KAY. AUBURN UNIVERSITY COMMUNICATIONS. >> SORRY, HE'S GETTING OVER

THAT LAST ANNOUNCEMENT. HOW YOU DOING, OLIVIA? >> GOOD, HOW ARE YOU?

>> DOING FINE. >> SHORT REPORT FROM YOU THIS WEEK'S INTO SUNDAY LAST WEEK.

FIRST THINGS FIRST, BIG EVENT IS SATURDAY, THE BIG EVENT IS A ONE DAY SERVICE EVENT WHERE HUNDREDS OF STUDENTS WILL GO OUT AND SPEND THE DAY GIVING BACK TO THE COMMUNITY AS A THANK YOU FOR LETTING US TAKE OVER YOUR CITY 10 MONTHS OUT OF THE YEAR. SO WE ARE REALLY LOOKING FORWARD TO THAT AND EXCITED TO SEE WHAT ALL GETS ACCOMPLISHED THIS WEEKEND, AND ANOTHER THING, WE HAD TWO AEROSPACE ENGINEERING STUDENTS, CODY SHELTON AND MEGHAN HAYES, SELECTED FOR THE 2023 SUMMER DEPARTMENT OF DEFENSE SCIENCE MATHEMATICS AND RESEARCH FOR TRANSFORMATION INTERNATIONAL INTERNSHIP COHORT. THEY WERE TWO OF ONLY 10 SELECTED NATIONWIDE AND WILL SPEND THE SUMMER DOING RESEARCH IN BELGIUM. THAT'S OBVIOUSLY A HUGE DEAL AND VERY PRESTIGIOUS AND PROUD THAT THEY ARE PUTTING OPERANT ON THE MAP

[00:05:05]

INTERNATIONALLY. I THINK THAT IS ALL FOR ME THIS WEEK. AS PER USUAL, LET ME KNOW IF YOU NEED ANYTHING AND CONTINUE SUPPORTING AUBURN ATHLETICS! WAR EAGLES!

>> SEE YOU NEXT WEEK AT BREAKFAST. FIFTH DIMENSION THE BIG EVENT. THEY INVITE ME TO COME AND SPEAK TO THE STUDENTS BEFORE THEY START ON SATURDAY MORNING AND THANKFUL FOR STUDENTS AND THEIR ENTHUSIASM. THEY WILL LITERALLY BE HUNDREDS OF DIFFERENT PROJECTS THAT WILL BE ATTACKING AROUND OUR COMMUNITY FOR INDIVIDUALS, FOR ORGANIZATIONS, AND WE ARE JUST VERY THANKFUL FOR THEIR ENTHUSIASM AND WILLINGNESS TO GIVE UP SATURDAY MORNING AND GO AND DO THAT FOR ALL OF OUR BENEFITS. AT THIS TIME, CITIZENS COMMUNICATION TO ON TONIGHT'S AGENDA, WE WILL POINT YOU TO THERE ARE PUBLIC HEARINGS FOR A COUPLE OF ITEMS UNDER RESOLUTIONS REGARDING A COUPLE OF PLANNING RELATED ITEMS. IF YOU WOULD LIKE TO SPEAK WITH US ABOUT THE OTHER FOUR OR FIVE THINGS ON THE AGENDA TONIGHT,

[8.c.2. National Fish and Wildlife Foundation. Authorize grant agreement. $45,154.86.]

NOW IS THE TIME TO COME FORWARD AND ADDRESS THE CITY COUNCIL WENT OKAY. SAYING NONE, MOVE

OUT OF THE CITY MANAGER, NEGATIONS. >> NOTHING UNDER CITY MANAGERS COMMUNICATIONS, SO WE WILL MOVE ON TO THE CONSENT AGENDA. ANYONE WISH TO REMOVE AN ITEM

FROM THE CONSENT AGENDA AND IT WITH THE ITEM INDIVIDUALLY? >> I WOULD LIKE TO REMOVE 8D AS

IN DAVID. >> D, DELTA, RIGHT? >> OR DAVID.

>> ANYONE ELSE? >> CANNOT REMOVE EIGHT CHARLIE TWO.

>> CHARLIE AND DAVID GET ALONG BETTER THAN DELTA AND CHARLIE. >> ALL RIGHT. ANYONE ELSE?

OKAY. WE WILL GO FIRST TO WE WILL GO FIRST TO 8C2. >> ITEM 8C2 AUTHORIZES EXECUTION OF A GRANT AGREEMENT WITH THE NATIONAL VISION WHILE I FOUNDATION THROUGH THE FIVE-STAR AND URBAN WATERS RESTORATION GRANT. THE GRANT AMOUNT IS 45,000, 154 86.

>> MOVE FOR APPROVAL. >> SECOND. >> MOTION AND A SECOND. MR.

MORMON? >> I THINK THIS IS A LAUDABLE OPPORTUNITY. IT NEEDS JUST A FEW WORDS A FEW MORE WORDS OF PRAISE! FIRST 2050 TREES GOING TO BE PLANTED AND A LOT OF OPPORTUNITY FOR PROFESSIONAL DEVELOPMENT TOURS OF THE PROJECT, INVOLVEMENT BY THIS GIRL SCOUTS AND THE ARDEN UNIVERSITY B LAB, A LOT OF PEOPLE WILL BENEFIT FROM THIS AND I JUST WANTED TO RECOGNIZE THIS AS SOMETHING KIND OF SPECIAL.

>> TOTALLY AGREE. ANY OTHER COMMENTS OR THOUGHTS? ALL RIGHT. ALL IN FAVOR POLICE SAY

[8.d. Board appointments. East Alabama Mental Health Board. Two (2) positions. Terms begin April 1, 2023, and end March 31, 2029.]

AYE. ANY OPPOSED? MOTION CARRIES. WE WILL GO TO 8D.

>> ITEM 8D APPOINTS TWO POSITIONS TO THE EAST ALABAMA MENTAL HEALTH BOARD FOR TERMS

APRIL 1, 2023 AND ENDS MARCH 31, 2029. >> I WOULD LIKE TO MOVE TO POSTPONE THE APPOINTMENT OF THOSE POSITIONS TO THE APRIL 18 MEETING AS WELL AS REOPENING

THE ADVERTISEMENT FOR THE POSITIONS. >> SECOND.

>> WE HAVE A MOTION IN THE SECOND POSTPONED THESE APPOINTMENTS UNTIL APRIL 18 AS WELL WITH TWO REOPENING APPLICATIONS. HAVE A MOTION IN THE SECOND. ANY OTHER FURTHER

[8. CONSIDERATION OF CONSENT AGENDA.]

COMMENTS OR QUESTIONS? ALL IN FAVOR POLICE SAY AYE. ANY OPPOSED? MOTION CARRIES. TO

HAVE A MOTION TO APPROVE THE BALANCE OF THE CONSENT AGENDA? >> SO MOVED.

[10.a. Authorize traffic calming devices. Fairway Drive. Postponed from March 14, 2023, City Council meeting.]

>> MOTION AND SECOND. ANY OTHER QUESTIONS OR COMMENTS CHEMICAL IN FAVOR POLICE SAY

AYE. ANY OPPOSED? THE CONSENT AGENDA IS APPROVED. >> WE HAVE NO ORDINANCES THIS EVENING UNDER RESOLUTIONS, ITEM 10 A IS A TRAFFIC CALMING DEVICE REQUEST FOR FAIRWAY DRIVE. THIS ITEM WAS POSTPONE FROM THE MARCH 14, 2023 CITY COUNCIL MEETING.

AS A REMINDER, THIS ITEM ALREADY HAS A MOTION IN SECONDS, SO THE ITEMS ON THE

TABLE. >> THIS ITEM IS ON THE TABLE, SO NEXT STEP WOULD BE TO BEGIN DISCUSSION? OKAY. ANY OTHER COMMENTS OR QUESTIONS? MR. COPELAND, AND HE REQUESTED THAT THIS WERE TO BE POSTPONED DUE TO YOUR ABSENCE LAST WEEK. ANYTHING YOU WOULD LIKE TO ADD?

>> YES, MR. MAYOR. THANK YOU TO MY FELLOW COUNCILMEMBERS FOR POSTPONING THIS. I'VE BEEN WORKING WITH THE APPLICANT ON THIS FOR A FEW MONTHS. SO WE JUST WANTED TO CLARIFY A FEW THINGS REGARDING THE TRAFFIC CALMING DEVICES THAT WILL BE GOING ON FAIRWAY. MS. EDGE, I WILL ASK THE QUESTIONS AND YOU CAN DIRECTIVES NEEDED. BUT AS FAR AS THE DESIGN OF THE SPEED BUMPS OR TRAFFIC CALMING DEVICES, AS IS THE PROPER TERM FOR THEM, WHAT THE DESIGN AND INTENSITY I GUESS THAT YOU WOULD CALL HAVE THESE SPEED BUMPS THAT ARE GOING ON

THAT STREET? >> AND I WILL ASK ALISON FRAZIER TO ANSWER THAT.

>> DOES THE QUESTION MAKE SENSE? AS FAR AS THE -- HOW BIG THEY WILL BE OR HOW, YOU

KNOW, THE GRADUAL NOTICE OF THEM, THAT TYPE OF THING? >> SO WE USE A STANDARD SPEED HUMP DESIGN. IF I REMEMBER THE DESIGN SPEED, WHEN HE STATES IN THE 15 MILES PER HOUR RANGE, BUT THAT IS SOMETHING THAT THE PUBLIC WORKS DEPARTMENT HAS A STANDARD FOR. IT WILL MIMIC

[00:10:05]

ONCE WE HAVE DONE RECENTLY LIKE ASHTON PARK OR WHEN WAY. WE HAVE REPLACED SOME OF THE OLD

RUBBERIZED ONES WITH CONCRETE, SO WOULD BE JUST LIKE THAT. >> I JUST HAD SEVERAL CONCERNS ABOUT WHAT I GUESS THEY CALL THE BOLD TONES, THE ONES THAT RATTLE YOUR WHOLE VEHICLE WHEN YOU ARE OUT OVER THEM. I KNOW WE DID A TRAFFIC STUDY THEY ARE TOO ON THE FAIRWAY AND THE STREET THAT'S COMING IN THERE, THAT'S LEAVING ME RIGHT NOW. BUT RAYMER PLACE. AND I'M ASSUMING THAT DID NOT WARRANT A TRAFFIC SIGN THERE. > CORRECT. WE DO STOP WARRANT ANALYSIS FOR THE RAYMER PLACE IN FAIRWAY DRIVE INTERSECTION AND DID NOT MEET

THE FEDERAL WARRANTING CRITERIA. >> SO WE WILL -- AS FAR AS THE NUMBER OF SPEED BUMPS COMING IN THERE, IT'S A TOTAL OF FOUR OF RELIEF COMING THROUGH THEIR.

