>> PLEASE RISE FOR THE PLEDGE OF ALLEGIANCE AND A MOMENT OF SILENCE.
[4. MAYOR AND COUNCIL COMMUNICATIONS]
PLEASE BE SEATED. >> THE COMMITTEE WHOLE DID NOT HAVE ANY BUSINESS. WE'LL GO INTO ANNOUNCEMENTS AT THIS POINT IN TIME. I WANT TO EXTEND MY THOUGHTS AND PRAYERS TO THE FAMILY OF DEWEY NORTH CUT.
HE WAS A MEMBER OF THE CITY COUNCIL IN THE 70S.
HE BEGAN A LONG FAMILY BUSINESS IN OUR COMMUNITY THAT HAS EXTENDED TO US HERE TODAY. AND IN FACT TYLER PROBABLY WOULDN'T BE WITH US IF DEWEY HAD NOT COME TO AUBURN AND STARTED THE STUDENT HOUSING BUSINESS A LONG TIME AGO.
YESTERDAY AT DUCK SANFORD PARK, I WAS ASKED TO BE PART OF A DEDICATION OF A FIELD 9 OUT THERE FOR -- WHO FOR OVER 20 YEARS COACH CANNED OUR CHILDREN IN BASEBALL WITHOUT HAVING A CHILD INVOLVED IN THE PROGRAM. HE GAVE HIS TIME AND HEART TO THE KIDS AND BUILT HIS OWN BATTING CAGE IN HIS BACKYARD.
IT WAS A SWEET CEREMONY YESTERDAY WITH HIS FAMILY AND MANY PEOPLE WHO BELIEVED IN COACH O AND THANKED HIM FOR EVERYTHING HE'S BEEN PART OF WITH OUR KIDS.
ALSO LAST WEEK I WAS INVITED TO BE PART OR GO AND WATCH NOT BE PART OF THE REDESIGNATION CEREMONY OVER IN COLUMBUS WHERE FORT BENNING IS NOW CALLED FORT MOORE.
I APPRECIATE DAVE MOOR INVITING ME TO BE PART OF THAT AND WHAT AN IMPRESSIVE CEREMONY THAT WAS TO THINK ABOUT EVERYTHING FOR OUR COUNTRY AND COMMUNITY AND JUST A REMINDER OF WHAT OUR MILITARY DOES ON BEHALF OF ALL OF US TO ALLOW US TO SIT HERE TODAY AND DEBATE THE THINGS THAT WE DEBATE AS A COMMUNITY.
THIS ORGANIZATION AND WHAT GOES ON AT THAT FORT THAT INSTALLATION IS JUST SO IMPRESSIVE.
CERTAINLY THANKFUL FOR DAVE INCLUDING ME IN THAT LIST AND IT WAS A VERY IMPRESSIVE MORNING AND PROUD TO HAVE FORT MOORE NAMED FOR A FORMER MEMBER OF OUR COMMUNITY.
I WANT TO REMIND EVERYONE A WEEK FROM MONDAY IS THE MAYOR'S MEMORIAL DAY BREAKFAST SO PLEASE CONTACT THE CITY FOR YOUR TICKETS AND MS. CROUCH I ASSUME WE HAVE SOME SEATS AVAILABLE?
I WANT TO CONGRATULATE AUBURN'S GOLF TEAM AND THE OTHERS.
I HAVE BEEN INVITED TO PARTICIPATE IN THE SENIOR SUNRISE EVENT TOMORROW MORNING AS THEY CELEBRATE THEIR FINAL DAY ON CAMPUS AND ALSO THANKFUL THAT LEE SCOTT ACADEMY HAS INVITED ME TO BE THEIR COMMENCEMENT SPEAKER NEXT WEEK FOR THEIR GRADUATION. TY LOOK FORWARD TO THIS SPECIAL MOMENT. ANYBODY ELSE FROM THE COUNCIL HAVE ANNOUNCEMENT THEY WOULD LIKE TO MAKE TONIGHT?
>> I WOULD LIKE TO THANK YOU FOR YOUR WORDS ABOUT DEWEY.
ON BEHALF OF THE NORTHCUT FAMILY WE'RE SO THANKFUL FOR ALL THE OPPORTUNITIES THAT LIVING IN AUBURN HAS AFFORDED OUR FAMILY.
IT'S A VERY SPECIAL PLACE AND SOMEBODY FROM ROBERTSDALE, ALABAMA OR BEAR CREEK, ALABAMA OR SOMEBODY FROM HOKES BLUFF, ALABAMA CAN COME DOWN HERE AND OPPORTUNITIES AFFORDED TO THEM MAY NOT BE AVAILABLE TO THEM IN LOTS OF OTHER PLACES.
THEY CAN MAKE SOMETHING OF THEMSELVES WITH A LOT OF HARD WORK AND THAT MAKES AUBURN A SPECIAL PLACE.
I HAVE A MEETING NEXT WEEK ABOUT TRAFFIC IMPROVEMENT ISSUES AT 6:00 AT THE LIBRARY ON TUESDAY 223RD OF MAY.
>> WARD FOUR RESIDENTS. >> YES.
>> I HAD THE OPPORTUNITY TO BE PART OF THE GRADUATING CLASS OF FIREFIGHTER RECRUITS THAT PHOENIX CITY HOSTED RECENTLY.
[00:05:02]
THREE OF THOSE RECRUITS ARE AUBURN FIREFIGHTERS.THREE EXCEPTIONAL YOUNG MEN. YOU'VE GOT SOME GOOD EMPLOYEES ADDED TO OUR PUBLIC SAFETY AND IT WAS A TERRIFIC CEREMONY.
[5. AUBURN UNIVERSITY COMMUNICATIONS]
>> OKAY. AUBURN UNIVERSITY COMMUNICATIONS.
>> HOPE YOU'RE HAVING A GOOD AFTERNOON.
TO START MY REPORT THIS WEEK I'M GOING TO REITERATE POINTS MADE IN THE CITY BREAKFAST THIS PAST WEEK WHICH WAS GREAT.
CAMP WAR EAGLE IS MAY 24TH ENDING JULY 13TH.
FALL SEMESTER KICKS OFF AUGUST 16TH.
THE AU CLUB IS HOSTING THE FIRST ROUND OF THE NCAA REGION MEN'S TOURNAMENT. THAT STARTS YESTERDAY AND
CONCLUDES TOMORROW. >> I WILL INFORM YOU THAT A LOT OF ITEMS TONIGHTED HAVE PUBLIC COMMENT ATTACHED SO IF YOU WANT TO TALK ABOUT THAT PLEASE WAIT UNTIL THE PUBLIC HEARING IS CALLED BUT ANYTHING ELSE YOU WOULD LIKE TO SPEAK TO THE COUNCIL ON PLEASE COME FORWARD WITH YOUR NAME AND ADDRESS FOR THE RECORD AND YOU HAVE FIVE MINUTES TO SPEAK TO THE COUNCIL.
[7. CITY MANAGER’S COMMUNICATIONS]
>> SEEING NO ONE WE'LL MOVE AHEAD.
>> I WOULD LIKE TO ANNOUNCE A VACANCY ON THE PLANNING COMMISSION. THE APPOINTMENT WILL BE MADE AT THE JULY 18TH MEETING. ALSO LIKE TO REMIND EVERYBODY JULY IS TWO WEEKS IN A ROW MEETING MONTH.
MEETING ON THE 11TH AND THE 18TH BECAUSE INDEPENDENCE DAY HOLIDAY FALLS AT A TIME THAT WE CANNOT MEET.
>> OTHER THAN THAT RED READY FOR THE CONSENT AGENDA?
>> PLEASE. >> DOES ANYONE WISH TO REMOVE AN ITEM AND DEAL WITH IT INDIVIDUALLY?
[8.b. Indian Pines Recreation Authority. Approve Amended and Restated Articles of Incorporation. ]
OKAY. WE'LL START OFF WITH 8 B.>> MOVE FOR APPROVAL. >> SECOND.
>> THANK YOU. I JUST HAD A QUESTION FER THE FINANCE CITY MANAGER ABOUT FINANCING.
WILL THIS POTENTIAL BORROWING OR SALE OF BONDS GO THROUGH OUR CITY FINANCE DEPARTMENT OR WILL THIS GO THROUGH A SEPARATE
THE RECREATION AUTHORITY WILL BECOME PUBLIC PARK AUTHORITY.
THEY ARE DOING THEIR OWN FINANCING WHICH IS WE HAVE A CONTRIBUTION WE'VE AGREED TO OVER A MULTIYEAR PERIOD AS OPEN LIE I CAN'T AND LEE COUNTY DO. THEY'RE FINANCING TO PAY THE BALANCE OF THE IMPROVEMENTS NOT FUNDED BY PURCHASE OF LAND FROM THE FEDERAL AVIATION ADMINISTRATION.
SO INSTEAD OF GETTING ALL OF OUR MONEY UP FRONT THEY'RE BORROWING MONEY THROUGH A BANK BUT BECAUSE THEY'RE A PUBLIC AUTHORITY EVEN WHEN WE BORROW MONEY FROM A BANK BOND ATTORNEYS CALL IT A BOND BUT WE DON'T BACKSTOP THIS AT ALL.
THEY'RE WHOLLY INDEPENDENT. >> THANK YOU.
AND ANOTHER QUESTION. IS THE -- YOU SAID THEY WERE FINANCING THE DELTA. HOW MUCH IS THE DELTA AFTER BOTH CITIES TOURISM BUREAU, LEE COUNTY, THE UNIVERSITY, EVERYBODY IN THE AIRPORT AUTHORITY OR THE INDIAN PINES AUTHORITY. HOW MUCH REMAINS
>> >> I DO NOT RECALL THAT NUMBER OFF THE TOP OF MY HEAD.
>> MR. KNIGHT >> CLIFF KNIGHT IS THE CHAIR OF
THE INDIAN PINES BOARD. >> HOW ARE YOU?
>> THANK YOU FOR YOUR WORK. >> YES.
>> YOU'RE TESTING MY MEMORY. CLIFF KNIGHT.
1212 FERNDALE DRIVE. AUBURN, ALABAMA.
I'M GOING TO ESTIMATE IT TO BE ABOUT 2.7 MILLION, MAYBE A LITTLE LESS AND, AGAIN, AS MS. CROUCH SAID, THIS IS MONEY PROMISE REDIRECT EXAMINATION SO IT'S NOT MONEY WE'RE GOING TO
[00:10:01]
HAVE TO SAY, EARN IN REVENUE. IT'S JUST PROMISED TO US OVER A FIVE YEAR PERIOD. EVEN THE LAWN IS SECURED BY OPELIKA CITY, AUBURN CITY, AND LEE COUNTY.>> ALSO THE TOURISM COMMITTEE IS ON THAT TOO.
>> ABSOLUTELY. >> THANK YOU VERY MUCH.
>> CAN I ASK BEFORE YOU GO ARE YOU ABLE TO MEET YOUR
OBLIGATIONS ON THIS PROJECT? >> AS IN THE CONSTRUCTION?
