I HAVE A STATEMENT I WOULD LIKE TO READ TONIGHT. MANY OF YOU MIGHT BE AWARE THERE WAS A VERDICT REACHED THIS AFTERNOON REGARDING THE TRIAL OF THE MURDER OF WILL BIGNER. TODAY A VERDICT WAS REACHED IN THE TRIALED OF GRADY WILKES RESULTING IN CONVICTIONS OF WILLIAM DEKE INNER AND THE ATTEMPTED MURDER OF TWO OTHER OFFICER EVAN ELLIOTT AND WEB SIS TRON.

BUT THE LEGAL PROCESS IS NOT OVER YET WITH THE POSSIBILITY OF AN APPEAL. WE JUST CONTINUE TO RESPECT THE LEGAL PROCESS AND AS MUCH MY COMMENTS WILL BE BRIEF.

SEEING KNOW ONE WE'LL MOVE AHEAD WITH SUNNY CITY MANAGER

[8. CONSIDERATION OF CONSENT AGENDA.]

COMMUNICATIONS. >> OUR FIRST ITEM OF BUSINESS IS A CONSENT AGENDA. DOES ANY MEMBER WISH TO REMOVE

AN ITEM FROM THE CONSENT AGENDA? >> YES I WOULD LIKE TO REMOVE

EIGHT BRAVO THREE PLEASE. >> EIGHT B THREE.

OKAY. ANYONE ELSE?

>> MR. MAYOR, I WOULD LIKE TO REMOVE EIGHT CHARLIE.

>> OKAY. ANYONE ELSE.

OKAY MR. CITY MANAGER, EIGHT B THREE.

>> ITEM EIGHT B THREE IS A REQUEST FROM GREEN WALT HOSPITALITY FOR A SPECIAL EVENT RETAIL ALCOHOL BEVERAGE LICENSE FOR SEPTEMBER 15, 2023 TO SERVE BEER WINE AND LIQUOR ON PROPERTY

AT 554 WEST THATCH AVENUE. >> MOVE FOR APPROVAL.

>> SECONDS. >> MOTION AND SECOND, MR. BRINGS

WITHHOLD. >> THANK YOU MR. MAYOR I WOULD LIKE TO RECUSE MYSELF FROM THAT VOTE BASED ON MY PARTICIPATION ON THE HOUSEING BOARD CORPORATION.

>> WE HAVE A MOTION AND SECOND, ALL IN FAVOR PLEASE SAY EYE.

ANY OPPOSED? >> ITEM EIGHT C ADOPT, TRANSPORTATION PLAN PER THE REQUIREMENTS OF REBUILD ALABAMA

ACT. >> MOVE FOR APPROVAL.

>> MOTION AND SECOND, MR. WARREN?

>> YES, SIR. I HATE TO BE A CONTAIN ON THIS ONE BUT I AM NOT CON CONVINCED THAT A ROUND ABOUT WHICH IS PART OF THIS PROJECT, ROUND ABOUT AND TURN LANES -- I'M NOT CONVINCED

[00:10:01]

THAT A ROUND ABOUT IS NECESSARY AT THIS INTERSECTION OR THAT THE GEOMETRY OF THE INTERSECTION IS A PROBLEM.

THIS IS ONE OF THE OLDEST INTERSECTIONS IN AUBURN AND I'M NOT SURE IT NEEDS FIXING. WE'VE BEEN DEALING WITH IT ABOUT 150 YEARS AND IF THERE'S A LOT OF TRAFFIC ACCIDENTS THERE I HAVEN'T SEEN THE DATA YET BUT I'M NOT AWARE OF IT BEING A REAL ISSUE, SO I MAY BE THE ONLY NO VOTE BUT I AM A NO VOTE.

>> THAT PROJECT ALSO INCLUDES PLEASE GROUT'S WORK ON IT.

>> DRAKE AND COLLEGE, THIS IS IN A BIRR ANNUAL BUDGET AND WAS ADOPTED AS PART OF THE CAPITAL IMPROVEMENT PLAN AND THERE WERE TWO SEPARATE PROJECT AND WE COMBINE IT INTO ONE SO IF WE WERE GOING TO MAKE A MESS OUT THERE JUST GOING TO DO IT AT THE

SAME TIME. >> ANY OTHER COMMENTS OR

QUESTIONS FROM THE COUNCIL. >> WELL, THAT INTERSECTION BOTH THOSE INTERSECTIONS HAVE BEEN PROBLEMATIC SINCE I'VE BEEN ON THE COUNCIL AND WHEN IT WAS PART OF WARD THREE I RECEIVED QUITE A BIT OF COMMUNICATIONS FROM INDIVIDUALS NOT ONLY THOSE WHO DRIVE VEHICLE AND ALSO THOSE WHO WALK THAT AREA, SO I THINK PAYING ATTENTION TO IT AND IMPROVING IT IS NECESSARY.