>> CORRECT.> THAT'S WARRANTED BY -- THIS IS PROBABLY FOR ME OWN KNOWLEDGE, BUT IS THAT A NUMBER OF VEHICLES TRAVELING THROUGH THEIR, CERTAIN SPEEDS THAT YOU

ARE TRYING TO ACHIEVE? >> WE MERELY LOOK AT SPEEDS. THE TRAFFIC CALMING POLICY IN THE DESIGN MANUAL OUTLINES CRITERIA THAT WILL EVALUATE THE SPEEDS IS ONE OF THE LARGER ONES AS WELL AS VOLUME AND REALLY CLASSIFICATION. FROM THERE, WE DETERMINE IF MEASURES

ARE WARRANTED AND WHAT THE MEASURES ARE. >> OKAY. LAST QUESTION AS FAR AS SIGNAGE IS CONCERNED, THERE ARE QUESTIONS AROUND -- AND THE NEIGHBORHOOD HAS A NICER SIGN IN THE STANDARD SIGNS THE CITY PUTS UP. THEY UNDERSTAND THE SIGNS THAT WE WOULD INSTALL WOULD BE THE GREEN POST AND SIGNAGE AS FAR AS ANY UPDATES TO THAT. THEY WOULD BE RESPONSIBLE FOR HOA WOULD BE RESPONSIBLE FOR ANY NICER POSTS OR WHATEVER WOULD COME OF

SIGNS. IS THAT CORRECT? >> WE HAVE A POSITION IN OUR GUIDELINES FOR HOA TO INSTALL THEIR OWN SIGNS, EXECUTED HOLD HARMLESS AGREEMENT WHICH BASICALLY SAYS THEY WOULD MAINTAIN THE SIGNS AND IN THE EVENT THOSE SIGNS OF DAMAGE AND THE HOA CANNOT REPLACE THEM, WE

REPLACE THEM IN THEIR STEAD UNTIL NEW SIGNS ARE INSTALLED. >> OKAY. DO WE SUPPLY ANY PART OF THAT SIGN, LIKE THE SIGN ITSELF, OR IS IT THE WHOLE SIGN RESPONSIBLE FOR --

RESPONSIBILITY OF THE HOA? >> THE WHOLE SIGN IS RESPONSIBILITY OF THE HOA.

TYPICALLY THEY WANT TO DO MORE DECORATIVE POSTS AND SYMPTOMS BUT THE DECORATIVE BORDERS

AROUND THE SIGNS. THOSE ARE THINGS WE DON'T PROVIDE. >> ALL RIGHT. I BELIEVE THAT'S ALL MY QUESTIONS. I HAVE BEEN WORKING WITH THE APPLICANT ON THIS FOR A FEW MONTHS, AND WE DID A FEW THINGS. SO I WILL NOT CALL HER OUT BECAUSE I DON'T WANT TO EMBARRASS HER.

BUT SHE DID A LOT OF WORK AS FAR AS WALKING THE NEIGHBORHOOD AND WAS CONCERNED ABOUT SAFETY OF OUR CITIZENS IN THE NEIGHBORHOOD AND I APPRECIATE ALL THE WORK THAT SHE PUT INTO THE. SO JUST WANTED TO THANK HER FOR THAT AND THAT'S ALL I HAVE, MRMAYOR.

>> OKAY. ANY OTHER QUESTIONS OR COMMENTS FROM COUNSEL? ? THESE ARE A LOT OF HOUSES SHE

TOUCHED. >> SHE DID. OKAY. ANY OTHER CONSEQUENCES? ALL RIGHT. THIS

[10.b.1. 152 Bragg Avenue. Performance residential development (multiple‐unit development). Property located at 152 Bragg Avenue. Applicant: Brett Basquin.]

IS A RESOLUTION AND DO A VOICE VOTE. ALL IN FAVOR POLICE SAY AYE. ANY OPPOSED? MOTION

CARRIES. >> ITEM 10 B1 IS A REQUEST FROM RICK BASS GOING FOR CONDITIONAL USE APPROVAL FOR PERFORMANCE RESIDENTIAL USE, MULTIUNIT DEVELOPMENT, LOCATED AT 152 BRAGG AVENUE IN THE CORRIDOR REDEVELOPMENT DISTRICT WEST A ZONING DISTRICT, THE PLANNING COMMISSION UNANIMOUSLY RECOMMENDED APPROVAL IN ITS MARCH 16, 2023 MEETING IN A

PUBLIC HEARING IS REQUIRED. >> MOVE FOR APPROVAL. >> SECOND.

>> MOTION IN THE SECOND, THE STILL OPEN TO PUBLIC HEARING IF YOU WOULD LIKE TO ADDRESS THE COUNCIL, PLEASE COME FORWARD TO GIVE YOUR NAME AND ADDRESS FOR THE RECORD AND YOU HAVE FIVE MINUTES TO SPEAK TO THE COUNCIL. SEEING NO ONE, WE WILL CLOSE THE PUBLIC HEARING.

ANY COMMENTS OR QUESTIONS FROM THE COUNCIL? >> I HAVE A QUESTION ON THIS ONE, BECAUSE SEVERAL PEOPLE HAS CALLED ME ABOUT I GUESS IT'S A NEW DEVELOPMENT THAT THEY ARE GETTING READY TO BUT THERE. ARE THEY GOING TO TEAR DOWN THE HOUSE THAT'S ALREADY THERE, RIGHT? OKAY. I THINK MOST PEOPLE WANT TO KNOW THE TYPE OF HOUSING THAT'S COMING UP IN THE

AREA. TRYING TO GET MY BOOT HERE. BUT IS THERE -- >> MS. EDGE, WE DO HAVE A DIAGRAM HERE OF WHAT IT WILL BE BUT THERE'S NO ELEVATIONS AS TO WHAT THE HOUSE WILL LOOK LIKE AT THIS POINT IN TIME AND ANOTHER SECURITY APPROVALS TO GO TO. I BELIEVE THE APPLICANT IS HERE WITH US TONIGHT. DID I THINK I SAW HIM? HE IS HERE. WOULD BE APPROPRIATE FOR HIM TO

COME FORWARD AND ANSWER THE QUESTION? >> AS MR. BACCHUS CAN COME UP?

>> MR. BASS GOING? >> BEFORE HE ANSWERS THE QUESTION, WHEN ASKED ANOTHER

[00:15:02]

QUESTION. I ALSO WANT TO KNOW THAT THE PLANNING MEETING, WERE THERE ANY COMMENTS OR ANYBODY DISAPPROVED IT OR WAS NOT SATISFIED WITH THE DEVELOPMENT OR ANYTHING?

>> IS APPROVED UNANIMOUSLY AND THERE WERE NO PUBLIC COMMENTS. >> NO PUBLIC COMMENT. OKAY.

>> THE ONLY PUBLIC COMMENT WAS THE ADJACENT NEIGHBOR WHO SUPPORTED IT, ADJACENT PROPERTY

OWNER SUPPORTED IT.> ALL RIGHT. >> MR. BASS?

>>.> THE DEVELOPMENT IS A MIXED-USE DEVELOPMENT, SO THERE WILL BE FIRST FLOOR COMMERCIAL, THEN RESIDENTIAL ABOVE. WITH BEFORE YOU TONIGHT IS THE CONDITIONAL USE FOR THE RESIDENTIAL COMPONENT. YOU CAN REBUILD AND JUST TO COMMERCIAL THERE BY RIGHT, BUT THE RESIDENTIAL COMPONENT IS WHAT REQUIRES THAT. SO IT WILL BE A FIRST FLOOR COMMERCIAL WITH 2 TO 3 STORIES OF RESIDENTIAL UNITS ABOVE IT. THOSE RESIDENTIAL UNITS WILL HAVE TO MEET THE CITY'S DESIGNATION OF MARKET RATE, MARKET RATE, HOUSING? COULD NOT BE A STUDENT PRODUCT OR STUDENT ORIENTED DESIGN. THE CITY HAS GUIDELINES THAT PROHIBIT THAT IN THAT PARTICULAR ZONING ORDINANCE. SO THAT IS WHAT IT IS SET UP FOR. THE CURRENT INTENT IS THE FIRST FLOOR COMMERCIAL, SECOND-STORY WOULD BE TWO UNITS, THEN THE 3RD AND 4TH STORY WOULD BE TWO UNITS, JUST A TWO STORY UNIT INTERIOR. SO THE 3RD AND 4TH, YOU WOULD HAVE A UNIT ON THE THIRD AND YOU'D BE ABLE TO GO THROUGH YOUR INTERNAL STAIRCASE TO THE FOURTH LEVEL, WHICH WOULD BE THE SECOND-STORY OF THAT UNIT.

SO THAT'S WHAT THEY ARE PLAYING FOR RIGHT NOW. >> THAT'S GOOD. PEOPLE WERE ASKING ME, SO I WANTED TO ASK THE BOARD. IS THAT CLOSER -- THE DEVELOPMENT, IS IT CLOSER

TO THE COLLEGE STREET? >> YES. SO IT'S EAST OF SANDERS. SO THERE WAS A VACANT LOT AT THE CORNER OF SANDERS, THE NEXT ONE OVER. IT'S TWO UNITS WEST OF AUBURN ELECTRIC.

YOU KNOW WHERE AUBURN ELECTRIC IS? >> I LIVE RIGHT IN THAT AREA.

>> HUMAN STAYING THERE FOR A SECOND? ALL RIGHT, MR. GRISWOLD.

>> SAID COMMERCIAL ON THE FIRST FLOOR AND THEN HOW MANY ADDITIONAL STORIES ABOUT IT?

>> THREE. >> SO TOTAL OF FOUR STORIES. AND I GUESS THE CEILING HEIGHT ON A COMMERCIAL PROPERTY IS HIGHER THAN OF RESIDENTIAL. SO YOU ARE GOOD GETTING ALL THAT

IN 45 FEET? >> YEAH. >> OKAY. AND IT'S NOT GOING TO

BE RUNNING BY THE BEDROOM ADD TYPE OF THING? >> CAN'T BE.

>> GOOD. THANK YOU. >> SO YOU WILL HAVE 12, YOU THINK, BIDS AGAINST -- IT RUNS

AND DETERMINES THE NUMBER OF PARKING PLACES? >> CORRECT.

>> I THINK THERE WILL BE 22, 23 PARKING PLACES. PLENTY OF ROOM TO PARK THERE. JUST WONDERING -- I GUESS THOSE THINGS DON'T HAVE TO BE IRONED OUT TONIGHT. ALL WE ARE IRONING OUT IS THAT IT WILL BE RESIDENTIAL AND COMMERCIAL. BUT IS THIS GOING TO BE IN ADD YOU?

>> NO, BY DEFINITION, AND ADD U IS AN ECONOMIC DETACHED DWELLING UNIT. SO AND ADDU IS ESSENTIALLY A SINGLE-FAMILY HOUSE BEING USED FOR -- THE PROPER TERM WOULD BE MORE PRIVATE DORMITORY, BECAUSE IF WE HAVE MORE THAN TWO UNITS THAT'S BEING PURPOSEFUL A STUDENT HOUSING, PRIVATE DORMITORY, THAT'S PROHIBITED IN THE ZONING AND THAT WOULD BE WORKED OUT WHEN PLANS ARE SUBMITTED ON THE ALLOWABLE FLOOR PLANS THAT WOULD BE ALLOWED. BUT WHEN YOU DO THAT, THE COMMERCIAL COMPONENTS ARE TOTALLY SEPARATE OUT OF THAT.

