I MENTIONED LAST TIME WE MET THE ALABAMA LEAGUE OF MUNICIPALITIES WAS HERE A COUPLE WEEKS AGO TO HOLD THEIR QUARREL MEETING.

MYSELF AND MAYOR GARY FULLER HOSTED THEM AND IT WAS GREAT TO SHARE MEALS WITH ALABAMA MUNICIPALITY BOARD IN OUR COMMUNITY AND GIVE THEM A TOUR OF AUBURN AND I WAS VERY PROUD OF THAT OPPORTUNITY TO SHOW OTHER MAYORS FROM AROUND OUR STATE WHAT WE ARE DOING IN TOWN. TONIGHT FINISHING NIGHT OUT OUR POLICE DEPARTMENT CONDUCTED WITH MEMBERS OF THE COMMUNITY AT HERITAGE PARK AND HOPE THAT GOES WELL AND APPRECIATE THEIR EFFORTS TO DO THAT. THE CHEERS EVENT WENT OFF A COUPLE WEEKS AGO. IT DID GET RAINED ON ABOUT HALFWAY THROUGH WITH A LOST LIGHTNING BUT I APPRECIATE EVERYBODY'S EFFORT TRYING TO MAKE THAT GO FORWARD AND THE PREPARATION FOR THAT TONIGHT WE WILL ANNOUNCE A BOARD VACANCY FOR THE LEE COUNTY COMMUNITY CENTER A SPOT THAT'S BEEN HELD BY TRAYCE ROBERTS THE WIFE OF AUBURN UNIVERSITY PRESIDENT CHRIS ROBBETS. OVER THE YEARS THAT SPOT ON THE BOARD HAS BEEN HELD BY THE FIRST LADIES OF AUBURN UNIVERSITY AND I HAVE TALKED TO TRACY AND SHE HAD WOULD LIKE TO APPLY TO BE RENOMINATED AND CONTINUE TO WORK WITH COUNTY YOUTH DEVELOPMENT SHEZ PASSIONATE ABOUT THE WORK OF LAURA COOPER AND HER STAFF OUT THERE SO WE CERTAINLY HOPE THE COUNCIL WILL BE FAVORABLE TOWARD REAPPOINTING MISS ROBERTS.

LEE COUNTY IS CONDUCTING THEIR KICKOFF TOMORROW AND START THEIR FUND-RAISING UNITED WAY DOES AND OUTSTANDING JOB AND I WOULD ASK ALL TO CONSIDER SUPPORTING UNITED WAY.

BEFORE WE GET BACK TOGETHER ON THE 15TH SCHOOL WILL HAVE STARTED AND I REMIND COMMUNITY TO PLAN AHEAD FOR THAT FIRST WEEK OF SCHOOL. IT'S ALWAYS A LITTLE HAIRY AS WE GET USED TO MORE CARS SCHEDULES AND SCHOOL BUSES ON ROADS AND PLAN AHEAD AS YOU PREPARE TO GO ABOUT YOUR LIFE.

>> YESTERDAY I HAD THE HONOR OF PRESENTING A PROCLAMATION TO AMBROSE E. HANSEN WHO TURNED 100 YESTERDAY, WE DECLARED YESTERDAY AMBROSE E. HANSEN DAY AND HIS WHOLE FAMILY WAS THERE.

HOPE STEVE IS LISTENING. >> I'M SURE HE IS.

>> ANYONE ELSE? >> YES, MR. MAYOR.

>> PLEASE. >> I'D LIKE TO TURN TO FIREFIGHTER SORENSON. MANY OF YOU MAY NOT KNOW THAT BUBBA ALSO SERVED THIS COMMUNITY IN A VOLUNTEER ROAD WITH A FARM BILL VOLUNTEER FIRE DEPARTMENT AND SOUTHWEST AND HE LIVED AND BREATHED FIREFIGHTING. HE WAS A GRADUATE OF THE AUBURN CITY SCHOOLS. HE ALSO HAD THE DISTINCTION OF BEING ALABAMA'S STRONGEST MAN. HE COMPETED IN ALL SORTS OF STRONG MAN COMPETITIONS. HE WAS AN EXTRAORDINARY FIGURE IN OUR DEPARTMENT. HE REALLY WAS THE HEARTBEAT OF US, 27 HE WENT TO SCHOOL MY SON, CHRISTOPHER, AND I APPRECIATE YOUR KIND WORDS. HIS FUNERAL WILL BE SATURDAY.

[7. CITY MANAGER’S COMMUNICATIONS.]

WITH US. SEEING NO ONE, WE WILL MOVE AHEAD. CITY MANAGERS COMMUNICATIONS.

>> CITY MANAGERS COMMUNICATIONS I'M GOING TO ANNOUNCE AGAIN WE HAVE ONE VACANCY ON THE YOUTH DEVELOPMENT.

CENTER FOR THE TERM OUR FIRST ITEM OF BUSINESS CONSENT AGENDA.

DOES ANYONE WANT TO REMOVE AND ITEM AND DEAL WITH IT

INDIVIDUALLY? >> YES, ITEM 8-C-1.

8-C-6, 8-C-7, 8-C-9. >> ANYTHING ELSE?

>> I'D LIKE TO REMOVE ITEM 8-C-2.

>> YES, MAN. >> 8 CHARLIE, 5.

[8.c.1. Alabama Power Company. Lighting Services Agreement. Boykin‐Donahue Campus Project. $112,486. ]

>> CITY MANAGER WILL TAKE THESE IN NUMERICAL ORDER.

>> ITEM 8 CAREY 1 AUTHORIZE LIGHTING.

>> APPROVAL. >> SECOND.

>> MISS TAYLOR. >> YES.

THE ONLY REASON WHY I TOOK THIS ONE OFF THE CONSENT AGENDA IS I

[00:15:02]

JUST WANT THE PUBLIC TO UNDERSTAND THAT THIS LIGHTING SERVICE AGREEMENT AT THE BOYKIN-DONAHUE IS TO INCREASE THE LIGHT AROUND BOYKIN AND THE NEW BOYKIN EXPANSION AND IT'S

TEMPORARY LIGHTING. >>, NO IT'S THE PERMANENT

LIGHTING IN THE NEW SECTION. >> OH, IT'S PERMANENT.

>> I MEANT PERMANENT. IT'S PERMANENT LIGHTING BUT IT'S ALSO FOR THE LIGHTING IMPROVEMENT IN THAT AREA JUST

FOR THE NEW. >> CORRECT.

>> EXPANSION. >> I GUESS I GOT A LITTLE CONFUSED IN OUR PACKET. I WAS THINKING IT WAS THAT

ENTIRE AREA. >> SO THIS PARTICULAR CONTRACT IS FOR 16 BIG OVERHEADLIGHTS. THERE WILL BE OTHER LIGHTING IN THE WALK WAYS THAT GO BETWEEN THE NEWER PHASE AND THE ORIGINAL SCHOOL KNOWN AS BOYKIN COMMUNITY CENTER WE CALL PEDESTRIAN LIGHTING AND THAT'S BUILT INTO THE OVERALL BID CONTRACT WHETHER WE GET TO THAT. THESE ARE BIG OVERHEADLIGHTS THAT GO IN PARKING LOTS. WALKING BACK AND FORTH BETWEEN THE TWO BECAUSE WE WILL HAVE ACTIVITY ESPECIALLY WINTERTIME WHERE THE SUN GOES DOWN EARLIER AND THERE WILL BE LIGHTING ON LOWER LEVEL FOR THE WALKWAY SO THIS IS BEGINNING OF LIGHTING.

>> [INDISTINCT]. >> NO, MA'AM THAT WILL GO IN THE OVERALL BID FOR THE LIBRARY AND SITE PACKAGE AND OTHER THINGS WE

ARE DOING. >> MR. MAYOR.

>> PLEASE. >> I OVERLOOKED ONE.

IS IT TOO LATE TO WITHDRAW? >> WE WILL COME BACK TO YOU ABOUT THIS. ANY OTHER QUESTIONS OR COMMENTS

ON 8-C-1? >> MOTION SECOND ALL IN FAVOR

AYE. >> AYE.

[8.b. Concurrence. INICS Battery Solutions Corp. 2585 Innovation Dr. Auburn Technology Park West. ]

>> ANY OPPOSED THAT MOTION CARRIES.

YES, SIR. >> [INDISTINCT].

>> CAN YOU GO BACKWARDS. >> THAT IS AT THE DISCRETION OF

THE COUNCIL. >> MOVE BACK.

SO WE WILL GO 8-B. >> ITEM 8-ABOUT CONCURS THE ACTION OF DANGEROUS TRILLION DEVELOPMENTAL . . . WHICH WILL GENERATE INITIAL CAPITAL INVESTMENT OF $14 MILLION AND

CREATE 30 JOBS. >> WE GOT A MOTION TO SECOND.

MR. MOREMAN. >> YES.

SOME OF THESE WILL BE NEW GUY QUESTIONS AND COMMENTS BUT I UNDERSTAND THE PROPERTY IS PROVIDED TO NX THROUGH A PREPAID CAPITAL LEASE WHICH WAS A NEW CONCEPT FOR ME.

WHAT HAPPENS WHEN NX NO LONGER CONTINUES THEIR BATTERY

OPERATION? >> SO, TO CLARIFY A COUPLE OF THINGS THIS IS A CONCURRING RESOLUTION OF THE ACTIONS OF THE INDUSTRIAL DEVELOPMENT BOARD SO THE CITY IS NOT GIVING ANYTHING WAY. THE INDUSTRIAL DEVELOPMENT BOARD IS ENTERING INTO THIS LEASE AND A PREPAID CAPITAL LEASE IS A LEASE IN WHICH FOUR TO RECEIVE WE CALL EIGHT STATE INDUSTRIAL DEVELOPMENT GRANT IT NEEDS TO BE IN THE NAME OF THE INDUSTRIAL DEVELOPMENT BOARD SO THIS IS CONCURRING FOR THE INDUSTRIAL BOARD TO ENTER INTO A LEASE WITH THE COMPANY WHO IS GOING TO INVEST OVER $12 MILLION IN A BUILDING ON THE PROPERTY TO LEAVE IT IN THE NAME OF THE BOARD UNTIL SUCH TIME . . . THEY

QUIT EXPANDING. >> SO, IN SUMMARY AFTER A NUMBER OF YEARS, THE LAND IS DEEDED TO THE BUSINESS FOR A NOMINAL FEE?