>> ANYONE ELSE? >> I ACTUALLY LIVE IN THAT AREA.

AND IT IS PROBLEMATIC. AND I'M GLAD THAT SOMEBODY DECIDED TO DO SOMETHING ABOUT GETTING IT WHERE IT NEEDS TO BE.

ACTUALLY THAT'S A TRAVELING ROUTE FOR ME, SO I WOULD LIKE TO SEE THE PROJECT, THE PLAN BE ADOPTED.

>> THANK YOU, PLEASE TAYLOR. BEFORE I SAT IN IN CHAIR I SAT WHERE MR. GRISWOLD WAS AND REPRESENTED THAT TOWARD AND I BELIEVE THE DANGER WITH COLLEGE AND DRAKE IS SIGNIFICANT.

THERE HAVE BEEN ACCIDENT THERE AND THERE CONTINUE TO BE ACCIDENTS THERE. THE ORIENTEERINGS OTHER INTERSECTION IS ABOUT WARD. I GO THROUGH THAT PROBABLY TWO, THREE TIME A DAY. PEOPLE ARE CONTINUOUSLY NOT SURE WHEN THEY'RE SUPPOSED TO GO AND PERTHS ARE THERE TEST AWKWARD.

I WOULD HAVE TO PRESUME THAT A ROUND ABOUT WOULD BE MORE PICTURE AND EFFECTIVE THAN THIS KIND OF COCKEYED INTERSECTION WE HAVE GOT GOING ON RIGHT NOW. SO I'M IN FAVOR OF THESE PROJECTS. ANYONE ELSE? GOT A MOTION AND SECOND, AIL IN FAVOR PLEASE SAY AYE.

ANY OPPOSED? MOTION CARRIES.

AND JUST TO BE -- LET THE CITIZENS KNOW THIS MONEY IS COMING FROM THE TRANSPORTATION PLAN, THIS IS MONEY THAT COMES INTEREST THE GAS TAX. THE CITY OF AUBURN RECEIVED $470,000, THE COST IS MUCH GREATER THAN THAT BUT --

>> ABOUT $2.6 MILLION PROJECT, POLLUTE ABSOLUTELY AND ALL THAT INFORMATION IS ONLINE IF YOU WOULD LIKE TO READ ABOUT THAT.

ALL RIGHT. IS THERE ANY OTHER -- ALL RIGHT.

DO O I HAVE A MOTION TO APPROVE THE BALANCE OF THE CONSENT

AGENDA? >> SO MOVED.

>> MOTION AND SECONDED. ILL YOU WILL IN FAVOR PLEASE SAY AYE. ANY OPPOSED?

[9.a. Annexations. Planning Commission recommendations.]

THE CONSENT AGENDA IS APPROVED. >> ITEM NINE A1 IS REQUEST TO ANNEX MILLION 1.79 ACRES OF PROPERTY AT 365 LEE ROAD 51 KNOWING AND INTELLIGENT AS CHAD WEB LANE.

THE PLANNING COMMISSION UNANIMOUSLY RECOMMENDED THE APPROVAL OF THIS REQUEST AT THE AUGUST 10 MEETING.

>> SECOND. >> THE MOTION AND SECOND, ANYONE ON THE COUNCIL HAVE A PROBLEM MOVING FORWARD WITH A VOTE ON THIS THIS EVENING? ALL RIGHT SEEING AND HEARING

NONE, LINDSEY. >> .

COMMENTS OR QUESTIONS, I APOLOGY FOR THAT.

DOES ANYBODY HAVE ANYTHING THEY WOULD LIKE TO --

>> I WOULD LIKE TO ASK THE STATUS OF THE WEST AUBURN DEVELOPMENT MASTER PLAN BECAUSE THIS IS CERTAINLY IN THAT AREA.

JUST LIKE TO SEE WHERE WE STAND ONLY IT.

>> THERE IS A DEVELOPMENT OF A WEST AUBURN MASTER PLAN, IT WAS A COMPREHENSIVE PLAN UPDATE THAT WE STILL OWE YOU THAT STAFF IS STILL WORKING ON. WE ARE WAITING ON THE COMPREHENSIVE PLAN MODEL TO BE COMPLETED.

MR. HOWARD AND THIS IS OUR INTERACTIVE GROWTH MODEL SO THEY CAN PROVIDE ALL THE DATA YOU'RE SEEKING.

>> AND WE'RE VERY CLOSE TO THE FINAL STAGES OF THAT SO I WOULD EXPECT WE WOULD HAVE THAT INFORMATION SHORTLY AND BE ABLE TO HOLD A JOINT SESSION WITH COUNCIL.

>> GOOD NEWS, THANK YOU VERY MUCH.