IT'S NOT FACTORED INTO THE RESIDENTIAL, YOU KNOW WHAT I MEAN? NO OVERLAPPING REGARDING BEING ABLE TO USE COMMERCIAL FOR PURPOSES OF CALCULATING RESIDENTIAL REQUIREMENTS OR ANYTHING LIKE THAT. THE ONLY THING WE ARE TALKING ABOUT HERE IS ENOUGH PARKING TO SUPPORT EITHER THE NUMBER OF BEDS IN THE SQUARE FOOTAGE OF THE COMMERCIAL THAT'S BEING

PROPOSED. >> WHAT IS YOUR TARGET AUDIENCE ON THIS? BUYERS OR RENTERS OR

FAMILIES OR PROFESSIONALS? >> YEAH, I THINK THE ULTIMATE GOAL WILL BE THE FIRST FLOOR, ONE OF THE OWNERS HAS AN ACTUAL BUSINESS HE'S TRYING TO MOVE INTO THAT. FOR ONE OF THE

[00:20:03]

COMMERCIAL PODS. ON THE OTHER ONE, YOU KNOW, IT'S PROBABLY CONDO OUT IS PROBABLY WHAT THEY ARE LOOKING TO DO. THERE IS A DEMAND FOR HOUSING THAT CLOSE. YOU NO, ESPECIALLY WITHIN A CORPORATE THERE, THE CLOSABLE WALK. SO I THINK THAT THE INTENT WOULD BE

TO CONDO IT OUT AND SELL THE UNITS. >> THANK YOU.

>> OTHER QUESTIONS FOR MS. BASSETT? THANK YOU.ANY QUESTIONS FOR YOUR COMMENTS,

QUESTIONS FOR OTHER STAFF? >> I HAVE ONE MORE. OUR ZONING IS COMPLEX. SOME TRYING TO GET MY HAND -- HAD AROUND IT. YOU DON'T HAVE ANY CONCERNS ABOUT WHETHER OR NOT THIS CAN BE

BUILT ON THAT PARTICULAR PIECE OF PROPERTY? DO YOU? >> NO, NO. THEY WILL HAVE TO SUBMIT PLANS AND THINGS AND THAT'S PART OF THE CONDITIONS THAT THE PLANNING STAFF PLACED ON THE APPROVAL AND RECOMMENDATION FROM PLANNING COMMISSION. SO PART OF THAT IS FOR SMITH IN ARCHITECTURAL PLANS, THE FLOOR PLANS AND SO FORTH. BUT AS FAR AS THE HOUSING REQUIREMENTS GO, THEY WILL HAVE TO MEET THAT. YOU MENTIONED PARKING. THEY WILL HAVE TO MEET THOSE CRITERIA FOR WHEN WE APPROVE THE PLANS TO MOVE FORWARD FROM DOT TO

CONSTRUCTION. >> BECAUSE TONIGHT WE DON'T KNOW IF IT IS TWO FLOORS OF RESIDENTIAL OR THREE FLOORS OF RESIDENTIAL, IF IT'S TWO FLOORS, I THINK MR. BASKETTE MENTIONED THERE WOULD BE A STAIRCASE FROM ONE FOOT TO THE NEXT. ON THE THIRD FLOOR WILL LOOK DIFFERENT, I GUESS, THE THIRD RESIDENTIAL FLOOR. SO THAT IS SOMETHING THAT IS

DECIDED ON LATER BY -- BY REVIEW PLAN. >> CORRECT.

>> ANY OTHER QUESTIONS? >> ONE QUESTION. THEY ARE GOING TO HAVE TO BE SOME ZONING VARIANCES AWARDED OR RENTED IN ORDER TO ACCOMPLISH ALL THIS? NO? OKAY.

>> PLANNING COMMISSION DID APPROVE THE WAIVER FOR THE SIDE YARD, SIDE BUFFER YARD THAT WAS

APPROVED. >> BUT DOES NOT HAVE TO GO TO THE BOARD OF ZONING ADJUSTMENT

ALSO? >> NO, SIR, THAT'S WITHIN THE PLANNING COMMISSION POLLS RIGHT

TO WAIVE. >> OKAY. ALL RIGHT. THINK YOU.

>> ALL RIGHT. GOT A MOTION IN THE SECOND. ALL IN FAVOR POLICE SAY AYE.

[10.b.2. Ridgecrest Bedell. Institutional (community housing services and daycare) and office uses. Property located at 945 North Donahue Drive. Applicant: Sharon Tolbert.]

>> ANY POST? MOTION CARRIES. >> ITEM 10 B2 IS A REQUEST FROM SHARON TOLBERT ON BEHALF OF THE HOUSING AUTHORITY ON THE CITY OF AUBURN FOR CONDITIONAL USE APPROVAL FOR INSTITUTIONAL COMMUNITY HOUSING SERVICES AND DAYCARE AND OFFICE USES AT 945 NORTH DONAHUE DRIVE IN THE REDEVELOPMENT DISTRICT ZONING DISTRICT. A PREVIOUS REQUEST WAS APPROVED BY THE CITY COUNCIL ON MARCH 16IN THE REDEVELOPMENT DISTRICT ZONING DISTRICT. A PREVIOUS REQUEST WAS APPROVED BY THE CITY COUNCIL ON MARCH 16, 2021 AND HAS EXPIRED. THE PUBLIC

HEARING IS REQUIRED. >> MOVE FOR APPROVAL. >> MOTION IN THE SECOND, THIS TIME I WILL OPEN THE PUBLIC HEARING AND WOULD LIKE TO ADDRESS THE COUNCIL, PLEASE COME FORWARD AND GIVE US YOUR NAME AND ADDRESS FOR THE RECORD. YOU HAVE FIVE MINUTES; SEEING NO ONE, CLOSING PUBLIC HEARING. ANY COMMENTS OR QUESTIONS FROM THE COUNCIL?

>> I GOT A COUPLE COMMENTS. >> YES, MA'AM. >> I'M GLAD TO SEE THIS ON THE AGENDA TONIGHT. I THINK MR. WEBER HAS WORKED REALLY HARD TO GET THIS DEVELOPMENT DONE. I THINK I WAS HOPING SHE WOULD BE HERE TONIGHT SO THAT I CAN THANK HER FOR JUST ALL THE HARD WORK THAT SHE HAS PUT INTO THIS DEVELOPMENT. I KNOW THAT THE COMMUNITY WILL BE HAPPY TO SEE IT HAPPEN. WHEN A LOOK AT SOME OF THE PICTURES IN THE DRAWINGS AND STUFF, IT ALMOST MAKES ME

FEEL AS GOOD AS BUCKETS. [LAUGHTER] >> SO THIS IS JUST AWESOME. I WILL THANK SHARON FOR WORKING SO HARD. THIS ALL HAPPENS WHEN IT COMES ON TO DONAHUE, IT WILL MAKE IT -- JUST GOING TO MAKE IT LOOK JUST BEAUTIFUL. SO IF ANYBODY SEES HER, CONGRATULATE HER AND TELL HER THAT WE JUST HAPPY TO HAVE THAT ON THE NORTHWEST SIDE OF AUBURN AT THIS NEW DEVELOPMENT. I DON'T KNOW WHICH ONE OF THESE HOUSING SHE'S GOING TO CHOOSE, BUT

EITHER ONE OF THEM, DO GOOD. THEY ALL LOOK GOOD. >> CONNIE, COULD NOT AGREE

[00:25:03]

MORE. THIS HAS BEEN PART OF OUR COMMUNITY SINCE 1971 AND HAS BASICALLY LOOKED THE SAME SINCE 1971. TO HAVE THIS FRESH, MODERN LOOK, I AM REALLY EXCITED FOR THE RESIDENTS AND JUST HAPPY IT'S GOING TO BE, WHAT A GREAT MOMENT FOR THEM TO MOVE INTO THESE HOMES. NOT ONLY IS 106 UNITS GOING TO BE REPLACED, BUT THEY WILL ADD 70 UNITS FOR SENIOR CITIZENS AS WELL. ALISON, I WAS GOING TO GET SOME OTHER STAFF TO SPEAK TO THE FACT THAT THERE WILL BE -- WE WILL PRIVATIZE SOME OF THE STREETS INTERNALLY WITHIN THE DEVELOPMENT AND WILL ALLOW THE SETBACKS TO BE DIFFERENT THAN WE WOULD NORMALLY ALLOW. CAN SOMEONE JUST MENTIONED THAT REAL QUICK? THEY HAVE OUR NOTES HERE.

>> ALISON? >> ONE OF THE THINGS WE WORK WITH SHARING ON IS THE VACATION OF BOOKER PRIDE AND JULIE. IF YOU REMEMBER THE COUNCIL VACATED CROSBY SOME TIME AGO, AND SO THIS WOULD VACATE THE REMAINDER OF THE STREETS TO ALLOW THE SETBACKS AND DEVELOPMENT TO BE MORE IN LINE WITH WHAT THE HOUSING AUTHORITY WOULD LIKE. YOU WILL SEE THE

VACATIONS MAYBE ANOTHER COUPLE MONTHS. >> OKAY. GOOD. VERY EXCITED.

TOTALLY AGREE. IT WILL BE GRATEFUL FOR OUR COMMUNITY. >> THEY HAVE A DATE AS TO WHEN THIS PROPERTY WILL START? AM I JUMPING TOO FAST? I DON'T WANT TO DIE NOT SEEING IT.[LAUGHTER]

>> WELL, SHARON WAS NOT ABLE TO BE HERE TONIGHT, BUT THEIR REPRESENTATIVES AND ALSO FROM

MIKE'S ORGANIZATION. >> SO RIGHT NOW -- > THE PROJECT IS TO GO THROUGH AND GET FUNDING THROUGH THE TAX CREDIT PROCESS. THE FUNDING CYCLE IS USUALLY ONCE A YEAR THROUGH THE STATE. AND SO, WE ARE IN THAT CYCLE AND HAD TO GET EVERYTHING PREPARED FOR THAT. TRACY IS ONE OF THE ARCHITECTS ON THE TEAM AND I WILL ADDRESS HER REMOVAL.

>> AT AFFORDABLE HOUSING, WE HAVE TO SUBMIT TAX CREDIT APPLICATIONS FOR EACH PHASE.