>> CORRECT. >> HAVE WE RECEIVED COMPLAINTS OVER THE PAST 40 YEARS THIS POLICY HAS BEEN VIEWED AS UNFAIR TO OTHER BUSINESSES WHO AREN'T AWARDED LAND?

>> I DON'T HAVE MR. DUNLAP OUR ECONOMIC DEVELOPMENT DIRECTOR GIVE MORE HISTORY ON THAT BUT IN MY 25 YEARS OF TENURE THIS IS A COMMON OCCURRENCE AND PHIL YOU CAN USE THAT MICROPHONE.

THIS IS COMMON IN INDUSTRIAL DEALS, YOU'RE TALKING ABOUT A LITTLE LESS THAN $200,000 WORTH OF PROPERTY FOR A $14 MILLION INVESTMENT THAT WILL GROW AND GROW HAND GROW SO WE LOOK AT IT FROM RETURN ON INVESTMENT STANDPOINT.

OUR COLLEAGUES AROUND THE STATE GIVE AWAY PROPERTY AND LOT MORE THAN THE INDUSTRIAL DEVELOPMENT BOARD DOES BUT TO BE IN THE GAME THIS IS NORMAL OCCURRENCE IN INDUSTRIAL I ALSO SAY THERE ARE TIMES WHEN WE DON'T DO THIS FENDING ON WHAT THE COMPANY IS DOING AND OUR RETURN THERE ARE TIMES PROPERTY IS SOLD TO COMPANIES. IT REALLY GENDZ ON THE DEAL.

MR. DUNLAP. >> FIRST ANSWER YOUR QUESTION I'VE BEEN 39 YEARS AND MY TENURE HERE NO ONE HAS ASKED ME THAT

[00:20:05]

QUESTION. NOW IF THEY HAD I WOULD HAVE ANSWERED THE QUESTION AS THESE ARE BUILT IN INDUSTRIAL PARKS ONLY SPECIFICALLY TARGETING PEOPLE WITH THE CORRECT NX CODES IN THE THE OLD DAYS IT HAD TO BE INDUSTRY SIC CODE SO THE STATE DOESN'T DO ENABLING LEGISLATION FOR TAX ABATE MEANTS FOR SOMEONE TO BUILD A RESTAURANT. YOU CAN DO THAT.

WE MADE A DECISION YEARS AGO UTILIZING 772 WE WOULD NOT USE THAT LACK OF INCENTIVE FOR INDUSTRIAL, SO ONE OF THE KEY LOCAL INCENTIVES THAT WE CAN PREPARE AND WE CAN UTILIZE IN RECRUITING, IS THE LOT. THE LOT IS OBVIOUSLY IT ULTIMATELY WILL CONVEY TO THE OWNER OF THE BUILDING BUT WHEN YOU LOOK AT THE TOTAL ININVESTMENT OF THAT COMPANY THE FACT THEY'RE CREATING JOBS THE FACT THAT BASIC INDUSTRY IS WHAT DRIVES THE ECONOMY, IF WE DON'T RECRUIT INDUSTRIAL JOBS AND WE DON'T HAVE RESTAURANTS TO GO TO, WE DON'T HAVE ANY NICE STORES TO GO VISIT BECAUSE WE NEED THOSE TO CREATE WEALTH AND CREATE JOBS THAT DRIVE THE LOCAL ECONOMY. ALL THOSE THINGS ARE HAND AND HAND GOING TOGETHER. WE ARE VERY SELECTIVE AND WE DO A PRETTY NICE JOB OF EVALUATING WHETHER A COMPANY IS A GOOD FIT FOR US OR NOT, AND I CAN TRUTHFULLY SAY TO YOU AS MEGAN SAID, WE SOMETIMES DO MIGHT BE AN OPERATING LEASE OR CAPITAL LEASE AND WE SELL PROPERTY. IT DEPENDS ON LOOKING AT EACH INDIVIDUAL PROJECT DOES IT MAKE SENSE IN THIS PARTICULAR CASE TO RECRUIT THIS. I WILL ADD, THIS PIECE OF POSITION FOR YOU IF WE SAID TONIGHT WE WANT THE BOARD NEVER TO DO THAT AGAIN, LET'S JUST QUIT DOING INDUSTRIAL RECRUITING BECAUSE YOU'RE NOT GOING TO BE GIVE BECAUSE I JUST BACK FROM

EDAA. >> TELL US WHAT THAT IS.

>> ECONOMIC DEVELOPMENT ASSOCIATION ALABAMA SO I DID MY SURVEY DOWN THERE AND I TALKED TO 10 OR 11 DIFFERENT CITIES.

LET'S SEE. HOW MANY DO WHAT WE DO? DON'T DO WHAT WE DO? ZERO.

THEY ALL DO THAT. SO TO BE COMPETITIVE THIS IS ONE OF THE FEW THINGS CAN YOU DO FROM A LOW CASUALTY TO HELP PUT TOGETHER A PROPER INCENTIVE PACKAGE TO WIN.

THAT'S THE ANSWER TO YOUR QUESTION.

>> SO WE INVEST IN THESE COMPANIES.

WE MAKE CONSCIOUS DECISIONS TO SOLVE PROBLEMS TO ATTRACT PEOPLE AND WE HAVE GIVE AND TAKE HOW WE DO THAT, BUT WE MAKE AN INVESTMENT HERE LIKE WE WOULD MAKE IN A TAKES ABATEMENT.

THAT'S A TOOL THAT WE USE. >> CORRECT.

AS A MATTER OF FACT I USED TO TEACH AT THE UNIVERSITY AND GRADUATE SCHOOL AND MY PART OF THE CLASS WAS UTILIZING TOOLS IN A TOOLBOX. IT'S A DID DIFFERENT CATEGORY THAN DOING COMMERCIAL DEVELOPMENT.

COMMERCIAL GEFLS THE PRINCIPLES ARE THE SAME BUT RECRUITING INDUSTRY NEVER FORGET WHO ARE OUR COMPETITORS IN RECRUITING INDUSTRY. EVERY CITY IN THE STATE.

EVERY CITY IN GEORGIA SOUTH CAROLINA WE RECRUIT AT STATES.

WE EVEN RECRUIT AGAINST COUNTRIES.

I'VE ACTUALLY BEEN UP AGAINST MEXICO, SOUTH AMERICA AND OUR FRIENDS TO THE NORTH, CANADA SO, YOU DON'T THINK ABOUT IT THAT WAY, THAT ONE SMALL CITY WOULD COMPETE IN A GLOBAL ENVIRONMENT BUT WE ARE COMPETING IN A GLOBAL ENVIRONMENT.

OUR SISTER CITY AS WELL KMEETS INTERNATIONALLY.

WE ARE ALL IN THE SAME BOAT. WHAT CAN WE DO TO SET OUR SELF APART TO WIN THIS PROJECT AND MAKE SURE THE PACKAGE WE PUT TOGETHER WINS? ONE THING I CAN ASSURE YOU THE INDUSTRIAL BOARD ALWAYS LOOKS TO MAKE SURE WHATEVER DEAL WE DO IS GOING TO GENERATE JOBS AND TAXES FOR THIS COMMUNITY AND IT'S GOING TO BE PROFITABLE. THIS DEAL, THE BIG WINNER AS ALWAYS ARE THE PUBLIC SCHOOLS. IF YOU LOOK AT THESE NUMBERS, WHEN YOU LOOK AT T ABATEMENT ABATEMENTS.

THOSE WOULD ALLOW US TO ABATE EVERYTHING INCLUDING SCHOOL TAXES. ONE OF THE FIRST THINGS IS I

[00:25:06]

RECOMMENDED THAT WE DON'T ABATE SCHOOL TAXES.

I'VE NOT SEEN A COMPANY YET THAT THINKS THEY SHOULD BALANCE THEIR BUDGET ON THE BACKS OF CHILDREN SO WE DON'T A BAIT THE HOSPITAL OR THE CHILDREN'S HOME. THAT'S BEEN CONSISTENT SINCE I'VE BEEN HERE. WE ADOPTED THAT POLICY OVER THE YEARS AND WE STUCK TO THAT POLICY.

>> THANK YOU. >> I HOPE I ANSWERED YOUR

QUESTION. >> APPRECIATE IT.

>> ARE YOU GOOD? COMMENTS OR QUESTIONS FROM COUNCIL? ALL IN FAVOR SAY AYE.

[8.c.2. Bill & Sons Body Shop Inc. Repairs to Police patrol vehicle #104 due to traffic collision. $23,662.90. ]

>> AYE. >> OPPOSED.

MOTION CARRIES. >> ITEM 8-C-2.

[READING] >> MOVE TO APPROVE.

>> SECOND. >> MOTION AND SECOND.

MR. GRISWOLD. >> THANK YOU.

I CERTAINLY HAVE NO QUALMS. I UNDERSTAND THE NECESSITY FOR REPAIRING THIS VEHICLE. MY QUESTION IS, WHY ARE WE GOING OUT OF TOWN TO FIND A BODY SHOP TO DO THIS WORK INSTEAD OF USING

AN AUBURN VENDOR. >> I HAVE OUR PUBLIC SAFETY DIRECTOR WILL MATTHEWS. HE'S GOING TO GIVE YOU A LITTLE

INFORMATION ON THIS. >> SURE.

THANK YOU. SO BILL AND SONS BODY SHOP HAS LONG BEEN VENDOR FOR CITY OF AUBURN.