[9.b. Zoning. Planning Commission recommendations. Unanimous consent necessary. Public Hearings required. ]

>> YOU ALREADY VOTED ON IT. ITEM NINE B TWO IS REQUEST FROM

[00:15:04]

HERRING DEVELOPMENT LLC TO ANNEX APPROXIMATELY 85.7 ACRES OF PROPERTY EAST OF CREEK WOOD TRAIL TEMPERATURE PLANNING COMMISSION FAILED TO RECOMMEND APPROVAL OF THIS REQUEST BY A ROTE OF 3-4. THE ITEM WAS POSTPONED FROM A JULY 18 CITY COUNCIL MEETING, THEREFORE FIRST READING AS

ALREADY OCCURRED. >> MOVE FOR APPROVAL.

>> SECONDS. >> WE HAVE A MOTION AND A SECOND. SINCE THIS IS A SECOND READING WE GO RIGHT INTO DISCUSSION HERE MEGAN? OKAY. ANYBODY ON THE COUNCIL HAVE ANY

COMMENTS OR QWEST? >> I WOULD LIKE TO MOVE WE POSTPONE THIS UNTIL THE FIFTH OF SEPTEMBER, ACCORDING TO THE PACKAGE FOR THE PLANNING COMMISSION THIS IS A PORTION OF BRIDAL WOOD DRIVE WILL BE CONSTRUCTED AS THE SITE IS DEVELOPED I BELIEVE UNTIL SUCH TIME AS THE DEVELOPER AGREES TO THE ROAD CONSTRUCTION OR THAT A DEVELOPMENT AGREEMENT IS IN PLACE THAT WE DISCUSSED I BELIEVE A POSTPONEMENT IS

APPROPRIATE. >> SECOND.

>> WE HAVE A MOTION AND SECOND TO OTHER SPOKENST -- POSTPONE THIS UNTIL SEPTEMBER 5. ANY DISCUSSION ON THAT.

>> I WOULD I'D LIKE SAY THAT IN CONVERSATION WITH THE APPLICANT, THAT THEY ARE REQUESTING THAT WE MOVE AHEAD.

THERE IS ALREADY AN I PROVED PLAT FOR THIS SUBDIVISION THAT WAS APPROVED REGARDLESS IF IT WAS IN THE CITY OR THE COUNTY.

I THINK IT IS THE BENEFITS OF THIS CITY THAT THIS PARCEL COME IN TO AUBURN SO THAT WE HAVE MORE ABILITY TO DRIVE HOW THE DEVELOPMENT CONTINUES, AND I WOULD LIKE IF WE GET PAST THIS MOTION, I HAVE FURTHER COMMENTS. THANK YOU.

>> OKAY. ANY OTHER COMMENTS RELATED TO

THIS. >> I PLAN TO ABSTAIN ON THIS.

>> AND YES, MR. MAYOR I WOULD LIKE THE CLARIFY.

I'M NOT CONCERNED ABOUT THE ANNEXATION, I'M CONCERNED ABOUT US NOT HAVE THE DATA BEFORE WE MAKE THIS FINAL DECISION.

THAT'S ALL. >> ANYONE ELSE? OKAY. SO DO THIS BY ROLL CALL?

>> YOU DON'T HAVE TO. IT'S UP TO YOU, JUST NEED TO CLARIFY IF PEOPLE ARE ON BOTH SIDES WHAT THE COUNT IS SO IT'S

EASIER TO DO ROLL CALL. >> SO YES YOU'RE SUPPORTING THE

POSTPONEMENT, NO YOU'RE NOT. >> NOT SUPPORTING ANYONE TO ACT

ON THIS TONIGHT, THAT'S CORRECT. >> LINDSEY?

>> ALL RIGHT. SO WE'LL GO BACK NOW TO THE

ORIGINAL MOTION. >> A MOTION AND SECOND FOR

APPROVAL. >> MOTION AND SECOND ANY

DISCUSSION RELATED TO THAT? >> YES, THE APPLICANT IS HERE AND I DO HAVE A QUESTION OF THE APPLICANT IF THAT'S APPROPRIATE

AT THIS TIME. >> COUNT SKILL OTHER THAN FOR THE APPLICANT TO COME FORWARD, ANSWER QUESTIONS? , OKAY, REPRESENTATIVE FOR THE DEVELOPMENT.

>> WOULD YOU TURN AND -- >> MY NAME IS WILL HERRING.

>> ADDRESS WILL. >> 1712 CREEK WOOD TRAIL.

>> THANK YOU MR. HERRING: I WANT TO CONFIRM THAT SINCE YOU DO HAVE A PLANNED -- I MEAN AN APPROVED PLAT FOR THE SUBDIVISION THAT WE'RE LOOKING AT, THE PROPERTY TO ANNEX, THAT SHOULD THIS COUNCIL AN EX-THAT YOU STAND BY THAT MALT AND DECIDE TO -- AND YOU ARE DEFINITELY MOVING FORWARD WITH DEVELOPING THAT AS APPROVED BY THE PLANNING COMMISSION.