THERE'S THREE PHASES. YOU CAN ONLY DO ONE TAX CREDIT APPLICATION A YEAR. WE WILL DO WITH THE FIRST OF THIS YEAR. WE HOPE THAT THAT WILL BE FULLY OCCUPIED IN 2025. SO IF WE, YOU KNOW, GET TO SUBMIT ANOTHER TAX CREDIT APPLICATION EACH ADDITIONAL YEAR, YOU CAN SEE IT COMPLETELY COMPLETE IN 2027. BUT WE HAVE TO MAKE SURE WE GET THE TAX CREDIT APPLICATION AWARDED AND THAT'S WHY WE ARE HERE BEFORE AND ARE HERE NOW BECAUSE WE NEED TO GET THAT

AWARD. >> OKAY. >> YOU GET EXTRA POINTS IF YOU COMMUNICATE THAT YOU HAVE A CITY COUNCIL REPRESENTATIVE WANTS THEM TO HURRY UP?

[LAUGHTER] >> THANK YOU FOR YOUR WORK. >> AS FAR AS FUNDING IS CONCERNED, IS IT A HUD TYPE FUNDING PROJECT OR HOW IS IT FUNDED?

>> GOOD EVENING. AND THE DEVELOPER FOR THE PROBLEM OBJECT WITH THE MICHAEL'S ORGANIZATION. YES, WE WILL BE USING LOW INCOME HOUSING TAX CREDITS.

>> OKAY. >> AS FAR AS WHEN THE CONSTRUCTION IS GOING IN PLACE, PLAN FOR THE RESIDENTS, I GUESS THERE'S A PLAN IN PLACE FOR DISPLACING THEM DURING THAT

TIME I GUESS. >> CORRECT. WE HAVE ENGAGED A RELOCATION CONSULTANT. SO SHE WILL WORK WITH THE RESIDENCE FOR SEVERAL MONTHS IN ADVANCE OF GREAT BREAKING GROUND TO

ENSURE WE FIND ADEQUATE HOUSING FOR THEM. >> SO THIS IS A THREE-YEAR PROJECT OVERALL PROBABLY? > FOR THE FIRST PHASE, WE INTEND TO START IMMEDIATELY AFTER GETTING FINANCING FOR THAT,, BUT THE CONSTRUCTION PROCESS WILL PROBABLY TAKE 12 TO 15

MONTHS. >> THANK YOU. >> THANK YOU FOR ANSWERING

THOSE QUESTIONS. >> ANY OTHER COMMENTS OR QUESTIONS?

>> I HAVE A QUESTION. HE SAID WE WOULD VACATE PRIDE AVENUE? THAT'S ONLY THE PART WITHIN THE

RIDGECREST? NOT ON THE SIDE OF DONAHUE. >> WESTSIDE.

>> THE REMAINING PORTION OF PRIDE REMAINS UNDER CITY CONTROL.

>> YES. >> THANK YOU. >> I DO HAVE ONE QUESTION. I DON'T KNOW WHO TO DIRECT MY QUESTION TWO, BUT THERE ARE TWO OR THREE CAMPUSES I THINK TOTAL. THERE'S RIDGECREST AND THEN THERE IS MOVING APARTMENTS. THEN ON DEAN ROAD.

PARDON? >> AND DRAKE APARTMENTS. >> OKAY. THANK YOU. I WAS JUST HOPING ON HOPE THAT THERE WAS SOME SPILLOVER FROM THIS PROJECT TO EVENTUALLY GET TO

THE DEAN ROAD HOUSING. >> HOLDING OUT FOR THAT, WE HAVE A BURNED-OUT FACILITY THERE AND I'M HOPING THERE'S A GOOD REASON THAT THERE HASN'T BEEN REPAIRED OR REPLACED OR SOMETHING. I'M HOPING THAT ONE DAY DOWN THE STREAM HERE THAT THESE DRAWINGS ARE AMAZING. WE HAVE ANYONE HERE WHO CAN SPEAK TO THE FUTURE PLANS OF THE HOUSING AUTHORITY? OKAY, TRY TO ASK FOR THAT INFORMATION AS TO WHAT THE FUTURE PLANS WOULD BE WITH THE OTHER FACILITIES AS

[00:30:08]

WELL. >> I CAN ADD TO THAT, BECAUSE ACTUALLY, SHARON, SHE SPOKE AT A COMMUNITY MEETING THAT I HAD AND SHE TALKED A LITTLE BIT ABOUT THIS. RIDGECREST IS -- WAS THE FIRST APARTMENT COMPLEX THAT SHE WAS STARTING WITH. NOW, I THINK FROM RIDGECREST, IF I'M NOT MISTAKEN, I THINK SHE WAS GOING TO DRAKE AND THEN EAST PARK. BUT THEN IT'S IN HER -- IT'S ON HER AGENDA TO RECONSTRUCT ALL THE HOUSING AUTHORITY APARTMENTS. SO EVERYTHING TAKES TIME AND I JUST THINK THAT SHE JUST -- I AM SO BLESSED RIGHT NOW, JUST FOR HER TO TAKE THE TIME OUT FROM THE PROJECT THE RIDGECREST. SO JUST KNOWING THAT IT'S GOING TO HAPPEN, RIDGECREST IS NOT THE OLDEST APARTMENT. I THINK EAST PARK IS. MAYBE MOUTON, ONE OF THOSE IS OLDER THAN RIDGECREST. BECAUSE I MOVED IN RIDGECREST WHEN WE.[INDISCERNIBLE] BUT -- AND I'M THINKING, I GUESS SHE PROBABLY WOULD BE THE WANT TO ANSWER THE QUESTION FOR RIDGECREST, THEN WHAT'S THE NEXT DEVELOPMENT? MAYBE WE CAN TALK TO HER IF YOU FEEL THE NEED THAT IT HAS TO GO TO EAST PARK INSTEAD OF ONE OF THE

OTHERS FIRST. >> WE WILL REACH OUT THIS YEAR AND SEE WHAT HAPPENS. OKAY? ANYTHING ELSE FROM THE COUNCIL IN A COMMOTION IN THE SECOND. ALL IN FAVOR PLEASE A AYE. ANY

[12. CITIZENS’ OPEN FORUM.]

OPPOSED? THE MOTION CARRIES. >> THOSE ARE ALL OF THE ITEMS WE HAVE ON THE AGENDA.

>> OKAY. THIS TIME WE WILL OPEN IT UP FOR CITIZENS OPEN FORUM, YOUR OPPORTUNITY TO ADDRESS CITY COUNCIL ABOUT ANYTHING THAT WOULD BE ON YOUR MIND. YOU HAVE THREE MINUTES AND ASKED TO ADDRESS YOUR COMMENTS STRAIGHT TO THE CITY COUNCIL. PLEASE GIVE US YOUR

NAME AND ADDRESS FOR THE RECORD. YES? >> COUNCILMAN TAYLOR, I DON'T

THINK YOU WILL BE DYING ANYTIME SOON. >> I HOPE NOT.

>> YOU LOOK TOO GOOD IN YOUR OUTFIT. >> THANK YOU. MINIMUS BOBBY WILKINS, 261 DENSON DRIVE, AUBURN. IS OPEN CITY COUNCIL SEEMS TO BE WAKENING UP. YOU ARE BEGINNING TO UNDERSTAND THAT ONE-VOTE HAS TREMENDOUS RESPONSIBILITY GIVEN TO YOU BY YOUR CONSTITUENTS TO MAKE INFORMED DECISIONS. MOST STUDENTS ARE NOT PAYING -- ARE NOT PARTYING. THEY ARE STUDYING AND DOING PART-TIME WORK AND CONCENTRATING ON THEIR GRADES AND GETTING A DEGREE FROM AUBURN UNIVERSITY. I DID THE SAME WHEN I WAS AT AUBURN. IN 1999 AUBURN CITY COUNCIL HAS DECIDED IT WAS FINE TO DISCRIMINATE AGAINST FORMER AUBURN ALUMNUS AND OTHERS TO STOP THEM FROM PURCHASING A HOUSE TO HAVE THEIR KIDS AND FRIENDS IN A SAFE AND QUIET ENVIRONMENT. WHY WAS THIS DONE? LIKELY TO SUPPORT THE REAL ESTATE DEVELOPER. GET RICHER AND PROVIDING HOUSING TO THE AUBURN STUDENTS. BUT I WAS TOLD BY COUNCILMAN PERSONS IN BY COUNCILMAN GRISWOLD, TWO STRONG SUPPORTERS OF ORDINANCE 3288, I COULD SELL MY HOME OR BUY A HOME IN THE FOLLOWING DISTRICTS WHERE THERE IS NO DISCRIMINATORY PRACTICES. LAST YEAR WE GOT 816 SIGNATURES IN EIGHT DAYS OR AGAINST THE ORDINANCE 3288.6 WERE FOR THE ORDINANCE. 7/100 OF A PERCENT.

>> WHO WILL BE NEXT? >> GOOD EVENING. MY NAME IS WAYNE FELLOW, LIVE AT 1425 CLOVER PARK IN AUBURN. THIS IS ABOUT THE BOOKIES AND THAT BIG OLD -- I KNOW THEY ARE ABOUT TO BE DONE AND WE ARE SO HAPPY. IT'S ACTUALLY THAT ROAD BETWEEN WARDS 6 AND 8, THE VETERAN BOULEVARD. ARE THEY GOING TO PUT LIKE LITTLE TINY CONNECTING ROAD, LIKE I KNOW THEY TRIED TO HAVE THE TRAFFIC LIGHT, BUT ARE THEY GOING TO BUILD A LITTLE SIDE ROAD? LIKE, FROM VETERANS TO LIKE LITTLE STRIP ONTO HIS PROPERTY? BECAUSE IF THAT IS, I'M WONDERING, LIKE, WHY WE PUT IN A TRAFFIC LIGHT RIGHT THERE IF YOU HAVE PEOPLE WHO TURN RIGHT AND TAKE LITERALLY HUNDRED EUROS AND TURN RIGHT BACK INTO VETERAN AND BACK INTO OUR BUSINESS. [INDISCERNIBLE]

I DRIVE THROUGH THERE. I JUST WANT TO TAKE ON BOTH SIDES. >> WE CAN GET THAT ANSWER BEFORE THE END OF THE MEETING. I WILL TELL YOU I HAVE A LOT OF CONFIDENCE THAT A LOT OF SMART TRAFFIC ENGINEERS HAVE BEEN EVALUATING THE INTERSECTION AND I TRUST THAT THE KIND OF DECISIONS THEY MAKE WILL GET YOU AN ANSWER IN A MINUTE. OKAY? THANK YOU. WHO'S NEXT?