TYPICALLY WHEN WE DO COMPETITIVE BIDS ON VEHICLE REPAIRS THEY ARE HISTORICALLY THE LOWEST BID THERE DO VERY GOOD QUALITY WORK, THEY'RE KNOWN FOR QUALITY WORK AND THEY DON'T HAVE A SIGNIFICANT BACKLOG OR LEAD TIME ON THOSE REPAIRS AS COMPARED TO SOME OF THEIR COMPETITORS. THIS PARTICULAR SITUATION WAS ONE WHERE THE VEHICLE WAS SIGNIFICANTLY DAMAGED AND HAD TO BE PARTIALLY DISASSEMBLED TO ASSESS THE LEVEL OF DAMAGE TO GET ACCURATE QUOTE. ONCE IT WAS TAKEN APART BASICALLY IT WAS IMPRACTICAL TO PUT IT BACK TOGETHER AND HAVE EVERYTHING REASSEMBLED TO MOVE IT TO A DIFFERENT SITE.

WE CONFIRMED WITH POLICE SERVICES.

THEY CONFIRMED IT WAS APPROPRIATE TO AWARD THE CONTRACT TO BILL AND SONS FOR THIS.

>> SO WHY DO WE HAVE BILL AND SONS DO THE DISASSEMBLY INSTEAD

OF AN AUBURN FIRM? >> WELL IT WAS TAKEN THERE FOR THE QUOTATION OF THE REPAIR BY POLICE SERVICES SO I'M ASSUMING IT'S BECAUSE THEY WERE THE FIRST ONES THAT COULD LOOK AT IT.

>> I JUST ENCOURAGE US TO KEEP AUBURN MONEY IN AUBURN.

THAT'S MY ONLY SUGGESTION ON THIS.

THANK YOU. >> CERTAINLY MAKE EVERY ATTEMPT TO DO THAT. WE ALSO HAVE WE ARE LOOKING AT WAYS WHERE WE MAY HAVE TO BID LARGER PACKAGES UNLIKE THE STRIPING LAYER WE CAN'T BID THIS.

EMERGENCY REPAIR WE ARE DOWN A CHEVY TAHOE, THIS WAS A BRAND NEW VEHICLE SO DEFINITELY HEAR YOU WE ARE LOOKING AT WAYS TO ADDRESS THAT AND WE CERTAINLY I THINK THERE'S BEEN A FEW COMMENTS TONIGHT. THE RULE THAT WE HAVE INTERNALLY IS AUBURN VENDORS FIRST AND BUNN ONE OF OUR CHALLENGES IF AUBURN VENDORS ARE NOT COMPETITIVE WE HAVE A 10 PERCENT RULE BUT BEYOND THAT WE GO WITH LOW SO WE HEAR YOU.

>> I WOULD LIKE TO POINT OUT THIS WAS ANOTHER VEHICLE THAT

WAS HIT. >> THAT'S CORRECT.

THE OFFICER WAS A STANDSTILL AND HIT BY INTOXICATED DRIVER.

>> PURSUING TO BE REIMBURSED MUCH AS WE CAN ON THIS.

>> YES, ANYTHING FROM AN INSURANCE PERSPECTIVE THAT WE CAN PURSUE YOU ALSO HAVE TO ASSUME THE PEOPLE THAT WERE

INVOLVED HAD INSURANCE. >> RIGHT.

MR. MOREMAN. >> ONE OF MY FAVORITE PROJECTS.

I KNOW THAT WE CAN SEE PICTURES OF SOME OF THIS WORK AT AUBURN ALABAMA.ORG/CIP/HCMORGAN BUT IS IT POSSIBLY TO PHYSICALLY GO THERE AND SEE THE SITE AND UNDERSTAND WHAT KIND OF TREES ARE BEING PLANTED AND SECONDLY, WILL THERE BE ANY SORT OF NATURE

[00:30:01]

TRAIL FOR PEOPLE TO ENJOY? WILL WE TAKE ADVANTAGE OF THIS SCENERY WE ARE PUTTING DOLLARS INTO?

>> A COUPLE OF THINGS. USUALLY WHEN A TOUR IS WARRANTED BY A COUNCIL MEMBER IF YOU WANT TO GO ON CERTAIN PROPERTY IS PLEASE ASK ME BECAUSE THERE'S A LOT OF PLACES WE ARE HAPPY TO TAKE YOU BUT YOU NEED SPECIALIZED VEHICLES OR GET THROUGH FENCED AREAS. I'LL HAVE OUR WATER RESOURCE MANAGEMENT DIRECTOR ERIC CARSON ANSWER ABOUT THE TRAIL AND IF I CAN ARRANGE A TOUR WE WILL DO THAT.

THIS ISN'T UNDERWAY YET. THIS WAS BID SPECIFICALLY AND OTHER PORTIONS OF THIS PROJECT ARE UNDERWAY BUT THE TREE AND SHRUB INSTALLATION CAN'T BEGIN UNTIL YOU APPROVE.

>> WHAT I MEANT WAS FOR THE CITIZENS IS THERE GOING TO BE ANYTHING PUBLIC FOR THE CITIZENS TO ENJOY.

>> MR. CARSON. >> THE PRIMARY PURPOSE OF THIS IS TO BE A TEACHING CLASSROOM SO I'M SURE THERE WILL BE OPPORTUNITIES THAT WE WILL MAKE AVAILABLE TO THE PUBLIC.

RIGHT NOW WE ARE STARTING WITH WORKSHOPS WITH AUBURN UNIVERSITY AND OTHER CITIES TO COME IN TO VIEW AS PART OF THIS MS-4 PROGRAM SO WE ARE TRYING TO LEAD BY EXAMPLE AND HAVE THIS DEMONSTRATION WITH THE TREES BUT YES, I IMAGINE IT WOULD BE AVAILABLE TO CITIZENS ACADEMY, CITY ACADEMY AND VARIOUS GROUPS AND SCHOOLS, THROUGHOUT THE YEAR.

THAT'S ONE OF THE MAIN PURPOSES. >> THE AREA IS NOT WIDE OPEN FOR THE PUBLIC TO GO THERE AND RECREATE.

>> NO, THEY WOULD PROBABLY HAVE TO BE ESCORTED AND SIGN TYPICAL

WAIVERS. >> THANK YOU ERIC.

>> SECOND. >> MOTION AND SECOND.

MS. TAYLOR. >> OKAY, I GUESS MY QUESTION ON THIS ONE IS, 1652 STREAM MITIGATION CREDITS.

CAN YOU EXPLAIN WHAT THAT MEANS? >> I'M GOING TO EXPLAIN BEFORE I ASK THE EVENING NEAR TO EXPLAIN. ULTIMATE MATTINGLY TO MAKE A FLAT PLANE SURFACE ON THE BOYKIN-DONAHUE CAMPUS YOU NEED TO FILL IN AREAS. WHEN DO YOU THAT THE U.S. ARMY CORPS OF ENGINEERS GET INVOLVED AND YOU HAVE TO BASE ON YOUR IMPACT TO THOSE STREAMS YOU HAVE TO BUY CREDITS TO RESTORE A STREAM ELSEWHERE IN A CERTAIN WATERSHED OR OTHER TYPE DEAL SO WE ARE IN ESSENCE SPENDING $250,000 JUST IN STREAM CREDITS TO BE ABLE TO EVENTUALLY DELIVER A FLAT PLANE SURFACE BETWEEN THE NEW AND OLD BUILDINGS. SCOTT AN EVENING NEAR WOULD YOU

LIKE TO ANSWER FURTHER? >> THIS IS A TOOL THAT IS TO ENABLE FOLKS THAT HAVE TO PERMANENTLY IMPACT.

THE CORPS OF ENGINEERS MANAGES THE PROGRAM.

THE COMPUTATION TOOLS WHERE YOU GET THE 1652 STREAM MITIGATION CREDITS IS A CALCULATION GEFLD BY THE CORPS OF ENGINEERS AND THE COST IS JUST SIMPLY WHAT IT WOULD REQUIRE TO PAY FOR THOSE CREDITS AT SOME MITIGATION BANKS SO THE MITIGATION BANKS HAVE BEEN ESTABLISHED I'D THEY ARE THR -- EITHER THROUGH RESTORATION OF STREAMS IN ORDER TO MANAGE THOSE AND FOREVER AND THE MITIGATION BANKS ARE ALSO MANAGED AND INSPECTED BY THE CORPS OF ENGINEERS.

>> IS THIS A REQUIREMENT OF THIS PROJECT?

>> YES, ULTIMATELY IF WE NEED TO, BECAUSE OF THE DIRT SHIFTING, THE AMOUNT OF SITE WORK YOU'RE ALLOWED TO SEE IN LATER CONTRACTUAL SAY TEMPERATURES WHICH YOU READ THROUGH ABOUT DESIGN CHANGES OUT THERE, THEY TALK ABOUT HERE'S THE ESTIMATED COST OF THE PROJECT MINUS SITE WORK AND ONE OF OUR BIGGEST EXPENSES ON THIS WHOLE PROJECT IS THE SIT ISILLY AND WE ARE FIXING THIS BUT ALLISON IS THERE ANY CHOICE BUT TO MITIGATE STREAM IT? HELPS DELIVER THE PLAYING

SURFACE. >> CORRECT ITS PRIMARY PURPOSE WAS TO DELIVER THE PLAYING FIELD.

>> IF WE DON'T WANT TO DO THAT WE CAN REDESIGN.

[00:35:04]

>> ANYBODY ELSE HAVE A QUESTION? >> SO YOU MEAN LITERALLY LEVEL

THE PLAYING FIELD. >> I GUESS THE OVERALL QUESTION, IS WHAT DO WE GET FOR OUR MONEY? ARE WE JUST DOING IT BECAUSE THE EPA AND THE CORPS OF ENGINEERS SAYS WE HAVE TO DO IT? IT'S MURKY WHERE THE MONEY GOES AND WHY.