BASED ON THE PROMISE OF MONEY FROM THESE ENTITIES AND BASED ON THE FACT THAT WE'RE RUNNING ON SCHEDULE, CONSTRUCTION, AND BUDGET PRESENTLY, EVERYTHING SEEMS TO BE FINE.
NOW, THE ORIGINAL REQUEST WAS $6,800,000.
THERE WAS AN OVERRUN IN THE CONSTRUCTION BID.
NO ONE IS SURPRISED ABOUT THAT BUT ACCORDING TO THOSE WHO BUILD GOLF COURSES, OUR 10% OVERRUN OF 770,000 WAS MUCH LESS THAN WHAT THEY HAD BEEN SEEING THROUGHOUT THE COUNTRY ON THE OTHER PROJECTS AND EVERYTHING. FORTUNATELY, INDIAN PINES HAD AN ASSET OF ABOUT 1.5 MILLION. 1.4 MILLION AT THE TIME SO WE ABSORBED SOME OF THAT. WE FEEL WE'RE GOING TO WROTES THE LINE IN THE BLACK. THAT'S THE PLAN ANYWAY.
>> I HAD A QUESTION UNRELATED TO THE ITEM BUT THOSE WHO GOLF THERE SINCE THE COURSE IS CLOSED DO YOU HAVE ANY RELATIONSHIP WITH OTHER COURSES TO HELP OFFSET FEES AND --
AUBURN IS SORT OF UNIQUE IN THE SENSE THAT THERE'S TWO PUBLIC COURSES BASICALLY, MAYBE A THIRD.
SOME WOULD SAY AT THE GREENS. BUT THE TRENT JONES COURSE OBVIOUSLY IS -- INDIAN PINES WE'RE THE ONLY TWO PUBLIC COURSES REALLY. YOU WOULD HAVE TO FIVE TO PHOENIX CITY, MONTGOMERY, STILL WATER, TO PLAY ON A PUBLIC COURSE. EVERYTHING ELSE IS PRIVATE.
OUR PROFESSIONALS HAVE BEEN TAKING SOME OF OUR, SAY, MEMBERS OUT OF TOWN TO PLAY THE COURSES BUT IT'S LIMITED.
>> WHAT IS THE EXPECTED GRAND OPENING IN.
>> THE DATE RIGHT NOW IS NOVEMBER 1ST.
SOMEWHERE AROUND NOVEMBER. WE START TO -- IT'S A DIRT PILE OUT THERE NOW. IF YOU DRIVE BY.
BUT WE'RE GOING TO START PUTTING DOWN SOME GRASS AND SOD JUNE 1ST. SO HOPEFULLY WE'LL START SEEING SOME GREENERY.
>> WE APPRECIATE IT, MAN. AS A PROFESSIONAL IN THE MINISTRY WORLD YOU HAVE VOLUNTEERED TO BE PART OF YOUR
COMMUNITY. >> THAT'S NOT WHAT THE BAPTIST PREACHER THOUGHT HE WOULD EVER DO.
I'LL TELL YOU. IT'S BEEN A LEARNING CURVE.
BUT I'M HONORED TO SERVE THE CITY.
I WILL JUST TAKE A QUICK MOMENT, THE STAFF, THE MAYOR, EVERYBODY HAS BEEN GREAT TO WORK WITH. EH WE HAVE A GREAT CITY.
GREAT CITY GOVERNMENT. I COULD NOT BE MORE PROUD TO BE A CITIZEN. THANK YOU.
>> THANK YOU. WE APPRECIATE IT.
>> OKAY. ANY OTHER COMMENTS OR QUESTIONS?
>> ALL RIGHT. MOTION AND SECOND ALL IN FAVOR
[8. CONSIDERATION OF CONSENT AGENDA]
>> ANY OPPOSED IN. >> MOTION CARRIES.
>>> MOTION TO APPROVE THE BALANCE OF THE CONSENT AGENDA?
>> SO MOVED. >> MOTION AND SECOND.
ALL IN FAVOR PLEASE SAY AYE. >> AYE.
>> ANY OPPOSED? THE CONSENT AGENDA IS APPROVED.

>> ANYONE HAVE A PROBLEM MOVING FORWARD WITH THE VOTE?
>> ANY QUESTIONS? >> ALL RIGHT.
[9.b. Annexations. Unanimous consent necessary. Planning Commission recommendations.]
>> YES. >> ITEM 9 B 1 REQUEST TO ANNEX 18.90 ACRES. THE PLANNING COMMISSION UNANIMOUSLY RECOMMENDED APPROVAL.
UNANIMOUS CONSENT IS NECESSARY. >> I'LL INTRODUCE IT AND ASK FOR
>> MOTION AND SECOND. ANYONE ON THE COUNCIL HAVE A PROBLEM MOVING FORWARD WITH THE VOTE?
>> ALL RIGHT. SEEING NONE ANY COMMENTS OR
[00:15:02]
QUESTIONS? >> UNDER THE NOTES FROM THE PLANNING COMMISSION GREENWAY GREEN SPACE IMPACT IT SAYS THAT A BACK PATH IS PROPOSED. CAN YOU UPDATE US ON THE STATUS
OF THE BIKE PATH? >> THAT IS MERELY COPYING OVER FROM THE GREEN WAYS AND GREEN SPACE PLAN AND A COMBINATION OF A BAKE PLAN AND PROPOSED IS JUST THAT.
IT IS PROPOSED BY THOSE PLANS AND NOT IN ANY OTHER WAY, SHAPE, OR FORM MEANING THAT BEEHIVE ROAD IS RIPE FOR A BIKE LANE AT SUCH POINT THAT ONE IS ABLE TO BE INSTALLED AND ONE OF THE THINGS THAT WE WILL BE WORKING ON IS AS A STAFF IS YOU NEED TO BE CAREFUL ABOUT PEOPLE'S CONFUSION WITH BOOK PATH AND BIKE LANE. LANE IS ON ROAD.
PATH IS OFF ROAD. IT'S RARE WE DO PATHS.
YOU SEE SOME ALONG WIRE ROAD AND MARTIN LUTHER KING DRIVE BUT THOSE ARE RARE. THIS WOULD BE A BIKE PATH SCENARIO WE DON'T OWN BEEHIVE ROAD.
WE'RE WORK, THE COUNTY. WE MAY TAKE SOME OWNERSHIP WITH IT OVER TIME AFTER A FULL RECOMMEND IS DONE MEANING WE HAVE TO DIG IT UP AND FIX THINGS AND SO WHEN THERE'S AN OPPORTUNITY THAT WE CAN ADD FOUR FEET TO EACH SIDE AND STRAP A BIKE LANE WE DO THAT AND SO THAT IS MERELY A STAFF COMMENT THAT IS VERY COMMON IN ALL STAFF REPORTS.
STAFF COMMENT COMES DIRECTLY WHEN REPORT PROPERTY IS COMING INTO THE CITY OR DEVELOPING IN A CERTAIN WAY BASED ON RULES AND REGULATIONS WE REQUIRE EASEMENTS AT THAT TIME.
VERY RARELY DOES SOMEBODY ASK TO BUILD IT.
SOMETIMES THEY DO BUILD IF IT'S CONNECTING TO SOMETHING ELSE BUT
THAT'S RARE. >> WHEN WE ANNEX SOMETHING SHOULD WE ASSUME THAT THERE'S AN EASEMENT THAT ALLOWS FOR A
PROPOSED BIKE PATH? >> NO THERE'S NO BIKE PATH.
A LANE WOULD BE JUST ON BEE HIGH ROAD ABE IT'S NOT NEEDED FOR RIGHT OF WAY OR ANYTHING ELSE. NO STAFF MEMBER IS SUGGESTING THAT. THIS COMMENT IS INDEPENDENT OF A REQUIREMENT. THIS WOULD ONLY BE A BIKE LANE ABE RIGHT NOW IT TEE -- AND RIGHT NOW IT TIE AS TO NOWHERE.
THERE IS NO BIKE LANE FOR IT TO ATTACH TO.
IF YOU WERE TO BUILD THIS HERE IT WOULD BE IN SPACE.
THERE'S NOT ONE DOWN WIRE ROAD OR AT THE INTERSTATE.
AND THERE'S NOT ONE ALL THE WAY TO SOUTH COLLEGE AS THIS CROSSES OVER THE INTERSTATE SO YOU DON'T -- IF WE WERE TO DO A SECTION WE WOULD MAKE IT CONNECT TO SOME OTHER BIKE LANE.
>> YES. >> THIS COMMENT COULD BE MADE ANYWHERE BUT AS LONG AS WE'RE TALKING ABOUT BEEHIVE ROAD I UNDERSTAND THAT OUR ENGINEERS ARE TALKING TO THE COUNTY ENGINEERS AND WE HAVE GREAT HOPES AND IT LOOKS LIKE AN EASY CALL THAT WE'RE GOING TO EXPAND THIS ROAD.
>> WE DON'T HAVE PLANS TO EXPAND IT AT ALL.
THE PLAN IS TO CORRECT IT. IT'S BUMPY.
>> IT'S GOING TO CARRY A LOT OF TRAFFIC AND MORE AS TIME GOES ON HERE. I WOULD LIKE TO SEE THAT OBVIOUSLY. AND IF WE'RE GOING TO DO IT, I WOULD LIKE TO SEE A BIKE LANE OR SOMETHING.
AS A MATTER OF SAFETY. >> YEAH.
AGAIN, GLADLY. IT'S ONE OF THOSE THINGS WHERE IT COMES IN WHEN IT CONNECTS TO SOMETHING AND RIGHT NOW ONE OF OUR CHALLENGES IS IF WE JUST PUT A BIKE LANE THERE STARTING AT WIRE ROAD AND ENDING AT SOUTH COLLEGE IT'S NOT CONNECTING TO ANY OTHER BIKE FACILITY SO PART OF THAT DECISION COMES FOR IT TO CONNECT TO SOMETHING ELSE. SAND HILL ROAD THAT CONTINUES ON THE OTHER SIDE WOULD HAVE THE SAME THING SO THAT WOULD BE THE TIME THAT YOU WOULD MAKE' BRITTER CONNECTION.
>> ANY FURTHER QUESTIONS? OKAY.
REQUEST TO ANNEX 78.3 ACRE OF PROPERTY.
[00:20:03]
RECOMMENDED APPROVAL APRIL 13TH. UNANIMOUS CONSENT IS NECESSARY.>> I'LL ASK FOR UNANIMOUS CONSENT.
>> SECOND. >> MOTION AND SECOND.
ANYONE HAVE A PROBLEM MOVING FORWARD WITH THE VOTE? SEEING AND HEARING NONE ANY COMMENTS OR QUESTIONS?
>> WHEN IT TALKS ABOUT WATER SERVICE AND SAYS WE DO NOT -- THE CITY OF AUBURN DOES NOT PROVIDE SANITARY SEWER SERVICE TO THIS AREA. ARE WE TO ASSUME THIS INDUSTRIAL COMPLEX, WHATEVER HAPPENS TO GO THERE THERE BE SOLELY ON SEPTIC?
THERE WILL BE THE ABILITY TO CONNECT A LATERAL THROUGH TO SANITARY SEWER. IT'S JUST NOT CURRENTLY
AVAILABLE TO THE PROPERTY. >> ALL RIGHT.