>> MAYOR ANDERS, LADIES AND GENTLEMEN OF THE COUNCIL, FOR 12 OPA-LOCKA ROOM -- AND IS THERE FIRST, I WOULD LIKE TO THANK MR. GRISWOLD FOR BRINGING UP THE SCOOTER SITUATION, BEING PART OF THE TUMOR SITTING GROUP. WE NOTICE A LOT SCOOTERS DOING SCOOTING ALONG DOWNTOWN. SO WE THANK YOU FOR THAT. I UNDERSTAND THAT YOU ARE LOBBYING THE ALABAMA LEGISLATURE THIS SESSION. I WAS WONDERING IF THAT LOBBYING INCLUDES ANYTHING, LOBBYING FOR FUNDING FOR HOSPITAL BASE TO VIOLENCE INTERVENTION, PRIMARILY HELPING EAST ALABAMA HEALTH AND ANY INVOLVEMENT AUBURN UNIVERSITY WOULD HAVE IN THE PUBLIC HEALTH BASED ON ITS CURRICULUM AND PRACTICE ACADEMICS, SO ON AND SO FORTH, AN ORGANIZATION INVOLVED IN THE MOMS DEMAND ACTION, BOTH THE LOCAL ROOT AND ALABAMA CHAPTER, IS WORKING WITH FATE AND ACTION ALABAMA FOR SUCH FUNDING FOR CERTAIN CENTERS THEY CALL LEVEL I TRAUMA CENTERS BASED ON WHAT IS DEFINED BY THE AMERICAN COLLEGE OF SURGEONS FOR ALABAMA PUBLIC HEALTH DEPARTMENT OR WHOMEVER. AND THEY ARE FOCUSING ON BIRMINGHAM MOBILE AND HUNTSVILLE. BASED ON MY UNDERSTANDING, HOW KNOW IF THERE'S ANY DISCUSSION ABOUT INCLUDING EAST ALABAMA HEALTH AND IT. SO I'M JUST WONDERING, AS FAR AS THE CITY LOBBYING IS CONCERNED, HAS THIS ISSUE BEEN RAISED, EVEN BEEN RAISED? AND IF HE COULD EVEN MENTION IT PUBLICLY WITHOUT GIVING AWAY ANY CONFIDENCE? BY THE WAY, GIVE MRS. TOVAR AT MY CONGRATULATIONS TOO. ALSO, IF YOU CAN CONGRATULATE MS. BLANKENSHIP FOR THE WORK SHE'S DOING WITH THE CITIZENS ACADEMY OF STARTING OVER AGAIN. HAD A CHANCE TO BE ONE OF THE RECEPTIONISTS, IF YOU WILL, FOR

THEIR OPENING JUST RECENTLY. >> YOU ARE AN ALUM. >> I AM IN A LONG, ALUM OF THE

FIRST GRADUATING CLASS. THANK YOU ALL VERY MUCH. >> I IN FACT WAS IN MONTGOMERY TODAY, BUT, MS. EDGE, IF WE CAN HAVE SOMEONE FROM THE STAFF MAY BE PROVIDE HIM WITH A SUMMARY OF THE THINGS THAT WE ARE LOOKING AT IN EVALUATING RIGHT NOW THAT ARE POTENTIALLY BEING

TALKED ABOUT IN MONTGOMERY. ALL RIGHT? >> KAREN HERRING, 311, BUTTERNUT DRIVE. FOUR YEARS AGO, I SUBMITTED IS THE OBJECTIVE IN MY LIBRARY BOARD MEMBER APPLICATION TO BE A PART OF HELPING THE LIBRARY PROVIDE EXCEPTIONAL SERVICES FOR OUR COMMUNITY, AS IT CONTINUES TO MEET THE DEMANDS OF OUR GROWING CITY. THANK YOU FOR APPOINTING ME TO SERVE. IT HAS TRULY BEEN AN HONOR. AS I SUBMITTED MY APPLICATION TO SERVE ANOTHER TERM, I THOUGHT ABOUT HOW TO REVISE THAT RESPONSE FOR MY OBJECTIVE. I FOUND IT ONLY NEEDED TO ADD THE WORD, CONTINUE. TO BEGIN SERVING ON THE BOARD IN 2019 PP, YOU KNOW,

[00:40:01]

THE PRE-PANDEMIC ERA THAT WE ALL ONCE LOVED. THE BOARD'S FIRST MAJOR TASK WAS CREATING THE FISCAL YEAR 2124 STRATEGIC PLAN, A SIX-MONTH STRATEGIC PLANNING INITIATIVE THAT INCLUDED EXTENSIVE COMMUNITY ENGAGEMENTS AND RESEARCH. THROUGH THIS PROCESS WE HAVE LEARNED THAT RESIDENTS WANTED ADDITIONAL BRANCH LOCATIONS, MEETING AND STUDY SPACES, EXPANDED COLLECTIONS, AND INCREASED PROGRAM OFFERINGS, RELEVANT AND APPEALING TO A DIVERSE POPULATION TO QUOTE. SURVEY RESPONDENTS MOST FREQUENTLY CALLED FOR ADDITIONS TO THE COLLECTION, MORE MATERIALS, VARIED FORMATS, AND GREATER DIVERSITY IN BOTH CONTENT AND AUDIENCE APPEAL. THE BOARD HAS ADVISED, ENCOURAGED, AND CELEBRATED THE LIBRARY STAFF'S ACTIONS AND INITIATIVES TO ADDRESS THE CHALLENGES AND GAPS REVEALED IN THE STRATEGIC PLAN. NOT ONLY HAS THERE BEEN ASTOUNDING GROWTH IN ALL AREAS OF THE LIBRARY, INCLUDING THE NEW WE CAN SATELLITE SPACE, BUT THERE'VE ALSO BEEN METRICS CREATED TO MONITOR AND UPDATE PROGRESS ON THESE LIBRARY INITIATIVES THAT'S EASILY ACCESSIBLE TO THE COMMUNITY. DURING MY TENURE, THE LIBRARY HAS ADOPTED A SYSTEMATIC PROCESS OF CONSISTENT REVIEW OF BOARD BYLAWS AND POLICIES, LEADING TO A MORE INCLUSIVE LANGUAGE IN OUR BORROWER PRIVILEGES AND RESPONSIBILITIES POLICIES, A MORE COMPREHENSIVE COLLECTION MANAGEMENT PLAN, AND MORE PATRON FROM THE WORDING IN THE UNATTENDED CHILDREN POLICY.

AS A BOARD WE HAVE ALSO WORKED TO INCREASE PUBLIC AWARENESS OF APL'S ENDORSEMENT OF THE AMERICAN LIBRARY ASSOCIATION'S LIBRARY BILL OF RIGHTS AND THE FREEDOM TO READ ACT -- STATEMENT, SORRY. SO WHILE WE HAVE SEEN SO MUCH PROGRESS OVER THE PAST FOUR YEARS, I WANT TO MAKE CLEAR THAT THE LIBRARY STAFF DESERVES ALL OF THE CREDIT. NEVER EVER WORKED WITH SUCH A DEDICATED AND TALENTED STAFF WHO CARES SO MUCH FOR THE SERVICE THAT THEY PROVIDE AND THE COMMUNITY MEMBERS THAT THEY SERVE. MY SINCERE HOPE IS TO HAVE THE OPPORTUNITY TO CONTINUE TO SERVE ON THE LIBRARY BOARD. I TRUST THAT THIS BODY WILL ALSO GIVE THOUGHTFUL CONSIDERATION TO APPOINTING OTHER BOARD MEMBERS THAT REFLECT AUBURN'S DIVERSE COMMUNITY. WE WOULD BE ESPECIALLY GRATEFUL TO SERVE WITH A MEMBER FROM THE NORTHWEST AUBURN COMMUNITY WHERE THE FIRST LIBRARY BRANCHES PLANNED. MAYBE ALL WORK TOGETHER TO IMPROVE AND INCREASE SERVICES FOR EVER-GROWING DIVERSE COMMUNITY.

>> THANK YOU FOR YOUR SERVICE. WHO'S NEXT? >> HELLO. MARTHA SHALL, 307, YOU DRIVE. THE LIBRARY IS NO LONGER A SAFE PLACE FOR CHILDREN. THE BOOKS HAVE FLOODED THE SHELVES OF THE CHILDREN'S WING, IT'S ALL ABOUT SEX, SEX, AND MORE SEX FOR --

>> POINT OF ORDER, MR. MAYOR. THE PERSON BEFORE US HERE IS DESCRIBING THE LIBRARY IN AN INAPPROPRIATE WAY. IT'S NOT A FACTUAL WAY THAT YOU ARE DESCRIBING THE CONTENT OF THIS

LIBRARY AT ALL. >> I REVIEWED ALL OF THESE BOOKS.

>> ALL THE BOOKS? THEY ARE ALL, AS YOU SAY? YOU ARE PLAYING THAT THEY ARE ALL AS

SEX, SEX, SEX. >> I HAVE CHECKED OUT MORE THAN 100 BUCKS IN THE LAST TWO MONTHS, AND THEY ARE ABOUT GENDER, SEXUALITY, BISEXUALITY, TRENDS TAX, THIS, THAT AND THE

OTHER. NO, NOT EVERY BOOK IN THE CHILDREN'S WING. >> THANK YOU.

>> PLEASE CONTINUE. >> YES, SEX FOR CHILDREN. HOW INAPPROPRIATE. IT IS A FORM OF CHILD ABUSE. THE LIBRARIANS SEEM TO NORMALIZE SEXUAL ACTIVITY TO CHILDREN, GROOMING

THEM, GROOMING THEM. >> POINT OF ORDER, MR. MAYOR. >> PLEASE.

>> THAT'S AN INFLAMMATORY STATEMENT. >> I THINK IT'S THE TRUTH.

>> GROOMING IS BEYOND ACCEPTABLE. >> THEY ARE GROOMING THE CHILDREN FOR PROMISCUITY AND PERVERSION. THERE IS A 5, 6-YEAR-OLD, SEVEN-YEAR-OLD NEED TO KNOW ABOUT TRANSGENDER, BISEXUALITY, 5, 6, 7-YEAR-OLDS? LESBIAN, QUEER, INTERSEX? NO CHILD NEEDS THIS. THE LIBRARY HAS BECOME A DANGER ZONE FOR AMERICANS WHO STILL CHERISH --

>> POINT OF ORDER, MR. MAYOR. OUR LIBRARY IS NOT DANGEROUS AT ALL.

>> IT IS MORALLY DANGEROUS, ESPECIALLY TO CHILDREN, WHO -- AND AMERICANS WHO STILL CHERISH PURITY, CHASTITY, AND THE HONORABLE THE STATE OF MARRIAGE WHICH OUR LORD SAYS IS ONE MAN,

[00:45:03]

ONE WOMAN, AND OFFSPRING, AND THEY ARE THE MAJORITY, CERTAINLY IN THIS CITY. BUT THE LIBRARY IS SEXUALIZING CHILDREN, TRYING TO CORRUPT THE MORALS OF MINORS AND RECEIVE A

PAYCHECK FROM US. >> POINT OF ORDER, MR. MAYOR. THE STATEMENTS THAT THIS PERSON

BEFORE US IS CLAIMING IS JUST FALSE. >> EVERYWHERE IT IS TRUE. THE LORD CHOOSES CHRIST, ALTERABLE MERCY, AND TRUTH, SAID THIS: ANYONE WHO CAUSES ONE OF THESE LITTLE ONES WHO BELIEVE IN ME TO FALL INTO SIN, IT WOULD BE BETTER FOR HIM TO HAVE A LARGE MILLSTONE TIED AROUND HIS NECK AND BE DROWNED IN THE DEPTHS OF THE SEA. MATTHEW 18:6. JESUS

CHRIST DOES NOT LIE. THANK YOU . >> IT WILL BE NEXT? PLEASE.