>> SONNY I THINK ONE KEY THING IS THIS IS COMMON IN ROAD PROJECTS AND IT'S COMMON IN BUILDING CONSTRUCTION SITES ALL OVER. MY HOME STATE OF CALIFORNIA YOU DON'T DO A DONE OF THIS. THERE ARE STREAMS AND WENT LANDS EVERY. IN ALABAMA SOMETIMES YOU HAVE A NATIONWIDE PERMIT THAT ALLOWS YOU TO DO THINGS DIFFERENTLY? IT'S EXTREMELY COMPLICATED BUT OVER THE YEARS WE DID AT SAM HARRIS PARK WE DID OUR OWN MITIGATION AND DAN BALANCED AROUND OUR PUBLIC WORKS DIRECTOR LED THE CHARGE INTERNALLY.

WHAT WE HAVE FOUND IS THE AMOUNT OF WORK AND TIME THAT GOES INTO THEM IF THEY CONTINUE MAKE SENSE THEY DON'T MAKE FINANCIAL SENSE TO US. YOU CAN TALK THE ENVIRONMENTAL SIDE OF IT. THE STAFF WILL TELL YOU WE ARE GLAD TO CONSIDER THAT. WE CAN DO.

IN THIS INSTANCE THIS IS A MEANS TO AN END.

YOU HAVE TO BUY THESE CREDITS OR WE CANNOT DISTURB IT OR IMPACT

IT IN ANY WAY SHAPE OR FORM. >> DOES BROAD VIEW MITIGATION BANK PROVIDE ANY EXPERTISE OR HELP?

>> THE MITIGATION BANK IS ESTABLISHED AND THE INVESTMENTS TO GET THAT BANK ESTABLISHED HAVE ALREADY BEEN MADE SO THEY'RE EITHER PRESERVING OR RESTORED WETLANDS OR SOMETHING.

I DON'T KNOW THE DETAILS OF THAT THEY HAVE TO HAVE THOSE CREDITS AVAILABLE TO SELL OUT OF THAT BANK SO THEY'VE ALREADY INVESTED THE MONEY. WHAT WE ARE DOING IS THROUGH THIS PROGRAM IS REPAYING THEM FOR THE INVESTMENT THEY'VE ALREADY MADE SO IT'S AGAIN PART OF THE PROGRAM BUT THEY'VE ALREADY SPENT THE MONEY. WE ARE PAYING FOR THAT.

THE OTHER THING ABOUT THIS IS THIS IS THE [NAME] WATERSHED SO ONE OF THE GOALS IS TO INVEST IN WATERSHED IMPROVEMENTS EVEN THOUGH THEY'RE OFF SITE AND AS THE CITY MANAGER SAID WE PREFER TO SPEND THAT MONEY MORE LOCAL.

IT IS BEING SPENT IN THE SAME RIVER BASIN WATERSHED AS WE ARE.

SO THE IMPACT IS SPREAD OVER THAT THAT'S ONE OF THE THINGS

THE CORPS WOULD LOOK AT. >> SCOTT, HOW IS THE DECISION MADE WHAT MID-GONZAGA BANK WE BUY INTO?

>> IT DEPENDS ON WHO HAS CREDITS AVAILABLE AND THE TIMING WE NEED THEM SO WE PURCHASE FROM MULTIPLE BANKS OVER THE YEARS.

WE ARE NOT, IT'S NOT LIKE WE BID THE MITIGATION BANK.

IT'S WHO'S GOT WHAT THAT MEETS THE CRITERIA AT THE TIME AND I'M NOT AWARE ANY OTHER BANKS OPEN IN THIS RIGHT NOW ALLISON.

>> SO THERE ARE PRIMARILY TWO BANKS.

ONE IS A STREAM MITIGATION BANKS AND MACLIN MORE THAT USES WET LAND MITIGATION SO WE HAVE USED BOTH THOSE ON PROJECTS OVER THE

YEARS. >> FROM THIS MAP IT APPEARS THE FIELD AND THE PUBLIC LIBRARY ARE THE SAME PROXIMITY TO THE STREAM. ARE WE GOING ALSO GOING TO HAVE TO BUY CREDITS FOR CONSTRUCTION IN THE PUBLIC LIBRARY?

>> SO, THIS MITIGATION IS PRIMARILY LOOKING AT THE MAP THERE'S A LINE ALMOST IN THE CENTER OF THE FIELD WILL THAT'S WHERE THE MITIGATION IS PRIMARILY FOR THE FIELD.

>> THANK YOU. >> WE HAD A MORE ENGINEERING VERSION THAT SHOWED THE EXACT AREAS AND WE SWITCHED TO SOMETHING THAT WOULD BE MORE DIAGRAMATIC FOR YOU.

>> THE MITIGATION BANK PROPERTY IS PUT INTO A PERMANENT NENT EASEMENT THAT CAN NEVER BE TOUCHED AGAIN, ESSENTIALLY BY A DEVELOPER OR ANYTHING LIKE THAT SO BUY MITIGATION BANKS YOU'RE BUYING CREDITS TO RESTORE CREEKS SOMEWHERE ELSE.

[00:40:10]

THAT'S WHY I'VE ALWAYS UNDERSTOOD.

IS THAT CORRECT? >> THAT'S CORRECT.

>> YOU'RE BETTERING ANOTHER BANK OR CREEK SOMEWHERE ELSE.

>> AND ALSO, TO CREATE YOUR OWN MITIGATION BANKS TAKES A MATTER OF YEARS. IT'S NOT AN OVERNIGHT DEAL SO EVEN IF YOU SIGNAL TO ME MOVING FORWARD YOU WANT THE CITY TO LOOK AT THAT WE ARE GLAD TO DO THAT BUT IT'S NOT SOMETHING WE CAN KEEP PROJECTS MOVING FORWARD F. WE CREATE THEM IT WILL TAKE A WHILE TO GET THEM FOR CREDIT PURPOSES.

>> IT'S VERY COSTLY. >> THE COST BENEFIT DOESN'T WORK AS IT DID ONCE. WE USE ITS --

>> IS IT COST-EFFECTIVE FOR THE PLAYING FIELD? I MEAN, THE COST OF JUST THE MID-GONZAGA AND THE CONSTRUCTION OF THE FIELD IS, THAT STILL WITHIN THE BOUNDARIES OF WHAT WE TYPICALLY PAY TO HAVE MULTI-FIELDS CONSTRUCTED?

>> SO, THESE WILL BE OPEN PLAY FIELDS BUT THEY'RE NOT BEING CONSTRUCTED TO THE LEVEL OF THE FIELDS AT LAKE WILMORE IN TERMS WE ARE NOT PUTTING DOWN AN ARTIFICIAL TURF SURFACE FOR MULTI-SPORT PLACES FOR SMALL PRACTICES AND CHILDREN THAT ARE UTILIZING OR ADULTS UTILIZING THE BOYKIN COMMUNITY CENTER.

IT'S JUST PROVIDING BIGGER SPACE.

ONE OF THE THINGS WHY WE ARE MOBILIZED FOR EARTH MOVING IT IS MORE COST-EFFECTIVE TO GRADE ALL AT ONCE THAN COME IN WITH SMALLER PACKAGES. SO WE WILL GET ECONOMY OF SCALE DOING ALL THE MASS GRADING OUT HERE.

WE ARE ALSO GRADING FOR GYMNASIUM THAT WE ARE NOT BUILDING TO A SUBGRADE. SO, THAT JIM NAIZ YUM WILL COME IN A FUTURE PHASE BUT THE GRADING PACKAGE WILL BE ONE BIG PACKAGE THAT WILL SAVE US MONEY IN THE LONG RUN.

>> IF I CAN ADD, TALKING TO THE CITY MANAGER SHE MAY HAVE MORE CLARIFICATION AND SHE'S ALREADY ALLUDED TO THIS IS THERE A SIGNIFICANT AMOUNT OF SOIL THAT WOULD HAVE TO BE TAKEN OFF THE SITE IN ORDER TO GET THESE GRA

GRADES? >> THERE'S SOMETHING CALLED A HAUL IN AND HAUL OUT IN A CON TRANGT, AND THEY ARE CRAZY EXPENSIVE SO WE DO EVERYTHING WE CAN TO KEEP THINGS ON SITE AND

BALANCE DIRT. >> ANYONE ELSE.

SO WHEN I WAS LOOKING AT THIS MAP AND I SEE THAT OUR BUCKET BOULEVARD AND YOU MAKE THAT LEFT TURN AND THE SEPARATOR IS GOING TO START MIDWAY ALMOST TO WHEN YOU GET OFF THE INTERSTATE. I'M GOING TO ASK ALL THE QUESTIONS TOGETHER. SO IT GOES UP TO ROAD 12 NOW WHICH IS A GOOD DISTANCE. NOW IF A CAR WANTS TO TURN AROUND, ONCE THEY PASS THESE SEPARATORS, AND GO BACK TO BUCKINGS I'M A LITTLE CONFUSED HERE AS TO WHERE DOES LEE ROAD 12 START AND MAKING A TURN, DO THEY GO BACK AND WHICH

DIRECTION? >> SO WHEN YOU'RE COME FROM THE INTERSTATE, WHAT HAPPENS WHEN YOU COME FROM THE INTERSTATE TOWARD BUCKY'S THERE IS WHAT WE CALL IN A RIGHT IN RIGHT OUT.

THE VISITORS TO BUCKY'S ARE DOING A GREAT JOB OF BUCKY'S BUT NOT DOING A GREAT JOB OF LEAVING BUCKY'S.

INSTEAD ARE TURNING LEFT THEY GO TO THE RIGHT TURN ONLY LANE AND GET OUT INTO TRAFFIC AND SOMETIMES FLIP A U-TURN BLOCK

[00:45:01]

PEOPLE MAKING ILLEGAL LEFT TURN OUT OF THERE WE HAVE HAD A LOST NEAR MISSES AND COMPLAINTS FROM THE RESIDENTS AND BUSINESSES IN THAT AREA, SO THESE WILL STAND IN WHAT IS LIKE THE CENTER LANE AND LEE ROAD AND COX ROAD IS ONE AND THE SAME.

