[7. CITY MANAGER’S COMMUNICATIONS.]
MINUTES TO SPEAK. THERE IS ONE ITEM THAT HAS A PUBLIC HEARING ATTACHED. IF YOU WOULD LIKE TO SPEAK ABOUT THAT, WE ASK THAT YOU WAIT UNTIL THAT TIME. >> PLEASE. DESPITE THE FIRST ITEM OF BUSINESS IS THE CONSENT AGENDA. DOES ANY MEMBER WISH TO REMOVE AN ITEM FROM THE CONSENT AGENDA AND DEAL WITH THAT ITEM SEPARATELY?
>> I WOULD LIKE TO REMOVE 8B3, PLEASE.
>> ANYONE ELSE? OKAY. WE WILL TAKE 8B3.
>> DID YOU MEAN 8C1? >> I'M SORRY. I MEANT 8C1.
>> NO OTHERS. >> OKAY. 8C1. A BILLBOARD REMOVAL AGREEMENT FOR LIFE STORAGE FOR PROPERTY LOCATED AT 2020 SOUTH COLLEGE STREET THAT IS THE SUBJECT OF AN ANNEXATION REQUEST LATER ON THE AGENDA UNDER ITEM 9A.
>> I MOVE TO APPROVE. >> SECOND.
>> MR. GRISWOLD. >> THERE'S OFTEN A LOT OF CONCERN ABOUT BILLBOARDS WITHIN CITY LIMITS. THIS IS AN AGREEMENT THAT IS GOING TO ALLOW AN EXISTING BILLBOARD TO REMAIN FOR ANOTHER THREE YEARS. BELIEVE ME. IT'S NOT BECAUSE WE DON'T WANT BILLBOARDS REMOVED. WE ARE OVER A BARREL BECAUSE IT IS IN PLACE FOR THIS. I DON'T WANT ANYONE TO THINK THAT WE ARE GOING OUT AND APPROVING BILLBOARDS THROUGHOUT THE CITY FOR ANY REASON. ABSOLUTELY THE OPPOSITE OF THAT. THIS IS A MECHANISM TO GET RID OF A BILLBOARD AND WE WILL DO SUIT -- SO, AS SOON AS THAT CAN BE DONE.
>> ANY FURTHER COMMENT? >> WE HAVE A MOTION AT A SECOND.
ALL IN FAVOR, PLEASE SAY AYE. COUNCILMAN MOREMAN
>> THE MOTION CARRIES. >> IS THERE A MOTION TO APPROVE
THE CONSENT AGENDA? >> SECOND.
[9.a. Extra Space Management Annexation. 4.4 acres. Property located at 2020 South College Street. ]
>> ALL IN FAVOR, PLEASE SAY AYE. COUNCILMAN MOREMAN
>> THE CONSENT AGENDA IS APPROVED.
[00:15:04]
>> THE PLANNING COMMISSION UNANIMOUSLY RECOMMENDED APPROVAL OF THIS REQUEST IN ITS JANUARY 9TH MEETING INCLUDING A CONDITION THAT THE LEASE OF THE BILLBOARD ON-SITE SHALL NOT BE RENEWED AFTER THE CURRENT LICENSE EXPIRES AND THE CONDITION SHOULD BE MADE AND SIGNED BY THE CITY OF AUBURN PRIOR TO AUTHORIZATION. UNANIMOUS CONSENT IS NECESSARY.
>> DOES ANYONE HAVE A PROBLEM WITH VOTING ON THIS THIS EVENING? ANY COMES OR CUSHIONS FROM COUNCIL? YES?
>> THIS IS THE SAME ITEM THAT MR. GRISWOLD JUST RAISED THE ISSUE ABOUT THE BILLBOARD. IN THIS CASE, WE WILL BE LOOKING AT
ANNEXATION OF THIS 4.4 ACRES. >> CORRECT.