>> I AM SUE AND BOLTON, LIVED IN AUBURN SINCE I WAS IN THE THIRD GRADE, WHICH TELLS YOU HOW OLD I AM. IT WAS 1965 WHEN I MOVED HERE, RAISE MY DAUGHTER IN AUBURN CITY SCHOOLS, I'VE EXPERIENCED BEING A SINGLE PARENT, HAVE ALWAYS LOVED THE LIBRARY. IT WAS -- MEANT SO MUCH TO ME GROWING UP. I WOULD WALK TO THE OLD DOWNTOWN LIBRARY FROM WHERE I LIVE NEAR THE CURRENT LIBRARY, AND IT WOULD BE MY GOAL. I HAD A FRIEND THAT I WOULD RACE TO SEE HOW MANY BOOKS COULD WE READ. THE LIBRARY PLAYED A SIGNIFICANT ROLE IN MY LEARNING, DEFINITELY. WHEN I GOT OLDER I MOVED ON TO THE UNIVERSITY LIBRARY AND I HAVE FACULTY AND THE HISTORY DEPARTMENT THAT WOULD GET MAD AT ME BECAUSE I'D HAVE A WHOLE BUNCH OF BOOKS CHECKED OUT THAT THEY NEEDED FOR THEIR GRADUATE STUDENTS. OKAY? I WAS A STUDENT AT THE LIBRARY BOARD THE OTHER DAY, ABOUT A MONTH AGO, I WAS A KID THAT WHEN I GREW UP, I WAS WHAT WE WOULD CALL A TOMBOY IN THOSE DAYS. ELECT TO THROW PINE CORN WAR WARS WITH THE KIDS IN MY NEIGHBORHOOD, MY BROTHER, I LIKE SHOOTING BB GUNS AND HUNTING FOR CHIPMUNKS OR SQUIRRELS OR WHATEVER LITTLE KIDS COULD SHOOT AT BACK IN THOSE DAYS. IN TODAY'S WORLD, SOMEONE WOULD HAVE TRIED TO TRANSITION ME. BY THE TIME I GOT TO BE IN PUBERTY, I REALIZED IT WAS NOT FOOTBALL ELECT SO MUCH, BUT IT WAS FOOTBALL PLAYERS. SO I HAVE A PERSONAL INVESTMENT IN NOT WANTING TO SEE LITTLE CHILDREN BE SUBJECTED TO THIS KIND OF INFLUENCE AT AN INNOCENT AGE. LET CHILDREN BE CHILDREN. I'VE ALSO WORKED AS A GUARDIAN AD LITEM. I AM AN ATTORNEY. IT USED TO BE JUDGE LANG'S LAW CLERK FOR THREE YEARS. I WAS THEN DIRECTOR OF INTERNATIONAL PROGRAMS IN AUBURN AND BROUGHT IN PEOPLE FROM 97 COUNTRIES, EVERY RELIGION IN THE WORLD, OR NO RELIGION AT ALL. SO I HAVE A VERY DIVERSE BACKGROUND. I HAVE FRIENDS FROM ALL OVER THE WORLD. WE HAVE A BIG MUSLIM COMMUNITY IN THIS TOWN. IT'S NOT JUST CHRISTIANS WERE JEWISH PEOPLE THAT ARE ORTHODOX, THAT WOULD BE OPPOSED TO SOME OF THE THINGS I HAVE SEEN IN THIS LIBRARY AND I'M NOT TALKING ABOUT ADULTS. I'M NOT FOR BOOK BURNING, AND DEFINITELY A FIRST AMENDMENT PROPONENT. I AM NOT FOR CENSORSHIP. BUT I AM FOR THE PRODUCTION OF LITTLE KIDS. I WORKED AS A GUARDIAN AD LITEM. SOME OF THE STUFF I SEE WOULD HAVE BEEN CONSIDERED PORNOGRAPHY WITH CHILDREN BEING EXPOSED TO PORNOGRAPHY. AND I HAVE FILED A COMPLAINT WITH THE AUBURN POLICE DEPARTMENT TO HAVE THIS INVESTIGATED, BECAUSE I'M NOT A JUDGE AND I'M NOT A PORNOGRAPHY SPECIALIST, BUT I THINK WE HAVE HIT THE POINT WITH THE BOOKS IN THIS LIBRARY THAT WE NEED A JUDGE TO DECIDE

IF THIS IS PORNOGRAPHY OR NOT. THANK YOU. >> MS. BULGE, COULD WE HAVE

YOUR ADDRESS FOR THE RECORD? >> 2231 SPRING HILL DRIVE. >> THANK YOU.

>> AUBURN. >> ANYONE ELSE? PLEASE. >> GOOD EVENING AGAIN. MY NAME IS MARCIA BUSEY AND I RESIDE AT 254 HEAD RIDGE CIRCLE IN AUBURN AND AM CURRENTLY THE CHAIR OF THE AUBURN PUBLIC LIBRARY ADVISORY BOARD. I'M GLAD TO SEE YOU ALL AGAIN AND I WOULD LIKE TO THANK COUNCILOR MOORMAN FOR COMING TO OUR OWN BOARD MEETING TODAY AND I WAS ALSO

[00:50:01]

WITH YOU AT THE IRISH DANCE FOR QUITE A GREAT EVENT. HAD A WONDERFUL TIME WATCHING CHILDREN DANCE. SINCE I SPOKE TO THE COUNCIL LAST MONTH, I KNOW YOU'VE BEEN MADE AWARE THAT IN THE LAST SIX MONTHS -- SORRY, SIX WEEKS TO TWO MONTHS, THE LIBRARY HAS RECEIVED OVER 70 LETTERS OF SUPPORT FROM MEMBERS OF YOUR COMMUNITY, YOUR CONSTITUENTS, IN SUPPORT OF THE LIBRARY AND ITS COLLECTIONS. AND BECAUSE THEY ARE VOICING THEIR VERY DEEP CONCERNS ABOUT THE EFFORTS BY INDIVIDUAL OR A SMALL GROUP OF VIGILS TO REMOVE LIBRARY MATERIALS OF ANY KIND, BUT PARTICULARLY LGBTQ+ MATERIALS OF THE COLLECTIONS, THEREBY RESTRICTING THE READING CHOICES OF EVERYONE ELSE IN THE AUBURN COMMUNITY, I WOULD LIKE TO ONCE AGAIN REVIEW SEVERAL EXCERPTS AS I HAVE TIME FROM SOME OF YOUR CONSTITUENTS. THE FIRST ONE SAID I WAS DISTRESSED TO LEARN THAT SOMEONE IS TRYING TO GET LGBTQIA MATERIALS FROM REMOVED FROM THE PUBLIC LIBRARY. I'D BE DISTRESSED TO LEARN THAT SOMEONE WANTED ANY MATERIAL REMOVED FROM THE LOOK LIBRARY. I WOULD DEPEND ON MY PUBLIC LIBRARY TO PURCHASE MATERIALS WITH AN UNPREJUDICED EYE AND MAKE THEM AVAILABLE TO ME SO I CAN MAKE MY OWN DECISIONS ABOUT TOPICS THAT CONCERN ME. THE LIBRARY AND SET UP IN PUBLIC LIBRARY HAVE NOT BEEN HIRED TO BE MY MORAL CONSCIENCE KEEPERS OR MY HEALTH OVERSEERS OR MY INTELLECTUAL DEVELOPERS. THEY HAVE BEEN TRAINED TO SELECT, ORGANIZE, AND PRESENT RELIABLE INFORMATION SOURCES. THE SECOND ONE SAID, THE IDEA OF ANYONE, INDIVIDUAL, ASSUMING THE RIGHT TO BAN READING CHOICES FOR ALL OTHERS IS ABHORRENT. EVERY PARENT HAS THE RIGHT AND RESPONSIBILITY TO MONITOR THEIR OWN CHILDREN'S READINGS, BUT ONLY THEIR OWN. SMALL MINDED PEOPLE ARE FREE TO AVOID BUYING AND READING ANY BOOKS THEY DISAGREE WITH, BUT THEY VIOLATE THE RIGHTS OF ALL OTHERS BY ATTEMPTING TO BLOCK FREEDOM OF READING CHOICES, WHICH IS ESSENTIALLY DENYING FREEDOM OF SPEECH. I HAVE SEVERAL OTHERS, BUT I WILL RUN OUT OF TIME. I WOULD JUST LIKE TO SAY AND REMIND THE COUNCIL THAT ANY PERSON WHO WISHES TO REMOVE A BOOK FROM THE COLLECTION IS INDEED ENGAGING IN CENSORSHIP. IN THE LIBRARY HAS PLEDGED TO NOT CENSOR, TO SUPPORT THE AILA FREEDOM TO READ ACT AND THE LIBRARY BILL OF RIGHTS! THANK YOU VERY

MUCH. >> WHO'S NEXT? PLEASE. >> HELLO. THANK YOU FOR YOUR TIME. MY NAME IS PATRICE DANIEL, 532 GREAT OAK CIRCLE, 36830. I WAS NOT EXPECTING TO COME HERE AS A CITIZEN, BUT I WOULD LIKE TO REQUEST TO COUNCIL TO GRANT SOME TIME FOR PEOPLE WHO DO OBJECT TO SOME OF THE SEXUALLY EXPLICIT MATERIAL AVAILABLE TO CHILDREN. I ASKED THIS FOR THE REASON BECAUSE SEXUAL DEVELOPMENT IS A LONG AND COMPLICATED AND SENSITIVE SUBJECT. IT TAKES TIME. PARENTS HAVE THE RIGHT TO FORM THEIR CHILDREN MORALLY. I HAVE CAREFULLY GONE THROUGH AND I DON'T HAVE TIME TO ADDRESS IN THREE MINUTES. I WOULD LIKE TO TAKE THE TIME AND ASK IF WE CAN ADDRESS THIS FURTHER AND GATHER MORE MATERIAL. I WOULD LOVE TO HAVE SOMEONE ON HUMAN TRAFFICKING TELL YOU THE HARM, THE PORNOGRAPHY DOES TO CHILDREN. I WOULD LIKE YOU TO NOW FROM QUALIFIED EXPERT HOW THIS PERFORMS THEIR SAFETY. IS NOT AN ATTACK ON LGBTQ. I AM TALKING ABOUT CHILDREN. LETTING THEM BE CHILDREN, LETTING THEIR PARENTS HELP THEM ADJUST IN THIS WORLD, AS IS THEIR RIGHT AND THEIR LOVE AND THEIR CONCERN. IF CHILDREN ARE AT RISK OF BEING HARMED, I KNOW IT WOULD ADVOCATE FOR QUALIFIED MEDICAL PROFESSIONALS TO ASSIST OR PROVIDE A SAFE ENVIRONMENT AND WE CERTAINLY HAVE FLAT WITH CASWELL WHO SEXUALLY ABUSED CHILDREN. AND I CAN'T THINK OF A BETTER OPPORTUNITY FOR PREDATOR. AND IF YOU THINK THIS IS ALL SUNSHINE AND MILK AND OATMEAL COOKIES, I THINK THERE IS SOMETHING WRONG. AND IF YOU THINK THAT THIS IS APPROPRIATE, AND I'D BE HAPPY TO SUBMIT IT TO YOU, BECAUSE I WAS GIVEN THIS AND I CAN'T BELIEVE THIS IS JUST RIGHT ON

[00:55:03]

OUR SHELVES. I HAVE GONE THROUGH ALL OF YOUR BYLAWS. AND THEY EXEMPT THEMSELVES FROM ANY KIND OF RESPONSIBILITY AND PUT IT ON THE PARENT. AND THEY SAY THAT I AM WRONG BECAUSE I REALLY DON'T WANT THIS WITHOUT PROPER SUPERVISION FROM THE CARING ADULT FOR A CHILD. I WOULD NOT WANT MY GRANDCHILDREN NEAR THIS, AND MY NEIGHBOR WHO IS A PSYCHIATRIST WHO I THINK IF I ASKED, SHE WILL TALK TO YOU BY THE CONSTANT SEXUAL ABUSE. AND IT COMES FROM POLITICIANS, IT COMES FROM NEIGHBORHOODS, IT COMES FROM POSSIBLY PEOPLE ON THE SCHOOL BOARD. AND I GUESS WITH LGBTQ, I THINK THE PROPER TERM IS A MINOR ATTRACTIVE PERSON.