THREES WILL BE STOOD UP RIGHT IN RIGHT OUT TO KEEP PEOPLE FROM MAKING ILLEGAL U-TURNS AND OR LEFT TURNS THROUGH THERE SO THIS WILL FORCE THEM TO USE THE TRAFFIC SIGNAL OR GO ELSE WHERE.

WHEN YOU ARE HEADED SOUTHBOUND FROM TOWN TOWARD BUCKY'S YOU NEED TO TURN LEFT AT THE TRAFFIC SIGNAL.

THE RIGHT IN RIGHT OUT IS NOT THE LEFT TURN LOCATION AND PEOPLE DO THIS ON MOORE'S MILL ROAD AT HOME FARMLY ON THE PUBLIX. THEY'RE THERE BECAUSE TRAFFIC IS TOO GREAT SO WE STRONGLY ENCOURAGE PEOPLE TO FOLLOW WHAT THEY WERE DESIGNED FOR TO KEEP EVERYONE SAFE.

SO THIS IS A GENTLE REMINDER CAL YOU CAN'T DO THAT IF WE PUT THEM UP. SOME PEOPLE WILL SOMETIME RUN THEM OVER BUT IT WILL DO MILD DAMAGE TO YOUR CAR.

>> ARE YOU GOOD, CONNIE? >> OKAY, THE MAP.

OH, OKAY. >> ALL IN FAVOR, OPPOSED.

[8.c.8. McMillan Pazdan Smith Architecture. Amended Professional Services Agreement. Boykin‐Donahue Campus Cultural Center Project. $27,992. ]

>> ITEM 8-C-8.

[READING]. >> MOVE FOR APPROVAL.

>> SECOND? >> IT SAYS AMEND PROFESSIONAL AGREEMENT SO THAT MEANS PROFESSIONAL AGREEMENT IS

ALREADY IN PLACE. >> SO, SO YOU ALREADY APPROVED ARCHITECTURAL CONTRACT FOR THIS CULTURAL WHAT HAPPENED IS COST ESCALATION AND SCOPE CHANGES, MEANING THE NEED FOR CERTAIN SIZING OF CLASSROOMS RESTROOMS ET CETERA, CAUSED THE END CONSTRUCTION PRICE TO INCREASE AND THREES ARE PERCENTAGE CONTRACTS SO ULTIMATELY ARCHITECTURAL FEES ARE YOU'RE AUTHORIZING ADDITIONAL FUNDS TO BE SPENT ON THIS ASSUMING THE BID COMES IN THIS AMOUNT FIFTH COMES IN LOWER IT ADJUSTS DOWN NOT UP BUT IF IT COMES IN HIGHER WE TALK AGAIN

WITH THE ARCHITECTS. >> SO, THIS IDEA OF CREATING THIS CULTURAL CENTER WAS BORN FROM A GENTLEMAN WHO LOVES IN OUR COMMUNITY LARRY DESHARE A, HE WAS A COACH WHEN I MET HIM AND CAME TO ME WITH THIS IDEA WHEN MOST OF US WERE ELECTED IN 2018 TO CREATE AROSE ENWALL ZOOL HOUSE, REFLECTING THE SCHOOLS THAT, I FORGET HIS FIRST NAME BUT MR. ROSEN WALL BUILT PRIMARILY IN RURAL AREAS IN SOUTH AND FOR UNDERSERVED AFRICAN-AMERICAN CHILDREN 150 YEARS AGO AND THE IDEA WAS TO CREATE THIS SCHOOL HOUSE AND USE IT AS A CENTER FOR EDUCATION, FOR RECOGNITION, FOR THERE COULD BE SOME HISTORICAL MUSEUM QUALITIES TO IT AS WELL, RECEPTION QUALITIES TO IT AS WELL AND I ASK CONNIE AND TOMMY AND WE MET WITH COACH DESHEER ONE DAY AND LISTENED TO HIS DECISION AND MR. BUSTIN WAS OUR CITY MANAGER AND WE WANTED TO BE GOING FORWARD WITH THE PROJECT BUT I NEVER NOT WE WOULD BE LOOKING AT A MILLION DOLLARS TO BUILD THIS. I UNDERSTAND COMPARING BUILDINGS IS APPLES AND WATERMELONS. I'M GOING TO EQUATE IT TO LIKE A HABITAT HOME WHERE PEOPLE WERE SPEND TIME RESOURCES AND PARTICIPATE FOR BUILDING SOMETHING GR THE GREATER GOOD OF THE COMMUNITY. I REALLY NEVER THOUGHT OR ENVISIONED WE WOULD BE TALKING ABOUT THIS KIND OF MONEY, SO

[00:50:01]

MR. CROUCH I'M NOT SURE WHERE WE ARE RIGHT NOW.

CAN WE STOP AND TAKE A BREAK AND REEVALUATE THIS? CAN WE LOOK AT WHAT WE ARE TALKING ABOUT? I'M PRESUMING, AND I APPRECIATE THE ARCHITECTS AND BRAGGED ON THE FIRM WE WERE USING FOR THIS AND CERTAINLY NO PROBLEMS THERE BUT CAN WE TALK ABOUT THIS MORE? MY VISION WAS NOT TO HAVE OVER A

MILLION DOLLARS SCHOOL HOUSE. >> CERTAINLY CAN, IF I MAY SUGGEST CONTRACTUALLY WE WERE OBLIGATED AT THIS STAGE.

MY GOAL AT THE BUDGET WORKSHOP WE CAN DO A BIG PRESENTATION ABOUT BOYKIN IN GENERAL BECAUSE IT'S HOT AND HEAVY IN THE NEXT FISCAL YEAR, GIVE YOU FULL UPDATE, LET YOU KNOW WHERE WE STAND WITH COST ASSESSMENTS AND WHAT PLANS ARE AND WE CAN TALK ABOUT IT AT THAT TIME. WE WOULDN'T BE PAST THE POINT OF NO RETURN I WOULD TELL YOU AS WE DISCUSS IN YOUR PACKET MEETING WE ARE DELAYED ON PUBLIC WORKS AND ENVIRONMENTAL SERVICE DUE TO MUCH NEEDED GENERATORS FOR EMERGENCY SERVICES BEING INSTALLED WITH THOSE COMPLEXES. THEY'RE NEARING COMPLETION.

WE WILL BE SEVERAL MONTHS, THEY NEED TO BE ALMOST FINISHED MOVING BEFORE WE ADVERTISE TO BID SO WE'VE GOT TIME BUT I WOULD LOVE TO TALK TO YOU, GIVE THE COUNCIL INFORMATION AND GET DIRECTION SO THAT WE DON'T DO WORK TWICE SO RIGHT NOW IS A GOOD TIME TO TALK ABOUT THIS. IT'S HARDER SIX MONTHS FROM NOW BUT WE ALWAYS CAN PIVOT AT THE COUNCIL'S REQUEST.

>> AND I WANT TO STAY I BELIEVE IN THE PROJECT, I BELIEVE IN THE PURPOSE OF THE PROJECT. I'M EXCITED ABOUT THE PROJECT.

I WANT TO MAKE SURE EVERYBODY -- >> WE CAN GO BACK OVERTAKE A DEEPER DIVE INTO THE SCORCH THESE THINGS THAT THIS ALSO INCLUDES A SPLASH PAD A LIBRARY. WE WILL TALK ABOUT THE LIBRARY ONE. WE HAVE GOT TO ADJUST THAT DESIGN CONTRACT BECAUSE WE DOUBLED THE SIZE LAST SUMMER.

WE WENT WITH A SMALLER LIBRARY AND FOUNDER THE LARGER VERSION TO BE MORE AFFORDABLE. IT'S NOT COST THAT'S CREPT UP IN PRICE. WE CAN TALK ABOUT THAT ITEM IF

YOU HAVE QUESTIONS. >> THE CULTURAL CENTER IN STATED IN THIS IS OVER A MILLION DOLLARS WITHOUT SITE WORK.

>> CORRECT. >> AND THAT'S FOR A 1700 CUELLAR

FOOT. >> MR. CUMMINGS I THINK ADDED SQUARE FOOTAGE. IT'S ACTUALLY 1980.

>> IT'S 1900-2000 SQUARE FEET FOR THE BUILDING.

>> WE ARE LOOKING AT ALMOST A MILLION DOLLARS FOR 2,000 SQUARE

FEET. >> ABSOLUTELY.

>> KEEP IN MIND DON'T COMPARE THERE TO RESIDENTIAL CONSTRUCTION. THIS IS COMMERCIAL CONSTRUCTION COMPONENT SO IT IS GOING TO BE MORE EXPENSIVE PER SQUARE FOOT.

>> I WAS CONSIDERING TAXPAYERS. >> UNDERSTAND.

>> ABSOLUTELY. >> SO JUST TO BE CLEAR ON WHAT RON IS ASKING ABOUT THIS PROJECT, SO YOU'RE ASKING US TO RELOOK AT THIS SIMPLY BECAUSE OF THE COST?

>> ABSOLUTELY. YES.

>> WHAT DID WE EXPECT AT FIRST IN I MEAN WHAT WAS THE EXPECTATION FROM THE BEGINNING, THE REASON WE WENT ON AND APPROVED THIS? I GUESS BEFORE IT WAS APPROVED, WAS THERE NOT A COST ASSOCIATED WITH ACTUALLY GOING OUT AND LOOKING AT IT OR ANYTHING? I MEAN, I JUST DON'T UNDERSTAND NOW WE ARE TALKING ABOUT A MILLION DOLLARS SO WE ARE GOING TO PULL IT BACK OFF BECAUSE OF THE MONEY BUT MAYBE THE MONEY SHOULD HAVE BEEN THE FACTOR FROM THE BEGINNING.

>> MY VISION WAS ALWAYS THAT THE COMMUNITY WOULD PARTICIPATE IN BUILDING THIS AND OFF SETTING THE COST.