>> AND WHAT WE WILL DO WE -- AND I WOULD LIKE TO MAKE IT CLEAR FOR EVERYBODY TONIGHT, WE ARE NOT VOTING ON ZONING.
>> NO. >> WE ARE NOT CHANGING THE ZONING. THE REASON FOR THAT IS BECAUSE IT IS FULLY BUILT. IT IS WHAT IT IS, I GUESS. THE APPROPRIATE WORDS MIGHT ESCAPE ME. I GUESS IT IS NOT CONDITIONAL USE OR IT IS?
>> IT IS NONCONFORMING USE. IT IS NONCONFORMING, WHICH JUST MEANS, YOU KNOW, DIDN'T MEET THE ZONING RECURRENCE BECAUSE IT
IS NOT IN THE CITY LIMITS. >> IT IS FULLY BUILT. I DROVE BY THERE TODAY. IT TAKES UP THE WHOLE 4.4. UNLESS THEY GO UP, I GUESS. IT COULD BE EXPANDED UPON.
>> IT COULD NOT BE EXPANDED UPON UNLESS THE DIRECTOR TELLS ME OTHERWISE. THEY HAVE TO STATE WITHIN THE CONFINES OF WHICH IT IS DESIGNED NOW AND ULTIMATELY. THEY HAD TO SEEK A REZONING TO
DO SO. >> IT IS VERTICAL AND HORIZONTAL AS WELL. IF THEY WANTED TO ADD A SINGLE UNIT, THEY COULDN'T DO IT. THAT IS AFTER CONDITIONAL APPROVAL FROM THE BOARD.
INAUDIBLE ] THERE IS NO INCENTIVE TO IF THEY'RE JUST GOING TO MAINTAIN THE BUSINESS AS IS. THEY CAN DO THAT WITHOUT EXPENDING THAT NONCONFORMING. IT IS STILL WITHIN THE NONCONFORMING PART OF THE ORDINANCE. DESPITE THAT HAPPENS WHEN WE DO CITYWIDE ZONING CHANGES. PEOPLE CAN END UP IN NONCONFORMING. IT IS NOT UNUSUAL. THE ACTUAL ZONE THAT THEY COULD ULTIMATELY GO INTO ALLOWS A LOT MORE OF THE BEST USE THAN EUROZONE DOES, AND IT IS FAR MORE RESTRICTIVE THAN STAYING IN THE RURAL ZONE. IT IS TOTALLY FINE. IT IS NOT AFFECTING ANYTHING. I DIDN'T SEE RECOGNITION FROM STAFF THAT
HE NEEDED TO CHANGE. >> THANK YOU VERY MUCH.
>> ANY OTHER QUESTIONS OR COMMENTS?
>> DO WE KNOW WHY THEY WANT TO BRING THEIR PROPERTY INTO THE
CITY? >> SO, IT WAS A PART OF AN AGREEMENT I GUESS, WHEN THEY FIRST CAME TO THE CITY AND THEY WANTED TO BUILD, IT WAS PART OF THE AGREEMENT FOR THEM TO GET WATER. AS PART OF THE RESOLUTION. AND THEY MADE A PETITION TO ANNEX AFTER THEY GOT THEIR C.O. SIX MONTHS AGO.
>> ERIC, DO YOU WANT TO SPEAK TO THAT FROM A WATER PERSPECTIVE?
>> SURE. THEY NEED WATER AND AS A CONDITION TO GETTING WATER, THEY HAD A PETITION TO ANNEX WITHIN THREE MONTHS OF RETAINING SERVICE. THAT WAS THE DRIVER FOR THAT.
>> THE BIG WIN FOR THE CITY AS WE HAVE LONG COVETED PROPERTY ON SOUTH COLLEGE TO TO BE WITHIN CITY LIMITS SEE YOU CAN EXERT SOME ZONING CONTROL OVER IT. THESE FOLKS HAVE WORKED WITH US FROM DAY ONE OF MANY YEARS AGO, THE COUNCIL TRIED TO GET ALL COUNTY ISLANDS ON IT.