>> 100 PERCENT, YES, MA'AM. >> THANK YOU.

>> JUST FOR A POINT OF CLARIFIES THE PLAT IS APPROVED IF THIS IS ANNEXED INTO THE CITY. IT IS NOT CURRENTLY APPROVED

UNTIL AN ANNEXATION IS FINAL. >> OKAY, ANY FURTHER QUESTIONS

OR COMMENTS? >> COULD WE HAVE THE PLANNING DEPARTMENT ADDRESS WHAT HAPPENED AT THE PLANNING COMMISSION TO RESULT IN THE DISAPPROVAL, PLEASE.

>> THE RECOMMENDATION FOR DENIAL, ABSOLUTE, MR. HOWARD.

>> SO AT THE I GUESS JULY -- EITHER JUNE OR JULY PLANNING

COMMISSION, I APOLOGIZE. >> JULY 18, THERE YOU GO.

SORRY, 13TH. >> THAT THE MEETING A MOTION WAS MADE TO APPROVE. THERE WAS SOME DISCUSSION AMONGST THE PLANNING COMMISSION MEMBERS ABOUT THE OUTLYING PIECE TO THE NORTHWEST OF THE PROPERTY WHICH IS PROPOSEDDED TO REMAIN OUTSIDE OF THE CITY LIMITS WHILE THE REMAINDER OF THE PROPERTY IS PROPOSED TO COME GOO THE CITY LIMITS.

THERE WAS SOME DISCUSSION AND CON CANCER NATION ABOUT THAT AND

[00:20:01]

WANTING TO BRING THAT INTO THE CITY.

ULTIMATELY THE VOTE TO APPROVE IT FAILED ON THAT I GUESS THREE TO FOUR NUMBER THAT WAS MENTIONED EARLIER, AND THAT WAS THE PRIMARILY REASON, I BELIEVE, BASED ON THE CUSHION DISCUSSION FOR THE DOWN VOTE OF THOSE HO DID DOWN VOTE IT.

>> ALL RIGHT. THANK YOU.

SO THE CREATION OF THE COUNTY ISLAND WAS THE ISSUE?

>> YES, SIR. >> AND BASED ON THE LOCATION OF THE ISLAND I DON'T HAVE AN OBJECTION TO IT.

I THINK -- BECAUSE IT'S NOT UP AGAINST A MAJOR ROADWAY, IT'S WAY OFF ON THE SIDE. IT'S NOT GOING TO BE SURROUNDED BY COMMUNITIES WITHIN THE AUBURN CITY LIMITS SO I THINK THIS IS A VERY DIFFERENT STORY THAN OUR OTHER COUNTY ISLANDS WE HAVE DEBATED ABOUT NUMEROUS TIMES WITH BILLBOARDS AND WHAT NOT SO I HAVE NO OBJECTION TO THE CREATION TO HAVE COUNTY ISLAND.

>> I WOULD ALSO LIKE TO CLARIFY THAT I TOO AM AN COMFORTABLE WITH THIS ENCLAVE THAT IS BEING CREATED, SINCE THERE'S ALREADY

AN EXISTING ENCLAVE. >> ANY FURTHER COMMENT.

>> YES, MR. MAYOR. >> PLEASE.

>> PLANNING STAFF RECOMMENDED APPROVAL, CORRECT?

>> YES, SIR. >> ANY OTHER COMMENTS?

>> ALL RIGHT WE HAVE A MOTION AND SECOND.

SO LINDSEY WILL DO THE ROLL CALL.

YES IF YOU'RE FOR THIS ANNEXATION, NO IF YOU'RE NOT.

REPEAL AND REPLACEMENT OF ORDINANCE NUMBER 30:44 FOR THE THE TRAY MARY ANNEXATION DUE TO AN INCORRECT LEGAL DESCRIPTION.

THE REQUEST WAS FOR THE ANNEXATION OF APPROXIMATELY 4.0 ACRES OF PROPERTY. UNANIMOUS CONSENT IS NECESSARY.

>> I'LL INTRODUCE THE ORDINANCE AND ASK FOR UNANIMOUS CONSENT.

>> ANYONE HAVE A PRESIDENT BIDEN WITH MOVING FORWARD WITH THIS? SEEING NONE AND HEARING NONE ANY COMMENTS OR QUESTIONS.

>> THE ORDINANCE AS PUBLISHED HAD SWITCHED FROM PLANNING COMMISSION. THE CORRECTED AND CITY COUNCIL ENDED UP BEING TRANSFERRED INADVERTENTLY, THING WRONG LEGAL DRINKS SO THEREFORE WE NEED TO REDO IT SO WE DO RIGHT BY THIS

ANNEXATION. >> ANY OTHER COMMENTS, QUESTIONS? OKAY.