>> ANY OTHER QUESTIONS? >> JUST ONE COMMENT.
I UNDERSTAND THAT OUR CITY STAFF AND THE INDUSTRIAL DEVELOPMENT BOARD IN THE PERSONS OF DAVE DEBITES AND PHILLIP DUNLAP HAVE CONCERNS THAT PROPERTY OWNERS HAVE.
THANK YOU FOR GOING THE EXTRA MILE TO DETERMINE WHAT WE AS A CITY CAN DO TO HELP EVERYBODY ACCOMMODATE PROGRESS.
>> OKAY. ROLL CALL. >> DAWSON.
>> ITEM 9 B3. REQUEST TO ANNEX 13.14 ACRES AT 2225 LEE ROAD 10. PLANNING COMMISSION UNANIMOUSLY RECOMMENDED APPROVAL AT ITS APRIL 13TH MEANING.

>> I'M HAROLD WATSON, 2549 FARMVILLE LAKES DRIVE, AUBURN, ALABAMA. MAYOR, MADAME, COUNCILMEN, FIRST
[00:25:03]
OF ALL THANK YOU FOR WHAT YOU COFOR THE CITY OF AUBURN.WE JUST MOVED HERE TWO YEARS AGO AND WE LOVE IT AND WE APPRECIATE ALL YOU DO. ESCAPE MRI BUCKIES.
WE LIVED IN TEXAS FOR 20 YEARS AND I KNOW WHAT IT CAN DO FOR YOUR COMMUNITY. SO MY WIFE SAID HAROLD WATCH YOUR TIME. DON'T GET CARRIED AWAY.
BREATHE. I'M HERE TO SPEAK IN OPPOSITION TO BUILDING THE APARTMENTS IN THE MULTIFAMILY UNITS.
MY WIFE AND I STARTED OUR JURISPRUDENCENY 55 YEARS AGO LIVING IN APARTMENTS AND THREE YEARS AGO WE DECIDED TO DOWNSIZE FROM OUR HOUSE IN PELHAM, ALABAMA.
WE LOVE AUBURN SO MUCH. WE WANTED TO COME DOWN HERE AND LIVE. AND I WILL TELL YOU THAT WE'VE LIVED THROUGHOUT TEXAS AND MASTER PLAN.
AND I'M NOT HERE TO BASH THE DEVELOPER, WHOMEVER, BUT WE WERE TOLD THESE CERTAIN THINGS WOULD HAPPEN.
WE WOULD HAVE HOMES AND HOUSES AND WE'D HAVE A RETAIL AREA.
WE'D HAVE A CLUBHOUSE. A POOL.
AND FISHING PIER. WELL, AS WE ALL KNOW THERE WERE SOME THINGS THAT HAPPENED ON THE WAY AND SOME THINGS DIDN'T REALLY WORK OUT, YOU KNOW. AND FIRST THING WE KNEW WE SAW THESE APARTMENTS AND THOUGHTED IT WAS GOING TO BE RETAIL AND WE STARTED INQUIRYING. THEY SAID THEY WANT TO BUILD MORE AND WE SAID THAT'S NOT RIGHT.
THAT AIN'T RIGHT. NOT JUST PERSONALLY BUT THESE ARE THE ISSUES. AS YOU WELL KNOW THERE'S A -- BUILT BETWEEN ASHTON LAKES AND OUR COMMUNITY OF FARMVILLE LAKES. GOOD AND BAD.
IT'S GOOD FOR THE RESIDENTS OF ASHTON LAKES BUT THAT THOROUGHFARE IS REALLY A TRAFFIC HAZARD WAITING TO HAPPEN.
AND WE HAVE CHILDREN IN OUR NEIGHBORHOOD WHO UNFORTUNATELY SOMETIMES PLAY IN THE ROAD OUT THERE.
AND IN OUR NEIGHBORHOOD WE HAVE NO SPEED BUMPS.
HOPEFULLY WE CAN GET THAT TAKEN CARE OF.
WE HAVE ONE SPEEDING SIGN FOR 25 MILES.
WE UNDERSTAND THAT. WE HOPE THAT WE CAN REDUCE THE TRAFFIC BUT I WILL TELL YOU AS WE GET MORE -- IT'S GOING TO GET WORSE AND WORSE. AND YOU TRAVEL FARMVILLE ROAD YOU KNOW ABOUT THAT ROAD OUT THERE AND YOU KNOW ABOUT THE INTERSECTION OF 280 AND FARMVILLE ROAD AS WELL.
SO IT'S GOING TO BE REALLY BAD AND WE DON'T NEED TO HAVE MORE APARTMENTS FOR PEOPLE TO LIVE UP THERE.
WE'RE NOT IN A TYPE OF GROWTH -- I LOVE GROWTH AND I LOVE THE AREA BUT WE JUST REALLY WANT TO MAKE SURE THIS IS A SAFE NEIGHBORHOOD FOR OUR RESIDENTS TO WALK IN THE AREA, TO WALK DOGS, WALK THEIR CHILDREN. RUN.
DO WHAT THEY WANT TO DO AND MORE IMPORTANTLY TO HAVE A GOOD NEIGHBORHOOD TO LIVE IN. SO I'LL JUST SAY THAT WE'RE REALLY LOOKING FORWARD TO BEING PART OF THIS COMMUNITY AND HELPING ANY WAY THAT WE CAN. AND AS I CLOSE, A GREAT FRIEND OF AUBURN USED TO SAY IN CLOSING THE GREAT GYM FIVE WOULD SAY MY TIME IS UP. THANK YOU FOR YOURS.
>> OKAY. WE'LL CLOSE THE PUBLIC HEARING.
ANY COMMENTS OR QUESTIONS FROM THE COUNCIL.
>> I WOULD LIKE TO SAY THAT I'VE HAD SEVERAL RESIDENTS OF THE AREA AND HAVE THE SAME SENTIMENT AS MR. WATSON AND OPPOSE THE CHANGE IN THE PDD. SINCE THIS WAS INTRODUCED IN 18 AND THERE WAS LOTS OF CONVERSATION, MR. WATSON WASN'T AROUND WHEN WE GOT TO HEAR A LOT OF CONCERNS ABOUT CONNECTING ASHTON LAKE TO FARMVILLE AND NOW I FIND IT CURIOUS THAT NOW IT'S ON THE OTHER SIDE ABOUT CONNECTIVITY.
HOWEVER THAT COMMERCIAL CORNER SHOULD BE AND NEEDS TO BE PRESERVED. THAT WAS ONE OF THE SHINING ELEMENTS OF THE PROPOSED DEVELOPMENT THAT THERE WOULD POTENTIALLY BE SOME SERVICES THAT THE NEIGHBORHOOD COULD TAKE ADVANTAGE OF AND IT BEING RIGHT ON 280, I DON'T KNOW THAT WE NEED TO ADD MORE LIVING DENSITY RIGHT ON THAT CORNER BUT I THINK
[00:30:03]
WE SHOULD PRESERVE IT FOR COMMERCIAL AND I DON'T BELIEVE THAT WE SHOULD AMEND THE PDD ANY FURTHER.ANYBODY ELSE ON THE COUNCIL? >> YES, SIR.
>> MR. MAYOR, JUST A COUPLE OF QUESTIONS.
WHAT WE'RE LOOKING AT TONIGHT, THE PDD COVERS 6 A AND B.
ON OUR LAST MAP I BELIEVE. THE AREA OF CHANGE IS THAT 6 B AREA. IT WAS SLATED INITIALLY THAT WAS 60,000 SQUARE FEET OF COMMERCIAL SPACE BUT SPLIT THAT OFF WITH SOME ADDITIONAL MULTIFAMILY JUST IN THAT SPACE AS WELL AND AS PART OF THIS REQUEST THERE ARE NO OTHER REQUESTED CHANGES TO OTHER PHASES OR ANYTHING.
THIS IS SUBJECT TO THE PDD AGREEMENT BUT REALLY --
>> ALL OF THIS IS COVERED BY THE PDD ITSELF HOWEVER THE AREA OF CHANGE WITH THIS REQUEST IS GOING TO ESSENTIALLY BE CONFINED TO THAT AREA. SINCE THE 6 A AREA HAS ALREADY BEEN ESSENTIALLY CLOSE TO BUILD OUT OR VERY CLOSE.
>> MY POINT IS IT'S IN THE PDD AND IT'S BUILT AND IT'S BUILT WITHOUT ANY COMMERCIAL.
6 A IS CURRENTSLY BUILT WITH JUST MULTIFAMILY HOMES AND 6 B HAS NOT BEEN DEVELOPED AS OF THIS TIME.
>> OKAY. >> CONTRARY TO THE PDD.
>> IT'S -- THE PDD HAS -- >> YOU COULD PUT 60% IN 6 B.
>> 6B IS SLATEDED TO BE COMMERCIAL DEVELOPMENT FOR RETAIL. OR SERVICES.
AND SO RIGHT NOW, THAT'S WHAT IT'S SLATED FOR.
IT HAS NOT BEEN BUILT BECAUSE THEY'RE WANTING TO DO ADDITIONAL MULTIUNIT DEVELOPMENT WHICH IS WHAT THEY'RE ASKING FOR WHICH IS WHY THEY HAVEN'T DEVELOPED ANYTHING IN 6 B YET BUT PHASE ONE, FIVE, TWO, MOST OF PHASE THREE, ALL OF THAT IS ALMOST FULLY BUILT OUT BUT THEY'RE WANTING TO ADDITIONAL DENSITY BY MORE MULTIUNIT FAMILY AS OPPOSED TO COMMERCIAL.
>> I UNDERSTAND BUT I THINK REASONABLE PEOPLE LIKE MR. WATSON AND MYSELF WOULD THINK THAT 6AWAS GOING TO BE
COMMERCIAL AS WELL. >> WAS IT SUPPOSED TO BE
IT'S VERY COMPLICATED BECAUSE THE PHASE AS PHASES START THINGS CHANGE SO A LARGER AREA COULD HAVE GONE ANYWHERE IN MR. PER
THE PLAN CORRECT? >> THAT'S CORRECT.
>> SO WHAT WAS KNOWN AS PHASE SIX COULD HAVE GONE ANYWHERE IN THERE SO CORRECT IF I UNDERSTAND WHAT YOU'RE GETTING AT IS NO COMMERCIAL HAS BEEN BUILT TO DATE BUT THERE WAS NOTHING SPECIAL TO 6A HAVING TO DO THAT. THERE IS SOME FLEXIBILITY.
AND YOU'RE CORRECT THAT THERE ARE A LOT OF PDDS OF A BINDING NATURE AND ONE OF THE THINGS YOU HAVE A DIFFERENT AGENDA ITEM LATER THE CITY IS BOUND AS THE DEVELOPER IS TO CERTAIN DENSITIES AND USES.
