NEXT? >> SPEAKER: MAYOR, IF I MAY.
THAT'S THE WAY IT IS COMMONLY DONE REGARDLESS OF WHAT HAPPENS.
>> SPEAKER: ABSOLUTELY, THAT IS STANDARD OPERATING PROCEDURE IN ALABAMA INVESTIGATION IS DONE AND THAT INFORMATION PRESENTED TO THE GRAND JURY. THAT IS STANDARD OPERATING PROCEDURE. THIS IS NO DIFFERENT THAN ANY OTHER SITUATION. IT WOULD BE SIMILAR TO THAT.
>> SPEAKER: THANK YOU. >> SPEAKER: I BELIEVE THE PUBLIC SAFETY DIRECTOR DID RELEASE A PUBLIC STATEMENT, A PRESS RELEASE DETAILING THE ITEMS THAT WERE RELEASABLE AND FRIENDLY THAT IS THE SAME THING WE HAVE RECEIVED.
>> SPEAKER: CORRECT. >> SPEAKER: ANYONE ELSE?
MOVED TO ADJOURN? >> SPEAKER: WE HAVE A STAFF
PERSON. >> SPEAKER: OKAY, WE HAVE A SCOUT WITH US. YOU ARE IN THE BACK, I DIDN'T RECOGNIZE YOU. WOULD YOU LIKE TO STAND UP AND INTRODUCE YOURSELF AND TELL US WHAT YOU ARE WORKING ON?
>> SPEAKER: [INAUDIBLE] >> SPEAKER: THANK YOU FOR COMING TONIGHT. IF THERE IS ANYTHING WE CAN DO TO ANSWER ANY QUESTIONS FOR YOU OR CLARIFY ANYTHING WE HAVE GONE OVER TONIGHT, I THINK WE WILL BE AVAILABLE TO YOU.
GOOD LUCK. THANK YOU, MS. WITTEN.
MOVED TO ADJOURN?