LINDSEY?

>> ITEM NINE B1 IS A REQUEST FROM DAVID SLOW COUPLE TO REZONE 55.2 ACRES OF PROPERTY ON EAST GLEN AVENUE FROM NEIGHBORHOOD CONSERVATION SIX TO CORRIDOR REDEVELOPMENT EAST.

THE PLANNING COMMISSION UNANIMOUSLY RECOMMEND AID PROVE OF THIS REQUEST. THE UNANIMOUS CONSENT IS NECESSARY AND A PUBLIC HEARING IS REQUIRED.

>> I WANTS TO INTRODUCE THE ORDINANCE AND ASK FOR UNANIMOUS

CONSENT. >> SECOND.

>> MOTION AND SECOND, ANYONE ON THE OWN COUNCIL HAVE PROBLEM WITH MOVING FORWARD? SEEING AND HEARING NONE WE'LL OPEN IT TO PUBLIC HEARING. SEEING N NO ONE WE'LL CLOSE THE PUBLIC HEARING. ANY COMMENTS OR QUESTIONS FROM

THE COUNCIL. >> I DO HAVE A COMMENT AND A COUPLE QUESTIONS MEGAN. OVER ALL I DO SUPPORT THE REDEVELOPMENT ON GLEN AVENUE. I HAVE SOME CONCERNS ABOUT THIS -- THIS ZONING. THE CORRIDOR REDEVELOPMENT DISTRICTSORING APPLYING TO THE PROPERTIES ALONG CHERRY STREET.

MY UNDERSTANDING IS THAT ZONING IS MEANT TO -- THAT CORRIDOR REDEVELOPMENT IS A REDEVELOPMENT OF GLEN.

IS THAT THE INTENT? >> DUE TO THE DEPTHS OF PARCEL TO A PARCEL ADJACENT THAT HAS BEEN REZONED, WHEN THE LINED WERE DRAWN IN LAND USE PLAN AND YOU CAN LOOK IN THE REZONING MAPS IN YOUR PACT MOST OF ITERANCES ONE PARTICLE DEEP BUT A LOT OF THEM ARE VERY LONG, AND THEY HAVE QUITE THE DEPTH TO THEM WHEREAS THE ONES ON CHERRY STREET GOT DEVELOPED AND SUBDIVIDED AND SO SOME -- YOU KNOW, YOU'VE GOT VERY FEW PARCELS OFF CHERRY THREE TO BE SPECIFIC FACE GLEN AND CHERRY STREET AND ONE JUST FACES GLOBE AND THE REST SIT FURTHER BACK,

[00:25:03]

SO THE ZONING LINES TEND TO BE DRAWN WHERE IT MAKES SENSE IT'S NOT A ZONING LAND USE DESIGNATION SO IT WAS RECOMMENDED DUE TO THE DEPTH OF THE ADJACENT MILES PER HOURS AND ALL OF THIS COULD BE CORRIDOR REDEVELOPMENT EAST BUT THE MAIN GOAL OF THE PLAN IF I'M UNDERSTANDING YOUR QUESTION CORRECTLY US FRONT FACING DIFFERENT THINGS ON GLEN AVENUE BESIDES SINGLE FAMILY DETACHED HOUSES.

IT'S A MAJOR ARTERIAL ROAD, SO YES.

>> LIKE I SAID, I I AM IN FAVOR OF THIS ARE YOU ZONING BUT IN THE FUTURE, IF WE HAVE OTHER REZONINGS THAT COME IN ON CHERRY STREET THAT ARE THESE LOTS THAT ARE JUST TODAYSING CHERRY STREET, NOT ON GLEN BEHIND IT, I SYMPATHY THAT WE SHOULD -- I THINK THE NATURE OF THOSE LOTS IS VERY DIFFERENT THAN THOSE THAT ARE FACING GLEN AND PROBABLY BE A LITTLE MORE RESIDENTIAL IN NATURE THAN COMMERCIAL.

BUT WHAT I DON'T WANT TO SEE HAPPEN IS I DON'T WANT TO SEE THIS AREA OF CHERRY STREET BECOME A LITTLE COMMERCIAL DISTRICT SEVEN TO BIRCH. SO THANK YOU.

>> YEAH, THANK YOU. >> ANYONE EL WITH A COMMENT OR

QUESTION? >> DO WE KNOW WHO OPEN IT IS PARCELS ON CHERRY STREET THAT ARE NORTH OF THE SUBJECT PROPERTY? AND A COMMON OWNER?

>> OLD ON, WE'RE CHEQUE. >> I BELIEVE THERE ARE A HANDFUL

OF SEVERAL DIFFERENT OWNERS. >> OKAY, THANK YOU.