>> PLEASE WRAP IT UP. >> SO I ASK YOU TO PLEASE PROVIDE AMPLE OPPORTUNITY AS

THIS IS A GENUINE AREA OF CONCERN. >> THANK YOU.

>> WHO'S NEXT? WE WILL CLOSE THIS TIME. MS. EDGE, CAN WE GO BACK TO THE QUESTION REGARDING THE ROADS OUT OF BUGGIES AND IF THERE IS ANY UPDATE? CAN MS. FRASER KIND OF TALK TO US ABOUT

WHAT THE GENTLEMAN'S QUESTION WAS? >> YES, OTHER ALISON CAN DO

THAT. NOT THIS ONE. >> HE WAS ASKING IF -- I THINK BUGGIES BOULEVARD AND CORPORATE PARKWAY ARE GOING TO CONNECT. THEY ARE DIRECTLY ALIGNED. VETERANS BOULEVARD WHICH IS A WORD THAT GOES THROUGH NORTH AND EXTENDS FROM COX TO COLLEGE STREET, BUT THERE'S NO OTHER

INTERVENING STREETS THAT ARE PROPOSED. >> I'M NOT SURE IF THAT ANSWERS ALL YOUR QUESTIONS. IF NOT, CERTAINLY LET US KNOW SO WE CAN GET YOU SOME FURTHER ANSWERS.

OKAY? ALISON, OBVIOUSLY YOU HAVE A LOT OF PRETTY HEAVY COMMENTS TONIGHT, ALLEGATIONS. I WOULD, IF THE CITY ATTORNEYS AVAILABLE RIGHT NOW, IF HE COULD SPEAK TO SOME OF THESE STATEMENTS THAT HAVE BEEN MADE THIS EVENING RELATED TO OUR LIBRARY?

>> THANK YOU, MAYOR. AS THIS COUNCIL IS AWARE, WHEN THE CITY COUNCIL CREATED THE AUBURN PUBLIC LIBRARY, INVESTED THE LIBRARY BOARD WITH THE AUTHORITY TO MANAGE THE COLLECTION OF THE LIBRARY. THAT'S BEEN ACCOMPLISHED THROUGH NOT ONLY THE LIBRARY BOARD THEMSELVES, BUT THE EMPLOYEES OF THE CITY, INCLUDING LIBRARY DIRECTOR, TYLER WINTON IS WITH US TONIGHT. IF ANY CITIZEN OF THE CITY OF AUBURN WHO HAS A LIBRARY CARD BELIEVES THAT THERE IS ANY INAPPROPRIATE MATERIAL WITHIN A LIBRARY, THERE'S AN ESTABLISHED POLICY AND PROCEDURE BY WHICH THAT PERSON CAN REQUEST REVIEW OF THE MATERIAL WITHIN THE COLLECTION, THAT'S A PROCESS THAT'S BEEN IN PLACE FOR MANY, MANY YEARS, THAT'S A POLICY AND PROCEDURE THAT'S FOLLOWED TO THIS DAY. SOME OF THE SPEAKERS HERE TONIGHT HAVE UTILIZED THAT POLICY, HAVE REQUESTED REVIEW OF MATERIALS WITHIN THE LIBRARY, THE LIBRARY MANAGEMENT TEAM HAS WORKED TO REVIEW THOSE MATERIALS PER THEIR POLICY, WHICH IS AVAILABLE ONLINE. AND FREQUENTLY REVIEWS THOSE REQUESTS WITH A VERY KEEN EYE TOWARD WHAT'S APPROPRIATE NOT ONLY FOR THE GENERAL PUBLIC, BUT WHAT'S APPROPRIATE FOR THE PARTICULAR AGES WITHIN THEIR VERY COLLECTIONS. THERE IS A LOT OF RESPONSIBILITY PLACED ON OUR COMMUNITY IN UTILIZING THE COMMUNITY RESOURCES MADE AVAILABLE THROUGH THE PUBLIC LIBRARY SERVICE, INCLUDING PARENTAL CONTROLS WHICH ARE AVAILABLE, NOT ONLY OUR PARENTS ENCOURAGED TO BRING THEIR CHILDREN TO THE LIBRARY, TO HELP THEM NAVIGATE THE COLLECTIONS, TO HELP THEM FIND MATERIALS THAT ARE APPROPRIATE TO THEM, BUT THERE ARE ALSO PARENTAL CONTROLS AVAILABLE FOR LIBR LIBRARY, THE PARENTS ARE ABLE TO SET THROUGH LIBRARY POLICY, WHICH IS ESTABLISHED AND AVAILABLE. AND LET ME ASSURE THE COUNCIL THAT THE LIBRARY BOARD IN THE LIBRARY STAFF ARE VERY KEENLY AWARE OF WHAT CONSTITUTES OBSCENE MATERIALS WITHIN THE STATUTES LAID OUT IN THE OUR STATE LEGISLATURE, THEY ARE VERY KEENLY AWARE OF WHAT CONSTITUTES CHILD PORNOGRAPHY AS SET OUT BY OUR STATE LEGISLATURE. THOSE MATERIALS DO NOT EXIST WITHIN OUR LIBRARY. TO THE EXTENT THAT

[01:00:01]

ANY PATRON DISAGREES WITH THE CLASSIFICATION OF MATERIALS WITHIN THOSE CONFINES, WE AT THE CITY ATTORNEY'S OFFICE CERTAINLY WOULD ASK THEM TO AVAIL THEMSELVES OF THE POLICIES THAT HAVE BEEN PUT IN PLACE AND THE PROCEDURES THAT ARE WORKING TO REVIEW THOSE MATERIALS FOR THEIR APPROPRIATENESS. ANY QUESTIONS FROM THE COUNCIL ABOUT THESE

PARTICULAR ISSUES? >> I JUST WANTED TO SAY THAT I DO APPRECIATE THE LAST TWO SPEAKERS WHO CAME AND HAD A MEASURED ARGUMENT WITH REGARD TO LIBRARY CONTENT. I DON'T THINK IT'S -- I HAVE NO INTEREST IN LISTENING TO HYPERBOLE AND EXAGGERATIONS FROM THE FIRST SPEAKERS. TO MY FELLOW COUNCILMEMBERS, I APOLOGIZE IF I STEPPED ON THE COMMENTS, BUT I FOUND THEM TO BE TOTALLY OUTRAGEOUS AND INAPPROPRIATE, UNNECESSARILY DEMONIZING MEMBERS ABOUT COMMUNITY. SO TO MY FELLOW COUNSEL MEMBERS, BUT IF MY REMARKS WERE HASTY, MY APOLOGIES! I'M NOT GOING TO TOLERATE THAT KIND OF DESCRIPTORS AND PERHAPS IN THE FUTURE IF SOMEBODY WISHES TO DO THAT, I SHALL JUST REMOVE

MYSELF. >> ANY QUESTIONS FOR THE CITY ATTORNEY RELATED TO THE

COMMENTS HE JUST MADE? >> JUST A QUESTION, MR. MAYOR. DO YOU THINK WE COULD DEDICATE TIME TO EXAMINE THIS MATERIAL AND THIS ISSUE? WITH THE CITY ATTORNEY AND HOLD COUNSEL?

>> I'M NOT SURE I'M PREPARED TO ANSWER THE QUESTION TONIGHT WITHOUT CITY MANAGER HERE WITHOUT PREVIOUSLY TALKING TO THE CITY ATTORNEY'S OFFICE. WE WILL TAKE THE UNDER

CONSIDERATION. >> I THINK IT IS SOMETHING WE NEED TO DO. I WANT TO GET TO THE BOTTOM OF THIS AND KNOW WHAT'S ACTUALLY GOING ON. SOME PEOPLE SAY IT DOESN'T EXIST IN SOME PEOPLE SAY DOES. OF SEXUALLY EXPLICIT MATERIAL IS OVER THERE WHERE A KID CAN WALK UP TO AND TAKE IT, I DON'T CARE WHETHER IT'S LGBT Q OR WHATEVER, THAT'S NOT RIGHT. SO I THINK WE DEFINITELY NEED TO LOOK INTO THAT. AS FAR AS THE LADY EXAGGERATING, THIS IS AMERICA AND SHE HAS A RIGHT TO SAY WHAT SHE WANTS TO SAY NO MATTER WHAT SIDE YOU ARE FOR, YOU HAVE A RIGHT TO SAY WHAT YOU WANT TO SAY. [INDISCERNIBLE] WHETHER I AGREE WITH IT OR NOT. I CAN GO HOME AND SLEEP TONIGHT IF I CAN MAKE THIS CLEAR. I WANTED TO EXPAND WITH RAY, BUT YOU CAN BE ON SITE BECAUSE YOU DON'T AGREE WITH IT. HAVE TO SIT AND LISTEN TO IT AND TAKE IT AND MOVE ON. BUT I THINK THE CITY ATTORNEY IS HEADED IN THE RIGHT DIRECTION. I PERSONALLY WANT TO KNOW, IF A CHILD CAN WALK UP AND GRAB SOME OF THE STUFF, IT APPEARS TO BE PORNOGRAPHIC, SO I THINK IT'S THE EASIEST FOR THE COUNCIL TO SIT BACK AND SAY IT'S NOT GOING AWAY, I WANT TO MAKE ANYONE MAD. OWNER DO ITS WAY FORWARD CHILDREN THAT'S GOING TO GROW UP IN THIS COMMUNITY. IF THERE IS ENOUGH PARTAKE IN THE FUTURE AS IS, I DON'T WANT TO CONFUSE IT WITH THE CITY OF AUBURN. WHETHER YOU AGREE WITH THAT OR NOT, SHE

IS A REGULAR THREE MINUTES UNINTERRUPTED. >> IF I MAY, TO THE QUESTION OF WHAT'S AVAILABLE IN OUR LIBRARY AND THE ACCESSIBILITY OF IT, IT'S MY UNDERSTANDING THAT THE LIBRARY STAFF AND BOARD HAVE COMPLETED A REVIEW OF MATERIALS RECENTLY, AND IT'S THE RESPONSIBILITY AND PURVIEW OF THE ADVISORY BOARD TO CONDUCT THOSE I GUESS EXERCISES AND X ABILITY IS APPROPRIATE BY AGE. IT'S ABOUT ATTENDING THAT IT'S BEEN DONE RECENTLY.