>> SO THE 60,000 RETAIL -- WAS PART OF THE PDD AND IT'S NEVER BEEN REDUCED TO THIS POINT. IT'S JUST GOING TO BE LOCATED ON
THAT CORNER. >> ORIGINALLY IT WAS STATED IN 2019 IN A MEETING WITH RESIDENTS THAT THE COMMERCIAL WOULD BE ON THE GROUND FLOOR AND THE DWELLING UNITS WOULD BE ABOVE IT AND SO THAT IT WOULD BE MUCH MORE BALANCED AS YOU WENT THROUGH THE WHOLE PHASE OF SIX AND THAT SHIFTED IN ALL THE
[00:35:05]
MULTIUNIT FAMILY WENT INTO ITS OWN SEPARATE FROM COMMERCIAL.>> AS LONG AS IT WAS IN THAT GEOGRAPHIC AREA THERE IS NOT ANYTHING BINDING IN THE PDD UNLESS THERE WAS SOME FORM OF CONDITION OF APPROVAL THAT IT CAN BE DONE THAT WAY AS LONG AS
IT'S IN THAT AREA IT COMPLIES. >> THIS MAY NOT.
I MAY BE CHASING A RABBIT. BUT THE 60,000 SQUARE FEET IT
CAN GO IN 6B NOW. >> ESSENTIALLY, YES.
UNLESS THEY WANT TO START DEMOLISHING STUFF THAT WAS JUST
COMPLETED. >> ARE THEY REQUIREDED TO DO AT LEAST 606,000? OR -- 60,000? I GUESS WHERE THE QUESTION IS LEADING TO IS CAN YOU FIT 60,000 SQUARE FEET THERE.
CURRENTLY THEY COULD DO KIND OF A NUMBER OF THINGS AS YOU
MENTIONED IF THE. >> SO ESSENTIALLY THAT 60,000 IS KIND OF THE TOTAL SQUARE FOOTAGE THAT THEY CAN PUT THERE.
>> GOTCHA. >> I DON'T BELIEVE THEY'RE FULLY COMPELLING HERE. AS LONG AS IT'S --
>> IT JUST HAS TO BE COMMERCIAL. >> IT'S JUST LIKE SOME DEVELOPMENTS ARE APPROVED FOR A GREATER DENSITY SO YOU'LL SEE AT TIMES THAT OFTEN TIMES PEOPLE END UP THE PHASE BUT THEY DO LESS DENSITY AND ARE NOT COMPELLED TO BUILD UP TO THE DENSITY. THEY JUST CAN'T BUILD MORE THAN THAT WITHOUT COMING BACK TO YOU.
>> ANY OTHER QUESTIONS OR COMMENTS?
>> NO. >> ITEM 9 C4, REQUEST FROM THE INDUSTRIAL DEVELOPMENT BOARD TO REZONE APPROXIMATELY 78.30 ACRES OF PROPERTY AT 24 # 7 LEE ROAD TEN.
>> MOTION AND A SECOND. ANYONE ON THE COUNCIL HAVE APE PROBLEM MOVING FORWARD WITH A VOTE ON THIS, THIS EVENING.
>> SEEING AND HEARING NONE WE'LL OPEN PUBLIC HEARING IF YOU WOULD LIKE TO ADDRESS CITY COUNCIL PLEASE COME FORWARD AND GIVE YOUR NAME AND ADDRESS FOR THE RECORD AND YOU HAVE FIVE MINUTES TO SPEAK.
>> SEEING NO ONE WE'LL CLOSE THE PUBLIC HEARING.
>> ITEM 9 C5. REQUEST ON BEHALF OF APRIL AND JOHN MCDONALD TO AMEND THE MADISON PARK PLANNED DEVELOPMENT.
THE PLANNING COMMISSION FAILED TO RECOMMEND APPROVAL OF THIS REQUEST BY A VOTE OF 3-3 AT ITS MEETING.
UNANIMOUS CONSENT IS NECESSARY AND A PUBLIC HEARING IS
REQUIRED. >> I'LL INTRODUCE THE ORDINANCE
AND ASK FOR UNANIMOUS CONSENT. >> SEEING AND HEARING NONE AT THIS TIME I'LL OPEN THE PUBLIC HEARING.
YOU HAVE FIVE MINUTES TO SPEAK. >> REPRESENTING THE APPLICANT.
THIS PARTICULAR PROJECT WAS BEFORE PLANNING COMMISSION.
IT ONLY HAD SIX MEMBERS ATTEND AND THE VOTE WAS SPLIT 3-3.
USUALLY IN BASEBALL TIE GOES TO BUT IN THIS CASE THE MOTION FAILS. ORIGINALLY THIS PDD WAS ORIGINALLY WHIT CAME IN WAS 50 ACRES.
THE MAJORITY OF THIS WAS MULTIFAMILY MANY MOONS AGO.
THE PDD WAS REVISED IN THE GREAT RECESSION IN 2012 WHEN THIS PROPERTY WAS IN FORE CLOSURE. ON YOUR SCREEN YOU'LL SEE AN OUTLINE IN GREEN. THAT DOTTED OUTLINE IN GREEN IS THE CURRENT PDD. PLUS OR MINUS 1315 ACRES DEPENDING ON WHAT INFORMATION YOU'RE LOOKING AT.
WE'RE THE ONLY UNDEVELOPED PARCEL LEFT IN THIS CURRENT PDD.
IF YOU LOOK UP TLP RIGHT NOW FROM NORTH TO SOUTH YOU HAVE AN OPEN SPACE. YOU HAVE MULTIUNIT.
[00:40:01]
THEN WE HAVE A DOLLAR GENERAL AND WE HAVE GRAYS AUTO.THE ONLY PIECE THAT'S VACANT LAYING IN THIS PDD IS OUR PARCEL. OUR PARCEL IS ACTUALLY SPLIT ZONED. THREE QUARTERS IS IN THE PDD, ABOUT A QUARTER OF IT IS OUTSIDE OF THE PDD.
WE ARE ALSO SEPARATED FROM THE REST OF THIS PDD BY HALEY LANE.
THAT ROAD THAT'S RUNNING THROUGH THERE BIFURCATING US FROM THE REST OF THE PDD. ANYWAYS.
OUR PAR SHELL IS ODD SHAPED. -- PARCEL IS ODD SHAPED.
BLAL LITTLE BIT OF FRONTAGE ON WIRE ROAD BUT THEN WE WRAP BEHIND ANOTHER PARCEL THAT FRONTS ON WIRE ROAD.
OR DO WE JUST REMOVE THIS PARCEL FROM THE PDD? AND IN CONVERSATIONS IT WAS KIND OF YOU GO ONE WAY OR GO FROM THE OTHER. WE MOVED IN THE DIRECTION BECAUSE THE REST OF THE PDD IS BUILT TO BE REMOVED FROM THE PDD. LATER ON IN YOUR AGENDA TONIGHT IF THE PDD -- IF WE'RE APPROVED IS A CONDITIONAL USE FOR A MULTIFAMILY USE. ON THIS PROPERTY.
IF YOU GO TO THE NEXT SLIDE ONE OF THE QUESTIONS IS THAT CAME UP WAS TALKING ABOUT THEY WANTED TO PRESERVE THIS PLANNED R LAND FOR COMMERCIAL. ALONG WIRE ROAD CORRIDOR THERE, WE HAVE A GOOD BIT OF COLLEGE OWNED PROPERTY WITH THE VET CLINIC THROUGH THERE. AS YOU HAVE SEEN IN AUBURN FOR THE MOST PART MOST OF OUR COMMERCIAL DEVELOPMENTS AT THE MAJOR INTERSECTIONS. WE HAVE LIMITED DEVELOPMENT IN BETWEEN OUR MAJOR INTERSECTIONS. OTHER THAN MAYBE SOUTH COLLEGE.
YOU KEEP COMING ON WIRE AND YOU GET TO WEBSTER AFTER YOU PASS THE VET SCHOOL AND WE HAVE A COMMERCIAL NODE THERE WITH STRIP CENTERS AND GAS STATIONS. IN BETWEEN THERE, THERE'S A LITTLE BIT OF COMMERCIAL ESPECIALLY AT THIS INTERSECTION WHICH DOESN'T GO ANYWHERE. RECENTLY APPROVED PDDS IN COX AND WIRE COMMERCIAL AT THOSE CORNERS.
IN THE FORESEEABLE COMMERCIAL IS DRIVEN ALONG THIS CORRIDOR.
-- IT'S WITH THE DENSITY WE COPT DON'T FEEL THIS IS -- THE COMMERCIAL VIABILITY OF THIS CORE CONSIDER BUT THAT'S ALL.
HAPPY TO ANSWER QUESTIONS BUT WANTED TO REVIEW OUR THOUGHTS WITH YOU GUYS AND GO OVER OUR THINKING ON THIS PARTICULAR SITE.
>> CAN YOU PLEASE RETURN? >> WE HAVE A QUESTION.
>> DO YOU WANT TO FINISH THE MAY I PUBLISH TO THE JURY LICK
HEARING FIRST. >> I WAS GOING TO LET HIM WHILE HE WAS STANDING HERE. BUT IF THAT'S WHAT WE NEED TO
DO. >> THAT'S BEST IF YOU COMPLETED
THE PUBLIC HEARING. >> ANYONE ELSE LIKE TO SPEAK?
1318 KURT CIRCLE. BRETT WAS TELLING YOU ABOUT THE PDD. ORIGINALLY MADISON PARK -- THIS IS GOING TO BE FREE STANDING HOUSES LIKE THE ONES THE BOTANIC BUILT IF YOU'RE FAMILIAR IN OPELIKA.
WHEN I DRIVE IN THERE'S A HOUSE TO THE RIGHT BUT IT'S LIKE TWO STORY REALLY NICE. THESE ARE GOING TO BE HALF MILLION DOLLARS PLUS HOUSES. THE THEORY IS THE THEME IS GOING
[00:45:04]
TOWARD THE GAME DAY MARKET WITH THE NEW BUCKIES THAT'S COMING IN THAT'S SO POPULAR WE THINK EVERYONE IS GOING TO COME INTO BUCKIES, MAKE THEIR PIT STOP THERE, GOOD FOR TAX REVENUE.RIGHT. >> THEY CAN HAVE THEIR HOUSE THERE. NOT HAVE TO DRIVE -- DRINK AND DRIVE. CATCH TIGER TRANSIT.
GO STRAIGHT INTO GAME DAY. WALK DOWNTOWN.
YOU KNOW, GO TO THE RESTAURANTS AND BOOKSTORE AND ALL THAT KIND OF STUFF AND THEN RIDE HOME WITH A SAFE RIDE HOME.
SO THAT'S KIND OF THE THEORY OF WHAT WE'RE DOING IN THIS LOCATION. BUT THEY'RE GOING TO BE HIGH END FREE STANDING HOUSES. NOT SOME KIND OF APARTMENT COMPLEX OR SOMETHING.
>> ANY COMMENTS OR QUESTIONS. >> IS IT POSSIBLE TO PROVIDE INPUT AS TO WHAT THE PLANNING COMMISSION FOUND OBJECTIONAL TO
>> GLADLY. I WANT TO ALSO CLARIFY.
THERE IS SOME CONFUSION. I WANT TO CLARIFY THAT WHEN THE PDD WAS DONE THE PARCEL IN QUESTION WAS A PARCEL IN AND OF ITSELF. THERE WAS NOT A PDD OVERLAY SPLITTING A PARCEL. THAT'S VERY UNUSUAL SO I DON'T WANT TO CREATE CONFUSION FOR YOU.