I NEVER ENVISIONED WE WOULD HIRE A CONTRACTOR TO BUILD THE THING ON BEHALF OF THE CITY SO IT WOULD BE MUCH LESS ABSOLUTELY.

I THOUGHT IT WOULD BE HALF OF THAT MAYBE.

>> OKAY, SO -- >> BUT THAT WAS IN 2018 AND I

KNOW THINGS HAVE CHANGED. >> AND I UNDERSTAND WHAT YOU'RE SAYING THAT WAS YOUR VISION BUT DID ANYBODY JUST GO OUT AND TALK TO WHOEVER MAYBE WE WERE THINKING WOULD HELP WITH US THE KOFTD OF ANYTHING BEFORE WE ACTUALLY MADE A DECISION ON THE COST OF IT AND ACTUALLY APPROVED THESE? BECAUSE IT WOULD LOOK, I'M GETTING SENSITIVE ABOUT THIS BECAUSE THIS IS SOMETHING THAT HAS ALREADY BEEN PUT OUT THERE TO THE COMMUNITY. EVERYBODY IS EXCITED ABOUT IT.

SO IF WE DECIDE WE ARE NOT GOING TO DO THIS BECAUSE IT'S A MILLION DOLLARS, WHAT'S THE NEXT STEP? WE ARE NOT GOING TO HAVE A MULTI-CULTURAL CENTER?

>> I DIDN'T SUGGEST THAT AT ALL. I THOUGHT I WAS VERY CLEAR ABOUT THE FACT I'M RESPONSIVE TO THE PROJECT WANT TO SEE TO IT FRUITION. I'M JUST QUESTIONING WHETHER

[00:55:01]

THERE'S A LESS EXPENSIVE WAY TO DO THIS THAN SPEND OVER A MILLION DOLLARS. CAN WE REALISTICLY COME UP WITH A PLAN THAT FUNCTIONS AND I'M USING THIS AS A LOOSELY AFFILIATED DESCRIPTION HABITAT HOME WHERE THERE ARE RESPONSE SOARS VOLUNTEERS AND PEOPLE THAT HELP PAINT THINGS AND INSTALL THINGS AND LIFT YOU WILL WALLS AND THAT KIND OF STUFF IS, THERE A WAY TO DO THAT CREATES A LOT OF ENERGY AND BUY IN FOR THE COMMUNITY SO IT BECOMES A SOURCE OF PRIDE FOR EVERYBODY BECAUSE THEY'VE ALL PARTICIPATED IN HELPING DO THIS.

THAT WAS MY VISION IN THE BEGINNING.

>> SO, IF WE PULL IT DOES THAT DELAY?

>> MAYBE A LOT OF CHOICES FOR THE COUNCIL ON THIS WITH THE MAYOR IF I UNDERSTAND WHAT HE'S SUGGESTING WE ALSO BUILD, WE BUILT HICKORY DICKRY PARK THIS WAY.

WE COULD BID THE SITE WORK AND STUB UTILITIES BUT IF DIFFERENT GROUPS ARE GOING TO PARTICIPATE IN CONSTRUCTION EVEN IF CONSTRUCTION FIRMS WANTED TO DONATE TIME WE NEED TO DO THAT DIFFERENTLY WE CAN'T BID WITNESS ONE ONE CONTRACTOR AND EXPECTED THEM TO DONATE THERE WOULD BE A WAY THE COMMUNITY WOULD COME TOGETHER AND TAKE PIECES OF IT THE DESIGN WOULD REMAIN.

YOU WOULD FIGURE OUT WAYS TO BUILD IT DIFFERENTLY SO THAT IF GROUPS WANTED TO FUND THE CITY BOUGHT MATERIALS WE JUST HAVE TO GO ABOUT IT DIFFERENTLY. THERE'S A LOT OF OPTIONS THERE IF YOU DECIDE THAT'S WHAT YOU WANTS TO PURSUE.

>> SO IF WE WERE TO GREEN LIGHT EVERYTHING TONIGHT AND SO GO AS FAST AS WE CAN GO WHEN WOULD BE THE EARLIEST THIS COULD START?

>> WE CAN'T START ANYTHING UNTIL WE GET GENERATORS IN AND ENVIRONMENTAL SERVICES AND PUCK WORKS AND RIGHT NOW THERE'S NOT

A GOOD TIME FRAME ON THAT. >> 3 MONTHS, 4 MONTHS, 5 MONTHS

ON THAT? >> AT ATHLETES 2 AND WE HAVE BEEN TOLD THINGS BEFORE IT IS OUR CONTRACTORS WORKING DILIGENTLY WITH THE MANUFACTURERS, NOT THE CONTRACTORS DOING BUT WE ARE IN A SUPPLY CHAIN SITUATION BECAUSE OF STORM RESPONSE BY WE CAN'T HAVE THEM IN A FACILITY WITH NO ELECTRICITY SO WE ARE STUCK UNTIL THOSE GENERATORS COME IN.

WE ARE LOOKING AT ALL TERN WAYS TO DO THIS OR RENT THINGS WE ARE LOOKING AT A LOT OF THINGS BUT IT WILL TAKE SEVERAL MONTHS TO GET THEM MOVED ONCE THE MOVE IS UNDERWAY AND WE ARE ALL COMFORTABLE WE WILL BID THIS BUT YOU GUYS HAVE THE NEXT COUPLE

MONTHS TO MAKE THE DECISIONS. >> WE CAN HAVE A MEETING ABOUT

THIS? >> I WOULD LIKE TO IN THE MIDDLE OF THAT WHILE WE ARE WORKSHOPING THAT WILL GIVE YOU MORE INFORMATION AND CHANCE TO ANSWER QUESTIONS AND WE WILL BE

PREPARED TO DO THAT. >> IS IT TIME SENSITIVE THIS 8-C-8 THAT WE VOTE ON THIS TONIGHT?

>> YES. THAT WE OWE THEM THIS MONEY REGARD LE CONTRACTUALLY WE ARE ADDING TO IT AND NEED TO GET

YOUR AUTHORIZATION. >> ADDING SCOPE AS WELL AS

CONSTRUCTION COSTS. >> YES.

>> THE ADDED SCOPE CAN YOU SUMMARIZE WHAT THE ADDED SCOPE

IS? >> YOU WANT TO TAKE?

>> YES, SO AS PART OF THE DESIGN WE HAVE CHANGED SOME OF THE BUILDING LAY OUT RESTROOMS KITCHEN AREAS THE CONFIGURATION OF THE CLASSROOMS SO THOSE ARE CHANGES THAT THE ARCHITECT HAS

ALSO MADE. >> WHY?

>> BECAUSE THOSE ARE JUST DECISIONS WE HAVE MADE

INTERNALLY. >> NOT MORE DETAIL.

>> THOSE ARE DESIGN IT RELATIONS INTERNLTLY.

>> THOSE KIND OF THINGS HAPPEN OVER TIME AS YOU LOOK AT PROJECT AND WE LOOKED AT POSSIBLY EXPANDING THIS AND PROVIDING MORE SERVICE TO THIS AREA AND ARCHITECT HAD TIME AND LOOKED AT THE COST OF ADDING A KITSCH NET IN THERE AND WE REALIZED THAT WAS NOT WHAT WE NEED SO THEY SPENT TIME AND MATERIALS TO GET US THAT PLAY OUT IN THOSE COSTS FOR THAT.

WE DECIDED TO PULL SOME OF THINGS BACK TO GET THE COST BACK

DOWN. >> IT'S NOT UNCOMMON WE LOOK AT OPTIONS TO DELIVER THE MOST FLEXIBILITY IN ONE OF THOSE BIG THINGS IN THE KITCHEN. THIS WENT BACK TO NOT DOING A FULL KITCHEN. IT BECOMES IN A BUILDING FACILITY THE SAME THING THE MAYOR IS TALKING ABOUT DO WE BUILD IT FOR LIMITED USE, DO WE BUILD IT FOR MAXIMUM USE AND WE HAVE TO LOOK AT THOSE THINGS BUT ALSO COSTES CLAIGSZ WE OWE THEM A PERCENTAGE REGARDLESS OF CHANGE IN SCOPE BUT WE DO OWE THEM A SMALLER AMOUNT. NOW IF WE DON'T FULLY PAY THEM EVERYTHING SO IF IT BIDS LESS AND YOU CHANGE AND WE DON'T BID THIS WE STILL HAVE TO DETERMINE A VALUE IN WHICH THEY'RE STILL

[01:00:05]

OWED THE MONEY. >> THERE'S A POSSIBILITY WE MAY RECOUP SOME THIS IN THE CONSTRUCTION?

>> AT ALREADY BEEN TAKEN INTO CONSIDERATION.

WE ALREADY ELIMINATED SOME OF THOSE THINGS WE ASKED THEM TO

EXAMINE. >> SO WE DIDN'T REDUCE COSTS.

>> SO IT WOULD REDUCE CONSTRUCTION COSTS.

THEY HAD TO DESIGN SOMETHING TWICE.

>> IT DID REDUCE. >> YES BECAUSE WE TOOK A FULL KITCHEN OFF FOR WARMING KITCHEN MEANING WE DON'T HAVE AS MUCH MECHANICAL AND WE WERE LOOKING BACK TO THE FACILITY.

COMMENTS OR QUESTIONS FROM THE COUNSEL.

MR. WILSON IS WITH US. WE CERTAINLY APPRECIATE HIS REININVESTMENT IN HIS BUSINESS IN OPALACA ROAD AND WILLING TO MAKE THIS CONSTRUCTION PROJECT COME TRUE IN OUR COMMUNITY.

>> MR. MAYOR, I NOTICE THE WORDS HEIGHTENED DESIGN STANDARDS ON A COUPLE OF PAGES OVER HERE. I WONDERED WHAT THAT MEANT.