>> MR. MAYOR, THIS PROPOSED ZONING CHANGE HAS ILLUSTRATED FOR ME JUST HOW IMPORTANT AND WHAT A BIG IMPACT THE 2030 PLAN MAKES. IT'S NOT JUST AN EXERCISE.

IT HAS A GREAT IMPACT ON THE WHOLE PROCESS, A I PLAN TO RESPECTFULLY DISAGREE WITH THE 2030 PLAN, AND VOTE NO TON REZONING TONIGHT. FOR TWO REASONS.

ONE, I WANT TO PRESERVE CHERRY STREET AS A QUIET NEIGHBORHOOD INGRESS AND EGRESS ACCESS ROAD TO THIS NEIGHBORHOOD.

AND ALSO I'M NOT SURE THAT THIS CORNER, WHAT THIS CORNER WOULD LIKE IF I VOTED YES, WOULD THERE BE A RESTAURANT THERE? WOULD THERE BE OTHER RETAIL THERE? I DON'T KNOW SO THE UNKNOWN OF THIS, AS IT AFFECTS THE NEIGHBORHOOD, AS IT AFFECTS THE YOU BE GUESS AND EGRESS TO THIS NEIGHBORHOOD ON CHERRY STREET CADSES ME CONCERN AND I HAVE TO DISAGREE WITH THE PLAN. AT LEAST AS FAR AS THE DEVELOPMENT ALONG CHERRY DISCREET TO INCLUDE THE LOTS

THAT ARE ON THE CORNER. >> OKAY.

THANK YOU. ANYONE ELSE?

>> I WOULD LIKE TO SAY I AGREE WITH WHAT TYLER SAID, I SAY THINK HE HIT THE NAIL ON THE HEAD AND I HAVE CONCERNS HE EXPRESSED ABOUT CHERRY STREET BUT I THINK IT'S GOOD TO GO.

>> THANK YOU CHIEF. ANYONE ELSE? OKAY. LINDSEY?

>>> ITEM NINE B TWO, ARE YOU ZONING 3.9 ACRES OF PROPERTY ON CORPORATE PARK WAY FROM COMPREHENSIVE DEVELOPMENT DISTRICT TO INTERSTATE COMMERCIAL DISTRICT.

THE PLANNING COMMISSION UNANIMOUSLY REQUESTED THIS AT THE JULY 13 MEETING. UNANIMOUS CONTINUE IS YESTERDAY NECESSARY AND A PUBLIC HEARING IS REQUIRED.

>> ASK UNANIMOUS CONSENT. >> I HAVE A MOTION AND 60, DOES ANYONE HAVE A PROBLEM VOTING ON THIS THIS EVENING? SEEING AND HEAR NONE WE'LL OPEN IT TO PUBLIC HEARING.

SEEING NO ONE WE'LL CLOSE THE PUBLIC HEARING.

ANY COMMENTS OR QUESTIONS FROM THE COUNCIL? OKAY. LINDSEY.

>> ROLL CALL VOTE.]. >> ITEM NINE C AUTHORIZES

[9.c. Traffic control signs and devices. Establish and set four (4) 25 MPH Speed Limit signs that will change the speed limit from 30 MPH to 25 MPH on Tuscany Hills Drive. Unanimous consent necessary. ]

LOWERING THE SPEED LIMIT ON TELL US CAN ANY HILLS DRIVE FROM 30 MILES PER HOUR TO TWIT MILES PER HOUR AS WELL AS THE INSTALLATION OF NEW SPEED LIMIT SIGNS.

UNANIMOUS CONSENT IS NECESSARY. >> INTRODUCE THE ORDINANCE AND

ASK FOR UNANIMOUS CONSENT. >> SENT.

>> HAVE A MIDCOAST AND MOTION AND SECOND, ANYONE HAVE A PROBLEM WITH MOVING FORWARD WITH THIS? SEEING NUB ANY QUESTIONS OR QUESTIONS.

[00:30:02]

>> I WOULD LIKE TO SAY THANK YOU TO THE STAFF FOR LOOKING INTO THIS AND A I DON'T THINK ANYONE IS GOING TO ARGUE WITH A LOWER SPEED LIMIT WITHIN A RESIDENTIAL NEIGHBORHOOD.

AND THEN THE MAP AND OUR PACKET DOES SHOW THAT ALL THE OFF SIDE STREETS ALSO 25 SO IT WILL BE CONSISTENT THROUGH THE WHOLE

NEIGHBORHOOD. >> MS. CROUCH WHAT ACTIONS TOOK

PLACE TO MAKE THIS HAPPEN? >> CITY ENGINEER FRAZIER WOULD

LOVE TO TELL YOU ABOUT THAT. >> WOULD SHE.

>> SHE WOULD, SHE'S BEEN CHOMPING AT THE BIT TO SPEAK

THIS EVENING. >> GOOD EVENING.