>> WE DON'T -- I DON'T WANT ANY CONFUSION THAT SOMEHOW WE LAID THE PDD OVER AND LEFT ACREAGE OUT.
THAT DOESN'T TYPICALLY HAPPEN SO OVER TIME PEOPLE ACQUIRE PROPERTIES AND THAT HAPPENS BUT TO SPEAK TO THE STAFF RECOMMENDATIONS WHEN APPLICANTS COME TO US IT'S OUR JOB TO FIGURE OUT A WAY TO HELP THEM ACCOMMODATE WHAT THEY'RE ASKING TO DO BUT IT DOESN'T MEAN THAT WE'RE ENDORSING WHAT THEY WANT TO DO. IT'S SIMPLY MEANING THEY NEED THE BEST SOLUTION TO WHAT THEY'RE ATTEMPTING TO DO SO SUGGESTING THAT THE STAFF IS SUGGESTING THE CLEANEST WAY AS INDICATED WOULD BE TO DO THIS FROM A REGULAR TOUGHER STANDPOINT IS THE NEATEST AND CLEANEST WAY TO DO THAT IF IT'S
GOING TO BE DONE. >> WHAT WAS THE STAFF
RECOMMENDATION ON THIS? >> STAFF RECOMMENDATION FOR DENIAL AND FUTURE CONDITIONAL USE YOU'LL SEE ON A PORTION OF THIS PROPERTY WAS ALSO FOR DENIAL.
>> DO YOU WANT TO EXPLAIN WHY? >> YES.
I THINK IT'S SOME OF THE DISCUSSION HAS GONE TONIGHT IN THE APPLICANT MENTIONED OBVIOUSLY THIS IS ON A HEAVILY TRAVELED FIVE LANE HIGHWAY REALLY IT CERTAINLY DESIGNATED THIS AREA AS COMMERCIAL ALREADY. THE FEW WHICH OUR LAND USE MAP TIES -- FUTURE LAND USE MAP TIES BACK TO THE PDD.
WE LOOK AT AREAS SURROUNDING IT. IT'S ALSO KIND OF A MIXED USE.
I DON'T NECESSARILY HAVE HEART BURN WITH RESIDENTIAL FURTHER BACK IN THE PROPERTY KIND OF IS PART OF THAT ORIGINAL PDD THAT WAS DISCUSSED. BUT FROM OUR STANDPOINT AND THE DOCUMENTS WE HAVE, GUIDING DOCKMENTS, THAT ULTIMATELY GOES BACK TO THIS IS GOING TO BE A COMMERCIAL CORRIDOR.
IT MAY NOT BE THE MOST BUSY ONE IN TOWN OR ANYTHING LIKE THAT BUT ULTIMATELY, COMMERCIAL USES ARE MORE APPROPRIATE FOR PROPERTIES AND PARCELS FRONTING THAT CORRIDOR THAN RESIDENTIAL.
>> AND THAT WAS THE PLANNING COMMISSION'S OBJECTION AS WELL?
>> YES. OBVIOUSLY THERE WAS A SPLIT VOTE BUT THOSE WHO VOTED AGAINST THE MOTION HAD VERY SIMILAR SENTIMENTS TO THE STAFF AS WELL. THE BASE STONE ON THAT IS CDD.
[00:50:19]
IT WOULD OPERATE AS CDD AND IN CDD WITH 1.69 ACRES, THEY COULD>> YES. ULTIMATELY, THEY WOULD HAVE TO LAY IT OUT ON THE SITE AND THERE WOULD BE THINGS OF THAT MANNER BUT CERTAINLY SINGLE FAMILY IS CDD AS WELL AS A NUMBER OF OTHER
USES. >> ONCE IT'S ARE MOVED THERE ALSO WOULD NOT BE I'M NOT SAYING THEY WOULD DO THIS BUT THEY'RE ALSO NOT COMPELLED TO BUILD ANYTHING CONDITIONAL USE WOULD BE CONSIDERED FOR. ONCE YOU REMOVE THE PDD, IT REVERTS BACK TO ITS BASE ZONE AND IF NOBODY EVER DEVELOPS ANYTHING, THEN IT JUST REVERTS BACK TO ITS BASE ZONE.
THERE IS NO HOOK ON THAT. THERE IS A HOOK IN OTHER WAYS WHEN YOU REZONE PROPERTY BUT THIS WOULD BE REMOVAL AND THE BASE ZONING THE ALREADY THERE. STAFF IS POINTING THAT OUT IN
THE MEMO. >> SO THERE'S NOTHING SAYING WE COULD NOT APPROVE THE REMOVAL OF THE 1.69 FROM THE PDD AND IT JUST SAYS CDD WHICH IS IN KEEPING WITH THE AREA THAT WE WOULD HAVE TO APPROVE THE CONDITIONAL USE LATER.
>> WELL, YOU WOULDN'T HAVE TO. >> RIGHT.
>> AND ANYTHING CDD CAN GO THERE REGARDLESS OF WHAT YOU APPROVE IF YOU REMOVE THE PDD. ANYTHING ALLOWED IN THAT ZONE CONDITIONALLY WOULD COME BEFORE YOU AND PERMITTED BY RIGHT WOULD NOT COME BEFORE YOU.
>> THE ALTERNATIVE IS TO ADD THIS ADDITIONAL ACREAGE TO THE PDD AND AMEND THE PDD TO INCLUDE MAXIMUMFALLY OR IS THAT A --
MULTIFAMILY. >> THE STAFF WOULD GIVE THE SAME RECOMMENDATION OF DENIAL. SO FOR THE APPLICANT THIS IS A CONCERTED EFFORT BY EVERYBODY TO SAY THIS IS THE SAME THING EITHER WAY. THIS WAS THE DECISION POINT.
>> OKAY. >> DOESN'T REALLY CHANGE THE STAFF RECOMMENDATION ULTIMATELY IT'S UP TO YOU GUYS.
>> I HAD A CURIOSITY QUESTION. HOW MANY HOUSES DO YOU THINK YOU
WOULD WANT TO BUILD ON THAT? >> MAXIMUM 16.
>> ITEM 10A5 IF YOU LOOK FOR IT IN YOUR AGENERAL DEAN.
THERE TALKING ABOUT HOUSES AND THE CONDITIONAL USE IS FOR MULTIUNIT. CAN YOU HELP ME SQUARE THAT UP?
>> IT'S A LOT SITUATION MANING IN AUBURN AS WE DEFINE FEE SIMPLE LOTS IT'S WHEN YOU OWN THE DIRT UNDERNEATH YOUR PROPERTY SOMETIMES WE CALL THEM CONDO PLATS AND MANY OTHER THINGS AND ATTORNEYS CALL THEM LAND CONDOS.
RIGHT NOW THEY'RE CAUGHT ON THE REGULATORY SIDE SO IT'S CALLED MULTIUNIT DEVELOPMENT BUT DEFINITELY NOT INTENDED TO BE
APARTMENTS. >> THERE'S NO THOUGHT TO ADDING A PDD LAYER OF A DIFFERENT KIND TO THIS PROPERTY TO EXPLAIN WHAT
WOULD BE DONE -- >> GREAT QUESTION.
>> I THINK OUR RESERVATION HERE IS IT'S THE BIG UNKNOWN.
WE DON'T KNOW WHERE THIS IS GOING.
>> SO THE PROBLEM IS AND ONE REASON WE'RE DOING THE PLANNED UNIT DEVELOPMENT REGULATION IS YOU NEED TEN ACRES MINIMUM TO HAVE A PLANNED DEVELOPMENT. SO THEY'RE STUCK.
THEY CAN'T GO INTO THEIR OWN PLANNING DEVELOPMENT DISTRICT BECAUSE WE DON'T ALLOW THAT. SO THAT'S WHY THEY EITHER HAVE TO EXIT OR MODIFY THIS ONE TO BE INCORPORATED AND STAFF RECOMMENDS DENIAL FOR THE SAME REASONS AND IT'S BASED ON OUR LONG RANGE PLANS AND HOW WE VIEW THIS CORRIDOR.
CERTAINLY UP TO THE COUNCIL WITH WHAT THEY WISH TO DO.
[00:55:01]
>> SO IF WE HAD PLANNED UNIT DEVELOPMENT REGULATIONS WOULD THERE BE A PLAUSIBLE DEVELOPMENT THAT THEY COULD PUT ON THE 2.4 ACRES OR WOULD WE STILL RECOMMEND DENIAL BECAUSE IT'S
RIGHT THERE? >> IT DEPENDS ON THE DESIGN.
THERE WOULD BE A LOT MORE DESIGN WE WOULD SEE AND A LOT MORE BACK AND FORTH ABOUT THINGS. PLANNED UNIT DEVELOPMENT YOU WOULD HAVE RENDERINGS AND OTHER THINGS AND YOU MIGHT BE -- THAT MIGHT BE ASKING FOR WAIVER TO SET BACKS AND THINGS LIKE THAT.
WHAT WE HAVE NOT DECIDED YET AS PART OF THAT PROCESS IS, IS THERE A MINIMUM ACREAGE? THOSE THINGS HAVE NOT BEEN DETERMINED BUT OUR GOAL WAS TO FACILITATE GOOD DEVELOPMENT IN AUBURN. THAT'S THE GOAL.
ULTIMATELY IN COLLABORATION WITH DEVELOPERS THIS IS A CHANCE FOR GIVE AND TAKE ON BOTH SIDES TO GET THE BEST PRODUCT OUT THERE AND SO UNFORTUNATELY THEY DON'T HAVE THAT OPTION RIGHT NOW.
WE'RE MONTHS AWAY FROM THAT OPTION.
>> ALL RIGHT. ANY OTHER QUESTIONS FROM THE
COUNCIL? >> MAYOR, I WOULD JUST LIKE TO SAY THAT I AGREE WITH STAFF ON THIS PARTICULAR DEVELOPMENT AND I GOT TO GO ALONG WITH THEM AND VOTE AGAINST THIS PLAN TONIGHT.
I THINK THEY'RE SPOT ON WITH THE WAY WE'RE HEADED IN THAT AREA BUT I CAN'T SUPPORT IT TONIGHT.
>> SO ITEM 10A5 BECAUSE THIS WAS NOT ADOPTED BY YOU THAT IS REMOVED FROM THE AGENDA AND I'LL REMEANED YOU AT THAT TIME BECAUSE WE CAN'T CONSIDER IF IF FOIST NOT OUT OF THE PDD.
ITEM 9 C 6 IS REQUEST TO REZONE APPROXIMATELY 13.14 ACRES OF PROPERTY LOCATED AT 2225 LEE ROAD 10 FROM RURAL TO INDUSTRIAL. THE PLANNING COMMISSION UNANIMOUSLY RECOMMENDED APPROVAL AT ITS MEETING.
UNANIMOUS CONSENT IS NECESSARY AND A PUBLIC HEARING IS
REQUIRED. >> I'LL ASK UNANIMOUS CONSENT.
>> SECOND. >> MOTION AND SECOND.