>> SO, WE ASK APPLICANTS, OPALAK ROAD WAS THE REASON WE DID A SALES TAKE REPEAT PROGRAM TO ENCOURAGE REDEVELOPMENT OR ARCHITECTURE ON FACADES SO WHAT THE ASK IS IN CONSIDERATION FOR THE CITY INVESTMENT SOMEBODY GO ABOVE AND BEYOND WITH ZONING OERDZ WOULD NORMALLY REQUIRE, ONE THING YOU NEED TO REMEMBER IN ALABAMA ARC -- THE COUNCIL HAS SAID IF YOU WANT A DEVELOPMENT AGREEMENT FROM US, WE EXPECTED YOU TO DEAL WITH IT.

IN THIS INSTANCE YOU DO IT BY CONTRACT.

YOU PUT STRONGER TAKE TOUR ON THIS WE WILL CONSIDER.

THIS YOU HAVE A COMMERCIAL DEVELOPMENT AUTHORITY THESE PROJECTS GO TO THAT BEFORE THEY COME TO YOU THEY DON DEAL IN DOLLARS AND CENTS BUT WHAT IS FEASIBLE THEY LOOK AT THE BUSINESS SIDE OF THE DEAL AND SAY WE DON'T WANT TO OVERASK SOMEBODY IF YOU LOOK AT THIS WE APPRECIATE MR. WILSON HE'S BEEN THERE A LONG TIME THIS IS A LONG STANDING BUSINESS BUT THE NEW BUILDING I THINK WILL BE QUITE IMPROVED AND HE HAS BEEN TALKING TO US SINCE THE INCEPTION OF THIS IN 2011 AND WE APPRECIATE IT BECAUSE HE'S WORKED A LONG TIME TO GET TO POINT SO THE ENHANCEMENT IS HE'S GOING ABOVE AND BEYOND.

HE COULD DO LESS THAN A INVEST LESS BUT HE'S DONE A BETTER LOOKING BUILDING BECAUSE OF THE PROGRAM SO WE APPRECIATE THAT.

>> I WOULD DEFINITELY AGREE THAT DEFINITELY ABOVE AND BEYOND THE

DESIGN IS FANTASTIC. >> I LIKE THE EDITION OF A PICKUP WINDOW. THIS IS IN AN AREA WHERE WE HAVE A VACANT CAR DEALER NEXT DOOR, BUILDINGS ON THE OTHER SIDE.

I APPRECIATE THE OWNER BEING INVESTED BUT THEY COULD USE A FACADE ENHANCEMENT AND WE APPRECIATE AND HOPE THIS WILL

[01:15:02]

STIMULATE ADJACENT REENINVESTMENT.

>> WHO WOULD BE DOING THE SIDEWALK WORK IN FRONT OF THE

BUILDING? >> HOWARD.

>> SO FOR THIS PROJECT THEY WILL PAY INTO A SIDEWALK FUND IF YOU'RE FAMILIAR WE ARE PLANNING LONGER TERM IN THE CIP TO DO THE NEXT PHASE HERE IN MEETING WITH THE PROPERTY OWNER AND MEETING WITH THEIR EVENING NEAR, IT JUST DOESN'T MAKE SENSE FOR THEM TO GO THROUGH AND DO A SHORT RUN OF SIDEWALK WHERE WE DOESN'TLY HAVE AN OPEN DITCH IT WILL BE CURB AND GUTTER SIDEWALKS ET CETERA.

THE LAST THING WE WANT THEM TO GO IN IS GO IN BUILD A SIDE WALKED FOR US TO COME IN AND RIP IT OUT SO WE HAVE WORKED ON ELEVATION OF THE DRIVEWAY WHAT THAT SLOPE IS AT OPEN LACK A ROAD TO ALLOW FOR THAT LATER ON BUT WE WON'T HAVE THAT CONSTRUCTED OR THEY WON'T BE OBSTRUCTIONING THAT SIDEWALK WITH THIS INITIAL PHASE BUT THE CITY MAKES THAT INVESTMENT

THROUGH THE NEXT PHASE. >> SO YOU'LL SEE DEVELOPMENTS PAY INTO THE SIDEWALK FUND WE CAN ONLY USE IT TO BUILD SIDEWALKS ALL OVER THE CITY AND WE WILL USE SOME OF THOSE FUND

TOWARD THE PROJECT. >> ANY OTHER QUESTIONS.

>> WHEN DO YOU EXPECT THE NEXT PHASE OF THE PROJECT PROCEEDING?

>> THE NEXT PHASE WOULD BE IN ITS VICINITY WOULD BE DEAN ROAD INTERSECTION. I ACTUALLY HAD A TALK IN THE VICINITY OF DEAN ROAD AND OPALAKA ROAD.

I TALKED WITH THE CITY CERIN ABOUT -- ENGINEER ABOUT IT SO TIMING WISE I DON'T RECALL ON THE CIP WHERE THAT WAS SAID.

IT WAS FEW YEARS OUT. WE HAVE TO ACQUIRE A SIGNIFICANT AMOUNT OF RIGHT OF WAY FROM CSX AIR ROAD AND PERMISSION BECAUSE WE HAVE TO WIDEN AT THE RAILROAD TRACKS TO ADD A WHOLE LANE FULL RIGHT TURN LANE AND THAT WILL TAKE TIME TO ACQUIRE PROPERTY.

>> SO THE A APPROVAL ON THIS BUSINESS IS NOT IN THE

FORESEEABLE FUTURE? >> WE MY PIPE THAT DITCH AS PART

OF THE PROJECT. >> MOST OF THE PARKING FOR THIS NEW FACILITY IS GOING TO BE IN THE BACK OF THE BUILDING?

>> THE MAJORITY OF THE PARKING FOR THIS BUILDING WILL BE ON THE SIDE OF THE BUILDING WHERE THE CURRENT LOCATION IS.

SO THERE WILL BE A LITTLE BIT OF OVERLAP THERE AND THEY'LL

DEMOLISH THE EXISTING BUILDING. >> AND THEY'VE GOT PLANS TO DEAL WITH PARKING AND TEMPORARY STUFF.

I THINK IT'S INNOVATIVE TO KEEP YOUR RESTAURANT OPEN AND FLIP IT

OVER. >> SO THE HANDICAP POLES I'M LOOKING AT, THOSE ARE GOING TO BE ON THE SIDE OF THE BUILDING?

>> YES, SO SOME OF THE ZONING ORDINANCES REQUIREMENTS REQUIRE THAT ALL OF THE PARKING BE NO CLOSER TO THE STREET THAN THE PRINT PLANE OF THE BUILDING SO THAT'S WHY THE MAJORITY OR REALLY ALL THE PARKING IS TO THE SIDE OR REAR AND THAT WILL SERVE AS THE MAIN ENTRANCE WHERE THE HANDICAP SPACES ARE.

>> THEY'RE REQUIRED TO BE. 88 SPACES HAVE TO BE AS CLOSE AS THEY CAN BE IN NEW CONSTRUCTION TO THE ENTRANCE.

>> WAS THERE A COMMENT THIS SIDE?

>> I JUST WANT TO THANK MR. WILSON THE WAY YOU SUPPORT PUBLIC SAFETY 36 YEARS AGO MY LIEUTENANT WOULD PUT HIS BUSINESS CARD, IF I DIDN'T FIND IT I GOT IN TROUBLE SO WE KEPT A CLOSE EYE THANKS TO LIEUTENANT JOHN DUNN.

IT IS AGAINST THE LAW IN CERTAIN AREAS.

IF TWO SINGLE FAMILIES WANT TO SHARE EXPENSES TO SURVIVE FINANCIALLY IT IS AGAINST THE LAW IN CERTAIN AREAS.

IF FOUR CONSTRUCTION WORKERS WANT TO SHARE EXPENSES BUILDING ONE OF THESE HIDEOUS CONCRETE AUBURN SKYSCRAPERS IT'S AGAINST THE LAW IN CERTAIN AERJS. IF THREE LGBTQ QIA-PLUS WANT TO LIVE IN THE SAME HOME AND SHARE EXPENSES, IT'S AGAINST THE LAW IN CERTAIN AREAS. CAN I GO ON AND ON AND ON.

ONE WAS TOO GREEDY. WOULD I LIKE TO SUPPORT MY WIFE TO STAY HOME MORE OFTEN, ABSOLUTELY YES BUT I DO NOT CARE IF I EVER GET ANOTHER DOLLAR FROM SHORT TERM RENTAL.

WHAT I CARE ABOUT IS OUR PROPERTY RIGHTS AND CONSTITUTIONAL RIGHTS. NO COUNCIL GOVERNMENT NO STATE GOVERNMENT NO FEDERAL GOVERNMENT HAS A RIGHT TO STOMP ON OUR CONSTITUTION, NONE OF YOU DO. FREEDOM REQUIRES EFFORT.

FREEDOM REQUIRES INVOLVEMENT. FREEDOM REQUIRES SACRIFICE.

FREEDOM REQUIRES DETERMINATION AND FREEDOM REQUIRES DECISION WITH INFORMED MIND AND HEART. THANK YOU.

>> WHO WILL BE NEXT? >> MY NAME IS BECKY RETSLAFF.

I LIVE A 350 GARDNER DRIVE. I SENT YOU ALL AN EMAIL ABOUT A SIDEWALK THE NEIGHBORHOOD BOUNDED BY SANFORD ALL THE WAY TO GLENN AND CHALK LA TO UNIVERSITY, THAT NEIGHBORHOOD IS WITHIN TWO MILES OF THE HIGH SCHOOL SO THERE'S NO BUGS SERVICE, YOU PROBABLY KNOW THERE'S NO BUS SERVICE WITHIN TWO MILES OF THE SCHOOL SO THOSE KIDS WHEN THEY WALK TO THE HIGH SCHOOL, I HAVE A RISING 10TH GRADESER EVENTUALLY THOSE KIDS END UP AT OLD MILL AND UNIVERSITY.