WE RECEIVED A REQUEST FROM THE HOA REGARDING THE SPEED LIMIT AND WHEN CAN YOU SAY AT ANY HILLS WAS DEVELOPED OUR OUR RESIDENTIAL STANDARDS FOR 30 MILES PER HOUR AND IT WARRANT

GOING TO 25. >> I WANT THE QUICKLY EXPLAIN WHAT WARRANTS THAT. SO A LOT OF TIMES YOU'RE HEARING FROM PEOPLE IN NEIGHBORHOODED AND MOST OF YOU REACHED OUT TO ME AND SAID PLEASE DO A STUDY ON BEHALF OF A CONSTITUENT AND LOT OF TIMES I REPORT TO YOU THAT WE CANNOT LOWER THE SPEED LIMIT.

SO ALISON PLEASE EXPLAINS WHAT HAPPENS.

BECAUSE IT'S RARE THAT WE LOWER THE SPEED LIMIT.

THE STUDY HAS TO SHOW THAT PEOPLE ARE GOING SLOWER NOT

FASTER. >> THAT'S CORRECT, SO WE PUT THE TUBES OUT REQUEST DO A COUNT FOR A CERTAIN WILLFUL BUT WE LOOK AT THE 85TH PERCENTILE SPEED WHICH MOON 85 PERCENT OR MORE, WHATEVER THAT NUMBER IS IF THE SPEED LIMIT IS POSTED AT 25 AND THE 85TH PERCENTILE SAY IT'S 30 IT MAY WARRANT RAISING THE SPEED LIMIT. SO 85TH PERCENTILE THE NUMBER WE USE WE LOOK AT WHEN MAKING ADJUSTMENTS TO SPEED LIMIT BECAUSE THAT TELLS THE PER VAILING SPEED OF MOST OF THE

TRAVELERS. >> IN THIS CASE THEY WERE

TRAVELING SLOWER THAN 30. >> YEAH.

>> VERY UNUSUAL BUT IT DOES HAPPEN AND THAT MEANS PEOPLE'S PERCEPTION, AND ALSO WE DO NOT ALLOW SPEED TRAP SOSES THE NOTION IS IF YOU LOWER THE SPEED LIMIT WHEN THE 80TH PERCENTILE IS DRIVING FASTER THAN THAT THAT IS A SPEED TRAP.

>> SO HOW LOW CAN YOU GO WITH A SPEED LIMIT?

>> IS THAT A SONG OR A QUESTION? >> THE CITY CODE STIPULATES OUR SPEED LIMITS AND 25 IS THE MINIMUM, HOWEVER, I SYMPATHY WE MAY HAVE ONE OR TWO STREETS THAT ARE 20 BUT THAT'S OUTLINE IN THE

THE CITY CODE. >> JUST A LITTLE INFORMATION

THIS EVENING. >> ANY FURTHER QUESTIONS? OKAY. LINDSEY?

>> .

MINUTE FOR YOU THIS EVENING. >> BEFORE WE GET STARTED WITH STIPES COMMUNICATIONS I WANT TO REMIND OUR PUBLIC TO USE DECORUM IN YOUR COMMENTS AND PLEASE DO NOT CALL THE NAMES OUT OF OUR STAFF OR US UP HERE. TALK TO US AS A GROUP.

IF YOU'VE GOT SOMETHING TO SAY SATE IT TO THE CITY COUNCIL, SAY IT TO ME, PLEASE REFRAIN FROM USING PEOPLE'S NAMES AND WE ASK THAT YOU GIVE US YOUR NAME AND ADDRESS FOR THE RECORD.

>> . >> MY NAME IS MARY MOORE.

I'M A RESIDENT AT 425 WEBSTER ROAD? AUBURN. AND ALSO JUST SO YOU KNOW I'M THE HIDDEN MOTHER THAT RON HID FOR MANY YEARS.

BUT HE PLAYED WITH MY SON WHEN HE CAME OVER.

>> I'LL CLAIM YOU MARY. >> I BRING THIS ISSUE BEFORE YOU TODAY BECAUSE AS WE'VE CAN YOU SAID MANY TIMES AT THE CITY HALL ABOUT THE AREA AT THE WEBSTER CROSSING MOBILE HOME COMMUNITY AND I'M ATENANT THERE. SO IS A OWN PROPERTY AT THE 913 SLOT. ONE ISSUE THAT I'M CONCERNED ABOUT AND I'VE SHARED WIT IT WITH A FEW PEOPLE, HOW WE DO THIS THING AND IT'S A WATER ISSUE THAT JUST RECENTLY CAME OUT WHERE THEY ARE ASKING TENANTS TO PAY ADDITIONAL -- THEY'RE TACKING ON ADDITIONAL MONEY TO THE WATER BILL AND MY CONCERN IS IF THIS IS -- IF WE'RE BEING SUPPLIED BY THE CITY OF AUBURN AND EACH PARK SHOULD BE IN COMPLIANCE WITH THE CITY RATES, RULES AND REGULATIONS, CAN THAT BE SO.