ANYONE HAVE A PROBLEM MOVING FORWARD WITH THE VOTE? SEEING AND HEARING NONE WE'LL OPEN THE PUBLIC HEARING.
PLEASE COME FORWARD AND GIVE US YOUR NAME AND ADDRESS FOR THE RECORD AND YOU HAVE FIVE MINUTES.
ANYONE HAVE COMMENTS OR QUESTIONS?
[9.d. Zoning Ordinance text and map amendments. Unanimous consent necessary. Public hearings required. ]
>> 9 D1 REQUEST FOR -- TABLES OF THE CITY OF AUBURN ZONING ORDINANCE TO CREATE THE INTERSTATE COMMERCIAL ZONING DISTRICT. UNANIMOUS CONSENT IS NECESSARY AND A PUBLIC HEARING IS REQUIRED.
A QUICK SIDE BAR THIS IS RELATIVE TO AN ITEM YOU CONSIDEREDED IN JANUARY IN THIS VICINITY.
MOTION AND SECOND. >> AT THIS TIME WE'LL OPEN THE PUBLIC HEARING IF YOU WOULD LIKE TO ADDRESS THE COUNCIL PLEASE COME FORWARD AND GIVES US YOUR NAME AND ADDRESS FOR THE RECORD AND YOU HAVE FIVE MINUTES.
>> CLOSE PUBLIC HEARING. ANY COMMENTS OR QUESTIONS FROM
COUNCIL? >> BASED OFF OF THE PERMITTED USES TABLE, BASICALLY EVERYTHING WOULD BE CONDITIONAL THAT WOULD COME BEFORE US OR IS THERE ANYTHING THAT'S PERMITTED?
>> LOTS OF THINGS ARE PERMITTED. >> OKAY.
>> MAYBE I'M READING THE TABLE WRONG.
>> IT'S BECAUSE IT SAYS HOLDING DISTRICT ABOVE IT.
THAT'S ACTUALLY THE TABLE AND I TOTALLY UNDERSTAND WHY THAT WOULD CONFUSE YOU BUT THE TABLE IN HERE IS ACCURATE TO THIS.
LOTS OF PERMITTED USES. >> OKAY. I SEE IT NOW.
>> COMMENTS OR QUESTIONS? >> IS THIS JUST FOR EXIT 50?
>> AT THE MOMENT, YES, SIR. TO ALLOW THEM TO PROCEED BUT WE TOLD YOU WE WOULD MOVE FORWARD CREATING THIS ZONE.
AND SO THIS ALLOWS AS PROPERTY DOES COME IN ON THE OTHER CORNERS OF THE INTERCHANGE TO BE CONVERTED TO THIS ZONING.
WE ATTEMPTED YEARS AGO AND HAD SOME LONG STANDING PROPERTY
[01:00:02]
OWNERS IN THE COMMIT 51 AREA THAT DID NOT WANT TO PROCEED WITH THE ZONING SO WE NEVER CREATED THE ZONE.>> WILL THE ZONE BE APPLIED TO ANY OTHER INTERSECTIONS DOWN THE
ROAD? >> HOW WE CRAFTED THIS OBVIOUSLY EXIT 50 IS GOING TO BE KIND OF THE FIRST AREA THAT WE TAKE THIS. I THINK WE DESIGNED THIS IN SUCH A WAY THAT THERE IS INTEREST IN MOVING IT UP TO SOME OF THE OTHER INTERCHANGES IT IS CERTAINLY SET UP FOR THAT BUT WE DON'T HAVE NECESSARILY ANY IMMEDIATE PLANS AT THIS POINT BUT THIS ZONE AND SOME OF THE ALLOWABLE USES AND SOME OF THE CONDITIONAL USES ARE CERTAINLY GEARED MORE TOWARDS AND MORE APPROPRIATE FOR SOME OF THESE AREAS AROUND THE EXITS AS OPPOSED TO CKD ZONING OR SOMETHING LIKE THAT.
THAT YOU'VE GOT TO GO THROUGH AND GET THESE CONDITIONAL USES TO GET A DRIVE THROUGH RESTAURANT OR A HOTEL OR SOMETHING LIKE THAT THAT IS WHAT WE WANT TO SEE AND WHAT WE WANT TO ENCOURAGE A NUMBER OF THESE INTERCHANGES.
>> SO ONLY PROPERTY OWNS CAN REQUEST THAT HE BE REZONED -- THEY BE REZONED INTO THIS DISTRICT.
>> WE CAN BRING IT FORWARD AND IT WOULD BE UP TO THE COUNCIL WHETHER OR NOT YOU WOULD AGREE TO DO THAT.
THE CITY HAS THE RIGHT TO MAKE MAP AMENDMENTS AND REZONE
PROPERTY. >> AND THE PARCEL YOU WERE JUST TALKING ABOUT EVEN THOUGH IT'S IN THE -- IT'S NOT IN THE CITY NOW IF WE ANNEXED IT, IT WOULD COME IN AS RURAL EVEN THOUGH
IT'S NOT RURAL RIGHT NOW. >> CORRECT.
AND THEN LIKELY THE STAFF RECOMMENDATION WOULD BE FOR IT TO CARRY ON TO THIS PARTICULAR ZONING.
>> YEAH. >> OKAY. AND THAT WOULD BE THE HOPE AND WE'RE VERY HOPEFUL WITH THE BUCKIES DEVELOPMENT THAT THREE OTHER CONNERS, YES, THERE IS SOME -- ROLL CALL.
>> REQUEST TO -- EXIT 50 FROM COMPREHENSIVE DEVELOPMENT DISTRICT -- THE PLANNING COMMISSION UNANIMOUSLY RECOMMENDED APPROVAL AT ITS APRIL 13TH MEETING.
UNANIMOUS CONSENT IS NECESSARY AND A PUBLIC HEARING IS
REQUIRED. >> I'LL INTRODUCE THE ORDINANCE AND ASK FOR UNANIMOUS CONSENT. ANYONE HAVE A PROBLEM MOVING FORWARD? WHOLE OPEN THE PUBLIC HEARING.
IF YOU WOULD LIKE TO ADDRESS THE COUNCIL PLEASE COME FORWARD AND HAVE YOU FIVE MINUTES.
>> SEEING NO ONE WE WILL CLOSE THE PUBLIC HEARING.
ANY COMMENTS OR QUESTIONS FROM COUNCIL?
>> I WOULD LIKE TO SAY I APPRECIATE THE STAFF'S WORK ON THIS DEAL HERE AND I APPRECIATE THE INVESTMENT FROM THE CITIZENS IN THIS AND WE'RE ABLE TO -- I THINK THIS IS A TIME WHEN LOCAL GOVERNMENT WORKED LIKE IT SHOULD.
WE WORKEDED WITH THE PERSON TRYING TO GET INTO THE CITY LIMITS AND DEVELOP DOWN THERE IN THAT AREA AND I THINK IT WENT VERY WELL AND I APPRECIATE ALL THE HARD WORK.
>> THANK YOU. >> CERTAINLY AGREE WITH YOU.
OKAY. ROLL CALL. >> YES, MA'AM.
[10.a. Conditional use approvals. Planning Commission recommendations. Public hearings required. ]
>> YES, MA'AM. >>> RESOLUTIONS.
10A1 REQUEST FOR CONDITIONAL USE -- PERFORMANCE RESIDENTIAL DEVELOPMENT WHICH IS A MULTIUNIT DEVELOPMENT BUT WHEN I SAY PERFORMANCE COMPONENT ALL YOU'RE VOTING ON THIS EVENING WOULD BE THE PERFORMANCE RESIDENTIAL PIECE. THE REST IS PERMITTED BY THE BASE ZONING DISTRICT SO IT'S A PERFORMANCE RESIDENTIAL COMPONENT OF A MIXED USE DEVELOPMENT TO INCLUDE RESIDENTIAL AND OFFICE FOR PROPERTY AT 1027 EAST GLENN

>> I WOULD LIKE TO SAY I MET THE CEO AT THE INDUSTRY EVENT AND
[01:10:05]
THEY'RE SO EXCITED TO BE PART OF THIS COMMUNITY AND IT'S NICE.THANK YOU TO THE CHAMBER FOR SETTING THAT UP AND THE IBB FOR HOSTING. IT WAS A GREAT EVENT AND A GREAT OPPORTUNITY. WE NORMALLY DON'T GET THE OPPORTUNITY TO MEET THE LEADERSHIP OF ALL OF THESE INDUSTRIES AND SO IT WAS A NICE EVENT.
VERY NICE TO MEET THE CEO AND KNOW THEY HAVE VERY POSITIVE
THINGS TO SAY ABOUT THE CITY. >> CERTAINLY THANK OUR INDUSTRIAL DEVELOPMENT TEAM FOR WHAT THERE DOING HERE.
THIS IS THEIR FIFTH PHASE AND WITH THE SUBSTANTIAL ADDITION THEY'RE MAKING WE'RE GRATEFUL THEY COULD HAVE CHOSEN TO DO THIS IN ANOTHER COMMUNITY BUT THEY'RE HUNKERING DOWN HERE WITH US IN AUBURN AND WE'RE GRATEFUL FOR THAT.
THANK THEM FOR THEIR INVESTMENT. >> ANYONE ELSE?

MOTION CARRIES. >> NOW 10A5 IS REMOVED.
>>> MOVE FOR APPROVAL. >> SECOND.
>> MOTION AND SECOND. WE'LL OPEN THE PUBLIC HEARING IF YOU WOULD LIKE TO ADDRESS THE CITY COUNCIL PLEASE COME
FORWARD. >> THERE'S NO PUBLIC HEARING.
ALL RIGHT. MOTION AND SECOND ON THIS.
I WOULD LIKE TO START OFF BY MAKING A FEW COMMENTS.
THE CITY COUNCIL HAS SPENT TIME WITH THE CITY MANAGER RECENTLY.
THIS IS THE FIRST TIME WE HAVE DONE THIS SINCE SHE WAS OFFICIALLY HIRED AND STARTED IN FEBRUARY OF 2021.
EACH COUNCIL MEMBER WAS ABLE TO SPEND A GOOD AMOUNT OF TIME WITH THE CITY MANAGER AND DISCUSS THINGS THAT WERE IMPORTANT, THINGS THAT THEY SEE AS PART OF AUBURN'S FUTURE AND HEAR FROM THE CITY MANAGER ABOUT HER GOALS AND WHAT SHE SEES ARE THINGS THAT ARE IMPORTANT FOR AUBURN'S FUTURE.
I GET THE OPPORTUNITY EVERY DAY TO BE ACROSS THE HALL FROM THE CITY MANAGER AND I SEE THE KIND OF WORK AND INVESTMENT AND COMMITMENT AND DEDICATION SHE MAKES TO ALL OF OUR CITY.
WE'RE NOT A SMALL TOWN ANYMORE. WE'RE A CITY OF OVER 80,000 CITIZENS. WE HAVE A BUDGET SHE HAS TO MANAGE AROUND $200 MILLION. THERE ARE EMPLOYEES THIS SUMMER THAT WILL TAKE US UP TO 900 EMPLOYEES WORKING FOR THE CITY OF AUBURN. IT'S A BIG JOB.