THERE'S NO OTHER ROADS. THERE'S A FEW THAT ARE LIKE SANFORD. AND SO, FROM OLD MILL AND UNIVERSITY YOU GO LEFT TO THE HIGH SCHOOL ENTRANCE WHICH IS LIKE TEN HOUSES DOWN AT MCKINLEY BUT THERE'S NO SIDEWALK THERE.

SO THE KIDS ARE WALKING THROUGH THOSE FRONT YARDS TO GET TO MCKINLEY I WAS HERE TO ASK YOU IF WE CAN GET A SIDEWALK SO MY SON DIDN'T HAVE TO DASH ACROSS UNIVERSITY OR WALK THROUGH THOSE YARDS. IT'S NOT JUST MY SON.

IT'S THE WHOLE NEIGHBORHOOD. >> WE APPRECIATE YOU BRINGING THIS TO OUR ATTENTION AND WE CAN SAFE THREW SAY WE ARE LOOKING

INTO IT. >> THAT'S CORRECT.

WE HAVE NOT RECEIVED SUCH A REQUEST BEFORE.

I WILL BE EMAILING TOMORROW AND ASKING YOU TO FILL IT OUT.

WE GO BACK TO THESE THINGS, WE HAVE TO DO AN EVALUATION.

IT'S NOT IN OUR CAPITAL STACK RIGHT NOW.

WE NEED TO DO EVALUATION AND TALK TO THE SCHOOLS BECAUSE WE DON'T WANT TO DO SOMETHING AND THEY QUIT DIRECTING TRAFFIC AT MCKINLEY AND REPLACE THE PROBLEM SO WE ARE HAPPY TO TAKE A DEEP DIVE I JUST DON'T WANT TO GIVE EXPECTATION IT'S GOING TO GO FIXED THIS SCHOOL YEAR. WE GLADLY WILL LOOK AT IT.

>> I APPRECIATE THAT I.E. MAILED DR. HERRING AND HER RESPONSE WAS TO HAVE MY KID WALK THROUGH THE YARDS BUT I APPRECIATE THAT.

>> THANK YOU. HAVE A GOOD DAY.

WHO WOULD BE NEXT? >> MARTHA SHAMP, [ADDRESS].

[01:30:14]

>> I WOULD LIKE TO SAY I'M SORRY ABOUT THIS GENTLEMAN LOSING HIS BROTHER BUT I SUPPORT THE POLICE, I SUPPORT THE U.S.

DEPUTIES ASSOCIATION, I FEEL HIGHS SWALLOWED WITH GRIEF OVER THE LOSS OF THE FAMILY AND HE CAN'T BE OBJECTIVE, I WANT TO THANK POLICE CHIEF DONALDSON FOR ALL HIS COMMENTS OF FAIRNESS.

I BELIEVE HE'S TRYING TO BE AS FAIR A MAN AS HE CAN CONSIDERING THESE TOUGH CALLS AND I DON'T KNOW IT ALL.

WHEN IN DOUBT I SUPPORT THE POLICE.

THAT'S ALL I'M TRYING TO SAY. I'M NOW BEGGING THIS COUNCIL FOR HOW MANY TIMES I'VE BEEN THERE TO REMOVE THE OBSCENE BOOKS IN THE AUBURN PUBLIC LIBRARY. THEY HURT CHILDREN.

I WILL NOW TELL YOU A STORY QUICKLY.

THERE WAS ONCE A RIVER IN A JUNGLE.

ALL THE ANIMALS WENT DOWN TO DRINK FROM IT.

THEY WERE-LAP, BUT THEN ONE DAY A HUGE AND ANACONDA CREPT INTO THE RIVER. HE HID IN THE DARK, WATER, HIS EYES ON TOP OF HIS HEAD SO SHE COULD STAY SUBMERGED.

TRICKY SNAKE. HE SAW KEPT QUIET, QUIETLY LITTLE BY LITTLE SQUEEZE SQUEEZE SQUEEZE.

LIKE ALL BOA CONSTRICTORS, SOON THE LITTLE ANIMAL WAS DEAD.

LATER HE SAW A WHITE TAIL DEER. HE SEIZED HIM, COILING AROUND HIM WITH A DEADLY GRIP. HE COULD SENSE WHETHER DID DEER'S HEART STOPPED. HE UNHITCHED HIS JAWS AND SWALLOWED THE DEER WHOLE. EVEN THE BRAVE JAGUAR BARELY ESCAPED THE AND ANACONDA. THE GREEN AND ANACONDA DESTROYED THE LIFE OF THE RIVER THE JOY OF THE JUNGLE AND TERRORIZED ALL THE ANIMALS WHO WENT TO DRINK. FINALLY THE ANIMALS AND THE BIRDS CRIED OUT WITH A LOUD VOICE, WHO WILL HELP US? WHO WILL KILL THE AND ANACONDA? WHO WILL HELP US KILL THE AND ANACONDA? WHO WILL KILL THIS DEADLY AND ANACONDA AND THEY ARE STILL WAITING AND CRYING OUT TO THIS DAY. THANK YOU.

>> WHO WOULD BE NEXT? OKAY, AT THIS TIME WE WILL CLOSE THIS PART OF THE MEETING THE CITIZENS OPEN FORUM.

BEFORE WE ADJOURN I WANT TO MAKE THIS STATEMENT.

WHEN MR. HALL CAME HERE THE FIRST TIME, I SAID THAT NIGHT I WAS SORRY FOR WHAT HIS FAMILY IS GOING THROUGH, AND LOSING A CHILD, I CAN'T IMAGINE WHAT HIS MOTHER IS DEALING WITH.

IN MY TIME ON THIS COUNCIL, IT'S BEEN ABOUT 11 YEARS AND ONE OF THE GREATEST HONORS OF MY LIFE HAS BEEN SERVING WITH TOMMY DAWSON. THERE'S NOT A BERN IN THIS TOWN I HAVE MORE RESPECT FOR TRUST, BELIEVE IN, OR CARE ABOUT.

WHAT HE HAS GONE THROUGH ON BEHALF OF THE CITY, SERVING US AS A POLICE OFFICER, FINALLY AS A POLICE CHIEF, AND THEN AFTER THAT DECIDING HE WASN'T THROUGH SERVING AND COMING UP HERE ON THIS COUNCIL IS ADMIRAL AND I OWE HIM A DEBT OF GRATITUDE.

I BELIEVE IN TOMMY DAWSON. AND I APPRECIATE YOU TOMMY.

>> THANK YOU, MAYOR. YOU KNOW, AS YOU KNOW, I HAVE PARKINSON'S, AND SPINAL STENOSIS AND THAT'S NOT THE ONLY REASON I'M NOT CHIEF OF POLICE IN AUBURN TONIGHT.

IF YOU ONLY KNEW HOW MUCH WHEN I GET UP EVERY MORNING HOW BAD I WANT TO PUT THAT BADGE ON AND MAKE A DIFFERENCE IN THIS COMMUNITY, I CAN'T TELL YOU, BUT I'LL TAKE THE LIES ABOUT ME.

THAT'S FINE, BECAUSE YOU KNOW, IF HE'S NOT TALKING ABOUT ME HE'S TALKING ABOUT MY MEN AND WOMEN IN BLUE.

THEY'RE A SPECIAL WEEK, MEN AND WOMEN IN BLUE, I USED TO USE BOYS IN BLUE. BUT MY JOB HAS BEEN EVERYTHING TO ME AND I REALLY APPRECIATE WHAT THE CITIZENS OF AUBURN HAVE DONE FOR ME. I PUT A VERY BEAUTIFUL YOUNG LADY THROUGH COLLEGE, MY DAUGHTER.

THE UNIVERSITY PAYS MY WIFE VERY WELL TO WORK OVER THERE.

WE HAVE BEEN HERE ALL MY LIFE SERVE GENERATIONS HERE.

[01:35:02]

IF I HAD TO DO IT ALL OVER AGAIN, MORE IMPORTANTLY, DON'T FEEL SORRY FOR ME. BECAUSE TOMORROW MORNING ABOUT 8:00, THE JURY POOL WILL GATHER AGAIN AT THE JUSTICE CENTER, AND THEY'LL TRY TO PICK A JURY TO TRY THE MAN THAT BRUTALLY MURDERED WILLIAM [INAUDIBLE] CAN'T SEE HIS CHILDREN AND GRANDKIDS AND CHILDREN GO TO COLLEGE AND GOD AL MIGHTY KNOWS IF I COULD HAVE TAKEN THAT YOUNG MAN'S PLACE I WOULD.

THIS IS NOT A GAME TO ME. I TAKE VERY SERIOUS SERVEING THE CITY OF AUBURN AND I CAN ONLY HOPE I DO AS WELL AS I CAN AND I'M GOING TO MAKE MISTAKES BUT I DO LOVE EACH AND EVERY PERSON IN AUBURN. I FEEL LIKE I'VE MADE A DIFFERENCE AND I DON'T HAVE TO PROVE ANYTHING TO SOMETHING LIKE MR. HALL. NOTHING I CAN SAY IS GOING TO BRING HIS BROTHER BACK. DO HATE THE LOSS OF HIS BROTHER.

I WISH I COULD CHANGE THAT BUT I CAN'T.

IT'S AWFUL TO LOSE A LOVED ONE LIKE THAT.

I'LL NEVER BE SILENT. I'LL NEVER NOT STAND UP FOR OUR PUBLIC SAFETY OFFICERS AND I'LL NEVER NOT STAND UP FOR WHAT'S NOT RIGHT, NO MATTER WHAT I BELIEVE IN, I WANT TO DO WHAT'S RIGHT AND WHAT I TOOK AN OATH TO DO.

THANK YOU FOR YOUR KIND WORDS, MAYOR.

THEY MEAN MORE THAN YOU'LL EVER KNOW.

AS A POLICE OFFICER YOU HAVE TO DO A JOB TO BE APPRECIATED.

IT'S JUST ABOUT DOING WHAT'S RIGHT FOR THE COMMUNITY.

HOPEFULLY I'VE MADE A DIFFERENCE.

THANK YOU. >> ANYONE ELSE? OKAY TO ADJOURN?