EVEN -- IT'S A PRIVATE OWNED PROPERTY.

WE HAVE HAD SITUATIONS WITH THEM, AND YOU KNOW, I DON'T KNOW WHERE IT'S DETERRED BECAUSE OF ONE PERSON'S PROBLEM THAT THEY DISOBEY THE RULES CAN REGULATION OF THE PARK.

BUT EACH TENANT IS BEING CHARGED FOR THAT DISOBEDIENCE, AND THAT'S JUST NOT RIGHT. AND I HAVE A REAL BIG PROBLEM WITH THAT. BUT MY THING IS TO CARRY IT BACK TO THEM, I WANT TO KNOW IF THE CITY OF AUBURN IS IN COMPLIANCE, I MEAN THAT THE PARK IS RESPONSIBILITY TO BE IN COMPLIANCE WITH THE RULES AND REGULATIONS AND THEY'RE RATES.

IF THEY RAISE THE RATES THEN I CAN UNDERSTAND THAT.

IF THE CITY RAISES THE RATE I UNDERSTAND THAT BUT CAN A PRIVATELY OPENED INDIVIDUAL DO THAT TO THE TENANT THIS IS THEIR PARK. THAT IS MY QUESTION AND I WAS

WHO WILL BE NEXT? >> GOOD EVENING, EVERYONE.

ANY MY NAME IS JEFF WALKER AND I'M HERE THIS EVENING TO BRING ATTENTION TO AN OUTSTANDING YOUNG LADY IN OUR CITY.

HERE IN AUBURN WE USE THE PHRASE SPIRIT IS THAT IS NOT AFRAID OFTEN, AND IN ALABAMA OUR STATE MOTTO IS ROUGHLY WE DARE DEFEND OUR RIGHTS. THIS 16-YEAR-OLD HAS EMBODIED BOTH OF THOSE TWO STATEMENTS IN THE FACE OF BIGOTRY AND OPPRESSION THAT NO YOUNG PERSON SHOULD ENDURE.

OVER THE LAST TWO YEARS THIS YOUNG LADY AS TRAVELED AID CROSS THE ESTIMATION TO BRING AWARENESS TO THE LGBTQ RIGHTS IN OUR COMMUNITYING SACK FACING HER SPRING BREAKS FOR THE OPPORTUNITY TO SIT DOWN AND PROVIDE REAL LIVED EXPERIENCES.

SHE'S BEEN TO WASHINGTON, D.C. SEVERAL TIMES MEETING WITH FEDERAL OFFICIALS. LAST YEAR SHE SAT DOWN WITH THE V., SECOND GENTLEMAN AND THE SECRETARY OF HEALTH.

MORE RECENTLY SHE'S BEEN INVITED TO SPEAK TO THE HOURS OF QUALITY CAUCUS WHICH IS THE LARGEST CAUCUS IN THE NATION, THE DEMOCRATIC CAUCUS IN JUNE AND SHE'S NOW THE YOUNGEST PROBLEM IN HISTORY TO TESTIFY IN PHOTOGRAPH THE SENATE JUDICIARY COMMITTEE. SHE WAS PERSONALLY INVITED BY SENATOR DURBIN AND SHE SAT BEFORE SOME OF THE HARDEST LEAD, IN OUR COUNTRY WITH POISE AND DISTINCTION TO DELIVER HER MAKE AN MESSAGE. AT THE END OF THAT TWO HOUR SESSION SENATOR DURBIN CALLED HER OUT FOR SITTING THROUGH THAT FOR SUCH A YOUNG AGE. SHE WAS VERY NERVOUS ABOUT INVITING HER BUT SHE APPLAUDED HER COURAGE.

ALL OF THIS TRAVELING AND SPEAKING MAINTAINING A HIGH GPA AT AUBURN HIGH SCHOOL, VERY ACTIVE IN MULTIPLE EXTRACURRICULAR 70 ACTIVITIES AND JUST TRYING TO BE A 16-YEAR-OLD WHICH IS HARD ENOUGH, AND THESE FEW MINUTES I CAN ONLY BRIEFLY TOUCH ON THE ACCOMPLISHMENTS OF MY DAUGHTER HARLEY WALKER BUT I ASK THAT YOU LOOK INTO THIS RISING CIVIL RIGHTS LEADER IN OUR COUNTRY AND THINK ABOUT SHOULD YOU RECOGNIZE HER SPIRIT THAT IS NOT AFRAID, THANK YOU.

>> THANK YOU. WHO WILL BE NEXT?

>> MARTHA SHARP 307 CAMILLE YA DRIVE.