AND WE ARE A BIG TOWN AND WE'RE GROWING.
I'M PROUD THAT OVER THE LAST TWO YEARS THAT SHE HAS DONE THINGS FOR TRANSPARENCY AND COMMUNICATION I BELIEVE HAS MADE AUBURN BETTER BY ADDING AN ENCOURAGING SOCIAL MEDIA WITH PUBLIC SAFETY, THE LIBRARY, AND PARKS AND REC.
SHE HAS MANAGED OUR BUDGET WELL. WE HAVE SEEN REVENUES GROW THE LAST TWO YEARS. BUT WHEN YOU THINK ABOUT THOSE ENTERPRISE FUNDS AND OUR GENERAL FUND AND WHAT SHE HAS THE RESPONSIBILITY FOR IT'S INCREDIBLE WHAT SHE'S DONE PLANNING OUR BUDGET WHICH SHE DID AN EXCELLENT JOB.
20 EXPANSIONS. TODAY WE JUST APPROVED AN EXPANSION WITH SHINHWA. THERE'S BEEN 20 DIFFERENT EXPANSIONS THE LAST TWO YEARS. THREE NEW COMPANIES.
OVER $580 MILLION OF CAPITAL INVESTMENT AND 800 JOBS CREATED UNDER HER LEADERSHIP HERE IN THE CITY.
THINK ABOUT THE COMMERCIAL. WE HAD A RESIDENT HERE EARLIER TALK ABOUT BUCKIES AND DOWNTOWN PUBLIX.
PUBLIC SAFETY TRAINING CENTER TO ALLOW THEM TO GET TRAINED AND CONTINUE TO BE EDUCATED RIGHT HERE WHERE THEY DO NOT HAVE TO TRAVEL. SOON WE'LL BE OPENING THE PARKWAY, A VERY STRATEGIC ROAD FOR OUR COMMUNITY NAMED AFTER A HERO WHO LOST HIS LIFE PROTECTING US AND WE'RE ABOUT TO GET STARTED OR HAVE STARTED THE COMMUNITY CENTER AND THE MARTIN LUTHER KING STREET SCAPE WHICH WILL TAKE A GATEWAY ROAD INTO OUR COMMUNITY AND MAKE IT BEAUTIFUL.
THEN REALLY A GENERATIONAL PROJECT WITH THE TOWN CREEK INCLUSIVE PARK. ALL OF THESE THINGS HAVE EITHER BEEN STARTED OR BUILT UNDER HER LEADERSHIP.
SHE'LL BE THE FIRST TO TELL YOU SHE HAS NOT DONE ALL THIS ON HER OWN. SHE HAS AN OUTSTANDING STAFF AND THAT WORKS HARD FOR HER. THEY HAVE STAFF THAT WORK HARD FOR THEM. AT THE TEND OF THE DAY THE BUCK STOPS WITH HER. SHE'S DONE AN OUTSTANDING JOB.
HER PRESENT SALARY WAS $215,000 AND I HAVE RECOMMENDED TO THE CITY COUNCIL AND WILL ASK THEM TONIGHT TO APPROVE A RAISE FOR
[01:15:02]
HER TO MAKE $250,000. SHE HAS EARNED EVERY BIT OF IT.WE DID NOT GET HER A RAISE LAST YEAR.
DID NOT CONSIDER HER PERFORMANCE AND THIS IS BASED ON 27 MONTHS OF WORK OF PROVEN EFFORT AND PROVEN LEADERSHIP FOR OUR COMMUNITY. AUBURN'S CHANGING.
WE'RE ADDING SEVEN PEOPLE A DAY IS WHAT WE WOULD SAY TO YOU.
THERE IS MORE THINGS COMING DOWN THE PIKE AND IT TAKES DETERMINED LEADERSHIP TO GET AUBURN IN THE RIGHT DIRECTION AND KEEP US MOVING IN A PATHWAY FORWARD AND I'M CONFIDENT THAT MEGAN CROUCH IS THE PERSON TO DO THAT. ANY OTHER COMMENTS FROM THE COUNCIL?
>> MR. MAYOR, KIND OF AN AWKWARD THING BECAUSE A YES VOTE INDICATES THAT WE AGREE WITH THE MAYOR'S TERMS FOR THE CONTRACT MODIFICATION. FOR REASONS THAT I'VE CONVEYED TO BOTH THE MAYOR AND THE CITY MANAGER, I DO NOT AGREE WITH THE TERMS OF THE AMENDMENT. SO A YES VOTE INDICATES I WOULD AGREE BUT A NO VOTE INDICATES I DON'T HAVE CONFIDENCE IN THE CITY MANAGER AND THAT ALSO IS NOT TRUE.
I DO HAVE THE UTMOST CONFIDENCE IN OUR CITY MANAGER AND I THINK SHE'S DONE A WONDERFUL JOB. SO IF YOU CAN'T AGREE WITH EITHER SIDE YOU'RE ALLOWED TO ABSTAIN.
THAT IS MY INTENT FOR THIS VOTE.
>> THANK YOU, I APPRECIATE YOUR HONESTLY AND FORTH RIGHTNESS.
>> YES. I APPRECIATE YOUR LEADERSHIP.
MEGAN, IT'S BEEN A PLEASURE WORKING WITH YOU.
I'VE ALWAYS FOUND YOU TO BE JUST ON OUR PERSONAL INTERACTIONS AS COUNCIL MEMBER TO A CITY MANAGER YOU'VE ALWAYS BEEN REALLY AN EFFICIENT PROFESSIONAL, PROMPT, THOROUGH WITH ALL THAT YOU HAVE DEALT WITH ME BECAUSE I'VE GOT A TON OF QUESTIONS STILL BEING RETIFFLY GREEN TO THIS -- RELATIVELY GREEN TO THIS GIG AND I AM AN ENTHUSIASTIC SUPPORTER OF YOUR LEADERSHIP AND I'LL BE ENTHUSIASTICALLY SUPPORTING THIS PROPOSAL.
>> THANK YOU. >> I'LL ECHO THAT.
I'M EVEN GREENER THAN YOU, BOB, AND MEGAN HAS DONE A WONDERFUL JOB IN THE TIME THAT I'VE BEEN HERE AND WE'RE VERY APPRECIATIVE AND TO HAVE SOMEBODY WITH A LONG STANDING TENURE WITH OUR CITY BRINGS A UNIQUE PERSPECTIVE AND WE'RE VERY FORTUNATE TO HAVE THAT BACKGROUND THAT YOU PROVIDE AND SERVICE TO OUR CITY.
THANK YOU FOR ALL YOU DO. >> I WILL SECOND THAT.
MY SHORT TIME HERE YOUR LEVEL OF PROFESSIONALISM HAS EXCEEDED MY EXPECTATIONS. I WANT TO SAY THANK YOU FOR THAT AND THAT I THINK IT'S VERY MUCH IN LINE WITH WHAT YOUR COUNTERPARTS IN OTHER PARTS OF THE STATE ARE MAKING AND I THINK THAT THE SHORING UP YOUR SALARY TO BE MORE IN LINE WITH WHAT
[01:20:01]
CITIES OF OUR SIZE AND EVEN CITIES WHO ARE SMALLER THAN US.IT'S THE RIGHT THING TO DO TO GET YOU TO WHERE YOU'RE MORE BALANCED IN YOUR COMPENSATION TO OTHER CITIES IN THE STATE OF
>> IF I MAY, I WOULD LIKE TO SAY HOW MUCH I APPRECIATE THE JOB YOU DO, MEGAN. I'M WORKING ON 36TH YEAR SERVING AUBURN AND I'VE SEEN WHAT CAN HAPPEN TO THE CITY AND THE CITY EMPLOYEES IN PARTICULAR. WHEN HAVE YOU A CITY MANAGER MAYBE YOU'RE NOT QUITE ON TOP OF YOUR GAME.
YOU'RE CERTAINLY ON TOP OF YOUR GAME.
I DON'T AGREE WITH EVERYTHING YOU DO BUT IT WOULD BE A PROBLEM IF I DID AGREE WITH EVERYTHING YOU DO.
YOU WORK HARD AND CARE ABOUT YOUR FOLKS AND THOSE TWO THINGS GET YOU A LONG WAY. I GUESS IT ALL COMES DOWN TO FINANCE AND THE CITY RUNS WELL AND YOU KEEP A TIGHT REIGN ON THE MONEY AND I APPRECIATE THAT. -- REIN ON THE MONEY AND I APPRECIATE THAT. I WATCHED YOU MATURE AND GROW UP THROUGH THE PROCESS HERE IN THE CITY OF AUBURN.
YOU ARE UNIQUELY QUALIFIED TO BE IN THE POSITION YOU'RE IN SO I HOPE YOU'LL BE WITH US A LONG TIME TO COME AND I'M GLAD TO HAVE YOU AS OUR CITY MANAGER AND IF YOU RUN INTO A PROBLEM CALL ME AND ASK ME. I'M GLAD TO ANSWER YOUR QUESTION. I'M JUST KIDDING ON THAT.
I DO APPRECIATE YOUR WORK AND APPRECIATE KELLY'S COMMENTS.
I ADMIRE HIM FOR WHAT HE SAID AND IT'S VERY WELL PUT.
>> THANK YOU. WE DO HAVE A MOTION AND SECOND
SO ALL IN FAVOR PLEASE SAY AYE. >> AYE.
>> ANY OPPOSED? >> ONE ABSTENTION.
>> IF I MAY, THANK YOU. IT'S AN HONOR AND PRIVILEGE TO SERVE THE CITIZENS OF AUBURN. I'M ONLY AS GOOD AS THE GREAT PEOPLE WORKING WITH THE CITY OF AUBURN AND ALL OF THEM ARE IMPORTANT TO ME IN EVERYTHING THAT THEY DO AND I WAKE UP EVERY DAY WORRIED ABOUT THEM AND NOT ABOUT THEM DOING THEIR JOB JUST TO PROTECT THEM AND GIVE THEM WHAT THEY NEED TO SERVE THE CITIZENS SO WE'RE FORTUNATE IN AUBURN.
THIS IS A GREAT COMMUNITY AND I'M VERY FORTUNATE TO BE AT THE HELM OF THIS COMMUNITY. THANK YOU VERY MUCH.
[10.c. Vacation. NEOH Holdings, LLC and North of Harper Ave, LLC. The Boulevard Development. Public hearing required.]
MOVING ON. ITEM 10 C AUTHORIZES THE NORTHERN PORTION OF THE UNUSED ALLEY ON HARPER AVENUE AND FURTHER AUTHORIZES THE PAY I DON'T AND CITY MANAGER TO EXECUTE A QUICK CLAIM DEED.A PUBLIC HEARING IS REQUIRED. >> MOVE FOR APPROVAL.
>> SECOND. >> MOTION AND SECOND.
AT THIS TIME WE WILL OPEN THE PUBLIC HEARING.
IF YOU WOULD LIKE TO ADDRESS THE CITY COUNCIL PLEASE COME FORWARD AND GIVE YOUR NAME AND ADDRESS FOR THE RECORD.