>> TO ANSWER YOUR QUESTION IN TWO PARTS. STATE LAW IS VERY CLEAR THAT THE AUTHORIZING STATUTE ALLOWS MUNICIPALITIES OF THE STATE OF MINNESOTA TO -- REQUIRES THAT THE COUNCIL CREATES A PUBLIC LIBRARY VEST MANAGE OF COLLECTION TO THE LIBRARY BOARD. WE EXERCISE THAT IN OUR PUBLIC LIBRARY BOTH THROUGH THE LIBRARY ADVISORY BOARD WHICH IS CANCEL POINTS AND THROUGH LIBRARY STAFF WHO ARE STAFF MEMBERS OF THE CITY OF AUBURN. YES, THERE IS A REVIEW OF MATERIALS, SPECIFICALLY I'M AWARE OF MATERIALS THAT HAVE NOT BEEN SPECIFICALLY REQUESTED TO BE REVIEWED THROUGH THE LIBRARY MANAGEMENT POLICY THAT'S AVAILABLE ON THE PUBLIC LIBRARY COSMIC WEBSITE. YES, THOSE MATERIALS, WHEN THEY ARE SUBMITTED, REVIEWED. DECISIONS ARE MADE, AND THOSE DECISIONS ARE REPORTED IN MEMORANDA BY THE BOARD, IN FACT THAT THE LIBRARY BOARD MEETING EARLIER TODAY, IT WAS ONE OF THE

[01:05:02]

MEMORANDA APPROVED BY THE BOARD AFTER REVIEW OF PARTICULAR REST MATERIALS.

>> THANK YOU. >> I WOULD LIKE TO ASK THE QUESTION TOO. I THINK WHEN YOU ARE TALKING, YOU WERE SAYING THAT THESE ARE I GUESS LAWS BY THE STATE LEGISLATORS. SO WITH THAT BEING SAID, I WAS JUST WONDERING, MAYBE INSTEAD OF I GUESS THE LIBRARY, THE AUBURN LIBRARY BOARD AND CITY OF AUBURN, I THINK IT MAY NEED TO GO BACK THERE OUR STATE LEGISLATORS IF LAWS AND STUFF, IF IT INVOLVED LAWS, MAYBE THE STATE LEGISLATOR -- SHOULD HAVE SOME TYPE OF INPUT OR CHANGES TO BE MADE IN THE LAW, IS WHAT I GUESS -- BECAUSE AT THIS POINT I DON'T THINK THE CITY COUNCIL HAS THE AUTHORITY TO MAKE ANY CHANGES. IT WILL HAVE TO GO BACK TO OUT OF STATE LEGISLATURE, I'M ASSUMING, FROM WHAT YOU WERE JUST SAYING.

>> THERE'S ACTUALLY SEVERAL LAYERS OF LAWS THAT APPLY TO MATERIALS WITHIN ANY PUBLIC LIBRARY. THERE IS A FEDERAL LEVEL, PARTICULARLY THE FIRST AMENDMENT, ONCE MATERIALS WITHIN THE COLLECTION THAT'S PROTECTED AS FREE SPEECH. AND THE REMOVAL OF MATERIALS FROM THE LIBRARY IS ADJUDICATED WITHIN SEVERAL REPORTED CASES ON A VERY STRINGENT BASIS, UNDER FIRST AMENDMENT PROTECTION REVIEWS. AND THERE'S LOTS OF DIFFERENT LAYERS TO THAT FIRST AMENDMENT PROTECTION THAT APPLIES TO WHAT IS ESSENTIALLY SPEECH THROUGH THE PUBLIC LIBRARY. SOMETHING THAT'S NOT PROTECTED UNDER THE FIRST AMENDMENT IS ANYTHING CONSIDERED TO BE OBSCENE MATERIAL. AND OBSCENE MATERIAL IS VERY SPECIFICALLY DEFINED WITHIN ALABAMA STATUTE, CHILD PORNOGRAPHY IS A VERY SPECIFICALLY DEFINED WITHIN ALABAMA STATUTE, AND THOSE TWO TYPES OF MATERIAL DO NOT ENJOY THE SAME LEVEL OF FIRST AMENDMENT PROTECTION THAT OTHER MATERIALS HAVE. AND SO, THERE IS A LOT OF LAYER WITHIN THE REVIEW OF ANY PARTICULAR MATERIAL THAT'S AVAILABLE THROUGH A PUBLIC LIBRARY SYSTEM. AGAIN, THIS COUNCIL IN CREATING THE PUBLIC LIBRARY VEST AT THE BOARD WITH THE AUTHORITY. IN FACT, THE COAT SAYS ALL AUTHORITY TO MANAGE THE COLLECTION. AGAIN, THAT HAPPENS IN OUR PARTICULAR PUBLIC LIBRARY THROUGH MIX OF THE LIBRARY ADVISORY BOARD AND CITY OF EMPLOYEE -- CITY EMPLOYEES WHO SERVE IN OUR PUBLIC LIBRARY.

>> OKAY, CONNIE? >> YEAH. >> ALL RIGHT.

>> ANY QUESTIONS FOR MR. CLARK? >> IS THERE ANY REVIEW OF THE ADVISORY BOARD'S DECISIONS? IS THERE ANY REVIEW ABILITY THERE AT ALL HER OUR CITY CODE?

>> NOT FOR OUR CITY CODE OR POLICIES WITHIN THE PUBLIC LIBRARY, NOR WITHIN THE ENABLING STATUTE ANALYZED MUNICIPALITIES TO CREATE A LIBRARY BOARD. THE POWER THAT THIS COUNCIL HAS IS THE POWER OF APPOINTMENT, THE POWER TO APPOINT THE LIBRARY BOARD MEMBERS, AND THERE IS A LIBRARY BOARD APPOINTMENT COMING BEFORE THIS COUNCIL I BELIEVE IN APRIL. IT ALSO HAS THE POWER OF THE PURSE TO APPROPRIATE MONIES TO BE USED WITHIN A LIBRARY BOARD, BUT THEN ONCE THOSE MONIES ARE APPROPRIATED AGAIN BY STATUTE, ALL AUTHORITY

AND CONTROL ARE VESTED WITHIN THE LIBRARY BOARD. >> THANK YOU.

>> MR. CLARK, THAT WAS A GOOD SUMMARY ON WHAT CONSTITUTES OBSCENE MATERIAL. BUT YOU MADE THEM A STATEMENT THAT THESE MATERIALS DO NOT EXIST IN OUR LIBRARY. THAT'S -- BASED ON

WHAT KIND OF A REVIEW DID YOU MAKE THAT STATEMENT? >> BASED ON WHAT I KNOW OF THE LIBRARY BOARD'S POLICY AND THE ABILITY OF INDIVIDUAL MEMBERS TO HAVE THOSE MATERIALS REVIEWED BY OUR STAFF. AGAIN, I'M TELLING YOU AS THE CITY ATTORNEY, MY UNDERSTANDING OF

THE MATERIALS AND COLLECTION WITHIN A REPUBLIC LIBRARY. >> HAS THERE BEEN A SITUATION WHERE BOOK HAS BEEN REVIEWED AND REMOVED OR PLACED IN A DIFFERENT LOCATION?

[01:10:02]

>> MY UNDERSTANDING IS THAT SINCE THIS PROCESS OF REVIEW HAS STARTED ON BOOKS, PARTICULARLY CHALLENGED WITHIN THE LAST 60 DAYS, THAT THERE HAS BEEN SOME RECOLLECTION OF THE MATERIALS, THAT IS, THEY HAVE BEEN MOVED UP INTO HIGHER CLASSIFICATION OF COLLECTION.

>> THANK YOU. >> I AM TO PRESUME THE ACTIONS TAKEN BY THE LIBRARY ALREADY DON'T SATISFY A NUMBER OF PEOPLE IN THE COMMUNITY. A BILL LIBRARY HAS NOT BEEN

RESPONSIVE? >> AM NOT AWARE OF ANY PARTICULAR CITIZEN COMPLAINING THAT THE REVIEW PROCESS HAS NOT BEEN ENACTED PROPERLY AS PER POLICY.

>> MR. CLARK, AS FAR AS THE LIBRARY CARDS, CAN A CHILD TAKE A PARENT'S CARD AND PULL BOOKS OUT FROM THE LIBRARY AND CHECK THOSE OUT? IS THAT AVAILABLE TO A CHILD WITHOUT APPARENT

BEING THERE? >> MY UNDERSTANDING OF THE LIBRARY POLICIES ON THE ISSUANCE OF CARDS IS THAT AN ADULT MEMBER OF THE CITY OF AUBURN, ADULT CITIZEN OF THE CITY OF AUBURN CAN ATTAIN A LIBRARY CARD IN THE REQUEST LIBRARY CARDS BE ISSUED TO MINOR CHILDREN. THAT'S WHERE THE PARENTAL CONTROLS ARE AVAILABLE IN MY UNDERSTANDING ON THOSE CARDS. THERE IS A PROCESS OF SELF CHECKOUT THAT OUR LIBRARY ALLOWS. PARENTS CAN CHOOSE TO HAVE THAT REMOVED FROM THEIR CHILD'S CARD, IS ALSO MY UNDERSTANDING THAT CERTAIN COLLECTIONS CAN BE RESTRICTED FROM CARDS OF MINOR CHILDREN. THOSE POLICIES AND

PROCEDURES HAVE BEEN IN PLACE FOR SOME PERIOD OF TIME. >> ANY OTHER QUESTIONS OR COMMENTS FROM COUNCIL? THANK YOU, MR. CLARK, FOR YOUR TIME. ANYTHING ELSE FROM THE COUNCIL?

>> THERE'S BEEN A REQUEST FROM MR. WARREN AND CHIEF DAWSON FOR AN EVALUATION PROCESS, IS HOW I'M DESCRIBING IT. I BELIEVE I HAVE HEARD WHAT YOU GUYS HAVE SAID. CITY MANAGER RETURNS BACK FRIDAY AND WILL BE BACK AT WORK ON MONDAY IF YOU ALLOW TIME TO GET HER, ALLOW HER TO COME BACK AND WE WILL GET WITH HER AND MR. CLARK AND SEE