DONE AT THE TIME. EVERY PIECE ON SOUTH COLLEGE HAS BEEN ENCOURAGED FROM THE ZONING AUTHORITY STANDPOINT. IT DOES HELP WITH WATER AND OTHER THINGS.
>> IT HAS BEEN IN THE COUNTY. >> FOR CLARIFICATION WITH EVERYBODY, THE CITY HAS NO REGULATIONS THAT DON'T ALLOW BILLBOARDS. WE REGULATE THE SIZE OF SCIENCE. THE SUPREME COURT HAS BEEN CLEAR ON THAT. THE CITY OF AUBURN DOES NOT ALLOW SIGNS OVER A CERTAIN SIZE. AT -- IN THIS CASE, IT IS TOO BIG TO MEET OUR RELATIONS SO IT NEEDS TO GO.
>> FOR CLARIFICATION, MEGAN, WHEN THE LEASE IS UP, WE'LL HAVE A SEPARATE AGREEMENT. WHEN THE LEASE IS UP IN A FEW YEARS, THE SIGN WILL COME DOWN AT THAT POINT?
>> THAT IS CORRECT, MR. COBLENTZ .
>> THAT WAS SPOKEN TO EARLIER IN THE CONSENT AGENDA TRADE
[00:20:01]
>> OKAY. >> LET'S HAVE THE ROLLCALL.

>> I HAVE A MOTION IT IS AGAIN. I WILL OPEN THE HEARING. PLEASE GIVE YOUR NAME AND ADDRESS FOR THE RECORD. YOU WILL HAVE FIVE MINUTES TO SPEAK TO THE COUNCIL.
I WILL CLOSE THE PUBLIC HEARING. ANY COMES OR QUESTIONS FOR THE COUNCIL? MOTION AT A SECOND. PLEASE SAY AYE. THE MOTION
[10.b. 2025 Improvements Reimbursements. Reimbursement of certain expenditures prior to tax-exempt financing for school projects. ]
CARRIES. >> 10B MAKES IT POSSIBLE FOR CITY OF AUBURN TO ACQUIRE AND INSTALL AND EQUIP CAPITAL IMPROVEMENTS FOR THE CITY PRIOR TO THE ISSUANCE OF ONE OR MORE TAX-EXEMPT BONDS OR GENERAL OBLIGATION WARRANTS WITH A PRINCIPAL AMOUNT NOT TO BE IN EXCESS OF APPROXIMATELY $28.5 MILLION FOR THE SECOND HIGH SCHOOL PROJECT.
>> MOVED FOR APPROVAL. >> SECOND.
>> WE HAVE A MOTION IT IS AGAIN. ANY COMMENTS OR QUESTIONS FOR
>> FOR THE PROJECT? >> 25. WOULD IT BE REIMBURSED ?
>> CURRENT EXPENDITURES NOW, WE WOULD REIMBURSE THEM LATER.
>> THE DEBT SERVICE WILL BE PAID THROUGH THE CITY SCHOOLS.
>> SO THE CITY, WE ARE NOT PAYING $28.5 MILLION. THIS IS ALL BEING PAID BY THE SCHOOL DISTRICT.
>> ALL OF THIS THAT WILL BE FUNDED, FROM THE 16TH MAIL. WE ISSUED THE DEBT, BUT THE DEBT WOULD PAY FOR THE 16 NO.
>> IT IS BEING PAID FOR WITH FUNDS FROM THE SCHOOL DISTRICT
-- THAT THEY ARE TO GET. >> THAT 16 MILL TAX IN ESSENCE.
>> IT IS PROPERTY TAXES THAT ARE RESERVED FOR THEM. THEY ARE USED
TO PAY FOR IT. >> ANY OTHER QUESTIONS? OKAY.
ALL IN FAVOR, PLEASE SAY AYE . >> ALL OPPOSED?