SEEING NO ONE WE'LL CLOSE THE PUBLIC HEARING.
COMMENTS OR QUESTIONS FROM COUNCIL?
>> IF I MAY, I WENT OUT THERE AND LOOKED AT THIS, THE PORTION THAT IS UNDER CONSIDERATION IS ALREADY BUILT UPON.
THERE'S A RETAINING WALL AND POSSIBLY EVEN ENCROACHMENT BY A DWELLING. AND THAT'S A LITTLE PRESUMPTIVE
I THINK. >> IT IS AN EXCELLENT QUESTION.
WHAT HAPPENED IS THERE'S AN INDEMNITY AND HOLD HARMLESS AGREEMENT ALLOWING THEM BECAUSE THIS PORTION OF THE ALLEY WAS UNUSED TO PROCEED. SHOULD THE COUNCIL AND I VERY MUCH RESPECT WHAT YOU'RE SAYING ABOUT BEING PRESUMPTUOUS, SHOULD THIS NOT BE APPROVED TONIGHT THE IMPROVEMENTS HAVE TO BE REMOVED BUT THEY HAD LEGAL DOCUMENT PERMISSION TO DO THE WORK THEY'VE DONE. MR. NELSON CAN BRING UP A MAP.
IT'S THE LAST ITEM, THAT WILL SHOW YOU WHAT COUNCILMAN NORMAN IS RIVERING TO TO THE -- REFERRING TO.
SO THE BLUE COLORED AREA IS THE ALLEY THAT IS BEING REQUESTED VACATION AND IF YOU LOOK AT THE SOUTHERN SIDE OF THE LOWER SIDE THERE'S A TOUCH OF A BUILDING THAT WOULD GO INTO IT.
THE REST IS PARKING. FURTHER SOUTH THE ALLEY CANNOT BE ABANDONED. THE ADJOINING PROPERTY OPENER WAS NOT INTERESTED IN THAT HAPPENING AND IT IS NOT MY PREFERENCE THAT WE DO PROJECTS IN THIS MANNER WITH AN ENDELL ANITY AND HOLD HARMLESS BUT WHEN THIS ALLEY IS WHOLLY ENCOMPASSED BY THEY ARE THE PROPERTY OWNER THE REASON WE ALLOWED THAT TO HAPPEN ALWAYS WITH THE CAVEAT THAT IF THE COUNCIL DOESN'T APPROVE THIS, YOU'RE AT YOUR OWN RISK.
YOU KNOW. WE HAVE NO -- THE CITY HAS NO RISK. THAT IS THE ONLY REASON IT WAS ALLOWED TO GO ON THIS WAY. I UNDERSTAND THE QUESTION AND
[01:25:06]
WHY YOU'RE ASKING THAT. >> SO THE PROCESS JUST GOT AHEAD
THEY WERE GIVEN PERMISSION BY THE STAFF TO DO SO.
>> IS THAT A REGULAR OCCURRENCE? >> NO, IT IS NOT A REGULAR OCCURRENCE AND AS A MATTER OF FACT IT WON'T BE HAPPENING MOVING FORWARD UNLESS I HAVE CERTAIN ASSURANCES AND I'LL LET YOU KNOW WHEN WE DO SO COUNCILMAN NORMAN RIGHTFULLY POINTED OUT THAT CONSTRUCTION WAS UNDERWAY ON THIS AND IT'S NOT OUR INTENT TO BE PRESUM WHICH YOUOUS WITH THE COUNCIL -- PRESUMPTUOUS WITH THE COUNCIL. THE REASON STAFF RECOMMENDED WE DO THIS IS BECAUSE THE DEVELOPERS IN QUESTION WHOLLY SURROUNDED -- SO THE ALLEY WASN'T NOR THE USE OF ANYONE ELSE IT WAS ONLY FOR THIS DEVELOPMENT.
AND THE CITY HAS NO REASON TO WANT TO OWN OR MAINTAIN IT SO THAT IS WHY WE AGREED TO ALLOW THIS BUT, AGAIN, ALL DOCUMENTS IF YOU DON'T APPROVE IT TELL THEM THEY'LL HAVE TO TAKE THE IMPROVEMENTS OUT AND RETURN IT TO ITS ORIGINAL STATE.
>> IT APPEARS THAT THE RETAINING WALL GOES DOWN TO HARPER.
>> THERE WOULD BE A RETAINING WALL IF YOU'RE LOOKING FURTHER SOUTH AND SEE DASHED LINES, IT WOULD BE ON THEIR PROPERTY.
IT WOULD NOT BE ON THE ALLEY PROPERTY.
DOES THAT MAKE SENSE TO YOU? >> SURE.
I GUESS THAT WAS MY QUESTION. ON THE PROPERTY THAT WOULD BE
WEST ON THE WEST SIDE. >> THAT WOULD BE ON THEIR
PROPERTY ON THE WEST. >> THE DEVELOPER'S PROPERTY AND CERTAINLY NOT THE ALLEY. THE ADJOINING PROPERTY OWNER TO THE SOUTH WAS VERY CLEAR THAT THEY WERE NOT INTERESTED IN SEEING THE ALLEY ABANDONED SO THEREFORE IT IS NOT ABANDONED.
THE GOOD NEWS FOR THEM IS WITH THE BUILDING GOING THERE I DON'T KNOW CITY ENGINEER FRAZIER IS THAT A DRIVEWAY OR JUST GOING TO BE BLOCKED BY THE BUILDING? I DON'T KNOW FINGERPRINT ANYBODY IS GOING TO -- I DON'T KNOW IF ANYONE IS DRIVING DOWN THE ALLEYWAY.
>> I WAS GOING TO ADD THAT ALL IN FAVOR PLEASE SAY AYE.
MOTION CARRIES. >>> THOSE ARE ALL THE ITEMS OF
[12. CITIZENS’ OPEN FORUM.]
BUSINESS FOR YOU THIS EVENING. >> AT THIS TIME CITIZENS OPEN FORUM. THIS IS YOUR OPPORTUNITY TO SPEAK TO THE COUNCIL ABOUT ANYTHING THAT MIGHT BONN YOUR MIND. WE ASK THAT YOU PLEASE ADDRESS YOUR COMMENTS TO THE COUNCIL AND YOU HAVE THREE MINUTES TO SPEAK.
>> I NEVER BOXED OR ANYTHING BUT I FELT LIKE I WAS GETTING PUNCHED WITH THE PDD AND THE CDD.
GOOD EVENING MAYOR, COUNCIL. I WANT TO TALK ABOUT FREEDOM OF CHOICE. WILL THIS AUBURN CITY COUNCIL GIVE ITS CITIZENS BACK THEIR FREEDOM OF CHOICE, PROPERTY RIGHTS, AND CONSTITUTIONAL RIGHTS BY ALLOWING THEM TO RESOLVE THEIR OWN ISSUES AND PERSONAL PROBLEMS OR WILL IT CONTINUE ON THE SAME PATH AS PAST AUBURN CITY COUNCILS? FIRST, AUBURN COUNCIL IN 1999 PASSED THE VERY DISCRIMINATORY FAMILY DEFINITION ORDINANCE AGAINST AUBURN CITIZENS AND OTHERS FROM PURCHASING HOMES BY RESTRICTING WHO STAYS IN THEIR HOME IN CERTAIN ZONES. SECOND, 32 YEARS LATER, THE AUBURN CITY COUNCIL EXPANDED THEIR 1999 RESTRICTION BY PASSING THE ORDINANCE 3288 IN 2021.
NOT ALLOWING 121 FAMILIES TO HAVE GUESTS IN THEIR HOME AND PROVIDING BENEFITS TO THOSE FAMILIES AND PROVIDING A NEEDED TO VISIT ALUMNIS AND OTHER ESPECIALLY DURING THE EXTREME DEMAND PERIOD SUCH AS THE AU FOOTBALLS AND GRADUATION.
THIRD, THIS IS GOING TO BE UNUSUAL.
BUT NOW THERE'S ANOTHER ISSUE ON THE HORIZON.
MOMUNE. WHAT THAT IS, IS A SHARING LIVING ARRANGEMENT. USUALLY INVOLVING SINGLE MOTHERS WHERE THEY PULL THEIR TIME -- POOL THEIR TIME EFFORT AND MONEY TO ASSIST IN THE MAINTENANCE OF THEIR HOUSEHOLD AND RAISING OF
[01:30:01]
CHILDREN. IN THE UNITED STATES 80% OF SINGLE PARENTS ARE MOTHERS COMPRISIING OVER 8 MILLION PEOPE BUT THE CITY OF AUBURN TELLS SINGLE MOTHERS THEY CAN ONLY LIVE IN CERTAIN AREAS OF AUBURN IF THEY HAVE AN MOMUNE SITUATION. THESE SINGLE MOMS WILL BE TREATED AS JUST AS IF -- SO IF TWO SINGLE MOTHER FAMILIES JOIN THEIR RESOURCES AND LIVE IN THE SAME HOUSE -- THE CITY OF AUBURN WILL SAY NO WAY.DO YOU AS A COUNCIL NOW UNDERSTAND HOW BUILDING ON THE COUNCIL OF 1999, THE COUNCIL OF 2021, AND POSSIBLY 22-23, 2024 THAT POOR DECISIONS WILL JUST GET MORE COMPLICATED.
FREEDOM OF CHOICE SOMETIMES IS DEAD IN AUBURN.
>> WHO WILL BE NEXT? WE'LL CLOSE THE CITIZENS OPEN FORUM.
ANYTHING ELSE FROM THE COUNCIL? >> MOVE TO ADJOURN.
>> I HAVE A COMMENT. I JUST WOULD LIKE TO POINT OUT WE'VE BEEN CRITICIZED QUITE A BIT UP HERE ABOUT RIGHTS AND THIS AND THAT. ACCORDING TO STATE LAW WE HAVE NO REQUIREMENT WHATSOEVER TO HAVE CITIZENS COME UP AND ADDRESS THE CITY COUNCIL UNLESS IT'S FOR A PUBLIC HEARING.
THE PRIOR COUNCIL AND THIS COUNCIL TOOK IT UPON THEMSELVES TO PROVIDE TWO OPPORTUNITIES THROUGHOUT OUR AGENDA FOR THE PUBLIC TO COME UP AND ADDRESS THINGS.
SO IF ANYTHING WHEN PEOPLE CRITICIZE US FOR DENYING OR EMPEEDING THEIR AMENDMENT ONE FIRST AMENDMENT RIGHTS, WE HAVE GONE TESTIMONY OPPOSITE DIRECTION.
WE HAVE PROVIDED TWO OPPORTUNITIES WHEREAS BY LAW WE DON'T HAVE TO PROVIDE ANY. SO I WOULD JUST LIKE TO SAY THAT WE HEAR PEOPLE COMING UP WEEK IN AND WEEK OUT AND THAT'S FINE.
THEY HAVE THEIR TIME. WE'RE HAPPY TO PROVIDE TIME AT THE POTS YUM TO MAKE YOUR COMMENTS BUT PLEASE UNDERSTAND WE HAVE GONE OUT OF OUR WAY TO ALLOW PUBLIC COMMENT.
>> ALL RIGHT. NIP
